The first step is complete since you are an active REALTOR member on the national, state, and local level. The next step is to contribute and create innovative and
new processes to make VPAR better for current and future members. Your ideas count and we want to hear them. As VPAR president, my most rewarding activity has been participating in the new REALTOR Indoctrination classes. So far this year, eighty three individuals have joined our VPAR family. Just think, all successful agents, award winners, and volunteer leadership members were rookies once in their career. The possibility of a future REALTOR of the Year, Salesperson of the Year, Director, Treasurer or President may be in our midst. I hope every one of them achieves their vision of greatness in their endeavors this year and years to come. SERVICE ANIMALS IN HOUSING & PUBLIC COMMON AREAS: AN OVERVIEW OF THE REQUIREMENTS UNDER THE ADA AND FHA
Service animals are often essential to a dis-abled individual’s ability to function in society without constant human assistance. The ben-efits are well established and heavily enforced federal laws have been enacted to protect these disabled individuals’ rights to utilize service animals in public housing and places of public accommodation. Specifically, the Fair Housing Act (FHA) sets the requirements regarding the admission of service and assistance animals in rental offices, property manager offices, public entities providing housing, privately owned housing, assisted living facilities, and housing provided by universities and other education centers. Title III of the Americans with Disabil-ities Act (ADA) sets the requirements regarding admission of service and assistance animals in the public common areas in and surrounding each of those places subject to the FHA.
This area of law can be quite simple and easy to apply in some circumstances and very confus-ing and quite difficult in others. It is commonly accepted, for example, that a dog assisting a blind individual is a service animal and that the blind individual is suffering from a disabil-ity. Accordingly, most establishments would
not think twice before granting admission to the disabled individual with his or her service dog. What about a service dog accompanying an otherwise fully functioning individual for the purposes of detecting and warning that in-dividual of an impending seizure? After some explanation, most would make the correct de-cision and grant admission to a service animal of this sort. What about a cat assisting an in-dividual with anxiety? Some may try to draw the line here, arguing that a cat is not an appro-priate service animal or that it is incapable of actually assisting an individual suffering from anxiety. This scenario is a bit tricky, however. Often times, barring such a cat from admission would be prohibited by the FHA but permis-sible under Title III of the ADA.
This article provides an overview of how the different requirements of the FHA and Title III of the ADA apply to private and public housing, establishments associated with housing, and places of public accommodation within those establishments. Consulting with an attorney prior to turning away a disabled individual with a service animal is advisable and highly recommended. However, when the practical time constraints associated with a request pre-vent such consultation, being familiar with the information provided below will be extremely helpful.
The FHA applies to virtually all types of private-ly owned and public housing. Notwithstanding any general rules concerning pets, all housing providers must consider disabled tenant and applicant service animal related requests for a reasonable accommodation. Under the FHA, an individual may keep any service animal in

his or her dwelling as a reasonable accommo-dation if all of the following requirements are met:
(1) the person has a disability;
(2) the animal is necessary to afford the person with a disability an equal opportunity to use and enjoy the dwelling; and
(3) there is an identifiable relationship or nex-us between the disability and the assistance the animal provides.
If these requirements are met, the housing pro-vider must not only provide reasonable accom-modation for the disabled individual, but must also waive any “no pets” policies and may not charge any fees as a condition of allowing the service animal to reside with the tenant.
The inquiry does not actually end there, how-ever. There are also some exceptions. A re-quest for a reasonable accommodation may still be denied if doing so would cause an un-due financial and administrative burden on the provider or would fundamentally alter the na-ture of the services otherwise provided to all tenants. Additionally, if the animal in question poses a direct threat to the health or safety of others or would cause substantial damage to the property of others and such threat or dam-age cannot be reduced by some other reason-able accommodation, the tenant or applicant request may be denied.
When evaluating a request for a reasonable ac-commodation and any potential exceptions, it is also important to be aware of strictly enforced FHA parameters. A housing provider may only request medical documentation evidencing an individual’s disability if the individual’s dis-

NEWPORT NEWSVPAR, the City’s Planning Department and Dr. Tom Hall from CNU continue to collaborate in data sources to be taken under review by Dr. Hall, the economist who is conducting the housing needs study and market analysis in the City. From Census Data to the American Community Survey, to statistics from REIN to City-wide apartment data, Dr. Hall is taking as much data and information as he can gather. The target completion date for the study to be released to VPAR and the City is mid- to late-August. The PPC will review the draft report initially as will the City Planning Department; from there, we will assess how best to formulate the study into a meaningful housing policy, perhaps starting with formulating housing goals and objectives as part of the City’s Comprehensive Plan that currently is under review. Stay tuned….there is continued excitement from City leaders on this effort that is underwritten by VPAR, courtesy of a NAR Housing Opportunity Grant!

