APPLICATION FOR EVENT PERMIT
THIS IS AN APPLICATION FOR A PERMIT TO HOLD AN EVENT WITHIN A DESIGNATED
LOCATION INSIDE SHOLOM PARK. SHOLOM PARK is owned and operated by
Horticultural Arts & Park Institute, Inc. (hereinafter “HAPI”), a Florida not-for-profit
corporation.
WHEREAS, HAPI owns certain property in Ocala, Florida, known as Sholom Park (“PARK”); and
WHEREAS, applicant desires to hold an event in PARK, (hereinafter referred to as “EVENT”).
WHEREAS, the issuance of a permit to hold an EVENT within the PARK is within the sole and absolute discretion of HAPI.
WHEREAS, applicant (hereinafter referred to as “APPLICANT”) agrees that should HAPI issue the permit for which this application is made, then in that EVENT APPLICANT shall comply with the terms and conditions set forth herein.
WHEREAS, should HAPI determine to issue a permit, then the term “PERMIT HOLDER” shall replace the term “APPLICANT.”
WHEREAS, should any additional permits be required by Marion County or other jurisdictions, APPLICANT must secure said permits in advance of the EVENT and provide proof of those permits to HAPI.

1. PAYMENT SCHEDULE:
The permit fee may change if the PERMIT HOLDER changes the number of guests, date or time of EVENT. The APPLICANT shall
submit 100% of the permit fee, 100% of any sales tax and 100% of the Damage Deposit at the time of submitting a signed
Permit Application. All permit fees, sales tax and Damage Deposit shall be made by cash, money order or check payable to
Horticultural Arts & Park Institute, Inc. The Damage Deposit is held by the PARK for damage/clean-up from the EVENT. Provided
there is no damage and/or clean-up necessary, this Damage Deposit may be refunded in full following the EVENT.
2. DAMAGE & CLEAN-UP CHARGES:
The PERMIT HOLDER shall pay for all damages caused by the PERMIT HOLDER, the PERMIT HOLDER’s guests and any of the
PERMIT HOLDER’s agents while on property for the EVENT. The PARK provides the site in an event-ready state. Clean-up of
the PARK, after the EVENT, is the responsibility of the PERMIT HOLDER. The PERMIT HOLDER shall clean the area of the PARK
used, and the area must be left in the same condition as when it was made available for the EVENT. Should the fees associated
with the damage/clean-up exceed the amount of the Damage Deposit, the PERMIT HOLDER shall be obligated to pay the
complete difference to HAPI. If there is a timely cancellation, pursuant to Section 12, the damage/clean-up deposit will be
refunded. If decorations, arrangements, trash, and other materials associated with the EVENT are not cleaned up immediately
following the EVENT then damage and clean-up charges may apply. The PERMIT HOLDER and any of his/her/their agents or
employees shall not affix decorations to any structure on the property by using nails, tacks, staples, or other implements that
damage the underlying structure. Non-biodegradable materials shall not be permitted at the PARK. It is the PERMIT HOLDER’s
obligation to discuss this requirement with the Event Planner and any other contracted agent.
3. LOCATION & TIME:
The PERMIT HOLDER shall meet with the PARK Manager in order to ascertain the location within the PARK where the EVENT
shall take place. The EVENT location shall be indicated and initialed on the PARK map and dated by both the PARK Manager
and the PERMIT HOLDER. The PARK allows one (1) hour set-up prior to the scheduled EVENT and one (1) hour following the
scheduled EVENT for cleanup. Total EVENT time including set-up and clean-up shall not exceed three (3) hours unless
specifically approved by the PARK in writing. The EVENT must end, be taken down and cleaned up no later than one hour
before PARK closing time. PARK hours will not be extended for any EVENT. The PERMIT HOLDER acknowledges that
he/she/they have been informed that several EVENTS may be occurring within the PARK at the same time. EVENT locations
within the PARK are in strict accordance with the locations set forth on the PARK map. EVENT locations shall be approved on
the basis of which APPLICATION FOR AN EVENT PERMIT has been completed and issued first. The PARK shall remain open for
visitors.
4. ATTENDANCE:
The APPLICANT represents that there shall be no more than the number of guests stated on p. 1 of this APPLICATION. An
EVENT shall not exceed two hundred forty-nine (249) guests, no exceptions.
5. CATERING AND INSURANCE:
Catering Firms providing food and other catering services, and also Event Planners, play a role in the set-up and clean-up and
also various requirements related to an EVENT. The PARK requires a signature on this APPLICATION from or by an authorized
representative of said Catering Firm or Event Planner. Additionally, the PARK requires the Catering Firm or the Event Planner
to deliver a valid and in force commercial general liability insurance and excess umbrella liability insurance coverage policy
naming Horticultural Arts & Park Institute, Inc. as an additional insured. The PERMIT HOLDER and the Catering Firm or Event
Planner guarantee that alcoholic beverages shall not be served anywhere within the PARK. These valid and in force certificates
of insurance must be provided to the PARK no later than 60 days prior to the EVENT.

