AN ACT relating to education; ensuring sufficient funding for K-12 public education for the 2019-2021 biennium; apportioning the State Distributive School Account in the State General Fund for the 2019-2021 biennium; authorizing certain expenditures; making appropriations for purposes relating to basic support, class-size reduction and other educational purposes; temporarily diverting the money from the State Supplemental School Support Account to the State Distributive School Account for use in funding operating costs and other expenditures of school districts and charter schools; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. 1. The total public support for school districts and 1 charter schools for Fiscal Year 2019-2020 is an estimated average of 2 $10,227 per pupil. 3 2. As used in this section, “total public support” includes all 4 money appropriated directly for the support of the public schools in 5 this State, including, without limitation, the basic support guarantee 6 per pupil and all money appropriated for a specific program or 7 purpose in support of the public schools, and all other money 8 projected to be received for the support of the public schools from 9 taxes, fees and other revenues authorized by state law, excluding 10

any money provided directly to a public school or school district by 1 the Federal Government. 2 Sec. 2. 1. The total public support for school districts and 3 charter schools for Fiscal Year 2020-2021 is an estimated average of 4 $10,319 per pupil. 5 2. As used in this section, “total public support” includes all 6 money appropriated directly for the support of the public schools in 7 this State, including, without limitation, the basic support guarantee 8 per pupil and all money appropriated for a specific program or 9 purpose in support of the public schools, and all other money 10 projected to be received for the support of the public schools from 11 taxes, fees and other revenues authorized by state law, excluding 12 any money provided directly to a public school or school district by 13 the Federal Government. 14 Sec. 3. The basic support guarantee for school districts, charter 15 schools and university schools for profoundly gifted pupils for 16 operating purposes for Fiscal Year 2019-2020 is an estimated 17 weighted average of $6,218 per pupil. For each respective school 18 district, the basic support guarantee per pupil for Fiscal Year 2019-19 2020 is: 20 21

Sec. 4. 1. The basic support guarantee for school districts, 39 charter schools and university schools for profoundly gifted pupils 40 for operating purposes for Fiscal Year 2020-2021 is an estimated 41 weighted average of $6,288 per pupil. 42 2. On or before April 1, 2020, the Executive Director of the 43 Department of Taxation shall provide to the Superintendent of 44 Public Instruction the certified total of the amount of ad valorem 45

taxes to be received by each school district for Fiscal Year 2020-1 2021 pursuant to the levy imposed under subsection 1 of NRS 2 387.195 and credited to the county’s school district fund pursuant to 3 subsection 4 of that section. 4 3. Pursuant to NRS 362.115, on or before March 15 of each 5 year, the Department of Taxation shall provide the estimates 6 required by that section. 7 4. The ad valorem adjustment may be made only to take into 35 account the difference in the ad valorem taxes to be received and the 36 estimated enrollment of the school district between the amount 37 estimated as of March 1, 2019, and the amount estimated as of 38 March 1, 2020, for Fiscal Year 2020-2021. The estimates received 39 from the Department of Taxation on or before March 15 pursuant to 40 subsection 3 must be taken into consideration in determining the 41 adjustment. 42 6. Upon receipt of the certified total of the amount of ad 43 valorem taxes to be received by each school district for Fiscal Year 44 2020-2021 pursuant to subsection 2, the Superintendent of Public 45

Instruction shall recalculate the ad valorem adjustment and the 1 tentative basic support guarantee per pupil for operating purposes 2 for each school district for Fiscal Year 2020-2021 based on the 3 certified total of the amount of ad valorem taxes provided by the 4 Executive Director of the Department of Taxation pursuant to 5 subsection 2. The final basic support guarantee per pupil for each 6 school district for Fiscal Year 2020-2021 is the amount which is 7 recalculated for Fiscal Year 2020-2021 pursuant to this section, 8 taking into consideration the estimates received from the 9 Department of Taxation pursuant to NRS 362.115 on or before 10 March 15, 2020. The basic support guarantee per pupil recalculated 11 pursuant to this section must be calculated on or before May 31, 12 2020. 13 Sec. 5. 1. There is hereby appropriated from the State 14 General Fund to the State Distributive School Account created by 15 NRS 387.030: 16

2. The money appropriated by subsection 1 must be: 19 (a) Expended in accordance with NRS 353.150 to 353.246, 20 inclusive, concerning the allotment, transfer, work program and 21 budget; and 22 (b) Work-programmed for the 2 separate fiscal years of the 23 2019-2021 biennium, as required by NRS 353.215. Work programs 24 may be revised with the approval of the Governor upon the 25 recommendation of the Director of the Office of Finance in the 26 Office of the Governor. 27 3. Transfers to and allotments from must be allowed and made 28 in accordance with NRS 353.215 to 353.225, inclusive, after 29 separate consideration of the merits of each request. 30 4. The money appropriated by subsection 1 is available for 31 either fiscal year or may be transferred to Fiscal Year 2018-2019. 32 Money may be transferred from one fiscal year to another with the 33 approval of the Governor upon the recommendation of the Director 34 of the Office of Finance in the Office of the Governor. If any money 35 appropriated by subsection 1 is transferred to Fiscal Year 2018-36 2019, any remaining funds in the State Distributive School Account 37 after all obligations have been met that are not subject to reversion 38 to the State General Fund must be transferred back to Fiscal Year 39 2019-2020. Any amount transferred back to Fiscal Year 2019-2020 40 must not exceed the amount originally transferred to Fiscal Year 41 2018-2019. 42 5. Any remaining balance of the appropriation made by 43 subsection 1 for Fiscal Year 2019-2020 must be transferred and 44

added to the money appropriated for Fiscal Year 2020-2021 and 1 may be expended as that money is expended. 2 6. Any remaining balance of the appropriation made by 3 subsection 1 for Fiscal Year 2020-2021, including any money added 4 thereto pursuant to the provisions of subsections 3 and 5, must not 5 be committed for expenditure after June 30, 2021, and must be 6 reverted to the State General Fund on or before September 17, 2021. 7 Sec. 6. 1. Expenditure of $495,451,456 by the Department of 8 Education from money in the State Distributive School Account that 9 was not appropriated from the State General Fund is hereby 10 authorized during Fiscal Year 2019-2020. 11 2. Expenditure of $508,259,870 by the Department of 12 Education from money in the State Distributive School Account that 13 was not appropriated from the State General Fund is hereby 14 authorized during Fiscal Year 2020-2021. 15 3. For the purposes of accounting and reporting, the sums 16 authorized for expenditure by subsections 1 and 2 are considered to 17 be expended before any appropriation is made to the State 18 Distributive School Account from the State General Fund. 19 4. The money authorized to be expended by subsections 1 and 20 2 must be expended in accordance with NRS 353.150 to 353.246, 21 inclusive, concerning the allotment, transfer, work program and 22 budget. Transfers to and allotments from must be allowed and made 23 in accordance with NRS 353.215 to 353.225, inclusive, after 24 separate consideration of the merits of each request. 25 5. The Director of the Office of Finance in the Office of 26 the Governor may, with the approval of the Governor, authorize the 27 augmentation of the amounts authorized for expenditure by the 28 Department of Education in subsections 1 and 2, for the purpose of 29 meeting obligations of the State incurred under chapter 387 of NRS 30 with amounts from any other state agency, from any agency of local 31 government, from any agency of the Federal Government or from 32 any other source that he or she determines is in excess of the amount 33 taken into consideration by this act. The Director of the Office of 34 Finance shall reduce any authorization whenever he or she 35 determines that money to be received will be less than the amount 36 authorized in subsections 1 and 2. 37 Sec. 7. During each fiscal year of the 2019-2021 biennium, 38 whenever the State Controller finds that current claims against the 39 State Distributive School Account exceed the amount available in 40 the Account to pay those claims, the State Controller may advance 41 temporarily from the State General Fund to the State Distributive 42 School Account the amount required to pay the claims, but not more 43 than the amount expected to be received in the current fiscal year 44 from any source authorized for the State Distributive School 45

Account. No amount may be transferred unless requested by the 1 Director of the Office of Finance in the Office of the Governor. 2 Sec. 8. The amounts of the guarantees set forth in sections 3 3 and 4 of this act may be reduced to effectuate a reserve required 4 pursuant to NRS 353.225. 5 Sec. 9. 1. The Department of Education shall transfer from 6 the State Distributive School Account the following sums for pupils 7 with disabilities to school districts, charter schools and university 8 schools for profoundly gifted pupils: 9

