Time-Sharing
• In Florida a shared joint child custody arrangement is known as time-sharing
• Time-sharing allows one parent physical custody of the child while allowing the other parent generous visitation time
• Generally in Florida, family courts lean towards a shared custody arrangement, which will allows both parents to enjoy time with a child
Best Interests of the Child• Florida courts will determine child custody arrangements or time-sharing based on
certain criteria which all revolves around the child’s best interests
• Below are the factors that play into the courts decision
• Both parent's willingness to encourage & support a relationship between the child and the other parent
• Both parent's ability to answer the child's needs
• Mental, physical, and emotional health of parents
• The child's wishes (generally age 12 or older)
• Child’s home environment stability
• To set and honor a time-sharing schedule
• History of domestic violence, sexual violence, child abuse, child abandonment, child neglect, etc.
• The parent's ability to be involved with the child's school and other activities in their life
Relocation and Child Custody in Florida• Both parents must sign a written agreement for one
parent to relocate with a child
• This agreement is based on:
• Consent to the relocation
• The time-sharing schedule for the non-relocating parent as well as any other persons entitled to access or time-sharing
• Transportation related to access or time-sharing

signed petition to the other parent, regarding the relocation, ASAP
• Included with the petition is:
• The address, telephone number, & description of the new residence
• Date of the intended move
• Detailed reasons for the move
Types of Child Custody1. Joint custody is often the type of
arrangement favored by most judges
• Both parents share custody of the child but one parent will be responsible for housing the child as the primary residence
2. Sole custody is when one of the parents has legal custody of the child while the other may obtain visitation rights
3. Shared custody in which both custody and actual residential arrangements for the children are evenly split between both parents
