In compliance with the judgment of the Hon'ble PrincipalBench of Central Administrative Tribunal, New Delhi in O.A.2957 of 1991 the Govt. of India have devised a promotionalscheme for Staff Car Drivers with the graded structure videMarginally noted O.M. in consultation with the Ministry ofLaw, Ministry of Finance and Ministry of Railways similar toone provided by the Ministry of Railways.

In terms of the O.M. marginally noted, the promotionalscheme for Staff Car Drivers was adopted in the KYICas thepay scales of Staff Car Drivers of the KYICwere similar to theStaff Car Drivers of the Govt. of India Ministries/Departments.

The nomenclature of the posts are as under as per thepromotional scheme.

The method of appointment to the posts in Grade.ll andGrade I of Staff Car Driver was by promotion. on Non-selection (Seniority-cum-fitness) basis and further subject topassing of a Trade Test of appropriate standard.

In terms of the acceptances of the recommendations of the5th Ce'ntral Pay Commission, the Pay scales in respect ofStaff Car Drivers were revised by the Govt. of India asunder:-

* The IVth CPCscales (a) 1320-2040 & (b) 1400-2300 havebeen merged in Vth CPCand revised to 4500-7000.

The above revision made applicable by the Govt. of Indiavide Marginally noted O.M.has been adopted by KVICvideS.O.marginally noted consequent upon the implementationof the revision of pay scales as per the recommendations ofthe Vth CPCin KYIC.

In compliance with the directions of the Principal Bench ofthe Central Administrative Tribunal, New Delhi in O.A.2529/96 filed by Central Govt. Staff Car Drivers'Association & Bikram Sing vs Union of India, the Govt. ofIndia, vide marginally noted O.M.created a new Grade forStaff Car Drivers viz. "Special Grade" in the pay scale of Rs.5000-8000 (Vth CPC scale) as under. Promotion to thespecial grade shall be by non-selection (seniority cumfitness) from Staff Car Driver Grade-I with 3 years regularservice in Grade-I.

-As a sequence of the promotional scheme, the introductionof Special Grade for Staff Car Driver (5%) in the Pay Scaleof Rs. 5000-8000 (Vth CPC pattern) has been adopted inKYICvide the 0.0. marginally noted.

The pay revision has been implemented in the KVICas perthe recommendations of the 6th CPC vide the S.O.marginally noted. However, the post of Driver (OrdinaryGrade) has only been included in the S.O.with replacementscale as per 6th CPCpattern.

In view of the above omission, though a foot-note has beengiven in the marginally noted S.O. to adopt thecorresponding PH/GP in respect of the posts, if any, leftout; the revision under 6th CPC pattern w.eJ. 01-01-2006in respect of Staff Car Drivers in the KYICwould be asfollows:

Under Vlth CPC stream, 3 scales of Vth CPC stream havebeen merged (Le. 5000-8000, 5500-9000 and 6500-10500has been merged and revised to 9300-34800 with GP of Rs.4200). (Subsequently one of the scales, Le. Rs. 6500-10500has been revised to PB 9300-34800 with GP ofRs. 4600/-).In view of this the PH of Special Grade Staff Car Driver hasbeen replaced in PB-II 9300-34800 with Grade Pay of Rs.4200/-.
