Declaration by the Presidency on behalf of the European Unionconcerning the elections in Zanzibar, Tanzania
Brussels, 3 November 2000
The European Union welcomes the joint communiqué issued by the international delegations ofobservers on 31 October to the effect that the elections held in mainland Tanzania on 29 Octoberwere on the whole peaceful, free and representative of public opinion.
However, the European Union expresses deep concern at the situation in Zanzibar, following theelections held there on the same day. It is clear from the statements by the teams of internationaland local observers in Zanzibar that the organisation of these elections was grossly inadequate.The holding of fresh elections in only 16 constituencies ignores the scale of the problem. Nor doesthe involvement of Zanzibar's electoral commission as currently constituted offer the possibility ofholding credible elections. The European Union strongly advises the Government of theUnited Republic of Tanzania to find a solution acceptable to all parties in Zanzibar.
The European Union condemns the excessive use of force by the security forces against civilians inZanzibar. It calls on all concerned, including the security forces, to show restraint and refrain fromany further violence or provocation. It stresses the responsibility of the Government of theUnited Republic of Tanzania for guaranteeing the political and human rights of all the people ofTanzania, including those in Zanzibar.
The Central and Eastern European countries associated with the European Union, the associatedcountries Cyprus, Malta and Turkey, and the EFTA countries Iceland, Liechtenstein and Norway,members of the European Economic Area align themselves with this declaration.

The European Union welcomes the release on 1 November of Mrs Flora Brovina, a symbolic figurefor human rights activists, a paediatrician and poet, wrongfully imprisoned by the Milosevic regime.
The European Union commends on this occasion the pardon granted by President Kostunica.

on the admission of the FRY to the United NationsBrussels, 3 November 2000
The European Union very much welcomes the United Nations General Assembly's adoption ofResolution 55/12, admitting the FRY to the United Nations.
Admission confirms the FRY's full compliance with the principles and values embodied in theUnited Nations Charter. It illustrates the determination of President Kostunica and the Yugoslavpeople to break with the dead-end policy conducted by the Milosevic regime. It testifies to theunanimous support of the international community.
The admission of the FRY to the United Nations marks a vital stage in the full reintegration of theFRY into the international community and an important step towards reconciliation, stability andpeace in the region.
The European Union, which has been resolutely involved in the FRY's admission to theUnited Nations, addresses its warmest congratulations to President Kostunica and the Yugoslavpeople on this occasion. It is pleased that it can now work closely with the FRY in theUnited Nations on all subjects of common interest.

Declaration by the Presidency on behalf of the European Unionconcerning Sri Lanka
Brussels, 9 November 2000
The European Union stresses the importance of the meeting held on 1 November 2000 betweenMr Eric Solheim and Mr Velupillai Prabhakaran, leader of the LTTE, the first such meeting sinceNorway took on the role of "facilitator" in the dialogue between the Sri Lankan Government and theLTTE in February 2000. In this connection, the European Union reiterates its support for theNorwegian initiative.
The European Union would urge the Sri Lankan Government and the LTTE to take the opportunityoffered today of a dialogue which could bring about a negotiated solution and put an end to anethnic conflict which has been the cause of much suffering for the Sri Lankan people for nearlytwenty years.
The European Union is strongly in favour of these negotiations, which must take substantialaccount of the aspirations of the Tamil minority while respecting the cultural and religious diversityof Sri Lanka and not undermining the inalienable principle of the territorial integrity and unity ofthe country.
The Central and Eastern European countries associated with the European Union, the associatedcountries Cyprus, Malta and Turkey, Iceland and Liechtenstein, members of the EuropeanEconomic Area, align themselves with this declaration.

