4610.1 PREFACE

4610.2 HOUSING ADMINISTRATOR

For the purposes of this policy, the Housing Administrator is the Business Administrator.

4610.3 HOUSING AGENT

In each area, the Housing Administrator may appoint a Housing Agent. It will be the duty of the Housing Agent to administer the District Housing Policy in a fair and equitable manner. The Housing Agent will be appointed based on input from the local housing committee and approval of the District administration.

4610.4 HOUSING ACCOUNTANT

A member of the Business Office staff will be designated to keep a record of all rent and fees assessed and paid and will be responsible to set up payroll deductions and make such

adjustments as may be directed by others of the housing administration.

4610.5 BUILDINGS AND GROUNDS DIRECTOR

The buildings and grounds director has the responsibility to oversee and assign all maintenance work on District housing and will designate the housing maintenance specialist.

4610.6 HOUSING MAINTENANCE SPECIALIST

A member of the District maintenance staff will be assigned to work directly with housing agents and perform maintenance duties and other duties as requested by the buildings and grounds director.

DISTRICT HOUSING ELIGIBILITY 4620

4620.1 PROFESSIONAL STAFF

Housing units are provided in certain communities by the District. Housing units will be available to licensed staff members, and their immediate families, who are assigned to the schools in those communities first. Housing units may be rented to other staff members or contractors only if it is determined to be in the best interest of the district.

Immediate family as referred to herein is meant to designate an employee, his/her spouse and their dependent children. The various-sized units are allocated on the basis of the size of the tenant's immediate family.

4620.2 GUESTS

Guests are permitted in the homes, but the stay of such guests must be limited to reasonable, short-term visits with the tenants, not to exceed two weeks. Any person not designated as an immediate family member as described in 4620.1 is considered to be a guest for purposes of this policy.

Exceptions to the guest policy must receive the advance approval of the Housing Agent.

4620.3 PRINCIPAL'S HOUSING

One home in each of the housing areas may be designated and reserved for the principal of each school.

4630.1 SELECTION OF TENANTS

4630.1.1 PRIORITY AND ORDER OF ASSIGNMENT

The priority for assigning personnel to District Housing shall be in the following order:

1. Licensed employees currently living in District housing shall have first priority in any housing assignment.

2. Licensed employees who do not have living quarters in their assigned school attendance area will be given second consideration in any housing assignment.

3. If there are vacant homes available after the first two priorities are met, housing will be available to licensed employees in each area on a basis of seniority. In the event of equal seniority, housing need will then be the determining factor.

Seniority is defined as current continuous service in the District in a professional assignment. In the event of comparable seniority, the earliest contract date will be given preference. If a teacher leaves the District and later returns, the date of the most recent contract will be in effect.

The size of the family and the ages of the children will be considered in assigning housing, with consideration being given to larger families with older children. Family size means members of the immediate family only.

Larger vacant housing cannot be assigned to smaller families until after all certified positions for the year are staffed and hired, and all staffing needs are determined for the year.

4630.2 SIZE OF HOMES

Housing needs will generally be determined according to the following:

1. Three or More Bedroom Home

• A family with four or more children. • A family with at least two older children of the opposite sex.

2. Two-Bedroom Home

• A family with two or three small children. • A family with two older children of the same sex.

3. One-Bedroom Home

• A family with no children or one child. • A single employee.

4630.3 HOUSE TRANSFER

A family may be asked to move to another home if, in the judgment of the Housing Administrator, the needs of the District can be better satisfied by such a move, for example:

• A small family living in a large home may be asked to move to a smaller home to permit a large family to move into the larger home.

• A tenant may request to move to other District housing. The request will be considered on the same criteria as for the initial assigning of homes.

4640.1 APPLICATION

The intent of this policy is to provide a secure commitment to the tenant for housing. The only homes considered available will be vacant units.

Single tenants, living in two or three bedroom units may be asked by the Housing Agent to accept one roommate per vacant bedroom. Single employees who wish to live alone should apply for one of the single unit homes.

Available housing units will be announced by the housing agent by placing a list of such vacant units on a designated bulletin board within each school for a period of one week. If the vacancy has not been filled within one week, it should remain on the board until a tenant has been identified.

Upon note of a vacancy, any licensed employee working in the housing area may make an application to the Housing Agent of the area where the vacancy has occurred. Any employee requesting housing may apply by completing the "Housing Application Form" and submitting it to the appropriate Housing Agent.

