In reviewing our records, we note that we had not closed the file on this well since October 31, 1996, due to the remaining requirement of obtaining an elevation survey of the wellhead. On February 18,2004, the Commission adopted updated Hawaii Well Construction and Pump Installation Standards, which allow the elevation survey for wells of 70 gpm or less to be deferred until some future date when it may become necessary for monitoring purposes. Under this provision, we are deferring this requirement for your well.
October 31, 1996 was the date we received the completion report for this well, in which you requested an exemption from the survey requirements. We were unable to approve an exemption at that time, but suspended enforcement, as we understood and appreciated the circumstances. We are now able to officially bring this matter to rest, issuing certificates of completion for the well construction and pump installation, as is now the practice with the approval of the revised standards.
We are also transmitting your water use report form, to be recorded monthly and reported annually.
If it should become necessary in the future, a wellhead elevation survey may be required, but otherwise the permitting process requirements for this well are complete.

To protect Hawaii's natural ground water resources for the benefit of all, the following requirements apply to the use of your well:
1. Before this well can be pumped on a regular basis, a certificate of pump installation completion must be obtained.
2. If the well is not in use it must be properly capped.
3. If the well is to be abandoned then the landowner must cause a licensed contractor to apply for a well abandonment permit in accordance with § 13-168-l2(f) prior to any well sealing or plugging work.
4. In the event that the well operator and/or landowner changes, the Commission shall be notified of the change prior to the change, and all forms shall be transferred to the new owner.
5. In the event the benchmark in the concrete base of the well is altered in any way, an updated elevation survey (page 5 ofthe Well Completion Report Part I) shall be submitted to the CommIssion. Because groundwater in Hawaii is a public trust, and adverse effects at one well may affect other water resources, any violation of the above conditions, or any other provision of the Hawaii Administrative Rules, may be subject to fines of up to $5,000/day. The CommiSSIon needs your help and asks that you to do your part in utilizing this shared resource. We prefer to work with you in meeting the goal ofprotectmg our ground water resources together.

5. Your approved pump has a capacity of 38 gpm at a head of 120 ft. In the future, pump replacements of equal or lesser capacity will not require an additional permit from the Commission, but will require the submission of a Well Completion Report Part II by the licensed pump installer. If the pump replacement is greater than the existing pump, you will need to apply for a new pump installation permit.
6. The landowner shall cause the well operator to maintain the installed meter or other appropriate means for measuring and reporting withdrawals and water levels, and appropriate devices or means for measuring chlorides and temperature. These data shall be measured monthly and reported to the Commission on a annual basis, on forms provided by the Chairperson (attached), in accordance with § 13-168-7, HAR.
7. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. The authorization to drill a well and/or install a pump shall not constitute a determination of correlative water rights. The landowner and well operator are notified that the quantity of water taken from the well and/or the pump capacity could be reduced by the Commission in the future.
8. In the event that your installed pump is less than 70 gallons per minute, and no elevation survey has been completed, you may be required to do one in the future.

Requirements for a driller include an exchange of documentation in a regular sequence to assure that the standards are met. We appreciate your efforts to complete your own portion of the documentation, but must underline the need to impress upon your clients their responsibilities. Because we have so often had to request further completion of standard documentation. we are taking this opportunity to review the procedure for your information. The sequence we observe follows:
1. Application is submitted, with topographic and TMK maps and fee. Well Construction and Pump Installation Permits may be requested simultaneously, although approval is separate and sequential. If the proposed well will produce less than 70 gpm, the applicant may request immediate pump installation pending final Pump Installation Permit approval; well owner must sign.
2. Application is reviewed for completeness and acknowledged accordingly.
3. Completed application is forwarded by staff to the Department of Health (DOH) Safe Drinking Water and Wastewater Branches and to DLNR Land Division for their review.
4. Staff compares proposed section for compliance with Hawaii Well Construction and Pump Installation Standards (HWCPIS).
5. Positive comments from DOH and Land Division plus okay with HWCPIS support issuance of Well Construction Permit (WCP). with any special conditions and a blank copy of the Well Completion Report (WCR); copies go to both owner and driller.
6. Owner and driller must sign WCP and return one copy to Commission to validate it. Drilling may not start without a validated permit.
7. Driller submits notification of starting work.
8. Following completion of well drilling, driller submits a. well Completion Report Part I (WCRl), b. as-built well section, c. pump test data. d. surveyed elevation of reference point on wellhead marked on the
as-built drawings. The well owner, driller, and surveyor must sign. If Pump Installation Permit Application has not yet been submitted, now is the time.
9. WCRl is reviewed for completeness, well section reviewed to verify compliance with standards. and pump test data are reviewed for aquifer support of pump size.