For the Fiscal Year 2019-2020 ........................... $211,504,167 10 For the Fiscal Year 2020-2021 ........................... $218,041,746 11

2. The money transferred by subsection 1 must be used only to 12 fund the school districts, charter schools and university schools for 13 profoundly gifted pupils for the enrollment of pupils with 14 disabilities in accordance with the funding multiplier calculated by 15 the Department of Education pursuant to subsection 3 of 16 NRS 387.122. 17 3. Any remaining balance of the sums transferred by 18 subsection 1 for Fiscal Year 2019-2020 and Fiscal Year 2020-2021 19 must not be committed for expenditure after June 30 of each fiscal 20 year and must be reverted to the State General Fund on or before 21 September 18, 2020, and September 17, 2021, for each fiscal year 22 respectively. 23 Sec. 10. 1. The Department of Education shall transfer from 24 the State Distributive School Account the following sums for pupils 25 with disabilities: 26

2. The money transferred by subsection 1 must be used only to 29 fund the school districts, charter schools and university schools for 30 profoundly gifted pupils for the enrollment of pupils with 31 disabilities in accordance with the funding multiplier calculated by 32 the Department of Education pursuant to subsection 4 of 33 NRS 387.122. 34 3. Any remaining balance of the sums transferred by 35 subsection 1 for Fiscal Year 2019-2020 and Fiscal Year 2020-2021 36 must not be committed for expenditure after June 30 of each fiscal 37 year and must be reverted to the State General Fund on or before 38 September 18, 2020, and September 17, 2021, for each fiscal year 39 respectively. 40 Sec. 11. 1. The Department of Education shall transfer from 41 the State Distributive School Account the following sums for 42 special transportation costs to school districts: 43

2. Pursuant to NRS 392.015, the Department of Education shall 1 use the money transferred in subsection 1 to reimburse school 2 districts for the additional costs of transportation for any pupil to a 3 school outside the school district in which his or her residence is 4 located. 5 3. Any remaining balance of the sums transferred by 6 subsection 1 for Fiscal Year 2019-2020 and Fiscal Year 2020-2021 7 must not be committed for expenditure after June 30 of each fiscal 8 year and must be reverted to the State General Fund on or before 9 September 18, 2020, and September 17, 2021, for each fiscal year 10 respectively. 11 Sec. 12. 1. The Department of Education shall transfer from 12 the State Distributive School Account to the school districts the 13 following sums for the National School Lunch Program state match 14 requirement pursuant to NRS 387.105 to reimburse school districts 15 for the costs of providing meals pursuant to 42 U.S.C. §§ 1751 et 16 seq.: 17

Any remaining balance of the sums transferred by 20 subsection 1 for Fiscal Year 2019-2020 and Fiscal Year 2020-2021 21 must not be committed for expenditure after June 30 of each fiscal 22 year and must be reverted to the State General Fund on or before 23 September 18, 2020, and September 17, 2021, for each fiscal year 24 respectively. 25 Sec. 13. Each school district shall expend the revenue made 26 available through this act, as well as other revenue from state, local 27 and federal sources, in a manner which is consistent with NRS 28 288.150 and which is designed to attain the goals of the Legislature 29 regarding educational reform in this State, especially with regard to 30 assisting pupils in need of remediation and pupils who are not 31 proficient in the English language. Materials and supplies for 32 classrooms are subject to negotiation by employers with recognized 33 employee organizations. 34 Sec. 14. The Legislature hereby finds and declares that: 35 1. Available money is estimated to provide a sufficient number 36 of licensed teachers to achieve in each school district pupil-teacher 37 ratios of 17 pupils per licensed teacher in grades 1 and 2 in Fiscal 38 Year 2019-2020 and Fiscal Year 2020-2021, and to achieve a pupil-39 teacher ratio of 20 pupils per licensed teacher in grade 3 in Fiscal 40 Year 2019-2020 and Fiscal Year 2020-2021. 41 2. Certain school districts do not have a sufficient number of 42 classrooms available to permit an average class size of 20 pupils per 43 licensed teacher in grade 3. 44

3. It is unreasonable to assign 2 licensed teachers to a 1 classroom of 40 pupils to attain a district-wide pupil-teacher ratio of 2 20 pupils per licensed teacher in grade 3. 3 4. School districts may, instead, attain the desired pupil-teacher 4 ratio in classes where core curriculum is taught by using alternative 5 methods of reducing the ratio, such as employing licensed teachers 6 to provide remedial instruction. 7 5. School districts may wish to use money for class-size 8 reduction to carry out programs that have been found to be effective 9 in improving academic achievement. 10 6. The Legislature has specifically designed the laws relating to 11 class-size reduction to allow the local school districts the necessary 12 discretion to effectuate the reduction in the manner appropriate in 13 their respective districts. 14 7. School districts are encouraged, to the extent possible, to 15 further reduce the pupil-teacher ratio in each classroom in the 16 district for grades 1, 2 and 3 for which additional funding is 17 provided. 18 8. The Legislature intends to continue the reduced pupil-19 teacher ratio for grades 1, 2 and 3 throughout the State. 20 Sec. 15. 1. The Department of Education shall transfer from 21 the State Distributive School Account the sum of $161,650,216 for 22 distribution by the Superintendent of Public Instruction to the 23 county school districts for Fiscal Year 2019-2020 which must, 24 except as otherwise provided in section 17 of this act, be used to 25 employ licensed teachers to comply with the required ratio of pupils 26 to teachers in grades 1, 2 and 3, as set forth in subsection 1 of 27 section 14 of this act. Expenditures for the class-size reduction 28 program must be accounted for in a separate category of expenditure 29 in the State Distributive School Account. 30 2. Except as otherwise provided in section 17 of this act, the 31 money transferred by subsection 1 must be used to pay the salaries 32 and benefits of not less than 1,911 licensed teachers employed by 33 school districts to meet the required pupil-teacher ratios in the 2019-34 2020 school year. 35 3. Any remaining balance of the money transferred by 36 subsection 1 must not be committed for expenditure after June 30, 37 2020, and must be transferred and added to the money appropriated 38 to the State Distributive School Account pursuant to section 5 of 39 this act for Fiscal Year 2020-2021, and may be expended as the 40 money in section 16 of this act is expended. 41 Sec. 16. 1. The Department of Education shall transfer from 42 the State Distributive School Account the sum of $165,487,286 for 43 distribution by the Superintendent of Public Instruction to the 44 county school districts for Fiscal Year 2020-2021 which must, 45

except as otherwise provided in section 17 of this act, be used to 1 employ licensed teachers to comply with the required ratio of pupils 2 to teachers in grades 1, 2 and 3, as set forth in subsection 1 of 3 section 14 of this act. Expenditures for the class-size reduction 4 program must be accounted for in a separate category of expenditure 5 in the State Distributive School Account. 6 2. Except as otherwise provided in section 17 of this act, the 7 money transferred by subsection 1 must be used to pay the salaries 8 and benefits of not less than 1,915 licensed teachers employed by 9 school districts to meet the required pupil-teacher ratios in the 2020-10 2021 school year. 11 3. Any remaining balance of the money transferred by 12 subsection 1, including any money added thereto pursuant to section 13 15 of this act, must not be committed for expenditure after June 30, 14 2021, and must be reverted to the State General Fund on or before 15 September 17, 2021. 16 Sec. 17. 1. The board of trustees of each school district: 17 (a) Shall file a plan with the Superintendent of Public Instruction 18 describing how the money transferred pursuant to sections 15 and 19 16 of this act will be used to comply with the required ratio of pupils 20 to teachers in grades 1, 2 and 3; and 21 (b) May, after receiving approval of the plan from the 22 Superintendent of Public Instruction, use the money transferred 23 pursuant to sections 15 and 16 of this act to carry out: 24 (1) An alternative program for reducing the ratio of pupils 25 per teacher, including, without limitation, any legislatively approved 26 program of flexibility; or 27 (2) Programs of remedial education that have been found to 28 be effective in improving pupil achievement in grades 1, 2 and 3, so 29 long as the combined ratio of pupils per teacher in the aggregate of 30 kindergarten and grades 1, 2 and 3 of the school district does not 31 exceed the combined ratio of pupils per teacher in the aggregate of 32 kindergarten and grades 1, 2 and 3 of the school district in the 2004-33 2005 school year. 34 The plan approved by the Superintendent of Public Instruction 35 must describe the method to be used by the school district to 36 evaluate the effectiveness of the alternative program or remedial 37 education programs in improving pupil achievement. 38 2. In no event must the provisions of this section be construed 39 to authorize the board of trustees of a school district in a county 40 whose population is 100,000 or more to develop an alternative plan 41 for the reduction of pupil-teacher ratios pursuant to subsection 2 of 42 NRS 388.720. 43 Sec. 18. 1. The money transferred for class-size reduction 44 pursuant to sections 15 and 16 of this act: 45

