1. The Development Plan Scheme

This Development Plan Scheme sets out the programme for preparing and reviewing the Local Development Plan(LDP)andincludesthefollowing:-

• AnupdatedprogrammeandtimetableforpreparingandpublishingtheLDP. • AParticipationStatement,whichsetsoutstakeholderinvolvementintheLDPi.e.when,howandwithwhom,consultationwilltakeplace.

TheproductionofanannualSchemeisarequirementofScottishGovernment.IthasbeenpublishedatthistimetoenableyoutolearnabouttheLDPtheCouncilispreparingandhowyoucangetinvolvedandalsotohelpfocuseveryoneonwhatisinvolvedingettinganuptodateplaninplaceasquicklyaspossibleasrequiredbyScottishGovernment.

2. The Current Local Development Plan

ThecurrentLocalDevelopmentPlanwasadoptedin2014.ThefirststageofthatPlan,theMainIssuesReport(MIR),waspublishedinMay2010.TheperiodfollowingthepublicationoftheMIRwasthemainopportunityforconsultationandengagementontheformulationofthePlan,andinthattimeweundertookanumberofdifferentparticipationactivities.ADraftPlanwaspublishedinOctober2011inordertogaugeopiniononitscontentasadraft.InOctober2012,theProposedPlanwaspublishedandconsultedupon.ExaminationoftheunresolvedrepresentationstoProposedPlantookplacefromJuly2013toMarch2014withtheModifiedPlanadopted in autumn 2014.

AnonlineversionofthecurrentPlanisavailableontheLDPwebpageat:www.stirling.gov.uk/localdevplan. ThisenablesmapsthatrelatetotheplansuchasGreenBelt,LocalLandscapeAreas,ConservationAreasetc.,tobeviewedinmoredetail.

AlegalchallengetotheadoptedPlanhasbeenlodged,howeveruntiltheoutcomeofthisprocessisknown,itremainsthedevelopmentplaninforcefortheStirlingCouncilPlanningAuthorityArea.

WorkiswellunderwaytoreplacethecurrentLDP.Planningauthoritiesarerequiredtohaveanuptodatedevelopmentplanandensurethatthisisreplacedatleastevery5years.Howevertoaddressapotentialshortfallinhousinglandsupply,StirlingCouncilisprogressingwithareplacementPlaninadvanceofthistimescaleandaimstohavethisinplacebyDecember2017.

4. How can I get involved in the LDP preparation?

Wehaveproducedaparticipationstatementatsection6,settingoutwhen,howandwhomwillbeinvolvedinthepreparation of the plan.

Why engage others in preparing the LDP?

Theplanningsystempromotes,facilitatesandregulatesdevelopmentinthepublicinterest.Theimpactofdevelopment,muchofwhichisirreversible,onthelivesofindividualsandcommunitiescanbeverysignificantdependingonitsnature,scaleandlocation.AsthePlansetsthecontextwithinwhichnewdevelopmentcanhappen,itisimportantthateveryoneaffectedhasanopportunitytoinput.Avarietyofgroups,organisationsandindividualswillthereforehaveaninterestinthePlan,andwillbegiventheopportunitytoinfluencethesurroundingsinwhichtheylive,work,shopandplay.

Who should participate?

Everyonehastherighttocommentonaproposeddevelopmentthatislikelytoaffectthem.ItisimportantthereforethateveryonewhowantstohaveaninputintothepreparationofthePlanhastheopportunitytodoso.Itisalsoimportantthatthosewhoarehardertoreach,anddonotnormallycommentonplanningmatters,arealsogiveneveryopportunityandassistancetoinputintotheprocess.Ourapproachistotargetthosemostaffectedbytheproposalsinthe Plan i.e. communities of interest (people who share a common interest).

Why should you participate?

ParticipationinthePlanprocesscanhelpshapeyourfuturesurroundings.Participationcannothoweverguaranteethateveryonegetstheoutcomestheywant,butitisimportantthatthebasisandjustificationforpoliciesanddevelopmentproposalsinthePlanaremadeclearandtransparent.Effectiveengagementwillensurethatpeoplearemadeawareoftheproposalsasearlyaspossible,havethefactstoallowthemtocontribute,havetheopportunitytomaketheirviewsknownandgetexplanationsofhowandwhydecisionsaremade.

5. OtherAssessments which support the LDP

VariousassessmentsoftheLDPwillbecarriedoutinordertoensurethatthecorrespondingaimsaretakenaccountofinthePlan.Theseassessmentsarestatutoryrequirementsarisingfromgovernmentlegislation.

Strategic Environmental Assessment

TheEnvironmentalAssessment(Scotland)Act2005requirestheCounciltoconsiderallpolicies,plansandprogrammesforStrategicEnvironmentalAssessment(SEA),aswellasalterationstoandreviewsofexistingplans.ThepurposeoftheSEAEnvironmentalReport,inreportingtheoutcomesoftheassessmentistoidentify,describeandevaluatethelikelysignificanteffectsontheenvironmentofimplementingthePlan,andtocomparethesewiththeequivalentpotentialeffectsofimplementingthepolicyapproachbymeansofreasonablestrategyoptions.

ASEAEnvironmentalReportwillbepublishedalongsidetheProposedPlan.TheSEAexerciseiscarriedoutinconsultationwiththethreeagencies–ScottishEnvironmentProtectionAgency,ScottishNaturalHeritageandHistoricScotland.