HAMPTONLate last month, town-hall style workshops known as “Dutch Dialogues” began taking place with area officials to discuss how leaders and residents in Hampton and Norfolk can address flooding and land subsidence. Two areas of Hampton Roads are being studied including Hampton and Norfolk. In Hampton, the Newmarket Creek watershed is a vein that branches through the city’s centermost neighborhoods, causing periodic flooding during heavy rainfalls as well as strong nor’easters and hurricanes. The Tidewater Drive district in Norfolk is also an area that periodically floods.
The City, local businesses and the military are discussing next steps so that concrete action items can be formulated and implemented. VPAR has been party to those discussions and will play an active role in developing potential responses and “asks.”
The City Council voted unanimously to approve the provision to the zoning ordinance that will allow VPAR and other commercial tenants in the Hampton Roads Center office
VPAR is taking an active role along with Chamber and City leaders to elevate the importance of Ft. Eustis as an economic driver of the Peninsula. This new effort kicks off in earnest with the convening of the Ft. Eustis Civic Leaders Association (ECLA); the Association’s Legislative Consultant, Susan Gaston, is an appointed member to ECLA and will serve in the role as Secretary. In early September, ECLA members will receive a tour of the base and an in-depth briefing of the mission, the future and the role of the community in protecting the installation from additional cuts. VPAR members continue to receive kudos from the Eustis leadership for being part of the Community Conversation back in February; that level of activity played a significant role in keeping the staff reductions much lower than expected.
YORK COUNTYVPAR is pleased to have the opportunity to work again with Neil Morgan, the former City Manager of Newport News who now has taken the reins in York County! VPAR’s Legislative Consultant met with Neil recently, and as he did when he served as the top executive in Newport News, Neil is keeping an open door, recognizes the important role that VPAR plays and looks forward to our input.

submitted proposed position statements to VAR for the 2016 General Assembly Session. Partnering with the Hampton Roads REALTORS® Association, VPAR submitted a request that VAR consider supporting the establishment of the Virginia Shoreline Resiliency Fund for the purpose of creating a low-interest loan program to help residents and businesses that are subject to recurrent flooding. Monies from the Fund may be used to mitigate future flood damage. The Fund is to be administered by the Virginia Resources Authority. This legislation was introduced by Sen. Lynwood Lewis (D-6th) in 2015 to establish the Virginia Shoreline Resiliency Fund. The proposal had no dedicated source of revenue. The bill passed the Senate 39-0 and reported out of the House Committee on Agriculture, Chesapeake and Natural Resources 21-1. However, the bill failed to report out of the House Appropriations Committee. The House Appropriations Committee does not look favorably upon the establishment of Funds without any earmarked money.
With Virginia realizing a revenue surplus, we hope to capitalize on those extra dollars and secure state appropriations to initiate this effort. MUCH MORE TO COME….but this is your Public Policy Committee at work!

OCTOBER 3rd NEW DATE for TRID IMPLEMENTATION
The Consumer Financial Protection Bureau (CFPB) has announced that the October 3rd start date for the new TILA-RESPA Integrated Disclosure (TRID) rule is now official.
The original implementation date of August 1st was delayed after NAR and other industry groups pointed out that the August/September timeframe is especially busy and therefore not a good time to implement major changes in the mortgage closing process.NAR also continues to press CFPB for written guidance on a number of issues including the need to be specific on the nature of its early review and enforcement of the TRID rule. On that point, CFPB Director Cordray last week told the Senate Banking Committee that the agency’s early review of lender handling of the new rules will be “corrective, not punitive.” He said that policy will be in effect “for many months.”