(a) May be applied first to pupils considered most at risk of 1 failure. 2 (b) Must not be used to settle or arbitrate disputes between a 3 recognized organization representing employees of a school district 4 and the school district, or to settle any negotiations. 5 (c) Must not be used to adjust the district-wide schedules of 6 salaries and benefits of the employees of a school district. 7 (d) Must fund the pupil-to-teacher ratios associated with the 8 type of class-size reduction program implemented, with 9 authorization to distribute residual class-size reduction program 10 funds to underperforming schools with approved class-size 11 reduction variances. 12 2. The money transferred for class-size reduction pursuant to 13 sections 15 and 16 of this act must not be distributed to a school 14 district unless that school district has: 15 (a) Filed with the Department of Education a plan required by 16 NRS 388.720 for achieving the required ratio set forth in NRS 17 388.700; and 18 (b) Demonstrated that, from resources of the school district 19 other than allocations received from the State Distributive School 20 Account for class-size reduction, a sufficient number of classroom 21 teachers have been employed to maintain the average pupil-teacher 22 ratio that existed for each grade for grades 1, 2 and 3 in that school 23 district for the 3 school years immediately preceding the start of the 24 class-size reduction program in the 1990-1991 school year. 25 Sec. 19. 1. There is hereby appropriated from the State 26 General Fund to the Other State Education Programs Account in the 27 State General Fund the following sums: 28

2. The money appropriated by subsection 1 must be expended 31 in accordance with NRS 353.150 to 353.246, inclusive, concerning 32 the allotment, transfer, work program and budget. Transfers to and 33 allotments from must be allowed and made in accordance with NRS 34 353.215 to 353.225, inclusive, after separate consideration of the 35 merits of each request. 36 3. Expenditure of $1,200,000 by the Department of Education 37 from money in the Other State Education Programs Account that 38 was not appropriated from the State General Fund is hereby 39 authorized during Fiscal Year 2020-2021. 40 4. The Department of Education shall transfer from the Other 41 State Education Programs Account the sum of $19,260,398 for both 42 Fiscal Year 2019-2020 and Fiscal Year 2020-2021 for distribution 43 by the Superintendent of Public Instruction to county school 44 districts for the support of courses which are approved by the 45

Department of Education as meeting the course of study for an adult 1 standard high school diploma as approved by the State Board of 2 Education. In each fiscal year of the 2019-2021 biennium, the sum 3 transferred must be allocated among the various school districts in 4 accordance with a plan or formula developed by the Department of 5 Education to ensure that the money is distributed equitably and in a 6 manner that permits accounting for the expenditures of school 7 districts. 8 5. The Department of Education shall, not later than 9 November 1, 2019, and November 1, 2020, provide a written report 10 to the Governor, the Legislative Committee on Education and the 11 Director of the Legislative Counsel Bureau that describes, for 12 the immediately preceding fiscal year, each expenditure made from 13 the amount transferred in subsection 3 of section 16 of chapter 394, 14 Statutes of Nevada 2017, p. 2597 or in subsection 4, as applicable, 15 and the performance results of the participants of the Adult High 16 School Diploma program. 17 6. Any remaining balance of the allocations made by 18 subsection 4 for Fiscal Year 2019-2020 must be added to the money 19 received by the school districts for Fiscal Year 2020-2021 and may 20 be expended as that money is expended. Any remaining balance of 21 the allocations made by subsection 4 for Fiscal Year 2020-2021, 22 including any such money added from the previous fiscal year, must 23 not be committed for expenditure after June 30, 2021, and must be 24 reverted to the State General Fund on or before September 17, 2021. 25 7. The money appropriated by subsection 1 to finance specific 26 programs as outlined in this subsection are available for both Fiscal 27 Year 2019-2020 and Fiscal Year 2020-2021 and may be transferred 28 from one fiscal year to the other with the approval of the Interim 29 Finance Committee upon the recommendation of the Governor as 30 follows: 31 (a) A total of $49,285 in both Fiscal Year 2019-2020 and Fiscal 32 Year 2020-2021 for reimbursement to public school teachers of the 33 actual costs incurred for successful completion of the National 34 Board Teacher Certification Program. Such reimbursement for each 35 teacher must not exceed an amount equal to the actual verified costs 36 incurred by the teacher or $2,000, whichever is less. 37 (b) A total of $3,640 in both Fiscal Year 2019-2020 and Fiscal 38 Year 2020-2021 for reimbursement to school nurses of the actual 39 examination cost for the successful completion of the National 40 Board Certification for School Nurses. 41 (c) A total of $668,740 in both Fiscal Year 2019-2020 and 42 Fiscal Year 2020-2021 to add a 5-percent salary increment for 43 Nationally Board Certified School Counselors and School 44 Psychologists. 45

(d) A total of $449,142 in both Fiscal Year 2019-2020 and 1 Fiscal Year 2020-2021 for LEA library books. 2 (e) A total of $13,543,822 in both Fiscal Year 2019-2020 and 3 Fiscal Year 2020-2021 for the award of grants for programs of 4 career and technical education pursuant to NRS 388.393 and, 5 notwithstanding the provisions of subsections 1, 2 and 3 of NRS 6 388.392, not for the use of leadership and training activities and 7 pupil organizations. 8 (f) A total of $5,106,645 in Fiscal Year 2019-2020 and 9 $4,201,645 in Fiscal Year 2020-2021 for the Jobs for America’s 10 Graduates Program. Of the total transferred in Fiscal Year 2019-11 2020 pursuant to this paragraph, an amount up to $1,200,000 may 12 only be allocated by the Department of Education to the Jobs for 13 America’s Graduates Program for expenditure upon determination 14 that an equivalent match of money provided by other sources of 15 funding received by the Jobs for America’s Graduates Program has 16 been secured. 17 (g) A total of $850,000, with a maximum of $50,000 to each of 18 the 17 school districts, in both Fiscal Year 2019-2020 and Fiscal 19 Year 2020-2021 to support special counseling services for 20 elementary school pupils at risk of failure. 21 (h) A total of $18,798 in both Fiscal Year 2019-2020 and Fiscal 22 Year 2020-2021 to pay the increase of salaries of professional 23 school library media specialists required by NRS 391.163. 24 (i) A total of $44,583 in both Fiscal Year 2019-2020 and Fiscal 25 Year 2020-2021 for the Geographic Alliance in Nevada. 26 (j) A total of $106,998 in both Fiscal Year 2019-2020 and Fiscal 27 Year 2020-2021 for vocational student organizations. 28 (k) A total of $750,000 in both Fiscal Year 2019-2020 and 29 Fiscal Year 2020-2021 for the Nevada Institute on Teaching and 30 Educator Preparation. This funding must be used only to carry out 31 the provisions of NRS 396.5185. 32 (l) A total of $500,000 in both Fiscal Year 2019-2020 and Fiscal 33 Year 2020-2021 to the Department of Education for transfer to the 34 Clark County Public Education Foundation, Inc., for the 35 implementation and operation of educational leadership training 36 programs. Expenditure of this money is contingent upon matching 37 money being provided from sources other than the appropriation in 38 subsection 1. The Department of Education shall not distribute any 39 money for the implementation and operation of educational 40 leadership training programs until an equivalent amount of matching 41 money has been committed. 42 8. Upon acceptance of the money transferred pursuant to 43 paragraph (l) of subsection 7, the Clark County Public Education 44 Foundation, Inc. agrees to: 45

