72/03Declaration by the Presidency on behalf of the European Union

concerning the presidential election in Togo

Brussels, 3 July 2003

The European Union notes the proclamation by the Constitutional Court of Togo of the official result of theelections on 1 June according to which Mr Gnassingbe Eyadema was elected President of the TogoleseRepublic. The European Union recalls its declaration of 12 February, in which it urged the Togoleseauthorities to ensure that the elections were held in a free and transparent manner so as to promote thedemocratic process in Togo, in accordance with the spirit of the 1999 Lomé Framework Agreementaccording to which, inter alias, President Eyadema would not stand for a third term of office.

The European Union expresses its serious concern about the incidents occurring before, during and since theelection, and especially:

the restrictions imposed on the opposition in the form of disqualifications, harassment and detentions;the obstacles to freedom of expression;the refusal of access for certain people to electoral rolls;

� the incidents involving the withdrawal of voting cards and the closure of polling stations, whichprevented many Togolese from casting their vote;

the difficulties for local electoral commissions in collecting and transmitting results;the violent confrontations in Tsévié, and the detention of members of the opposition following the election.

The European Union calls on the Togolese political forces to act responsibly and to uphold the law and civilpeace in Togo.

The European Union regards the situation following the presidential election in Togo with concern. It callson the Government to commit itself to an effective inter-Togolese political dialogue. Following theannouncement made by the Togolese President, the European Union will keep a careful watch on theimplementation by the Togolese authorities of a genuine policy of openness towards the entire opposition inorder to take account of the criteria of good governance demanded by the European Union, the AfricanUnion and NEPAD.

on violations of the Somalia cease-fire agreement

Brussels, 23 June 2003

The EU, which has financially and politically supported with determination the Somali Peace Process, isencouraged by the progress made at the Mbagathi reconciliation conference and acknowledges that it hasreached the crucial stage of adopting a new transitional charter and electing a new transitional assembly andgovernment.

The EU expresses deep recognition for the important role played by the special envoy B. Kiplagat and theGovernment of Kenya, which has hosted and politically promoted the peace negotiations in Nairobi.

The EU reaffirms its support for the IGAD-sponsored peace process and urges all political and militaryleaders as well as traditional and religious authorities and civil society representatives to redouble theirefforts with a view to achieving fair and balanced compromise solutions to the outstanding issues, and toreach a comprehensive peace agreement during this final stage of the conference.

The EU calls upon the political and military leaders still in Somalia to join those at Mbagathi without anyfurther delay.

The EU strongly condemns the repeated violations of the cessation of hostilities declaration of 27th ofOctober 2002, in particular the recent fighting in middle Shebelle and Mogadishu, and calls for an immediateand lasting cessation of hostilities. The EU reiterates its willingness to consider appropriate measures,including smart sanctions, against individuals and groups undermining the peace process. The EU notes thecontents of the recent report of the UN panel of experts and calls upon all countries to strictly abide by theUN arms embargo on Somalia.

The EU invites the ministers of the IGAD frontline states to honour their commitment to a strongerinvolvement in overseeing and supporting the reconciliation conference.

The EU notes with appreciation the report of the African Union and IGAD fact-finding mission to Somalia,exploring the feasibility of deploying cease-fire observers and assessing the conditions for demobilisation.The EU is looking forward to discussing with the AU, IGAD, other interested parties and especially with theUnited Nations, detailed proposals for cease-fire monitoring, demobilisation and reintegration of formercombatants.

The EU, in accordance with the principles and guidelines repeatedly laid down by the United NationsSecurity Council, reiterates its willingness to support a comprehensive and balanced peace agreement andall-inclusive institutions entrusted with its implementation, notably in the areas of demobilisation,progressive democratisation, and reconciliation, during the interim period.

The EU invites all interested parties to play an active role in support of this process, whose success is a corefactor in the stability of the whole region of the Horn of Africa and in the fight against terrorism.

on the cease-fire agreement in Liberia

Brussels, 23 June 2003

The European Union welcomes the signing of a cease-fire agreement in Ghana on Tuesday 17 June betweenthe Government of Liberia and representatives of rebel groups Lurd and Model.

The EU urges the parties to fully comply with the cease-fire agreement and to co-operate constructively withthe ECOWAS mediator and the representatives of Liberian political parties and civil society in order to reacha sustainable peace agreement for Liberia. The European Union reiterates its strong support for ECOWASefforts to reach a peaceful solution to the Liberian crisis and its commitment to support a comprehensivepeace agreement for Liberia.

The European Union reminds the signatories of the cease-fire agreement of their obligation to respectinternational humanitarian law, ensure that humanitarian initiatives are protected and allow access toterritory under their control for humanitarian actors.

regarding Armenian Parliamentary elections

The EU has taken note of the preliminary findings of the International Election Observation Mission at therecent parliamentary elections in Armenia. The EU is pleased to see that a large number of international anddomestic observers, including observers of the OSCE and the Council of Europe, have monitored theelections.

