SECTION I: AUTHORITY TO ACT

“Florida State Statutes: 720.3035 Architectural control covenants; parcel owner

improvements; rights and privileges.”

(1) The authority of an association or any architectural, construction improvement, or other such similar committee of an association to review and approve plans and specifications for the location, size, type, or appearance of any structure or other improvement on a parcel, or to enforce standards for the external appearance of any structure or improvement located on a parcel, shall be permitted only to the extent that the authority is specifically stated or reasonably inferred as to such location, size, type, or appearance in the declaration of covenants or other published guidelines and standards authorized by the declaration of covenants.

“Dupree Lakes HOA By-Laws, Article X - Committees” The Board may appoint a committee or committees as deemed appropriate in carrying out its purpose.

“Dupree Lakes HOA Covenants and Restrictions, Article IX - Architectural Control” Except for those improvements constructed by Declarant, ( B e a z e r ) no building, garage, shed, fence, wall, statue, yard ornament, mailbox, newspaper box, dock, or other structure shall be commenced, erected, or maintained upon the Property, nor shall any exterior addition to, change, alteration or repair (other than repairing or restoring the exterior of any building located upon the Property to its original appearance and color) therein be made until the plans and specifications showing the nature, kind, shape, height, color, materials and location of the same shall have been submitted to and approved in writing by the Board or by an architectural committee appointed by the Board.

The Board may promulgate design and development guidelines, application and review procedures, and building criteria (the "Guidelines"). The Guidelines shall be promulgated on behalf of the Association and shall be binding upon all Owners, builders, developers and contractors. The Board shall have sole and full authority to prepare and to amend, from time to time, the Guidelines.

ARCHITECT & LANDSCAPE REVIEW COMMITTEE MISSION & FUNCTIONS

A. Mission:

To ensure that the development of the Property will proceed pursuant to a uniform plan of development and construction, with consistent architectural and landscape standards designed to create, maintain, preserve and protect a unique, attractive and harmonious physical environment in compliance with the Association’s Official Documents and the Board-approved A&LRC Guidelines, as well as for meeting property value improvement goals.

B. Functions:

1. Establish, develop and maintain a uniform plan of development and construction with consistent architectural and landscape standards.

2. Review, approve and control the design and construction of all improvements of any kind to owner properties within Dupree Lakes.

3. Prohibit those uses or activities inconsistent with the provisions in the Association’s Official documents, or as determined by the A&LRC to be contrary to the best interests of other residents of the Property in maintaining the value and desirability of the Property as a residential community.

4. All reviews undertaken by the A&LRC, and their subsequent decision relating thereto, shall take into account (i) the objectives and purposes of the Association’s Official Documents, (ii) the purposes and function of the A&LRC, (iii) the type, nature, design, style, shape, size, scale, color, quality, quantity, texture and materials of the proposed structure or other improvement under review, (iv) its compatibility and harmony with other nearby structures, (v) its relation to the topography and other physical characteristics of its proposed location, and (vi) the character of the community in general.

5. Create and maintain the procedure for review and approval of plans, reasonable rules and regulations governing the submission of plans and specifications to the A&LRC, and its subsequent review and approval of same, as well as, a process for appeals.

6. Schedule and post in the Standard location the date, time and location of “as-needed” meetings and inform the President of the HOA Board thereof.

7. Approve or disapprove any plans, specifications or other materials submitted to it within thirty (30) days after the same have been duly submitted to the Management Company or A&LRC in compliance with the Association’s Official documents.

SECTION III POLICY AND STANDARDS

A. Purposes

The A&LRC will use the Architectural Review Policy, Standards and Guidelines as the basis for their review of projects. The guidelines are the foundation of approval by the A&LRC and set in place the general parameters and limits under which both the A&LRC and property owner work, for the betterment of individual properties as well as the whole of the community. The A&LRC may also consider the merits and ascetic appeal of a project.

B. Homeowners responsibilities pertaining to the CCRs, A&LRC Standards and Guidelines

Dupree Lakes is a community of single-family homes and as such property owners (and their rents/lessees) are responsible for maintaining their properties in a condition consistent with common standards and as define in the Official Documents of the Association.

All Dupree Lakes property owners agreed to abide by the Official Documents of the Homeowner’s Association, that are designed to maintain the quality of the community and the property values of fellow members, when buying their property. All residential property owners within the community are required to submit plans and obtain prior A&LRC/Board approval for all exterior architectural construction, additions, modifications, including repainting and landscaping alterations exceeding 33% of total existing landscaping area.

Periodic inspections of all properties will be made by the Association and/or its agent (Management Company) to verify that all properties are meeting these standards. Properties that fail to be in compliance with the CCRs and A&LRC Guidelines, will be subject to corrective action. This action may included the addition of fines and/or legal action in the form of liens (and possibly foreclosure) to enforce correction of the violation. (For further information, see the Violations, Fines and Liens Process.)