(a) Prepare and transmit a report to the Interim Finance 1 Committee on or before September 18, 2020, that describes each 2 expenditure made from the money transferred pursuant to paragraph 3 (l) of subsection 7 from the date on which the money was received 4 by the Clark County Public Education Foundation, Inc. through 5 June 30, 2020; 6 (b) Prepare and transmit a final report to the Interim Finance 7 Committee on or before September 17, 2021, that describes each 8 expenditure made from the money transferred pursuant to paragraph 9 (l) of subsection 7 from the date on which the money was received 10 by the Clark County Public Education Foundation, Inc. through 11 June 30, 2021; and 12 (c) Upon request of the Legislative Commission, make available 13 to the Legislative Auditor any of the books, accounts, claims, 14 reports, vouchers or other records of information, confidential or 15 otherwise, of the Clark County Public Education Foundation, Inc., 16 regardless of their form or location, that the Legislative Auditor 17 deems necessary to conduct an audit of the use of the money 18 transferred pursuant to paragraph (l) of subsection 7. 19 9. Any remaining balance of the sums transferred in subsection 20 7 must not be committed for expenditure after June 30, 2021, and 21 must be reverted to the State General Fund on or before 22 September 17, 2021. 23 10. Except as otherwise provided in subsections 6 and 9, 24 unencumbered or unexpended balances of the appropriations made 25 by this section for Fiscal Year 2019-2020 and Fiscal Year 2020-26 2021 must not be committed for expenditure after June 30 of each 27 fiscal year. Except as otherwise provided in subsections 6 and 9, 28 unencumbered or unexpended balances of these appropriations must 29 revert to the State General Fund on or before September 18, 2020, 30 and September 17, 2021, for each fiscal year respectively. 31 Sec. 20. Notwithstanding the provisions of paragraphs (d), (i) 32 and (j) of subsection 7 of section 19 of this act, the Department of 33 Education shall transfer from the Other State Education Programs 34 Account the sum of $600,723 in Fiscal Year 2019-2020 and 35 $600,723 in Fiscal Year 2020-2021 identified in paragraphs (d), (i) 36 and (j) of subsection 7 of section 19 of this act to the Account for 37 Programs for Innovation and the Prevention of Remediation created 38 by NRS 387.1247. This funding must be used only to carry out the 39 provisions of Assembly Bill No. 309 of this session. 40 Sec. 21. 1. The Department of Education shall transfer from 41 the Other State Education Programs Account the sum of $1,314,000 42 in both Fiscal Year 2019-2020 and Fiscal Year 2020-2021 for 43 incentive grants to public high schools for pupils who earn a college 44 and career ready high school diploma, or reimbursement to a public 45

high school or school district for costs associated with the 1 administration or provision of an assessment, credential, certificate 2 or certification required for receipt of a college and career ready 3 high school diploma pursuant to NRS 390.605. 4 2. Any remaining balance of the sums transferred by 5 subsection 1 must not be committed for expenditure after June 30 of 6 each fiscal year and must be reverted to the State General Fund on 7 or before September 18, 2020, and September 17, 2021, for each 8 fiscal year respectively. 9 Sec. 22. 1. The Department of Education shall transfer from 10 the Other State Education Programs Account the sum of $8,274,243 11 in both Fiscal Year 2019-2020 and Fiscal Year 2020-2021 for pupils 12 enrolled in school districts and charter schools who qualify for 13 gifted and talented education programs. 14 2. The money transferred by subsection 1 must be distributed 15 on a per-pupil basis to pupils who have been identified as gifted and 16 talented through a state-approved identification procedure and must 17 receive at least 150 minutes per week during the school year of 18 differentiated instruction delivered by a person licensed by the 19 Department of Education to teach pupils who are gifted and 20 talented, unless the pupil’s individualized educational program 21 otherwise provides. The Department of Education shall calculate an 22 amount of funding for each pupil identified as gifted and talented for 23 both Fiscal Year 2019-2020 and Fiscal Year 2020-2021 by dividing 24 the money appropriated by the Legislature for such pupils in Fiscal 25 Year 2019-2020 and in Fiscal Year 2020-2021 by the total final 26 count of such pupils in the immediately preceding fiscal year. 27 3. The money transferred by subsection 1 for pupils enrolled in 28 school districts and charter schools who qualify for gifted and 29 talented education programs: 30 (a) Must not be used to settle or arbitrate disputes between a 31 recognized organization representing employees of a school district 32 and the school district, or to settle any negotiations. 33 (b) Must not be used to adjust the district-wide schedules of 34 salaries and benefits of the employees of a school district. 35 4. Any remaining balance of the sums transferred by 36 subsection 1 for Fiscal Year 2019-2020 and Fiscal Year 2020-2021 37 must not be committed for expenditure after June 30 of each fiscal 38 year and must be reverted to the State General Fund on or before 39 September 18, 2020, and September 17, 2021, for each fiscal year 40 respectively. 41 Sec. 23. 1. The Department of Education shall transfer from 42 the Other State Education Programs Account the following sums for 43 a college and career readiness grant program: 44

Except as otherwise provided in subsection 3, the money 3 transferred by subsection 1 must be used by the Department of 4 Education for awarding competitive grants to school districts and 5 charter schools: 6 (a) To support dual enrollment for pupils enrolled in high 7 schools, including, without limitation, charter schools, and 8 simultaneously enrolled in college courses; and 9 (b) To create a competitive science, technology, engineering and 10 mathematics grant program for pupils enrolled in middle schools 11 and high schools, including, without limitation, charter schools, to 12 assist those pupils in becoming college and career ready. 13 3. Of the money transferred by subsection 1, not more than 14 $750,000 in both Fiscal Year 2019-2020 and Fiscal Year 2020-2021 15 may be used by the Department of Education to provide competitive 16 grants to school districts, charter schools and nonprofit 17 organizations for the development and implementation of work-18 based learning pilot programs. 19 4. The money transferred by subsection 1: 20 (a) Must be accounted for separately from any other money 21 received by the school districts, charter schools and nonprofit 22 organizations and used only for the purposes specified in this 23 section. 24 (b) May not be used to settle or arbitrate disputes between a 25 recognized organization representing employees of a school district 26 and the school district, or to settle any negotiations. 27 (c) May not be used to adjust the district-wide schedules of 28 salaries and benefits of the employees of a school district. 29 5. Any remaining balance of the sums transferred by 30 subsection 1 for Fiscal Year 2019-2020 and Fiscal Year 2020-2021 31 must not be committed for expenditure after June 30 of each fiscal 32 year and must be reverted to the State General Fund on or before 33 September 18, 2020, and September 17, 2021, for each fiscal year 34 respectively. 35 Sec. 24. 1. The Department of Education shall transfer from 36 the Other State Education Programs Account the following sums for 37 underperforming schools: 38

(a) Activities to replicate high poverty/high performing schools 1 and high performing schools. 2 (b) To support a transition period until such time as an 3 underperforming school is sustainable at a three-star level, as 4 determined by the Department of Education pursuant to the 5 statewide system of accountability for public schools. 6 (c) Other activities consistent with the approved federal plan for 7 school improvement. 8 3. The money transferred pursuant to subsection 1: 9 (a) Must be accounted for separately from any other money 10 received by the school districts and charter schools of this State and 11 used only for the purposes specified in subsection 2. 12 (b) May not be used to settle or arbitrate disputes between a 13 recognized organization representing employees of a school district 14 and the school district, or to settle any negotiations. 15 (c) May not be used to adjust the district-wide schedules of 16 salaries and benefits of the employees of a school district. 17 4. Any remaining balance of the sums transferred by 18 subsection 1 for Fiscal Year 2019-2020 and Fiscal Year 2020-2021 19 must not be committed for expenditure after June 30 of each fiscal 20 year and must be reverted to the State General Fund on or before 21 September 18, 2020, and September 17, 2021, for each fiscal year 22 respectively. 23 Sec. 25. 1. The Department of Education shall transfer from 24 the Other State Education Programs Account the following sums for 25 the Read by Grade 3 grant program: 26

2. The money transferred by subsection 1 must be used by the 29 Department of Education to provide grants and other financial 30 support, within the limits of legislative appropriation, to public 31 schools to support school-based efforts to ensure that all pupils are 32 proficient in the subject area of reading by the end of the third 33 grade. Such school-based efforts may include, without limitation: 34 (a) Hiring or training learning strategists; 35 (b) Entering into contracts with vendors for the purchase of 36 reading assessments, textbooks, computer software or other 37 materials; 38 (c) Providing professional development for school personnel; 39 (d) Providing programs to pupils before and after school and 40 during intercessions or summer school; and 41 (e) Providing other evidence-based literacy initiatives for pupils 42 enrolled in kindergarten and grades 1, 2 and 3. 43

