We are often asked whether or not it is possible to sell a debtor’s house in order to get money to pay the debt.
The process varies from state to state.
A starting point is that it is essential that you take out a judgment against your debtor.
For all states and territories, if the debtor is known to own real estate and the judgment debt exceeds $5000, our recommendation is to proceed to bankruptcy action. If the debt is for less than $5000, then it will be necessary to follow one of the state based procedures.
The states with the best processes for this are Tasmania and South Australia. In those two states, there are relatively simple procedures which allow for a caveat to be lodged over the title to the property, after judgment is taken out and this usually results in the debt being paid on the ultimate sale of the property.
In all other states except New South Wales, there is a process which ultimately results in an Order for the Sheriff or Bailiff to sell the equity the debtor has in the property.
Unfortunately, if your debtor owns a property in New South Wales, there is nothing you can effectively do to force the sale of it. However, if the judgment exceeds $5,000, we can still proceed to bankruptcy , which is highly effective.

BASIC CREDIT CHECKS There are some very very basic but effective credit checks you can carry out when advancing credit to a new customer.
The starting point is the information contained in the Credit Application Form completed by the customer.
Check that the home address provided is an actual address. Google the address to see what the house looks like and
what the street looks like.
If your customer is a home-owner, you can feel more relaxed.
Check with other suppliers or references. The best check will be with the customer’s accountant. You will need the cus-
tomer’s consent to do this but be wary if he does not provide his consent.
If your customer works and has a steady job, particularly in an organization such as the public service, the armed
forces, fire brigade or police, your ultimate changes of recovery are good.
