DIVERSITY IN MOTION

www.duanemorr is .com

It has been a great privilege

for me to be a part of Duane

Morris since 1997. At that

time, Nolan Atkinson Jr.

needed a senior associate to

assist on several signifi cant

matters and I was brought in

to work under him. Nolan inspired me and helped me

develop as a lawyer. At that point, of course, I could

not imagine that I would have the honor of becoming

Chairman of this great fi rm years later. It was, however,

no surprise that Nolan’s leadership was called upon to

establish the role of Chief Diversity Offi cer at Duane

Morris, and then be called upon to repeat that success

as the city of Philadelphia’s fi rst ever Chief Diversity

and Inclusion Offi cer. Working now with Joe West, I am

proud to say that we have developed our Diversity &

Inclusion program into one of the most innovative and

recognized programs in the legal industry.

A key reason for our success in a challenging area

is how we approach diversity and inclusion. Simply

hiring more diverse attorneys will not move the

needle unless the issues that cause so many diverse

attorneys to leave law fi rms are addressed. Much of

2018 was focused on developing a strategic plan that

would establish systemic, fi rmwide changes to drive

a higher performing culture that specifi cally includes

diversity. We are committed to both hiring marquee

diverse talent and making Duane Morris the obvious

choice for such outstanding diverse lawyers. To do

so, we are implementing programs that help ensure

our diverse attorneys have opportunities and training

to lead in their practice groups, industry teams and

offi ces. Importantly, we are also addressing issues

of implicit bias with changes to processes, instead of

only focusing on changing perceptions and behaviors.

By using systems and programs that examine how

assignments are given, we can reduce and eliminate

the unconscious biases that often prevent diverse

attorneys from receiving the work assignments they

need to succeed at a law fi rm. We can ensure that

our diverse and female attorneys have the critically

important opportunities for high value, highly visible

work that drives career success and satisfaction.

We all have a stake in the success of our fi rm, and I

know that the culture of high performance that we

want to create and maintain depends on both the skills

and diversity of our people. It also depends on how fi rm

leadership takes responsibility for how well these plans

are executed, which is why we are holding ourselves

accountable for achieving the goals we set forth. We

understand that our plan is aspirational and that we

will need to refi ne and redouble our efforts to reach

those goals. I am proud and confi dent that we are on

the right track and that we have the culture and people

to realize this mission-critical aspect of our strategic

plan, and we are excited to see it unfold!

attorneys to engage with affi nity bars, we see our

robust approach to diversity and inclusion not just as a

critical part of the DNA of the fi rm and essential to our

business, but also as central to our every interaction

with each of our clients. It allows us to engage with

existing and prospective clients, with existing and

prospective employees and with every aspect of our

public engagement where we consistently emphasize

that diversity and inclusion is part of the fabric of our

fi rm and that it informs every aspect of our internal and

external relationships. We hope you enjoy this annual

illustration of how critical diversity and inclusion are to

our business.

As client expectations around diversity intensify and

their tools for discerning compliance become more

fi nely honed, it's ironic that many fi rms adopt a “hands

off” approach to client engagement around diversity

that is distant at worst and sterile at best. As our 2018

Annual Diversity & Inclusion Report proudly shows, at

Duane Morris our approach is the exact opposite.

From our annual Diversity & Inclusion Retreat and

Vashon Lecture, to the diversity segment at our

annual fi rmwide Fall Meeting, to our unique and

very successful Diversity and Inclusion Consulting

Practice, to the numerous opportunities for all of our

Diversity & Inclusion Metrics

While progress toward greater diversity among our attorneys is a key goal for Duane Morris, realizing this goal has been

challenging for us and the legal industry at large. The reasons are varied and complex, and include systemic, historical

inequities and the pervasiveness of implicit bias. There’s also the simple fact that the industry has not been signaling

and showcasing its successes in recruiting and retaining diverse lawyers. Still, despite these ongoing challenges, we see

evidence that the fi rm’s strategy is moving us toward becoming a more diverse and inclusive law fi rm, one that can lead the

way for others. As part of the fi rm’s strategic initiative, diversity is now a key metric that is tied to our activities and is being

addressed in a systemic manner.

The Duane Morris Diversity and Inclusion

Consulting Practice: A Unique Service from

Duane Morris to Help Clients Achieve

Best Practices in Diversity and Inclusion

As diversity and inclusion (D&I) has become a leading

challenge for businesses and other organizations, a critical

gap has widened between the need for information

and training and actual organizational preparedness.

Consequently, many companies are left vulnerable to

negative impacts ranging from underperformance in

productivity, recruiting and retention, to adverse business

results, reputational damage, and regulatory and legal

issues including EEOC complaints and shareholder

derivative actions.

To help clients recognize such potential threats, adopt

appropriate best practices and evolve organizational

capabilities, Duane Morris provides a comprehensive suite

of consulting, legal and training services under our Diversity

and Inclusion Consulting Practice. Duane Morris is distinct

among large law fi rms in offering clients these services, as

well as in differentiating from HR consultants by virtue of

attorney-client privilege—a particularly valuable attribute

since actionable issues are often unearthed in the course

of an engagement.

Our Diversity and Inclusion Consulting Practice, comprised

of our foremost employment lawyers and D&I experts,

works closely with company leadership to understand

business culture and goals, implementing a two-phase

process to: a) assess organizational strengths, weaknesses

and competencies; and b) develop and implement a custom

program aimed at achieving the benefi ts of best practices.