JAN 2.d am 10. Pump Installation Permit Application, if newly submitted, is
reviewed for completeness and acknowledged accordingly. In an older well, if pump tests are not current, staff may require new pump tests. Copy of application is sent to DOH/Safe Drinking Water and Wastewater Branches for review.
11. If the staff review of WCRlInew application is positive, a completed Pump Installation Permit Application will be processed, and Permit issued and transmitted with a blank Well Completion Report Part 2 (WCR2) and Water Use Report form.
12. Following completion of pump installation, installer submits WCR2 with as-built drawing including depth below ground of pump intake. The pump installer and owner must sign, as must the surveyor if the benchmark is relocated.
13. WCR2 is reviewed for completeness, and completion of permitting requirements acknowledged accordingly.
If extensions are needed for start dates or permit expiration, these must be requested in writing (preferably by the owner). Some clarifications can be handled by telephone, but steps in the procedures should be made in writing for the fIle. This is to track the process for hundreds of applications accurately and protect the legal liability of owner and driller.

The well owner is responsible for all conditions of the permit. This includes ensuring that the pump installation contractor, or other party who installs the pump, submits a completed Part n of the Well Completion Report form (enclosed) within sixty (60) days after the pump installation work is completed. Be advised that you may be subject to rmes of up to $1000 per day for any violations of your permit conditions.
To validate your pump installation permit, please sign and have the contractor sign both permit originals and return one for our files.
A copy of the Well Completion Report (Part II) and a copy of your water use report form are enclosed for your use. Except for the monthly water use report form, please provide copies of all the information in this packet to your pump installation contractor.
Finally, this letter is notice that we have accepted your Well Completion Report - Part I as complete.

Thank you for your letter of July 15, 1996, providing information on outstanding applications and pennits.
We are administratively extending the start date for the Peahi-Wilson and HueloHarold Wells (Well Nos. 5515-02 and 5413-06) as you requested in the well owners' behalf and have noticed the well owners of this. We generally find it appropriate to have the well owner request a specific amount of time needed to start work. If it is not possible to comply WIth this condition of the permit, it may be allowed to lapse with no prejudice against any subsequent new application once the owner is ready. l1te extensions here have been granted for six months, through January 24, 1997. All other conditions of the pennit, including its expiration date for completion of work, remain the same.
The well completion reports for Peahi-Phillips (Well No. 5615-02), Huelo-Gould (Well No. 5413-05), and Peahl-Trier (Well No. 5615-03) are incomplete, lacking the pump test results, as-built drawings for the wells and elevations established by a HawaU licensed surveyor. l1tese are essential to proceed with approving Pump Installation Pennits.
Finally, please note that the well construction permit applications have three separate spaces for well owner, landowner (as these may be different), and contractor. We have legal obligations to provide these people with notice directly, even though we may routinely be in contact with a contractor if so specified as the primary contact on the project. Please complete the forms as specified, rather than submitting your own name as contact person for a well owner or landowner or providing your own address in lieu of theirs.

