Dokumentari synon të ndikojë tek autoritet e ngarkuara për ti dhënë
zgjidhje çështjes së të zhdukurve në Shqipëri. Synon gjithashtu të
sensibilozojë familjarët e të zhdukurve për tu bërë pjesë e procesit
përmes deklarimeve për të afërmit e tyre. Dokumentari synon
gjithashtu të sensibilozojë institucionet shtetërore të angazhohen
maksimalisht për të marrë në mbrotje vëndet e vuajtjes.
Shoqëria shqiptare duhet të përballet me këtë të shkuar gjakësore
për ta pranuar dhimbjen e asaj pjese që u prek rëndë nga diktatura
dhe për t'iu kthyer eshtrat e të afërmve.
Në të kundërt, kjo pjesë e shoqërisë shqiptare, pasardhës të mijëra
viktimave të diktaturës do të vazhdojë të jetë e lënduar, për fatin
tragjik të të afërmve të tyre.
The documentary aims to influence the authorities in charge of
resolving the issue of missing persons in Albania. In addition, it aims
to motivate the relatives of the missing persons to become part of
the process through the provision of statements regarding their lost
relatives. Also, the documentary aims to prompt the State
institutions to do their utmost to protect places of suffering.
The Albanian society must face its bloody past to acknowledge the
pain of those who suffered the most by the dictatorship.
In case that this will not be achieved then this vulnerable and
discriminated part of Albanian society, the descendants of
thousands of victims by the dictatorship, will continue to be hurt by
the tragic fate of their relatives.

me AIDSSH dhe ICMP dhe organizata të tjera të përfshira në këtë
process. Marrëveshja që pritet të arrihet në të ardhmen synon
lehtësimin e procedurave për nisjen e procesit të zhvarrimeve.
Dhe së fundi shfaqet problematika e vendeve të kujtesës, ku
humbën jetën 5157 të zhdukur gjatë diktaturës komuniste. Janë
vetëm dy vende, që janë marrë në mbrojtje nga Ministria e
Kulturës: Kampi i Spaçit dhe ai i Tepelenës, ndërsa numërohen
me dhjetëra të tilla në të gjithë Shqipërinë. Stafi që përgatiti këtë
dokumentar ka shkuar në shumë prej vëndeve të kujtesës, atje ku
sot kanë mbetur vetëm gjurmë. Për shkak të shpërfilljes së
institucioneve shumë prej tyre janë zhdukur dhe dy kampet që
ministria e Kulturës ka marrë në mbrojtje, janë në gjendje të
mjerueshme.
The documentary includes the General Prosecutor's Office
statement, which explains that an agreement is being drawn with
the AIFSSD, the ICMP, and other organizations involved in this
process. The agreement, which is expected to be reached in the
future, aims to the facilitation of better conditions and more
favorable legal provisions which will assist in the start of the
exhumation process.
Finally, the problem of memorial sites is presented, where 5157
people lost their lives during the communist dictatorship. There
are only two such sites that have been taken under protection by
the Ministry of Culture: the Spaç Camp and the Tepelena Camp,
while there are dozens of others in all of Albania. The staff that
prepared this documentary has visited the majority of these
memorial sites, where today only traces remain. Due to the
neglect of the institutions, many of them have disappeared,
while the two camps that are under the protection of the Ministry
of Culture are in a miserable condition.

The process of searching and finding
the missing persons of the communist dictatorship
Bazuar në të dhënat zyrtare të konfirmuara në konventën e OKB-së
për personat e zhdukur me forcë, rezulton se: Elementet e zhdukjes
me forcë në Shqipëri, evidentohen gjatë periudhës së diktaturës
komuniste. Sipas të dhënave zyrtare, rezultojnë 5157 persona të zhdukur apo të ekzekutuar për motive politike, pa vendim gjykate,
gjatë periudhës 30.11.1944 - 01.10.1991.
Shqipëria e ka miratuar këtë konventë në vitin 2007 dhe ka marrë
përsipër të garantojë nisjen e procesit të identifikimit të
vendvarrimeve e më pas të nisjes së procesit të zhvarrimeve.
Deri tani janë bërë hapa minimalë drejt zbatimit të kësaj konvente.
Është ngritur Autoriteti për Informimin mbi Dokumentet e ish-
Sigurimit te Shtetit (AIDSSH), i cili në bashkëpunim me Komisionin
Nërkombëtar për Personat e Zhdukur (ICMP) dhe Institutin e
Integrimit të Ish të Përndjekurve Politikë (IIPP) duhet të kryejë
procesin e gjetjes, zhvarrimit dhe identifikimit të personave të
zhdukur me forcë gjatë diktaturës komuniste. Procesi është në fazën
e parë, të mbledhjes së dëshmive për vendvarrimet e të zhdukurve
me forcë.
Deri në dhjetor 2020, janë 643 raste raportimi nga familjet e personave të zhdukur dhe burime të tjera, në lidhje me personat e
zhdukur nga regjimi komunist prane IIPP, AIDSSH dhe ICMP.
Në tetor 2016, një grup pune nga OKB vizitoi Shqipërinë për të
verifikuar se si po zbatohen pikat e konventës nga pala shqiptare.
Grupi i punës konstatoi me keqardhje se për shumicën e pikave nuk
është bërë asnjë hap përpara.
Ndër të tjera, konventa detyron qeverinë shqiptare t'i garantojë viktimave të zhdukjes zgjidhje efikase, përfshirë dhe një proces
hetimor 'ex officio' të plotë dhe të paanshëm me synim identifikimin
e atyre që pretendohet se janë përgjegjës për zhdukjet, si edhe
vendosjen e sanksioneve të përshtatshme.
