1. Objective of the Terms of Reference (TOR) Public Consultation
Tocollectcommentsfromrelevantstakeholdersontheprojectobjectivesandthe technical methodology, proposed by the proponent, to carry out theEnvironmental Impact Assessment (EIA), in accordance to the legalrequirements of Decree-Law no. 5/2011 – Environmental Licensing, andrespective regulations. The TOR is to be the guideline for the proponent tofollowandcarryouttheEIA.
2. What are we proposing?
TheGovernmentofTimor-Leste, throughtheDíliMunicipalAuthority (DMA),under the Ministry of State Administration (MSA), proposes the TibarDumpsiteRehabilitationandUpgradingProject(TDRUP).
In summary, the Government wants to invest in design, construction worksandspecializedequipmenttorehabilitatethecurrentwastedisposalsiteandupgradeittoasanitarylandfilloperatedandmanagedtomoderninternationalstandards.
Why?ToenhancetheconditionsofthecurrentTibaropendumpsite,thathasnegativeeffectsonpublichealthandtheenvironmentofthesurroundingarea.Its rehabilitation is highly recommendable to improve the environmentalquality and the level of public health of the surrounding population and thegeneralpublichealth,safetyandenvironmentamenityofDili.
TheTDRUP ispartof theDili SolidWasteManagementProject (DSWMP),anInvestmentStrategythat theGovernmentofTimor-LestehasdevelopedwithADB since 2015, which is legally defined in the Government Resolution no.32/2016-DiliUrbanSolidWasteManagementInvestmentStrategy.
TheDSWMPhasgonethroughseveralstepssince itsbeginning in2014,withthepreparationofanInitialEnvironmentalExamination(IEE)forTibarLandfill,carried out in 2015, and now the more recent steps to guarantee theimplementationoftheDSWMPstrategywithsupportfromanADBTransactionAdvisory(TA)Supportteam,composedoftheFinishingConsultingGroup(FCG,REBELandOASISSustainableProjects,toassisttheDMAinthenecessaryDueDiligenceandcarryouttheTechnicalStudiesfortheeffectiveimplementationoftheDSWMP.

Now, theproject is at aphasewhere a tenderprocesshasbeenopened forContracters to bid for a Design-Build-Operate (DBO) Contract, meaning thattheywill improveonthecurrentConceptDesign,alsobasedontheresultsofthis EIA assessment and carry out the implementation and operation of theprojectonbehalfoftheDíliMunicipality,foraperiodof10years.
3. Why do we need the project?
The population of Dili has grown rapidly over the past decades, currentlyestimated at 345,620 people (Census 2015), which has led to a significantincreaseinthewastemassgeneratedbycitydwellers.
Theexistingwastecollectionsystemisnotenoughandsosolidwasteendsupinthebeachesanddrainagesystem,frequentlyleadingtoflooding.
Governmentisintheprocessofimplementinganappropriateandsustainableurban solid waste management system for the long-term, modernizing thecollectionfleetandrehabilitatingTibarDumpsiteforsafedepositingofurbansolid waste, while waiting for recycling to establish itself and becomecommerciallyfeasibleinDili.
However,today,TibarDumpsiteisanopendumpwithair(wasteburning)andwaterpollution (leachate)andhealth risksassociatedwithwastepickersandinsectsandanimalpestsintheoperationalarea.
TheredesignandrehabilitationoftheTibarlandfill isexpectedtosolvetheseissues, resulting in improved air, water and noise environment quality andcommunitysafetyat the landfill siteandsurroundingareasandcater foranyresidualwastematerialsthatarenottreatedorprocessed.
Togetherwiththewastecollectionimprovement,itwillalsohavetheindirectpositive impact of improving the quality of life and urban amenity of thepopulationofthecityofDili.
4. Why an Environmental Impact Assessment of the TDRUP?
This TDRUP Project requires Government environmental licensing andapproval under Timorese Law, where it has been classified as a Category A(Environmental Impact Assessment) [EIA] under Decree-Law no. 05/2011 –Environmental Licensing, because the dimension (area) of the proposed