Although some progress has been made since the last presidential elections on 5 March 2003, especiallyregarding the technical preparations, the pre-election campaign and the media coverage of the pre-electoralcampaign, the EU regrets that the overall election process did not meet the international standards in a

The EU is especially concerned with the reoccurrence of falsification of vote counts, the unbalancedrepresentation in the election commissions, the intimidation of proxies and the lack of transparency in thepublishing of the elections results.

The EU stresses its readiness to assist the Armenian authorities in readdressing these shortcomings in thefuture in cooperation with other relevant international institutions such as the OSCE and the Council ofEurope.

The EU firmly condemns the recent military confrontations in Northern Kivu, and particularly the offensivescarried out by the RCD-Goma, which constitute a serious violation of the ceasefire and a threat to thepolitical process in the Democratic Republic of the Congo. It refers to the signing on 19 June 2003 of theBujumbura commitment by the government of the DRC, the RCD-Goma and the RCD-ML, and urges theparties to implement it immediately and unconditionally.

The EU renews its urgent appeal to the governments of the DRC, Rwanda and Uganda to refrain from anyact likely to destabilise further the situation in Northern Kivu. It urgently calls upon all the partiesscrupulously to respect the Lusaka, Luanda and Pretoria agreements as well as the Kampala and Hararedisengagement plans. The governments concerned must exert their influence on the armed groups in the Eastto urge them also to respect these agreements, to cooperate fully with MONUC and to guarantee access forhumanitarian organisations. The EU voices its concern at the risk of a serious escalation of the conflict in theDRC and its implications for the Great Lakes Region. The EU would point out that, further to the Councilconclusions of 16 June 2003, it is determined to use all its instruments in a coherent fashion, includingpolitical and aid action. The EU confirms its commitment to support the peace process in the DRC as well aspeace and stability throughout the region.

The EU reiterates its appeal to the parties in Kinshasa to conclude over the coming days the negotiations onthe last outstanding issues in order to set up the transitional government without further delay. The EUvoices its full support for the mediation efforts under way under the aegis of the United Nations, with whichits Special Representative for the Great Lakes Region is associated.

regarding the media situation in Russia

Brussels, 7 July 2003

The European Union has noted the decision by the Russian authorities to discontinue the broadcasting of thetelevision station TVS. This gives rise to concern.

The EU understands that commercial considerations played a role in that decision. However, regardless ofthe reasons which led to the station�s closure, it will have a negative impact on the plurality of the media,which is a key part of the values upon which the EU/Russia partnership is built. The EU hopes that theRussian authorities will undertake measures to support and strengthen the plurality and independence of themedia.

The EU also hopes that the proposed amendments to the law on the media will not constrain the ability ofjournalists to report fully and accurately on the up-coming Duma and presidential elections. The EU looks tothe Russian authorities to implement the law in a transparent and non-discriminatory manner at federal,regional and local level.

Authorities of six ISA Detainees

The European Union welcomes the release by the Malaysian authorities on 1 and 12 June 2003 of 6 politicalactivists detained since April 2001 under the Internal Security Act (ISA). The European Union alsowelcomes the readiness of the Malaysian Government to consider the conclusions of the recent review of theISA produced by Suhakam, the Malaysian National Human Rights Commission, which calls, inter alia, forthe repeal of the ISA and the enactment of new legislation in line with relevant UN principles andinstruments. The European Union looks forward to a review of the present modalities of recourse to ISA.

Statement by the Presidency on behalf of the European Unionon the formation of the transitional government in the Democratic Republic of the Congo

Brussels, 2 July 2003

The European Union welcomes the formation of the Transitional Government of National Union in theDemocratic Republic of the Congo. This is a fundamental step in the peace process in the DRC, and marksthe acme of the path mapped out by the Inter-Congolese Dialogue and the Sun City and Pretoria agreements.

The European Union calls on the new Transitional Government to take the necessary action to achieve theobjectives of the transitional period as laid down in the Pretoria agreements of 17 December 2002, inparticular the holding of free and transparent elections at all levels enabling the establishment of ademocratic constitutional regime, and the formation of a restructured and integrated national army.

The European Union stands ready to support the Transitional Government's activities by means of concreteinitiatives to assist in rebuilding a stable Congolese State able to guarantee the safety of the Congolesepeople, national reconciliation and stability in the region.

The European Union commends the work of the Special Representative of the Secretary-General of theUnited Nations for Inter-Congolese Dialogue, Mr Moustapha Niasse, who facilitated the formation of the

concerning the situation in Haiti

Brussels, 10 July 2003

The European Union is very concerned at the resignation of the acting head of Haiti's national police force,Mr Jean-Robert Faveur, and the circumstances surrounding it. The detailed explanation given by Mr Faveurof the reasons for his action, namely the obstacles and restrictions which the political authorities had placedin the way of the proper performance of his duties, raises serious questions as to the Haitian government'sreal resolve to ensure the impartiality and professionalism of the police. These doubts are, moreover,confirmed by the manner in which the new acting head of the national police force, Ms Jocelyne Pierre, wasappointed, namely in the absence of appropriate consultations with the special mission of the Organisation ofAmerican States whose aim is to strengthen democracy in Haiti.