3. The board of trustees of a school district or the governing 1 body of a charter school that receives a grant of money pursuant to 2 subsection 2 shall: 3 (a) Set measurable performance objectives based on aggregated 4 pupil achievement data; and 5 (b) Prepare and submit to the Department of Education, on or 6 before September 1, 2020, for funding received from the state in 7 Fiscal Year 2019-2020 and September 1, 2021, for funding received 8 from the state in Fiscal Year 2020-2021, a report that includes, 9 without limitation: 10 (1) A description of the programs or services for which the 11 money was used by each school; and 12 (2) The number of pupils who participated in a program or 13 received services. 14 4. The Department of Education shall prepare a report that 15 includes, without limitation: 16 (a) Identification of the schools that received an allocation of 17 money by the school district or grant of money from the 18 Department, as applicable; 19 (b) The amount of money received by each school; 20 (c) A description of the programs or services for which the 21 money was used by each school; 22 (d) The number of pupils who participated in a program or 23 received services; 24 (e) The average expenditure per pupil for each program or 25 service; 26 (f) An evaluation of the effectiveness of the program or service, 27 including, without limitation, data regarding the academic and 28 linguistic achievement and proficiency of pupils who participated in 29 such a program or received such services; and 30 (g) Any recommendations for legislation, including, without 31 limitation, legislation to continue or expand programs or services 32 that are identified as effective in improving the reading proficiency 33 of pupils in kindergarten through grade 3. 34 5. On or before November 15, 2020, the Department shall 35 submit the report prepared pursuant to subsection 4 and any 36 recommendations made by the State Board of Education or the 37 Legislative Committee on Education to the Governor and to 38 the Director of the Legislative Counsel Bureau for transmittal to the 39 81st Session of the Nevada Legislature. 40 6. The money transferred pursuant to subsection 1: 41 (a) Must be accounted for separately from any other money 42 received by the school districts and charter schools of this State and 43 used only for the purposes specified in subsection 2. 44

Any balance of the money transferred by subsection 1 6 remaining at the end of the respective fiscal years must not be 7 committed for expenditure after June 30 of each fiscal year and must 8 be reverted to the State General Fund on or before September 18, 9 2020, and September 17, 2021, respectively. 10 Sec. 26. 1. There is hereby appropriated from the State 11 General Fund to the Account for Programs for Innovation and the 12 Prevention of Remediation created by NRS 387.1247 the following 13 sums: 14

Transfers to and 19 allotments from must be allowed and made in accordance with NRS 20 353.215 to 353.225, inclusive, after separate consideration of the 21 merits of each request. 22 3. The Department of Education shall transfer from the 23 appropriation made by subsection 1 to the school districts specified 24 in this subsection the following sums which must be used only to 25 carry out the provisions of section 1 of Senate Bill No. 467 of this 26 session for Fiscal Year 2019-2020: 27

4. Except as otherwise provided in subsection 5, the 31 Department of Education shall calculate an amount of funding for 32 each pupil identified as an English learner, as defined in NRS 33 385.007, for Fiscal Year 2020-2021, by dividing the money 34 appropriated by subsection 1 for Fiscal Year 2020-2021 by the total 35 final count of such pupils in Fiscal Year 2019-2020 and shall 36 transfer the applicable sums to the school districts specified in 37 subsection 3. 38 5. Of the sums appropriated by subsection 1, the Department of 39 Education shall use not more than $5,051,416 in Fiscal Year 2019-40 2020 and the amount determined in subsection 4 other than the 41 amounts determined for the Clark County School District and 42 Washoe County School District in Fiscal Year 2020-2021, which 43 must be used only to carry out the provisions of section 1 of Senate 44 Bill No. 467 of this session to provide grants of money to the State 45

Public Charter School Authority and the school districts, other than 1 the Clark County School District and the Washoe County School 2 District. The board of trustees of a school district and the State 3 Public Charter School Authority may submit an application to the 4 Department on a form prescribed by the Department. 5 6. Any remaining balance of the transfers made by subsection 6 3 for Fiscal Year 2019-2020 must be added to the money transferred 7 for Fiscal Year 2020-2021 and may be expended as that money is 8 expended. Any remaining balance of the transfers made by 9 subsection 4 for Fiscal Year 2020-2021, including any money added 10 from the previous fiscal year, must not be committed for 11 expenditure after June 30, 2021, and must be reverted to the State 12 General Fund on or before September 17, 2021. 13 7. Any remaining balance of the transfers made by subsection 14 5 for Fiscal Year 2019-2020 must be added to the money transferred 15 for Fiscal Year 2020-2021 and may be expended as that money is 16 expended. Any remaining balance of the transfers made pursuant to 17 subsection 5 for Fiscal Year 2020-2021, including any money added 18 from the previous fiscal year, must not be committed for 19 expenditure after June 30, 2021, and must be reverted to the State 20 General Fund on or before September 17, 2021. 21 8. Any remaining balance of the appropriation made by 22 subsection 1 must not be committed for expenditure after June 30, 23 2021, by the entity to which the appropriation is made or any entity 24 to which money from the appropriation is granted or otherwise 25 transferred in any manner, and any portion of the appropriated 26 money remaining must not be spent for any purpose after 27 September 17, 2021, by either the entity to which the money was 28 appropriated or the entity to which the money was subsequently 29 granted or transferred, and must be reverted to the State General 30 Fund on or before September 17, 2021. 31 Sec. 27. 1. There is hereby appropriated from the State 32 General Fund to the Account for Programs for Innovation and the 33 Prevention of Remediation created by NRS 387.1247 a total of 34 $10,000,000 in both Fiscal Year 2019-2020 and Fiscal Year 2020-35 2021 to be distributed by the Commission on Educational 36 Technology created by NRS 388.790 for the Nevada Ready 21 37 Technology competitive grant program for statewide one-to-one 38 pupil computing to provide pupils and teachers with 24-hour access 39 to their own personal, portable, technology device connected 40 wirelessly to the Internet. The money must not be used for 41 administrative expenditures of the Department of Education. 42 2. The money appropriated by subsection 1 must be expended 43 in accordance with NRS 353.150 to 353.246, inclusive, concerning 44 the allotment, transfer, work program and budget. Transfers to and 45

The Department of Education shall transfer money from the 24 appropriation made by subsection 1 to school districts and charter 25 schools which must be used only to carry out the provisions of 26 section 2 of Senate Bill No. 467 of this session for Fiscal Year 27 2019-2020 and Fiscal Year 2020-2021, respectively. 28 4. Expenditure of $3,231,171 in Fiscal Year 2019-2020 and 29 $1,175,916 in Fiscal Year 2020-2021 from money in the Account 30 for Programs for Innovation and the Prevention of Remediation 31 created by NRS 387.1247 that was not appropriated from the State 32 General Fund is hereby authorized for use to carry out the 33 provisions of section 2 of Senate Bill No. 467 of this session for 34 Fiscal Year 2019-2020 and Fiscal Year 2020-2021, respectively. 35 5. A Victory School that attains a performance rating of three-36 stars or higher, and that would otherwise not be eligible to receive a 37 Victory Schools grant pursuant to the current program requirements, 38 may retain 50 percent of the Victory Schools grant funding received 39 in the preceding year to sustain successful programs for each year of 40 the 2019-2021 biennium. 41 6. Any remaining balance of the transfers made to carry out the 42 provisions of section 2 of Senate Bill No. 467 of this session for 43 Fiscal Year 2019-2020 must be added to the money transferred for 44 Fiscal Year 2020-2021 and may be expended as that money is 45

2. On or before August 31, 2019, the board of trustees of a 13 school district may apply to the State Board of Education for a grant 14 of money from the money appropriated by subsection 1 to provide 15 financial incentives to newly hired teachers as described in 16 subsection 3. Each application submitted pursuant to this subsection 17 must include the number of teachers to whom the board of trustees 18 intends to provide such incentives. On or before October 31, 2019, 19 the State Board of Education shall distribute the money to each 20 board of trustees of a school district that submits an application in 21 proportion to the number of teachers to whom the board of trustees 22 plans to provide incentives. 23 3. Each board of trustees of a school district that receives a 24 grant of money pursuant to subsection 2 must use the money to pay 25 for incentives to newly hired teachers through the program of 26 performance pay and enhanced compensation for the recruitment 27 and retention of licensed teachers and administrators established by 28 the board of trustees pursuant to NRS 391A.450. A board of trustees 29 of a school district may only use such money to provide incentives 30 to licensed teachers who were not employed by the board of trustees 31 during the 2018-2019 school year and: 32 (a) Are employed full-time to teach in a school that: 33 (1) Is a Title I school, as defined in NRS 385A.040; or 34 (2) Received one of the two lowest possible ratings 35 indicating underperformance of a public school, as determined by 36 the Department of Education pursuant to the statewide system of 37 accountability for public schools, for the most recent school year; or 38 (b) Are licensed to teach special education and employed full 39 time. 40 4. An incentive provided pursuant to subsection 3 may be used 41 to increase the base salary of a teacher for the 2019-2020 and 2020-42 2021 school years in an amount not to exceed $5,000 per school 43 year. A teacher who receives such an incentive is not entitled to 44 continue to receive such an incentive after the 2020-2021 school 45