Landfill and the tonnage of waste received at the landfill (150 ton/day)surpassedthelimitssetinANNEXIotheDecree-Law,specificallyinitemno.1ofSECTORVII–SANITATIONSECTOR,oftheabove-mentionedDL(LandfillsanddisposalsofUrbanSolidWastes,<100Ton/day,1to100CBM/day,0.5to10hectares).
5. What is the EIA process
ItisalegalprocessgovernedbyTimoreseLawtoanalysetheimpactoflarge-scale projects proposed in Timor-Leste. EIA follows a process with thefollowingsteps:
Screening (Project Document): the first stage of the EIA process where theEnvironmental Regulator (National Environmental Licensing Authority [ANLA]ortheSecretaryofStateforEnvironment)decideifEIAisrequired.
Scoping (Terms of Reference): once it has been agreed that EIA is required,scoping is undertaken to define what to assess and report in theEnvironmentalImpactStatement(EIS)andaPublicConsultationiscarriedout,toearly identify issuesandthematicareasthatareexpectedtobeofgreaterrelevance,becauseofthepotentiallynegativeandpositiveenvironmentalandsocialimpactsgeneratedbyprojects.WEAREATTHISPHASE.
Baseline Assessment: With the scope set, relevant information on theenvironmentalbaselineconditionsiscollectedintheprojectareaandusedtounderstand thepotentialenvironmentaleffectsand informthedesignof theproposed development to minimise the potential for significant adverseimpacts.
ImpactAssessment:Theformalassessmentprocessisthenundertakenoftheproposed project to define the significant impacts of the proposeddevelopmentandaDraftEISisprepared.
Impact Management and Monitoring: Where significant adverse impactscannot be minimised through alterations to the design itself, mitigation orreduction measures are considered and put into an EnvironmentalManagement Plan (EMP), which also considers monitoring to measure thesignificance of the impact during and post-construction and allowmanagementofmitigationwhereappropriate.

DraftEIS/EMPtoEnvironmentalRegulator:OncetheEIAiscompleted,theEISand the EMP are submitted to the ANLA for review and another PublicConsultationiscarriedouttoreceivecommentsontheEIS/EMP.

7. Who is the Assessment Team?
The Díli Municipality have requested and ADB have commissioned theenvironmental assessment to FCG-International and OASIS SustainableProjects, a local EnvironmentalConsultancyactive inTimor-Leste since2011,thathaspreparedtheenvironmentalapplicationandtheTORandisprovidingtechnicalinputs,environmentalassessmentandco-coordinatingtheEIAstudywith JGP NVIST, Consultoria Ambiental, S.A., a Portuguese consultancycompany.
8. What is our Project?
8.1. Where do we want to implement the Project?
TheTDRUPstudyarea is located insucoTibar,Bazarteteadministrativepost,Liquiçamunicipality,adjacenttotheTibarBayareaandapproximately14kmwestofDilicentre.Itisanexistingopendumpusedfordumpingofmunicipalsolid waste since Indonesian times and extends over a total area ofapproximately12hectares.Therearenocontrolsoveraccess to thesiteandthere are a large number of scavengers (waste pickers) who set fire to thewastetorecovermetals,whichproducescontinuousfiresandlargevolumesofpotentiallytoxicfumes.

