ACUERDO DE ASOCIACIÓN TRANSPACÍFICO (TPP)
L a Asociación participó activamente
en todas las rondas de negociación
celebradas durante el 2014 al amparo de la
iniciativa para alcanzar un Tratado de Libre
Comercio en la región de Asia Pacífico,
conformada por Canadá, Estados Unidos,
México, Chile, Perú, Australia, Nueva Zelanda,
Malasia Singapur Vietnam, Brunei y Japón.

A s part of the initiative to reach a Free
Trade Agreement in the Asia-Pacific
region that encompasses Canada, United
States, Mexico, Chile, Peru, Australia, New
Zealand, Malaysia, Singapore, Vietnam, Brunei
and Japan, ANIQ actively participated in all the
rounds of negotiations held in 2014.

Las negociaciones continuaron utilizando el
formato establecido el año anterior, a través de
la conformación de 22 mesas a través de las
cuales se atienden todos los temas relacionados
con una integración comercial, económica y
política de la región.
Las rondas de negociación han sido
sumamente intensas, con miras a alcanzar
acuerdos sustanciales que permitan concluir
el proceso hacia el primer trimestre del 2015,
de tal forma que pueda ser aprobado por los
diferentes congresos y se programe su entrada
en vigor en el transcurso del año 2016.
Al cierre del año, en materia de desgravación
arancelaria, prevalecen dificultades relevantes
para alcanzar un acuerdo definitivo,
especialmente en los sectores que en los países
miembros se consideran sensibles siendo los
más relevantes el agropecuario, automotriz,
textil – vestido y calzado.
The negotiations continued using the format
set the preceding year, creating 22 round tables
to focus on all topics related to the commercial,
economic and political integration of the region.
These have been intensive negotiations,
aiming at reaching substantial agreements and
complete the process by the first quarter of
2015. In this manner, this agreement could be
passed this year by the various congresses to
become effective in 2016.
By the end of the year the difficulties to reach
a final agreement on tariff item elimination
matters continued, particularly related to the
industries considered more sensitive in the
member countries, being the most relevant
the agricultural and cattle raising, automotive,
textile, apparel and footwear sectors.

En lo que se refiere a la industria química,
se ha logrado acordar aproximadamente el
85% del universo arancelario resguardando
la totalidad de los intereses de las empresas
socias y consultándolas en la medida que los
términos de la negociación cambian.
La expectativa es que en el transcurso de
los primeros tres meses continúe la revisión
de los productos aún pendientes de acordar y
eventualmente se logre un consenso hacia el
mes de marzo del 2015.
La negociación de reglas de origen para
el sector químico ha sido sin duda muy
complicada, debido fundamentalmente a la
falta de integración de insumos en la región,
la disparidad de las economías y las enormes
diferencias en las expectativas para acceder
al mercado de Estados Unidos y Japón
principalmente.
Al cierre de las negociaciones en el mes
de diciembre, ANIQ ha logrado acordar más
del 90 por ciento del universo arancelario del
sector químico, respetando la totalidad de las
solicitudes realizadas por las empresas socias.
No obstante lo anterior, aún permanecen
pendientes de acuerdo en la negociación
todos los herbicidas, fungicidas, reguladores
de crecimiento de las plantas, los inhibidores
de germinación, además de todas las resinas
plásticas.

