BEREA CITY COUNCIL REGULAR MEETING OCTOBER 7, 2014

The Berea City Council met in a regular session; Tuesday, October 7, 2014; Mayor Steven Connelly presiding. A quorum being present, the meeting was called to order at 6:30 p.m.

COUNCIL MEMBERS PRESENT: Burnside, Kerby, Little, Farmer, Wagers, Powell, Hembree, Terrill

OFFICIALS: Gilbert, Stone, Chasteen, Gregory, Curtis, VanWinkle, Hurt

VISITORS: Over one hundred people were in attendance.

APPROVAL OF MINUTES; September 2, 2014

Burnside moved, Little seconded to approve the minutes of September 2, 2014; all ayes.

APPROVAL OF MINUTES; September 16, 2014

Farmer moved, Burnside seconded to approve the minutes of September 16, 2014; all ayes.

PROCLAMATION – INDUSTRIAL APPRECIATION MONTH

Mayor Connelly read the Proclamation declaring the month of October as Industrial Appreciation Month in the City of Berea. Jeff Cruse, Operations Manager of Novelis accepted the Proclamation.

SET DATE AND TIME FOR TRICK OR TREAT

Farmer moved; Hembree seconded to designate 6pm-8pm on October 31st at Trick-or-Treat time in the city; all ayes. Mayor Connelly added the Trick-or-Treat event in the Park will also be held on the date and time.

ORDINANCE #19-2014; AN ORDINANCE OF THE CITY OF BEREA, KENTUCKY, PROVIDING THAT THE LAND MANAGEMENT AND DEVELOPMENT ORDINANCE OF THE CITY OF BEREA, KENTUCKY, ORDINANCE NO. 18-04, AS AMENDED BY ORDINANCE NO. 16-07, BE AMENDED BY THE ADDITION OF SECTION 408(B)(4) TO REQUIRE BUILDING PERMITS FOR ALL ACCESSORY USES AND TO LIMIT THE SQUARE FOOTAGE OF ACCESSORY USES TO NO MORE THAN 25% OF SIDE OR REAR YARDS – 2ND READING

Corporate Counsel Jerry Gilbert read the ordinance in its entirety. Burnside moved, Kerby seconded to approve and adopt the ordinance. Roll call vote; Burnside-yes, Kerby-yes, Little-yes, Farmer-yes, Wagers-yes, Powell-yes, Hembree-no, Terrill-yes. Ordinance adopted.

ORDINANCE #22-2014; AMENDING ORD. #05-05-LAND MANAGEMENT- 1ST READING

Corporate Counsel Gilbert read the ordinance in its entirety; Codes Administrator VanWinkle explained amendments is needed to this ordinance to allow development plans be approved by the Codes Officers if they meet all requirements; this would shorten the process for the developer. Mayor Connelly suggested some changes to the wording prior to the second reading.

CHANGE ORDER #9; WATER STREET DRAINAGE IMPROVEMENT

Mayor Connelly read the change order noting an addition of $5,950.00. The original contract price was $186,000.00; previous change orders total is $87,223.72, revising the contract price to $279,173.72. Little moved, Powell seconded approval of the change order, all ayes,

RESOLUTION 08-2014; CONSENT TO TRANSFER OF CONTROL - TIME

Corporate Counsel read the resolution in its entirety; Burnside moved, Wagers seconded authorizing the mayor to sign transfer for control from Time Warner to Comcast, and then change of control to Charter Communications.

ORDINANCE #18-2014; AN ORDINANCE OF THE CITY OF BEREA, KENTUCKY, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF BEREA, KENTUCKY, BE AMENDED BY REVISING CHAPTER 22, ARTICLE V!!!, HUMAN RIGHTS COMMISSION, SECTIONS 22.700-22.708, AND ADDING SECTIONS 22.709-22.713, WHICH REVISIONS AND ADDITIONS PROHIBIT DISCRIMINATION BASED ON

Corporate Counsel read the ordinance by title and summary; Burnside moved, Kerby seconded to approve the ordinance. Discussion and comments were presented by members of the council. Roll call vote; Burnside-yes, Kerby-yes, Little-no, Farmer-no, Wagers-yes, Powell-no, Hembree-no, Terrill-no, Ordinance defeated.

