    DECLARATION OF AN INDEPENDENT GAMING REPUBLIC

    This Declaration, and embodied Constitution establishes The Division as an Independent Gaming Republic.

    We hold the evidence of effect of the vision, principles, processes, and systems established by our Constitution to beempirically evident.

    To secure the gamer rights established herein, Active Domains are instituted among its Members, deriving just authorityfrom this Constitution, which has been established through the consent of the governed.

    It is the right of the collective membership to amend or create addenda to this Constitution for the purpose of institutingnew principles, processes, and systems that will create an improved Union.

    Wisdom, insight and knowledge, indeed, will dictate that principles, processes, and systems long established should not bechanged for light or fleeting causes.

    The independent gaming experiences of each Division Member, prior to Division membership, establish that theIndependent Gaming Republic creates a desired experience not achievable outside of The Division.

    To confirm this truth, let the following evidence be submitted to the existing and future multiplayer video game universes.

    The Division is the first Independent Gaming Republic established within a multiplayer video game universe.

    The Division is the first Independent Gaming Republic established for the benefit and betterment of the individual gamerand the multiplayer video game community participated within.

    The Division is the first Independent Gaming Republic copyrighted and trademarked to secure and safeguard its identity,independence and intellectual property.

    The Division is the first Independent Gaming Republic supremely governed by its Constitution.

    The Constitution of The Division is the first document to establish principles, processes, and systems for gamergovernance that have been created by the collective will of the governed.

    The Constitution of The Division is the f irst to establish unalienable Member rights.

    The Constitution of The Division is the first to establish democratic processes, securing for its Union the right to elect itsleaders.

    The Constitution of The Division is the first to establish Active Domains created to secure, defend and improve thegaming experience of its Members.

    The Constitution of The Division is the first to establish for its Members a measurable system of individual Player trainingand development.

    The Constitution of The Division is the first to establish a measurable process of new Member cultivation created to

    safeguard and improve its Union.

    THE PREAMBLE

    We, the Gamers of multiplayer video games, in Order to form a moreperfect online gaming experience, promote player-to-player Camaraderie,insure player-to-player Tranquility, provide player-to-player Development,protect player-to-Union Well Being, And secure this Independent Gaming

    Republic, to ourselves and future gaming generations, do ordain andestablish this Constitution for The Division.

    ARTICLE 1 THE EXECUTIVE OFFICE

    This Article binds and charges the Executive Office of The Division with the duty of (a) protecting and enforcing thisConstitution, (b) unwaveringly working toward solutions and resolutions that best serve the interest of The Division, and(b) advancing the Independent Gamming Republic and its Members toward effective and measurable levels of continuedsuccess.

    The Executive Office is responsible for but not limited to (a) the analysis and management of the Independent GammingRepublic, (b) amendment or addenda of constitutional Articles, Acts, Bills, and Policy, (c) implementation of procedures,

    processes, and systems and (e) matters that do not immediately fall within the scope of the duties and responsibilities ofthe 5 Star Council as outlined in this constitution.

    Section 1: President of the Division

    1. The Executive Office of The Division is directed by the Presidential position of Commander in Chief (CINC).

    2. The CINC is elected through the majority vote of the Union.

    2. The CINC is vested with the powers of enforcing this Constitution.

    3. The CINC is responsible for (a) developing and maintaining a forward organizational vision, (b) promotion of TheDivision within all applicable mediums, and (c) oversight of the 5 Star Council as outlined in this Constitution.

    Section 2: Officer of Executive Operations

    1. The Officer of Executive Operations (OEO) is appointed by the CINC and is responsible for aiding the ExecutiveOffice in its affairs.

    2. The OEO is vested with the powers delegated to him/her by the CINC.

    3. To qualify for appointment to OEO, a Member must hold a Commissioned rank within The Division.

    4. The CINC reserves the right to terminate and reappoint an OEO if the incumbent is failing to reasonably execute theduties and responsibilities of the Executive Office.

