1. Southwark Council hereby GIVES NOTICE that it proposes to make the above orders under the powers of the Road Traffic Regulation Act 1984
1, as amended.
2. The general effect of the orders, as part of the provision of a new parking zone ‘SEB’ in the south-east Bermondsey area would be:-
(a) to provide permit holders' parking places in which vehicles in respect of which has been granted either a valid residents' permit, a valid business permit or a valid visitors' permit may be left between the hours of 8.30 am and 6.30 pm on Monday to Friday inclusive, in:- ANCHOR STREET, BEATRICE ROAD, BLUE ANCHOR LANE, BOMBAY STREET, CAMILLA ROAD, GALLEYWALL ROAD, LYNTON ROAD,
ROSEBERRY STREET, SIMMS ROAD, STRATHNAIRN STREET and TENDA ROAD; (b) to provide 'permit holders past this point' parking places in which vehicles in respect of which has been
granted either a valid residents' permit, a valid business permit or a valid visitors' permit may be left at any unmarked part of the kerbside (providing this does not cause an obstruction to the passage of other vehicles) between the hours of 8.30 am and 6.30 pm on Monday to Friday inclusive, in parts of:- BEATRICE ROAD and CAMILLA ROAD, in so much of each is deemed public highway;
(c) to provide 'shared-use' parking places in which either:- (i) vehicles which have paid the parking charge using 'Pay by Phone' may be left for up to 2 hours, provided no vehicle may return to a parking place within 2 hours, or (ii) vehicles in respect of which has been granted either a valid residents' permit, a valid business permit or a valid visitors' permit may be left without time limit, between the hours of 8.30 am and
6.30 pm on Monday to Friday inclusive, in:- ANCHOR STREET, BEATRICE ROAD, BLUE ANCHOR LANE, BOMBAY STREET, CAMILLA ROAD, GALLEYWALL ROAD, LYNTON ROAD, ROSEBERRY STREET, SIMMS ROAD, ST JAMES’S ROAD, STRATHNAIRN STREET and TENDA ROAD;
(d) to provide ‘stop and shop’ parking places in which either:- (i) vehicles may be left free of charge for up to 30 minutes, or (ii) vehicles which have paid the parking charge may be left for up to 2 hours, the first 30 minutes of which parking session would be free of charge, provided no vehicle may return to a parking place within 2 hours, between the hours of 10 am and 6.30 pm on Monday to Friday inclusive, in:- BLUE ANCHOR LANE, BOMBAY STREET and SOUTHWARK PARK ROAD; NOTE: a parking session must be registered with the Council’s ‘Pay by Phone’ provider to obtain the 30 minutes free of charge parking in addition to a longer charged-for stay. The ‘Pay by Phone’ provider will calculate the total parking
charge for the parking session payable automatically upon registering. (e) to (i) remove free short stay parking places in GALLEYWALL ROAD (south-west side, two locations
either side of its junction with Roseberry Street) and LYNTON ROAD (north side opposite St Augustines Court), and (ii) amend the operating hours for all remaining free short stay parking places located within the parking zone boundary to operate between the hours of 8.30 am and 6.30 pm on Monday to Friday (max stay 1 hour, and no return within 2 hours);
(f) to amend the designation of an existing car club parking place in LYNTON ROAD on the south -east side o/s Kite House, to more closely match what is in the street;
(g) to (i) formally remove a disabled persons’ parking place in GALLEYWALL ROAD, south -west side o/s No. 46 Galleywall Road, and (ii) amend the designation of an existing disabled persons’ parking place in
LYNTON ROAD on the north-west side o/s No. 267 Lynton Road, to more closely match what is in the street;
(h) to amend the designation of existing solo motor cycle parking places in AMBROSE STREET, ANCHOR STREET and BLUE ANCHOR LANE to more closely match what is in the street;
(i) to amend the operating hours of existing loading bays to operate between the hours of 7 am and 7 pm on Monday to Friday (max stay 40 mins, and no return within 2 hours) (i) in AMBROSE STREET north-east side and (ii) in SOUTHWARK PARK ROAD (goods vehicles only) north-east side, o/s No. 289 Southwark Park Road;
(j) to introduce 'at any time' waiting restrictions (double yellow lines) at road junctions, footway and vehicle crossovers between kerbside designated as parking places in the above-mentioned streets. Loading or
unloading to or from attended vehicles would be permitted for a maximum of 40 minutes at any single location on these waiting restrictions; and

(k) to introduce single yellow line waiting restrictions (operating between the hours of 7 am and 10 am on Monday to Friday) on new ‘stop and shop’ parking places in BLUE ANCHOR LANE, BOMBAY STREET and SOUTHWARK PARK ROAD, on which vehicles would be prohibited from waiting but permitted to load or unload to or from attended vehicles for a maximum of 40 minu tes at any single location during
those operating hours. 3. The parking charges (where applicable) in respect of vehicles left in ‘stop and shop’ parking places and
‘shared-use’ parking places would be: £3.25 per hour (diesel fuelled), or £2.75 per hour ( non-diesel fuelled).
4. Residents’ permits, business permits and visitors’ permits would be available to residents and businesses located at qualifying addresses located within the parking zone boundary, provided they are not subject to a planning agreement restricting the grant of permits. Information on eligible addresses for permits and a full list of parking charges can be found at www.southwark.gov.uk/parking.

