Article V SCIENTIFIC AND TECHNOLOGICAL CO-OPERATION·

The High Contracting Parties commit themselves to establish direct co-operation links through the Executive Secretariat and/or relevant international organizations in the field of science and technology. Fur­thermore, they shall endeavour to exchange information and data related to the corllliiance of the objectives set forth in this Protocol.

Article VI EXCHANGE OF INFORMATION

The High Contracting Parties undertake to exchange amongst themselves information and to make H available to the Executive Secretariat on the following subjects:

a. Programmes or projects dealing with scientific and technical ass1tance or otherwise amongst the Parties, comprising some of the following aspects: .. - Training of scientific and technical personnel - Supply of equipment and services "", ••• ~ > '''1 - Consunancy on assessment and 5~ FVe i ll ange programmes

b. Research Projects under way in search of new methods and techniques to adequately treat radioactive wastes and other matters.

d. Actions taken, resuhs obtained and difficunies encountered during the application of this Protocol.

Article VII SURVEILLANCE PROGRAMMES

On their own behalf, or in co-operation with the Executive Secretariat or relevant internationat organiza­tions, the High Contracting Parties shall design individual or joint programmes of surveillance comprising the geographical areas covered by this Protocol. To this effect, the High Contracting Parties shall appoint those authorities to be responsible for surveillance practices within their own sovereign and jurisdictional boundaries. Furthermore and insofar as H may be deemed appropriate, the H!ph Contracting Parties shall enter into international agreements regarding those geographical areas~He~eyOnd their sovereign and jurisdictional boundaries.

Article Vtll CO-OPERATION IN CASE OF EMERGENCY

On an individual or joint basis, the High Contracting Parties shall encourage the setting up of emergency programmes wtth a view to avoid the ocurrence of any event related to the noncompliance of estipulations banning the disposal of radioactive wastes at sea as enacted in Article II of this Protocol.

To this effect, the High Contracting Parties shall have access to the devices, including expertise and equipment, as may be deemed necessary, to adequately comply wtth programmes as scheduled.

Articte IX TRAtNtNG PROGRAMMES

The High Contracting Parties shall endeavour to design and carry out training programmes to upkeep a high degree of efficiency as far as regional co-operation efforts referred to in this Protocol are concerned.

Anlcle x MEASURES TO BE TAKEN IN CASE OF FORCE MAJEURE

",~.J JL..-.d In case of force majeure, to safeguard human IHe and to protect vessels, aircraft, offshore platforms and other Installations from the eventual shedding of radioactive wastes or any other radioactive matter at sea wnhin the area covered by this Protocol, the High Contracting Parties shall make all necessary efforts to Immediately seek to minimize the effects of pollution on the marine environment.

To this effect, the High Contracting Parties bind themselves to co-ordinate access by all concemed to communication devices at their disposal in order to ensure the timely reception, transmission and dissemination of information on emergency measures as may be adopted. Simunaneously, data collected shall immediately be made known to those Contracting Parties whose terrnories may be adversely affected by pollution.

Anlcle XI ENACTMENT OF LAWS AND REGULATIONS

Each Contracting Party binds ~se lf to ensure the compliance of the provis ions stipulated in this Protocol and to adopt the necessary actions to prevent, or impose penalties on, any activ~ which fails to abide by the wording of this Protocol.

Article XIII EXECUTIVE SECRETARIAT

For purposes of managing and implementing this Protocol, the High Contracting Parties agree to appoint the Permanent South Pacific Commission (CPPS) as Executive Secretary of this Protocol. At their first meeting, the High Contracting Parties shall work out the methodology and financial mechanisms for the canrying out of the activity on the part of the Commission.

Article XIV MEETINGS OF THE HIGH CONTRACTING PARTtES

The High Contracting Parties shall hold ordinary meeting every two years. Extraordinary meeting shall be convened at any time, whenever two or more Parties so request the holding of such a meeting. At their ordinary meetings, the High Contracting Parties shall study the following subjects, amongst others:

a. The degree of compliance of this Protocol and the effectiveness of actions undertaken. Also, they shall look into the need to develop _ other typesof activities in compliance with the aims of this Protocol.

b. The need to amend or modify this Protocol and its Annex and the~;~~-to. enlargior modiiy'7 resolutions enacted by virtue of this Protocol.

c. The il1l>lementation of surveillance, training and emergency programmes, and,

d. The development of any other acitivity which may be beneficial in the achievement of the aims sought after by this Protocol.