With reference, as in its previous declarations on Haiti, to the European Union's attachment to the values ofdemocracy and the rule of law, which govern its relations with non-member countries and lie at the heart ofthe partnership entered into with the African, Caribbean and Pacific States, the Union takes the view that thepresence of an impartial police force, working for the security of all citizens, constitutes a cornerstone of therule of law, without which democratic institutions cannot operate as they should.

Despite the renewal on 10 January 2003 of measures partly suspending its aid to Haiti, the European Unionstill provides considerable cooperation of direct benefit to the Haitian population; this it is resolved tocontinue to do. The European Union also remains ready to participate in a programme of technicalassistance for the judiciary and the police, provided it obtains assurances from the Haitian authorities, with aview to restoring order, security and the rule of law.

Declaration by the Presidency on behalf of the European Union to mark the entry into force ofProtocol No. 13 to the European Convention on Human Rights, concerning the abolition of the death

penalty in all circumstances

Brussels, 14 July 2003

The European Union welcomes the entry into force on 1 July 2003 of Protocol No. 13 to the EuropeanConvention on Human Rights, concerning the abolition of the death penalty in all circumstances.

This Protocol is banning the death penalty in all circumstances, including for crimes committed in times ofwar and imminent threat of war. No derogation or reservation will be allowed to Protocol No. 13 to theEuropean Convention on Human Rights. As of today, 41 out of the 45 Member States of the Council ofEurope have signed the Protocol, which was opened for signature by member states of the Council of Europeonly a little over a year ago, in Vilnius, on 3 May 2002.

The abolition of the death penalty also in respect of acts committed in time of war or of imminent threat ofwar should be discussed within the wider contest of the global trend towards the universal abolition of thedeath penalty.

The European Union urges Member States of the Council of Europe, who have not yet done so, to signProtocol 13 and to ratify Protocol 6 which abolishes the death penalty in times of peace. The EuropeanUnion also expresses the hope that Japan and the United States, who have observatory status to the Councilof Europe, will feel encouraged to consider steps towards the abolition of the death penalty.

The European Union reiterates its longstanding and firm position against the use of the death penalty in allcircumstances � a punishment which we believe impairs the human dignity, increases the level of brutalityand provides no added value in terms of deterrence. Consequently, all European Union countries haveabolished the death penalty. It is worth noting in this respect that the international community has excludedthe use of the death penalty in establishing international criminal courts and tribunals competent for the mostheinous crimes such as genocide and crimes against humanity.

In countries which maintain the death penalty, the EU aims at the progressive restriction of its scope andrespect for the strict conditions, set forth in several international human rights instruments, under which thecapital punishment may be used, as well as at the establishemnt of a moratorium on executions so as tocompletely eliminate the death penalty. The EU reiterates its concern about sentencing to death personsbelow 18 years of age at the time of the commission of the crime.

The European Union�s aspiration is to see the death penalty abolished in law and in practise in every countryin the world, in times of peace and war.

Declaration by the Presidency on behalf of the European Unionon the latest military attacks in Bujumbura (Burundi)

Brussels, 10 July 2003

The European Union is deeply concerned at the intensification of hostilities in Burundi and calls upon thewarring factions to cease the fighting immediately and show the greatest restraint. Absolute priority must begiven to the security of the civilian population, which has already suffered enough from the absence of apeaceful settlement of the conflict in Burundi.

There can be no military solution to the tragedy of Burundi: negotiation, and the honouring of existingcommitments, are the only possible way to restore the peace so longed for by the people.

The European Union urges the transitional government and the Palipehutu-FNL, led by Agathon Rwasa, toshow sufficient good will to start constructive talks with a view to peace negotiations.

The European Union calls upon the transitional government and the CNDD-FDD, led by Pierre Nkurunziza,to implement rapidly and conscientiously the cease-fire agreement of 2 December 2002 and to make theefforts necessary to resolve the outstanding issues.

The EU also appeals to all actors in the subregion to refrain from giving any support to the parties to theconflict in Burundi and to respect the will of the people of Burundi in its search for peace.

The European Union:

- Takes note of the decision of the Hong Kong SAR Government to extend the consultation period forthe adoption of a National Security Bill enacting Article 23 of the Basic Law

- Welcomes the Hong Kong SAR Government commitment to further engage in building consensuson this issue and to address the concerns expressed about the preservation of the rights of freespeech, freedom of association and freedom of assembly in Hong Kong

- Also welcomes the withdrawal from the proposed legislation of the provisions concerning theproscription of local organizations subordinate to those banned on the mainland on grounds ofnational security, which was one of the main concerns, as specified in previous EU statements. Theintroduction of the notion of "public interest" defense and of its requirements for a court warrant forany police search are also welcome moves, especially with regard to the protection of the freedom ofthe press and the flow of free information.

- Believes that the recent decisions of Hong Kong SAR Government could serve to alleviate thepolitical atmosphere in the territory.

- Would like to recall its support of the "one country, two systems" principle and of the preservation ofthe specific status of Hong Kong and respect for human rights and freedoms enjoyed by its citizens,as enshrined in the Basic Law of the SAR.

on the peace process in Somalia

Brussels, 15 July 2003

The European Union welcomes the signing on July 5th by all Somali leaders present in Kenya of a documentin which they set out the basic principles that will govern the passage from the second to the third phase ofthe Mbagathi Conference, as well as the four years of the Transitional Federal Government of the Republicof Somalia. It also expresses its appreciation for the fact that the document was subsequently approved byacclamation by the plenary assembly of the Conference.This is fully in line with the EU Council conclusions on Somalia of 22 July 2002.