The Commission on Water Resource Management (Commission), P.O. Box 621, Honolulu, HI 96809, shall be notified, in writing, before any work by this permit commences.
The well construction permit shall be for construction and testing of the well only. A minimum one-inch diameter monitor tube shall be permanently installed, in a manner acceptable to the Commission, to accurately record water levels. The permittee shall coordinate with the Commission and conduct a pumping test in accordance with the attached Aquifer Pump Testing Procedure. The permittee shall submit to the Commission the test results as a basis for supporting an application to install a permanent pump and withdraw water for use. No permanent pump may be installed until a pump installation permit is approved and issued by the CommiSSIOn.
The permittee shall incorporate mitigation measures to prevent construction debris from entering the aquatic environment, to schedule work to avoid periods of high rainfall, and to revegetate any cleared areas as soon as possible.
In the event that subsurface cultural remains such as artifacts, burials or concentrations of shells or charcoal are encountered during construction, the permittee shall stop work and contact the Department's Historic Preservation Division (587-0045) immediately.
The proposed well construction shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to construct the well shall not constitute a determination of correlative water rights.
The following shall be submitted to the Commission within thirty (30) days after compl\tion of work:

ISSUES/ANALYSIS:
Agency Review: The application was circulated to the State DLNR's Divisions of Historic Preservation and Aquatic Resources, the Office of Hawaiian Mairs, the Departments of Hawaiian Home Lands and Health, and to the (Island) Department of Water Supply. While the Department of Health has no jurisdiction over individual and small private drinking water systems, it points out that cesspools in rural areas warrant testing prior to well use for drinking, for the applicant's safety. Aquatic Resources Division believes that proximity to Waipio and Hanehoi Streams call for care to prevent construction debris from entering the aquatic environment and efforts to revegetate cleared areas as soon as possible.
Staff review: The proposed well would tap fresh basal ground water. Proposed use is approximately 20,000 gallons per day. Two small wells are about a little over 500 feet away, in different directions; two other wells are about 1500 feet away. No adverse impacts are expected.
RECOMMENDATION:
A. That the Commission approve the issuance of a well construction/pump installation pennit for Huelo-Gould Well, subject to the standard permit conditions in Exlubit 3 and the following special conditions:

Thelermit may be extended by the Commission upon a showing of good cause and goo -faith performance. A request to extend the permit shall be submitted to the Commission no later than three (3) months prior to the date the pennit expires. If the commencement or completion date is not met, the Commission may revoke the permit after giving the permittee notice of the proposed action and an opportunity to be heard.

The pwn{> test procedure for new wells shall consist of a step-drawdown test followed by a lonz-term contmuous aquifer test. Testing the well and aquifer in the prescribed manner shou1Ci result in the hydrologic information needed to determine: 1) the well's oerformance with regard to yield and water quality (chloride concentration), and 2) the nearoy hydraulic properoes of the aquifer.
General Recording Requirements
The records required for analysis and the tolerance in measurement acceptable for the step-drawdown and long-term continuous aquifer test are as follows:

Recording of data should be on a form similar to Table 1. All information shown in T~ble 1 shall be provided. In addition. data shall be plotted on Graph 1 and prOVIded.
Step-Drawdown Test.
The pU!POse of the step-drawdown test is to establish the efficiency of the well and to provide prelimiiuuy information on the yield of the well, both from a quantity and quality standpomt.
1. Measurement of water level in the pumped well shall be made evelY. 12 hours for a period of no less than two days prior to the initiation of the step-(lrawdown test in order to obtain the pretest trend in water levels. .
2. The step-drawdown test will consist of continuously pumping the well for four hours at four different rates.

Each pump'ing rate should be continued (or one hour, after which the new rate should be instituted as rapidly as possible.
Pumping should begin at the lowest rate and conclude with the highest rate.