Lidhur me këtë pikë, grupi i punës pranë OKB-së konstatoi me
shqetësim se gjatë kësaj kohe ka ndodhur e kundërta, pasi në
administratën e lartë shtetërore janë punësuar persona, të cilët
pretendohet se kanë qënë pjesë e procesit të zhdukjes me forcë
gjatë diktaturës komuniste. Në raportin e grupit të punës
konstatohet se prej momentit të ratifikimit të konventës nga
Republika e Shqipërisë, nuk ka pasur asnjë rast që është hetuar apo
gjykuar për krimin e zhdukjes me forcë.
Dokumentari i titulluar “Pesha e baltës” është i fokusuar pikërisht tek
problematika e procesit të kërkimit dhe gjetjes së personave të
zhdukur me forcë gjatë diktaturës komuniste.
Përshkrim i shkurtët i dokumentarit “Pesha e baltës”
Dokumentari bazohet mbi rrëfimet e të mbijetuarve që vuajtën
në kampet dhe burgjet e diktaturës komuniste, studimet dhe
kërkimet shkencore të institucioneve dhe dokumentet origjinale
të arkivave shtetërore.
Pasqyrohet historia e personave të dënuar me internim në
kampin e Tepelenës gjatë viteve 1949-1954, ku humbën jetën
rreth 600 persona, prej të cilëve 300 fëmijë. Ata u varrosën na
shpëatet e maleve afër kampit, buzë lumit të Bënçës. Deri tani
nuk është bërë asnjë kërkim nga institucionet shtetërore për
gjetjen e eshtrave të tyre.
Në dokumentar tregohet historia e dhimbshme e familjes së
Gjetë Kadelit dhe të tjerë të afërmve që prej 30 vitesh janë në
kërkim të eshtrave të familjarëve të tyre të zhdukur me forcë
gjatë diktaturës komuniste.
Nga ana tjetër pasqyrohet qëndrimi i institucioneve që janë
ngarkuar të gjejnë zgjidhje për këtë problematikë të
jashtëzakonshme të Shqipërisë; qëndrimi i Prokurorisë së
Përgjithshme për rolin e munguar të këtij institucioni në procesin
e hetimit të çështjes së zhdukjes së personave me forcë.
Në dokumentar janë bërë pjesë përmes deklaratës, përokuroria e
përgjithshme, e cila sqaron se po punohet për një marrëveshje
Based on the official data confirmed by the UN Convention on
missing persons, it results that: cases of enforced disappearances in
Albania were evident during the period of the communist
dictatorship. According to the official data, 5157 individuals were convicted or executed based on political accusations, without a
preceding court process or verdict, during the period of 30.11.1944 -
01.10.1991.
Albania ratified this Convention in 2007 and assumed the
responsibility of guaranteeing the start of the burial sites'
identification process and subsequently, the beginning of the
exhumation process.
So far, minimal actions have been taken towards the actual
implementation of this convention. The Authority for Information on
Former State Security Documents (AIFSSD) has been established,
which in cooperation with the International Commission on Missing
Persons (ICMP) and the Institute for the Formerly Politically
Persecuted (IFPP) should carry out the process of locating,
exhuming, and identifying persons who were forcefully disappeared
during the communist dictatorship. Currently, the process is in the
first phase; the collection of testimonies regarding the locations of
the missing persons' graves.
As of December 2020, there are 643 cases reported by the families and other sources, regarding the missing persons during the
communist regime, at the AIFSSD, ICMP and IFPP.
In October 2016, a UN working group visited Albania to verify the
degree to which the Articles of the Convention are being
implemented by the Albanian State. The working group noted with
regret that no progress had been made concerning the majority of
the Convention's objectives.
Among other things, the Convention obliges the Albanian
government to guarantee that the cases of the missing persons will receive a full and impartial 'ex officio' investigative process aimed
at identifying those allegedly responsible for their disappearances,
as well as imposing the respective, suitable sanctions.
In regards to this point, the UN working group concluded with great
concern that during this period the exact opposite has happened.
People who are considered of having participated in the forceful
disappearances of certain individuals during the communist
dictatorship have been employed in senior state administration
posts after the fall of the regime. The Report of the UN working
group states that from the moment of the ratification of the
Convention by the Republic of Albania, there has been no case that
has been investigated or tried for the crime of enforced
disappearance of individuals.
Therefore, the documentary entitled "The burden of mud" is focused
on the problematic areas of the process of searching and finding the
missing persons of the communist dictatorship.
Short description of the documentary "The burden of mud”
The documentary is based on the stories of the survivors who
suffered in the concentration camps and prisons of the
communist dictatorship, the studies and scientific research
conducted by institutions, and the original documents derived
from the State Archives.
The story of the people sentenced to internment in the Tepelena
camp during the years 1949-1954 is reflected, where about 600
people lost their lives, of which 300 were children. They were
buried on the slopes of the mountains near the camp, on the
banks of the Bënça River. Thus far, no search missions have been
carried by the State institutions to find their remains.
The documentary tells the painful story of the family of Gjeta
Kadel and other relatives who for 30 years have been searching
for the remains of their family members who were forcefully
disappeared during the communist dictatorship.
Additionally, the attitude of the institutions that are in charge of
finding the necessary solutions to this extraordinary problem of
Albania is reflected; the official stance of the General
Prosecutor's Office regarding the lack of its involvement and
activity in the process of investigating the issue of the enforced
disappeared persons.