    Section 3: Active Domain

    1. The Active Domain of the Executive Office encompasses the entire Union.

    2.In an effort to congregate the Union or its leadership concerning matters of important business, the CINC holds thesupreme authority to declare his/her Domain active, superseding the jurisdiction of all other Active Domains.

    3. The Executive Office has the authority to move through other Active Domains as he/she sees fit to be of maximumservice to The Division.

    Section 4: Executive Action

    1. The Presidential decision making powers of the CINC are executed through Executive Action.

    2. Executive Action is a supreme Presidential power that can be activated when (a) the CINC has responsibly identifiedtreasonous activity or an imminent threat to the Union security, (b) an attempt to corrupt, perverse or alter with maliciousintent this Constitution, (c) constitutional negligence, (d) after the expiration of the Authorization Term or TermExtension, and (d) through a suspension Term or Motion to Veto as outlined in this Constitution.

    Section 5: Domain Suspension

    1. The Commander in Chief has the power to temporarily suspend an Active Domain for a period of seventy two (72)hours, referred to as the Suspension Term, if (a) it is reasonably determined that the Active Domain is operating in

    conflict with this Constitution, (b) is operating counter productive to the responsibilities and duties of the Domain asoutlined in this Constitution or (c) is in direct or malicious conflict with another Domain.

    2. Once an Active Domain has been suspended it is the duty of the CINC to present his/her cause of suspension to the5 Star Council for review no later than upon the expiration of the Suspension Term.

    3. Once the CINC has presented the cause of suspension to the 5 Star Council, it is the Councils responsibility to managea resolution.

    Section 6: State of the Republic Address

    1.The CINC is responsible for addressing The Division within the first eight (8) days of every month to formally updatethe Union, including but not limited to the overall clan vision, monthly accomplishments, needed improvements and goalsmoving forward.

    2. The Chairman of the 5 Star Council will also receive time to address the Union concerning Council and Domainupdates.

    3. At the discretion of the CINC a Q&A session may be held in closing.

    Section 7: Executive Term

    1. From the conclusion date of the Executive Ceremony, the CINC will serve The Division for a period of five hundredand forty (540) days. Upon the five hundred and forty first (541) day, the Executive Election Process will be reopened asoutlined in this Article.

    2. There is no Term limit for the Executive Office. A Division President may serve as CINC until he or she is voted outof Office through either (a) the Executive Election Process or (b) the Executive Impeachment Process.

    Section 8: Executive Election Process

    1. To qualify as a candidate for Executive Office, a Member must hold a seat within the 5 Star Council at the time theExecutive Election Process is activated.

    2. The CINC must be elected through the vote of the majority.

    3. The Executive Election Process is managed by the Division Alumni Council.

    4. The Executive Election Processes requires that each Member of the 5 Star Council cast one vote for the candidatewhom they feel is best suited to serve The Division within the Executive Office. A vote cast by a Member of the 5 StarCouncil will count as one (1) vote toward a candidacy.

    5. Candidates are prohibited from casting a vote in favor of their own candidacy. Members of the 5 Star Council will cast averbal vote with the Division Alumni Council.

    6. The Executive Election Process requires that public polling be opened up to each Division Member. Members will castan individual vote for the Candidate they feel is best suited to lead the Executive Office.

    7. Public polling will be opened to Division Members for a period of seven (7) days. This voting period is referred to asthe Polling Term. Once the Polling Term is concluded, the candidate that receives the majority vote from The Divisionpublic will be allocated one (1) vote toward his/her candidacy.

    Section 9: Presidential Campaigning

    1. In the spirit of Campaigning for Executive Office, Candidates are encouraged to creatively, and positively, promotetheir candidacy to the Union. This is to be done with a reflection of positive sportsmanship and good spirit. Attacking,slandering or belittling another Candidate is strictly prohibited and evidence of such campaigning will result in theCandidates immediate disqualification from the race. Campaigning is to be solely focused on the strengths and benefits

    candidates believe they bring to the Executive Office.

    2. Campaigning will begin sixty (60) days prior to the activation of the Executive Election Process. This is referred to asthe Campaign Term.