Article XV ENFORCEMENT

This Protocol shall enter in force once sixty (50) days have elapsed from the date the Third Ratffication

This Protocol could be denounced by any 01 the High Contracting Parties once two (2) years have elapsed hom the date of its 9flle~ tor the Contracting PartiM denouncing It .

The denunciation shall be made effective by means of wrttten notice addressed 10 the Executive Secretary who shall immediately make ;.t known to the High Contracting Parties.

The denunciation shall be effective once 180 days have elapsed from the date of the above mentioned wrttten notice.

Al1lcle XVII AMENDMENTS

This Protocol shall&r:!Jbe modified/ by the ~nanimous agreement of the High Contracting Parties. Mod~icatlons shall be subject to ratilicalion and shall enter in force once the Third Rat~icalion Agreement has been deposited with the Executive Secretariat of the CommiSSion.

Al1lele XVIII ADHERENCE

This Protocol shall be open to be endorsed by any Coastal State sited on the South East Pacific upon having been unanimously invited to do so by the High Contracting Parties.

Endorsement of this Protocol shall be performed once the tnstrument concemed has been depostted with the Executive Secretariat who shall inform the High Contracting Parties a=rdingly.

Forthe adhering State, this Protocol shall enter in force sixty (60) days alter the relevantdorument has been depostted with the Executive Secretariat of the Commission.

Al1lele XIX RESERVATIONS

~ This Protocol shall be subject to no limitation whatsoever.

" Written in six (6) copies of the same nature, one of which shall be deposited wtth the Secretary General of the Permanent South Pac~ic Commission and all of which shall be equally legally binding insofar as their application and interpretation is concerned.

IN WITNESS THEREOF, Plenipotentiary Representatives duly authorized by theirGobemments, endorse this Protocol.

Igualmente, las Altas Partes Contratantes acuerdan prohibir todo ente­rramiento de desechos radiactivos u otras s ustancias radiactivas en el s ubsuelo del mar dentro del ambito de aplicaci6n del presente Convenio •

MEDIDAS EN CASO DE FUERZA MAYO

Si por causa e uer za mayor, a fin de sal vaguardar la seguridad de la vida humana 0 de buques, aeronaves, plataformas u otras construcciones en el mar se produjere un vertimiento de desechos radiactivos u otras sustancias radiactivas en el ambito de aplicaci6n del presente Convenio , l a s Altas Par tes Contratantes cooperaran, en la medida de ~ lo· :·. posi ble, para reducir de inmedia to el peligro de contaminaci6n del medio marino.

Para tal fin, las Altas Partes Contratantes se comprometen a coordinar el uso de los medios de comunicaci6n de que disponen, con el prop6sito de asegurar la oportuna recepci6n , transmisi6n y difusi6n de toda informa­ci6n sobre estas medidas de emergencia .

La informaci6n que se obtenga sera inmediatamente comunicada a las Partes Contratantes que puedan vers e afectadas por el peligro de con t aminaci6n.

ENl-IIENDAS

Articulo XVII El presente Convenio solo podra ser enmendado por la una nimidad de las Altas Partes 'contratantes . La s e nmi e ndas estaran s uj e tas a ratifi cacion y en traran en vigencia en la fecha de deposito del tercer instrumento de ratificacion en la Secretaria Ejeeutiva .

ADHESION

Articulo XVIII Este Convenio estara abierto a la adhesion de cualquier Estado ribereiio del Pacific; Sudeste a invitacion unanime de l as Altas Partes Contratan- ­tes .

La adhesion se efectuara mediante un deposito del respectivo instrumento en la Secretaria Ejecutiva, que 10 comunicara a las Altas Partes Contra­tantes .

El presente Convenio entrara en vigencia para el Estado que adhiera , despues de 60 , H as e el deposito del r espectivo instrumento.

RESERVAS

Articulo XIX El presente Convenio no admit ira reservas.

Hecho en seis ejemplares del mi smo tenor, uno de los cuales se depositara en la Secretaria General de la Comision Perma nente del Pacifico Sur, todos igualmente validos para efectos de su aplicacion e interpretacion .

En fe de 10 cual los Pleni potenciarios, debidamente autorizados por sus respectivos Gobiernos , suscriben el presente Convenio .
