Comments Clean-up ongoing, Mr. Martin will follow-up as needed.

On March 17, 2016, Mr. Ron Martin, with Buchanan County Codes Enforcement and I conducted an investigation into allegations of dumping at the above listed location. Mr. Martin had visited the home prior to my arrival and contacted Mr. Sean Tomkins regarding the excessive amount of solid waste he had on the property. During the time of the investigation on 3-17-16, much of the waste had been removed, and it appeared the clean-up efforts were still ongoing. There was a large truck with waste on the back and a skid steer pulled up to a pile of waste with waste in the bucket.

Ron stated that he would check back by the residence in a week or so to check on progress and agreed to advise DNR on the situation as the need arises.

Residential Waste Disposal / Burning

Concern Info Sean Tompkins appears to be hauling waste to the property and burning it. The caller does not know when the last time the pile was burned. It has been going for quite awhile. The caller first heard about it two weeks ago. The waste is residential. There is approximately one truck load of waste on the burn pile right now that has not been burned. Drives White F-150 MO license 5CR-078. The caller said he has seen the truck loaded with waste. Trash is now blowing offsite all over the neighborhood.

During the call the caller was outside of the property. A lady showed up and he spoke with her. I overheard her say that the waste was just coming from the property and was not being hauled from offsite. The caller is certain that waste is being hauled to the property because of the quantity of waste and because it was in the truck.

Concerned party has photos of waste and is a Buchanan County Code Enforcement Officer. He offered to accompany an investigator onsite.

Concern Info This is a repeat issue. A caller said the Mr. Hill burned again on Thursday March 3, 2016. The caller said that the fire was really large and was still smoldering and would probably continue to smolder for a while. Lathrop Fire Dept. responded to the fire.

I arrived on site 3/17/16. Upon arrival, it appeared as though the alley identified by CP was a private driveway; a truck was parked in it at the road on the east side. I drove around the block; there is no entrance on the west side. The BBQ restaurant was closed, possibly out of business. There is a large wooden privacy fence between the garage and the restaurant. No one was on site at either location. I looked through the fence slats and did not see any evidence of open burning from there. No violations observed.

Concern Info CP states that he was walking his dog on 3/10/16 and noticed a pile of burned oil filters near the alley way behind (north of) "Trent's BBQ". CP states he has photos of the burn. To the west of the restaurant is a car garage, CP believes that is where the filters came from.

According to GIS, both the plot where the restaurant and the garage are owned by the same individual.

Comments No excessive odors were detected during the investigation.

On March 22, 2016, I responded to the above concern. Upon arrival to 19501 Fightmaster Road, there was no evidence of any odor described by the concerned party. I drove around the neighborhood and could not detect any odor. I then drove State Highway W and C where there were fields that were recently plowed and could not detect any odor from the fields.

I called the concerned party to tell her of my findings, and she told me that the odors only lasted for a week. I told her about the recent plowed fields and told her that could have been where the odor came from. She told me that at the corner of C and W Highway were some piles of manure in the fields, and that could have been it . I agreed and told her that if the odor came back to call in and we would be back out to investigate.

Concern Info Caller reports that there has been a very putrid odor coming from the northeast. They have talked with the neighbor to the north, and have determined the smell is coming somewhere east or northeast of the neighbor's property. They have lived here for several years and have not smelled anything like this before.

I explained that the odor was likely from land application and would likely be exempt from the odor regulation; however, I would have an inspector drive through the area in an attempt to find the source.

Arrived on site on 3/31/16, there were about 6 cars parked outside and one in the garage. I spoke to Scott Meadows, brother of the property owner Brandon Meadows. Together they work on auto body repairs. Scott told me they typically work on one car a day, and have a couple of long term projects they work on periodically. I was also told that they only do body work, and do not typically do any car maintenance work such as oil changes. They do a little bit of painting but it is usually small touch ups. Any painting is done in the garage.

There were some car batteries located outside, which Mr. Meadows told me he would immediately move them inside the garage.

It had recently rained, and there was no evidence of oil sheen in the puddles under and around the cars parked outside, leading me to believe that little car work is done outdoors and that the area is kept very clean.

On March 28, 2016, I responded to the above concern. Upon arrival to 22105 State Route 371 there was no evidence of fugitive dust leaving the property of Buildex, Inc. I went into the office and asked to speak with Mr. Barnett, vice president of production about the dust concern. While I was waiting for Mr. Barnett I spoke to Mark about the concern and asked to see any records of watering the haul roads and entrance and exits of the facility. He told me that if there was it would be on the time sheets of the maintenance workers. Mr. Barnett came into the break room and I explained the reason for my visit and he also told Mark to look on time sheets of the workers of when the roads were watered last week (3/21-3/25). Mark found three days that the roads were watered last week; Monday, 3-21, Tuesday 3-22, Wednesday 3-23 and Thursday 3-24 until noon when they stopped quarrying. In Buildex's construction permit 0994-016 it states that unpaved haul roads and storage piles shall be watered whenever conditions exist which are capable of producing visible emissions. The permit does not require any watering records. The facility also has a basic operating permit, and does not require watering records. I reminded Mark and Mr. Barnett that when fugitive dust is leaving the property boundary, going towards highway 371 that watering has to take place and more than once per day to keep the dust down from truck travel.