    3. Extortion or the negotiation of votes in exchange for power or special interests between Candidates and other DivisionMembers, or deliberate sabotage of either the Executive Election Process or the Polling Extension Term is strictlyprohibited. Violation of this policy will result in the permanent Division disbandment of all parties involved.

    Section 10: Election Stale Mate

    1. If a stale mate is achieved through the Executive Election Process, resulting in two or more candidates receiving anequal number of votes, polling will be closed for a period of thirty (30) days. This is referred to as the Polling ExtensionTerm.

    2. Upon the thirty-first (31st) day from activation of the Poll Extension Term, the Executive Election Process will bereopened as outlined above. If a stale mate is achieved in consecutive order, the Polling Extension Term and ExecutiveElection Process will be applied as outline above until a majority winner is established.

    3. During the Executive Election Process and Poll Extension Term, the incumbent holding the Executive Office willremain in power until a majority winner is established.

    4. Candidates are permitted to continue campaigning during the Polling Extension Term.

    Section 11: Executive Ceremony

    1. Once a Candidate has been declared the unanimous winner, an Executive Ceremony will be held within seven (7) daysfrom the date the victorious Candidate is established. This Ceremony will consist of (a) the attendance of the DivisionAlumni Council, 5 Star Council and The Division public in that order, (b) the swearing in of the President-elect and (c) aninaugural State of the Republic Address.

    2. The candidate cannot assume the title, duties and powers of the Executive Office until the Executive Ceremony hasbeen concluded.

    Section 12: Performance Review

    1. The 5 Star Council is vested with the authority, through an Authorized Action, to request a Performance Review of theExecutive Office at any time by the Division Alumni Council.

    2. The Division Alumni Council may request corrective action if it is determined that the Executive Office is operating ina manner not conducive to the growth or betterment of the Union.

    Section 13: Impeachment Process

    1. The 5 Star Council is vested with the authority, through an Authorized Action, to request an Impeachment Review atany time by the Division Alumni Council.

    2. The Commander in Chief may be Impeached by the Division Alumni Council if it unanimously determines that (a) theCommander in Chief has committed acts of Treason or is involved in acts of Treason, (b) is extorting The Division toserve self-interest or the interest of another entity, (c) has compromised or is involved in compromising Union security,(d) is intentionally sabotaging The Division, its operations or this Constitution, (e) is abusing the powers of the ExecutiveOffice, or (f) is neglecting his or her Executive duties and responsibilities to The Division.

    ARTICLE 2 THE 5 STAR COUNCIL

    This Article binds and charges The Division 5 Star Council with the duty of (a) protecting and enforcing this Constitution,(b) unwaveringly working toward solutions and resolutions that best serve the interest of The Division, and (b) advancingthe Independent Gamming Republic and its Members toward effective and measurable levels of continued success.

    The 5 Star Council is exclusively comprised of Division Generals and is responsible for but not limited to (a) theconceptualization of constitutional Articles, Acts, Bills, and Policy, (b) implementation of procedures, processes, andsystems, (b) Domain oversight, (c) Internal Rank promotions and demotions, and (d) matters that do not immediately fall

    within the scope of the duties and responsibilities of an Active Domain as outlined in this constitution.

    Section 1: Chairman of the Council

    1. The Council Chairman is appointed by the Commander in Chief.

    2. The Chairman is responsible for organizing participation and managing the Council meetings with the purpose ofensuring that all points of interest are discussed, that each member has an opportunity to be heard, and that theprogression of the meeting sustains the proper focus need to achieving an effective and measurable level of successregarding said points of interest.

    3. The Chairman is responsible for the Record of Minutes for each Council meeting including but not limited to thedocumentation of dates, times, attendees, points of interest discussed, motions passed, and status of adjournment.

    4. The Record of Minutes is to be published to the Division website within forty eight (48) hours of documentation. Thisis referred to as the Doc. Term.

    5. If the Chairman determines that a counter productive stale mate has been reached within a Council meeting, anadjournment can be called with an associated date or time for a return to Council to continue discussing said points ofinterest.