Concerning the chemical industry,
approximately 85% of the tariff item universe
has been agreed upon, protecting all the
interests of member companies and consulting
with them as the negotiation terms change.
Expectations are that over the next three
months the pending products will be reviewed
and eventually a consensus could be reached
by the end of March 2015.
The negotiations on rules of origin for
the chemical sector have undoubtedly been
very difficult, mainly due to the lack of input
integration in the region, the disparity of
economies, and the enormous differences in
expectations to have access primarily to the US
and Japan markets.
At the closing of negotiations in December,
ANIQ had achieved an agreement on more than
90% of the tariff item universe of the chemical
sector, abiding by all the requests submitted by
member companies.
Notwithstanding the above, the agreement
on herbicides, fungicides, plant growth
regulators, germination inhibitors and all
plastic resins remains pending.
PACIFIC ALLIANCE
The negotiations to create a free trade region
including Mexico, Colombia, Peru and Chile
ended in February 2014, with the signing by
the Presidents of all member countries.
This agreement includes two different parts:
the first is a Framework Agreement setting
forth the Political Association. The negotiation
of this stage was completed in June 2012, and
the second part promoting the execution of the
Free Trade Agreement by the nations of the
region was completed in February 2014.
In the Framework Agreement, the
permanence of bilateral Free Trade Agreements
previously signed by Mexico with each country
was agreed upon. This means that companies
may choose which Agreement to use depending
on the principles governing them, using the
one that suits them best.
Additionally, ANIQ had a relevant
participation in the negotiation of the second
part that is, the Free Trade Agreement, since it
achieved the immediate elimination of 100% of
tariff items, while incorporating all the requests
of member companies in the negotiations of
rules of origin.
Unfortunately, this free trade agreement has
not been submitted yet to the Mexican Senate
to be passed so that it can become effective at
a later date. The reason for this delay is that
the Colombian Congress has not passed the
Framework Agreement yet.
We estimate that the Federal Government
will submit this Free Trade Agreement to the
Mexican Congress to be ratified over the first
half of 2015, in such a way that may become
effective this same year. This is the status of
the Agreement in the four participant nations
regarding their pertaining governments.
MEXICO-PANAMA FREE TRADE AGREEMENT
The negotiations between the two countries
for the signing of a Free Trade Agreement
were developed in five rounds from July 2013
to March 2014. Two additional intermediate
rounds were held prior to the fourth and fifth.
During this process, ANIQ requested the
immediate elimination of 99 percent of tariff
items for the chemical industry, as well as
setting forth the rules of origin previously
agreed in the Free Trade Agreement of the
Pacific Alliance.
The 5th Round of Negotiations, with which
the negotiation process was completed, was
held from March 18 to March 22, 2014 in
Panama City. Its purpose was to agree upon
the pending chapters of the negotiation, which
included the Chemical Industry.
Finally, on April 3rd the Free Trade Agreement
was signed by the Presidents of both nations in
the framework of the World Economic Forum for
Latin America, incorporating in this instrument
100 percent of the requests submitted by
ANIQ during the negotiation process.
This Free Trade Agreement will very soon be
submitted to the Mexican Senate for approval.