4640.2 SECURITY DEPOSIT

A security deposit will be required of all tenants. The security deposit may be a payroll deduction for employees. A security deposit must be paid to the San Juan School District Business Office prior to occupancy by non-district employees. Monies paid as a security deposit will be held by the District Office until the tenant terminates from the District housing at which time any charges assessed because of breakage, cleaning, or damages, will be deducted from this deposit.

4640.3 RENTERS INSURANCE

District insurance does not cover loss of personal belongings due to fire or other events that may cause personal loss. Tenants are encouraged to secure personal fire and other loss insurance which should also include renter's personal liability coverage.

4640.4 RENTAL PAYMENT RATES

Renters who are District employees are required to sign a release for the District Office to deduct rent payments from their monthly payroll checks. They must also agree to an annual review of the District need for the house. Any District employee renter must have enough monthly salary to allow for full rent deduction.

Rental rates will be established for each of the housing areas by the Board of Education. An increase in the rental schedule shall occur annually. This increase will be at least a percentage

increase identical to the percentage increase established for the base of the teacher salary schedule.

Rental charges for non-employees are payable to the District Office each month. Non-district employees are required to pay the security deposit and the first and last months rent in advance.

Charges for a partial month's occupancy shall be computed on the basis of a daily percentage of the monthly rate. Each month shall be considered as having 30 days for the purpose of computation. All rental rates shall apply year round.

4640.5 DELINQUENT PAYMENTS

Monthly rental charges are payable in advance and are due on the first of each month. Accounts become delinquent when not paid within ten (10) days after the due date. Delinquent rent may be a cause for eviction from District housing. A 5% penalty fee for delinquent rent payments will be charged.

All unpaid fees and charges will be deducted from the employee's final check for that fiscal year.

4640.6 UTILITIES

All utility payments will be the total responsibility of the tenant. Tenants may be charged a utilities fee for all utilities provided by the District.

4640.7 KEYS AND LOCKS

Keys may be obtained from the Housing Agent. If a key is lost, another key may be obtained. A replacement fee will be assessed for all lost keys. Tenants shall not install or change locks on District owned housing.

4640.8 PHONES

Each tenant is responsible for obtaining their own telephone, if desired.

4640.9 TERMINATIONS

All renters must vacate their District house within 15 days after their contract has been terminated.

An employee planning to leave District housing to accept employment elsewhere should notify the Housing Agent at least 15 days prior to their departure. If tenants do not intend to accept a contract for the coming year, they will be expected to terminate their housing agreement and completely vacate the home no later than 15 days after their last contract day with the school district.

On the date of involuntary termination, an occupant must immediately move their family and personal property from any District unit.

On the date of any termination of employment with the District the tenant will have the Housing Agent inspect the home with the tenant to determine the cleanliness and conditions of the unit. All housing units must be left in the same state of cleanliness in which they are received—that is, all appliances, walls, and floors must be left in an orderly, clean condition. Failure to leave the unit in such condition will result in cleaning charges being levied.

Employees who have located a private housing unit in a District Housing Rental Space must arrange to have their private unit removed from the District's property within 45 days of their last contract day with the District. The unit may be sold to another District employee, but availability of the rental space is subject to the Priority and Order of Assignment defined in Policy DOAB above. Private units located in a District Rental Space may not be sublet.

4640.10 SATELLITE DISH INSTALLATIONS

Any permanent satellite dish installation done by the tenant must receive the advance approval of the Housing Maintenance Specialist. Any brackets stands or poles mounted directly to any building will be considered as a permanent improvement which shall remain as part of the District property.

Rental dishes are allowed; installation must receive the advance approval of the Housing Maintenance Specialist.

DISTRICT HOUSING PET OWNERSHIP IN DISTRICT HOUSING 4645

PET OWNERSHIP POLICY FOR SAN JUAN SCHOOL DISTRICT HOUSING

4645.1 GENERAL

1.1

Tenants of San Juan School District housing may own and/or maintain in their housing unit household pets, subject to the following pet ownership and maintenance policy. The District reserves the right to make changes to this policy as circumstances warrant and to notify each tenant accordingly.

1.2 The District's housing administrator is granted the authority to monitor and enforce the pet ownership and maintenance policy. Violations of the pet ownership policy may lead to revocation of a tenant's renting privileges.