8.2. What do we want to do?
Wewanttore-developthewholewastedisposalarea,subdividedinto4principalareas(see:
1. TheWasteDisposalAreawiththeconstructionofthreesanitarylandfillcells,definedengineeredareasforthereceiptanddisposalofresidualwaste.Thethreecellscover11,07hectaresofthepresentfilledarea.Eachcellwillbedevelopedprogressivelyandinaphasedmanner,whilsttheconstructionofthesupportinfrastructurewillbecompletedinthefirst3yearsofsitere-development;
2. ReserveArea,abufferzonearoundthesouthern,easternandnorthernmarginsofthelandfillarea.Itisforthetemporarylaydownandstorageofmaterialsandequipmentduringconstruction(ifrequired),andprotectionoftheinvestmentareaduringtheoperationalphase.Therewillbenowastedisposalinthisarea;and
3. TheOperationalSupportArea,theremainingpartsofthesiteonthewestmarginoftheWasteDisposalAreaandinwhichtherequiredsupportinfrastructuretoupgradethedisposalfacilitywillbedeveloped.
4. TheDepotArea,forovernightparkingandcleaningoftheDíliwastecollectionvehiclesandfuelstorageanddispensingstationforthelandfilloperatorandthecollectioncontractors.
8.3. How do we propose to do it?
8.3.1. RemediationoftheWasteDisposalArea1. ExtinguishFiresandcoolthewaste;2. Plannedrehabilitation–willbedoneinorder,fromCell1toCell3,
withthefollowingsteps:i) Excavate existingwaste in each cell (down to the natural soil)
andTemporarilyre-locateitwithintheWasteDisposalArea;ii) RemovedNatural soil (to a depth of around 20 cm) to ensure
anycontaminatedsoilisremoved.Ifcontaminatedsoilisdeeperthan20cmthenremoveallcontaminatedsoilandreplacewithcleansoil;

3. Shape, grade and compact the base of the cell to achieve therequiredslopesandelevationstopromotedrainage(fromthetoptothebottomandalongthemiddleoftheWasteDisposalArea);and
4. Install aBasal LiningSystemtocollect theLeachate,composedof(bottom-to-top):i) Compacted natural soils, enriched with bentonite cement to
reducepermeability;ii) Sodium-bentonite Geocomposite Clay Liner (GCL) [1 layer of
bentoniteclayinthemiddleoftwolayersofgeotextile];andiii) PrimarylinerofHDPEflexiblegeomembrane(2mmthick)
5. CollectandTreattheLeachatei) InstallanetworkofFeederandCollectionHDPEpipesonalayer
ofporous,highlypermeablegravel;ii) DirectLeachatetobestoredtemporarilyinalinedpondandre-
circulateitbacktothelandfilltoprovideadditionalmoistureforwastedecomposition.
iii) Asmallpackagetreatmentplantmaybeinstalledtoimprovethequality the remaining leachate effluent to comply with IFCEnvironmental, Health, and Safety Guidelines for WasteManagementFacilities(EmissionsandEffluents)
6. CollectandTreattheproducedGas
Waste decomposition produces landfill gas (methane (40-60%) andcarbon dioxide (most of the rest), with trace amounts of othervolatileorganic compounds [VOCs]) thatneeds tobe collectedandtreatedforClimateChangeandLanfillSafetyissues.
A series of gas collectionwellswill be distributed throughout eachcell and installed as waste deposition proceeds in the cell. Thecollectionwellswillpenetratethefulldepthofthewastemassandisextended vertically as thewaste thickness increases andwill directthegas toacentralgas treatmentplantwitha flarestack inwhichcollectedgaseswillbecombusted.
8.3.2. RehabilitateOperationalInfrastructure1. ImproveaccessroadsaroundCells1to3;