    Section 2: Authorized Action

    1. The decision-making powers of the Council are executed through Authorized Action.

    2. Authorized Action is achieved through the unanimous ruling of the Council. All members of the Council must cast avote to establish unanimity.

    3. Any member of the Council can call an Authorized Action meeting to address immediate Union issues.

    4. All Council members operating within the multiplayer universe participated in are required to attend an AuthorizedAction meeting.

    5. If it is unanimously determined by the Council that a Member is abusing his/her authority to call an Authorized Actionmeeting, or neglecting his/her attendance responsibilities, the Council reserves the right to suspend his/her voting powersfor a term to be defined by the Council, or to request a performance review of said Member by the Executive Office.

    Section 3: Authorized Action Term and Term Extension

    1. Once a Member of the Council submits a reasonable request for Authorized Action, the council is required to reach aunanimous decision within seven (7) days from the date points of interest are included into the Record of Minutes. This isreferred to the Authorization Term.

    2. If a unanimous decision is not reached within the Authorization Term, the points of interest submitted for AuthorizedAction will be presented to the Executive Office for analysis. Upon review of the Record of Minutes and the Councilspresentation of the facts surrounding said points of interest, the Commander in Chief will have the power to (a) add orremove components of the issues in an effort to assist the Council in establishing an Authorized Action or (b) enact an

    Executive Action concerning said points of interest based on his or her interpretation of the facts surrounding the requestfor Authorized Action.

    3. If option (a) is selected by the Commander in Chief, the Council will be provided with a maximum of three (3) days toestablish an Authorized Action. This is referred to as a Term Extension.

    4. If option (b) is selected by the Commander in Chief, or the 5 Star Council exceeds the Term Extension, the followingExecutive Action will be considered absolute and be put into effect immediately.

    Section 4: Scheduled Council Meetings

    1. The Council is required to meet at a minimum of bi-weekly to manage Union affairs and establish Authorized Actionpertinent to the Council.

    2. If it is reasonably determined by the Executive Office that the Council is failing to meet this obligation, the CINCreserves the right to enact Executive Action powers.

    Section 5: Motion to Veto

    1. Veto power of an Authorized Action is limited to the Commander in Chief of the Division.

    2. Veto power is only authorized if the Executive Office reasonably determines an Authorized Action (a) violates the

    Division Constitution, (b) is in direct conflict with one or more Active Domains, (c) is malicious in intent, or (d) is indirect conflict with the Presidential vision for the Union.

    3. An appeal of any Veto may be submitted by the Council, through Authorized Action, to the Division Alumni Councilfor review. The Authorized Action in question will be suspended until the Alumni Council establishes a resolution.

    Section 6: Director Report

    1. Each Division General in charge of a Domain will be required to provide the Council with a monthly status report,referred to as the Director Report. This report will be due within the first seven (7) days of each new month. Thisreport will include but is not limited to overall Domain operations, vision, personnel, Member participation,achievements and difficulties, targets and needs.

    2. The Council is responsible to the Executive Office for producing Director Reports, and is required to supply thesereports to the Executive Office prior to the State of the Republic Address.

    Section 7: Performance Review

    1. Division Domains, and individual Domain personnel are subject to a performance review by the Council if it is failingto meet the obligations outlined within this Constitution.

    2. The Council has the authority to request that specific Corrective Action be taken to address its concerns. In the event

    of a performance review, Domain management will be granted a minimum of seven (7) days from the date ofPerformance Review to apply Corrective Action. This is referred to as the Corrective Term.

    3. Failure to satisfy the Corrective Action within the Corrective Term will activate the Councils power to override theDirectors jurisdiction within said Domain through an Authorized Action.

    4. If a Performance Review results in an Authorized Action to remove a Director, approval to carry out said AuthorizedAction must be approved by the Commander in Chief.

    5. Upon review of the Record of Minutes concerning said Authorized Action and the Councils collective presentation ofthe facts surrounding the Authorized Action, the Commander in Chief retains the power to, (a) add or removecomponents of the Authorized Action to aid in an amicable resolution or (b) provide an Executive Authorization to carry

    out the Authorized Action to remove said Director based on his or her interpretation of the facts presented.

