1. INTRODUCTION

1.1. Western Digital must guarantee environmental compliance for all materials, components and parts used in the assembly of WD products. Information on environmental compliance will allow WD to: Satisfy legal and regulatory requirements; Drive improvements in product design; and Respond to inquiries from customers, product recyclers and other stakeholders.

1.2. This document describes Western Digital’s specifications for prohibiting, restricting, and reporting certain chemical compounds/materials/substances in WD’s products or manufacturing processes.

1.3. This document describes Western Digital’s compliance and certification plan.

1.4. This specification describes WD suppliers requirements for compliance to WD environmental specification.

2. SCOPE The scope of this specification applies to:

2.1. Products designed, manufactured and sold by Western Digital

2.2. Products contracted to a third party by Western Digital for design and manufacturing, and sold by Western Digital with its trademark/logo (including Branded Products)

2.3. All components, materials and other items used within the products mentioned in items 1 and 2

2.4. Components and materials (including electrical components, mechanical components, electro-mechanical components, semiconductors, printed circuit boards, enclosure components and packaging)

2.5. Assembled components such as functional units, modules and board assemblies

2.6. Auxiliary materials such as solder, adhesive, etc. that may be used in WD products

2.7. Packaging materials used for transport and protection to customers (e.g. trays, reels, bags, cushioning & foam, boxes, inks or dyes or paints for printing labels, tapes, shrink wrap, etc.)

2.8. Packaging materials used to ship components to Western Digital and Western Digital subcontractors (including electrical components, mechanical components, electro-mechanical components, semiconductors, printed circuit boards, enclosure components ) must meet Western Digital packaging requirements for cadmium, hexavalent chromium, lead, mercury, PBBs and PBDEs (Section 7.36).

3. REGULATORY REQUIREMENTS 3.1. Although these specifications have been developed in accordance with the current principal laws and

regulations, they do not necessarily refer to all revelant regulations. All products shall fully comply with the treaties, laws, ordinances, industry guidelines and other requirements effective at the time of production introduction in addition to these specifications.

5. TERMS AND DEFINITIONS For the purposes of this specification the following definitions apply:

5.1. Article: As defined by the EU with respect to REACH, an “Article” is an object which during

production is given a special shape, surface or design which determines its function to a greater degree than does its chemical composition. The HDD is an article. Components are articles. Homogenous materials are not necessarily articles.

5.2. Article Level: The threshold applies to the WHOLE part/product (e.g. components, sub-assemblies), not to the homogenous material as in EU RoHS.

5.3. CAS Number: CAS numbers are unique numerical identifiers for chemical substances assigned by the Chemical Abstracts Service (CAS) for its chemical substance registry system.

5.4. Conflict Minerals- Tin, tungsten, tantalum, or gold from any source whose supply chain, back to the mines of origin of the minerals used to produce these metals, contributes to human rights abuses in the Democratic Republic of Congo or adjoining countries.

5.5. Contained: Contained refers to a substance which is added to or blended with a part or material.

5.6. Critical Minerals – A mineral can be regarded as critical only if it performs an essential function for which few or no satisfactory substitutes exist and the supply of which has a high probability of becoming restricted, leading to physical unavailability or excessive costs for the applicable minerals and materials in key applications

5.7. Full Material Disclosure – Disclosure of all chemical substances, by Chemical Abstract System (CAS) number, present in each homogenous material in a part or assembly

5.8. Halogen Free or Low Halogen- Descriptive term for products, components and materials that contain less than 900ppm total chlorine, less than 900ppm total bromine and less than 1500ppm total chlorine and bromine

5.9. Homogeneous Material: Homogeneous materials are those of uniform composition throughout, which cannot be mechanically disjointed into different materials.

5.10. Impurity: An impurity is a substance with is present in a natural material or generated in a synthetic process, neither of which can be removed by technical means.

5.11. Intentionally Added: Intentionally introduced or intentionally added shall mean deliberately utilized in the formulation of a material or part where its continued presence is desired in the final product to provide a specific characteristic, appearance or quality.

5.12. Material: A material is made up of one or more substances (e.g., copper alloy is a material, which in turn is made up of a number of defined substances, copper, nickel, silver, etc.).

5.13. Mechanically Disjointed: Mechanically disjointed means mechanically separated by cutting, unscrewing, grinding, crushing, etc.

5.14. Nanoparticles: A natural, incidental or manufactured material that contains particles in an unbound state or as an aggregate or as an agglomerate and where, for 50% or more of the particles in the number size distribution, one or more external dimensions is in the range 1nm-100nm

5.15. Not Detectable: Not detectable means that the substance is not detected using the specified analytical technique.

5.16. Non-Ferrous Metals: Any metal, including alloys, that does not contain iron in appreciable amounts.

5.17. PPM: Parts per million, unit of measurement for weight percentage. 1 ppm = 1mg/kg = 0.0001% by weight. The parts per million thresholds listed in this specification refer to the weight of the material in a specific part, not the weight of the material in an entire system.