ALIANZA PACÍFICO
Las negociaciones para alcanzar un área
de libre comercio conformada por México,
Colombia, Perú y Chile concluyeron en el
mes de febrero del 2014, con la firma de los
presidentes de todos los países miembros.
El acuerdo se compone de dos diferentes
Acuerdos, el primero un Acuerdo Marco que
establece la Asociación Política y que concluyó
su negociación en junio de 2012, y el segundo
que promueve la celebración de un Tratado de
Libre Comercio en la región que fue concluido
en febrero de 2014.
En el Acuerdo Marco se logró implementar la
permanencia de los Tratados de Libre Comercio
bilaterales previamente signados por México
con cada uno de los países, es decir que las
empresas podrán decidir que Tratado utilizar
de acuerdo a las disciplinas que los rigen,
utilizando siempre el instrumento que más les
convenga.
Adicionalmente, ANIQ tuvo una participación relevante en la negociación del segundo, es decir, el Tratado de Libre Comercio, en el cual logró la desgravación inmediata del 100 por ciento del universo arancelario y al mismo tiempo la incorporación de todas las solicitudes de las empresas socias en las negociaciones de reglas de origen.
Lamentablemente, este acuerdo de libre comercio aún no es presentado al Senado de la República para su ratificación y posterior entrada en vigor, debido a que el Congreso de Colombia aún no aprueba el Acuerdo Marco.
Se estima que el Gobierno Federal presente
este Tratado de Libre Comercio al Senado de
la República para su ratificación en el primer
semestre de 2015 de tal forma que pueda
entrar en vigor durante el año 2015, ya que los
4 países se encuentran en el mismo estatus con
sus respectivos gobiernos.
TRATADO DE LIBRE COMERCIO ENTRE MÉXICO Y PANAMÁ.
La negociación entre ambos países para la
suscripción de un Tratado de Libre Comercio se
desarrolló en 5 rondas entre los meses de julio
de 2013 y marzo de 2014, además de llevarse
a cabo dos rondas intermedias, previas a la
cuarta y quinta.
Durante el proceso de negociación, la ANIQ solicitó la desgravación arancelaria inmediata para el 99 por ciento del universo arancelario de la industria química y el establecimiento de las mismas reglas de origen previamente acordadas en el Tratado de Libre Comercio de la Alianza del Pacífico.
La V Ronda de Negociaciones, con la que finalizó el proceso de negociación, se celebró del 18 al 22 de marzo de 2014, en la Ciudad de Panamá y tuvo por objeto acordar los capítulos pendientes de la negociación del Tratado entre los que se encontraba la industria Química.
Finalmente, el 3 de abril se concretó la firma del Tratado de Libre Comercio por parte de los Presidentes de ambos países en el marco del Foro Económico Mundial para América Latina, incorporando en este instrumento el 100 por ciento de las solicitudes realizadas por la ANIQ durante el proceso de negociación.
Este Tratado de Libre Comercio se someterá
a la brevedad para su aprobación al Senado de
la República.
TLC TURQUÍA
En el transcurso del segundo semestre
de 2014 inicio la negociación de un Tratado
de Libre Comercio entre México y Turquía,
motivo por el cual ANIQ conformó una
posición detallada en materia de desgravación
arancelaria y reglas de origen.
Las posiciones de negociación fueron
intercambiadas con las contrapartes de ANIQ
en septiembre, a la luz de la primera ronda de
negociación celebrada en la ciudad de Ankara.
Una vez realizado el intercambio de
ofertas, la negociación de reglas de origen
y desgravación arancelaria inicio durante la
segunda ronda celebrada en el mes de octubre
en la Ciudad de México.
Como resultado de ambas rondas de
negociación se ha logrado acordar el 68 por
ciento de las reglas de origen y aproximadamente
el 50 por ciento de las posiciones en materia de
desgravación arancelaria.
Derivado de la dinámica establecida en
este proceso, se espera la conclusión de las
negociaciones hacia el primer trimestre de
2015, con el objetivo de que sea presentado al
Senado de la República para su aprobación y
eventual entrada en vigor.

FREE TRADE AGREEMENT WITH TURKEY
In the second half of 2014, the negotiations
of a Free Trade Agreement between Mexico and
Turkey started. In view thereof, ANIQ prepared
a detailed positon on rules of origin and tariff
item elimination matters.
The negotiation positions were exchanged
with ANIQ counterparties in September, during
the first round of negotiations held in the city
of Ankara.
After the exchange of proposals was made,
negotiations on rules of origin and tariff item
elimination started in the second round held in
October in Mexico City.
As a result of these two rounds, 68 percent
of the rules of origin and approximately
50 percent of the positions on tariff item
elimination matters have been agreed upon.
Resulting from the dynamics set forth during
this process, we expect the completion of the
negotiations to be achieved during the first
quarter of 2015, to be submitted for approval
to the Mexican Senate, and finally becoming
effective at a later date.
CUSTOMS CONTROL AND GOVERMENT SURVEILLANCE PROGRAM
ANIQ jointly with the General Customs
Administration continued implementing
actions, controls and mechanisms to fight
smuggling of chemical products.