The board of trustees of a school district that provides an 3 incentive pursuant to subsection 3 shall provide professional 4 development to each teacher who receives such an incentive for 5 each school year for which the teacher receives the incentive. 6 6. Any remaining balance of the appropriation made by 7 subsection 1 for Fiscal Year 2019-2020 must be added to the money 8 appropriated for Fiscal Year 2020-2021 and may be expended as 9 that money is expended. Any remaining balance of the appropriation 10 made by subsection 1 for Fiscal Year 2020-2021, including any such 11 money added from the previous fiscal year, must not be committed 12 for expenditure after June 30, 2021, and does not revert to the State 13 General Fund. 14 Sec. 30. 1. There is hereby appropriated from the State 15 General Fund to the Account for Programs for Innovation and the 16 Prevention of Remediation created by NRS 387.1247 the sum of 17 $2,500,000 for allocation to the Department of Education to provide 18 incentives for the hiring of new teachers to teach at Title I schools or 19 schools that are designated as underperforming pursuant to the 20 statewide system of accountability for public schools. 21 2. There is hereby appropriated from the State General Fund to 22 the Account for Programs for Innovation and the Prevention of 23 Remediation created by NRS 387.1247 the sum of $2,500,000 for 24 allocation to the Department of Education to provide incentives for 25 teachers who are currently employed to teach at a public school in 26 Nevada that is not a Title I school or a school designated as 27 underperforming pursuant to the statewide system of accountability 28 for public schools and who transfer to teach at a Title I school or a 29 school with that designation. 30 3. The money appropriated by subsections 1 and 2 must be 31 expended in accordance with NRS 353.150 to 353.246, inclusive, 32 concerning the allotment, transfer, work program and budget. 33 Transfers to and allotments from must be allowed and made in 34 accordance with NRS 353.215 to 353.225, inclusive, after separate 35 consideration of the merits of each request. 36 4. Any remaining balance of the appropriations made by 37 subsections 1 and 2 must not be committed for expenditure after 38 June 30, 2021, and does not revert to the State General Fund. 39 Sec. 31. 1. A school district that receives an allocation pursuant to 14 subsection 1 shall serve as fiscal agent for the respective regional 15 training program for the professional development of teachers and 16 administrators. As fiscal agent, each school district is responsible for 17 the payment, collection and holding of all money received from this 18 State for the maintenance and support of the regional training 19 program for the professional development of teachers and 20 administrators and the Nevada Early Literacy Intervention Program 21 established and operated by the applicable governing body. 22 3. Any remaining balance of the transfers made by subsection 23 1 for Fiscal Year 2019-2020 must be added to the money received 24 by the school districts for Fiscal Year 2020-2021 and may be 25 expended as that money is expended. Any remaining balance of the 26 transfers made by subsection 1 for Fiscal Year 2020-2021, including 27 any money added from the transfer for the previous fiscal year, must 28 not be committed for expenditure after June 30, 2021, and must be 29 reverted to the State General Fund on or before September 17, 2021. 30 Sec. 33. 1. Of the sums appropriated by subsection 1 of 31 section 31 of this act, the Department of Education shall transfer to 32 the Statewide Council for the Coordination of the Regional Training 33 Programs created by NRS 391A.130 the sum of $100,000 in both 34 Fiscal Year 2019-2020 and Fiscal Year 2020-2021 for additional 35 training opportunities for educational administrators in Nevada. 36 2. The Statewide Council shall use the money: 37 (a) To disseminate research-based knowledge related to 38 effective educational leadership behaviors and skills. 39 (b) To develop, support and maintain ongoing activities, 40 programs, training and networking opportunities. 41 (c) For the purpose of providing additional training for 42 educational administrators, including, without limitation, to pay: 43 (1) Travel expenses of administrators who attend the training 44 program; 45

(2) Travel and per diem expenses for any consultants 1 contracted to provide additional training; and 2 (3) Any charges to obtain a conference room for the 3 provision of the additional training. 4 (d) To supplement and not replace the money that the school 5 district or the regional training program would otherwise expend for 6 the training of administrators as described in this section. 7 3. Any remaining balance of the transfer made by subsection 1 8 for Fiscal Year 2019-2020 must be added to the money received by 9 the Statewide Council for Fiscal Year 2020-2021 and may be 10 expended as that money is expended. Any remaining balance of the 11 transfer made by subsection 1 for Fiscal Year 2020-2021, including 12 any money added from the transfer for the previous fiscal year, must 13 not be committed for expenditure after June 30, 2021, and must be 14 reverted to the State General Fund on or before September 17, 2021. 15 Sec. 34. 1. There is hereby appropriated from the State 16 General Fund to the Department of Education the sum of $120,000 17 to administer the training required pursuant to paragraph (g) of 18 subsection 1 of NRS 391A.125, as amended by section 8 of Senate 19 Bill No. 314 of this session. 20 2. Any balance of the appropriation made by subsection 1 must 21 not be committed for expenditure after June 30, 2021, by the entity 22 to which the appropriation is made or any entity to which money 23 from the appropriation is granted or otherwise transferred in any 24 manner, and any portion of the appropriated money remaining must 25 not be spent for any purpose after September 17, 2021, by either the 26 entity to which the money was appropriated or the entity to which 27 the money was subsequently granted or transferred, and must be 28 reverted to the State General Fund on or before September 17, 2021. 29 Sec. 35. 1. There is hereby appropriated from the State 30 General Fund to the Great Teaching and Leading Fund created by 31 NRS 391A.500 the following sums: 32

Any remaining balance of the appropriation made by 1 subsection 1 for Fiscal Year 2019-2020 must be added to the 2 appropriation for Fiscal Year 2020-2021 and may be expended as 3 that money is expended. Expenditure of $94,591 in both Fiscal Year 2019-2020 and 9 Fiscal Year 2020-2021 from money in the Great Teaching and 10 Leading Fund created by NRS 391A.500 that was not appropriated 11 from the State General Fund is hereby authorized to carry out the 12 provisions of NRS 391A.500 to 391A.515, inclusive. 13 6. For the purposes of accounting and reporting, the sum 14 authorized for expenditure by subsection 5 is considered to be 15 expended before any appropriation is made to the Great Teaching 16 and Leading Fund from the State General Fund. 17 7. The money authorized to be expended by subsection 5 must 18 be expended in accordance with NRS 353.150 to 353.246, inclusive, 19 concerning the allotment, transfer, work program and budget. 20 Transfers to and allotments from must be allowed and made in 21 accordance with NRS 353.215 to 353.225, inclusive, after separate 22 consideration of the merits of each request. 23 8. The Director of the Office of Finance in the Office of the 24 Governor may, with the approval of the Governor, authorize 25 the augmentation of the amounts authorized for expenditure by the 26 Department of Education in subsection 5, for the purpose of 27 carrying out the provisions of NRS 391A.500 to 391A.515, 28 inclusive, with amounts from any other state agency, from any 29 agency of local government, from any agency of the Federal 30 Government or from any other source that he or she determines is in 31 excess of the amount taken into consideration by this act. The 32 Director of the Office of Finance shall reduce any authorization 33 whenever he or she determines that money to be received will be 34 less than the amount authorized in subsection 5. 35 Sec. 36. 1. There is hereby appropriated from the State 36 General Fund to the Great Teaching and Leading Fund created by 37 NRS 391A.500 the following sums: 38