The European Union notes with satisfaction that once again important differences among the Somali leadershave been overcome by their willingness to compromise and by the patient and effective mediation of theIGAD Technical Committee, headed by the Kenyan Special Envoy, Ambassador Kiplagat.

The European Union strongly urges all the Somali leaders who have been unable to return to Kenya to do sowithout delay and thereby allow the Conference to move into the third and final phase. Moreover the EUcalls on all Somali leaders to avoid actions which may disrupt the Conference, in particular any violations ofthe 27 October 2002 Eldoret Agreement of the cessation of hostilities.

The European Union is convinced that the future of the reconciliation process continues to rest in Somalihands. It therefore calls on all Somali leaders to achieve a final compromise at an early date in order to allowthe return of peace and stability to the country, ending a decade of conflict which has caused immensesuffering to the Somali people.

The European Union stands ready to lend its full support to the IGAD-sponsored peace Conference as well toa comprehensive and balanced peace agreement and all-inclusive institutions entrusted with itsimplementation.

years of negotiations have reached agreement on verification of the first 12,000 people in the KhudunabariCamp.

However, the EU shares concerns expressed over procedures and results of the verification process,according to which the legal standing, including citizenship rights, of 70.5% of the refugees classified ashaving left Bhutan voluntarily is uncertain. The EU is also concerned over the lack of adequate appealsprocedures.

The EU calls on both parties to initiate repatriation and integration of the refugees as soon as possible and infull compliance with international law and human rights. The EU believes that it is especially important thatparties involve the UNHCR or any other equally experienced international organisation as independent andimpartial advisor and monitor in the process so that an appropriatetreatment of all remaining verification cases and of all appeals can be ensured.

In order to facilitate the process, the parties are urged to prepare, and make transparent, plans forrepatriation/reintegration, addressing inter alia the questions of citizenship, housing, agricultural land andrepatriation grants, covering both those refugees who wish to return to Bhutan and those who wish to stay inNepal. As earlier indicated the EU is prepared to provide adequate financial assistance related to thereintegration and resettlement of the refugees.

Finally, the EU reiterates that respect for international law and human rights is one of the fundamental pillarsof cooperation between the EU and both Nepal and Bhutan, as it is for all of the EU's development partners.

The EU strongly condemns the military rebellion which took place on the 16th July in S. Tome and Principe.

The EU rejects any unconstitutional seizure of power and emphasises its commitment to the principles of therule of law and democratic processes which are the only means for a change in Government.

The EU welcomes the statement by the AU�s Presidency and the Portuguese Speaking Countries Communitycondemning the military rebellion and appealing for the restoration of the constitutional order.

The EU calls on the military forces involved to free all Ministers and other detainees, cease the rebellion andrestore the rule of law and democracy in S. Tome and Principe, without violence.

The European Union stresses the importance of strict adherence to the cease-fire agreement signed in Accraon 17 June 2003 between the Government of Liberia and representatives of rebel groups Lurd and Model.

The European Union reiterates its strong support for the ECOWAS led peace negotiations and itscommitment to sustain a comprehensive peace agreement for Liberia. It calls on all parties to sign such apeace agreement without delay in order to allow the return of peace and stability to the country and the endof more than thirteen years of conflict which have caused immense suffering to the Liberian people.

The European Union calls attention to the gravity of the humanitarian situation in Liberia and theurgent need to provide assistance. It reminds the signatories of the cease-fire agreement of their

The European Union condemns the repeated violations of the cease-fire agreement signed in Accra on 17June 2003, as a major impediment to the successful conclusion of the peace process and a cause of untoldsufferings for the civilian population.

The European Union urges the GOL and the rebel groups LURD and MODEL to sign without delay acomprehensive peace agreement in the framework of the ECOWAS-led Peace Talks due to resume in Accraon Monday 28 July. It calls on all parties to rise above their narrow interests and to face the challenge offorging a true partnership for the reconstruction of a stable and democratic Liberia.

The European Union calls attention to the gravity of the humanitarian situation in Liberia and the urgentneed to provide assistance. It reminds the signatories of the cease-fire agreement of their obligation to respectinternational humanitarian law, respect human rights, ensure that humanitarian initiatives are protected andto allow unimpeded access to territory under their control for humanitarian actors.

Declaration by the Presidency on behalf of the European Unionon ad hoc Human Rights Tribunal for crimes committed in East Timor

Brussels, 6 August 2003

The EU welcomed the establishment of an ad hoc Human Rights Tribunal on East Timor. This was a crucialfirst step in bringing to justice those persons responsible for human rights violations committed in EastTimor in 1999, and was in accordance with the concerns of the UN Security Council.

However the trials, recently completed with the last verdict delivered by the ad hoc tribunal on August the5th, have failed to deliver justice and did not result in a substantiated account of the violence.

