AUTHORIZING REFERRAL TO THE ATTORNEY GENERALREGAR DING MULTIPLE SEWAGE SPILLS BY THECITY OF SOUTH PASADENA TO WATERS OF THE STATE,
A. WH EREA S, the City of South Pasadena (hereinafter referred to as Permittee),operates and maintains 54 miles of a w astewater collection system , in which 36miles are more than 75 years o ld. The wastewater collection system is tributary toboth the Los Angeles County Sanitation District 16 and to the C ity of LosAngeles collection systems.B. WH EREA S, the Perm ittee is enrolled under State Water Resou rces Control BoardOrder No. 2006-0003-DWQ (State Wide Waste Discharge Requirements forSanitary Sewer System s), also known as the Sanitary Sew er Overflow (SSO)WDR. The S SO W DR regulates sanitary sewer systems greater than one mile inlength that collect andlor convey untreated or partially treated wastew ater to apublicly owned treatment facility in th e State of California. Thewastew ater issusceptible of co ntaining high levels o f suspended solids, pathogenic organisms,toxic pollutants, nutrients, oxygen-demanding organic compounds, o il and grease,and other pollutants which can degrade w ater quality and im pact beneficial uses.C. WH EREA S, the Permittee has reported twenty-six (26) SSO s (listed on Table 1,which is hereby incorporated by reference) into the S SO database, in accordancewith the SSO WDR , between January 29,20 07 and January 7, 2 0 11,resulting in

F. WHEREA S, the Los Angeles Regional Water Quality Control Board (RegionalBoard) is a state agency, whose p rimary authority under the Porter-Cologne WaterQuality Control Act (at California Water C ode 5 13000 et seq.; hereafter WaterCode) is regulating, enforcing, and ensurin g the quali ty of the waters of the S tate.
G. WHEREA S, the Regional Board finds it necessary and appropriate to refer thismatter to the California Attorney General's Office to seek judicially imposed civilliabilities under applicable sections of the W ater C ode, to file such otherapplicable causes of action, and to seek other appropriate remedies.H. . WHEREAS, all enforcement options have been considered. Any Regional Boardenforcement order issued (e.g., Cleanup and A batement Order, Cease and DesistOrder, or Tim e Schedule Order) may lead to compliance; howev er, if compliancewith those orders are not achieved, the Regional Board would follow up with anAdministrative C ivil Liability (ACL) assessing monetary pe nalties. Because theultimate goal for the Permittee is compliance with the SSO W DR, a Regional 'Board issued AC L assessing only monetary penalties ma y not b e the best and
most direct remedy to fix the shortcomings of the City's sanitary sewer system.WHER EAS, given the gravity of the multiple discharges, the age of thePermittee's infrastructure, and the lack of any significant operation andmaintenance program, referral to the California Attorney General's Office willallow the ~ e g io n a l oard to pursue more appropriate civil liability and injunctiverelief than would otherwise be allowed if the R egional Board pursued anadministrative liability action . Inparticular, the ab ility to pursue injunctive reliefwould allow the Regional Board, through the California Attorney General'sOffice, to place the Permittee under a judicially enforceable timeline to make theneeded im provements to the sewer infrastructure and managemen t.

Water Code section 13350. On January 7,201 1, notice was given to the Permitteeregarding this hearing. On March 3,201 1, the Regional Board held such a hearingin compliance with section 13350(g), and considered, he testimony and evidenceoffered at the hearing and in the record.
NOW THEREFORE BE ITRESOLVED THAT:1. The Regional Board hereby authorizes the Executive Officer to request that theAttorney General seek civil liabilities under the Water Code, including, but notlimited to, Water Code sections 13350(a) and 13385, as appropriate, bring otherapplicable causes of action, andlor seek other relief as may be appropriate againstthe Permittee.2. The Regional Board hereby authorizes the Executive Officer to participate in anysettlement discussions regarding the resolution of the violations at issue. TheRegional Board retains its authority to approve any proposed settlement of the
alleged violations.I, Samuel Unger, Executive Officer, hereby certify that the foregoing is a full, true, andcorrect copy of the Resolution adopted by the California Regional Water Quality ControlBoard, Los Angeles Region, at its regular meeting on March 3,201 1.