C. Submission for Approval Procedures

2. ApprovalApproval cannot be granted until all plans are properly submitted and reviewed by the

A&LRC. All construction plans, tree placement, children’s playhouses, pools, extended porches/lanais, fencing or screening require drawings, to scale, for location and size on the homeowner’s property survey. If the plan is approved, the homeowner will receive a letter (or email) from the Management Company or the A&LRC Chairperson. If a plan has multiple areas that will require subsequent submissions, the A&LRC may review and approve those portions of the plan that can be approved and have no questions or need resubmittal. Conditional approval may be given on projects for example that require more information; however, commencement of that project may only happen after final approval.

3. Change of Plans:

If a homeowner would like to change their plans after approval, they will need to resubmit the changes on the A&LRC form found on the website. Approval must be received on all changes prior to commencement of the project.

4. Resubmission:

The A&LRC may attempt to contact members to clarify information in the submission and may require resubmission.

5. Meetings:

The A&LRC generally meets, as necessary, to review submissions. The meetings will be posted on the website and on signage at the entrances of Dupree Lakes Subdivision, same as HOA Board meeting and Member meetings. Members who have submitted application are encouraged to attend to reduce the time required for approval.

D. A&LRC, HOA and Management Company Disclaimer

Review and approval of plans and specifications submitted is made on the basis of aesthetic considerations only and the A&LRC shall not bear any responsibility or liability for ensuring the structural integrity or soundness of approved construction or modifications, nor for ensuring compliance with building codes or other governmental requirements. The A&LRC and its members shall not be held liable for any injury, damage or loss arising out of the manner or quality of approved construction, modifications or project results. The property owner shall be solely responsible for determining whether the improvements, alterations, or additions described in the submission comply with all applicable laws, rules, regulations, codes and ordinances; including without limitation, zoning ordinances, subdivision regulations and building codes. Homeowners are responsible for obtaining any and all required permits for work on their property. Neither the Dupree Lakes Homeowner’s Association, Inc., nor the Management Company are required to take any action to repair, replace or maintain any such approved changes, alterations or additions or any structure of any other property. The homeowner and their assigns assume all responsibility and cost for any addition or change and its future upkeep and maintenance.

SECTION IV PROPERTY MAINTENANCE AND LANDSCAPING

A. General• By Florida Statue, homeowners are allowed to implement a Florida-Friendly Landscaping Plan for

their entire yard; however, homeowners must still apply to the A&LRC for approval.

• All property improvements shall at all times, be kept and maintained in a safe, clean, and attractivecondition and shall not be allowed to deteriorate, fall into disrepair or become unsafe or unsightly.

• No weeds, underbrush or other unsightly growth and no trash, rubbish, refuse, debris or unsightlyobjects of any kind shall be permitted or allowed to accumulate on any property.

• Including the landscaping on their lot, owners are responsible for maintaining their property on theland area between the sidewalk and street: grass, irrigation system, mailbox, sidewalk, drivewayapron, etc.

B. Lawns

• Types of Sod: Homeowners must use an acceptable Florida Friendly turf on the front and sideyards to the back corner of the house or the back property line of side streets. Grass must extendinto the area between the sidewalk and street. All grass replacements of any Florida Friendly grassdo not require approval; however, the maintenance of the grass must follow A&LRC guidelines.

• Proper Lawn Maintenance: Proper lawn maintenance is vital for the long-term health of your lawn.Appropriate mowing and watering practices must occur so yourlawn will have a healthy root system and be more drought-tolerantand be able to resist pests and disease.

• Yellow, Brown or Dead Areas: All yellow, brown or dead lawnareas must be treated or replaced immediately. These areas indicatethat perhaps lack of grass nutrients, overwatering or other problemsare present. Brown areas may indicate a mole cricket or chinch buginfestation that may impact adjacent lawns. Consult a landscapeprofessional.

• Storm Drains, Ditches, Wetland Areas and Roadways: Keep grassclippings, vegetative material and vegetative debris away fromstorm drains, ditches, water bodies and roadways. No dumping orblowing debris after mowing into these areas is allowed.

C. Lawn Care

Mowing

• Length of Grass: Grass must be cut to approximate the SWFWMDguidelines and must not exceed six inches (6”).

• Mow Height: Mow at the highest height for your grass species. Seechart for specific types. Mowing at lower heights can result in a shallow root system.

• Mower Blades: Keep your mower blades sharp. A dull blade tears the grass blades, making thegrass unattractive and prone to insect or disease invasion.

Helpful Hints: It is recommended that you do not mow when lawn is wet. This is dangerous for you, tough on the mower and bad for the grass. Never remove more than one-third of the leaf blade at any one time. Cutting too much of the leaf blade can stress your lawn.

Watering

• Irrigation Times: All irrigation must follow County-watering rules. Irrigate after midnight tillaround sunrise or after 6 pm. You want the leaf blades to dry out fully during the day.

• Deeper Root Growth: Do not apply water to just wet the top of the soil; this will result in ashallow root system. Apply enough water to encourage deeper root growth.

Irrigation Systems

• Installation: More lawns are damaged by improper irrigation practices than by any otherpractice. All homeowners are responsible for maintaining their irrigation systems in goodworking order.

