NOTICE OF DRAFT RESOLUTIONS(Pursuant to PU Code § 311(g))

Draft Resolution Authorizing Vessel Common Carriers To Temporarily Adjust Fares And Rates Available For Public Review And Comment

A draft resolution (TL-19042) of the Consumer Protection and Safety Division that gives vessel common carriers (VCCs) temporary authority to adjust their passenger fares and freight rates without specific Commission authorization will be on the June 9, 2004, Commission meeting agenda. The Commission may vote on this resolution at that time, or it may postpone a vote until later. When the Commission votes on Resolution TL-19042, it may adopt all or part of it as written, amend or modify it, or set it aside and prepare a different resolution.

The resolution was drafted in response to a request made on behalf of Blue & Gold Fleet, L.P., Angel Island-Tiburon Ferry, Inc., and Catalina Freight Line for the Commission to authorize VCCs to assess a surcharge to offset significant increases in fuel prices. The resolution would authorize VCCs for a 180-day period to raise their fares and rates as much as 15% above their currently authorized fares and rates.

Summary: On April 28, 2004, Mark Pocta, Program Manager of the Office of Ratepayer Advocates (ORA), met with Cmmr. Wood in an all-party meeting in San Francisco. Also present were Manuel Ramirez and Steven Weissman, advisors to Cmmr. Wood, Bruce Foster and Frank Cooley of Southern California Edison Company (Edison), Marcel Hawiger of The Utility Reform Network, James Weil of Aglet Consumer Alliance and Mark Joseph of the California Coalition of Utility Employees. Pocta stated that ORA supported the proposed decision (PD) of the ALJ even though they did not support the manner in which all issues were addressed. On balance, Pocta asserted that Edison was treated very fairly and prevailed on many issues. Pocta expressed his objection to Edison’s use of 2003-recorded expenses to assert that they are spending more than requested, given these costs have not been analyzed. Pocta emphasized that the methodology used by SCE for calculating net salvage costs is flawed. Pocta explained the reasons that the PD correctly rejected SCE’s request to add $2.5 million to the SONGS Refueling Outage costs. Pocta indicated that although ORA appreciated the alternate decision (AD) of Cmmr. Wood adopting quality assurance measures, ORA could not support the performance standards in the AD due to the significant upside potential to Edison. Pocta explained that the PD’s elimination of the attrition floors disregards the fact that the CPI-based mechanism negotiated by the parties results in attrition increases substantially less than compared to the traditional methodology proposed by PG&E, and supported by ORA.