1.3 A Tenant must obtain pre-authorization to keep a pet in any District housing unit in accordance with the terms of this policy. Tenants may own or have no more than two pets in their housing unit. Any animal not meeting the definition of a "pet" in this policy shall not be permitted.

4645.2 DEFINITION

"Pets" mean the following domesticated, common household animals, and no others: cats, dogs, birds, turtles and fish. All dogs and cats must be less than 14 inches tall, measured from the floor to the shoulder and may not exceed 25 pounds (adult size). One bird cage may be kept. Only one aquarium, which shall not exceed 25 gallons, may be kept. One enclosure not exceeding 25 gallons in size, suitable for housing turtles may be kept. Each cage of birds, each aquarium and each turtle enclosure shall count as one animal for purposes of this policy. Dogs and cats must be spayed or neutered. This definition may not apply to animals that are used to assist the disabled.

4645.3 APPLICATION

Prior to housing any pet in a housing unit owned/or operated by San Juan School District, a tenant shall apply for and receive and an approved permit to do so. The application must be accompanied by the following:

3.1 A full pet deposit of $200.00 (per household). This deposit is in addition to the standard deposit collected from all tenants. This deposit is refundable within 14 working days after the Tenant disposes of the pet or vacates SJSD housing if SJSD verifies that there are no expenses directly attributable to the presence of the pet. However, for expenses exceeding the deposited amount, the household shall be responsible to reimburse SJSD

for those costs. In addition to the pet deposit, each tenant owning a dog or cat will be charged a non-refundable fee of $50.00 per month (per animal). This non-refundable pet fee will cover reasonable operating costs expended by the District associated with the increased maintenance costs relating to the presence of pets. Employees must agree to pay this monthly pet fee and any additional pet charges via payroll deduction.

3.2 A signed veterinarian's statement or other evidence acceptable to the housing administrator verifying that the animal is in good health, has no communicable diseases or pests, has received all current inoculations or boosters, and, in the case of cats and dogs, is spayed or neutered.

3.3 A signed affidavit from an alternate custodian who will take temporary custody of the pet from the premises for period of time not to exceed 10 days when the Tenant is to be away overnight or longer and will assume all the responsibilities of the pet owner in caring for the pet. In addition, the alternate custodian must be available to take temporary custody of the pet from the premises within twelve hours after any emergency causing the owner not to be able to care for the animal.

3.4 A signed statement from the Tenant acknowledging that:

A. Tenant has received and read the Pet Rules and agrees to comply with them; B. Tenant accepts any and all financial and personal liability associated with the

personal pet ownership in the District's housing. This financial and personal liability includes, but is not limited to, property damage to District Property, property damage to the property of others and injury to persons caused by their pet; and

C. Tenant authorizes the District to withhold and offset from any money or salary payable to Tenant such amounts as the District deems reasonable to cover Tenant's responsibility for damage or injury.

3.5 SJSD may request a letter of reference from the pet applicant's previous landlord.

3.6 SJSD may require the Tenant to maintain "renter's insurance" covering damage or liabilities arising from injuries caused by the Tenants pet[s].

4645.4 APPROVAL OF PET APPLICATION.

Once all of the applicable conditions for application for pet ownership permit have been met, the housing administrator or his/her designee shall make a decision on the resident's application within five working days. If approved, the resident will be informed in writing and an anniversary date (Month and Day Only) will be established for purposes of the annual update of the pet ownership permit. It is the responsibility of the resident to re-validate the pet ownership permit within 30 days after the anniversary date. Failure to re-validate the pet ownership permit shall result in the removal of the pet or termination of the Tenant's tenancy or both.

4645.5 REFUSAL OF PET APPLICATION

The housing administrator or his/her designee may refuse to approve a pet application due to the following reasons:

5.1 The animal does not meet the definition of pet.

5.2 Tenant fails to provide complete application information required by the Pet Ownership Policy or agree to the terms of District's policy for pet ownership.

5.3 The housing administrator determines that the Tenant will not be able to keep the pet in compliance with the Pet Rules and other Rental Agreement obligations, including such factors as pet's temperament and size and tenant's habits and practices.

4645.6 REVOKING PET OWNERSHIP

Maintaining a pet in a facility owned and/or operated by the District shall be subject to the rules and restrictions set forth in District policy and the Tenant's rental agreement. The Tenant's pet ownership may be revoked at any time, due to any of the following reasons:

6.1 The housing administrator determines that the pet is not properly cared for.

6.2 The pet presents a threat to the safety and security of other tenants, SJSD employees, contractors and others on the premises.