Declaration by the Presidency on behalf of the European Unionconcerning Mozambique
Brussels, 21 November 2000
The European Union condemns the use of violence as a means to achieve political ends andstrongly deplores the excesses which accompanied the demonstrations in the centre and north ofMozambique on 9 November 2000. It is seriously concerned at the loss of life which occurred. Itcalls on all involved to respect the law and show restraint.
In recent years Mozambique has shown that it is capable of a sustained commitment to nationalreconciliation and multi-party democracy. We would exhort the leaders of all political parties,especially the two main ones, as well as the public authorities and civil society to engage inconstructive dialogue, which is the only way of continuing, in an atmosphere of peace and stability,the laudable efforts which have been made towards sustainable development, with the support ofthe international community and in particular the European Union and its Member States.

The European Union is ready to support the process of political and socio-economic transition,which until now has been internationally hailed as a success and has enabled the country to play animportant role in the quest for peace throughout the region. Declaration by the Presidency on behalf of the European Unionconcerning the United Nations Mission in Ethiopia and Eritrea (UNMEE)
Brussels, 17 November 2000
The European Union warmly welcomes the implementation of the decision of the UN SecurityCouncil (Resolutions 1312 of 31 July and 1320 of 15 September 2000) to establish theUnited Nations Mission in Ethiopia and Eritrea (UNMEE).
The European Union considers that the decision of a number of Member States to participate in theUnited Nations Mission in Ethiopia and Eritrea (UNMEE) is an expression of the wish frequentlyexpressed by the EU, notably in its Common Position of 29 June 2000, to facilitate any progressthat can be made towards a peace settlement between Ethiopia and Eritrea.
The European Union calls on both Ethiopia and Eritrea to ensure the safety of all UN personnel andto cooperate fully with the UN Mission.
The European Union urges both parties to continue and intensify the peace process under the aegisof the OAU, supported by the EU and the US, in order to reach a comprehensive and sustainablepeace settlement as soon as possible.

Declaration by the European Union on the Middle EastBrussels, 20 November 2000
For weeks now lives have been lost on a daily basis, both Palestinian and Israeli. This is anintolerable situation. The European Union appeals to both sides' sense of responsibility not torespond to provocation.
The lack of progress in the Peace Process, including on the settlements issue, is the source of thePalestinian community's frustration and the violence.
The European Union urges Israeli and Palestinian leaders to comply fully, and without delay, withthe undertakings entered into at Sharm el Sheikh five weeks ago and in Gaza on 2 November.
It calls on the Israeli authorities:
- to pull back their armed forces to the positions they occupied before 28 September and toend restrictions on the movement of goods and persons in the Palestinian territories;
- to lift the financial sanctions imposed on the Palestinian Authority;
- if action by the security forces appears unavoidable, to use non-lethal means only, as calledfor by the United Nations Secretary-General.
It calls on the Palestinian Authority:
- to make every endeavour to bring the violence to an end;
- to issue strict instructions to the security forces to stop shooting at Israelis, in accordancewith the statement made by President Arafat.
The European Union calls on the Fact-Finding Commission, set up following theSharm el Sheikh Summit and in which the European Union is represented by Mr Javier Solana,Secretary-General/High Representative for the CFSP, to commence its work on the ground withoutdelay.

It supports the moves by the United Nations Secretary-General to examine with the partiesarrangements for an observer mission in accordance with the Security Council's mandate.It continues to support the endeavours and personal commitment of President Clinton in the searchfor peace.
The goal naturally remains a resumption of the dialogue and the peace talks, as this is the only wayout of the current crisis. The protagonists are well aware of this. Putting a stop to the violence is amatter of vital urgency.
The European Union is willing to make a contribution. It is ready to assume its responsibilities.

179/2000Declaration by the Presidency on behalf of the European Union
on IndonesiaBrussels, 28 November 2000
The European Union remains deeply concerned by the climate of tension and violence whichcontinues to reign in a number of Indonesian provinces, particularly in Aceh, the Moluccas andIrian Jaya.
The European Union has spoken out on a number of occasions in favour of a strong, united,democratic Indonesia. The Union fully supports the country's territorial integrity. It encourages theIndonesian authorities' efforts to find a solution to regional disputes through dialogue rather than byforce.
In the case of Aceh, in May this year the European Union welcomed the agreement on ahumanitarian truce signed in Geneva between the Indonesian authorities and the Free AcehMovement (GAM). It also welcomed the start of the legal process to bring to justice the allegedperpetrators of human rights abuses in the province.