Concern Info Concerned caller requested to remain anonymous.

The CC reports excessive amounts of dust being stirred up by trucks entering and leaving the Haydite plant at 22105 371 Highway near Dearborn, MO 64439.

The CC states this has been an ongoing issue for months, and the situation has grown worse lately. CC stated the dust clouds are huge during operating hours and have become a great concern for her and her neighbors.

The CC stated she has not reported this to any other agency.

Concern Info Caller reported that one year ago someone in Melbourne (on 146 east of Gilman City) dug a pit, burned some tires in it over night, then added another load on top after it had gone out, and then buried it all. Caller did not know specific address or nearby intersection or property owner's name. He stated that it is on the south side of the highway in town on a junky property with 7-8 junk cars. He stated that there is still a bald patch of dirt where the tires were buried. Caller requested to remain anonymous.

I arrived at the site and found a burn pile about 7 feet in diameter. The burn pile contained construction and demolition waste.

I contacted the Nodaway County Assessors office and determined the property's address was 318 East Elm and owned by Mr. Rick Stanton. Mr. Stanton is hard to get ahold of according to the assessors office and my attempts to contact him in regards to previously issued LOW. The sheriff's department gave me two numbers that might help in contacting him, but I got no response at the phone numbers. The P.O. box is where his tax records get sent.

A possible address that he may live at is 310 W Elm Street in Skidmore.

Concern Info Rick Stanton is burning a double wide trailer house. He started a few days ago. Not burning at this time. He is salvaging and burning the waste. Caller believes he owns the property where the trailer is located.

Concerned party advises that Mr. Stanton will hide from investigators.

In my opinion I believe they may have lit the smaller one using gas, and as kids do lit the huge pile because let’s be honest small fires are cool, huge fires as really cool. Does not have a distinct smell. Noticed it last night. Fist time this has happened. Unilever does salad dressing and tea and now he thinks they are doing dry powdered seasonings. Used to be a big field between he and property, but just built an addition closer to him. Just wants to make sure it is nothing toxic in his yard.

At 5:20 p.m., Mr. Pease called me back. He stated the Braymer Fire Chief was aware of the issue and the situation has been resolved.

Concern Info Tuesday there was an underground natural gas leak in Braymer school. Maintenance man told principal that the kids would be ok. There was also a basketball game that night and a couple of kids went to the hospital for this. No work has been done on the school, but it is believed that the leak has been fixed. The school closed last Tuesday after the game and it has opened today.

Comments LOW sent to property owner for burning of prohibited items.

Seth Norcross and I arrived on site April 13, 2016. Immediately we could see a large burn pile of demo debris, tires, and household trash. We circled around and parked on the road. We stopped a neighbor in the road to ask if they knew if anyone owned the property or was dumping and burning trash. They stated that they think someone squats on the backside of the property in a fifth wheel trailer and that the house used to be a meth house but burned down. They stated that they were under the impression that the city had condemned the property and owned it. We walked around the pile and took photos. The pile is approximately 20 yards in diameter and 2-3 foot tall in some areas. The pile was made up of carpet, construction and demolition waste, tires, lumber, household waste, and other metal and fiberglass materials. We took photos and proceeded to the West Peculiar Fire Protection District.

At the fire station we obtained three incident reports along with photos. The fire department also informed us that Chief Randy Powers had sent the property owner a letter stating they had referred the burning issue to MoDNR. We obtained a copy of that letter. Chief Powers sent the letter to the property owner as listed on the county web site, Lynn Hercules. The fire department also believes that squatters are starting the fires. No other contact information can be found for Ms. Hercules besides a mailing address.

Cass County Collector lists Lynn Hercules as the one who paid the real estate taxes on December 31, 2015. A letter of warning will be mailed to the property owner, Ms. Hercules. The LOW will contain fact sheets on open burning and solid waste topics, as well as a copy of the open burn regulation. A response will be required within 35 days.

Concern Info Randy Powers of South Metro emailed me stating that he would like to file a concern for 24717 S Donahue Road in Peculiar. "They have tires and other debris that they are burning on a vacant lot on a somewhat regular basis" he was advised from West Peculiar FPD.

Randy suggests the Sheriffs attend with investigator. It is not clear if anyone lives on site or not, but when RP is there they can be combative.

I have attached the emails and incident report from Randy/West Peculiar FPD.

Concern Info Every single day one or the other of these two manufacturers elicit the foulest odors that permeate the southern part of St Joseph. Tonight, it was National Beef Leathers. I almost gagged driving by there and now it has drifted to the air surrounding my home. I do not understand why these two companies continue to foul the air with their GOD awful odors. Is there a reason that they continue to do this? We either get to smell hog waste or beef leather processing smells every day. This should be absolutely unacceptable and I can't possibly believe that it is even remotely to have to deal with these putrid smells for even a short period of time. PLEASE do something with them.