In August and September 2019, a study was carried out on the possible introduction of a parking zone in a network of streets within the south east Bermondsey area (South Bermondsey ward), in the London Borough of Southwark.
Following the informal consultation stage on the proposal to implement a new permit parking zone in the SE Bermondsey area, officers have taken into account feedback from the consultation namely for:-
- the retention of existing free ‘short stay’ bays
- half of the existing loading bays to operate 7 am to 7 pm and the remaining half to operate 7 am to 10 am (single yellow lines with up to 40 mins loading/unloading permitted) with 10am to 6.30pm paid parking with first half hour free (‘stop and shop’ bays)
The design includes further amendments requested by residents in response to the proposed designs, where feasible and in line with relevant parking design standards and safety considerations.
The Cabinet Member for Environment, Transport and the Climate Emergency has approved the following recommendation, in January 2020:-
To implement a permit parking zone in the SE Bermondsey area, within the South Bermondsey ward in the London Borough of Southwark operating Monday to Friday 8.30 am to 6:30 pm, subject to the outcome of any necessary statutory procedures. The council of the London Borough of Southwark, after consulting the Commissioner of Police of the Metropolis, in exercise of the powers conferred by sections 45, 46, 49, 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984
a, as amended, and of all other powers thereunto enabling,
hereby make the following Order:-
PART I – PRELIMINARY
Citation and commencement
1.1 This Order may be cited as the London Borough of Southwark (Parking places) (Parking zone
‘SEB’) (No. 1) Order 20** and shall come into force on 20**.
Interpretation
2.1 In this Order, unless the context otherwise requires:-
“ambulance” has the same meaning as in the Vehicle Excise and Registration Act 1994b;
“authorised agent” means the parking services contractor appointed by and acting on behalf of
the council for the purposes of the supervision and enforcement of the provisions of this Order;
“bus”, "goods vehicle" and "solo motor cycle" have the same meaning as in Schedule 1 to the
Traffic Signs Regulations and General Directions 2016c;
“business permit” means a permit granted under the provisions of Article 24;
“business permit holder” means a person to whom a business permit has been granted under
the provisions of Article 24;
“business user” means a person who carries out business at any premises the postal address of
which is in a street or length of street in the London Borough of Southwark specified in
Schedule 5;
“civil enforcement officer” means a person in uniform authorised by or on behalf of the council in
accordance with section 76 of the Traffic Management Act 2004d to enforce and supervise the
provisions of this Order;
“council” means the council of the London Borough of Southwark;
“diesel vehicle” means a vehicle registered in the Great Britain or Northern Ireland vehicle registration records on the basis of a United Kingdom registration document or, in the case of a
vehicle registered in a country other than the United Kingdom, in the appropriate records of that country on the basis of an equivalent registration document issued by the appropriate national authority, that states the vehicle is diesel fuelled.
“disabled person’s badge” and “parking disc” have the same meanings as in Regulation 3(1) of
the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations
2000e and “relevant position” has the same meaning as in Regulation 4 of those Regulations;
“driver”, in relation to a vehicle waiting in a parking place, means the person driving the vehicle at the time it was left in the parking place;
“electric vehicle” means either:-
(a) a vehicle for which a nil licence is in force by virtue of its being an exempt vehicle for the purposes of the Vehicle Excise and Registration Act 1994 in accordance with paragraph 20G (electrically propelled vehicles) of Schedule 2 to that Act; or
(b) registered in the Great Britain or Northern Ireland vehicle registration records on the basis of a United Kingdom registration document or, in the case of a vehicle registered in a country other than the United Kingdom, in the appropriate records of that country on the

basis of an equivalent registration document issued by the appropriate national authority, that states the vehicle is wholly electrically fuelled or powered.
"electronic communications network" has the same meaning as in section 32 of the
Communications Act 2003f;
“electronic payment system” means a system to facilitate and monitor the payment of parking charges using telephone or internet enabled devices via communication with the service
provider, in accordance with the instructions indicated on signs located at or in the vicinity of each parking place;
“enactment” means any enactment, whether public general or local, and includes any order,
byelaw, rule, regulation, scheme or other instrument having effect by virtue of an enactment;
“goods” means goods of any kind whether animate or inanimate and includes postal packets of any description and “delivering” and “collecting” in relation to any goods includes checking the
goods for the purpose of their delivery or collection;
“hand-held device” means a wireless hand-held computer used by a civil enforcement officer, which is programmed to interface with the council and their authorised agent's parking permits
management system and electronic payment system;
"location identification number" means the unique number assigned to each type of parking place within a particular street where the electronic payment system is operational;
“maximum parking period” means the maximum period of time during which a vehicle may be
left in a parking place referred to in Schedule 3 or 4;
“minimum return interval” means the minimum period of time, following a vehicle having been taken away from a parking place during the permitted hours, before that vehicle may again be left in that parking place during the permitted hours;
“motor cycle” has the same meaning as in section 136 of the Road Traffic Regulation Act 1984;
“owner”, in relation to a vehicle, means the person in whose name the vehicle is registered under the provisions of the Vehicle Excise and Registration Act 1994;
“parking charge” means an amount payable, subject to the provisions of this Order by the electronic payment system in respect of a vehicle left in a parking place referred to in Schedule 3 or 4;
“parking period” means a period of time for which payment of the parking charge has been paid
in respect of a vehicle and during which that vehicle may be left in a parking place referred to in Schedule 3 or 4, subject to the provisions of this Order;
"parking session" in relation to a visitor's permit granted under the provisions of Article 26
means the period of time specified at the time of payment of the charge in relation to the grant or issue of a visitor's permit during which, following the validation of that visitor's permit, that visitor's permit shall remain valid;
“parking place”, means any area on a highway designated as a parking place by this Order;
“passenger vehicle” means a motor vehicle (other than a motor cycle) constructed or adapted solely to carry not more than eight passengers (exclusive of the driver) and their effects , and not
drawing a trailer;
“permitted hours”, in relation to a parking place designated by this Order, means the (inclusive) period specified in column 3 of the Schedule relating to that parking place;
“postal packets”, “postal services”, "universal postal service” and “universal service provider" have the same meanings as in Part 3 of the Postal Services Act 2011

“resident” means a person whose usual place of abode is at premises the postal address of
which is in any street or length of street in the London Borough of Southwark specified in Schedule 5;

“resident’s permit” means a permit issued or granted under the provisions of Article 22;
“resident’s permit holder”, means a person to whom a permit has been issued or granted under
the provisions of Article 22;
“Schedule” unless otherwise so specified means a Schedule to this Order;
“service provider” means the company authorised and appointed by the council to operate, administer and maintain the payment of parking charges made via the electronic payment
system;
“street” includes any part of a street;
“traffic sign” means a sign of any size, type and colour prescribed and authorised under, or as
having effect as though prescribed or authorised under section 64 of the Road Traffic
Regulation Act 1984;
“ultra-low emission vehicle” has the same meaning as in Article 1 of Annex 2 to the Scheme as referred to in the consolidated Greater London (Central Zone) Congestion Charging Order
2004h;
“visitor” means a person who is visiting a resident and who has obtained a visitor’s permit
issued or granted in respect of a vehicle, from and with the permission of that resident; and
“visitor’s permit” means a visitor’s permit issued or granted to a resident which may be used in respect of a vehicle visiting said resident under the provisions of Article 26.
2.2 Any reference in this Order to any enactment shall be construed as a reference to that
enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of
any subsequent enactment.
2.3 Any reference in this Order to a numbered Article or Schedule shall, unless the context
otherwise requires, be construed as a reference to the Article or Schedule bearing that number
in this Order.