• Rain Sensors: It is highly recommended that all irrigation systems have working rain sensors tooverride the system when enough rain has fallen. Check your rain sensor to see if it is installedcorrectly and still working on an annual basis.

• Broken Sprinkler Heads or Spewing Water: Broken sprinkler heads and heads that are spewingwater should be repaired immediately. Sprinkler heads are easily misaligned or broken, whichcan lead to improper water application to your lawn and may waste water as runoff. Inspectyour irrigation system regularly.

D. Landscaping other than Lawns

Properties that have the Reclaimed Watering System

Angelonia Terrace, Wood Violet Court and Cherokee Rose Place all have reclaimed water for outside watering use. This is NON-potable water identified by pink coloring of materials used.

Helpful Hints for areas with Reclaimed Water: Salt concentration in Pasco County’s reclaimed water is variable but falls in the 100 to 400 ppm range. Various types of landscape plants commonly used in Central Florida, such as Azaleas (Rhododendron sp.) and crape myrtles (Lagerstroemia sp.), are especially sensitive to high salt levels. If chloride salt concentrations exceed 200 parts per million (ppm), which it almost always does in Pasco County, extra care is required.

To minimize potential problems associated with using reclaimed water on landscape plants: 1. Grow salt-tolerant plant species,

2. Minimizing the use of overhead sprinkler irrigation so that high-salt water does not contactplant foliage by using drip-irrigation which will help prevent leaf burn,

3. Professionals may recommend the use of iron sulfite products to assist in mitigating thehigher salt content of reclaimed water; however, care must be taken to keep it off ofdriveways and sidewalks,

4. Consult a landscape professional for questions about minimizing problems,5. Resources for watering with Reclaimed Water are provided in Appendix C.

Climate Zone Dupree Lakes is located in Zone 9A. This West Central Florida area is unique- humid and moist with freezes and occasional hard freezes. Some Zone 9 “tropical” as well as more Northern Zone 8 plants do not do well in our area. Recommendations:

To the extent possible, plants and trees should follow the Florida-Friendly Landscaping Guide to Plant Selection & Landscape Design.

Because Dupree Lakes is surrounded by conservation areas, wildlife is used to grazing on a variety of plants and trees; therefore, deer, rabbits, turtles, tortoises, snails and slugs, bugs and microbes may impact the success of your plants, sod and trees, even if they are Florida Friendly Plants and Trees. Consult a landscape or lawn care professional if you see any damage so that it can be addressed immediately. (See Exhibit C Resources)

E. Edging and trimming

• Edging Areas: All plant beds, sidewalk areas, grass areas around the house, walkways, anddriveways shall be edged.

• Hedges: All hedges shall be kept trimmed. Hedges must follow the same height rules as fences.

F. Mulch:

• Mulching and Weeding: All plant beds must be mulched. Pine bark, Pine straw (needles),Melaleuca mulch, mixed hardwood mulch, eucalyptus mulch, utility mulch, cypress mulch orsmall stones. Mulched beds must be kept free of weeds and dead plants. Small pebbles (Nolarge river rocks) can be used as mulch, but they won’t contribute to the soil’s nutrient contentor water-holding capacity. If you use this type of mulch, make sure to first install a wovenground cloth to keep it from sinking into sandy soils. When using rock mulch, a little goes along way. Rock mulch should be used minimally in the landscape and reserved for use forexample on pathways, in dry creek beds, or under downspouts.

• Replacement: Mulch must be replaced in a timely manner as a result of rain runoff and rotting.

G. Trees

• Tree Removal: All tree removal must follow County rules. A&LRC and County approval arerequired on tree removal on single-family lots with existing homes for trees greater than ten(10) inch diameter at 4’ height or higher.

• Dead Trees and Plants: Dead trees and plants must immediately be removed and properlydisposed of. Broken or hanging tree branches must be removed. Palm trees require special

attention and pruning. Not all discolored palm leaves should be removed right away. We strongly encourage you to read see Exhibit C Pruning Palm, or consult an arborist.

• Care of Trees: All homeowners are responsible for the care and upkeep of all trees on theirproperty. Branches too close to the house should be cut back to eliminate animals and insectsfrom invading your home. Consult a certified arborist for proper pruning.

• New Tree Plantings: New tree plantings are encouraged, but homeowners must follow Countyand Surface Water Management Area rules. Consult a certified arborist to learn the root systemexpansion and best location on your property so that, as the tree matures, it will not interferewith your driveway or house foundation. Tree plantings must be approved by the A&LRC.

• Mitigation of Improperly Place Trees: The original landscape companies appear to have plantedinappropriate trees for the area and planted them in such locations that may cause seriousdamage, and in some cases already are, to driveways and foundations. The trees may also, asthey mature, encroach on your house foundation, porches and roofs. Consult a certifiedarborist in order to eliminate future problems.

Helpful Hints Even though trees may be listed as Florida Friendly, some trees do not do well as stand-alone landscape trees in this area (Zone 9A) or in Association areas with reclaimed water. Consult an arborist or landscape professional for the best trees to plant and proper care.

