    SUWECT: Granting Study Leave Privilege to DENR EmployeesPreparing for their Board/Bar Examinations orCompleting their Master's Degree Program.Pursuant to Civil Service Commission Resolution No. 04101 6 dated 14

    September 2004, the following guidelines (a squoted) ar e hereby adopted:"Section 1. SEC. 68. STUDY LEAVE. OFFICIALS ANDEMPLOYEES, EXCLUDING THOSE IN THE TEACHING PROFESSION WHO ARECOVERED BY DIFFERENT PROVISIONS OF LAW, MAY APPLY FOR STUDY

    LEAVE SUBJECT TO THE FOLLOWING CONDITIONS:"I. THE STUDY LEAVE IS A TIME-OFF FROM WORK NOT

    EXCEEDING SIX (6) MONTHS WITH PAY FOR QUALIFIEDOFFICIALS AND EMPLOYEES TO HELP THEM PREPARE FORTHEIR BAR OR BOARD EXAMINATIONS OR COMPLETE THEIRMASTER'S DEGREE. FOR COMPLETION OF MASTER'S DEGREE,THE STUDY LEAVE SHALL NOT EXCEED FOUR (4) MONTHS.THE LEAVE SHALL BE COVERED BY A CONTRACT BETWEENTHE AGENCY HEAD OR AUTHORIZED REPRESENTATIVE ANDTHE EMPLOYEE CONCERNED. NO EXTENSION SHALL BEALLOWED IF THE OFFICIALS OR EMPLOYEES AVAIL OF THEMAXIMUM PERIOD OF LEAVE HEREIN. IF THEY NEED MORETIME TO COMPLETE THEIR STUDIES, THEY MAY FILE A LEAVEOF ABSENCE CHARGEABLE AGAINST THEIR VACATION LEAVECREDITS.

    11. THE BENEFICIARY OF SUCH LEAVE SHALL BE SELECTED ONTHE FOLLOWING REQUIREMENTS:

    1. THE OFFICIAL/EMPLOYEE MUST HAVE A BACHELORS DEGREETHAT REQUIRES THE PASSING OF THE BAR OR BOARDEXAMINATION FOR THE PRACTICE OF PROFESSION;2. THE PROFESSION OR FIELD OF STUDY TO BE PURSUED MUST

    BE RELEVANT TO THE AGENCY'S MANDATE, OR TO THE DUTIESAND RESPONSIBILITIES OF THE CONCERNED OFFICIAL OREMPLOYEE, AS DETERMINED BY THE AGENCY HEAD;

    3. THE EMPLOYEE MUST HAVE RENDERED AT LEAST TWO (2)YEARS OF SERVICE WITH AT LEAST VERY SATISFACTORYPERFORMANCE FOR THE LAST TWO RATING PERIODSIMMEDIATELY PRECEDING THE APPLICATION;

    4. THE EMPLOYEE MUST HAVE NO PENDING ADMINISTRATIVEAND/OR CRIMINAL CHARGES;5. THE EMPLOYEE MUST NOT HAVE ANY CURRENT FOREIGN OR

    LOCAL SCHOLARSHIP GRANT;6. THE EMPLOYEE MUST HAVE FULFILLED THE SERVICE

    OBLIGATION OF ANY PREVIOUS TRAINING/SCHOLARSHIP/STUDY LEAVE GRANT; AND7. THE EMPLOYEE MUST HAVE A PERMANENT APPOINTMENT.

    HOWEVER, AS THE PURPOSE OF GRANTING A STUDY LEAVE ISTO DEVELOP A CRITICAL MASS OF COMPETENT AND EFFICIENTEMPLOYEES WHICH WILL REDOUND TO THE IMPROVEMENT OFTHE AGENCY'S DELIVERY OF PUBLIC SERVICES, EMPLOYEESWITH COTERMINOUS APPOINTMENT MAY BE ALLOWED TOAVAIL OF THE STUDY LEAVE PROVIDED THAT THEY:a) MEET THE REQUIREMENTS UNDER ITEMS 11.1 TO 11.6;b) WOULD BE ABLE TO FULFILL THE REQUIRED SERVICEOBLIGATION; ANDC) . ARE NOT RELATED TO THE HEAD OF AGENCY OR TO ANYMEMBER OF A COLLEGIAL BODY OR BOARD, IN CASE OF

    CONSTITUTIONAL OFFICES AND SIMILAR AGENCIES,WITHIN THE 4 T H DEGREE OF AFFINITY ORCONSANGUINITY.

    THE FOLLOWING ARE THE CORRESPONDING SERVICE OBLIGATIONSTO THE DENR WHICH CANNOT BE TRANSFERRED/SERVED IN OTHERGOVERNMENT AGENCIES: I

    TH E BENEFICIARIES O F THE STUDY LEAVE SHALL INFORM THEIRRESPECTIVE AGENCIES IN WRITING, THROUGH THE PERSONNEL OFFICE,O F THEIR FAILURE T O TAKE TH E BAR/BOARD EXAMINATION OR TOCOMPLETE THEIR MASTER'S DE GR EE FO R WH ICH THEY WERE GRANTEDTHE STUDY LEAVE. THEY SHALL ALSO REFUND TO THE AGENCY ALLSALARIES AND BENEFITS R ECEIVED DURING THE STUDY LEAVE. FUR THE R,FOR CAUSES WITHIN THEIR CONTROL, THEY SHALL BE WARNED THAT AREPEAT O F THE SAME WOULD BAR THEM FROM FUTU RE AVAILMENT O FTHE STUDY LEAVE AND TRAINING/SCHOLARSHIP GRANT WHETHERFOREIGN OR LOCAL.

    2.4 Officials/employees can avail of th is privilege only once.Failure to complete the boa rdlbar review classes or pa ss theboard/bar examinations or complete their master's degreeprograms (comprehensive or thesis process) within theperiod of the gran t does not entitle the official or employee toanother privilege or extension. Extensions of the study leaveshall be charged against the official's/employee's leavecredits.2.5 Deferments of the study leave privilege shall not be allowed.2.6 Due to budgetary constraints, there shall be no financial

    ass istance to be extended by the DENR2.7 The RED/RD shall submit a report on the academic st atusof the officials/employees who availed of the study leaveprivilege. Such report shall contain, among others, thefollowing:

    a. the review school or educational institution where theboard/bar reviewees and thesis writers are enrolled,respectively;b. da te of boardlba r examinations or da te of completion

    of thesis process;c. documentary proofs of enrollment;d. approved thesis outline and time frame within whichto finish th e thesis writing; ande. ot he r information which the RED/ RD/ ~ u r e a ;Director/Head of Attached Agency deem as necessary.

    This Memorandum Circular supersedes DENR Memorandum Circular No.2001-10 and all other orders, circular and memoranda inconsistent herewith.This will take effect Calendar Year 2006.