The EU is disappointed that the prosecutors have not submitted all the evidence, especially that referred toby UN investigators and the Indonesian National Commission on Human Rights (KPP � HAM) in theirreports, suggesting that elements of the military, police and civil government allegedly funded, trained andabetted local militia groups. Besides, no officials from UNAMET, or members of independent observermissions, and only a very few �victim witnesses� from Timor-Leste, were called to testify by theprosecutors.

These deficiencies in the process have jeopardised the credibility of the verdicts, which weredisproportionate to the seriousness of the crimes committed.

The EU would like to underline that ensuring the accountability of all perpetrators of serious human rightsviolations would enhance trust in the judiciary and contribute to reconciliation. That is why it is ofparamount importance that the Indonesian judicial authorities ensure the appeal process is conducted in amanner consistent with international legal standards and the appeal judgments are set out in accordance withthe principle of transparency.

The EU also urges the Indonesian government to implement the recommendations made on reforming thejudicial system contained in the report by the UN special rapporteur on the independence of judges andlawyers. At the same time, the EU encourages the relevant authorities to take the necessary steps to improveproceedings for future trials on human rights violations, such as the Tanjung Priok cases.

The EU regrets that the Sander Theones case was not brought before the ad hoc tribunal, and reiterates onceagain the urgency that the perpetrators of his murder be brought to justice without further delay and inaccordance with international standards.

Declaration by the Presidency on behalf of the European Unionon the reform process in Turkey

Brussels, 31 July 2003

The EU warmly welcomes the latest package of reforms approved by the Turkish National Assembly, which reflects thecontinuing Turkish commitment towards meeting the Copenhagen political criteria.

The package appears to deepen and broaden the reform process, by addressing several of the priorities of the accessionpartnership, such as civilian control of the military, the fight against torture and the exercise of fundamental freedoms.In the Commission's forthcoming regular report, the contents of the package will be assessed more thoroughly and theEuropean Council will review progress in December 2003.

In Copenhagen, the European Council acknowledged the Turkish Government's determination to take furthersteps on the path of reform and urged it to swiftly address the remaining shortcomings in the field of politicalcriteria. In Thessaloniki, it welcomed the Turkish Government�s commitment to carry forward the reformprocess, in particular the remaining legislative work, by the end of 2003.

The European Union welcomes the resumption on August 10th of the IGAD-sponsored peace talks onSudan.

The EU considers that time is ripe to strike the final compromises on the outstanding key issues and reach acomprehensive agreement to put an end to the conflict and to the sufferings of civilian population in Sudan.

The European Union calls on the Parties to work actively with the IGAD mediators led by the KenyanSpecial Envoy with a view to achieve a comprehensive solution, based upon a strict observance of the rule oflaw and full respect for human rights and fundamental freedoms to fulfil the aspirations for peace andprosperity of all the Sudanese people within a unified Sudan.

The European Union commends the pivotal role of the IGAD member states and particularly of Kenya for itsfacilitating role and reiterates its full and continued support for the IGAD peace process.

The European Union assures the Parties of its readiness to assist them in the implementation of the PeaceAgreement and to accompany Sudan on a path of peace building, democracy and development.

The European Union welcomes the extension of the cessation of hostilities and of the Addendum on theVerification and Monitoring Team for a further three months and stands ready to support the monitoringmechanism.

The EU expresses its satisfaction at the inclusion of the ancient cultural site of Bagan on the World HeritageTentative List.

The EU is however very concerned at the decision by the Burmese Authorities that an observation tower isbeing built at Bagan and at the implications for Bagan�s heritage status. The EU underlines that such abuilding would be contrary to accepted international standards on the preservation of sites of historicalimportance.

In light of the potential effect of this project on Bagan, the EU calls upon the Burmese Authorities toconsider the consequences of the construction of this tower for the cultural heritage of Burma.

on the new violence in Israel and the Palestinian territories

Brussels, 14 August 2003

The European Union expresses the strongest condemnation of the recent suicide attacks by some Palestinianterrorist organisations, by which innocent people lost their life. The EU extends its condolences to thefamilies of the victims and expresses its sympathy to those injured.

The European Union is deeply concerned for the resurgence of violence in Israel and the PalestinianTerritories. The suicide attacks contravene the ceasefire declared on 29 June 2003 and undermine theinterests of the majority of Palestinians, who support an end to violence.

The European Union reaffirms once again that there is no alternative to a swift and full implementation, ingood faith by the two sides, of the road map. The European Union urges all parties to refrain from any actionwhich might lead to the resumption of the cycle of violence. Both sides must remain committed to the pathof negotiations, which must not be hindered by radical organisations opposing peace.

The European Union is horrified by the brutal and evil act of terrorism which was perpetrated against thepeople of Israel yesterday evening in Jerusalem.

The European Union expresses its deepest condolences and closest solidarity for the innocent victims, totheir families and to the government of Israel.

The European Union reaffirms that the fight against all forms of terrorism is paramount in the quest for a justand comprehensive peace in the Middle East. The EU fiercely condemns this inhuman attack which wasintended at undermining the negotiation process, based on the road map principles accepted by all partiesinvolved. This brutal act of violence was claimed by groups which totally oppose any kind of peacefulsolution, thus choosing, by virtue of their own actions, to set themselves outside the rule of law. In this

The plenary session of 16 and 17 July 2003 was attended by Mr Rocco Butiglione,the Italian Minister for Community Policies on behalf of the EU Council president-in-office, andMr Tarso Genro, Minister in charge of the Special Secretariat of the Brazilian Council forEconomic and Social Development.