H. Curbing around Plant Beds

• Curbing: All plant bed curbing visible from the street must be approved by the A&LRC. Allcurbing should be similar, to the extent possible, in color to the pavers or house palette.

I. Surface Water Management System

• Construction of Structures: No Owner may construct or maintain any building, residence orstructure of any kind, or undertake or perform any activity in the Surface Water ManagementSystem, wetlands, wetland mitigation areas, buffer areas, upland conservation areas anddrainage easements described in the Permit and Plat unless prior approval is received from theA&LRC, the CDD and SWFWMD Regulation Department.

• Alteration of Surface Management System: No Owner shall in any way change, alter, impede,revise or otherwise interfere with the flow and the volume of water in any portion of anydrainage areas or the Surface Water Management System, nor shall any grading, alteration, orother modifications to these areas be made without the prior written permission of the A&LRC,the CDD and SWFWMD.

• Removal of Native Vegetation: No Owner shall remove native vegetation that becomesestablished within the Surface Water Management System without prior written approval fromSWFWMD, the CDD and the A&LRC. Removal includes dredging, the application ofherbicide, cutting, and the introduction of grass carp.

• Prevention of Ingress and Egress: No Owner shall in any way deny or prevent ingress andegress by the Association, the CDD, the County, or SWFWMD to any drainage areas or the

Surface Water Management System for maintenance or landscape or enforcement purposes. The right of ingress and egress, and easements therefore are hereby specifically reserved and created in favor of the Association, the CDD, SWFWMD, the County, or any appropriate governmental or quasi-governmental agency that may reasonably require such ingress and egress.

• Filling of Drainage Areas: No Lot shall be increased in size by filling in any drainage areas or other portion of the Surface Water Management System. No Owner shall fill, dike, rip-rap, block, divert, or change the established drainage areas or the Surface Water Management System without the prior written consent of the Board, the CDD and SWFWMD.

• Improvements: No sidewalk, driveway, impervious surface, paving, patio, deck, pool, air-conditioner, structure, utility shed, pole, fence, wall, irrigation system, tree, shrub, hedge, planting, landscaping plants other than grass, or other improvement shall be placed by an Owner within a drainage area, drainage easement, or the Surface Water Management System, except for landscaping of stormwater detention and retention ponds as required by governmental land development code.

• Compliance: All owners must follow the rules for the Surface Water Management System. Each Owner, at the time of construction of a building, Residence or structure, shall comply with the construction plans for the Surface Water Management System approved by and on file with SWFWMD.

• Dumping: No dumping in wetlands, woody buffer or conservation areas is allowed.

SECTION V PROPERTY APPEARANCE CONSIDERATIONS

A. Clothesline or Clothes Drying Area

• Clotheslines: No clotheslines or other facilities or apparatus for the drying of clothes outside of a dwelling shall be constructed or maintained on a Lot if viewable from other Lots, Common Area or Streets.

B. Exterior Shutters and Window and Door Coverings

• Exterior Windows: No exterior windows or doors of any building or other improvements on a Lot shall be covered by any shutters, boards, or similar type window coverings.

• Hurricane or Storm Shutters: Hurricane and storm shutters that may be required for protection from severe storms are allowed to be use only during the actual period of any such severe storm and the period within seventy-two (72) hours before and must be removed within twenty-four (24) hours after an anticipated severe tropical storm or hurricane.

• Window and Door Coverings: No exterior windows or doors of any building or other improvements on a Lot shall be covered by or coated with any foil or other reflecting or mirrored materials.

• Accent Shutters: The foregoing restriction shall not be construed as a prohibition against decorative exterior shutters located to the side of or over window or door openings; provided the same are first approved by the A&LRC taking into account the architectural style and

character of the residential dwelling or other improvement on which the same are proposed to be installed and such other factors as may be deemed relevant to such approval by the A&LRC.

C. Antennas, Aerials & Satellite Dishes

• Type: Outside antennas, antenna poles, antenna masts, satellite television reception deviceslarger than forty inches (40") in diameter, electronic devices, antenna towers or citizen band(CB) or amateur band (ham) antennas MUST BE approved in writing by the A&LRC/Board.

• Size: Satellite television reception devices smaller than forty inches (40") in diameter arepermitted but must have approval from the A&LRC.

• Height: Antennae extending more than twelve feet (12') must be approved by the A&LRC.

D. Hoses

• Storage: Hoses shall be rolled up and stored out of view from front or side streets.

E. Exterior Lighting

• Spotlights and Floodlights: Except as may be initially installed, no spotlights, flood lights, orsimilar high intensity lighting shall be placed or utilized upon any Lot which in any way willallow light to be reflected on any other Residence without the written authorization of theA&LRC.

• Other Outdoor Lighting: Ground-level landscape lights and coach light, garage lights should beconsistent with the architectural style of the home and must be approved by the A&LRC, ifreplaced with fixtures other than those originally installed.

• Pool Lighting: Lighting to highlight the pool or patio area is suitable but should be subdued notto shine directly into any other residence.