Concern Info Sni Valley responded to a smoke investigation that turned out to be across the street from the address mentioned previously in this report. Sni Valley personnel arrived at the scene to find a large pile of debris, a few tires, at least one mattress, dimensional lumber, and brush burning. Due to the contents of the pile being forbidden (no burning of those items allowed) by MODNR, the fire was extinguished by E1 crew. Sni Tanker was added to the alarm for water supply due to the size of the pile. The property owner was informed of the burn regulations for the district.

Concern Info Concerned party reported that a farmer near their property had cleared 4 fields of trees and was burning the piles. Party said there were 3-4 large piles of trees burning which were next to the woods. Party said the burning was worse at night to where they were having issues sleeping. The smoke is starting to affect their asthema and needed to sleep at the Walmart last night to breathe fresh air. Concerned party does not know who owns the land and has not seen anyone around the burn piles or any vehicles.

West of Harrisonville on 2 HWY past the new justice center. Fields sits at the intersection of 2 HWY and DD hwy. Can see smoke easily. About a quarter mile off the road. Is up against woods.

Burning is on private property. Talked to Central Cass Fire Dept. they said they couldn't do anything about it.

Concern Info Mr. Glenn Bowles is concern about the anhydrous ammonia fumes in the area of his resident and pesticides runoff onto his property. The odor from the anhydrous ammonia fumes in the area is a 24 hour on going problem.

Comments Issue a letter of warning for failure to notify the department and for failure to conduct an asbestos inspection

On April 15, 2016, I investigated to determine if the items being dumped near the Longview Lake Dam. The piles consisted of concrete, dirt and minimal amounts of plastic and metal. Mr. Clever stated that the concrete slabs will be used as riprap to eliminate the erosion caused by wave action. We discussed that rebar needs to be cut out, asphaltic concrete should not be placed under the water level. Mr. Clever stated that the concrete and dirt was from a sidewalk removal in Grandview.

There was a pile of dirt and brick. I contacted John Johnson about origin of this debris. Mr. Johnson stated that this pile came from the demolition of a tool shed on Jackson County Park property. There was no asbestos notification or inspection conducted. So a Letter of Warning will be sent to the Jackson County Parks for failure to notify and asbestos inspection.

Concern Info Either the Army Corps of Engineers or Jackson County is dumping construction trash along the northwest corner of Longview Lake in South Kansas City off 109th. This would include hazardous waste like paint and plastics along with various other construction debris that doesn't belong in our lake. Which is appears they are dumping it into the lake as well. Looks like a demolished strip mall or something. About 100 tons of garbage, broken asphalt and wiring, general trash and other toxic waste. I would suspect the rising cost of dumping such materials has lead to a backroom deal where they fill our lake with garbage while making some kind of kickback off it. We are notifying the media of this disgraceful and sad act by our own government. We have several photographs of the giant mounds that are growing, full of the garbage and toxic materials being pushed into the lake, which is home to a wide variety of wildlife, including bald eagles. We will provide all needed evidence that proves this was an intentional dump of toxic building materials including paint and other liquid pollutants by those that have access to Longview Lake and provided a gravel roadway to it.

Concern Info Every other night the resident has been burning plastic off of copper wire in his shed causing the entire neighborhood to be filled with smoke. Lawson PD has been called to the area by residents due to the smoke. By the time we get there he would no longer be burring anything and we would not be able to prove he was burning on his property. 0230am this morning Lawson Fire and Lawson pd had to respond to the area again to investigate the smell of smoke. Once again we arrived and the burning had stopped. We have heard from multiple residents that Mr. Wood has been in the small shed behind his residence burning plastic off of copper. I advised Lawson fire last night we would try our best to keep an eye on him. Chief Nolker from Lawson Fire advised to just get ahold of DNR.

The dust from the demolition goes right into the houses located on 2nd street in Chillicothe. The kids are coughing and the person filing the report is concern that this is due to lead paint dust.

On the burm was a pile of sheet rock, vinyl siding, rubber. It has been there a few weeks. Went by there Wednesday March 16th, and Frank Forck was out there with a business truck (Forck Construction) burning the pile. He was adding brush to it to help it burn. The morning after, a partial pile remained. Could see parts of door frames or window frames remaining. Our concern is that there is a small creek just yards away from where the construction material was trying to be burned. There is also livestock just across the road from the pile.

Our concern is for the livestock located across the road from pile of waste is, and a stream is just yards down the hill from the dumping site. It is on Helias drive which is off of route M in Taos, Missouri. They have been dumping construction material there for quite awhile, but he was seen trying to burn it, it did not all completely burn, because you can still see some vinyl siding and frames from doors and windows there.

Comments At the time of my investigation, it was apparent that renovation was taking place. I spoke to Mr. Eric Lawson, who is acting as Manager for the site. Mr. Lawson works directly for the property owner, Ms. Norma Inafuku. I explained the building inspection asbestos requirement of Title 40 Code of Federal Regulations Part 61 Subpart M---National Emission Standard for Asbestos, to both Mr. Lawson and Ms. Inafuku. Since required asbestos building inspection had not been conducted prior to beginning the renovation project, Ms. Norma Inafuku hired a state-certified asbestos building inspector, Mark S. Bonney of Trutest Environmental Solutions, to return to compliance with the asbestos regulation.

