Workforce Minimum Data Set The GPC has been active to address some of the concerns about the submission of the Workforce Minimum Data Set (WMDS), particularly around workload and information governance. Practices have been asked to supply data on their staff, including recruitment, vacancies, absences and personal details, such as date of birth, National Insurance (NI) number and gender.

The data collection is to allow the DH, NHS England and Health Education England (HEE) to understand the current NHS workforce and plan for future needs. The data collection replaces the annual GP census and practices have been asked to submit data through the Primary Care Web Tool (PCWT), with the first data submission due by the end of May 2015. Practices will thereafter be asked every six months to confirm the information held within the tool is correct.

Practices are required by law to provide the information requested for the WMDS.

For the March 2015 collection (with the submission deadline of May), practices will be asked to complete additional data items for clinical staff only, rather than the whole workforce within a practice. For all other staff, the deadline will be extended to the end of November 2015 (to reflect the practice position as at 30 September 2015).

Practices had raised concerns with the inclusion of the National Insurance (NI) number in the dataset. The purpose of the NI number is to act as a unique identifier to map the workforce across different sectors. Following GPC raising the concerns being expressed by practices, the WMDS team has agreed to make the NI number a desirable rather than essential item for the March collection only. This will allow time to consider options for a unique identifier to become mandatory from September 2015.

Important information regarding NeisVac-C vaccine, Boostrix IPV injection and Fluenz Tetra nasal spray suspension Influenza vaccineNHSBSA Prescription Services is making practices aware that where vaccines have been centrally procured for the practice through Public Health England, they should not make a claim under personal administration arrangements to the NHSBSA on form FP34P/D Appendix or FP10. NHSBSA Prescription Services has identified an increase in FP34P/D Appendix forms and FP10 forms claiming payment for Fluenz Tetra nasal spray suspension Influenza vaccine, NeisVac-C vaccine and Boostrix IPV injection where practices have later verified these have been centrally procured via a vaccine ordering facility, such as ImmForm. Practices must not submit payment claims for vaccines or injections obtained in this way to the NHSBSA.

An FP34P/D appendix or FP10 form should only be submitted for payment to cover the ‘dispensing’ of the vaccine for personal administration where the vaccine has been purchased by the practice. Practices who have incorrectly submitted centrally procured vaccines to NHSBSA Prescription Services should contact [email protected].

Generic prescribing of pregabalin A generic version of pregabalin (Lyrica) is shortly to become available, but it only has a license for use in epilepsy and general anxiety disorder with the manufacturer’s patent on use for pain control continuing. The manufacturers have indicated their intention to enforce their patent through the courts, and anyone supplying generic pregabalin for pain control might be open to litigation. While this primarily affects dispensing doctors, others might be troubled by pharmacists seeking to confirm the indications for generic prescriptions. The GPC would therefore advise doctors to prescribe Lyrica by brand when used for its pain control indication for the time being.

The National CKD Audit – England and Wales Detection of chronic kidney disease (CKD) in primary care allows identification of people at higher risk of developing ‘end stage’ kidney disease, acute kidney injury and cardiovascular disease. There is an important balance between the identification and management of risk and a prudent approach to minimise over-medicalisation.

To inform their understanding and encourage better identification and management, NHS England and the Welsh Government have jointly funded a National CKD clinical audit. The aim of the audit is to improve the identification and treatment for patients with CKD. One of the key features of the audit is the serial collection of data on kidney function over time, which will help practices to identify patients with CKD and optimise the care provided to those patients already on the CKD register.

The audit will run automatically so requires no extra work once it is installed. Practices are encouraged to participate so that their data can contribute to the national picture of CKD care. The software also includes an optional Quality Improvement (QI) tool for practices, providing in-consultation computer prompts and lists of patients who potentially need recoding.

The free CKD Audit is available to GP practices who are current BMJ Informatica customers. It will soon be made available to all practices through the new GP Systems of Choice (GPSoC) framework.

Fit for work scheme Fit for Work offers free and impartial guidance and resources that can be used by GPs who are supporting patients facing work-related health challenges. It is designed to help employed people with health conditions, or those who want to return to work after a period of sickness absence lasting or expected to last four weeks or more.

In addition to accessing online resources ( http://fitforwork.org/general-practitioner/ ) around work-related health topics, GPs can use the Fit for Work website to refer patients who have been, or are likely to be, off work for four weeks or more for a health assessment. This free and voluntary referral will culminate in a Return to Work Plan tailored to patients’ needs and focused on helping them return to work in a way that is right for them.

The roll out (https://referral.fitforwork.org/en/gp/referral/eligibility ) of the referral service across England and Wales will be taking place over the coming months.