F. Signs

• For Sale or Lease: A "For Sale or Lease" sign not exceeding four (4) square feet in surface areaand one sign of not more than one (1) square foot used to indicate the name of the resident, maybe erected or displayed to the public view on any Lot.

• Political Signage: Political yard signs may be erected in yards no more than 30 days prior to anelection. Political yard signs must be wire frame and no more than 18” by 24” in size.

• Removal of Political Signs: Political yard signs must be removed from the yard within 24 hoursfollowing the election.

• Security Signs: Any parcel owner may display a sign of reasonable size provided by acontractor for security services within 10 feet of any entrance to the home.

G. Garbage Containers, Oil and Gas Tanks, Wood, Air Conditioning Units and Outdoor Equipment

• Containers: All garbage and trash containers must be placed in walled-in areas or landscaped

areas so that they are not visible from any adjoining Lot or any Street, except on those days designated as scheduled collection days, or evening before, for the Property by the agency responsible for collecting garbage and trash.

• Gas or Oil Containers: No oil tanks or bottled gas tanks shall be allowed on any Lot without theexpress written consent of the A&LRC.

• Air Conditioning Units: All Air Conditioning Units shall be shielded with landscaping fromview from the street.

• Wood for Fireplaces: Wood storage must be shielded from the street and neighboringproperties.

H. Dumping and Outside Burning

• Dumping: No Lot shall be used or maintained as a dumping ground for rubbish, trash, or otherwaste. Trash or other waste shall be kept only in closed containers and all equipment for thestorage or disposal of such materials shall be kept in a clean and sanitary condition. Nodumping in common areas, wetlands, woody buffer or conservation areas is allowed.

• Burning of Trash or Waste Material: There shall be no burning of trash or other waste material.

I. Pools

• Approval: All pools must have A&LRC and County approval prior to construction.Homeowners are responsible for pulling permits required by the county.

• Submission of Plan: Pools must be submitted to the A&LRC with drawings to scale on siteplans.

• Location in Easement: Swimming pools shall not be located within any of the drainage orutility easements shown on the Plat.

• Pool Equipment: Pool equipment must be screened from street view using landscaping or anapproved fence or wall.

• Pool Enclosures: Pool enclosures are not allowed to encroach on building setbackrequirements.

• Screen Enclosure Color: Aluminum screen enclosures must be bronze or black.

• Pool Fencing and Enclosures: If screen enclosures will not be used, Pasco County ordinancesmust be followed. If screened or privacy fence enclosures are not used, pool areas must befenced with black powder coated aluminum at least 4’ high.

J. Vehicles and Recreational Equipment

• Parking or Storage: No truck or commercial vehicle, limousine, mobile home, motor home, house trailer, utility trailer, camper, boat, boat trailer or other recreational vehicle or equipment, horse trailer, bus, passenger vehicle without current registration, van (other than a passenger van), or the like shall be permitted to be parked or stored on any portion of the Property unless they are parked within a garage, or are located so they cannot be seen from any Street.

"Truck" means a vehicle with any sort of weight capacity, which has a compartment or bed for carrying cargo, as opposed to passengers. Regardless if such vehicle has a cover or "topper" for the cargo-carrying area, it shall be deemed to be a Truck; however, "pick-up trucks" or "sport utility vehicles" with a cargo capacity of one ton or less that are not Commercial Vehicles (as hereinafter defined) are permitted to park on the driveway of a Residence.

"Commercial Vehicle" means any vehicle, which from viewing the exterior of the vehicle or any portion thereof, shows any commercial markings, signs, logos, displays, tool racks, saddle racks, or other elements of a commercial nature or otherwise indicates a commercial use.

• Temporary Parking for Maintenance: The above prohibition of Parking and Storage shall not

apply to temporary parking of Trucks and Commercial Vehicles used for pickup, delivery, and repair and maintenance of a Lot.

K. Vehicle Repairs

• Vehicle Repair: No maintenance or repairs shall be performed on any vehicles upon any portion of the Property for longer than a six (6) hour period except in an emergency situation. All repairs to disabled vehicles within the Property must be completed within twelve (12) hours from its immobilization or the vehicle must be removed.

L. Prohibited Structures

• Temporary Structures: No structure of a temporary character including, but not limited to, trailers, tents, shacks, sheds, barns, tree-houses, garages, tool sheds, guest quarters, carports, storage buildings or other outbuildings shall be placed or erected on the Property at any time without the express written permission of the A&LRC.

M. Interior Window Treatment

• Window Coverings: No reflective foil, sheets, newspapers, or other similar material shall be permitted on any window or glass door. Drapes, blinds, verticals, and other window coverings visible from outside a Residence shall have a white, beige, or similar light coloring.

N. Mailboxes

• Changes or Additions While mailboxes are in the median, between the curb and sidewalk and therefore placed in the “common area” that is under the jurisdiction of the county/CDD, like the sidewalk, grass area and driveway extension across that area, mailboxes are an integral part of the “ look” of the architecture of the home. Any changes/additions of mailboxes must be approved by the A&LRC.