Notice of Violation SE1687 was issued on April 6, 2016, to document this violation.

Comments This odor investigation of March 17, 2016, began on 10:13 a.m. and ended on 12:17 p.m. No odor problems were noted. This facility is a distributor of fuel (including denatured ethanol, diesel, and biodiesel) and stores and sells asphalt products (residual oil, asphalt oil, asphalts blended with vulcanizer dispersion (UP1935) and styrene/butadiene copolymer latex (UP7289), cutback asphalt, and cold patch asphalt. Products created onsite are cold patch asphalt and the asphalts blended with UP1935 and UP7298. The facility was monitored especially along Railroad Drive and Business 63, but some time was spent driving through Willow Springs to check for odor in other areas and to check for additional odor sources in the area in order to eliminate other possible suspects. Temperatures were approximately 54 to 60 degrees F. the wind was 5-6 mph and from the west northwest during the observation period. Humidity was about 30-45%. The applicable state air regulation is 10 Code of State Regulations 10-6.165 Restriction of Emission of Odors. It is available on the Secretary of State's website.

No violation was observed.

The facility is applying water and keeping records as required. I returned to the area as weather made observations possible on March 29, 2016; March 31, 2016; and April 5, 2016. On March 29, 2016, I observed the quarry from 2:59 p.m. to 3:30 p.m. On March 31, 2016, I observed the quarry from 2:26 p.m. to 3:30 p.m. And on April 5, 2016, I observed the quarry from 1:37 p.m. to 3:01 p.m. I observed a blast on Tuesday April 5, at 1:43 p.m. and noted that the asphalt plant on site was in operation during most of my observation period on April 5. However, it did not appear that dust generated was leaving Seminole Ag-Lime's property and impacting the neighboring residential area. No violation was observed.

Comments At the time of my investigation, open burning was not taking place. I returned on March 23, 2016; but the business was closed. It was apparent that open burning had taken place; but was not occurring at the time of my visits. I spoke with Mr. Bobby Barnes on March 24, 2016. Mr. Barnes stated that some scrap from a lumber shed had been burned while the shed was being dismantled for use at another location. Since the shed was reportedly, unpainted all-wood construction with tin roofing and some tin for side protection no suspect asbestos-containing building materials would have been involved. Therefore, it was deemed reasonable to proceed with only the open burning portion of the investigation. The rule involved was 10 Code of State Regulations 10-6.045 Open Burning Requirements and was violated because no open burning permit application was made and no open burning permit was issued.

A letter of warning was issued to document this violation of the open burning rule.

Comments At the time of my investigation, Mayor Charlie Lewis was not on site. He is the owner of this property and not the City of Leadwood. I spoke with Mr. Roger Deckard, Foreman and Mr. Daniel Seward, Laborer, who were on site working on the demolition for Mayor Charlie Lewis as a private party and not for the City of Leadwood. The building is a four apartment unit building that had some structural and other problems that necessitated the demolition project. The concrete foundation is solid and will continue to be used for the planned new construction project. The building is not regulated under Title 40 Part 61 Subpart M-National Emission Standard for Asbestos because it is excluded from the definition of a facility as a residential building with four or fewer dwelling units (apartments). For this reason an asbestos building inspection and a demolition project notification to the Missouri Department of Natural Resources were not required. I had discussed this project with Mayor Lewis on March 4, 2016. Mayor Lewis stated that he did have the building inspected by a state-certified asbestos building inspector, Mr. Bryan Giffin, to find out whether asbestos was present. The only asbestos-containing material was non-friable linoleum that was not glued down and could be maintained in a non-friable state during removal and for disposal at a landfill. Mayor Lewis wanted to make sure that he could handle the asbestos removal and transport the linoleum to a landfill for disposal himself and would not have to hire an asbestos contractor. Mr. Deckard and Mr. Seward stated that they had been open burning only untreated wood waste from this demolition project and that the other demolition project waste materials were hauled to the St. Francois County Transfer Station in Desloge for disposal. I informed them that they could not open burn untreated wood waste in the City of Leadwood without an open burning permit from this office. Mr. Deckard telephoned Mayor Lewis and informed him of this issue and then Mr. Deckard agreed to cease open burning at the site. Mr. Deckard, Mr. Seward and I discussed that the wind speed during the day of the investigation made it an unsatisfactory time for open burning, since it was very windy. I spoke with Mayor Charlie Lewis by telephone on April 11, 2016, and requested solid waste receipts for the demolition project and informed him that he would receive a Letter of Warning and could call me if he had any questions. Solid waste receipts dating from late March 22 to April 8 were received on May 9, 2016.

Comments On 4/1/16 I took an Open Burning fact sheet to JV Contracting's place of business just north of Potosi on Highway 21. The owner was unavailable at the time. I informed the receptionist of the concern and to pass on the fact sheet to the owner as open burning of trade wastes is prohibited and is a violation of Missouri Conservation Laws.

On 4/7/16, this second concern came in about JV Contracting.

