Development of Checklists for MPO and State DOT (FAST Act Compliance)

FAST Act Requirements Under 23 CFR 450.324(h)

(h)(1) The MPO(s), State(s), and the providers of public transportation shall jointly agree upon and develop specific written provisions for cooperatively developing and sharing information related to transportation performance data, the selection of performance targets, the reporting of performance targets, the reporting of performance to be used in tracking progress toward attainment of critical outcomes for the region of the MPO, and the collection of data for the State asset management plan for the NHS.

Documented as part of: 1) the MPO planning agreements, or 2) in some other means outside of the MPO agreements as

determined cooperatively by the MPO(s), State(s), and providers of public transportation.

Includes:- Roles & Responsibilities- Target Setting- Tracking and Reporting- Monitoring of Trends

Agencies involved include: - State DOT/TxDOT- MPO, and - Regional Transit

Operator

Three Options for Consideration(Draft Joint Letter to MPO Directors)

Scenario 1 (without an agreement): Utilize the MOU template to develop and adopt a MOU between the MPO, TxDOT, and Public Transit Operators addressing the metropolitan and performance-based planning- or in some other form determined cooperatively.

Scenario 2 (with an existing agreement): for areas with existing MOU agreement, simply amend it with the performance-based planning language (as shown within the MOU template)- or in some other form determined cooperatively.

Scenario 3 (without a tri-party agreement): for areas that do not have a fully executed agreement with all three parties, need to adopt an agreement that includes the metropolitan and performance-based planning requirements (as shown within the MOU template)- or in some other form determined cooperatively.

Next Steps Have Written Correspondence: draft letter to be developed and sent to all

MPO directors to ensure timely action and clearly communicate potential consequences of inaction.

Identify Deadline: rapidly approaching for meeting FAST Act metropolitan and statewide planning requirements (by May 27, 2018), including having the agreements in-place.

Start Early and Communicate Often: coordinate with all agencies involved in the process.

Developed a Checklist: to ensure consistency across all MPOs.

Provided Written Examples: provide examples of MOU templates.