Long-Tenn Continuous Test
The purpose of the long-tenn continuous test is to determine the hydraulic properties of the aquifer to explore for and identify nearby aquifer boundaries such as streams or dikes, and to observe the trend in chloride concentration of the discharge water. .
1. The lopg-tenn test should not conunence until the water level in the pumped well has fully recovered from the stelHlrawdown test. Generally, the time required (or this recoven- will be slig'htly greater than four hours. The water level in the pumped well should be measured immediately before initiation of the long-tenn test.

The pump rate for the long-tenn test should be sufficient to create an observable drawdown.
The test should be run 24 hours per day for at least seven days. If during the test, the water level remains the same for a period of 24 hours, the test can be tenninated.
Measurement of chloride concentration and temperature of the discharge water during the long-tenn test shall be made at the beginning of the test and every six hours thereafter.
Depth to water in all wells shall be measured with sufficient frequency that each loaarithmic cycle in time on the data plots (Graph 1) contains at least 10 data pomts spread through the cycle. Thus, depth to water should be made at t=O {immediately prior to start of the test). and as close as possible at t=l, 1.5t 2, 2.5,3,4,5,6, 7, and 8 minutes for the first ten minutes and at all succeedmg decimal mUltiples of these numbers to the end of the test (t=10, 15, 20

The proposed new well construction site is located on an upland flat, between Waipio and Huelo Streams. The area consists of former agricultural lands that were cleared and plowed during the early and middle twentieth century.
Our records indicate that no historic sites have been recorded for the area near or surrounding the proposed well site. In general, existing historic sites occur in the stream valleys and gulch areas which were not impacted by pineapple and sugar cultivation.
According to the applicant, the well site is accessible by vehicle, and is within a formerly cleared pasture area.
Based on ~revious land use patterns in the area, and the known patterning of remaining historic sites in the Hamakualoa area, it appears unlikely that historic sites are present in the area of the proposed well.
We believe that this proj ect will have "no effect II on historic sites.

Thank you for the opportunity to review and comment on the well construction and pump installation permit application for the Huelo-Gould well. Although the proposed well is intended for domestic use (individual, non-commercial water system), we would like to provide the following comments:
1. Federal and state regulations define a public water system as a system that serves 25 or more individuals at least 60 days per year or has at least 15 service connections. All public water system owners and operators are required to comply with Hawaii Administrative Rules, Title 11, Chapter 20, Rules Relating to Potable Water Systems. If the system is not a public water system, we would recommend that the user perform microbiological and chemical sampling and analyses to evaluate the quality of the water for drinking purposes.
2. Section 11-20-29 of Chapter 20 requires that all new sources of potable water serving a public water system be approved by the Director of Health prior to its use.' Such approval is based primarily upon the submission of a satisfactory engineering report that addresses the requirements set in section 11-20-29.
3. The engineering report must identify all potential sources of contamination and evaluate alternative control measures which could be implemented to reduce or eliminate the potential for contamination, including treatment of the water source. In addition, water quality analyses, performed by a laboratory certified in the State of Hawaii,

must be submitted as part of the report to demonstrate compliance with all drinking water standards. Additional tests may be required by the Director upon his review of the information submitted.

The applicant, Sherrie Gould, proposes to drill a new well in the Haiku area of MauL A submersible pump will be used to withdraw 20,000 gallons of water per day to be used for agricultural purposes.
The Division has no objection to this request since the proposed project is not expected to have significant adverse impact on aquatic resource values in this area. However, we are concerned because the proposed project site is located in the vicinity of Waipio and Hanehoi Streams. These streams contain suitable habitat for native freshwater fauna that recruit from the ocean. This is likely because other streams in the same area harbor native freshwater fauna. Therefore, construction activities could have potential short term impacts on aquatic resources such as temporary turbidity, biota displacement and disturbance. The applicant should take precautions to prevent contaminants such as drill cuttings, cutting extraction medium, sediment, pollutants, petroleum products, and debris from possibly entering the aquatic environment. In addition, we suggest that site work be scheduled for periods of minimal rainfall and lands denuded of vegetation be replanted or covered as quickly as possible to control erosion.