AUDIT & FINANCE COMMITTEE; RECOMMENDATION OF BREAKER BIDS RECEIVED

Utility Director, Ed Fortner stated all bids received were favorable for the Oak Street Sub Station; his recommendation was from Alstom for the primary breakers at $72, 500.00, and Schneider Electric for 15KV breakers in the amount of $161,780.00. Burnside moved, Little seconded to approve and award; all ayes.

Terrill asked if there had been a recent rate increase; Fortner stated no increases have taken place, utility bills were up this past month due to usage increase, and September was usually warmer than normal. No rate increase this year. The twelve month calendar is now on the utility bills to help customers track their usage.

The Solar Tour is taking place this Saturday at the Utility Department with free food and events starting at 11 a.m. Sustainable Berea is partnering with the event and there will be things for the kids to do. Our linemen won the Electric Lineman Rodeo for the second year, we are very proud of them. Hembree added thanks from the residents of Dixie Park for the recent upgrade.

CITY ADMINISTRATOR’S REPORT: R. STONE

Berea has been nominated as a Green Community for our work on our Solar Farm; tomorrow afternoon at the Governor’s Conference on Energy, Mayor Connelly will present our Utility Work to the State.

Bratcher Lane Project is ready for the final inspection; with the exception of one driveway curb that crumbled; The Allen Company will return to replace it as weather allows. We will make the final punch list inspection in the next two-weeks. There is one tree that will have to be taken down, and some fencing to complete. The new sidewalk has allowed residents to get out more and meet their neighbors.

The Indian Fort Trail is 45% complete; we plan to start paving at the end of this week, weather permitting. To date we have paid Bluegrass Contracting $125,000.

The curb is in and the paving is down on one side of Menelaus Road diversion; this project is going very well.


Received word from the state that the letting for the By-Pass will be in December and the US25 North Project will be in March of 2015.

We interviewed five firms for the 595 Widening Project; we will be offering a contract to Blake Adams for the engineering work. We have sent a letter to the State for their approval of his firm and asked for a release of $120,000 for the design work.

Our Street Department will be accepting yard waste on the 1st and 3rd Saturdays at the old landfill site for Berea residents; proof of residency will be required and times will be received from 8am – 11:30am.

The city will begin the annual leaf pick-up starting on Monday, Oct. 13th; our new leaf machine is expected soon. After Nov. 1st. residents may pick up a biodegradable bag from the street department to place their leaves in for the third week pick-up. Bags much be placed by the curb. This will be the once phase of the MS4 program we are now required to do.

The street paving project for this year is complete; there will be a change order for the addition of a section on Cope Lane and we made some changes on the gravel streets; we widened Fair Grounds Road and Neeley Court.

We have signed a contract for salt with Detroit Salt; we will receive 1,000 tons for this winter’s stockpile. After 20 years of doing business with Morton Salt they declined us for a delivery. The price will be $115.00 per ton.

The Comcast/Charter Resolution we signed this evening will allow us to retain all of the same services that Time Warner provided to us; we will keep our modems and our government channel.

Questions:

Wagers; what can residents do with TV’s or large appliances? Legacy offers special pick-ups each Friday, residents need to call and schedule a pick-up or call city hall for questions. Legacy has been charging customers a fee for replacement of the large containers, it has been brought to their attention that this was not in their contract.

MAYORS COMMENTS:

The city received a letter from the Arts Council thanking the city for all their assistance during the “Walk with the Arts Program” to help create a safe and educational environment for the kids.

Berea is being recognized tomorrow at the Governor’s Energy Conference for our Solar Farm.


COUNCIL COMMENTS:

Hembree – are we receiving notices for the age friendly meeting; replies are starting to come in. A big thanks for Tom in his efforts to push the paper work through in getting the new kidney dialysis center in Berea, he had to take his dad out of town for his appointments, it is a blessing to be getting one here.

Wagers – invited residents to attend the Volunteer Fire Department’s breakfast that they hold each first Saturday of the month; suggested a donation of $6-$7, they offer country ham, biscuits, sausage and eggs. We need to support our Volunteer Fire Department.

Farmer – reminded the residents of this week-end’s upcoming Guild Fair at Indian Fort; Saturday and Sunday.

Little – hopes the community comes back together.