1. SINGLE MARKET AND INDUSTRIAL POLICY

The EESC appreciates that this Communication is essentially a panoramic perspective of therange of relevant questions. It is not, itself, designed to offer detailed policy applications.However, the logical sequence is that the Commission must now follow through on the policyimplications and adopt pro-active policies in support of industrial development. The EESC willthen offer the benefit of its experience and opinions to the Commission.

The EESC has concerns that there may have been an insufficient appreciation of the impact ofenlargement in a number of areas.

A critical feature for the extension of the single market is that the infrastructure endowment ofmany of the new Member States still lags behind the standards of the rest of the EuropeanUnion. An appraisal of the priorities and financing mechanisms (with a defined contribution

from Community sources) to modernise key parts of the infrastructure, including themodernisation of trans-European networks, is commended.

The value of the Commission Communication is that it sets a framework for a betterunderstanding of the pressures affecting the development of industry in the Community. Theessential theme of this Communication, endorsed by the EESC, is that the combined efforts ofindustry itself, industrial associations, local and regional government, national governments andthe Community must acknowledge and respond to the need to maintain, and enhance, industrialcompetitiveness within a context that offers a sustainable and viable future.

The EESC welcomes the proposal outlined in this Communication for the launch of a continuingreview of all EU policies that impact on industry. The Committee welcomes this positive re-orientation of policy making and commends the intention to use evaluation methods based onimpact assessment analyses.

� Key points:

While welcoming the Commission communication and supporting its recommendations, theEESC believes that there are some significant omissions. In particular, there is insufficientattention given to job creation. Though the Commission communication expresses the belief ingeneral terms that the internal market will create jobs, it does not provide any evidence.

Furthermore, the Commission communication virtually overlooks consumers and the advantagesto which they have a right through the completion of the internal market.

The Committee also points out that, on its own, the setting-up of the internal market will notresolve the problems on the European labour market but that additional pro-active measures willalso be required on this front.

The EESC believes that labour markets are under constant development, jobs disappear in thecourse of economic restructuring, changes in the international division of labour, technologicaldevelopment, etc. How to manage change is an important challenge to the EuropeanCommission and especially to the social partners.

The internal market brings with it challenges for the social systems and their futuredevelopment. Any discussion about the future shape of the social systems must not, however,

focus solely on the internal market and budget requirements but must look at the systems as awhole and take account of their objectives.

Slow progress with the Lisbon process is beginning to cause concern. The Commissioncommunication does not acknowledge that concern.

Additional welfare benefits within the EU will not be achieved by market liberalisation andenhanced competition alone. A supporting macro-economic policy geared towards growth andemployment will do much to help complete the European internal market.

Lastly, the EESC finds it strange that the strategic priorities for the internal market do notinclude steps to gain citizens' confidence (consumers and workers) and to ensure that theybenefit from the advantages associated with completion of the internal market.

2. EXTERNAL RELATIONS

• The Role of Civil Society in European Development PolicyRapporteur: Ms Florio (Employees - IT)

In its communication on 'The European Community's Development Policy'1 adopted on 26 April2000, the Commission emphasised the crucial role of civil society and stated that "... future ECpolicy will aim at the further strengthening of civil society and the further involvement of civilsociety actors in Community development aid policy." Similarly, the more recent CommissionCommunication 'The Participation of Non-State Actors in EC Development Policy'2 adopted on7 November 2003 highlighted the importance of the widest possible participation by all sectors ofsociety as a key principle in EC development policy, thus strengthening the democratic fabric ofsociety.

In view of the EESC's extensive involvement in and experience of this field, the own-initiativeopinion on the role of civil society in European development policy can make a significantcontribution to the debate currently under way within the European Union.

• The reaching of a common agreement in the short to medium term defining the practicalarrangements and instruments for the participation of NSAs, culminating in a regulatorysystem conferring full legitimacy based on dialogue

• The preparation of a "roadmap" on the basis of broader and clearer selection systems in orderto facilitate dialogue with NSAs and their participation

• The inclusion in the process of decentralisation to the delegations of mechanisms for a realexchange with third country NSAs

• The necessity for specific training initiatives for boosting the capacity of third country NSAs• The necessity for establishing a constant and comprehensive flow of information at grassroots

level• The importance of strengthening anti-corruption measures as a criterion for granting funds• Arrangements should be introduced to monitor the real involvement, in qualitative and

quantitative terms, of NSAs in procedures for defining and assessing development policies inthose countries receiving European funds

• The EESC recommends that the World Bank, the International Monetary Fund and theInternational Labour Organization join with the European institutions in helping to strengthenand promote the social partners and civil society organisations in the developing countries

• The Committee proposes that more EU funds should be channelled directly to NSAs in thedeveloping countries.

The Committee strongly supports the efforts to train legislators and members of the judiciaryinvolved in China's implementation of the WTO rules at the various relevant levels.