O. Games and Play Structures

• Game Structures: No basketball courts or basketball standards or backboards shall be affixed to any structure on any portion of the Property.

• Play Sets: All play sets, playground equipment, and other outdoor recreational equipment must be approved by the A&LRC prior to installation.

• Storage: All moveable basketball stands or backboards, bicycles, toys, and outdoor recreational equipment must be taken inside the Residence at night.

P. Solar Equipment

• Collectors: Solar collectors should be integrated into the architectural design of the home or hidden from view as much as possible. Solar panels placed on a roof surface should have the same pitch as the roof and use a design that obscures their view. Solar equipment requires approval from the A&LRC.

• Equipment Screening: All equipment must be screened from view of nearby homes and view from front and side streets in a way that is acceptable to the A&LRC.

Q. Screening

• Approval: All installation of screens (pool, lanai and lanai extension) must be approved by the A&LRC prior to installation.

• Screening of garages or front porches: No garages or front porch areas may be screened.

• Color: Aluminum screen enclosures must be bronze or black. R. Garages and Garage Doors

• Approval: All garage door replacements (styles, manufacturer and colors) or re-painting must be approved by the A&LRC prior to installation. All garage doors must meet County code. Garage doors that are not solid or are wood will be considered.

• Creating Occupancy: No Owner shall cause any garage on his Lot to be permanently enclosed, screened, converted, or remodeled to allow for occupancy by occupants of the Residence.

• Color: Garage doors may be base or trim color. Wooden doors may be considered.

• Commercial Doors: All garage doors must be residential garage doors. NO commercial garage doors will be allowed.

S. Architectural Base Colors, Trim and Accents

• Submission to A&LRC: Submissions must be made for all paint colors to the A&LRC. Approval must be granted by the A&LRC prior to exterior painting, including automatic approval, for exterior color, trim, accents, garage doors and front doors.

• Automatic Approval: Automatic approval is granted if one of the Pre-approved color combinations in Exhibit A or Exhibit B (or previous Beazer color) is used. The color palette

needs to be identified on the submission. The main house base color defined in Exhibit A by Sherwin Williams is sorted by Sherwin Williams designated color families. Exhibit B is sorted by the color it would be on the house. Main base color and secondary base color are used to assist in finding the variety of palettes.

• Exterior Paint Color Coordination: All paint colors must be coordinated with other architecturalelements such as pavers, stone or other building materials.

• Paint Manufacturer: Although the Sherwin Williams paint palette is used to define Pre-approved colors, Sherwin Williams’s paint is not required.

• Approval for Paint Palette Colors Other Than Sherwin Williams: Any other color palette (notpre-approved), or use of a different color palette other than Sherwin Williams, must besubmitted to the A&LRC for approval. This submission must include the paint manufacturer,color palette code and be clearly identified as to where, as on base, exterior trim, garage doors,accent and/or front door, each color shall apply. Color swatches must be included.

• Neighboring Homes: All new paint house base colors, main house color, must not be the sameas any home base color within three houses on either side, or three houses either way directlyacross the street. The base color may not be the same to the house directly behind. Cornerhouses must consider all visible homes on cross streets.

T. Fences

All fence application must show the fence location on the property survey. The survey is available in the Pasco County offices on Hwy. 41.

• Approval: All fences must be approved by the A&LRC. Fence applications will be reviewedand approved by the A&LRC, and you must have the approval before you begin installation.

• Fences Backing Up To Common Area or CDD Wall/Fence: All fences backing up to acommon area or CDD maintained fence or wall shall not be higher than the CDD fence/wall atthe intersection of the two structures, should one exist in that particular location. Thehomeowner’s fence shall begin transitioning a minimum of six (6) feet away from the CDDfence/wall so that the top of the homeowner’s fence matches the top elevation of, or is lowerthan, the CDD fence/wall.

• Coloration After Installation: No color paints or stains are permitted on fences after they areinstalled. Fence material colors shall be inherent to the material during the manufacturingprocess.

• Fence Setback: All fences must be at least twenty feet (20’) back from the forward facingcorners of the house.

• Corner Lot Fences: Fences for corner lots require close coordination with the A&LRC due totheir unique layout and concerns for vehicle visibility/safety and compliance with existingeasements and county building code setback requirements.

• Properties that are on water, wetland or conservation areas will use the black powdered coatedmetal fences on the sides and across the back of the property. This is to allow all neighbors tohave full view of the wetland, water or conservation area.

Black powdered coated fences

• Location: All fences located with all or a portion of the back yard adjacent to a stormwater pond, wetland, or other water feature or conservation area shall consist of powder coated black metal material and shall be “picket” type constructed to a maximum height of four (4’) feet. The black 4’ fence should extend from the back corner of the house on both sides to the back and across the back of the property.

• Visible Screws or Fasteners: No screws or fasteners shall be visible from the outside on the aluminum fence.

PVC “privacy fence”

• Height: All remaining lots can construct fences consisting of either the 4’ high powder coated black powder coated metal picket fence or a PVC “privacy fence”. The “privacy fence shall consist of white PVC material, (or A&LRC approved PVC natural wood color) and shall be tongue & grooved style constructed to a maximum height of six (6) feet.