PROGRAMA DE CONTROL ADUANERO Y DE FISCALIZACIÓN
La Asociación en conjunto con la
Administración General de Aduanas
continuaron instrumentando acciones,
controles y mecanismos destinados al combate
al contrabando de productos químicos.
Para lograr lo anterior ambas instituciones
administran el Programa de Control Aduanero
y Fiscalización, el cual está diseñado para
combatir las prácticas desleales e ilegales de
comercio exterior a través del análisis de las
estadísticas de importación y exportación así
como la glosa de pedimentos.
De esta forma ANIQ ha puesto esta
información a disposición de las empresas
socias a través de consultas directas con su
personal o bien en el portal de la ANIQ, el cual
fue diseñado pensando en la facilitación del
acceso a la información en tiempo real.
Asimismo, en coordinación con la
Administración Central de Investigación
Aduanera, se realizaron modificaciones en los
procedimientos de glosa de pedimentos en el
Archivo General de Aduanas, permitiendo ahora
que las búsquedas y acceso a la información se
realice de manera electrónica.
Con este mecanismo se logró reducir los tiempos en las consultas y mayor efectividad en la integración de los expedientes para iniciar las denuncias correspondientes, respetando en todo momento la confidencialidad de la información obtenida.
A través de este instrumento, durante
el año 2014 se presentaron ante la
Administración General de Aduanas y las
distintas Administraciones Centrales que
conducen las investigaciones cuatro denuncias
por contrabando, arrojando resultados muy
satisfactorios en términos de las auditorías de
comercio exterior celebradas.
PROYECTO DE COMPACTACIÓN DE LA TIGIE
Durante el año 2014 la ANIQ, en conjunto
con la Secretaría de Economía trabajaron en
un proyecto de compactación de la Tarifa de
la ley de Impuestos Generales de Importación
y Exportación que involucró el universo
arancelario de la industria química.
Este proyecto tuvo como objetivo compactar el número de fracciones arancelarias para facilitar el comercio y reducir el riesgo en la clasificación arancelaria.
En el marco de estos trabajos se acordó con la Secretaría de Economía establecer la compactación solo en aquellas fracciones que registraran un comercio mínimo, es decir, inferior a un millón de dólares americanos al año y que mantuvieran el mismo arancel y las mismas regulaciones y restricciones no arancelarias.
Como resultado de esta iniciativa, ANIQ durante el último trimestre del año, conformo grupos de trabajo con las empresas socias, llegando al acuerdo de revisar las propuestas de cambio que sufrirían algunas fracciones dentro de los capítulos que corresponden al universo químico.

To achieve this, both institutions managed
the Customs Control and Government
Surveillance Program designed to fight illegal
and unfair foreign trade practices through the
analysis of import and export statistics and the
revision of customs declarations.
In this manner, ANIQ has made this
information available to member companies
through direct consultation with its personnel
or through ANIQ’s portal designed to facilitate
access to this information in real time.
Furthermore, in coordination with
the Central Administration of Customs
Investigations several amendments were
made to the proceedings to analyze customs
declarations in the Customs General Archives,
so that the search and access to information is
electronically made.
With this mechanism, consultation times
were shortened and greater effectiveness
achieved in the integration of files to start filing
the pertaining claims, observing at all times
the confidentiality required for the information
obtained.
Through this instrument, over 2014, four
contraband claims were filed with the Customs
General Administration and other Central
Administration offices, having very good
results of the foreign trade audits made.
BILL FOR COMPACTING THE GENERAL CUSTOMS DUTIES LAW TARIFF RATE (TIGIE)
During 2014, ANIQ jointly with the Ministry
of the Economy worked in a Project to compact
the tariff rate of the General Customs Duties
Law that involved the tariff item universe of the
chemical industry.
The purpose of this project was to condense
the number of tariff item numbers to facilitate
trade and reduce risk in tariff item classification.
In this framework, we agreed with the
Ministry to set forth this condensation only for
such sections that have minimum trade, that
is, less than one million US dollars a year, and
to keep the same tariff and the same non-tariff
item regulations and restrictions.
As a result of this bill, during the last quarter
of the year ANIQ organized work groups with
member companies and agreed upon reviewing
the proposals to change several tariffs in the
chapters pertaining to the chemical universe.
It must be pointed out that, simultaneously
to the condensation process, work was carried
out to expand to ten digits those tariff items
that so required because of their particular
features.
The result of these efforts will be submitted
to the Ministry of the Economy over the first
months of 2015 and the publication of the new
TIGIE is expected to be made in 2016.