    6. If an Authorized Action to remove a Director is granted, the Executive Office and the Council will be responsible formanaging said department until a replacement can be established.

    Section 8: State of the Republic Address

    1. The Council is required to attend the State of the Republic Address.

    2. During the State of the Republic Address, the Council Chairman is responsible for providing a Domain update to theUnion.

    ARTICLE 3 DIVISION DOMAINS: SOCOM UNIVERSE

    This Article binds and charges Division Domains, and their Domain Management with the duty and responsibility of (a)protecting and enforcing this Constitution, (b) unwaveringly working toward solutions and resolutions that best serve theinterest of The Division, and (b) advancing the Independent Gamming Republic and its Members toward effective andmeasurable levels of continued success.

    Section 1: Domains

    1. The Division is universally comprised of six Domains, Intelligence, Strategic Development, Corps Delite, FieldOperations, Player Development and Player Resources.

    2. Each Domain is constructed with a unique scope of functionality designed to safeguard and empower the Union.

    Section 2: Intelligence Domain

    1. The Intelligence Domain is the information clearinghouse of the Division and is responsible for collecting, centralizing,and managing the critical data generated by each Domain.

    2. The information contained within the Intelligence Domain is used to advance the Union through process, procedureand system development, projections, trend identification, and growth, loss and needs identification.

    Section 3: Strategic Development Domain

    1. The Strategic Development Domain is the strategic think tank of The Division and is responsible for developing,managing and evolving competitive gameplay strategies.

    2. The strategic intelligence contained within the Tactical Development Domain is used to advance the Union through thecritical interpretation, transfer and translation of strategic reconnaissance and counter strategies.

    Section 4: Corps Delite Domain

    1. The Corps Delite Domain is the supreme tactical force of The Division and is responsible for producing victorieswithin the competitive apex of the multiplayer universes participated in.

    2.The resources contained within the Corps Delite Domain are used to advance the Union through critical ladder,tournament, and event recognition.

    Section 5: Field Operations Domain

    1. The Field Operations Domain is the war instrument of The Division and is responsible for producing victories withinthe open servers of the multiplayer universes participated in.

    2. The resources contained within the Field Operations Domain are used to advance the Union through critical war playrecognition.

    Section 6: Player Development Domain

    1. The Player Development Domain is the empirical cognition link of The Division and is responsible for the gameplaytraining and development of its Members.

    2. The empirical intelligence contained within the Player Development Domain is used to advance the Union through thegrowth and development of critical strategic and tactical competencies.

    Section 7: Player Resources Domain

    1. The Player Resources Domain is the interpersonal conduit of The Division and is responsible for cultivating andintegrating new Members.

    2. The assets contained within the Player Resources Domain are used to advance the Union through critical membershipgrowth, and retention.

    Section 8: Domain Management

    1. Each Domain is managed by four positions of authority, Director, Officer, Command Assistant, and Agent.

    2. Domain positions are congruent with the Internal Division Ranking System. The position of Director is limited to therank of Division General. The position of Officer is limited to the rank of Division Colonel. The position of CommandAssistant is limited to the rank of Division Lt. Colonel and the position of Agent is limited to the rank of DivisionMembership.

    3. Domain personnel are vested with operative authority within their Active Dominion. Division Members not holdinga personnel position within an Active Dominion, fall under the jurisdiction of its personnel during live management.

    4. A Domain that is being live managed is considered Active. This is referred to as an Active Dominion.

    5. Two or more Domains sharing a simultaneous Active Dominion is referred to as Inter-Dominion Activity.

    6. Inter-Dominion activity is to be managed mutually by participating Domain personnel, in accordinance to the jointagenda of the Inter-Dominion Activity.

    Section 9: Domain Director

    1. Directors are elected through the Authorized Action of the 5 Star Council, and are vested with the powers granted tothem through this Constitution.

    2. Directors are responsible for managing the day-to-day affairs of their Domain.

    3. Directors are responsible for supporting the efforts of fellow Directors wherever possible, except when to do so would

    compromise the proper execution of his/her Domain duties.