6.3 The pet is destructive or causes an infestation.

6.4 The pet disturbs other tenants for reasons including but not limited to noise, odor, cleanliness, sanitation, and allergic reactions.

6.5 Tenant fails to re-validate the pet ownership permit as required in the Pet Ownership Policy.

6.6 Tenant fails to pay the monthly non-refundable pet fee.

6.7 A written recommendation from the onsite housing administrator indicating a demonstrated lack of cooperation and responsibility in maintaining a pet.

6.8 Other violations of rules and restrictions as outlined in District policy and/or the Tenant's rental agreement.

4645.7 RULES

All tenants allowed to keep a pet shall comply with the following rules:

7.1 No pet may be kept in violation of state law or local ordinances with respect to humane treatment or health.

7.2 If pets are left unattended for a period of twenty-four (24) hours or longer, the Management may enter the dwelling unit to remove the pet. The Management will transfer the pet to the proper County authorities. SJSD accepts no responsibility for the animal under such circumstances.

7.3 No animal shall be kept, raised, or bred for any commercial purpose.

7.4 Dogs must wear identification tags specifying resident's name and housing unit number.

7.5 All pets shall remain inside the Tenant's dwelling unit. No pets of any kind shall be permitted within school buildings.

7.6 When taken outside the unit, dogs must be kept on a leash and controlled by a responsible individual. Pets that are unleashed or unattended on SJSD property may be impounded and transferred to County animal control officials or another appropriate animal shelter.

7.7 No animal may be leashed to any stationary object outside the Tenant's apartment.

7.8 Birds must be confined to a cage at all times. Turtles must be confined to an aquarium or other suitable enclosure.

7.9 Vicious and/or intimidating breeds of dogs or animals with a history of attack or aggressive behavior towards other animals or people will not be allowed. Examples may include: Rottweiler, Doberman Pinscher, Pitt Bulldog, and any reptile other than a turtle.

7.10 The tenant shall have pets restrained so that maintenance can be performed in the housing unit. The tenant shall, whenever an inspection or maintenance is scheduled, either be at home or shall have all animals restrained or caged. The District shall not be responsible if any animal escapes from the residence due to maintenance, inspections or other activities of the landlord.

7.11 Tenants shall not permit their pet to disturb, interfere, or diminish the peaceful enjoyment of other tenants. The terms "disturb", "interfere", and "diminish" shall include but not be limited to barking, howling, chirping, biting, scratching, and other like activities.

7.12 Tenants must provide litter boxes, which must be kept in the dwelling unit for cat waste. Tenants shall not permit refuse from litter boxes to accumulate nor to become unsightly or unsanitary. Litter shall be changed not less than once a week and placed in a sealed plastic bag, properly disposed of by being placed in a trash container outside of the building, and at no time washed down any drains or flushed down any toilets.

7.13 Tenants shall take adequate precautions and measures necessary to eliminate pet odors within or around the unit and shall maintain the unit in a sanitary condition at all times.

7.14 Tenants are responsible for cleaning up waste from their pet both inside and outside the dwelling unit and on facility grounds. Waste must be disposed of by being placed in a sealed plastic bag and then placed in a trash container outside of the building. At no time is pet waste washed down any drains or flushed down any toilets.

7.15 Tenants shall not alter their dwelling unit, patio, or unit area in order to create an enclosure for any pet. No doghouses, animal runs, pet doors, etc. will be permitted.

7.16 Tenants are responsible for damages caused by their pets that are beyond normal replacement of floor coverings and fumigation.

7.17 The housing administrator may designate specific units where pet owners must live and may direct such moves as may be necessary to establish such areas. The areas may be adjusted and the housing administrator may direct such additional moves as may be necessary to meet changing needs. The housing administrator shall provide adequate written notification to tenant should any designation be made. Tenant agrees to comply with the District's request to move pursuant to this paragraph.

7.18 Tenants are prohibited from feeding, housing or harboring stray animals. The feeding of stray animals shall constitute having a pet without the written permission of the District and may result in eviction from District housing.

7.19 The District housing administrator or his/her designees are authorized and directed to capture, and/or transfer custody to appropriate County or other authorities any unleashed, unattended, or stray animal found on San Juan School District premises.