On 4/12/16, I called and spoke with Mr. Kenny Snowdell, the manager of JV Contracting. He mentioned that the owner owns some rental property on Sansoucie Road. He stated that all of their construction waste is brought back to the business and put in the dumpster for disposal. We discussed what can and cannot be open burned. I mentioned that I was pretty certain I found the burn area on Sansoucie Road, but mentioned that there was Keep Out and No Trespassing signs. Mr. Snowdell said that the owner put the signs up, due to people previously trespassing on the property.

On 4/14/16, I called and left the concerned party (CP) a message to contact me with further information about the site.

On 4/15/16, the CP contacted me and says that the owner of JV Contracting, Mr. Julius Tyler has been burning misc. waste for several years and his family has been suffering from the toxics in the air. He also stated that's it been a couple months since there's been any burning. I asked the CP to contact me if there was any future burning as they have been informed of the open burning regulations twice in the past two weeks.

I will continue to investigate the site on Sansoucie Road routinely when in the area to investigate whether burning is still taking place. The CP is to contact me with any further burning at the site.

I had telephoned Ms. Sue Kaempfe on April 11, 2016, and I made her aware of the asbestos regulatory requirements that an asbestos building inspection be conducted and that a demolition project notification be made to the Missouri Department of Natural Resources' Air Pollution Control Program as per Title 40 Code of Federal Regulations Part 61 Subpart M---National Emission Standard for Asbestos. Ms. Kaempfe employed Mr. Tim Pekios, a state-certified asbestos building inspector with Midwest Environmental Studies. Mr. Pekios conducted an asbestos building inspection on April 13, 2016, and he found that the building contained 12 square feet of vinyl asbestos floor tile and 50 square feet of window glazing. Mr. Pekios assisted Ms. Kaempfe in filling out the demolition project notification. Mr. Pekios' asbestos building inspection report stated that the service station was built on a concrete slab in 1970 and that it has a metal roof and concrete block walls.

On April 21 received a call from Sarah Swisloski. Seems the daughter (Pam) of the home owner, John Cook, now deceased, was contacted by the city and told if she didn’t do something about the dilapidated property, they were going to tear it down and charge her for the demo(Pam is Sarah’s cousin). Since Sarah’s husband owned a backhoe Pam asked if the Swisloski's could help her get rid of the house so Sarah and her husband have been tearing it down and hauling it by the pickup load to their property and burning the rotten lumber and saving the good lumber for their use. As seen in attached photos there is a pile of decent lumber sorted at a different location than the burn pile on their property. Sarah said she didn’t know there were any rules about removing it from the site to burn and didn’t know if the city had told Pam that would be ok to do. Sarah also told me that they do not live in the city but their property adjoins the city. Sarah was asked to immediately halt the demo. Ms. Cook was contacted and told she should start making arrangements to have the demo waste removed and taken to a permitted disposal site. It was discussed that the easiest way to remove the debris would be to call a trash service for a dumpster and let them haul it or if they wanted to take it by the pickup load to a permitted facility they could do that. She was also asked to save all disposal receipts

On April 26, Pam Cook was sent an Unsatisfactory Letter and Report giving 90 days or as required by City of Cabool to complete demo project.

She stated that she didn't feel it was necessary for her to be home either. I investigated the site on 3/18/2016. No odors were detected around the facility off outside of the facility's property boundary. I also drove around the roads around the facility and did not detect odor. I conducted an air pollution inspection at the site also. No violations were noted during the inspection.

On my way back to my satellite office (approaching Wentzville, MO) at approximately 3:05 PM, Ms. Fitch called and I pulled over to take the call. Ms. Fitch stated that she was observing the odor at that very moment and wanted me to turn around. after asking her a few more questions, I asked her if the odor was still occurring. She went outside to check and stated that the odor was now NOT occurring.

CommentsPallet Logistics Management operates a wood pallet recycling operation at this location. Wood pallets are received from various sources. Incoming pallets are inspected, repaired and re-sold to customers. Pallets which are not repairable are shredded and sold in bulk as mulch material.

Non-repairable pallets are conveyed to a shredder which is located behind the building. The infeed conveyor to the shredder has water spray to control fugitive particulate matter. The shredder does not employ water spray control. Shredded material is then placed on a partially enclosed conveyor which transports the material up to the top of storage bins which are approximately 40 feet high. The material then drops into the storage bin in an uncontrolled manner where it is exposed to atmospheric winds resulting in particulate matter going beyond the premises of origin. Shredded material has also accumulated on the top of the storage bin where it remains exposed to wind resulting in particulate matter going beyond the premises of origin.

An Air Pollution Level II State Source Inspection was performed on the entire facility.

Facility must submit a Source Review to determine the installation's permitting and other regulatory requirements.