• Decorative Fence Tops: Decorative areas at the top are permitted upon A&LRC approval.

• Placement: Only the front face of the fence may face outward. No posts or stringers may be visible from the outside of the PVC fence.

• Fence Examples: See fence examples in Exhibit E. These examples are not exhaustive. U. Flags and Flag Poles

• The American Flag: Any homeowner may display one portable, removable United States flag or official flag of the State of Florida in a respectful manner, and one portable, removable official flag, in a respectful manner, not larger than 41/2 feet by 6 feet, which represents the United States Army, Navy, Air Force, Marine Corps, or Coast Guard, or a POW-MIA flag. Such additional flags must be equal in size to or smaller than the United States flag.

• Flag Pole: Any homeowner may erect a freestanding flagpole no more than 20 feet high on any portion of the homeowner’s real property, if the flagpole does not obstruct sightlines at intersections and is not erected within or upon an easement. The flagpole and display are subject to all building codes, zoning setbacks, and other applicable governmental regulations, including, but not limited to, noise and lighting ordinances in the county or municipality in which the flagpole is erected and all setback and locational criteria contained in the governing documents.

• Weather Damage: The flag should not be subject to weather damage; therefore, it should not be

displayed during rain and wind storms unless it is an all-weather flag. Weather damaged flags, torn or faded, should be replaced immediately.

V. Access Ramps

• Construction of Access Ramp: Any parcel owner may construct an access ramp if a resident or occupant of the parcel has a medical necessity or disability that requires a ramp for egress and ingress. The ramp must be as unobtrusive as possible, be designed to blend in aesthetically as practicable, and be reasonably sized to fit the intended use.

• Submission of Plans for Ramp: Plans for the ramp must be submitted in advance to the A&LRC. The association may make reasonable requests to modify the design to achieve architectural consistency with surrounding structures and surfaces.

• Affidavit for Medical Necessity for Ramp: The parcel owner must submit to the association an affidavit from a physician attesting to the medical necessity or disability of the resident or occupant of the parcel requiring the access ramp. Certification used for s. 320.0848 shall be sufficient to meet the affidavit requirement.

W. Driveways, Sidewalks and Porches

• Alteration of Driveways, Sidewalks and Porches: All requests for driveway, sidewalk or porch alteration or additions of any kind must first be submitted to and approved by the A&LRC prior to work starting. All applicants seeking such approval must work with the A&LRC first, to ensure that the modified design achieves architectural consistency with surrounding structures and surfaces. The application must include:

§ The desired alterations/additions drawn on the property survey, § A photo of the current driveway and landscaping, § A re-landscaping plan, § A list of materials to be used, including colors and design specifications.

• Maximum Width Increase: Any and all width increases from the original width, as installed by

the builder, may not exceed a total of five (5) feet, with a maximum of three (3) feet on one side, no matter when or how many applications are submitted.

• Width Exception for Disabled Persons: Consideration priority for widening of driveway on one

side, or sidewalk from the driveway to the porch, will be given to an owner/occupant who is disabled. The property owner must submit to the association an affidavit from a physician attesting to the medical necessity or disability of the owner or permanent occupant of the parcel requiring the driveway, sidewalk or porch alteration. Certification form used in FS 320.0848 shall be sufficient to meet the affidavit requirement.

• Type of Product: Pavers are the preferred material for driveway and sidewalk width increases/additions. Due consideration will be given to stepping stones, natural stone, brick, aggregate stone/rock and concrete, particularly if the expansion is to assist the movement of a disabled person. Other than concrete, the materials colors must be consistent with the paint palette of the house. If concrete, the color must be the same as the current color.

• County Approval: A&LRC application approval, if given, is ONLY for the area between the

front of the structure and the inside edge of the front sidewalk. Approval for any structural modification or increased width from the inside edge of the front sidewalk to the curb can ONLY be granted by Pasco County as that area is County-Right-Of-Way. If that area is to also be modified, the same materials must be used as submitted to the A&LRC.

• Mailbox: Mailbox relocation must be included on the survey, if applicable.

SECTION VI ENFORCEMENT

In the event an Owner of any Lot shall fail to maintain the premises and improvements situated thereon in such a manner as defined in the Official Documents of the HOA, the Owner shall be notified to correct the situation. The Violations and Enforcement Procedures as adopted by the HOA Board will be enforced.

Dupree Lakes HOA Pre-Approved House Palettes

The color palettes for the neighborhood have been extended beyond the original Beazer color schemes. You may repaint using the current Beazer color schemes or you can select a new color palette from Exhibit A. Sherwin Williams colors were used for the palettes; however, you can use any manufacturer. Automatic approval will be given for the color palettes in Exhibit A&B. You may create your own color palette or alternative trim or accent colors within a palette. All re-paintings, including pre-approved must be submitted to the A&LRC prior to beginning the project.

Palette Number: This is an identification number assigned by the A&LRC so it would be easier to find a palette. Each pre-approved palette has a base, trim and accent color number.

