Open Forum CWU Attendance – Steve Bennett, Plumbing Program Coordinator, College of Western Idaho (CWI), stated there are 240 plumbing apprentices currently enrolled in the CWI Plumbing Apprenticeship Program. The number reflects both classroom and on-line students. Cross Connection – Bill Arnold, Cross Connection Specialist, City of Lewiston, was concerned should the 2015 Uniform Plumbing Code (UPC) be adopted, contractors would not be able to install double check valve assemblies in irrigation boxes. For clarification, the American Water Works Association (AWWA) manual can be used for the next year and double checks will still be allowed. Another concern is a valve open in the ground would be subject to flooding without any backflow device other than a meter and possibly a dual check. If approved at the 2017 legislative session, section 603.5.17 Potable Water Outlets and Valves will be removed from the new code and contractors will be able to use stop and waste valves underground. City and County Concerns – Brian Peltzman, Meridian Plumbing, questioned why a city would require two permits, one for plumbing and one mechanical for venting, to change out a

tank-style water heater to a tankless water heater. In statute, a plumber can run all associated venting to the water heater if doing the entire job; however, through an ordinance, a city may elect to implement a plumbing enforcement program greater than what is required by the state of Idaho. The Division does not have jurisdiction over the city in question; therefore, Mr. Peltzman will need to contact the city directly.

Approval of October 6, 2016 Agenda The Compliance Program Supervisor had a training session in the early afternoon. Therefore, a request was made to move agenda item seven Compliance Program Report in front of agenda item five Automated CEU System. MOTION: Gilbert Pond made a motion to accept the agenda with the change. Rick Garrett seconded. Vote called. All in favor, motion carried.

Approval of July 19, 2016 Minutes MOTION: Rick Garrett made a motion to approve the minutes as written. Debbie Oberhofer seconded. Vote called. All in favor, motion carried.

Schedule 2017 Board Meetings

The 2017 Idaho Plumbing Board meeting dates are as follows: February 16th, May 18th, July 27th and October 12th. MOTION: Rick Garrett made a motion to approve the following 2017 board meeting dates: February 16th, May 18th, July 27th and October 12th. Gilbert Pond seconded. Vote called. All in favor, motion carried. ACTION: The 2017 Plumbing Board meeting dates will be placed on the Division’s board calendar and website.

Compliance Program Report Supervisors and inspectors were acknowledged for assisting with complaints. The Compliance Program Supervisor continues to search social media for non-compliant individuals and check licenses at job sites.

Automated CEU System The Division is in the process of automating continuing education units (CEUs). An outside carrier will keep track of licensee’s CEUs at no cost. The identity of each individual will be by license number only.

Plumbing Program Manager Report

Statute Rewrite – For 2017, the Plumbing Program Manager would like to discuss the following statute rewrites: 1) Idaho Code § 54-2602 Exceptions, 2) License fees and 3) $2,000 bond requirement.

Backflow Prevention – This issue was addressed earlier in the meeting under the title Cross Connection. It was suggested to get rid of the AWWA manual since the standard for backflow prevention on plumbing systems is already in the Idaho State Plumbing Code. There will be discussions throughout next year on the backflow side of the UPC. Schooling Requirements – The Division has discussed with the Career and Technical Education (CTE), formally known as Professional Technical Education, on how they manage components of the plumbing education programs. In statute, the Board has control of standards and procedures, rules for examinations, qualification and certification of plumbing contractors, journeymen and apprentice plumbers and continuing education requirements for journeymen and plumbing contractors. Rather than continue to come to the Board for permission to make changes to curriculums, etc., the CTE will approach the Division over the course of the next year in hopes there will be statutory provisions to address this situation.

Contractor Exam – Board Member Pond has received numerous complaints that the contractor exam is based on business-related topics only. It is Board Member Pond’s desire to revisit this issue and for the exam to have more questions specific to the trade.

Board Member Garrett requested a copy of the current exam. The Division is unable to provide the test; however, the Plumbing Program Manager will get a copy of the Contractor’s Business and Law Reference manual to Board Member Garrett.

ACTION: The Plumbing Program Manager will provide Board Member Garrett with the Contractor’s Business and Law Reference manual.

IAPMO Conference – In September, the Plumbing Program Manager attended the International Association of Plumbing and Mechanical Officials 87th Annual Education and Business Conference in Albuquerque, New Mexico. Reports – The following reports were reviewed: 1) Plumbing Journeyman First Exam Attempts, 2) Plumbing Notice of Violations/Civil Penalties Issued and 3) “Verification” Inspections by Inspectors.