Concern Info On-Line complaint received by USEPA Region 7Tip or Complaint: Pallet Logistics Management is located near my place of business. They buy and sell millions of pallets according to their website. Pallets that are no longer usable, get sent to a wood chipper which turns them into a very fine saw dust. This chipper is about 40' up in the air and has no dust collection system. Everyday, the cars in our parking lot are covered with a layer of sawdust when we leave. More worrisome, is that we cannot open any of our windows in our office, or they too will be covered with the sawdust in a matter of minutes. This is concerning because some pallets are treated with Methyl Bromide. This has been linked to health problems in humans and ozone depletion. Other pallets have been known to contain formaldehyde. We are concerned enough about breathing in the small particles, but having them possibly be toxic, is very scary. Our employees work outside seasonally, and have to wear hats and safety glasses on some days. We would like to see Pallet Logistics Management install a dust collection that protects humans and the environment. Comments TTT Dustless Blasting Company is at 871 Midpoint Drive, O'Fallon, MO is a mobile sand blasting operation. It has been at this location since January 2016. It operates M-F 8am to 5pm and employs 5 people. It is located in a business park approximately a mile north of I-70 on Midpoint Drive, O'Fallon, MO. Sand blasters are transported to job sites where various types of metal parts are cleaned using media such as glass, copper slag and sand mixed with water. The operation release minimum mount of dust due to use of water in the mix. Some times a blaster may blast parts at 871 Midpoint location when business in the area ( e.g. Fab Tech company at 865 Midpoint Drive) have their metal parts cleaned there.

The nearest residence apartment complex is located about quarter a mile west of the facility with some trees in between. To the east, south, and north of the facility are different types of business most of them car repair shops. No dust found inside or outside the facility.

Blasting LZO'Fallon

Concern Info Sand blasting on items believed to have lead based paint which is leaving debris from premises onto other properties, paint fumes, possibly unventilated which is making employees at neighboring businesses nauseous. This is an ongoing issue which occurs on a daily basis.

At the time of the investigation, the investigator was able to detect the odor of food at the entrance to the site. In addition, the odor of food could be detected in front of the Starbuck and apartment building entrance and at the rear parking area of the building. The Nasal Ranger Field Olfactormeter used to measure the odor strength. The dilution factor required by 10 CSR 10-6.165, Restriction of Emission of Odors, requires the odor be detectable at one volume of odor to seven volumes of odor free air. There was no detection at this level.

Comments Left message for E.J. Brand 4:00 pm 3/25/2016 to call me back to discuss his observations. As of 3/31/2016 I have not heard from him.

On 3/29/2016 I observed the MSD Bissell Sewage Sludge Incinerator (SSI) stack from 1:30 pm to 2:00 pm. The sky was sunny with wispy clouds, wind variable from the SE at 10-20 mph, 35% RH and 60°F. Wispy yellow smoke was being emitted from the stack. It was densest at the stack and the plume trailed off. The sky did not provide good contrast, and due to the height of the stack and dense industrial area it was not possible to get a good background. The sun was high in the sky to the southwest. The wind was not blowing in the direction of Proctor and Gamble (P&G) and the orange wind sock at P&G indicated that it would have been blowing toward MSD's treatment plant and the river. I observed it from the P&G parking lot near the stack and from Ferry and Angelica Streets. The plume appeared to contain some water vapor closest to the stack; the opacity of the plume seemed to be relatively consistent in the 10-20% range. The yellow color has been studied by the industry and is typical for SSI's and for MSD's St. Louis City and County incinerators and although it does not indicate a malfunctioning SSI it is unfortunately being controlled just below the limit for opacity. MSD-Bissell has recently installed new control devices (scrubbers) on SSI's #2, 3 & 4. Performance tests have been performed on all three and the reports are awaiting technical review. Past testing on these existing SSI's have shown emissions of combustion products in typical ranges.

Comments On 3/29/2016 I observed the facility from Courtois St. from 12:30 - 1:00 pm. Conditions were sunny, 65°F, 35% RH and wind from ESE at 10-15 mph (est.). Tractor-trailer traffic was very heavy, about one per minute. Courtois had a lot of dry sand and/or dirt from Italgrani (Polk Ave) to S. Broadway, especially at the curbs. The pavement was broken at the intersection of Polk and Courtois. Nexeo was paved and trailers appeared to be hauling liquids in tank trucks, The road to Italgrani appeared to be mostly paved and tractor trailers were hauling grain to the silos. Three (3) concrete mixer trucks were observed to enter Lemay Concrete Block (LCB) during that time by turning onto Reilly Ave. At the intersection with Courtois, Reilly had a big puddle that extended across the road and was very muddy. It wasn't possible to see the road surface, but it seemed rough when I drove through it.

On 3/30/2016, from 11:00 am - 12:30 pm, I performed an inspection of LCB to determine compliance with their 2001 construction permit. Refer to the full report for details. Conditions were cloudy, 45% RH, 64°F and wind from the south at 10-15 mph. There was some light rain that occurred during the inspection. In spite of the rain, the area of Reilly at the intersection with Courtois was dry and it was possible to see how rough and full of gravel it was. There was good pavement on Courtois and on Reilly on into the facility that was paved to and in the aggregate delivery area (up the hill) and to and in the concrete mixer truck loading and concrete block manufacture areas. The facility stated that they have a sweeper that they use to sweep their haul roads and Reilly up to the unpaved corner. They said the City sweeps Courtois about once per month. The unpaved area gets worse with each vehicle that drives through it and tracks dirt out. It has been there since MSD did sewer work and according to the facility neither MSD nor the City of St. Louis will agree to pave it. LCB will try again to get it done. It is their belief that the majority of dirt on Courtois is from that "hole" with some contribution from the LCB mixer truck traffic and the Italgrani grain truck traffic. We discussed the fugitive dust rule, 10 CSR 10-6.170, and I left them a copy. I explained that if the dirt on Courtois was fugitive dust leaving LCB then it was their responsibility to clean Courtois. They agreed to run their sweeper on Courtois.