Habitats Regulations Assessment

TheConservation(NaturalHabitats,&c.)Regulations1994,asamended,requiresthepotentialeffectsoftheProposedPlanon‘Europeansites’tobethesubjectofaHabitatsRegulationsAppraisal(HRA).Whereitisnotpossibletoruleouttheriskof‘significanteffects’relevantaspectsofthePlanandsupplementaryguidancewillanrequire‘appropriateassessment.’TheCouncil,ascompetentauthority,shallagreetothePlanonlyafterhavingascertaineditwillnotadverselyaffecttheintegrityofanyEuropeansite,bothwithinandoutsidetheareaofthePlan.AreportdetailingthisprocesswillbepresentedalongsidetheProposedPlan.

Equality Impact Assessment

TheEqualityAct2010introducesadutyonpublicbodiesandotherscarryingoutpublicfunctionstoensurethattheyconsidertheneedsofallindividualsintheirday-to-daywork–inshapingpolicy,indeliveringservices,andinrelationtotheirownemployees.ThepoliciesandproposalspresentedintheProposedPlanhavethereforebeenconsideredundertheCouncil’sEqualitiesImpactAssessment(EqIA)process,andsubjecttoanEqIARelevanceCheck(attachedasanappendixtothereporttotheCouncilon30June2016)tohelpdeterminewhetherornotanEqualityImpactAssessmentisrequiredandprovidearecordofthedecision.Takingaccountoftheaimsandoutcomesandthoselikelytobeaffecteditwasconcluded,forthereasonsgivenintheRelevanceCheck,theProposedPlanwouldnothaveanypotentialimpactsonpeoplewith“protectedcharacteristics”

6. Participation Statement

ThereviewoftheStirlingLocalDevelopmentPlan(LDP)requirestobeaccompaniedbyaParticipationStatementwhichsetsoutthelevelofstakeholderinvolvementthatwilltakeplaceinpreparingthePlani.e.when,how,andwithwhom,consultationwilltakeplace.

TheScottishGovernmentsuggeststhefollowingcharactersofengagementareappropriateateachstageoftheLDPprocess.

Learning from previous consultation

FeedbackonthepreviousconsultationexerciseinpreparingthecurrentLDPhasbeenanalysedandusedtoinformthecurrentengagementstrategy.Figure2belowsummarisesthekeypointsfromtheanalysis.

What was done well68%ofrespondentsdescribedtheevents(Roadshows,dropinsessions,etc.)asusefulorveryuseful.

GoodtoheardirectfromtheCouncilandhaveofficersavailabletoanswerqueries.

Mostpeoplesatisfiedwiththeprocessasit was made clear including timescales.

What needs to be improvedEventsneedmorepublicity. Consultationshouldavoidholidayperiods

suchasSummerandChristmas.Need to review how information is presented as 52% of respondents said it wasdifficult/confusingtofind.

General feedback to improve consultationMorepublicevents. Shouldmakeuseofsocialmedia. Don’tforgetaboutthosewhodonothave

webaccess.

Totakeaccountofthefeedback,whilstalsorecognisingthatthereplacementLDPismuchmorefocusedonparticularissuesthanthecurrentadoptedLDP,thefollowingactionswillbetaken:-

• Publiceventssuchasdropinsessionswillcontinue.However,thesewillbemorefocusedonthosecommunitiesmostimpactedbydevelopmentproposals.

• TherewillbeasocialmediapresenceviaourCouncilFacebookandTwitterpagestoadvertisemorewidelyLDP events and timescales.

• TheLDPtimescalenecessitatesthatconsultationwillberequiredinsummer2016,howevertoallowmaximumopportunityforcomment,theminimum6weekperiodrequiredwillbeextendedtoalmost11weeksendingon23rdSeptember2016.

• TheLDPwebpagewillbeconsistentlyreviewedtoensurethatinformationispresentedinaclearandlogicalmanner.

SP=EED™

ToensurethattheCouncil’sengagementiseffectiveandappropriate,theSP=EED™(SuccessfulPlanningequalsEffectiveEngagementandDelivery)methodofengagementadvocatedbyPlanningAidScotlandwillguidetheapproachtakenbytheCouncil.

TheSP=EED™programmehasbeenspecificallydesignedforconsultationprocessesinplanning.TheprogrammeisreferredtoinPlanningAdviceNote3/2010asabenchmarkingtoolforcommunityengagementinplanning.Additionally,oneofficerfromtheplanningteamhasundertakentrainingtobecomeSP=EED™verifiedtoenhancethequalityofengagementbytheCouncilonplanningissues.

ThediagramsbelowsetouthowStirlingCouncilintendstoengagewithstakeholdersintheLDPprocessateachstage,consistentwiththeadvicefromScottishGovernmentandPlanningAidScotland.

Figure3summarisesthe8criteriaforeffectiveengagementintheplanningprocessandwhatshouldbeaimedforatlevels 1 and 2 of engagement. Level 1 engagement is termed ‘informing’ and is used when information is released butnotnecessarilyforcomment.Level 2 engagement is termed ‘consulting’ and is used when comment and participation is invited. The aims at Level 2 are in addition to those at Level 1.