5.18. Preparation: a solution or mixture of two or more substances (ink, adhesive, paint).

5.19. Prohibitted: Banned or Use not allowed.

5.20. REACH: European Commission Regulation Number 1907/2006 concerning the Registration, Evaluation, Authorization and Restriction of Chemicals.

5.21. SVHC (Substances of Very High Concern: Chemical substances identified through the procedure specificed in Article 29 of the REACH Regulation as well as those that criteria specificed in Article 57 of the REACH Regulation

5.22. RoHS: European Union Directive 2002/95/EC and the recast RoHS Directive 2011/65/EU, “Restriction on the use of Certain Hazardous Substances (RoHS) in Electrical and Electronic Equipment”. The RoHS substances regulated at this time at this time include lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls and polybrominated biphenyl ethers.

5.23. Substance: A chemical element and its compounds in the natural state or obtained by any manufacturing process, including any additive necessary to preserve its stability and any impurity deriving from the process used, but excluding any solvent which may be separated without affecting the stability of the substance or changing its composition.

5.24. Threshold Limit: The maximum concentration or level at which the material or substance can be present in a specific part or component, based on the requirements of this specification.

5.25. WEEE- European Union Directive 2002/96/EC of the European Parliament and of the Council on Waste Electrical and Electronic Equipment.

6. MATERIALS AND SUBSTANCES CLASSIFICATION

Classes of materials and substances that must be managed and declared

6.1. Substances Prohibited by Governmental Laws and Regulations

Substances or materials whose use has been banned or restricted by existing regulations. The material is acceptable if not intentionally added or is present in a quantity below the threshold limit per homogeneous material, where a threshold limit is listed.

6.2. Substances Restricted by REACH Substances of High Concern (SVHC)

The Registration, Evaluation, Authorization and Restriction of Chemicals (REACH) 1907/2006/EC Regulation of the European Parliament and of the Council of December 2006 requires Western Digital to provide information to recipients of articles placed on the market in case substances are present in the article, which are listed on the candidate list for inclusion in Annex XIV of this regulation and present above a concentration of 0.1wt/wt%. Companies must respond to consumer inquiries within 45 days. Both product and packaging must be considered articles under REACH. Suppliers shall

monitor the development of the candidate list for inclusion in Annex XIV of the REACH Regulation. To avoid such reporting, the use of SVHC substances is restricted

6.3. Substances Prohibited/Restricted by WD specification

Substances or materials whose use has been banned or restricted by existing WD specific

requirements. The material is acceptable if not intentionally added or is present in a quantity below the threshold limit per homogeneous material, where a threshold limit is listed.

6.4. Substances Restricted by Halogen Free/Low Halogen Specification

Substances or materials whose use has been restricted by WD halogen free/low halogen specification.

6.5. Substances Restricted by Packaging Specificatiion Substances or materials whose use has been restricted by WD specification on drive and component packaging.

6.6. Reportable Substances

Substances/materials that the industry has determined relevant for disclosure, no reductions or restrictions are currently set for these materials. However, appropriate recycling or disposal must be considered. Actual use or non-use must be reported.

6.7. Conflict and Critical Minerals

In Additon to the standardized template ( CMRT-Conlict Minerals Roporting Template) from the Electronic Industry Citizenship coalition (EICC), amount of each of Gold, Tantalum, Tungsten and Tin has to be decalred. WD HDD components like MBA, VCM, Disk Media, PCBA ICs and other metal components contain some of the critical elements identified. While there seems to be no short term (2-3 years) constraints on HDD’s components supply with regards to these critical minerals, awareness must be disseminated in expectation of coming regulations from US and European government sectors on critical minerals. Supply amount and pricing of this minerals are expected to be affected and close monitoring will be maintained. WD will have a proactive stand by surveying suppliers of their awareness and plan to research possible alternative materials that rely less on these minerals.

8. CONFLICT MINERALS

WD prohibits the use of minerals mined in armed conflict regions, sometimes referred to as“conflict minerals”. The WD conflict mineral policy can be found at: http://www.wdc.com/en/company/globalcitizenship/supplychainmgmt.aspx

All suppliers of materials,components and subassemblies containing tantalum, tungsten, tin, gold that have the potential to be derived from minerals mined in armed conflict regions must disclose Smelter information using the standardized template from the Electronic Industry Citizenship coalition (EICC). Further questions on conflict minerals can be directed to WD EICC Coordinator ([email protected])

WD Ethics Hotline has now been updated to reflect conflict minerals. http://www.wdc.com/en/company/governance/EthicsHotline.aspx Procurement department is responsible to ensure the new supplier sign the declare the conflict minerals / metals (EICCGeSI Due Diligence) before the supplier qualification activity starts.