These criminal acts are a reminder to the international community that extremist forces, bent uponpreventing coexistence between communities, are determined to continue their activities against theKosovo Serbs in spite of Resolution 1244, the results of the municipal elections on 28 October inKosovo and the democratic change that has occurred in the FRY since the elections on24 September.
We call on all the Kosovar leaders to condemn such acts unreservedly.

Declaration by the European Union on the presidential and senatorial electionsin Haiti
Brussels, 1 December 2000
The European Union takes note of the announcement by the Provisional Electoral Council of theelection of Mr Jean-Bertrand Aristide in the presidential poll held in Haiti on 26 November 2000.
It deplores the fact that the presidential and senatorial elections on 26 November 2000 werepreceded by a wave of violence, including a series of explosions which claimed many victims,killing two children in particular.
The Union regrets that the efforts of the Organisation of American States (OAS) did not lead to anagreement, particularly on two vital issues:
� setting up an independent Provisional Electoral Council, representative of the range ofopinion in the country;
� addressing and resolving the disputes arising from the contested elections held on21 May 2000.

The opposition refused under these circumstances to present any candidates, and no internationalobserver mission could be organised.
The European Union stresses the need to respect human rights and democratic pluralism. It urgesthe resumption of dialogue amongst all sections of Haitian society.
The European Union points out that, following the refusal of the Haitian authorities to take accountof the OAS's findings on the elections of 21 May 2000, it initiated the consultation procedureprovided for in Article 96 of the Cotonou Agreement in order to seek measures to remedy thesituation, but it does not rule out the possibility of readjusting its cooperation with Haiti if noacceptable solution were to be found.

The European Union is pleased that the lawful constitution of Guinea-Bissau has been upheld,despite the attempt at destabilisation on 20 November 2000 and the clashes which have cast ashadow over the country.
Its full support goes to the legitimate authorities in their efforts to bring about nationalreconciliation and consolidate democracy. In this connection, the European Union will beparticularly alert to action to further human rights and civil liberties, with due regard for political,cultural and religious diversity.
It is concerned that the programme of demobilisation and restructuring of the armed forces shouldbe brought to a successful conclusion.
It urges the authorities to abide closely by the principle of good governance, which it regards asparticularly important.
On this basis, the European Union wishes to reaffirm its readiness to assist Guinea-Bissau in itsnational reconstruction effort. It calls on the international community to join in the task.

The European Union deplores the restrictions imposed on voters' freedom of choice by theCôte d'Ivoire Supreme Court's decision of 1 December 2000 barring Mr Alassane Ouattara,President of the RDR, from standing in the parliamentary elections on 10 December. It considersthat this decision mars preparations for those elections, as it could lead to the absence of asignificant portion of Côte d'Ivoire's electorate from the electoral process.
The European Union strongly urges the Côte d'Ivoire authorities to do everything possible tore-establish national cohesion and take account of the balance of all the country's political forces. Itcalls on the authorities and on all political forces to act responsibly and ban all forms of violence. Itconsiders it desirable to seek a political solution to the current crisis, so that democracy can be fullyrestored in an atmosphere of calm.
The European Union, recalling the terms of the consultations on the EU-ACP Convention in thefirst half of 2000, will assess its support for Côte d'Ivoire at the end of the whole process of returnto constitutional legality, depending how it unfolds.