    4. Directors are responsible to the 5 Star Council for providing monthly Director Reports.

    Section 10: Domain Officer

    1. Domain Officers are appointed by the Domain Director, and are vested with the powers granted to them by theDomain Director.

    2. Domain Officers are responsible for executing the day-to-day affairs of their Domain.

    This Act binds and charges the Player Development Domain with the duty of the development, management, evolution,transfer, translation and analysis of the Division Competency Assurance Program (D-CAP), and establishes D-CAP as anActive Dominion.

    ARTICLE 5 DIVISION RECRUITING PROCESS: SOCOM UNIVERSE

    This Article binds and charges the Player Resources Domain with the duty of managing and analyzing the DivisionRecruiting Process (D-RP), and establishes the D-RP as an Active Dominion.

    The Player Resources Domain is responsible for ensuring that all recruits are provided with the legitimate opportunity tocomplete the D-RP.

    Section 1: D-RP Phases

    To earn official membership within The Division, each new recruit must successfully complete all three of the followingD-RP phases.

    1. Division Battle Challenge | D-BC2. Division Dedication Challenge | D-DC3. Division Initiation Challenge | D-IC

    Section 2: Preliminary Requirements

    1. To become eligible for D-BC competition, a player must complete or pass three preliminary requirements, (a) gamertagregistration at The Division website, (b) an existing stat assessment, and (c) a verbal persona interview.

    2. Once the preliminary requirements are met, the recruit will gain D-BC eligibility and advance.

    Section 3: Division Battle Challenge | D-BC

    1. The D-BC consists of a 1v1 challenge between the potential recruit and a D-BC Enforcer. Player Resourcesmanagement is responsible for dictating the dynamics of this challenge.

    2. If the player fails, a rematch may be arranged at a later date per the discretion of Player Resources.

    3. If the player passes, he/she earns a Division Recruiting Number (DRN) and advances.

    Section 4: Division Recruiting Number | DRN

    1. A DRN is a numerical gamertag issued to a recruit by Player Resources.

    2. All recruits are required to operate under their DRN throughout the Division Recruiting Process.

    3. The numerical value of a new DRN is to be issued in order from the last.

    Section 5: Division Dedication Challenge | D-DC

    1. The D-DC requires a recruit to complete a minimum of seventy-five (75) games played under their D-RN. Once arecruit completes 75 games played, the new statistics amassed and the persona he/she has displayed throughout this phaseare assessed by Player Resources.

    2. Completion of seventy-five (75) games played does not guarantee that a recruit will advance to the next phase.Contingent on the recruits individual performance, Player Resources may require additional improvements to advance.

    3. Once a recruit successfully completes all requirements within D-DC, he/she will advance to the final phase.

    Section 6: Division Initiation Challenge | D-IC

    The D-IC consists of two challenges.

    Section 7: The Division Battle Gauntlet

    1. To complete this sub phase, a recruit must pass three (3) of the four (4) challenges presented. A D-IC Enforcer will beassigned to each challenge listed below. Player Resources management is responsible for dictating the dynamics of thesechallenges.

    a. Offenseb. Defensec. Snipingd. Warplay Commanding

    2. If a recruit fails this challenge, he/she must complete twenty-five (25) additional games played under their D-RN to gainre-match eligibility. A recruit may repeat this process indefinitely until he/she passes the Division Battle Gauntlet.

    3. Once a recruit passes, he/she will advance to the final sub phase.

    Section 8: Independent Gaming Republic Comprehension Interview

    1. To complete this sub phase a recruit must display a general comprehension of the four (4) topics presented through averbal assessment. This assessment is conducted by the Commander in Chief of the Division.

    2. All of the information needed to establish a general comprehension of the below topics are made available to the recruit

    through general gameplay, and The Division website.

    a) Division Membershipb) Division Communicative Networksc) Division Domainsd) Division Constitution

    3. If the recruit fails, the Commander in Chief may allot additional time for the recruit to strengthen his/hercomprehension of the areas assessed.