PART II - DESIGNATION OF PARKING PLACES
Designation of parking places
3.1 Each area on a highway comprising the length of carriageway of a street specified in column 2
of Schedules 1, 2, 3 or 4 and, unless otherwise so specified, bounded on one side of that length by the edge of the carriageway and unless otherwise so specified having a width throughout of 2 metres, is designated as a parking place.
Vehicles for which parking places are designated
4.1 Each parking place referred to in Schedules 1, 2, 3 or 4 may be used, subject to the provisions of this Order, for the leaving during the permitted hours of vehicles of the following class, that is:
- passenger vehicles of not more than 2.28 metres in height, goods vehicles of not more than 2.28 metres in height or solo motor cycles.
4.2 Each parking place referred to in Schedule 1 or 2 may be used, subject to the provisions of this
Order, for the leaving during the permitted hours of such vehicles of the class specified in paragraph 1 of this Article as either: display in the manner specified in Article 5.1 a valid visitor’s permit issued in respect of that vehicle; or in respect of which vehicle there is an indication via
hand-held device that either a valid resident’s permit, or a valid business permit, or a valid visitor’s permit has been granted in respect of that vehicle, under the provisions of this Order.
4.3 Each parking place referred to in Schedule 3 may be used, subject to the provisions of this
Order, for the leaving during the permitted hours of such vehicles of the class specified in paragraph 1 of this Article as either: display in the manner specified in Article 5.2 a valid visitor’s permit issued in respect of that vehicle, or in respect of which vehicle there is an indication via
hand-held device that either a valid resident’s permit, or a valid business permit , or a valid visitor’s permit has been granted in respect of that vehicle, or in respect of which the parking charge has been paid using the electronic payment system, under the provisions of this Order.
4.4 Each parking place referred to in Schedule 4 may be used, subject to the provisions of this Order, for the leaving during the permitted hours of such vehicles of the class specified in paragraph 1 of this Article as are either: left in a parking place for a period not exceeding 30 minutes, or in respect of which the parking charge has been paid using the electronic payment
system, under the provisions of this Order.
Certain permits to be displayed on or indications by hand-held device in respect of vehicles left in parking places
5.1 At all times during which a vehicle is left in a parking place referred to in Schedule 1 or 2 during the permitted hours, either:-
(a) it shall display on the front or nearside of the vehicle a valid visitor’s permit issued in
respect of that vehicle in accordance with the provisions of this Order, so that all the particulars on that visitor’s permit are readily visible from the front or nearside of the vehicle; or
(b) there shall be an indication via hand-held device that either a valid resident’s permit or a valid business permit or a valid visitor’s permit has been granted in respect of that vehicle.
5.2 At all times during which a vehicle is left in a parking place referred to in Schedule 3 during the permitted hours, either:-
(a) it shall display on the front or nearside of the vehicle either a valid visitor’s permit issued
in respect of that vehicle in accordance with the provisions of this Order, so that all the particulars on that visitor’s permit are readily visible from the front or nearside of the vehicle; or
(b) there shall be an indication via hand-held device that either the parking charge has been duly paid in respect of that vehicle using the electronic payment sys tem, or a valid resident’s permit or a valid business permit, or a valid visitor’s permit has been granted in
respect of that vehicle.

5.3 At all times during which a vehicle is left in a parking place referred to in Schedule 4 during the permitted hours, there shall be an indication via hand-held device that the parking charge has been duly paid in respect of that vehicle using the electronic payment system.
Provided that nothing in the paragraph above shall apply where a vehicle is left in a parking place for a period not exceeding 30 minutes.
5.4 In this Article any reference to particulars on a visitor’s permit, shall be construed as those
particulars referred to in Article 30 of this Order.
Contravention of this Order
6.1 If a vehicle is left in a parking place referred to in Schedules 1, 2, 3 or 4 during the permitted
hours, without complying with the provisions of this Order, then a contravention of, or failure to comply with this Order shall be deemed to have occurred.
Alteration of position of a vehicle in a parking place
7.1 Where any vehicle is standing in a parking place in contravention of the provisions of Article 10, a civil enforcement officer may alter or cause to be altered the position of the vehicle in order that its position shall comply with those provisions.
Movement of a vehicle in a parking place in an emergency
8.1 A civil enforcement officer or a police constable in uniform may move or cause to be moved, in case of emergency, to any place they think fit, any vehicle left in a parking place.
Exemption for a vehicle displaying a disabled person’s badge
9.1 Notwithstanding the foregoing provisions of this Order, a vehicle which displays in the relevant position a disabled person’s badge may be left in a parking place referred to in Schedule 3 or 4
without time limit, provided that the use of that part of the parking place in which the vehicle is left has not been suspended, and no charge shall be incurred or payable in respect of that vehicle.
9.2 Without prejudice to the generality of this Article, a disabled person’s vehicle shall stand in a parking place in accordance with the provisions of Article 10.

PART III – SUPPLEMENTARY PROVISIONS
Section 1 – General
Manner of standing in a parking place
10.1 The driver of a vehicle waiting in a parking place specified in Schedules 1, 2, 3 or 4 during the permitted hours shall cause it so to stand:-
(a) in the case of a parking place in relation to which special provisions as to the manner of
standing of a vehicle in that parking place are specified in column 2 of Schedules 1, 2, 3 or 4 so as to be in accordance with those provisions;
(b) in the case of any other parking place so that the longitudinal axis of the vehicle is parallel
to the edge of the carriageway nearest to the vehicle and the wheels of the vehicle are not more than 300 millimetres away from the edge of the carriageway nearest the vehicle;
(c) so that every part of the vehicle is within the limits of a parking place;
(d) so that no part of the vehicle obstructs any vehicular means of ingress to or egress from any premises adjacent to the side of the road on which the vehicle is waiting.
10.2 For the purposes of sub-paragraph 1(d) of this Article, the expression “premises” shall not
include any premises to or from which any furniture is being removed by virtue of the provisions of Article 14.1(g) or to or from which goods are being delivered or collected by virtue of the provisions of Article 14.1(h).
Manner of standing in a parking place for vehicles using the electronic payment system
11.1 Without prejudice to the provisions of Article 10, every vehicle left in a parking place in respect of which payment of the parking charge has been made via the electronic payment system
shall stand wholly within the limits of a parking place (or part thereof), which shall be the appropriate parking place (or part thereof) in relation to the location identification number used for payment of the parking charge.
Power to suspend the use of a parking place
12.1 The Commissioner of Police of the Metropolis or any police officer above the rank of Chief Inspector may suspend the use of a parking place or any part thereof for a period not exceeding twenty-eight days whenever he considers such suspension necessary for maintaining the
security of premises in the vicinity of that parking place.
12.2 At the expiration of the period of twenty-eight days mentioned in paragraph 1 of this Article, the suspension of the parking place or any part thereof shall be reviewed by the person who
suspended its use and any continuation of the suspension that they consider necessary shall be notified to the council and shall not exceed a further period of twenty-eight days without similar review.
12.3 Any person duly authorised by the council or authorised agent may suspend the use of a parking place or any part thereof whenever they consider such suspension reasonably necessary:-
(a) for the purpose of facilitating the movement of traffic or promoting its safety;
(b) on any occasion on which it is likely, by reason of some special att raction or occurrence, that any street will be thronged or obstructed;
(c) for the purpose of any building operation, demolition or excavation adjacent to the parking place, the maintenance, improvement or reconstruction of the highway or the cleansing of gullies in or adjacent to the parking place, the laying, erection alteration or repair in or
adjacent to the parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any electronic communications network, or the placing, maintenance or removal of any traffic sign;
(d) for the convenience of occupiers of premises adjacent to the parking place, on any occasion of the removal of furniture to or from one office or dwelling-house adjacent to that parking place, from or to a depository, or another office or dwelling-house;