2. Improvedrainageinthelandfillareawhere:a) Stormwater will be directed to a first stormwater retention
pond andoverflow fromthispondwillbedrained toasecondlined stormwater pond, adjacent to the compost plant, in theOperationalSupportArea.
b) Theretainedstormwaterwillbeusedin:• compostplantoperations;• circulated back to the landfill to assist in increasing waste
compactionandexpeditingwastedecomposition;• discharged off-site near to the existing DNSB waste water
treatmentplant.3. Access control and security access to the site (security gates,
fencingandsecuritypersonnel)4. WasteReceptionwithaweighbridgeforwasteweighing;5. Newadministrationbuildingsandcoveredparkingareas;6. Operationalareas:storageandworkshop7. Composting – Green waste will be collected separately from the
othermunicipalwasteandcompostedsothat:a) morespaceavailableinthelandfill;b) reduceleachateandgasinthelandfill;c) produceasafecompost(endproduct)forMunicipalityparksand
openspaces.8. Depot area – two depot sites for the secure overnight parking of
waste collection vehicles, an access road and a fully-bunded steelfuelstoragetank[50,000L]anddispensingstation.
9. How do we propose to assess the Environmental Impacts?
9.1. Collect information on the Project Site
TheEISwillprovideanoverviewanddetaileddescriptionofthenatureofthevariousimpacts(onphysical,biologicalandsocialcomponents)thatmayoccurduringtheimplementationofeachcomponentoftheTDRUPproject.

Todothat,we’llhavetocollectbaseline information(primaryandsecondarydatacollectionandliteraturereview)thatdescribestheconditionsofthesitetoday and compare/estimate them with possible impacts of the proposedfuturesituationandactionsfromtheprojectimplementation.
TheenvironmentandSocialcomponentsthattheEIAconsultantswillcarryoutinthefield(Primarydata)arethefollowing:
a) WaterResources(surfaceandground):Collectwatersamplesat8points(2surface,5groundand1drinkingwater).
b) AirQuality:Collectairqualitysamplesat4points.c) Soil:Collectsoilsamplesat9points.d) Noise:Collectnoiselevelsamplesat6points(industrialandresidential).e) Social Components: Interview with the communities affected by the
projectinthewholevillages(sucoand/oraldeia)affectedbytheproject.Census of affected persons and asset register of directly affected - toidentifypersonswhowillbeeconomicallydisplacedbytheProjectandtodeterminewhowillbeeligibleforcompensation.
f) Cultural Components: Field inspection by collecting the photos of theTibar archaeological, historic and sacred sites based on the CentroNacionalCHEGA(CNC)andSecretaryStateforCulture(SEC)data.
9.2. We will use that information to estimate impacts…
The assessment of the impacts of a project is the result of the comparisonbetween the foreseeable futureenvironmentalandsocial situationswith theprojectandinitsabsence(“ZeroAlternative”).
Wehavean ideaonthegeneral impactsattributedtoa landfill rehabilitationproject,suchastheonesintheTable1.
For this project, in order to identify and assess all relevant impacts, thecharacteristics of each environmental and social factor will be examined,followedbytheassessmentandpredictionoftheSIGNIFICANTimpactsbasedonadescriptionoftheireffectsandaqualitativecharacterisation.
9.3. How will we manage the significant impacts?
Wewill grab the significant impacts and definemitigationmeasures into anEnvironmentalManagementPlan(EMP)whichisthedocumentthat

identifies the potential environmental impacts from the construction,developmentanddecommissioningphases.
TheEIAteamandtheProponentwillagreeonwhatto include intheplantoefficientlyminimizethenegativeimpactsandenhancethepositiveimpactstoimprove the project environmental and social performance during thedifferentphasesoftheproject.
TheobjectiveoftheEMPistocommunicatethekeyenvironmentalobligationsthat apply to all contractors, their sub-contractors and employees whilecarrying out any form of construction activity as part of the TDRUP. It is tobecome the main obligation reference for contractors to follow during thedesign, construction and operation phases, and address the conditionsprecludedintheEMPthatwillbeattachedtotheBidandContractDocuments.
10. How can you participate in the next EIA phases?
10.1. Today’s TOR Public Consultation
Objective: collect, determine if pertinent and include any technical concernsfrom stakeholders and the public related specifically to the content,methodology,etc,tobeusedinthenextstep(BaselineStudiesandEIS/EMP).Written comments to be delivered until the 31st July 2020, to the contactsbelow.
10.2. In the next EIA phase