    4. If the recruit passes, he/she will advance to the Graduation Ceremony.

    Section 9: DRN Graduation Ceremony

    Once a recruit has successfully completed the Division Recruiting Process, a DRN Graduation Ceremony will be held inhonor of the recruit. This ceremony will include the Affirmation of Division Allegiance, membership uniforming, issuingof Internal Division Rank, issuing of passwords, and a welcoming reception.

    ARTICLE 6 AFFIRMATION OFALLEGIANCE

    Section 1: Affirmation of Office | Commander in Chief

    "I (legal name) do solemnly swear that I will faithfully execute the Office of Commander in Chief of The Division, and wil lto the best of my natural ability, preserve, protect and defend the Constitution of The Division and the IndependentGaming Republic it represents. So help me God."

    Section 2: Affirmation of Office | Commissioned Rank

    "I, (legal name) having been appointed an officer in The Division, do solemnly swear that I will support and defend theConstitution of The Division and the Independent Gaming Republic it represents against all enemies, external or internal,that I will bear true faith and allegiance to the same; that I will obey the orders of the Commander in Chief of TheDivision, and the orders of the officers appointed over me, that I take this obligation freely, without any mentalreservations or purpose of evasion; and that I will well and faithfully discharge the duties of the office upon which I amabout to enter; and will serve The Division in the office of (Rank) which I now hold, with fide lity, according to the best ofmy skill and understanding."

    Section 3: Affirmation of Enlistment | Non-Commissioned Rank

    "I, (legal name), have this day, voluntarily enlisted, as a Member of The Division indefinitely, and I do bind myself toconform, in all instances, to the vision, principles, processes, and systems, as are, or shall be, established for the governing

    of The Division, to be true to the Independent Gaming Republic and to serve it honestly and faithfully against all itsenemies or opposers whatsoever; and to observe and obey the orders of the Constitution of The Division, and the ordersof the Generals and officers set over me by The Division Constitution."

    ARTICLE 8 MEMBER BILL OF RIGHTS

    This Bill binds and charges every Member of The Division with the following unalienable rights.

    1. Division Members are vested with the freedom of speech, and anonymity where applicable.

    2. Division Members are vested with freedom from discrimination based on race, creed, national origin, gender or rank.

    3. Division Members are vested with the right of personal privacy.

    4. Division Members are vested with the freedom of player-to-player Camaraderie.

    5. Division Members are vested with the freedom of player-to-player Tranquility, outside the scope of competitivegameplay.

    6. Division Members are vested with the freedom of player-to-Union Well Being.

    7. Division Members are vested with the freedom of equal opportunity.

    8. Division Members are vested with the right to receive gameplay Training.

    9. Division Members are vested with freedom from internal extortion.

    10. Division Members are vested with freedom from being held solely accountable for the actions' of many; nor shall becompelled in any review to be a witness against himself, nor be deprived of his/her Member rights.

    11. Division Members are vested with the right to receive a thorough grievance review.

    12. Division Members are vested with the right to receive a fair and balanced internal review, prevention of unreasonablejudgment, penalization, and or removal from The Division.

    13. Division Members are vested with the right to receive proper notification of any Performance Review resulting fromgrievances brought against them, to be informed of the nature and cause of the grievance; to be confronted with thewitnesses against, to be given an opportunity for obtaining witnesses in their favor, and to have the opportunity to present

    their defense before a judgment is made.

    14. A witness has the right to enact their anonymity when bearing witness against another Member however; enactinganonymity will negate the ability of the Executive Office to conduct a Performance Review of the grievance matter. Incircumstances that directly affect the security and stability of The Division, the Commander in Chief holds thesuperseding right to subpoena a witness that has enacted their right to anonymity.

    15. Division Members are vested with the freedom of independent disbandment without residual obligation or penalty.

    ARTICLE 9 POLICIES: SOCOM UNIVERSE

    This Article binds and charges all Division Members with the duty of adhering to, and upholding the following policies.