ability is not readily apparent. Likewise, the provider may only request documentation to show that a disability necessitates the use of a service animal if the disabled individual’s need is not apparent. Finally, providers are strictly prohibited from requesting any documenta-tion to illustrate that a service animal is certi-fied or individually trained.
Title III of the ADA controls service animal ad-mittance requirements for all places of pub-lic accommodation located within or around those establishments subject to the FHA test just previously discussed. The ADA require-ments are a bit stricter than the FHA require-ments. Under the FHA, for example, any ani-mal can qualify as a service animal if it meets all of the other requirements however, trained dogs and, just recently, miniature horses are the only types of animals that may qualify as service animals under the ADA. The ADA also expressly precludes emotional support ani-mals from protection. The ADA requirements are certainly more rigid with respect to the types of animals that may qualify and with re-spect to the types of disabilities recognized as necessitating the assistance of a service ani-mal. Nevertheless, it would be foolish to take any ADA type requests for a reasonable accom-modation lightly. Consider for a moment, for example, a reasonable accommodation request for a dog or miniature horse trained to detect and assist in avoiding or lessening the impact of an anxiety attack. Somewhat surprisingly, such a dog or horse is classified as a service animal under the ADA and must be admitted. Ensuring avoidance of any liability due to inap-propriate prohibition of a service animal on an establishment’s premises requires a thorough evaluation of every request pursuant to the
framework below.
It is most important to understand that under the ADA, there are instances in which a dis-abled individual and his or her service animal must be admitted into an establishment with-out any preliminary inquiry made by that es-tablishment. This will be the case whenever it is readily apparent that an individual is dis-abled and that the animal accompanying the disabled individual is trained to do work or perform tasks for the disabled individual. If it is not readily apparent that the individual has a disability or that the animal is trained to do work or perform tasks for the disabled in-dividual, the requirement that covered estab-lishments must admit service animals may be subject to an initial two part test:
(1) an inquiry into whether the animal is a ser-vice animal required by a disability and
(2) an inquiry into what work or tasks the ani-mal has been trained to perform.
An establishment may offer voluntary regis-tries for the convenience of disabled individu-als and their service animals but it may not require an individual, as a part of the second inquiry, to provide documentation to prove that a service animal is adequately trained. In fact, individuals with disabilities are permitted to train their service animals themselves, mak-ing it quite possible, and permissible under the ADA, for no such documentation to exist.
There are also some exceptions to the require-ment for a reasonable accommodation under Title III of the ADA. There are three scenarios in which an otherwise qualified service animal may be denied access under the ADA:

• Kiln Creek Golf Club & Resort : It was a beautiful day for the 25th Silver Anniversary Annual Golf Tournament sponsored by the VPAR Charitable Foundation. And best of all, a lot of fun people on the course, playing and working the holes for their companies.
•• Yes it was a little warm and there was a threat of thunderstorms that afternoon but everybody
played and had a good time. The Kiln Creek staff took care of us like we were at the Masters Golf Tournament in Augusta.
• Comments’ circling around the Peninsula community were that it was one of the best tournaments ever put on by the Association. On top of that, it was a huge success financial. We don’t have all
the final numbers in yet, but the VPAR Charitable Foundation is looking to donate more $12,000 to local charities here on the Peninsula. This money will help support be helping local charities related to homelessness on the Peninsula. Such charities as Youth Challenge, LINK, Menchville House, HELP, Transitions, Natasha House, Operation Breakthrough and the Hampton‐ Newport News Community Services Board have all received numerous donations over the years.

