Short title.

Interpretation.

Power ofat torney maybe registeredby theRegistrar-General.

1. This Ordinance may be cited as thePowers of Attorney Ordinance.

2. For the purposes of this Ordinance,and unless there be anything in the subjector context repugnant to such construction—

" attorney" shall include every personholding such power of attorney;

" power of attorney" shall include anywritten power or authority otherthan that given to an attorney-at-law or law agent, given by oneperson to another to perform anywork, do any act, or carry on anytrade or business, and executedbefore two witnesses, or executedbefore or attested by a notarypublic or by a Justice of the Peace,Registrar, Deputy Registrar, or byany Judge or Magistrate, orAmbassador, High Commissioneror other diplomatic representativeof the Republic of Sri Lanka; and

" Registrar-General" shall include theDeputy Registrar-General and anAssistant Registrar-General andany person for the time beinglawfully discharging the duties ofthe Registrar-General or of theDeputy Registrar-General or anAssistant Registrar-General.

3. Any attorney desiring to have hispower of attorney registered under thisOrdinance shall be entitled to have the sameso registered, and shall for that purposeproduce the same to the Registrar-General,together with a copy thereof certified by anotary public to be a true copy, and shallmake an affidavit to the effect that to the

best of his knowledge and belief such powerof attorney is genuine and still in force. Andthe Registrar-General shall, after satisfyinghimself of the correctness of such copy,register the power of attorney and file suchcopy and shall endorse upon it and upon thepower of attorney a certificate signed byhim stating the fact of such registration andthe date thereof, together with a reference tothe volume and folio wherein suchregistration is recorded and such copy isfiled, and shall return the power of attorneyto the person producing the same. Such Registration toregistration shall be recorded in a book to be recorded.be kept in the form prescribed in theSchedule.

4. In the event of the cancellation orrevocation of any registered power ofattorney, or where any attorney ceases toact under such power of attorney, thegrantor or attorney, if desirous of havingsuch cancellation or revocation registered,shall be entitled to have the same soregistered, and shall for that purpose notifysuch cancellation or revocation to theRegistrar-General, with an affidavitverifying such fact, and shall also causepublication of such notification to be madein the Gazette and in three issues of at leastthree daily papers published in the Sinhala,Tamil and English languages in Colombo;but until such notification and publicationthe grantor shall be held liable and boundby all acts of his attorney:

Provided that nothing in this section shallbe construed to affect any power of attorneywhich shall cease or become void byoperation of law or to affect or prejudice theoperation of any clause, proviso, orcondition contained in any power ofattorney dealing with or touching or