6. FURNITURE & SET-UP:
The PARK has a limited number of tables, chairs, and canopies available for lease. Lease of these PARK items requires a separate
RENTAL AGREEMENT, DEPOSIT, and FEES. Tables, chairs, canopies or rental items supplied by other vendors shall be the sole
obligation and responsibility of the PERMIT HOLDER. Load-in, set-up, and load-out of any such furniture or decorations shall
be the responsibility of the PERMIT HOLDER and must be completed fully on the day of the PERMIT. Failure to adhere to this
policy may result in loss of the Damage Deposit.
7. MUSIC, ENTERTAINMENT & VENUE VOLUME CONTROL:
Sound from music, entertainment, public address and similar systems shall not be audible beyond the site of the EVENT. PARK
staff retain the right to prohibit any sound amplification they determine it to be disturbing to PARK guests. Music and other
forms of entertainment should be suitable for a quiet PARK setting.
8. PHOTOGRAPHY:
Professional photographers are required to be pre-registered with the PARK. Annual permits for professional photographers
are available through HAPI. Permits must be secured in advanced of the EVENT.
9. FLOWERS:
The PERMIT HOLDER must provide any desired floral arrangements other than those naturally occurring within the PARK.
Naturally occurring blooms or other vegetation shall not be cut or removed from the PARK by the PERMIT HOLDER, the PERMIT
HOLDER’s guests, agents or employees. Destruction of or damage to the landscaping and naturally occurring blooms or other
vegetation shall result in loss of the Damage Deposit.
10. PETS:
Any pets or animals to be included in EVENT must be pre-approved by the PARK in writing.
11. NO DRUGS & NO ALCOHOL POLICY:
SHOLOM PARK IS A DRUG FREE AND ALCOHOL FREE PARK. PERMIT HOLDER SHALL NOT PERMIT ANY ILLEGAL DRUGS OR
ALCOHOL AT THE EVENT.
12. EVENT CANCELLATION POLICY:
If the PARK is unable to provide the agreed upon location for the PERMIT HOLDER’s EVENT, such non-performance shall be
excused with no obligation or liability to HAPI. Provided further, HAPI may terminate the PERMIT without further liability of
any nature upon return of the PERMIT HOLDER’s paid fees. In the alternative, the PERMIT HOLDER may elect to hold the EVENT
at an alternate location within the PARK if such is available, and thereafter all terms of this Permit Application shall remain in
full force and effect. Permitted EVENTS are to be held, rain or shine. HAPI cannot guarantee weather conditions; HAPI reserves
the right to cancel or reschedule EVENTS on a mutually agreeable time and date if severe weather conditions are imminent on
the permitted EVENT time and date, or if HAPI has reason to believe visitors might be in danger. If the PERMIT HOLDER fails to
comply with all of the requirements set forth herein, HAPI may, at its election, revoke the EVENT permit. If any PERMIT HOLDER
cancels, prior to 30 days of the EVENT Date, the PERMIT HOLDER may request a refund. If this refund is approved by HAPI, a
fifty dollar ($50.00) processing fee shall be deducted.
13. PERMIT HOLDER shall conduct the EVENT in a safe and orderly manner, in full compliance with all applicable laws, regulations and ordinances and all rules, regulations and policies of HAPI. The PERMIT HOLDER hereby voluntarily and expressly releases, indemnifies, forever discharges and holds harmless HAPI and any of its Directors, officers, employees or agents, from any and all liability, claims, demands, causes or rights of action whether personal or to a third party, which are in any way connected with participation in the EVENT, including those allegedly attributable to negligent acts or omissions. HAPI retains the right to select counsel of its choice for any such defense.

Should HAPI or anyone acting on behalf of HAPI be required to incur attorney's fees and costs to enforce this Agreement, the PERMIT HOLDER expressly agrees to indemnify and hold HAPI harmless for all such fees and costs.
If the PERMIT HOLDER, or any related participants, files a lawsuit against HAPI, its venue shall be in Marion County, Florida. PERMIT HOLDER agrees that if any portion of this Agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
In consideration of being permitted by HAPI to use its products and facilities, the PERMIT HOLDER and its participants shall indemnify and hold harmless HAPI, its Directors, and all related parties, from any and all claims which are brought by the PERMIT HOLDER and/or their participants and which are in any way connected with such use or participation, including injuries to persons or damage to property, theft, resulting from the PERMIT HOLDER’s negligence or any other act or omission or the negligence or any other act or omission of persons employed by, associated with, or under the direction or control of the PERMIT HOLDER or the Catering Firm or Event Planner.
14. This Application and any permit issued by HAPI shall be governed by and construed in accordance with the laws of the
State of Florida applicable to agreements made in, and to be wholly performed in, such state.
15. This Application and any permit issued by PARK contains the entire and only understanding of agreement between the
parties. Oral statements or representations not contained in this permit Application or any permit issued by PARK shall have
no force or effect. This Application and any permit issued by the PARK shall not be amended or modified in any way except by
a written agreement executed by both parties.
16. ALTERNATIVE DISPUTE RESOLUTION: Any dispute involving this Application or any permit issued thereafter shall be
resolved only through mediation and arbitration proceedings with each side to pay their own attorney fees and costs. Venue
of all disputes shall only be in Marion County, Florida. The dispute shall first be submitted to mediation before a Circuit Court
Certified mediator. If an impasse is declared, then the dispute shall be submitted to binding arbitration before an arbitrator
mutually selected by the PERMIT HOLDER and HAPI. Attorneys’ fees shall not be awarded to either party.
17. The language in all parts of this Application and any permit issued by the PARK shall in all cases be construed according to its fair meaning and not strictly for or against the PARK or the APPLICANT for the permit or the PERMIT HOLDER.