The European Union welcomes the recent decision by the Indian authorities to declare a unilateralceasefire in Kashmir throughout Ramadhan. The Union is likewise pleased to note Pakistan'sstatement that it would exercise "maximum restraint" along the line of control.
Such encouraging moves will make for a calmer atmosphere conducive to efforts to find a peacefulsolution, in accordance with the wishes of the Kashmiri population concerned.
The European Union remains convinced that, if such a peaceful solution, being the only kindconceivable, is to be achieved, a stop must be put to terrorist acts, the line of control must be strictlyobserved and confidence-building and security measures must be implemented, in order fordialogue between the parties concerned to resume, in keeping with the Lahore spirit.
The European Union therefore calls upon all parties to show the utmost moderation on the ground,honour their undertakings, consider fresh confidence-building measures and resolutely, actingentirely in good faith, engage in sincere, constructive dialogue.

The Opinion endorses the guidelines proposed by theCommission in its Communication concerning the recognition of diplomas. The Opinionparticularly approves of the measures proposed to ensure the credible monitoring of the applicationof the principle of mutual recognition: evaluation reports, compliance with obligations arising fromthe proper application of Community law, notification procedures, and improving information andeconomic analysis. The Opinion supports the establishment of a European frame of referencewithout the force of law but possibly in the form of a recommendation. The non-regulatedprofessions may adhere to a set of common rules of education, professional standards and ethicalcodes, so as to distinguish their qualifications in a voluntary but recognisable way.

Rather than merely "approximating" legislation, the main objective of any futurerevision of Directive 93/13/EC - which is hopefully not far away - must be to truly harmonise and,especially in fundamental areas such as the very concept of "unfair term" or the drawing up of a"black list" of terms, standardise national legislation in this field.
An essential aspect of such a revision will be to redefine the Directive's field ofapplication so that it also includes contracts between professionals which contain major contractualimbalances and inequalities, particularly when standard or predetermined contracts are used.
Current exclusions should be removed so that the Directive can also apply tocontractual terms negotiated individually, general terms and conditions arising from "mandatory"provisions and contractual stipulations relating to the price or the subject matter of the contract,providing that these terms meet the requirements to be classified as unfair.

The Opinion is a framework for the constantly updated Single Market Observatory(SMO) database on Best Practice in the Single Market. It establishes that the Single Market hasgenerated a proliferation of initiatives - growing in number and variety - and continues to list theorigins of these initiatives, which are to be found at EU, national and sub-national level. It then liststhe positive effects of these as well as some of the persistent obstacles.
Since the main purpose of the PRISM-exercise is to establish criteria for "bestpractice", remove obstacles hampering this and make the best initiatives known, the Opinion setsout a number of recommendations addressed to the European Institutions, the Member States,regions and socio-economic organisations.

The Committee views further liberalisation as a very complex process subject at eachstep to the law of unintended consequences. Departure from the present position should beundertaken with great care. The Committee stresses that the functioning of the universal service is apriority and underlines the need to ensure that liberalisation does not happen too suddenly, thusupsetting the financial balance of the universal service provider, and undermining the interests ofthe community.
The Committee is well aware that differences in the geographical and populationdensity of Member States and other regions mean that the economics of the universal service will be

constrained in different ways in each Member State. The Committee believes that liberalisationmust be gradual and controlled. The ESC recognises that liberalisation of postal services should proceed cautiouslyand that the long-term goal should be a Single Market in postal services taking into considerationthe following aspects: the maintenance, the integrity and continuing development of the universalservice, the employment considerations and the resolution of the "co-lateral" social issues attachedto historic presence of post offices and postal workers in rural and sparsely populated areas.

− Youth Employment and Social Integration. The Committee believes that Member States,with the support of the Community, should make a quantitative commitment to reducingyouth unemployment.
− Education and Mobility. The Committee believes that lifelong learning measures must beexpanded to ensure that they are available from a young age, that there are improvedopportunities, and that the value of non-formal education is recognised as an important aspectof lifelong learning. These should include measures to promote learning for active Europeancitizenship.
− Participation and Civil Society. The Committee reaffirms the basic principle of youthparticipation in the development, implementation and evaluation of youth policy. It believesthat representative structures of young people and youth organisations are a key constituent ofyouth policy and a unique instrument for fostering youth participation at all levels.