Work capability assessments GPs often face requests for letters to support appeals to a tribunal for Employment Support Allowance (ESA) following a Work Capability Assessment (WCA). There are Regulations in place that go some way to address concerns about the WCA process and GPs that are approached for letters in support of their patients’ appeals should be aware of them. The ESA Regulations 2013 set out the exceptional circumstances where an adverse decision may pose a substantial risk to the claimant or others in the workplace. These are Regulation 25 and 31 and can be found online. http://www.legislation.gov.uk/ukdsi/2013/9780111531877/regulation/25

These two regulations should be applied to all cases where a GP makes a clinical judgement that harm is likely.

Medical information and insurance – Subject Access Requests The BMA’s joint guidance with the Association of British Insurers (ABI) on the use of medical information for insurance purposes has been withdrawn and is under review. The BMA is aware that some insurance companies are now requesting full medical records (via a Subject Access Request – SAR) rather than asking for a report from the applicant’s GP, as previously agreed with the ABI.

In the GPC’s view, requesting the full medical record for any patient is excessive and potentially in breach of the third data protection principle under the Data Protection Act 1998 (DPA) which states that personal data shall be "adequate, relevant and not excessive" in relation to the purpose for which it is processed.

Under the DPA, patients are entitled to copies of their full medical record. BMA is awaiting guidance from the Information Commissioners Office (ICO) regarding concerns about the use of SARs. Until this guidance is received, the BMA would recommend that a letter is sent to any patients requesting their medical records via a SAR. The BMA have announced that they now have the results of their largest ever UK survey of GPs. 15,560 responses were received.

The first results show only too clearly that GPs feel that consultation times are wholly inadequate, and that workload pressures are now directly affecting the quality of care they can provide.

Outcome of the Primary Care Infrastructure Fund for 2015/16The outcome of the Primary Care Infrastructure Fund has been announced by NHS England.  All practices, whether successful or unsuccessful in their applications for funding, should have been contacted their regional NHS England representative. The GPC have prepared a brief guidance note to help explain what the outcome means for those practices involved. Upper Tribunal Ruling on Business Rates and Premises ValuationsIn January 2015, the Upper Tribunal (Lands Chamber) made a ruling that has implications for how business rates are calculated for practices occupying purpose built GP premises. The impact of the ruling is that surveyors evaluating purpose built premises must now adopt a valuation methodology which could considerably reduce the valuation of the property for business rates purposes.

As business rates are reimbursable under the Premise Costs Directions, any reduction in business rate should have no impact on the practice. However, as it is reimbursed cost, this is an area where NHS England (or the Health Board) can recoup costs.

There are a number of important points to note.  It may transpire that Area Teams attempt to pressure practices into appealing their current business rates. Any appeal to the Local Authority regarding business rates may only be made by the practice. As such it is entirely at the discretion of the practice and they are under no obligation to comply.  

Although it hasn’t been explicitly stated, please be aware that any rates rebates from the local authority to the practice will almost certainly be clawed back by NHS England. We are also aware that some legal firms are approaching practices about applying for a rebate. Given the reimbursable nature business rates practices would receive no financial advantage in doing so but may be left with subsequent legal fees.

NHS Property Services Standard LeaseThe GPC is in the process of developing a standard lease for practices who are tenants of NHS Property Services. The intention of this lease is that it will act as a template which practices – with assistance from LMCs and their legal advisors – can adapt to suit their specific needs.

The lease is the culmination of many months of negotiations between GPC, BMA Law and NHS Property Services.  

GPC are also in conversations with Community Health Partnership about developing a standard lease for practices in LIFT buildings.

Six week coil checksA recent communication was distributed by Mr Bappa from DRI suggesting that GPs may deliver the 6 week coil check where a Mirena coil has been inserted for the purpose of menorrhagia. Doncaster LMC would like to remind practices that GPs and their nurses are not contracted to provide this service. If a patient wishes to have a 6 week coil check, practices can either choose to provide this service unfunded, or can choose to refer the patient back to gynaecology for their check. Deprivation of Liberty Safeguards Update GP's must refer all deaths of patients who were under DoLS to the coroner. The coroner is responsible for the issue of a 'death certificate' in these circumstances. The Coroner will ask the GP for the necessary medical information in the form of a short report to assist in their enquiries.

The Medical Referee at the Crematorium will not allow a cremation without a coroner's inquest nor will the registrar of births and deaths accept a death certificate from anyone except the coroner.

Goodbye

Dr Kerr will be retiring from Carcroft Doctors Group on the 28th April. Dr Berry retired from Mount Group Practice on Wednesday 31st March. They are both wished a long and happy retirement.

Dr Alla resigned from Princess Medical Centre as a GP Partner on 11th March.

Dr Jawaid resigned from St Johns Group Practice 31st March.
