Foreword

Kivells are delighted to have received instructions on behalf of Mr JM Williams of

Werrington Park Farm, Launceston, Cornwall to disperse their entire herd of Pedigree

Red Ruby Devons.

The Werrington Park Herd was founded in the autumn of 1994 with the arrival of two

maiden heifers; Willsworthy Gertie and Bywood Aggie, given to me as a house-

warming present. Gertie’s line continues to this day. The herd was gradually increased

over the years with the purchase of, amongst others, Clampit, Woodrow, Luckcroft

and Essington Females.

The breeding policy has been to maintain pure Red Ruby characteristics as far as

possible, but always with an aim to increase size and improve conformity (a tall order

some might say!). Since 2008 Champson, Challenge, and Yeomadon bulls have been

used. Currently the herd is running, and has been since 2017, with Colleton Rasputin

and he has proved very successful. Calving was completed before the end of March this

year and the general ease of calving has improved. The average age of the herd is low

and this reflects a strict culling policy to some extent.

It is with great sadness that I am offering the herd for sale, but retirement beckons and

it is time for the next generation to take the strain.

Calving Pattern

The herd is spring calving, with all the calves having been born between February and

March.

Herd Health

The herd has been closed since 2005, is a member of the Premium Cattle Health Scheme,

has been accredited free of BVD since 2015 and is risk Level 1 for Johnes. The herd

passed their last annual TB test on 18th June 2019. The cows & heifers have been PD’d

by the vet. Any PD dates are given as the vets best estimate and should only be treated

as a guide.

Auctioneers comments

This is a super herd of Red Ruby Devon Cattle, the herd is in great order and there

really are some exceptional cows in the herd. The cows are powerful and very milky

with this year’s crop of calves looking very well. The health status is excellent and anyone

looking for replacement cattle or new bloodlines should make every effort to attend this

important dispersal.

AUCTION SALE RULES

To be Sold under the Livestock Auctioneers Association Conditions of Sale.

Maiden heifers stated to be sold for breeding purposes.

The vendor warrants a maiden heifer stated in the catalogue or at the time of sale to be

sold for breeding purposes to be free from any malformation which would render the animal

incapable of breeding. The warranty is a 5 day warranty if the malformation is patent or a 6

month + 5 day warranty if the malformation is latent.

If the purchaser proves a breach of warranty the purchaser may return the animal to the

vendor. Notice of claim must be supported by a veterinary surgeon’s certificate.

Cows or heifers sold as being in milk and/or in calf. The vendor warrants a cow or heifer in

calf and/or in milk:

(a) To be correct in the udder and teats;

(b) Not to be infected with clinical mastitis; and,

(c) Not to suck any other animal or herself.

The warranties in conditions (a) & (b) is an after sale warranty which shall run from the

close of the day’s sale or until the animal is removed from the sale premises, whichever is

sooner. The warranty in conditions (c) is a 5+5 day warranty.

Cleansing: The vendor warrants that all newly calved cows and heifers have cleansed

satisfactorily before the sale. This warranty is a 3 day warranty in which any claim made by

the purchaser must be supported by a veterinary surgeon’s certificate. The vendor is obliged

to pay for the cost of one wash out.

Cows or heifers sold as served or guaranteed in calf.

When an animal stated to have been served less than 10 weeks prior to the sale and is

pregnancy diagnosed positive, this is given as guidance only and carries no warranty. If a cow

or heifer has been positively diagnosed as 10 weeks or more in calf at the time of sale and

thereafter is proved to be not in-calf, and a Veterinary Surgeon’s certificate to that effect is

produced there is a 38 + 5 day warranty.

Where a cow or heifer is sold as ‘having run with a bull’ no warranty as to the animal being

in calf at the time of sale is given.

Breeding Stock Bulls: The vendor warrants that any bull 10 months or over sold as a stock

bull is capable of and effective at natural service. This warranty is a 16 week warranty.

Livestock & Machinery Notice to Purchasers:

Travel - See location map & directions on back page. Signs to the sale will be roadside in the vicinity of the sale.

Parking – Our staff will be present on the day to assist with car parking. Please follow signs and instructions from the stewards.

Viewing – From 8am on morning of sale.

Health & Safety - Kivells accept no liability for any damage or injury to persons, livestock,

vehicles or plant not arising out of their negligence. Any person entering the sale premises

does so at their own risk and must comply with the requirements of any Health and Safety

notices. All persons entering the sale premises are hereby given notice that there are

potential hazards due to the type, penning, herding, loading and unloading of livestock and

vehicle movement. Caution should be exercised and children must be fully supervised at all

times. Kivells reserve the right to refuse admission to any person or vehicle into the sale

premises without giving reason. Kivells strongly advise that no persons access the sale ring,

pennage or livestock passageways during the sale or whilst animals are being moved through

passageways. Should any person decide to enter these aforementioned areas they do so

entirely at their own risk. No vehicle will be allowed in the Sale premises during the sale

without the express permission of the Auctioneers. Permission from the Auctioneers is

required ahead of starting powered equipment or machinery. Any incidents or accidents on

the sale premises should be reported to the Pay Office immediately.