Fugitive Dust SWSt. Louis

Concern Info Complainant and 86 year old parent have been living in the neighborhood for many years. Lemay Concrete Block Co. (LCBC) has been there for more years. About 3 years ago the dust being tracked onto the streets (Reilly and Courtois) has become unbearable. Complainant concerned about health and afraid "lime" may cause cancer. Reported that the City of St. Louis Street Department sweeps the street once a month but the excessive dust returns within a couple of days. Reported that MSD cleans out the sewers of large amounts of gravel and sand each year. Reported that residents used to leave windows open but now must keep them closed and must hose down porch and vacuum interior of house. Reported that two (2) new air conditioners purchased both "blew up" and must be replaced again. Reported that LCBC does not have a street sweeper and never cleans. The mud / dust is tracked onto street by the trucks coming and going from LCBC and other trucks and vehicles then kick it up into the air.

LCBC City file shows many complaints in the past but also indicates that they used to have a Basic OP and a street sweeper and water. Permits Reporter shows they were downgraded from Basic to NOP-DemPAL in 2002 and issued CP# 01-05-010 (replacing their 1994 permit and 1978 & 1979 source registrations) by the City of St. Louis in 2001. Concrete production is limited to less than 200,000 cubic yards plant-wide in any consecutive 12-month period, baghouses, pressure drop readings, water spray, visible observations / Method 22 and record keeping.

Comments I arrived at 13683 State Road TT, Festus, MO at 1:25 PM on March 30, 2016 and knocked on the door of the residence. Mr. Richard Mincher greeted me and I told him that I was there to speak with him about a fugitive dust complaint that is coming from his property. I told him that the concern was about the four wheelers in his lot. Mr. Mincher said, "I know and it is not going to stop. This is farm land and, yes, occasionally dust goes across the road." He went on to say that he would fight this in court and that he would not cease allowing people to ride their four wheelers on his land. I told Mr. Mincer that the air pollution rules prohibit people and businesses from allowing fugitive emissions from going across property boundaries. Mr. Mincher stated again that he didn't care and that he would fight this in court if he had to. On 3/30/2016, an officer with Jefferson County Sheriff's office contacted me and told me that they would try to stop the ATVs from a different angle. Sandra Mincher contacted me on 3/31/2016 and I re-iterated the fugitive rules. She indicated that the problem would stop. I sent a letter with a copy of the rules and a fact sheet about fugitive dust to the Minchers for their review. There was no fugitive dust at the time of my investigation.

Concern Info People on 4-wheeler off-road vehicles causing dust from subject property to become airborne and visibly leaving the premises of origin and onto his property. Complainant stated that there was about a dozen of these vehicles last Saturday (3-26-16) from about 1 PM to Midnight, causing dust to land on the streets and on his property. Complainant said this is the about the 5th occurrence since February 4th. The complainant added that the problem stopped after he had reported the matter to the SLRO last Summer but the 4-wheeling has become a problem again and the 4-wheeling occurs mainly on the weekends and in the evenings as well as the Jefferson County Sheriff's Office has been contacted about the 4-wheelers being driven on public roadways.

Comments There was no odors detected at the property boundary surrounding the plant. I drove slowly down Scudder Ranch Road with my windows open and down the gravel road at the back of the plant. No odors were detected. I also checked the service road in front of the plant and no odors were detected.

Concern Info Complainant stated odors are continuing from the Certainteed plant and that she could not handle being outside due to the odors being to bad. Complainant wants to sell her home but is worried she won't be able to with the odors being so bad. Complainant mentioned that there was some sort of 1.5 million dollar tax break given to the company to locate there under a promise that there would be no odor. The complainant also stated that OSHA had investigated an allegation that a neighbor had filed and cited somewhere in a Certainteed response to OSHA that DNR did not find an odor violation. The complainant stated that she has tried to contact the company to report the odor but gets no answer or response from on-site. Most-recently, she attempted to report an odor incident at 7:15 PM on April 1, 2016. The complainant said she has maintained a log of odor incidences that she is willing share with the investigator.

The Part 70 Permit To Operate OP2010-019 issued to the facility on February 10, 2010 was reviewed to determine control device requirements. The facility is not required to have after burner control devices on their dryers.

Air Odors / Particulate DKOwensville

Concern Info Email sent to EPA:Air quality from gas fired dryers. They have no after burners on them and at times it can be seen and smelt 1/2 mile away. Chuck Foster worked on them as a contractor before he had a stroke. On the day that ha had his stroke in the plant he was trying to convince the plant that something needed to be done about the dryers and the discharge air quality. I can't say that I know for sure that it is a problem, but that is what Chuck did for a living for many years and he thinks that it is. Please check it out in the event that he is right.

Dryer stacks are on the roof top and run from 300' to the right of the main entrance and go to the left of the main entrance almost to the end of the building.