Operational Report

Legislation – The following proposed statute and rule changes will be presented at the 2017 legislature: 1) Board pay from salary to honorarium, 2) Standardization of HVAC and electrical provisions, 3) Contractor civil penalties, 4) Refunds and transfers of permits, 5) Idaho Plumbing Code updates and 6) 16,000 hours of work experience in lieu of 8,000 hours and four years of schooling for out-of-state plumbers.

A temporary rule on shower/threshold requirements was not allowed by the Governor’s office; however, it will move forward as a pending rule.

Administrator Report

Financial Report – The Idaho Plumbing Board Fund, FY 2017 financial statement as of August 30, 2016, was addressed.

Personnel - The Division has requested an additional compliance officer in the budget proposal. If approved, the individual will be located in the Meridian office. A Tale of Two Cities – A comparison of the FY 2008 and FY 2018 budgets was provided. The approved budget in FY 2008, and the requested budget for FY 2018, was/is a little over $14 million dollars. Compared to 2008, the Division is doing more with less employees.

AWWA manual for backflow prevention and using the Idaho State Plumbing Code (ISPC) as written in Section 603.5.6. This would have discontinued the use of DCBA for sprinkler and irrigation systems. The Board asked this topic be brought back up for further discussion.

Potable water supplies to systems having no pumps or connections for

pumping equipment, and no chemical injection or provisions for

chemical injection, shall be protected from backflow by one of the

following devices:

(1) Atmospheric vacuum breaker (AVB)

John Nielsen Program Manager / Plumbing 1090 East Watertower St Meridian, ID 83642 RE: Plumbing Code changes Mr. Nielsen, I am writing to you to share my concerns regarding the potential updates to the State of Idaho Plumbing Code. I trust you will forward my thoughts along to the Plumbing Board and any other interested parties. My understanding is that the currently proposed changes to the Plumbing Code have been delayed until the 2018 legislation session due to concerns specifically dealing with double check valve assemblies and their application on irrigation systems. While I can understand that some feel that it is better to maintain the status quo and are more comfortable leaving current regulations in place, I see this as an opportunity to bring the rules to be more in line with industry standards and nationwide professional best practices. As an example, I would like to share some of the following reference: The 2009 International Association of Plumbing & Mechanical Officials (IAPMO) code: Section 603.4.6.1 states that sprinkler and irrigation systems must have backflow prevention protection in the form of valves utilized for high hazard conditions. This is due to the longstanding classifications of irrigation systems as high hazard. The 2015 American Water Works Association (AWWA) Manual M14: This manual which is considered an excellent industry reference for cross connection control states the following; (Begin excerpt) Irrigation Systems Irrigation systems include but are not limited to agricultural, residential, and commercial applications. They may be connected directly to the public water system, internally to the private plumbing system, or to both systems. However, the irrigation system is a high hazard for several reasons. Most systems are constructed of materials that are not suitable for use with potable water. Sprinklers, bubbler outlets, emitters, and other equipment are exposed to substances such as fecal material, fertilizers, pesticides, and other chemical and biological contaminants. Sprinklers generally remain submerged in water after system use or storms. Irrigation systems can have various design and operation configurations. They may be subject to various onsite conditions such as additional water supplies, chemical injection, booster pumps, and elevation changes. All of these conditions must be considered in determining proper backflow protection. Solutions of chemicals and/or fertilizers are used in or around irrigation systems for many purposes. Some of the chemical compounds that may be injected or aspirated into or come in contact with these systems include • Fertilizers: Ammonium salts, ammonia gas, phosphates, potassium salts.

• Herbicides: 2,4-D, dinitrophenol, 2,4,5-T, T-pentachlorophenol, sodium chlorate, borax, sodium arsenate, methyl bromide • Pesticides: TDE, BHC, lindane, TEPP, parathion, malathion, nicotine, MH, and others • Fecal matter: Animal and other

Protection recommended. Irrigation systems connected to the public water system should be

considered a high hazard, and the appropriate protection is an air-gap separation or a reduced-pressure principle backflow prevention assembly. A properly installed pressure vacuum breaker assembly (PVB) may be used for service protection if the water service is a dedicated supply to the premises or property and used strictly for irrigation (such as for median islands and parking strips). The installation requirements for a PVB must be closely adhered to, requiring proper elevation and no means or potential means for backpressure. The local authority having jurisdiction should be consulted. Irrigation systems connected internally to the private plumbing system are considered a high hazard. Appropriate backflow protection for such internal applications is outlined in the local plumbing code. However, if the system is not protected according to the water supplier’s requirements or if the water supplier lacks jurisdiction over internal plumbing code compliance, protection should be required at the service

connection as previously outlined. (End of excerption)

During my over 17 years of providing backflow assembly testing services, my experience has been that most of the failures during tests on irrigation assemblies are of faulted double check valves. To help illustrate this I have provided a table below representing the number of valves I have tested on irrigation systems and the failure rate of the different types of assemblies. Overwhelmingly double checks have the highest failure rate.