(e) for the convenience of occupiers of premises adjacent to the parking place at times of weddings or funerals, or on other special occasions.
12.4 A police constable in uniform may suspend for not longer than seven days the use of a parking
place or any part thereof whenever he considers such suspension reasonably necessary: -
(a) for the purpose of facilitating the movement of traffic or promoting its safety;
(b) on any occasion on which it is likely, by reason of some special attraction or occurrence,
that any street will be thronged or obstructed.
12.5 On the suspension of the use of a parking place or any part thereof in accordance with the provisions of this Article, the person authorising or causing such suspension shall place or
cause to be placed in or adjacent to that parking place, or that part thereof, as the case may be, a traffic sign indicating that waiting by vehicles is prohibited.
12.6 No person shall cause or permit a vehicle to wait in a parking place or any part thereof at any
time during which there is displayed in or adjacent to that parking place or that part thereof, as the case may be, a traffic sign placed in pursuance of paragraph 5 of this Article:
Provided that nothing in this paragraph shall apply:-
(a) in respect of any vehicle being used for ambulance, fire brigade or police purposes or any vehicle which is waiting for any reason specified in Article 14.1(b), (d) or (e);
(b) to anything done with the permission of the person suspending the use of the
parking place or part thereof, as the case may be, in pursuance of paragraph 1, 3 or 4 of this Article, a police constable in uniform or a civil enforcement officer.
Restriction on the use of a parking place
13.1 During the permitted hours no person shall use any parking place or any vehicle while it is in a parking place in connection with the sale or offering or exposing for sale of any goods to any person in or near the parking place or in connection with the selling or offering for sale of their
skill in handicraft or their services in any other capacity:
Provided that nothing in this Article shall prevent the sale or offering or exposing for sale of goods from a vehicle:-
(a) if the vehicle is a passenger vehicle of not more than 2.28 metres in height, a
goods vehicle of not more than 2.28 metres in height, or a motor cycle and the goods are immediately delivered at or taken into premises adjacent to the vehicle from which the sale is effected; or
(b) if the vehicle is one to which the provisions of Article 14.1(i) apply.
Restriction on waiting by a vehicle in a parking place
14.1 Notwithstanding the foregoing provisions of this Order, any vehicle may wait during the
permitted hours in any part of a parking place if the use of that part has not been suspended and if:-
(a) the vehicle is waiting for a period not exceeding two minutes or such longer period as a
civil enforcement officer may approve to enable a person to board or alight from the vehicle or load onto or unload from their personal luggage:
Provided that if that person is a person having any disability or any injury which
seriously impairs their ability to walk, or who is blind, the vehicle may wait for so long as may be necessary to enable that person to board or alight from the vehicle or load onto or unload from their personal luggage;
(b) the vehicle is waiting owing to the driver being prevented from proceeding by circumstances beyond their control or to such waiting being necessary in order to avoid an accident;
(c) the vehicle is being used for ambulance, fire brigade or police purposes or, not being a passenger vehicle, is being used in the service of a local authority in pursuance of statutory powers or duties provided that in all the circumstances it is reasonably

necessary in the exercise of such powers or the performance of such duties for the vehicle to wait in the place in which it is waiting;
(d) the vehicle is waiting only for so long as may be necessary to enable it to be used in
connection with the removal of any obstruction to traffic;
(e) the vehicle is being used by a universal service provider in the course of the provision of a universal postal service and the vehicle is waiting only for so long as may be
reasonably necessary for postal packets to be collected or delivered at premises or posting boxes adjacent to the place in which the vehicle is waiting;
(f) the vehicle, not being a passenger vehicle, is waiting only for so long as may be
necessary to enable it to be used for any purpose specified in Article 12.3(c);
(g) the vehicle is in actual use in connection with the removal of furniture to or from one office or dwelling-house adjacent to the parking place from or to a depository, another office or
dwelling-house;
(h) in any other case, the vehicle is waiting for the purpose of delivering or collecting goods or loading or unloading the vehicle at premises adjacent to the parking place in which the
vehicle is waiting and the vehicle does not wait for such purpose for more than twenty minutes or for such longer period as a civil enforcement officer may approve;
(i) the vehicle is waiting while goods are being sold or offered or exposed for sale from the
vehicle by a person who is licensed by the council to sell goods from a stationary vehicle on a pitch situated in the parking place;
(j) the vehicle is waiting with the written consent of the council or authorised agent and such
conditions and requirements as they may impose are being complied with.
14.2 Except as provided by this Order, the driver or person in charge of a vehicle shall not cause or permit that vehicle to wait in a parking place during the permitted hours.
14.3 The driver of a vehicle waiting in a parking place by virtue of the provisions of paragraph 1 of this Article shall cause it so to stand in accordance with the provisions of Article 10.
14.4 Nothing in the foregoing provisions of this Order shall be taken as authorising anything which would be a contravention of any Regulations made or having effect as if made under section 25
of the Road Traffic Regulation Act 1984.
Engines to be turned off whilst vehicles are stationary
15.1 Notwithstanding the foregoing provisions of this Order, no person shall cause or permit any
vehicle to wait in any parking place specified in a Schedule to this Order, unless the driver of the vehicle shall turn off the engine of that vehicle as soon as the vehicle is in position and stationary in the parking place and shall not start the engine again except when about to change
the position of the vehicle or depart from the parking place or designated area.
15.2 Save as provided in paragraph 1 of this Article, the driver of a vehicle shall, when the vehicle is stationary, stop the action of any machinery attached to or forming part of the vehicle so far as
may be necessary for the prevention of noise or of exhaust emissions (as defined in regulation 3 of the Road Vehicles (Construction and Use) Regulations 1986
i - as amended by the Road
Vehicles (Construction and Use) (Amendment) Regulations 1998j).
15.3 The provisions of paragraph 1 of this Article do not apply:-
(a) when the vehicle is stationary owing to the necessities of traffic;
(b) so as to prevent the examination or working of the machinery where the examination is
necessitated by any failure or derangement of the machinery or where the machinery is required to be worked for a purpose other than driving the vehicle; or
(c) in respect of a vehicle propelled by gas produced in plant carried on the vehicle, to such
plant; or

(d) to any vehicle being used for police, fire brigade or ambulance purposes.
Placing of traffic signs, etc.
16.1 The council shall:-
(a) place and maintain traffic signs indicating the limits of each parking place referred to in Schedules 1, 2, 3 or 4;
(b) place and maintain in or in the vicinity of each parking place described in Schedules 1, 2,
3 or 4 traffic signs indicating that such parking places may be used during the permitted hours for the leaving only of the vehicles specified in Article 4.2, 4.3, or 4.4 respectively;
(c) carry out such other work as is reasonably required for the purposes of the satisfactory
operation of a parking place.
Placing of traffic signs at parking places indicating availability of the electronic payment system
17.1 The council shall place and maintain traffic signs in or in the vicinity of each parking place
referred to in Schedules 3 or 4 indicating:-
(a) that such parking place may be used by vehicles making payment of the parking charge via the electronic payment system; and
(b) the location identification number of such parking place or part thereof.