8.1 Requirements for WD Conflict mineral All suppliers of materials,components and sub-assemblies containing Tantalum, Tungsten, Tin and Gold that have the potential to be derived from minerals mined in armed conflict regions must disclose Smelter information using the standardized template ( CMRT-Conlict Minerals Roporting Template) from the Electronic Industry Citizenship coalition (EICC). Supplier must use smelters certified as conflict free with CFSP: Conflict Free Smelter program or CFSP equavalant programs if not supplier must declare migration plan /actions plan to ensure that Tantalum, Tungsten, Tin and Gold not be derived from minerals mined in armed conflict regions

9. COMPLIANCE AND TESTING CERTIFICATION PLAN

9.1. The compliance to WD’s Environmental Specification is administered by multiple cross-functional organizations. Anthesis Group, a 3rd party Service Provider under contact to WD, is responsible for collecting and validating compliance data from the supply chain. Org chart can be distributed upon request.

10. Laboratory Testing for Verification of Compliance 10.1. Homogeneous materials in each component part shall be tested for RoHS critical substances by ISO

17025 RoHS accredited labs using methods referenced in IEC 62321. 10.2. For WD part numbers with designations XXXX-77XXXX and XXXX-80XXXX-. Total Halogen must be

tested for using the method listed. 10.3. Phthalate testing is required one time only for each material or guarantee letter 10.15 10.4. Testing shall be performed at the request of the material or component supplier and provided to

Western Digital along with the Material and Substance Composition Sheet as part of First Article Qualification.

10.5. Testing of homogeneous materials shall be performed at least once a year. 10.6. Testing of PCBA solder paste to be performed every six months. 10.7. Reports shall be valid for WD use up to 1 year from sample testing date and will be maintained on file

by WD for 13 years. 10.8. Homogeneous Materials reports can be used for multiple WD part numbers if the material and

process are identical. 10.9. Use of a non-certified lab must have prior approval by WD and must demonstrate that it meets or

exceeds the required detection limits corresponding to the threshold limits given in this document. 10.10. Any laboratory used should follow industry standard good lab practices and have a documented

quality control policy in place. 10.11. The substances to be tested and required test procedures are given below. 10.12 Any homogenous material which, when tested, has a result for a prohibited or restricted RoHS & HF

substance, that is greater than 80% of the threshold limit, must document a corrective action plan to reduce the amount of the substance in the material to below 80% of the threshold limit. Supplier required to perform XRF inspection follow Proc#2092-771950 and submit XRF report to WD Product Environmental Compliance SQE once a quarter.

10.16 Laboratory Testing Data for Auditing 10.16.1 WD part numbers for RoHS compliant components are numbered XXXX-7XXXXX-XXX and

XXXX-80XXXX-XXX 10.16.2 WD part numbers for RoHS compliant and halogen free components are numbered XXXX-

77XXXX-XXX and and XXXX-80XXXX-XXX 10.16.3 Supplier testing data may be required on an audit basis, at a process level, material level or

final component level. 10.16.4 The need for such an audit will be determined based on supplier history of compliance,

material risk and to understand levels of possible banned substances in new materials or components.

10.16.5 Suppliers who can show evidence of thorough and well documented environmental programs, with a history of supplying environmentally compliant materials around the global market may be considered low risk with little of need for an on-going audit plan.

10.16.6 New suppliers with a limited history of supplying compliant products, and without an official environmental policy may be considered higher risk and require an audit plan.

10.17 Laboratory Test Methods-General

10.17.1 There exists no single method for testing for all of the restricted, prohibited and managed substances. For guidance, follow document IEC 63231 for appropriate testing methods

10.17.2 In all cases, a homogenous material should be tested. If a component, made up of two of more materials, is tested, then the component should be either processed (physical grinding or chemically dissolved) into a homogenous state.

10.18 Process Control and Documentation

10.18.1 Process Control Plans documented by the supplier and approved by the appropriate Western Digital personnel will also be used to ensure compliance to this specification.

10.18.2 Suppliers are required to have documentation indicating which materials are used in the manufacture of components and assemblies made for Western Digital. This documentation should outline how materials are confirmed to be compliant to this WD Environmental specification.

10.18.3 There is no requirement for every batch of incoming materials to be tested for compliance. 10.18.4 Suppliers shall take reasonable measures to ensure compliance.