2016 276 27 15 11 1 A failing double check valve is not providing the needed protection to the system owner and the service provider. Unfortunately, since double check valves do not show any easily recognizable symptoms for failure, the only way to ensure they are operating in the proper manner is to test it. It is my direct experience that many double check valves have not been tested for numerous years which, compounded by the high failure rate, means the protection to the system owner and service provider is not being maintained. Unlike double check valves, high hazard assemblies all have some type of visual indicators as to when they are not working properly to help in diagnosing and expediting their repair. An additional complication of the double check valve is that their assemblies are VERY often installed in underground irrigation boxes, which many times allows for the valve to become submerged. These installations become “Out of sight , Out of mind”, forgot and regularly untested or maintained.

There is also a misconception that high hazard valves are more expensive than double check valves. Most irrigation systems are able to have pressure vacuum breakers (PVB) installed which has a relatively comparable cost to a double check valves. Reduced pressure principle assemblies (RP) may be slightly more expensive than a double check valves and PVB's but provide the benefit of protection as the highest form of mechanical protection against backflow. My professional opinion is that these very small cost differences should not be encumbrance to the health and safety protections provided by backflow requirements. This is a priority that the board has shown for safety in the requirement of RP's on supplies to carbonated fountain drink dispensers, which I whole heartedly support. I have seen this safety oriented approach in some local agencies in Idaho that have forbidden, through their local code/ordinance, the application double checks on irrigation. These local code/ordinances have been in place for quite a few years and resulted in no undue difficulties to the consumer or the water system. It is my understanding that those irrigation systems that have existing double check valve assemblies installed are allowed to keep them until the assembly needs to be repaired or replaced and then are required to bring the installation up to current requirements and install the required high hazard assembly at that time. There is solid industry rational for the requirement of high hazard assembly requirements on irrigation, as this has been in the IAPMO/UPC for many years. Idaho is one of the very few states that currently still allows for double checks to be installed on irrigation systems. I professionally and personally as a resident of Idaho, feel we should follow suit with the current professional standards and best practices to only allow high hazard assemblies on irrigation systems. This is concerning the health and safety for all and I do not feel we should jeopardize these for convenience or the smallest monetary burden. I present to you that I support removing the PNWS AWWA Cross-Connection Control Manual as the standard for backflow requirements. This reference is not a code manual and we should be following the available code material for enforcement. Again, I applaud the board with this decision. § 54-2606. Powers and duties of the Idaho plumbing board

(3) The board may exercise such powers and duties as are reasonably necessary

to carry out the provisions of this chapter, and it may among other things:

(a) Establish the fees to be charged for permits and inspections of plumbing

systems.

(b) Hold public meetings and attend or be represented at such meetings, within or

without the state, prepare and publish rules pertaining to this chapter, and such

other information as may be necessary, and furnish copies thereof to those

engaged in the business, trade, practice or work of plumbing and pipefitting and

to the public upon request.

(c) Furnish standards and procedures and prescribe reasonable rules for

examinations, qualification and certification of plumbing contractors and

journeymen and apprentice plumbers not herein prescribed, including the

establishment of continuing education requirements for journeyman and

plumbing contractors.

(d) Require applicants for plumbing contractor and plumbing specialty contractor

licenses to provide certificates issued by an insurance company authorized to do

business in Idaho showing that the applicant has procured and has in effect:

(i) A general liability insurance policy, including products and completed

operations insurance covering the applicant’s operations in the sum of not

less than three hundred thousand dollars ($300,000) single limit; The name

of the insurance company, the insured and policy number shall be made

available only to persons or their insurers in the event that they bring a

claim against the contractor. Required insurance coverage shall be

maintained at all times when a contractor’s license is active; and

(ii) A worker’s compensation insurance policy. the furnishing of a

compliance bond by plumbing contractors in an amount not to exceed two