Section 2 – The park ing charge and indications by the electronic payment system
Amount of the parking charge and maximum parking periods
18.1 The parking charge for a vehicle left in a parking place referred to in Schedule 3 during the
permitted hours shall, subject as hereinafter provided, be as specified in item 1 of Schedule 6.
18.2 The parking charge for a vehicle left in a parking place referred to in Schedule 4 during the permitted hours shall, subject as hereinafter provided, be as specified in item 2 of Schedule 6.
18.3 Where payment of the parking charge has been made in respect of a vehicle left in a parking place in Schedule 3 or 4, the parking period shall not exceed the maximum parking period specified in column 4 of that Schedule.
Payment of the parking charge
19.1 Payment of the parking charge shall be made, in accordance with paragraph 3 of this Article, immediately as a vehicle is left in a parking place referred to in Schedule 3.
19.2 Payment of the parking charge shall be made, in accordance with paragraph 3 of this Article, immediately as a vehicle is left in a parking place referred to in Schedule 4.
Provided that nothing in the paragraph above shall apply where a vehicle is left in a
parking place referred to in Schedule 4 for a period not exceeding 30 minutes, and the vehicle is subsequently taken away from that parking place at or before the expiration of said period.
19.3 The parking charge shall be payable on the leaving of a vehicle in a parking place referred to in Schedule 3 or 4 using the electronic payment system.
Indications and evidence by the electronic payment system
20.1 Where a vehicle has been left in a parking place referred to in Schedule 3 or 4 using the electronic payment system, an indication that payment has been made and the parking period for which payment has been made shall appear on a hand-held device.
20.2 If at any time while a vehicle is left in a parking place referred to in Schedule 3 or 4 and no indication appears on a hand-held device that payment of the parking charge has been made using the electronic payment system, or an indication that the parking period for which payment was made has expired, it shall be presumed, unless the contrary is proved, that either:-
(a) the parking charge has not been duly paid in respect of that vehicle; or
(b) the parking period for which payment was made has already expired.
Interval before a vehicle may again be left in a parking place
21.1 No vehicle which, having made payment of the parking charge by the electronic payment system, having been taken away from a parking place specified in Schedule 3 or 4 during the permitted hours shall, either:-
(i) where a minimum return interval is specified in column 5 of Schedule 3 or 4 relating to that parking place, until the expiration of the minimum return interval so specified from the time it was taken away, again be left in that parking place during the permitted hours; or
(ii) where no minimum return interval is specified, again be left in that parking place during
the permitted hours on that same day.

Section 3 – Application for and grant or issue of permits
Application for and grant of resident’s permits
22.1 A resident who is the owner of a vehicle of the class specified in Article 4.1 may apply to the
council or authorised agent for the grant of a resident’s permit in respect of that vehicle and any such application shall be made on a form obtainable from or made available online by the council or authorised agent and shall include the particulars and information required by such
form to be supplied and shall be accompanied by the remittance of the relevant charge specified in item 3 of Schedule 6:-
Providing that a resident may not apply to the council or authorised agent for the grant of
a resident’s permit in any case where three resident ’s permits have previously been granted to a resident or to residents residing at the same address and the permits remain valid.
22.2 On receipt of an application for a resident ’s permit or after the grant of a resident’s permit, the council or authorised agent may at any time require an applicant for a resident ’s permit or a resident’s permit holder, as the case may be, to produce to an officer of the council or a
representative of the authorised agent:-
(i) in respect of any application, such evidence as they may reasonably call for to verify the details of that application; or
(ii) in respect of any resident’s permit that has been granted, such evidence as they may reasonably call for to verify that the resident’s permit is valid.
22.3 On receipt of an application made under the provisions of this Article and on receipt of the
charge specified in item 3 of Schedule 6, the council or authorised agent, upon being satisfied that the applicant is a resident and is the owner of the vehicle in respect of which the application is made and the vehicle is of the class specified in Article 4.1 and that not more than two
resident’s permits which remain valid have been granted to a resident or residents residing at the same address and that no other permit which remains valid has been granted under the provisions of this Order in respect of that vehicle, shall grant to the applicant:-
one resident’s permit for the leaving during the permitted hours in a parking place referred to in
Schedule 1, 2 or 3 of the vehicle to which such resident ’s permit relates by the resident ’s permit holder or by any person using such vehicle with the consent of the resident ’s permit holder, other than a person to whom such vehicle has been let for hire or reward.
Surrender, withdrawal and validity of resident ’s permits
23.1 A resident’s permit holder may surrender a resident ’s permit to the council or authorised agent at any time and shall surrender a resident ’s permit to the council or authorised agent on the
occurrence of any one of the following events:
(a) the resident’s permit holder ceasing to be a resident;
(b) the resident’s permit holder ceasing to be the registered keeper of the vehicle in respect
of which the resident’s permit was granted;
(c) the withdrawal of such resident’s permit by the council or authorised agent under the provisions of paragraph 2 of this Article;
(d) the vehicle in respect of which such resident ’s permit was granted being adapted or used in such a manner that it is not a vehicle of the class specified in Article 4.1.
23.2 The council or authorised agent may, by notice in writing served on the resident ’s permit holder
by sending the same by the recorded delivery service to the resident ’s permit holder at the address shown by that person on the application for the resident ’s permit or at any other address believed to be that person’s place of abode, withdraw a resident ’s permit if it appears to
the council or authorised agent that any of the events set out in paragraph 1(a), 1(b) or 1(d) of this Article has occurred.
23.3 Where a resident’s permit is granted to any person upon receipt of a cheque and the cheque is
subsequently dishonoured, the resident ’s permit shall cease to be of any effect and the council or authorised agent shall, by notice served on the person to whom such resident ’s permit was