Sherwin Williams Base Color Family: Base color is the main house color. Sherwin Williams puts each of their colors into what they call a “Color Family.” These color families sometimes contain colors that are very different in look from that family. In addition, some color families are not listed as a color as Sherwin Williams has given them names, such as Historic Colors, Neutrals, and Timeless Colors. When trying to figure out a paint palette, those titles might not be helpful; hence, the second sort is Exhibit B so you can go down the Main Base General Color column to find the main color you might want.

Main Base General Color: This column attempts to help identify exactly what color the Sherwin Williams Base Color Family with the base number in the particular selection better resembles. The Secondary Base color is just additional information about that selection base color.

Color Palettes (Read across the Row) Each palette consists of a base color, which is the main house color, trim color and accent color. In some cases there are two accent colors. If you mix and match numbers from different palettes, they are not considered pre-approved.

Example: Selection 52 shows that the base color is 2823. If one looks across the row to the column entitled Main Base General Color, you can see that the Base will be in the brown color family. However, you will need to go to the Sherwin Williams or their site: www.sherwin-williams.com to see the brown color. Below is the link to many of the paint palettes used in Exhibit A & B.

Painting Tips Guide and Use of Visualizer

Choosing the “right” combination of paint colors for a house can be a challenging task. It takes time and reflection, and while personal preference is a large part of the thought process, so to must be what colors are compatible within the community and do not conflict with homes nearby.

As help in that reflection process, the A&LR Committee has pre defined over 70 color combinations (palettes) for you to consider. (See: Pre-Approved Color Palette Swatches below.) These are color combinations or “palettes” based upon Sherwin Williams modern colors and combinations. While they are pre defined (pre-approved) you still must submit an application. You do NOT have to use Sherwin Williams paint OR one of the 70+ palettes. BUT it will take longer to get approval from the A&LRC. If you pick one the the 70+, you will get very quick approval so that you start painting right away.

AND, before you make your final decision and submit your application and start buying gallons and gallons of paint, it is recommended that you go to Sherwin Williams or your selected supplier and pickup swatch samples of your selections, EVEN IF IT IS ONE OF THE 70+ PRE-APPROVED PALETTES.

Be aware that sample swatches are matte finished. That means they are a flat color, not shiny. Paint looks different if it semi-gloss (shinier) and looks very different in sunlight than on a cloudy day or in a shaded area. Further, a color on a computer screen is going to look different than that same color on a house. It is very expensive to repaint a house, so make sure it is the color you want and the best way to do that is, once you are very sure you have the “right” colors, get some small samples from your paint supplier and find a couple of different spots on your house to paint. Check the colors throughout the day. And if you have already submitted an application with different colors, you can always submit a new request if you find you do not like the color in the sample.

Main wall (Base) colors are typically done in matte finish but trim colors, many times, are done in a semi-gloss, which makes the paint brighter and the trim standout more.

Base: Main walls.

Trim: Areas around windows, roof fascia and soffit, railings, porch coverings, coining/relief areas.

Accent: Doors, shutters and other decorative areas/appliques.

Garage Doors: Base color or Trim color.

Ready? Clearly fill out an A&LRC Request Form, if you haven’t already done so. Per the above, know where your trim and accent colors will go. It is important that you and your painter know that the roof fascia and soffit is considered trim and should be the trim color. Once you are approved, you may begin - - -

WAIT! One more thing to do if you are not painting your house yourself: Always check the paint colors that the painter brings from the supplier against the colors you selected. Make certain they are the colors that have been approved and that you want.

Clear the colors that come-up at the bottom by clicking the Garbage can in each, then click the “+” sign. Then click “cancel” in the upper right corner, then “Close”. Your selected colors will now be at the bottom of the house scene. Click your “Base” color to the left at the bottom, then any large area of the wall of the house, click your “Trim” color at the bottom then any trim area such as the column to the far left, click your “Accent” color and then the front door of the house. There, you have a representation of your selected palette.

To print your sample color palette scene, click “Image” on the middle right. In the pop-up window select what you want to do with the scene (it is in a JPEG format so you can save it or open it in your photo program of choice) and then, using the “Print” option of that program, print it out.

Notes: • In the scene, the arched fake vent on the wall above the garage door is colored by the program the

“Trim” color but in the Dupree Lakes community that type of applique or “detail” is to be the “Accent”color like the shutters and front door. Any other small items such as the garage lights, fake garage doorhinges and handles and even house numbers can also be the “Accent” color.

• Also note that the garage door in the scene does not change from “white” whereas in the Dupree Lakescommunity the garage door MUST be either the “Base” color or the “Trim” of your selected palette. ITCANNOT BE THE “ACCIDENT” COLOR! Most Accent colors are much to dark for that large a space.

• AND, due to screen limitations, colors seen here may not accurately reflect actual painted colors as theywill appear on your house. To confirm your color choices, visit your neighborhood Sherwin-Williams store and refer to their in-store color swatches (cards) or Color to Go® color samples.(See “Painting tips”)