7.20 Guests may not bring pets (any type) onto the premises. No pet sitting will be allowed except as allowed as an alternate custodian pursuant to the terms of this policy.

4645.8 ANIMALS THAT ASSIST THE DISABLED

8.1 These Pet Rules will be modified as necessary for animals that are used to assist the disabled.

8.2 To determine which rules, if any, do not apply to a service animal, a tenant must provide a written certification of the disability of the person in Tenant's household from a licensed medical doctor on a form provided by the SJSD verifying that:

a. The animal is trained to assist persons with the specific disability.

b. The animal actually assists the disabled individual.

8.3 Once Tenant has provided this information, the District will meet with Tenant to determine which rules shall be modified or eliminated.

4645.9 VIOLATION OF RULES

Violation of these rules may be grounds for removal of the pet or termination of the Tenant's tenancy or both.

4650.1 GENERAL

Requests for repair or replacement are to be submitted to the Housing Agent. The tenant will be expected to take certain precautionary measures to prevent serious maintenance problems. Any damage to District housing caused by tenants or negligence by tenants will result in charges being levied.

4650.2 PAINTING

No painting, paper hanging or installing of contact paper is to be done without advance approval of the housing maintenance specialist. When, in the judgment of the Housing Agent, a unit needs painting a request shall be submitted to the buildings and grounds director who will schedule the painting on a priority basis and as funds allow.

4650.3 WOOD-BURNING STOVES

Tenants shall not install wood-burning stoves in the units.

4650.4 GROUNDS AND YARDS

Cars, trailers, trucks, etc., are not to be driven over the lawn areas at any time. Any planting or fencing done by the tenant must receive the advance approval of the buildings and grounds director and will be considered as a permanent improvement which is to remain as part of the property.

All tenants must keep personal property picked up and cleared from grass areas so lawns may be mowed. Tenants are not allowed to store inoperable vehicles, tires and vehicle parts, any type of machinery, discarded or unused appliances or otherwise clutter any School District property with any personal items.

Vehicles not licensed or vehicles not in an operable condition for more than three (3) months may not be stored on District housing property or parking lots and must be removed.

4650.5 REMODELING

A tenant is not to remodel or alter their housing unit in any way. Any remodeling of District housing must have prior approval of the District buildings and ground director.

4660.1 RULES

The maintenance of high standards of personal behavior and appearance is essential to the preservation of a healthful and peaceful environment. This includes graciousness and consideration for other people and the observance of high principles of honor, integrity, and morality. Respect for property and personal rights is essential.

Tenants will be expected to abide by the following rules established for District housing.

1. Tenants shall use District housing as a residence only. For purposes of this housing policy, a "residence" shall be defined as a space to be used primarily for living space and not for commercial or industrial purposes.

2. Tenants will provide reasonable care of house, yard and fixtures.

3. The District shall have the right to inspect housing units to determine maintenance and care, after giving proper notification.

4. Tenant's failure to maintain housing adequately will constitute grounds for eviction for District housing.

4660.2 VIOLATION OF RULES

A tenant may be asked to move for violation of housing rules. Such a request to vacate shall be made in writing, and only after prior notification explaining the problem has been given.

DISTRICT HOUSING GRIEVANCE PROCEDURE 4670

4670.1 DISTRICT HOUSING TENANT GRIEVANCE PROCESS

1. It is acknowledged that certain complaints or minor irritations may develop where employees are involved in a decision-making process. It is expected, however, that in most instances the employees of the District will be able to meet and solve these problems by adhering to a professional code of ethics and maintaining friendly relationships among their associates.

2. In the event that a problem arises which cannot be, or is not, solved satisfactorily, the aggrieved employee is encouraged to present this problem or complaint to the Housing Agent. The Housing Agent shall use all means at their disposal to settle such problems in a fair and equitable manner to all parties concerned.

3. An aggrieved person, not satisfied after having met with the Housing Agent, may petition the Housing Administrator for an interview. The Housing Administrator will review the facts in the case and use all means at his disposal to settle the matter fairly.

4. All school employees have the right to appeal to the Board after having had their complaints reviewed by the Housing Administrator. The Housing Administrator shall arrange such an appeal with the Board. The aggrieved person may have another person or persons accompany them and testify in their behalf if they desire. After such a hearing, the decision of the Board shall be final.