granted, by sending the same by the recorded delivery service to them at the address shown by that person on the application for the resident ’s permit or at any other address believed to be that person’s place of abode, withdraw that resident's permit.
23.4 A resident’s permit shall cease to be valid at the expiration of the period specified at the grant of the permit on the occurrence of one or more of the events referred to in paragraph 1 of this Article, whichever is the sooner.
Application for and grant of business permits
24.1 A business user who uses a vehicle of the class specified in Article 4.1 that:-
(a) is essential to the operation of a business carried out at any premises the postal address
of which is in a street or length of street in the London Borough of Southwark specified in
Schedule 6; and
(b) is used for the purchase or sale of goods or services or for delivering goods or providing
a service, in connection with that business;
may apply to the council or authorised agent for the grant of a business permit in respect of that vehicle and any such application shall be made on a form obtainable from the council or
authorised agent and shall include the particulars and information required by such form to be supplied and shall be accompanied by the remittance of the relevant charge specified in item 4 of Schedule 6.
24.2 On receipt of an application for a business permit or after the grant of a business permit, the
council or authorised agent may at any time require an applicant for a business permit or a
business permit holder, as the case may be, to produce to an officer of the council or a
representative of the authorised agent:-
(a) in respect of any application, such evidence as they may reasonably call for to verify the
details of that application; or
(b) in respect of any business permit that has been issued, such evidence as they may
reasonably call for to verify that the business permit is valid.
24.3 On receipt of an application made under the provisions of this Article and on receipt of the charge specified in item 4 of Schedule 6, the council or authorised agent, upon being satisfied that the applicant is a business user who uses a vehicle of the description specified in
paragraph 1 of this Article and that no other permit which remains valid has been granted under the provisions of this Order in respect of that vehicle, shall grant to the applicant:-
one business permit for the leaving during the permitted hours in a parking place referred to in
Schedule 1, 2 or 3 of the vehicle to which such business permit relates, by the business permit holder or by any person using such vehicle with the consent of the business permit holder, other than a person to whom such vehicle has been let for hire or reward.
Surrender, withdrawal and validity of business permits
25.1 A business permit holder may surrender a business permit to the council or authorised agent at any time and shall surrender a business permit to the council or authorised agent on the
occurrence of any one of the following events:-
(a) the business permit holder ceasing to be a business user;
(b) the business permit holder ceasing to be the user of the vehicle in respect of which the business permit was granted;
(c) the withdrawal of such business permit by the council or authorised agent under the provisions of paragraph 2 of this Article;
(d) the vehicle in respect of which such business permit was granted being adapted or used
in such a manner that it is not a vehicle of the class specified in Article 4.1.
25.2 The council or authorised agent may, by notice in writing served on the business permit holder by sending the same by the recorded delivery service to the business permit holder at the
address shown by that person on the application for the business permit or at any other address

believed to be that person’s place of abode or business, withdraw a business permit if it appears to the council or authorised agent that any of the events set out in paragraph 1(a), 1(b) or 1(d) of this Article has occurred.
25.3 Where a business permit is granted to any person upon receipt of a cheque and the cheque is subsequently dishonoured, the business permit shall cease to be of any effect and the council or authorised agent shall, by notice served on the person to whom such business permit was
granted by sending the same by the recorded delivery service to them at the address shown by that person on the application for the business permit or at any other address believed to be that person’s place of abode or business, withdraw that business permit.
25.4 A business permit shall cease to be valid at the expiration of the period specified at the grant of the permit or on the occurrence of one or more of the events referred to in paragraph 1 of this Article, whichever is the sooner.
Application for and grant or issue of visitor’s permits
26.1 A resident may apply to the council or authorised agent for the grant or issue of either a visitor’s
parking permit or a number of visitor’s parking permits in respect of vehicles of the class
specified in Article 4.1 and any such application shall be made on a form obtainable from or
made available online by the council or authorised agent and shall include the particulars and
information required by such form to be supplied and shall be accompanied by the remittance of
the charge specified in item 5 of Schedule 6:
Providing that the quota of visitor’s permits granted or issued to the resident, which the council may from time to time resolve to limit, has not been exceeded.
26.2 On receipt of an application made under the provisions of this Article and of the charge
specified in item 5 of Schedule 6 and on being satisfied that the applicant is a resident and that
they satisfy the council’s criteria, the council or authorised agent shall grant or issue to the
applicant either a visitor’s parking permit or a number of visitor’s parking permits for the leaving
during the permitted hours in a parking place specified in Schedule 1, 2 or 3 of vehicles of the
class specified in Article 4.1:
Providing that the council or authorised agent shall not grant or issue more than the quota of visitor’s permits that the council may from time to time resolve to supply.
26.3 The council may at any time require an applicant for either a visitor’s parking permit or a number
of visitor’s parking permits to produce to an officer of the council or a representative of the
authorised agent such evidence in respect of an application for visitor’s permits as they may
reasonably require to verify any particulars or information given to them or in respect of any
visitor’s permits granted or issued by them as they may reasonably call for to verify that the
visitor’s permits are valid.
26.4 A visitor’s permit shall be valid for the duration of the parking session specified at the time of
issue of that visitor's permit only, running from the beginning of the parking session on the day on which it is first validated.
Surrender, withdrawal and validity of visitor’s permits
27.1 A resident may surrender visitor’s permits to the council or authorised agent at any time and shall surrender all unused visitor’s permits to the council or authorised agent on ceasing to be a resident.
27.2 The council or authorised agent may, by notice in writing served on the resident by sending the
same by the recorded delivery service to the address shown by that person on the application
for the visitor’s permit or at any other address believed to be that person’s place of abode,
withdraw all visitor’s permits if it appears to the council or authorised agent that the person has
ceased to be a resident.
Refunds of charges paid for resident ’s permits, business permits and visitor’s permits
28.1 A resident’s permit holder, or a business permit holder who surrenders a resident ’s permit or a business permit respectively to the council or authorised agent, shall be entitled to a refund of

the charge paid or part of the charge paid, in accordance with the provisions set out in item 6 of Schedule 6.
28.2 A resident who surrenders a visitor’s permit to the council or authorised agent, shall be entitled
to a refund of the charge paid or part of the charge paid, in accordance with the provisions set out in item 7 of Schedule 6.
Restriction on the removal of permits
29.1 Where a visitor’s permit has been displayed in accordance with the provisions of Article 5, no person not being the driver of the vehicle shall remove the visitor’s permit unless authorised to do so by the driver of the vehicle:
Provided that nothing in this Article shall apply to a civil enforcement officer or a police constable in uniform or any other person removing the vehicle in pursuance of an arrangement made under regulations pursuant to the powers contained in sections 99,
100 and 101 of the Road Traffic Regulation Act 1984.
Form of permits
30.1 Where a visitor’s permit has been issued as a printed document it shall include the following
particulars:
(a) the registration mark of the vehicle in respect of which the visitor’s permit has been validated;
(b) the date on which the visitor’s permit is valid;
(c) an indication that the visitor’s permit has been issued by the council or authorised agent; and
(d) an indication of the controlled parking zone within which the visitor’s permit is valid.
30.2 The particulars specified in paragraphs 1(a) and (b) of this Article are to be completed by the resident who applied for the visitor’s permit or by the visitor, before the permit is displayed in
accordance with the provisions of Article 5.1 or 5.2.