must be used only to carry out the provisions of Assembly Bill No. 1 309 of this session. 2 Sec. 37. 1. There is hereby appropriated from the State 3 General Fund to the Professional Development Programs Account 4 the sum of $1,300,000 in both Fiscal Year 2019-2020 and Fiscal 5 Year 2020-2021 for the Department of Education to allocate funding 6 to school districts for the support of a peer assistance and review 7 program. 8 2. A school district that receives an allocation pursuant to 9 subsection 1 shall use the allocation to provide assistance to teachers 10 in meeting the standards for effective teaching, including, without 11 limitation, by: 12 (a) Conducting observations and peer assistance and review; and 13 (b) Providing information and resources to teachers about 14 strategies for effective teaching. 15 3. The sums allocated by subsection 1: 16 (a) Must be accounted for separately from any other money 17 received by the school district and used only for the purposes 18 specified in this section. 19 (b) May be used for expenses relating to conducting a program 20 of peer assistance and review of teachers, which may include, 21 without limitation, salaries and benefits of teachers and supervisors 22 who provide consulting services, salaries and benefits of necessary 23 substitute teachers, supplies, travel expenses and expenses relating 24 to professional development. 25 (c) May not be used to settle or arbitrate disputes between a 26 recognized organization representing employees of the school 27 district and the school district, or to settle any negotiations. 28 (d) May not be used to adjust the district-wide schedules of 29 salaries and benefits of the employees of the school district. 30 4. Any balance of the appropriation made by subsection 1 31 remaining at the end of the respective fiscal years must not be 32 committed for expenditure after June 30 of the respective fiscal 33 years by the entity to which the appropriation is made or any entity 34 to which money from the appropriation is granted or otherwise 35 transferred in any manner, and any portion of the appropriated 36 money remaining must not be spent for any purpose after 37 September 18, 2020, and September 17, 2021, respectively, by 38 either the entity to which the money was appropriated or the entity 39 to which the money was subsequently granted or transferred, and 40 must be reverted to the State General Fund on or before 41 September 18, 2020, and September 17, 2021, respectively. 42 Sec. 38. 1. There is hereby appropriated from the State 43 General Fund to the Professional Development Programs Account 44

This funding must be used 7 only to carry out the provisions of Assembly Bill No. 309 of this 8 session. 9 Sec. 39. 1. There is hereby appropriated from the State 10 General Fund to the Contingency Account for Special Education 11 Services created by NRS 388.5243 the sum of $100 in both Fiscal 12 Year 2019-2020 and Fiscal Year 2020-2021. 13 2. There is hereby authorized for expenditure from the 14 Contingency Account for Special Education Services the sum of 15 $1,999,900 in both Fiscal Year 2019-2020 and Fiscal Year 2020-16 2021. 17 3. The money appropriated by subsection 1 and authorized to 18 be expended by subsection 2 must be used only to carry out the 19 purpose of the Contingency Account for Special Education Services 20 created by NRS 388.5243. 21 4. Any remaining balance of the money appropriated by 22 subsection 1 for Fiscal Year 2019-2020 and Fiscal Year 2020-2021 23 must not be committed for expenditure after June 30 of each fiscal 24 year and must be reverted to the State General Fund on or before 25 September 18, 2020, and September 17, 2021, for each fiscal year 26 respectively. 27 Sec. 40. 1. There is hereby appropriated from the State 28 General Fund to the Grant Fund for Incentives for Licensed 29 Educational Personnel created by NRS 391A.400 to purchase one-30 fifth of a year of retirement service credit pursuant to section 5 of 31 chapter 8, Statutes of Nevada 2007, 23rd Special Session, at page 32 18: 33

For the purposes of accounting and reporting, the sum 36 authorized for expenditure by subsection 3 is considered to be 37 expended before any appropriation is made to the Teach Nevada 38 Scholarship Program Account from the State General Fund. 39 Sec. 43. 1. and $18,068,101 in Fiscal Year 2020-2021 to school districts and 1 charter schools for block grants for contract or employee social 2 workers or other licensed mental health workers in schools with 3 identified needs. The money must not be used for administrative 4 expenditures of the Department of Education. 5 3. For purposes of the allocations of sums for the block grant 6 program described in subsection 2, eligible “social workers or other 7 licensed mental health workers” includes the following: 8 (a) Licensed clinical social worker; 9 (b) Social worker; 10 (c) Social worker intern with supervision; 11 (d) Clinical psychologist; 12 (e) Psychologist intern with supervision; 13 (f) Marriage and family therapist; 14 (g) Mental health counselor; 15 (h) Community health worker; 16 (i) School-based health center; and 17 (j) Licensed nurse. 18 4. The money appropriated by subsection 1 must be expended 19 in accordance with NRS 353.150 to 353.246, inclusive, concerning 20 the allotment, transfer, work program and budget. Transfers to and 21 allotments from must be allowed and made in accordance with NRS 22 353.215 to 353.225, inclusive, after separate consideration of the 23 merits of each request. 24 5. Any remaining balance of the transfers made by subsection 25 2 for Fiscal Year 2019-2020 must be added to the money transferred 26 for Fiscal Year 2020-2021 and may be expended as that money is 27 expended. Any remaining balance of the transfers made by 28 subsection 2 for Fiscal Year 2020-2021, including any such money 29 added from the previous fiscal year, must not be committed for 30 expenditure after June 30, 2021, and must be reverted to the State 31 General Fund on or before September 17, 2021. 32 6. Of the appropriation made by subsection 1, $1,500,000 in 33 Fiscal Year 2019-2020 and $3,000,000 in Fiscal Year 2020-2021 34 must be transferred by the Department of Education to provide 35 grants to public schools to fund additional school resource officers 36 or school police officers, based upon need, utilizing school 37 discipline data, school violence data, school climate data, school 38 vulnerability, and the ability of the school district or charter school, 39 to hire additional school police officer or school resource officer 40 positions. The money must not be used for administrative 41 expenditures of the Department of Education. 42 7. The money transferred pursuant to subsection 6: 43

(a) Must be accounted for separately from any other money 1 received by the school districts and charter schools of this State and 2 used only for the purposes specified in subsection 6. 3 (b) May not be used to settle or arbitrate disputes between a 4 recognized organization representing employees of a school district 5 and the school district, or to settle any negotiations. 6 (c) May not be used to adjust the district-wide schedules of 7 salaries and benefits of the employees of a school district. 8 8. Except as otherwise provided in subsection 5, any remaining 9 balance of the sums appropriated by subsection 1 for Fiscal Year 10 2019-2020 and Fiscal Year 2020-2021 must not be committed for 11 expenditure after June 30 of each fiscal year and must be reverted to 12 the State General Fund on or before September 18, 2020, and 13 September 17, 2021, for each fiscal year respectively. 14 Sec. 44. 1. There is hereby appropriated from the State 15 General Fund to the School Safety Account the sum of $7,500,000 16 to provide grants utilizing a competitive grant process based on 17 demonstrated need, within the limits of legislative appropriation, to 18 school districts in counties whose population is less than 100,000 19 and to charter schools for school safety facility improvements. 20 2. Any remaining balance of the appropriation made by 21 subsection 1 must not be committed for expenditure after June 30, 22 2021, and must be reverted to the State General Fund on or before 23 September 17, 2021. 24 Sec. 45. 1. There is hereby appropriated from the State 25 General Fund to the Account for the New Nevada Education 26 Funding Plan created by NRS 387.129 the following sums: 27

2. This funding must be used only to carry out the provisions 30 of NRS 387.131 to 387.139, inclusive. The money appropriated by 31 subsection 1 must be expended in accordance with NRS 353.150 to 32 353.246, inclusive, concerning the allotment, transfer, work 33 program and budget. Transfers to and allotments from must be 34 allowed and made in accordance with NRS 353.215 to 353.225, 35 inclusive, after separate consideration of the merits of each request. 36 3. Expenditure of $22,044 in both Fiscal Year 2019-2020 and 37 Fiscal Year 2020-2021 from money in the Account for the New 38 Nevada Education Funding Plan that was not appropriated from the 39 State General Fund is hereby authorized for the New Nevada 40 Education Funding Plan program to carry out the provisions of NRS 41 387.131 to 387.139, inclusive. 42 4. Any remaining balance of the appropriation made by 43 subsection 1 must not be committed for expenditure after June 30, 44 2021, by the entity to which the appropriation is made or any entity 45

to which money from the appropriation is granted or otherwise 1 transferred in any manner, and any portion of the appropriated 2 money remaining must not be spent for any purpose after 3 September 17, 2021, by either the entity to which the money was 4 appropriated or the entity to which the money was subsequently 5 granted or transferred, and does not revert to the State General Fund. 6 Sec. 46. 1. There is hereby appropriated from the State 7 General Fund to the Teachers’ School Supplies Reimbursement 8 Account created by NRS 387.1253 to reimburse teachers for out-of-9 pocket expenses incurred in connection with purchasing necessary 10 school supplies for the pupils they instruct: 11