With respect to the enforcement of WTO rules, the Committee recommends that the Commissionshould cooperate closely with the EU Chamber of Commerce in China.

The involvement of organised civil society seems highly desirable to tackle the negative aspectsof transition. The European Commission is aware of the crucial role NGOs can play.Unfortunately, they have so far paid little attention to the role of free and independent economicand social interest groups.

With respect to NGOs, the EESC proposes, in close cooperation with the CESC, to work closelyto help make improvements in the transparency and clarity in regulations for NGOs.

China, as a prominent member of the International Labour Organisation, should ratify all eightfundamental human rights Conventions of the ILO and implement them and should withdraw itsreservation on Article 8:1(a) of the International Covenant on Economic Social and CulturalRights.

In its human rights dialogue with China, the European Commission should pay even moreattention to China�s persistent violation of the right to organise and the right to bargaincollectively and stress the importance of full involvement of free, independent and democraticeconomic and social interest groups in the transition to a market economy.

The EU should support and enhance dialogue between organised civil society, economic andsocial interest groups in China and the EU.

The development of political, civil economic, social and cultural rights under the conditions of�one country, two systems� in Hong Kong and Macao will be closely followed by the EuropeanEconomic and Social Committee. It points to the OECD Guidelines for Multinational Enterprisesas a reference point for the activities of Hong Kong based companies and their subcontractors inmainland China. The EESC delegation to Hong Kong and Macao concluded that relationsbetween the EU and Hong Kong and between the EU and Macao have continued to be excellentsince the hand-over, but now need to become more structured.

The EESC would encourage development cooperation actions with respect to living conditionsand social justice, employment and social security issues, and support for business training.

The EESC agrees that the EU should further encourage the transfer of know-how, technology orpolicy experiences.

The Committee believes that in order to take full advantage of trade and investment liberalisation,China�s economy requires extensive restructuring.

The European Commission's China programmes should more prominently reflect the importanceit places on governance, civil society, human rights, and sustainable development and include awomen-specific agenda for poverty reduction.

The EESC and the China Economic and Social Council have decided to engage in regularconsultation, dialogue and research on economic and social issues, human rights and the rule oflaw. Future EESC visits to China should not only be used to strengthen contacts with the ChinaEconomic and Social Council, but also to renew and to widen contacts with the NGO community.

• Preparation of the 5th WTO Ministerial ConferenceRapporteur: Mr Vever (Employers - FR)

The 5th WTO Ministerial Conference in Cancun (Mexico) on 10-14 September 2003 will carryout a mid-term review of the Doha Development Agenda. It is going to play a decisive role inthe completion of negotiations by the end of 2004. The success of this conference is particularlynecessary in the present circumstances in order to revive economic growth, which has fallensharply since Doha, bolster investor confidence, which has been shaken by the ongoing stockmarket and financial crisis, and improve the general climate, which is still dominated byinternational security concerns and the war on terrorism.

The EESC notes that the situation in the run-up to this conference is contrasting.

If negotiations are to receive a new decisive fillip at the Cancun Conference, the EESC thinksthat all parties must feel that an overall and dynamic balance - borne out by impact assessmentsand proportionality tests - has been attained with regard to market access.

The EESC would also underline the importance of obtaining at the conference a significantreduction in non-tariff barriers, with more transparency in the field of government procurement,an agreement on foreign direct investment, more appropriate and effective anti-dumping andanti-subsidy provisions, and progress in making allowance for environmental protection.

The EESC also points out the key importance of development for the success of the DohaAgenda. This presupposes in particular real progress in launching the work programme whichhas been agreed on to facilitate the implementation of commitments, by way of the special anddifferential treatment of developing countries, greater clarification of developing countries'situations and categories, by making a clearer distinction between countries which lag behind

persistently and countries which already enjoy the benefits of an emerging economy, andeffective support for administrative capacity building in the least developed countries.

The EESC reiterates the importance which it continues to attach to progress in the field offundamental social rights, which cannot be called into question for the sake of the developmentissues at stake.

Finally the EESC invites the various civil society players (businessmen, socio-occupationalorganisations, social partners, NGOs) to take steps to:

� participate in information campaigns about the issues at stake in the Doha Agenda,

� organise international meetings, at a cross-sectoral level or within sectors of activity, and

� contribute through their assessments, proposals and participation, to the success ofsustainable development worldwide.

The EESC will take part in these initiatives. Before the conclusion of the Doha Cycle at the endof 2004, it will present operational proposals for improving participatory democracy byinvolving organised civil society in the WTO's activities. These proposals will be the result ofjoint deliberations with its partners in the European Union and in non-EU countries.

3. RESEARCH AND HEALTH

With due regard for the respective competences of the Member States and of the EU, the problemsraised and the contributions made by numerous players, the European Economic and SocialCommittee proposes a series of measures which are the result of using the Open Method ofCoordination.

The Open Method of Coordination must be put in place as a matter of urgency, and could have thefollowing objectives:

� to modernise national systems by developing a quality healthcare programme;� to improve cooperation between Member States.

Cooperation must enable common objectives to be identified, if possible for healthcare and care forthe elderly. These objectives could then form part of national action plans, and regular updatescould be produced.