Amount of the parking charge using the electronic payment system
1. The parking charge referred to in Article 18.1 shall be payable using the electronic payment system at the rate of either:-
(a) two pounds and seventy-five pence (£2.75) per hour, in respect of a vehicle other than a
diesel vehicle; or
(b) three pounds and twenty five pence (£3.25) per hour, in respect of a diesel vehicle;
subject to the maximum parking period specified in Article 18.3.
2. The parking charge referred to in Article 18.2 shall be payable using the electronic payment system at a rate of either:-
(a) free of charge for the first 30 minutes of any parking period;
(b) then either:-
(i) two pounds and seventy-five pence (£2.75) per hour, in respect of a vehicle other than a diesel vehicle; or
(ii) three pounds and twenty five pence (£3.25) per hour, in respect of a diesel vehicle;
for any subsequent stay, subject to the maximum parking period specified in Article 18.3.
Resident's permits
3. The charge referred to in Articles 22.1 and 22.3 (in relation to the grant of a resident's permit),
shall be as follows:-
(a) in the case of resident applicants other than disabled person's badge holders in respect of
any vehicle of the class specified in Article 4.1, other than a solo motor cycle or a greener
vehicle:–
(i) the sum of fifteen pounds and seventy-five pence (£15.75) in respect of a permit which, subject to the provisions of this order, shall be valid for a period of one month commencing from the beginning of the month in which the permit first became valid;
(ii) the sum of thirty-six pounds and sixty pence (£36.60) in respect of a permit which, subject to the provisions of this order, shall be valid for a period of three months commencing from the beginning of the month in which the permit first became valid;
(iii) the sum of sixty-seven pounds and eighty-five pence (£67.85) in respect of a permit which, subject to the provisions of this order, shall be valid for a period of six months commencing from the beginning of the month in which the permit first became valid;
(iv) the sum of one hundred and five pounds (£125.00) in respect of a permit which, subject to the provisions of this order, shall be valid for a period of twelve months commencing from the beginning of the month in which the permit first became valid;
(b) in the case of resident applicants who are disabled person's badge holders in respect of
any vehicle of the class specified in Article 4.1, the sum of thirty -one pounds and twenty-five pence (£31.25) in respect of a permit which, subject to the provisions of this order, shall be valid for a period of twelve months commencing from the beginning of the month
in which the permit first became valid;
(c) in the case of a solo motor cycle or an ultra-low emission vehicle, the sum of thirty-one
pounds and twenty-five pence (£31.25) in respect of a permit which, subject to the
provisions of this order, shall be valid for a period of twelve months commencing from the
beginning of the month in which the permit first became valid.

Business permits
4. The charges referred to in Article 24.1 and 24.3 (in relation to the grant of a business permit)
shall be as follows:-
(a) in the case of any vehicle of the class specified in Article 4.1, other than an electric
vehicle:-
(i) the sum of one hundred and eighty pounds (£180.00) in respect of a permit which, subject to the provisions of this order, shall be valid for a period of three months commencing from the beginning of the month in which the permit first became
valid;
(ii) the sum of three hundred and sixty pounds (£360.00) in respect of a permit which, subject to the provisions of this order, shall be valid for a period of six months
commencing from the beginning of the month in which the permit first became valid;
(ii) the sum of five hundred and ninety pounds (£590.00) in respect of a permit which,
subject to the provisions of this order, shall be valid for a period of twelve months commencing from the beginning of the month in which the permit first became valid;
(b) in the case of an electric vehicle, the sum of two hundred and ninety-five pounds (£295.00) in respect of a permit which, subject to the provisions of this order, shall be valid for a period of twelve months commencing from the beginning of the month in which
the permit first became valid.
Visitor's permits
5. The charge referred to in Article 26.1 and 26.2 (in relation to the grant or issue of visitor's
permits), shall be as follows:-
(a) in the case of resident applicants other than disabled person's badge holders, in relation
to the grant of paperless or ‘virtual’ visitor’s permits:-
(i) twenty-six pounds and ninety pence (£26.90) for the first set of ten visitor's all day parking sessions purchased between 1
January and 31 December in the same
year;
(ii) forty-eight pounds and forty pence (£48.40) for the second and subsequent sets of ten visitor's all day parking sessions purchased between 1 January and 31
December in the same year;
(iii) five pounds and forty pence (£5.40) for a visitor’s all day parking session, purchased singly;
(iv) twenty-one pounds and fifty pence (£21.50) for a set of ten visitor's 5 hour parking sessions;
(v) two pounds and eighty pence (£2.80) for a visitor’s 5 hour parking session, purchased singly;
(vi) ten pounds and eighty pence (£10.80) for a set of ten visitor’s 1 hour parking sessions;
(vii) one pound and seventy pence (£1.70) for a visitor’s 1 hour parking session,
purchased singly;
(b) in the case of resident applicants who are disabled person's badge holders, in relation to the grant of paperless or ‘virtual’ visitor’s permits :-
(i) thirteen pounds and forty-five pence (£13.45) for the first set of ten visitor's all day parking sessions purchased between 1
January and 31 December in the same
year;
(ii) twenty-four pounds and twenty pence (£24.20) for the second and subsequent sets of ten visitor's all day parking sessions purchased between 1 January and 31
December in the same year;

(iii) two pounds and seventy pence (£2.70) for a visitor’s all day parking session, purchased singly;
(iv) ten pounds and seventy-five pence (£10.75) for a set of ten visitor's 5 hour parking
sessions;
(v) one pound and forty pence (£1.40) for a visitor’s 5 hour parking session, purchased singly;
(vi) five pounds and forty pence (£5.40) for a set of ten visitor’s 1 hour parking sessions;
(vii) eighty-five pence (£0.85) for a visitor’s 1 hour parking sess ion, purchased singly;
(c) in the case of all resident applicants, in relation to the issue of visitor’s permits as a printed document:-
(i) twenty-nine pounds and seventy pence (£29.70) for the first book of ten visitor's all
day parking permits purchased between 1 January and 31 December in the same year;
(ii) fifty-three pounds and twenty pence (£53.20) for the second and subsequent books
of ten visitor's all day parking permits purchased between 1 January and 31 December in the same year.
Refunds of charges paid for resident's permits and business permits
6. The refunds referred to in Article 28.1 shall be as follows:-
(a) a resident's permit holder who surrenders a resident's permit to the council before it
becomes valid, a business permit holder who surrenders a business permit to the council
before it becomes valid, shall be entitled to a refund, less an administration charge, of the
charge paid in respect of the surrendered permit;
(b) a resident's permit holder who surrenders a resident's permit to the council after it
becomes valid, a business permit holder who surrenders a business permit to the council
after it becomes valid , shall be entitled to a refund of part of the charge paid in respect of
the surrendered permit, as follows:
(i) where the surrendered permit is valid for less than one calendar month, no such
refund will be paid;
(ii) where the surrendered permit is valid for one complete calendar month or more, the
part of the charge that is refundable shall be calculated as the total sum of the charge paid in respect of the permit, divided by the number of whole calendar months for which the permit is valid and multiplied by the number of complete
calendar months which remain unexpired at the time the permit is surrendered to the council or authorised agent, less an administration charge, providing that where the refund calculated includes a fraction of a penny, the amount of the refund shall
be reduced to the nearest full penny.
Refunds of charges paid for visitor's permits
7. The refund referred to in Article 28.2 shall be as follows:-
(a) a resident who surrenders a set or book of unused visitor's permits to the council or
authorised agent, shall be entitled to a refund, less an administration charge, of the
charge paid in respect of that set of visitor's permits;
(b) no refund shall be payable for any book of lost or damaged visitor's permits (including a book that contains less than ten permits) or for any individual visitor's permit in writing that is no longer part of a book.