(1) the service animal is out of control and the owner is unable to take effective action to re-gain control,
(2) the service animal is not housebroken, or
(3) the service animal poses a direct threat to the health or safety of other individuals utiliz-ing the area and such threat cannot be reduced or eliminated by some reasonable modifica-tion to general rules and procedures.
Entities are also permitted to conduct an as-sessment of the following four factors when they are evaluating the appropriateness of ad-mission of miniature horses:
(1) whether the horse is housebroken,
(2) whether the horse is under the owner’s control,
(3) whether the facility can accommodate the horse’s type, size, and weight, and
(4) whether the horse’s presence will compro-mise the requirements for safe operation of the facility.
Taking the position that an exception exists should be handled with care and, unless the animal is posing an immediate threat to an-other’s safety, should not be taken prior to consulting with an attorney or other individual with expertise in this area of law.
Many of the establishments mentioned in this article are subject to the requirements of both the FHA and the ADA. Compliance with one law does not guarantee compliance with the other and the ADA regulations expressly state that the ADA requirements may not be used as an avenue to reduce a housing provider’s or
other covered establishment’s duty to accom-modate service animals pursuant to the re-quirements established by the FHA. Establish-ments covered by both the FHA and the ADA should first determine whether the service animal meets the qualifications for admittance under the FHA and then, only after arriving at a decision under the FHA framework, evaluate the request using the ADA framework.
Violations of either of these acts can subject housing providers and facilities to severe monetary penalties. It is the establishment’s responsibility to understand and apply the laws correctly and it is therefore, incumbent on them to seek legal counsel if they are ever unsure as to the validity of the result of their application of a test or exception to a disabled individual’s service animal. To further avoid potential liability, it would also be wise to train employees, representatives, and agents on the scenarios they will encounter most frequently when disabled individuals seek to visit or re-side on premises with their service animals and how to most effectively handle those mat-ters within the constraints of the questions permitted by the ADA and the FHA.

The petroleum tank increase was a budget amendment.
Prison time: 1 to 6 years We added a felony charge to any criminal who lures or entices a REALTOR® to a property with the intent to do harm.
The added felony will increase a criminal’s sentence by up to 6 years. The 1-6 years are the statutory sentencing guidelines.
Save $150 - $500/hr. on attorneys’ fees We continued to refine legislation that allows property managers to represent your clients in General District court
without needing an attorney. So, how much would your attorney charge per hour? Typically, attorney fees range from $150 - $500/hr.
$12,000 back to consumers Under a new law that VAR drafted, we have made it easier for Virginia consumers who have received a court judgment to
collect damages from the Real Estate Transaction Recovery Fund. The average claim is approximately $12,000. The $12,000 figure is an estimate by the DPOR finance staff on the average claim that comes before the Board.
Wiped out $200/per Sign Fines We worked with a state legislator to prevent a proposal creating daily fines of $200 for any sign in any public right of
way. How often do you use such signs for your listings? 10 days for 1 sign = $2,000 The $200 per sign was the language in the proposed bill VAR was able to stop.

What’s The Buzz about Drones..
Drones seem to be in the national headlines almost daily rising concerns about the unauthorized use and safety risks of Drones or the official term Unmanned Aerial Vehicles (UAV’s). Available online and by retailers these Drones are popping up everywhere and sometimes in places where they are not supposed to be. Why just this past month the national news reported of how firefighters efforts in fighting a blaze was hampered by Drones in their flightpath (http://www.cnn.com/2015/07/18/us/california-freeway-fire/) or a close call for jet airliners at New Yorks’s JFK airport (http://www.cnn.com/2015/08/01/us/drone-airliner-jfk/).
As a real estate professional the use of drones in marketing efforts of properties and communities has become more and more popular. In fact The National Association of REALTORS® has lobbied congress to make the use of drones available for REALTORS®. At the same time they are working hard to educate members of the current laws and also the procedure on getting permission to Fly in the U.S. The Federal Government is working hard at developing UAS policies that make sense but integrating UAS into the National Airspace involves coordination with many FAA rulemaking processes to address safety, licensing, airworthiness, flight rules; Federal Interagency Process to address privacy,
transparency, accountability, civil rights and liberties and Agency Specific Processes with the Dept of Justice and Department of Homeland Security. Current FAA regulations permit Model Aircraft Flights strictly for hobby or recreational use and have other limitations that make this option not available for REALTORS® use.
Given the current FAA prohibition, “the National Association of REALTORS® recommends that its members not use this technology for any purpose related to selling property. The FAA is developing a regulatory framework that would integrate drones into the national airspace, while ensuring safety, privacy and national security.”
Still need that drone….your options may include using a licensed operator with a FAA and the Section 333 Exemtion which is the most appropriate avenue for real estate professionals.