2. The money appropriated by subsection 1 must be expended 14 in accordance with NRS 353.150 to 353.246, inclusive, concerning 15 the allotment, transfer, work program and budget. Expenditure of the following sums not 35 appropriated from the State General Fund or the State Highway 36 Fund is hereby authorized during Fiscal Year 2019-2020 and Fiscal 37 Year 2020-2021 by the Department of Education for the State 38 Supplemental School Support Account created by NRS 387.191: 39

Sec. 48. 1. There is hereby appropriated from the State 1 General Fund to the Account for Instruction in Financial Literacy 2 created by NRS 388.895 the following sums: 3

2. If and only if Senate Bill No. 314 of this session is enacted 6 by the Legislature and approved by the Governor, the Department of 7 Education shall transfer from the appropriations made by subsection 8 1 to the school districts specified in this subsection the following 9 sums which must be used only to carry out the provisions of Senate 10 Bill No. 314 of this session for Fiscal Year 2019-2020 and Fiscal 11 Year 2020-2021: 12

School District: 2019-2020 2020-2021 13 Clark County School District $500,000 $500,000 14 Washoe County School District $150,000 $150,000 15

3. If and only if Senate Bill No. 314 of this session is enacted 16 by the Legislature and approved by the Governor, of the money 17 appropriated by subsection 1, the sum of $100,000 in Fiscal Year 18 2019-2020 and $100,000 in Fiscal Year 2020-2021 must be used to 19 award grants of money to school districts, other than the Clark 20 County School District and Washoe County School District, and to 21 the sponsors of charter schools that submit an application to the 22 Department of Education. The amount granted to each school 23 district and charter school must be based upon the number of pupils 24 enrolled in each such school district or charter school, as applicable, 25 who are enrolled in a subject area in which instruction in financial 26 literacy is provided, and not on a competitive basis. 27 4. Money transferred by subsection 2 must be used to support 28 instruction in financial literacy, including, without limitation, by 29 providing technical assistance, monitoring, support and professional 30 development training regarding financial literacy to teachers who 31 teach in a subject area in which instruction in financial literacy is 32 provided. 33 5. Any balance of the sums appropriated by subsection 1 that is 34 unencumbered or unexpended at the end of the respective fiscal 35 years does not revert to the State General Fund, must be carried 36 forward to the next fiscal year and is hereby authorized for use in 37 the next fiscal year for the purposes specified in subsection 3 or 4, 38 as applicable. 39 6. The sums appropriated by this section must be accounted for 40 separately by each school district and charter school from any other 41 money and used only for the purposes specified in this section. 42 Sec. 49. 1. If Assembly Bill No. 533 of this session is not 43 enacted by the Legislature and approved by the Governor, 44 expenditure of $55,574,846 during Fiscal Year 2019-2020 and 45

$57,242,070 during Fiscal Year 2020-2021 is hereby authorized for 1 the Department of Taxation’s Marijuana Regulation and Control 2 Account. 3 2. If Assembly Bill No. 533 of this session is enacted by the 4 Legislature and approved by the Governor, expenditure of 5 $55,574,846 during Fiscal Year 2019-2020 is hereby authorized for 6 the Department of Taxation’s Marijuana Regulation and Control 7 Account and expenditure of $57,242,070 during Fiscal Year 2020-8 2021 is hereby authorized for the Cannabis Compliance Board 9 created by section 54 of Assembly Bill No. 533 of this session. 10 3. If Assembly Bill No. 533 of this session is enacted by the 11 Legislature and approved by the Governor, any balance of the sums 12 authorized by subsection 2 that is unencumbered or unexpended by 13 June 30, 2020, and not required to be transferred to the Distributive 14 School Account or to local governments pursuant to NRS 15 372A.290, 453A.344 or 453D.510 is hereby authorized to be used 16 by the Cannabis Compliance Board created by Assembly Bill No. 17 533 of this session on July 1, 2020. 18 Sec. 50. NRS 387.191 is hereby amended to read as follows: 19 387.191 1. Except as otherwise provided in this subsection, 20 the proceeds of the tax imposed pursuant to NRS 244.33561 and any 21 applicable penalty or interest must be paid by the county treasurer to 22 the State Treasurer for credit to the State Supplemental School 23 Support Account, which is hereby created in the State General Fund. 24 The county treasurer may retain from the proceeds an amount 25 sufficient to reimburse the county for the actual cost of collecting 26 and administering the tax, to the extent that the county incurs any 27 cost it would not have incurred but for the enactment of this section 28 and NRS 387.193 or NRS 244.33561, but in no case exceeding the 29 amount authorized by statute for this purpose. Any interest or other 30 income earned on the money in the State Supplemental School 31 Support Account must be credited to the Account. 32 2. On or before February 1, May 1, August 1 and November 1 33 of [2020,] 2022, and on those dates each year thereafter, the 34 Superintendent of Public Instruction shall transfer from the State 35 Supplemental School Support Account all the proceeds of the tax 36 imposed pursuant to NRS 244.33561, including any interest or other 37 income earned thereon, and distribute the proceeds proportionally 38 among the school districts and charter schools of the state. The 39 proportionate amount of money distributed to each school district or 40 charter school must be determined by dividing the number of 41 [students] pupils enrolled in the school district or charter school by 42 the number of [students] pupils enrolled in all the school districts 43 and charter schools of the state. For the purposes of this subsection, 44 the enrollment in each school district and the number of [students] 45

pupils who reside in the district and are enrolled in a charter school 1 must be determined as of each quarter of the school year. This 2 determination governs the distribution of money pursuant to this 3 subsection until the next quarterly determination of enrollment is 4 made. The Superintendent may retain from the proceeds of the tax 5 an amount sufficient to reimburse the Superintendent for the actual 6 cost of administering the provisions of this section and NRS 7 387.193, to the extent that the Superintendent incurs any cost the 8 Superintendent would not have incurred but for the enactment of 9 this section and NRS 387.193, but in no case exceeding the amount 10 authorized by statute for this purpose. 11 Sec. 51. Section 8 of chapter 4, Statutes of Nevada 2009, as 12 last amended by section 44 of chapter 394, Statutes of Nevada 2017, 13 at page 2614, is hereby amended to read as follows: 14

Sec. 8. Transitory provision. 15 1. Notwithstanding the expiration of section 4 of this 16 measure on June 30, 2011, any tax and any interest or penalty 17 owing and unpaid as of that date and collected on or before 18 October 1, 2011, must be paid, deposited and credited to the 19 State General Fund as provided in that section. 20 2. The Superintendent of Public Instruction shall make 21 the initial transfer from the State Supplemental School 22 Support Account, as required by section 6 of this measure, on 23 or before February 1, [2020.] 2022. 24 3. The board of trustees of each school district and the 25 governing body of each charter school shall prepare their 26 initial reports to the Superintendent of Public Instruction, as 27 required by section 6 of this measure, on or before 28 November 10, [2020.] 2022. 29

Sec. 52. 1. This section and section 44 of this act become 30 effective upon passage and approval. 31 2. Sections 1 to 19, inclusive, 21 to 25, inclusive, 27, 29 to 33, 32 inclusive, 39 to 43, inclusive, and 45 to 51, inclusive, of this act 33 become effective on July 1, 2019. 34 3. Sections 20, 36 and 38 of this act become effective on 35 July 1, 2019, if and only if Assembly Bill No. 309 of this session is 36 enacted by the Legislature and approved by the Governor. 37 4. Sections 35 and 37 of this act become effective on July 1, 38 2019, if and only if Assembly Bill No. 309 of this session is not 39 enacted by the Legislature and approved by the Governor. 40 5. Sections 26 and 28 of this act become effective on July 1, 41 2019, if and only if Senate Bill No. 467 of this session is enacted by 42 the Legislature and approved by the Governor. 43

6. Section 34 of this act becomes effective on July 1, 2019, if 1 and only if Senate Bill No. 314 of this session is enacted by the 2 Legislature and approved by the Governor. 3