    Section 1: General Participation

    1. Division Members agree through Division Membership to honor this Constitution in all of their related gaming affairs.

    2. Division Members are required to register their gamertag at www.thedivision.us

    3. Division Members are required to check The Division website for weekly updates.

    4. Division Members are required to own a functioning microphone.

    5. Division Members support a mature environment.

    6. Division Members support microphone courtesy when communicating with others.

    7. Division Members support actively gaming with one another.

    8. Division Members support displaying a positive attitude when faced with game play, or player-to-player adversity.

    9. Division Members are required to utilize the Grievance Procedure to resolve legitimate internal grievances asoutlined in this Constitution.

    10. Division Members support the jurisdiction of the Internal Ranking System as outlined in this Constitution.

    11. Division Members are required to comply with the Member Competency Assurance Program as outlined within thisConstitution.

    12. Division Members are required to notify The Division of an absence exceeding a period of seven days or more.

    13. The Division does not support unauthorized multiple clan participation.

    14. The Division does not support the use of unauthorized multiple gamer tags.

    15. The Division does not support competing against one another within ranked servers unless Domain managementdirects this action.

    16. The Division does not tolerate Member insubordination.

    17. The Division does not tolerate internal rank abuse.

    18. The Division does not tolerate Constitutional negligence.

    19. The Division does not support a level Member participation that threatens his/her personal or professional WellBeing.

    Section 2: Ranked Gameplay

    1. All Members support practicing positive sportsmanship.

    2. All Members support gaming for competitive purposes.

    3. All Members support gaming within a communicative, strategy driven, team-play environment.

    4. All Members play to win, placing the team outcome above individual statistics.

    5. All Members support providing the commanding Officer with supreme microphone authority during competitivegame play.

    6. Division Members do not support idle chat during competitive game play.

    7. Division Members do not tolerate "rank-up" behavior. This is defined as any deliberate effort that results in amanipulated statistical gain outside of the natural scope of competitive game play.

    8. Division Members do not tolerate gaming behavior that creates illegal advantages or disruption during gameplay. i.e.glitching, Ethernet cord-pulling, modem magic switching, virtually networked lag switching imputed coding,map manipulation pixel bending, team killing, microphone abuse, or any other deliberate game play sabotage.

    Section 3: Warplay

    All of the policies within Section 2 apply to Section 3, with the following addit ions:

    1. The commanding Officer is held accountable to the Department of Intelligence for the war record generated.

    2. The commanding Officer is responsible for organizing his/her war team prior to initiating a pre-war lobby.

    3. Once a pre-war lobby is initiated, the commanding Officer is vested with supreme microphone authority and is

    responsible for negotiating the competitive conditions with the opposing team.

    4. Unless directly addressed by the commanding Officer, all Division Members participating in the pre-war lobby supportabsolute silence when an opposing team is present.

    5. Once the competitive conditions are established and the war lobby is initiated, the commanding Officer and allparticipating Division Members support absolute lobby silence for each map.

    6. Initiated by the commanding Officer, the war team is expected to green up in unison to spawn each map.

    7. The Division does not tolerate aborting voluntarily during war play.

    8. Upon both teams entering the post war lobby, each Division Member, in a show of positive sportsmanship and in orderfrom top to bottom, is expected to queue the microphone and provide the opposing team with a simple good gamebefore exiting the post war lobby.

    9. All war team participants are required to attend a post war room for debriefing.

    Article 10 Grievance Procedure

    This Article binds and charges all members of the Division with the duty of following the Grievance Procedure to enact aresolution effort of any and all legitimate grievances within the Division, and establishes the Grievance Procedure as amanagement function of the Executive Office.

    Section 1: Grievance Function

    1. All formal grievances are to be sent via e-mail to [email protected] for initial review by the Executive Office.

    2. A preliminary grievance response will be received within seventy-two (72) hours of Grievance submission to confirmreceipt.

    3. The Executive Office will conduct an interview with the Member who submitted the grievance.

    4. If the Executive Office establishes just cause for the grievance, an investigation into the facts surrounding the grievancewill be conducted.

    5. Once all the facts have been collected, all sides heard, and all the witnesses interviewed, Executive Action will be takento establish a resolution as it pertains to the facts.