Biosecurity and Livestock Welfare - All persons entering the sale premises must comply with

all current Biosecurity legislation, rules and conditions. All persons should be in clean clothing

and disinfect footwear upon entry and exit from the sale premises. Hand wash facilities,

disinfectant boot dips and brushes are available and should be used. Vehicles used to

transport animals to or from the sale premises must comply with current cleaning and

disinfection legislation. All vendors, purchasers, agents and hauliers must comply with all

current legislation governing the welfare of livestock whilst at the sale premises or in

transport to or from the sale premises. Any concerns over Biosecurity and Animal Welfare

should be reported to Kivells Biosecurity and Animal Welfare officers, whose details are

located in the Kivells sales office.

Registration - In order to bid, all new Buyers are required to register before the auction, at

the Kivells market office or as otherwise advised by the Auctioneers. All such Buyers will be

asked for two forms of identification and a credit reference will be required. Acceptable

identification includes Driving Licence/Passport together with a Utility Bill/Proof of

Address/Business Letter Heading/Business Card. The Auctioneers reserve the right to request

a deposit ahead of any purchase or during sale proceedings and to refuse registration or any

bid or bidder without giving reason. It is strongly recommended that Bidders and Buyers visit

Payment – All Lots must be paid for on the day of the Sale by the Buyer prior to any removal or

consolidation, unless alternative arrangements have been agreed with the Auctioneers. At the

fall of the hammer the highest bidder will be deemed to be the Buyer and transfers of purchases

will only be permitted with prior approval from the Auctioneers. Any payment is to be by a

means approved by the Auctioneers. Our preferred payment terms are debit card or cash and

Kivells reserve the right to stipulate payment by these methods. Kivells may also accept bank

transfers and cheques with prior approval. Our Bank Account details are: Sort Code 56-00-49

Payment in Cash - In order to comply with money laundering regulations we cannot accept Cash

payments above the maximum permitted at the time of sale. The maximum varies according to

exchange rates and currently it is circa £9,000. Buyers are advised to check with the Auctioneers

ahead of the sale.

Commission/Buyers Premium (On Machinery Only) - All Lots will be subject to a Buyers Commission, VAT at the standard rate will be charged on all commissions. Buyers shall pay Commission to the Auctioneers at the following rates:-

• 10% on any single lot up to and including £2000

• 5% on any single lot over £2000

Value Added Tax (On Machinery Only) – Please be aware some lots will be subject to VAT and therefore VAT will be charged in accordance to the current rate and added to all accounts and is applicable to the Commission/Buyers Premium.

Bidding Form - The Auctioneers will bid on your behalf if written instructions are received on the

form supplied, or an email or text has been received confirming instructions and acceptance of

the terms set out in the form and adequate time is available to enter such bids. The Auctioneers

reserve the right to request a deposit as part of the instruction process. It is entirely at the

discretion of the Auctioneers whether other forms of bids are acceptable however in every case

there is no liability on the auctioneers.

Cattle Conditions of Sale - It is strongly recommended that Bidders and Buyers visit

Risk - All livestock are at the risk of the Vendor before they are sold and at the risk of the Buyer

when they are sold (fall of the hammer). It is strongly advised that Vendors and Buyers ensure

that their insurance policies cover livestock at a market or sale premises and that Buyers have

immediate cover for animals purchased. All machinery lots remain at the risk of the Buyer from

the fall of the hammer and it is strongly advised that the Buyer effects insurance immediately.

Removal of Lots - Lots can only be removed once payment has been made in full and/or a pass issued by the Auctioneers. We would like all machinery lots to be cleared from the sale ground on the SALE Day unless alternative arrangements have been agreed with the Auctioneers. No removal of machinery lots will be permitted until after the conclusion of the machinery sale unless agreed by the Auctioneers. No cattle will be loaded until the sale has finished. Cattle may stay on farm until Friday 16th August by arrangement with the vendor. Any lots, be they machinery or cattle, left are done so at the buyers own risk.

Descriptions of Machinery Lots - Buyers should satisfy themselves prior to making bids as to the condition of any Lot and should rely on their own judgement as to whether the Lot accords with its description. All Lots are sold with all faults and imperfections and errors of description.

nor the Vendor accept any responsibility for any subsequent reaction by an animal sold to

any relevant test administered after the sale.

Liability of The Auctioneer - The Auctioneer acts in all respects only as agent for the Vendor
