In 1985, the Government of British Columbia approved the Applied Science Technologists & Technicians Act. The Statute provides the legal basis for defining and recognizing the practice of persons certified and registered with ASTTBC. Section 18 of the Act grants to the ASTTBC Council the authority to make regulations. The Regulations provide greater detail on the meaning and application of the Act. The Fire Protection Certification Board polic and this SoP are, in turn, derived from the ASTT Act and Regulations.

3.0 PROVIDING INSPECTION, TESTING AND MAINTENANCE SERVICES 3.1 Building Owner Responsibilities It is the responsibility of the building owner or authorized agent to carry out the provisions of the Administrative Provisions section of the published version of the National Building and Fire Codes as adopted in British Columbia, which includes maintaining fire prevention equipment and systems in good working order, and to make arrangements for the required inspections and testing. It is the owner or their authorized agent’s responsibility to initiate repairs or additional work, and follow-up inspection and testing to be in compliance with manufacturer specifications, codes, standards and municipal regulations.

3.2 Responsibilities of the RFPT and fire protection service company 3.2.1 Many RFPTs are employed by fire protection service companies and the contractual relationship between the RFPT and the service company is independent from ASTTBC. Fire protection service companies provide their fire protection testing and inspecting services to the building owner or their authorized agent on a contract basis. As a matter of internal fire protection service company process (often called ‘Chain of Command’), many RFPTs who work for fire protection service companies are required to notify their employer of deficiencies or issues with fire protection systems or equipment they are inspecting and/or testing before contacting an AHJ. If an RFPT notifies their fire protection service company employer of deficiencies or issues with the fire protection equipment and/or or systems in a building, it then becomes the duty of the fire protection service company to notify the building owner or their authorized agent of the issues. It is highly probable that there are differences in the way fire protection service companies report to building

The stamp remains the property of ASTTBC and must be returned upon written request by the Registrar. Any unauthorized production or modification of an RFPT stamp is a matter for civil and criminal proceedings. The Practice Review Board (PRB), the AHJ and the fire protection company (employer if applicable) shall be advised if an unauthorized stamp has been used. Failure to return a stamp within 30 calendar days of receiving notification from the Registrar shall result in temporary suspension of the RFPT right to practice. The AHJ and the fire protection company (employer if applicable) shall be so advised.

7.0 Ownership, responsibility and use of RFPT stamps or seals 7.1 Stamp or seal ownership ASTT Regulations section 4.5 specifies that stamps or seals may only be issued to Technical Specialists as prescribed by Council. Stamps or seals may only be affixed to documents prepared under his or her direct supervision. Use of the stamp or seal is strictly limited to documents describing work or containing information that is within the scope of practice defined by the Special Certification Board and approved by Council. Stamps or seals are not transferable or usable, by anyone at any time other than the individual to whom the stamp or seal was issued and remain the property of ASTTBC.

7.2 RFPT responsibility The RFPT is responsible for the safekeeping and use of the stamp issued in their name. Any stamp that is misplaced, lost, stolen or damaged beyond use shall be reported immediately to ASTTBC. It is the responsibility of the RFPT to use the stamp in compliance with the ASTTBC Act and Regulations and the policies, standards and codes applicable to RFPTs. The use of the stamp is restricted to the RFPT whose name appears on the stamp. The inspection and/or testing done by the RFPT is restricted to the specialty endorsements for which the RFPT is qualified, certified and registered.

8.0 Document Retention Requirements Complaints are investigated and processed based on the nature of the allegations, the risk to the public and the extent of alleged non-compliance of the RFPT. Various interpretation of the regulations may and do occur. Preparing and keeping well-organized records of work done is extremely important in any situation alleging that an RFPT has been non-complaint to the ASTTBC Code of Ethics or the RFPT Standards of Practice. Fire protection companies typically prepare and retain inspection and test reports based on the information provided by the RFPT. The reports are signed and sealed (stamped) by the RFPT then submitted to the client. When a complaint is received it is the RFPT that is named as the respondent not the fire protection company. It is the RFPT and not the fire protection company that is required to provide evidence of the inspection and testing the RFPT did. In some situations the fire protection company may agree to provide a copy of the report to the RFPT as evidence of work completed. In other situations the fire protection company may not have retained or may be unwilling to provide the RFPT a copy of the report. The statute of limitations specifies 15 years as the legal limit for maintaining records. Financial transaction including Revenue Canada consider seven years as the minimum time to retain records The method of maintaining records of work done varies from one RFPT to another. The minimum safeguard for RFPTs is to keep a log with a record of the date, location, type of work done and any unusual circumstances encountered or observed while inspecting and testing fire protection equipment or

systems. Based on the statute of limitations records should be retained for 15 years. APPENDIX 1 9.0 Complaint Process and Non-compliance As per the ASTT Act and Regulations, all RFPTs, are required to adhere to the ASTTBC Code of Ethics. ASTTBC has a complaint and disciplinary mechanism to deal with breaches of the Code and titles violations. The Practice Review Board (PRB) under the authority delegated by Council evaluates complaints and if necessary, recommends sanctions. The ASTTBC website provides information on how complaints must be submitted and the process that is followed. ASTTBC’s mandate does not include complaints against a company. Therefore, in a complaint against a RFPT, regardless of whether the RFPT is a sole proprietor or is employed by a company providing fire protection services, ASTTBC’s complaint mechanism shall be limited to the RFPT alone. The ASTTBC Act and Regulations specifies: “Complaints against any member or registrant must be made in writing to the Registrar within two years of the occurrence of the substance of the complaint. Any complaint not received within such period shall be considered to be extinguished.” In recent interpretations of the 2-year limit on reporting a complaint the Supreme Court has used the date of discovery of a problem and not the date when the work was done. Example: If a complaint is submitted in 2017, about work done in 2011 and the alleged error discovered in 2016 this complaint could be considered within the 2-year time limit based on the date of discoverability. ASTTBC’s complaints handling is conducted following the principles of administrative law and natural justice. This means that the RFPT will be treated with fairness and given adequate opportunity to provide comments, facts and arguments on the complaint, and will be kept adequately updated during the course of the investigation. The RFPT shall also be provided the opportunity to speak with the Investigator assigned by ASTTBC. All complaint-related proceedings are confidential and RFPTs must do their part in maintaining the confidentiality. Any complaint-related communication

and interaction is strictly between the RFPT and ASTTBC. Employers shall not be a party to the complaint. The RFPT’s comments on the complaint must be their own. Unless specifically requested by ASTTBC, submissions from an outside party, such as the RFPT’s employer, or an AHJ, will not be accepted. When requesting comments on the complaint, ASTTBC will ask the RFPT to provide copies of all their documentation for the work that is referenced in the complaint. In the case of RFPTs employed by a company providing fire protection services and who submit reports to their company for forwarding to relevant parties, those RFPTs may be particularly vulnerable defending a complaint if they are unable to provide ASTTBC with pertinent documentation. This can happen if their employer does not support or help them by providing a copy of their original documentation. To provide themselves the best opportunity for a fair review, RFPTs must consider, at the bare minimum, a log to record basic facts such as dates, times and location of work done. Keeping a copy of photographs and original reports written by the RFPT goes a step further and is invaluable as evidence of work done by the RFPT, particularly if the employer altered the report. The RFPT becomes more vulnerable in situations where they are no longer working for the same employer. Therefore, it is considered best practice for RFPTs to maintain scrupulous records on their own.
