Asmanyclubsareaware,theissueoflicencesrequiredtoplaymusicatsurfclubshasbeenadiscussionpointoverthepast12monthsorso.Indeed,manyclubsalreadyhavelicencesinplacewiththetwomusicrightsmanagementorganisations(APRAAMCOSandPPCA)fortheplayingofmusic,andothershavebeenapproachedtodoso.SLSNSWhasbeenliaisingwithAPRAAMCOSinrecentmonthstoclarifythesituationandtounderstandexactlywhattherequirementofsurfclubsiswithrespecttoholdinglicencestoplaymusic.Thefollowingpointsaresomekeyfactstoassistintheexplanationofthelandscapearoundlicensingforthepublicplaying(alsocalledpublicperformance)ofmusic:
1. Ifyouusecopyrightmusicwithinyourclub,Commonwealthlegislation(undertheCopyrightAct(1968))yourequirepermission(alicence)fromthecreatorsofthatmusic.Withoutthislicenceyouwould,forexample,needtodealdirectlywithallthecomposers,songwriters,musicpublishers,recordingartistsandrecordlabelswhoowntherightsinthemusicyouwishtouse.
2. Therearetwobodiesresponsiblefortheprotectionofthatcopyrightonbehalfoftheowners.APRAAMCOSrepresentsthesongwriters,composersandmusicpublishers(thelyrics,themelody,thechords;essentiallythe‘frame’ofthesong)andPPCArepresentstherecordingartists(thesinger,thedrummer,theguitarist,theproduceraswellastherecordlabelsuchasSony)ofthesong.Thesongwriterisnotalwaystherecordingartist.Theseareseparateindependentbodies,andeachhasalegalrightonbehalfofthemusiccreatorstheyrepresenttocollectlicencefeesontheirbehalf.
3. Thelicencerequirementcoversallpublicperformanceswhichincludes-livemusicwheretheartistplaystheiroriginalsorcovers,recordedmusic(suchasfromaCDorvinylrecord),andpublicplayingofmusicfromtheradio,TV,smartphone,streamingservices,videosandthelike.
4. Ourresearchindicatesalargenumberofclubshavealicenceagreementwithoneorganisationinplace,butveryfewhaveonewithbothbodies.Notwithstanding,thereisactuallyarequirementthatanypublicperformancerequiresalicencewithbothbodiestobecompliant.
DuringthetimeofourdiscussionswithAPRAAMCOS,wehavebeenmadeawareofajointinitiativebetweenbothbodies.TheyarenowlookingtocreateasinglelicensingmodelthroughtheentityOneMusicAustralia.Thismeansclubswillnowonlydealwithonesetofrequirementsandonefeestructure.SLSNSWhasbeenabletonegotiatethatSurfClubsarecategorisedasaCommunityHall.For2019/20,thismeansafeeof$7perdayper100personcapacitywheremusicisplayed.Forexample,ifmusicisplayedeachSundayatSippersallyearround,thefeewouldbe$7x52weeks=$364perannum.Theprocessisaself-reportingmodelwherethereisflexibilityaroundtheexactnumberofdaysyouhavehadmusicplayedatyourclub.Notknowingtheexactdetailsofwhatindividualclub’sarrangementswitheitherorbothbodiesare,itcouldbethecasethataclub’slicensingfeesactuallyincreasefromyourcurrentlevels,andthisismostlikelyduetotheclubcurrentlyonlycomplyingwithoneofeitherofthebodies.WewouldencourageclubstoviewtheattacheddocumentationfromOneMusic,andliaisedirectlywiththatbodytoclarifyanyquestionsyouhave,includingtransitionarrangementsifyourcurrentlicencesfallduepriortothecommencementofthenewarrangements.IwouldalsoencourageclubswithamorecommercialoperationtoconfirmwithOneMusictheapplicabilityoftheCommunityHallsclassificationtoyourcircumstances.Youcanreadindependentlegalinformationatwww.copyright.org.auPleasefeelfreetocontactmedirectlyshouldyouhaveanyquestions.PhilAyresChiefOperatingOfficerSLSNSW