ON THAT DAY, HE WAS OUT OF THE OFFICE, BUT ONE GENTLEMAN TOLD ME THAT THE PROBLEM AREA WAS OFF PLANNED INDUSTRIAL DRIVE. THIS STREET IS TO THE REAR OF 4500. I FOUND A PARKING AREA WHICH WAS GRAVEL COVERED, NUMEROUS HOLES IN IT. ON THE DAY OF INVESTIGATION, THE LOT WAS SOMEWHAT WET DUE TO RAIN THE NIGHT BEFORE. A DISCUSSION WITH A DRIVER ON SITE INDICATED THAT WHEN DRY, THE DUST RAISED WAS QUITE HEAVY. I WAS EVENTUALLY PUT INTO CONTACT WITH KEVIN McGOWAN. MR. McGOWAN INDICATED HE WOULD MEET WITH THE PROPERTY OWNER. MR. McGOWAN CONTACTED ME ON MAY 4, 2016 AND STATED THAT THE OWNER WAS GOING TO GET BIDS ON REPAIRING THE SITE.

Concern Info Second complaint, original is #6720, from October 22, 2015.Department of Agriculture Centralized Servicing Center neighbors a Pepsi warehouse where a lot of dust is still leaving their property and blowing and settling on USDA property. This facility is spraying finish products on wooden cabinets, they are using an exhaust fan that pulls these chemicals to the outside with out filtering it at all. They have been doing this process for several months.

They also are taking the buckets that these products come in and are just dumping them on the north side of the building in a hole that had been dug. When this hole gets full enough with buckets and scrap wood products then they burn this site. However there is no way they are getting all these products out of the buckets, so what is left has to be leaking into the ground and the water supply.

This is a very unsafe environment that needs to have something done about the issues that they are creating for the water supply as well as the wildlife that is in the area.

Concern Info Caller said contractors burned 8 large piles of trees this weekend. Caller said a lot of neighbors are upset about the ongoing smoke, they have started a facebook group that now has 68 persons but caller did not give the name of that group. Caller called the FD, no response, called the sheriff who contacted the FD, FD responded, attempted to put out some of the fires as there is a burn ban, got one of the trucks stuck. Caller said she is allergic to trees and she has hives in her throat and other symptoms, also that her neighbor is on breathing treatments, also that the Truman elementary school is closer than she is and they have complained about the smoke. She said it is still burning, it is in the woods and this will be a long term project hired by the city of Oronogo, unknown contractors, to doze the trees and make a reservoir. Caller said it is hard to get to area, could go through her property but it is in the woods.

Concern Info Concerned party states that four mobile home collect their trash into very large pile of garbage and that when the pile gets large enough the residents burn it. The garbage is also causing infestation of flies and the caller stated that they have found several dead animals on there property assuming that they were poisoned by the residents as well.

Comments I investigated the site on March 25, 2016. I spoke with Mr. Marler, and he informed me that he had fired an employee on February 16, 2016 for stealing and for drug abuse. He thought the concerned party may have been this former employee. I then inspected the two mechanic garages that belong to Alliance Motors. I observed the used oil barrel and the used coolant barrel, and I did not see any signs of dumping. Mr. Marler showed me all areas of the property, and I did not see any signs of oil or coolant being dumped. He stated that they take their oil to Oreilly's to be recycled. I did not see any water quality or hazardous waste violations. I told Mr. Marler to make sure that his employees keep the bungs on the barrels sealed, and to keep the tops of the barrels clean and free of oil residues.

The company awarded the contract by Joplin, Gator Industrial LLC/Jordan Disposal LLC, is NOT a Missouri certified asbestos removal/disposal contractor (at least the company/companies do NOT appear on the MO Department of Natural Resources webpage listing of certified contractors).

Many concerned residents of Galena, KS, just six miles across the state line, fear the hazardous ASBESTOS waste from this demolition project might be disposed of in the Galena C&D landfill, operated by Jordan Disposal LLC.

Can someone in the MO DNR please verify that the hazardous ASBESTOS waste from this project will be removed and properly disposed of by a CERTIFIED contractor, in accordance with MO laws?Thank you for a prompt reply as this demolition project is scheduled to begin at any time!

The concerned party states that they live amount a mile from the quarry and they cannot open window and doors due to the dust the cars are always dusting as well. The concerned party states that someone really needs to go take a look at the quarry due to they feel the owner is not living up to everything that was told to the citizen. The concerned party is also very concerned about the blasting and property damage. I recommended to the concerned party to contact the quarry and ask if a seismograph could be placed at the residence to see if the quarry is within the permitted limits as well as I provided the information of the Missouri Division of Fire Safety in regards to who regulates blasting concerns. The quarry is T & M Stone Fair Play Quarry on Hwy 123 south of Fair Play. I do not see an Air Pollution permit number but there is a water pollution permit number MOG491306

Concerned party said to call him first and he will give access to his property so the inspector can see the trash and carpet inside of the pile. The caller stated that there are several people who live adjacent to the property that have serious health issues and they are asking for help to get Mr. Millman stopped before he sets the trash on fire.