In order to establish this Open Method of Coordination, to make it visible and credible and to give ita solid basis, the Committee considers it essential to set up a simple, flexible, efficient structureresponsible for a series of priority actions.

The European Economic and Social Committee intends to make healthcare issues an area foraction, whilst respecting the existing Community political and legal framework. The Committeefeels there is a need to develop tools at European level which draw on the collective Europeanintelligence beyond discussions on the future of national social security systems. The Committeeperceives a need for political will to promote awareness of the realities of healthcare and tofoster excellence in innovative practice in the medical and social domain. This is why itproposes creating effective bodies to guarantee EU citizens the fundamental right of access tobetter health for all.

The EESC considers it a matter of top priority that the EU and Member States take on board thecompetitiveness of the biotech industry, which is a key element in achieving the Lisbon objectives.

The "cluster" and "biotech incubator" models represent a yardstick to assess competitiveness,synergies, technological transfer and the most useful approaches for funding. Cooperation betweenMember States and the Commission and learning and sharing best practices should be particularlystrong in this sector, in order to find ways to trigger a more accelerated process of growth.

More effort should be made to understand the types of SMEs that compose the industry and theirspecific needs for funding.

While recognising that a Commission initiative to review the directive on consumer credit isappropriate, the European Economic and Social Committee cannot support adoption of the proposalas it stands: it must firstly be radically amended, principally on account of the need to:

• ensure it is compatible with the provisions of other Community legislative instrumentsdealing with related matters;

• carry out a detailed simulation of the impact of every aspect of the proposed measures,especially regarding progress in completing the single market in financial services andboosting consumer confidence;

• fine-tune several of the suggested provisions in the light of the principles of proportionalityand necessity, ensuring that opting for total harmonisation does not lead to a potential fall inthe level of consumer protection, presently guarded against by retaining a minimum clause.

The most important aspects which, in the EESC's view, need to be adjusted to meet the proposal'saims, concern:

• the legal basis on which the directive is to be adopted;• its scope, with regard both to what is included and what is excluded;• the way in which the total harmonisation method is used without guaranteeing maintenance

of a high level of consumer protection;• the failure to take account of over-indebtedness, assuming that matters can be resolved with

an inappropriate and at times disproportionate list of information obligations, leaving asideothers which are effectively essential;

• the need to flesh out the structure, functioning and guarantees concerning the use ofcentralised databases.

The Committee agrees with the Commission that the creation of a general legal framework for thefinancing of Community actions in favour of consumer policy.

The Committee does not consider that the introduction of a two-year project cycle in principle and acall for proposals at least every two years implies that the projects financed must have a duration oftwo years as this would be excessively rigid.

The Committee notes that only one organisation will be awarded this type of subsidy and believesthat the Commission should be more flexible.

The Committee asks the Commission to ensure that the criteria relating to representation on theConsumer Committee do not become dependent on the criteria used to grant funding.

It is important to distinguish the size and resources of the organisations, whether they operate atnational or Community level and the "Community interest" of their proposals.

The Committee finds it strange, against the current background of European integration, that norequirement is placed on these organisations to operate in a democratic and transparent manner andto make their organisational data available to the public.

The Committee finds it unusual that the support for the co-financing of specific projects cannot alsoattain 95% of eligible project implementation costs.

Finally, the Committee would remind the Commission of the need to set aside public money forthe creation of a European research body for the protection of consumer rights.

The Committee supports the integrated approach of the Commission proposal and considers theproposal a useful contribution to making food safety a more tangible priority of the official systemof controls for feed and foodstuffs.

The Committee considers that to guarantee the success of the integrated approach, a strongpartnership between the various players in the sector should be promoted, based on mutual trust andtransparency, and an appropriate balance between official control systems and self-regulation,responsibility and voluntary certification on the part of producers.

The Committee considers that food safety in the European Union cannot be guaranteed withoutpromoting and strengthening cooperation with third countries through agreements and specificmeasures, in line with their level of development, as well as international cooperation with regard tothe Codex Alimentarius, by strengthening the EU's presence in this field, and the WTO.

The Committee recommends paying particular attention to harmonising controls in the applicantcountries and promoting training and information activities, not only for control staff, but also forthe players in the various sectors and the general public.

opinion means that while assistance must focus on less-developed regions, especially in theaccession countries and using instruments in addition to those proposed by the Commission, a highunemployment level must be adopted as a priority criterion within each cohesion objective.

The EESC endorses the options proposed by the Commission in the context of enlargement withrespect to eligibility criteria for Objective 1, but it also thinks that an assessment is needed as towhether the funding allocation is sufficient to guarantee an ambitious cohesion policy in theenlarged Union of 25 countries. � Contact: Mr Roberto Pietrasanta

� Key points:

The EESC feels that the reasons advanced do little to justify the provision, so much so that onemight wonder whether this were not almost a case of state aid rather than a temporary taxexemption. However, the EESC is well aware of the political circumstances and of the state ofrelations between Corsica and mainland France. A refusal would have consequences reaching farbeyond the relatively small figures at stake. Consequently, and mindful of its responsibilities, theEESC reluctantly endorses the proposed directive as submitted.