Administration charge
8. The administration charge payable on either:-
(a) applying to the council or authorised agent to change the vehicle registration number for
a which a permit is granted; or
(b) surrendering a permit to the council or authorised agent for refund or partial refund;
shall be fourteen pounds and fifty pence (£14.50).

This Order:-
(i) provides new permit holders’ parking places in Anchor Street, Beatrice Road, Blue Anchor Lane, Bombay Street, Camilla Road, Galleywall Road, Lynton Road, Roseberry Street, Simms Road, Straithnairn Street and Tenda Road;
(ii) provides new 'permit holders past this point' parking places in parts of Beatrice Road and Camilla Road;
(iii) provides new 'shared-use' parking places - for the use of both permit holders and ‘pay by phone’
users – in Anchor Street, Beatrice Road, Blue Anchor Lane, Bombay Street, Camilla Road, Galleywall Road, Lynton Road, Roseberry Street, Simms Road, St James’s Road, Straithnairn Street and Tenda Road;
(iv) provides new ‘stop and shop’ parking places – which may be used free of charge for the first 30 minutes of parking, with a longer stay available by ‘pay by phone’ – in Blue Anchor Lane, Bombay Street and Southwark Park Road; and
(v) makes certain provisions and sets out certain restrictions for the operation and use of the aforementioned parking places and makes provision for the grant or issue of resident’s, business and visitor’s permits for use therein;
in the new south-east Bermondsey area ‘SEB’ parking zone, in the London Borough of Southwark.

Citation and commencement

Interpretation
2.1 In this Order:-
“car club” means an organisation operating a car sharing scheme approved by the Council to operate within its boundaries and which supports the planning and sustainable transport policy objectives of the Council;
“car club permit” means a permit issued by the Council to a car club, under the provisions of Article 16.4 of the Order of 2011;
"council" means the council of the London Borough of Southwark;
“enactment” means any enactment, whether public general or local, and includes any order,
byelaw, rule, regulation, scheme or other instrument having effect by virtue of an enactment;
“parking bay” means an area within a parking place that is indicated by road markings as being provided for the leaving of one vehicle only;
“parking place” means an area on a highway designated as a parking place by this Order; and
“the Order of 2011” means The London Borough of Southwark (Parking Places) (Car Club) (No. 1) Order 2011

2.2 Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment.
2.3 Unless the context otherwise requires, any expression used in this Order which is also used in the Order of 2011 shall have the same meaning as in that Order.
Revocation
3.1 Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before the coming into force of this Order, the designation by the Order of 2011 of the parking place numbered S101 in the Schedule therein, is hereby revoked.
Designation of parking place and application of the Order of 2011 thereto
4.1 The area on a highway comprising the length of carriageway of a street specified in columns (2) and (3) of the Schedule to this Order and bounded on one side of that length by the edge of the
carriageway, and having a width throughout of 2 metres, is designated as a parking place.
4.2 The provisions of the Order of 2011 (other than Articles 3 and 15) shall apply to the area designated as a parking place by this Order as if in those provisions any reference to a
designated parking place or to a parking place shall include a reference to the area designated as a parking place by this Order and as if any reference to the Schedule to the Order of 2011 included a reference to the Schedule to this Order.
Placing of traffic signs etc.
5.1 The council shall:-
(a) place and maintain traffic signs indicating the limits of the parking place referred to in the
Schedule to this Order;
(b) place and maintain in or in the vicinity of each parking place referred to in the Schedule to this Order traffic signs indicating that such a parking place may be used during the
permitted hours for the leaving only of the vehicles specified in Article 4.1 of the Order of 2011; and
(c) carry out such other works as is reasonably required for the purposes of the satisfactory operation of a parking place.

Citation and commencement
1.1 This Order may be cited as The London Borough of Southwark (Loading bays) (No. **) Order

Interpretation
2.1 In this Order:-
"council" means the council of the London Borough of Southwark;
"enactment” means any enactment, whether public general or local, and includes any order,
bye-law, rule, regulation, scheme or other instrument having effect by virtue of an enactment; and
"the Order of 2016" means the London Borough of Southwark (Loading bays) (No. 1) Order
2016b.
2.2 Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment.
2.3 Unless the context otherwise requires, any expression used in this Order which is also used in the Order of 2016 shall have the same meaning as in that Order.
Revocation
3.1 Without prejudice to the validity of anything done or to any liability incurred in respect of any act
or omission before the coming into force of this Order the designation by the Order of 2016 of the loading bays numbered 1, 5 and 6 in Schedule 1 therein; and the good vehicle loading bays numbered 3, 4 and 5 in Schedule 2 therein, are hereby revoked.

Designation of loading bay and application of the Order of 2016 thereto
4.1 Each area on a highway comprising the length of carriageway of a street specified in column 2 of a Schedule to this Order and bounded on one side of that length by the edge of the
carriageway, is designated as a loading bay.
4.2 The provisions of the Order of 2016 (other than Articles 3.1 and 12.1) shall apply to each area designated as a loading bay by this Order, as if in those provisions, any reference to a loading
bay shall include a reference to each area designated as a loading bay by this Order and as if: -
(a) any reference to Schedule 1 to the Order of 2016 included a reference to Schedule 1 to this Order; and
(b) any reference to Schedule 2 to the Order of 2016 included a reference to Schedule 2 to this Order.
Placing of traffic signs etc.
5.1 The council shall:-
(a) place and maintain traffic signs indicating the limits of each loading bay referred to in a Schedule to this Order;
(b) place and maintain in or in the vicinity of each loading bay referred to in a Schedule to this Order, traffic signs indicating that such a loading bay may be used during the permitted hours for the leaving only of the vehicles referred to in Article 4.1 of the Order of 2016; and
(c) carry out such other work as is reasonably required for the purposes of the satisfactory operation of a loading bay.