Cabe destacar que simultáneamente al
proceso de compactación se trabajó en la
apertura a 10 dígitos para las fracciones que por
sus características especiales así lo requirieron.
El resultado de estos trabajos se presentará a
la Secretaría de Economía durante los primeros
meses de 2015 y se espera que la publicación
de la nueva TIGIE (Tarifa de Ley de Impuestos
Generales de Importación y Exportación) se
presente durante el año 2016.
SERVICIO DE PREVALIDACIÓN ELECTRÓNICA DE PEDIMENTOS “PREVALIDADOR ANIQ”.
Uno de los objetivos principales de ANIQ
es ofrecer a sus Asociados servicios de alta
calidad y mejorar en forma continua los ya
establecidos, un ejemplo de ello es el Servicio
de Prevalidación Electrónica de Pedimentos a
través del “Prevalidador de ANIQ”.
La función del Prevalidador, consiste en
confirmar que los datos asentados en el
pedimento por alguna empresa o agencia
aduanal estén dentro de los criterios
sintácticos, catalógicos, estructurales y
normativos, conforme a lo establecido por el
Servicio de Administración Tributaria (SAT).
Durante el año pasado, ANIQ también
realizó importantes inversiones en tecnología,
y equipo de última generación y alto
rendimiento, lo cual permite garantizar que el
sistema opere con los mejores estándares de
tiempo y calidad en el envío y recepción de la
información contenida en los pedimentos.
El Prevalidador de ANIQ es ya un sistema
con altos estándares de seguridad física y
lógica, que garantiza la confidencialidad de
la información y cuenta con un esquema de
contingencia robusto.
Adicionalmente se ha fortalecido el
crecimiento y desarrollo del área de “Call Center
Especializado”, el cual opera las veinticuatro
horas del día los 365 días del año, atendiendo y
resolviendo casos técnicos, legales, normativos.
Al mismo tiempo la operación de dicho
sistema le ha dado a la ANIQ la posibilidad de
participar activamente en el Comité del Sistema
de Automatización Aduanera Integral (SAAI)
así como en el Comité de Operación Aduanera
(COPA), en el cual se comunica de manera
directa a la autoridad problemas recurrentes
reportados por los usuarios, lo que ayuda a
resolver de manera rápida y eficaz cualquier
inconveniente.

CUSTOMS DECLARATIONS ELECTRONIC PRE-VALIDATION SERVICE: “ANIQ’S PRE-VALIDATION SYSTEM”.
One of ANIQ’s major objectives is to
offer high quality services to its members
while continuously improving those already
established. One good example is the Electronic
Pre-Validation Service of Customs Declarations
through “ANIQ’s Pre-Validation System”.
The purpose of the Pre-Validation System
or “Prevalidador” is to confirm that the data
entered in the customs declarations of any
company or customs agent is consistent
with the syntactic, structural, classification
and regulatory criteria established by the Tax
Administration Service (SAT).
During the past year, ANIQ also made
important investment in technology, high
performance and latest generation equipment.
Its purpose is to ensure that this system
operates according to the best time and
quality standards for sending and receiving the
information entered in customs declarations.
ANIQ’s Pre-Validation System is already
a system with high physical and logical
security standards that ensures information
confidentiality and offers a robust contingency
scheme.
Additionally, the growth and development
of the “Specialized Call Center” has been
strengthened and is currently operating 24
by 7, 365 days a year, serving and solving
technical, legal and regulatory cases.
At the same time, the operation of such
system has given ANIQ the possibility of actively
participate in the Comprehensive Customs
Automation System Committee (SAAI) as
well as in the Customs Operation Committee
(COPA) which directly communicate recurrent
problems reported by users to the authorities,
thus helping to solve any inconvenience in a
fast and efficient manner.