Clients include a leading fi nancial services company,

a National Football League team, a national insurance

industry group association and others. Some clients have

engaged our team for a single-day, board-level information

and training session, while for others we have done a

top-to-bottom sweep from the C-suite through operating

executive levels to front-line supervisory personnel and the

entire work force. To learn how your company can leverage

our training, please get in touch with Chief Diversity and

Inclusion Offi cer Joe West at [email protected] or

202.776.7806.

What our clients are saying about the

Duane Morris Diversity and Inclusion

Consulting Practice:

>>>

“The segment on unconscious bias was

outstanding.”

>>>

“Continuously think about diversity and

how it positively affects the workplace.”

>>>

“Diversity has many more facets than

I originally thought.”

>>>

“Diversity is key to helping us get where

we want to be.”

>>>

“Evaluate my thoughts and opinions for

implicit biases; don't assume.”

>>>

“We all have to be aware of unconscious

bias that exists within us.”

Diversity and Inclusion Retreat

Each spring, diverse attorneys, fi rm leadership and others

from across the fi rm attend the annual Duane Morris

Diversity and Inclusion Retreat to share their experiences

at the fi rm and delve into topics including retention issues,

Q&A sessions on matters that affect minority attorneys and

panels on marketing and business development strategies.

In 2018, the retreat featured the theme of Diversity Through

the Looking Glass: Seeing What Our Clients See. Lisa Helem,

Editor in Chief of The National Law Journal, delivered the

keynote speech. Panels included:

>>> What's the Code? The Keys to Tech Sector

Success for Diverse Lawyers

>>> What They're Seeing and What They're Doing

>>> Bank on It! –The Changing Landscape in the

Financial Services Sector

>>> The Importance of LGBT Awareness

For the 2018 Vashon Lecture, the fi rm presented the panel

discussion From Lean In to Time’s Up—The Corporate and Legal

Landscape for Women. With introductory remarks by Duane

Morris Chairman and CEO Matthew A. Taylor, the keynote

speech by Stephanie Scharf, Chair of the ABA Commission

on Women in the Profession, and Joseph K. West serving

as moderator, the panel featured Deborah DeHaas, Vice

Chairman and National Managing Partner, Deloitte; Sandra

A. Jeskie, Partner and Women’s Impact Network for Success

(WINS) Chair, Duane Morris LLP; Deborah Elam, Retired

Chief Diversity Offi cer and President of the GE Foundation,

General Electric Company; and Stephanie Scharf.

Establishing an Effective Neurodiversity

Employment Program: Legal Issues

On August 22, 2018, Microsoft, SAP and Duane Morris LLP,

in conjunction with Autism Speaks and the Cornell University

Yang-Tan Institute on Employment and Disability, presented

an innovative program on the legal issues that employers

face when creating a neurodiversity program. In 2013,

SAP established its Autism at Work program, a structured

program to hire and retain adults on the autism spectrum.

In the years since, the SAP program has grown and other

major employers have established their own Autism at

Work programs, including Microsoft, JPMorgan Chase &

Co., Freddie Mac, Ford, EY and DXC Technologies. These six

employers and SAP also recently formed an Autism at Work

Employer Roundtable. Further, more than 50 other U.S.

employers have programs in various stages of development.

Encouragingly, a recent Autism at Work summit hosted by

Microsoft brought companies from throughout the country.

For companies interested in developing an Autism at Work or

related neurodiversity program, there are some legal issues

that need to be addressed. Duane Morris attorneys James

Brown, Michael Bernick and Linda Hollinshead, along with

SAP attorney Deborah Dee, discussed the key legal issues

in establishing an effective employment program for adults

with autism and other neurodiverse conditions. David

Kearon of Autism Speaks and Professor Susanne Bruyere

of Cornell University explained how these issues fi t into the

neurodiversity employment movement nationwide.

that assessed how supportive the nation’s top law fi rms and

corporations are of their LGBTQ employees. HRC evaluates

survey respondents in four areas: anti-discrimination policies

for sexual orientation, gender identity and expression;

equitable benefi ts for LGBTQ workers and their families;

internal education and accountability for LGBTQ inclusion;

and public treatment of the LGBTQ community.

Duane Morris is a founding sponsor of

Philadelphia’s Equality Forum and a

leader among major fi rms in its early

of the top places to work for LGBTQ

attorneys, as noted in its annual recognition, Raising the Bar.

Immigration Equality (IE)

Immigration Equality is the nation’s

leading LGBTQ immigrant rights

organization. Chicago Partner Paul

Coyle is a board member for IE. Duane Morris supports

IE’s mission by regularly representing individuals seeking

asylum in the United States fearing persecution in their

home country as a result of their sexual orientation.

DUANE MORRIS GOES PURPLE IN SUPPORT OF LGBT YOUTH

Every year on Spirit Day, Duane Morris turns its website purple to support

LGBT youth and the Gay & Lesbian Alliance Against Defamation's (GLAAD)

anti-bullying campaign. The Daily Report's ATLaw blog recognized that

Duane Morris led the way among law fi rms in this consciousness-raising

effort, being the only fi rm listed as a participant as far back as 2012.

Since then, other law fi rms have joined Duane Morris and the many well-

known companies who pledge to go purple each October. Duane Morris

attorneys are active in organizations that support LGBT inclusion, from

the workplace to the broader community.
