ThetermofofficeoftheVice-PresidentofIndiaisuptoandincluding10thAugust2012.Under the provisions of sub-section (1) and sub-section (3) of section 4 of thePresidentialandVice-PresidentialElectionsAct,1952,thenotificationcallingtheVice-PresidentialElectioncanbeissuedbytheElectionCommissiononorafterthesixtiethdaybefore theexpiryof the termofofficeofoutgoingVice-President, i.e.,notificationcontainingtheprogrammeofelectiontotheofficeoftheVice-Presidentcanbeissuedin the present case by the Election Commission on any day after 12th June, 2012.

CONSTITUTIONAL PROVISIONS

TERM OF OFFICE

2. UndertheprovisionsofArticle67,theVice-Presidentshallholdofficeforatermoffiveyearsfromthedateonwhichheentersuponhisofficeandundertheprovisionsof clause (c) of Article 67, the Vice-President shall, not withstanding the expirationof his term, continue to hold office until his successor enters upon his office.

ELECTORAL COLLEGE

3. Under the provisions of Article 66(1) of the Constitution of India, the Vice-President shall be elected by the members of Electoral College consisting ofMembers of both Houses of Parliament. That is to say, at the election to the officeof the Vice-President of India, the nominated members of both the Houses ofParliament (2 of LokSabha and 12 ofRajyaSabha) are also eligible to be includedin the Electoral College along with the elected members of both the said Houses.

4. Under rule 40 of the Presidential and Vice-Presidential Elections Rules,1974, the Election Commission is required to maintain a list of members ofthe above referred Electoral College with their addresses corrected upto-date.5. The listwill contain thenamesof (i) electedmembersofRajyaSabha, (ii) thenominated members of Rajya Sabha, (iii) the elected members of Lok Sabha, and(iv) nominated members of Lok Sabha, in that order. The names will be numbered

in a continuous series andwill be arranged in alphabetical orders of theState/UnionTerritoryoftherespectiveHouses.MembersinrespectofwhomtheappropriateCourt,i.e. HighCourt or SupremeCourt, has given a limited stay of operation of the orderof setting aside of his election by the Court, are not entitled to vote at the election,thoughtheirnamesmayhavebeenincludedintheelectoralcollege.ThelistofElectoralCollegefortheVice-PresidentialElectionwillbemadeavailableforsale inJuly,2012.

7. UndertheprovisionsofArticle68oftheConstitution,anelectiontofillavacancycausedbytheexpirationofthetermofofficeofVice-Presidentshallbecompletedbeforetheexpirationoftheterm.AnelectiontofillavacancyintheofficeoftheVice-Presidentoccurringbyreasonofhisdeath,resignationorremovalorotherwiseshallbeheldassoonaspossibleaftertheoccurrenceofthevacancy,andthepersonelectedtofillthevacancyshallbeentitledtoholdofficeforthefulltermoffiveyearsfromthedateonwhichheentersuponhisoffice.

CONDUCT OF VICE-PRESIDENTIAL ELECTION

RETURNING OFFICER & ASSISTANT RETURNING OFFICERS:

8. UnderSection3ofthePresidentialandVice-PresidentialElectionsAct,1952,forthepurposeofeachelection,theElectionCommission,shall,inconsultationwiththeCentralGovernment,appointaReturningOfficerwhoshallhavehisofficeinNewDelhiandmayalsoappointoneormoreAssistantReturningOfficers.AccordingtoconventionevolvedbytheCommissionandnormallyfollowed,theSecretaryGeneraltoRajyaSabhaandSecretary

GeneraltoLokSabhaareappointedastheReturningOfficer,byrotation.Accordingly,this time, theSecretaryGeneral toLokSabhamaybeappointedasReturningOfficerandtwoOfficerssubordinatetohimmaybeappointedasAssistantReturningOfficers.

ELECTION SCHEDULE

9. Undersection4ofthePresidentialandVice-PresidentialElectionsAct,1952,theElectionCommissionshallnotifytheelectionscheduleintheofficialGazettespecifyingthedaysfromthedateofissueofthenotificationasthedaysforthevariousstagesoftheprogramme,asunder:

a)14thdayasthelastdateforfilingofnominations; b)15thdayasthedateforscrutinyofnomination; c)17thdayasthelastdateforthewithdrawalofcandidatures; d)adaynotearlierthanthe32nddayasthedateofpoll,ifnecessary.

10. Whiledecidingtheprogrammeasabove,theCommissiontakesintoaccountpublicholidays so declared by theGovernment of India under section 25 of theNegotiableInstrumentsAct, 1881 and ensures that the date of the issue of the notification; lastdate for filing nominations; date of scrutiny and the last date for the withdrawal ofcandidatures are not public holidays so declared. The ELECTION SCHEDULESfor the earlier thirteen Vice-Presidential elections may be seen at APPENDIX-I.

PLACE OF POLL

11. AroomintheParliamentHouseinNewDelhiisfixedastheplaceofpoll.Thefulldetailsoftheplaceofpollwillbenotifiedinduecourse.

ELIGIBILITY FOR ELECTION

12. No person shall be eligible for election as Vice-President unless he: a)isacitizenofIndia; b)hascompletedtheageof35years;and c)isqualifiedforelectionasamemberoftheCouncilofStates(Article66).

13. A person shall not be eligible for election as Vice-President if he holds anyoffice of profit under the Government of India or the Government of any State orunderanyLocalorotherAuthoritysubject to thecontrolofanyofsaidGovernments.

14. However, a person shall not be deemed to hold any office of profit by

reason only that he is the President or Vice-President of the Union or theGovernor of any State or is a Minister either for the Union or for any State.

15. Detailed provisions regarding the election are contained in the Presidentialand Vice-Presidential Elections Act, 1952 (No.31 of 1952) and the rules madethereunder, viz. the Presidential and Vice-Presidential Elections Rules, 1974.

IMPORTANT PROVISIONS RELATING TO CANDIDATURE AT VICE-PRESIDENTIAL ELECTION

16. On or before the last day fixed for the filing of nominations, each candidateshall, either in person or by any of his proposers or seconders, between thehours 11.00 a.m. and 3.00 p.m., deliver to the Returning Officers, at the placespecified by him in this behalf, a nomination paper completed in prescribedform(Form3)andsubscribedbythecandidateasassentingtothenomination.

17. A prospective Vice-Presidential candidate should get his nomination papersubscribedtobyatleast20electorsasproposersandatleast20electorsasseconders.

18. No elector shall subscribe whether as proposer or as seconder, morethan one nomination paper at the same election and if he so does, his signatureshall be inoperative on any paper other than the one first delivered to the R.O.

19. NotmorethanfournominationscanbefiledbyoronbehalfofacandidateoracceptedbytheReturningOfficer.

20. EachnominationpapershallbeaccompaniedbyacertifiedcopyoftheentryrelatingtothecandidateinthecurrentelectoralrollfortheParliamentaryConstituencywhereheisregisteredasanelector.

21. AprospectivecandidateshoulddepositasumofRupeesRs.15,000/-assecurity.Theamountisliabletobeforfeited,ifattheelectionwherethepollhasbeentakenthecandidateisnotelectedandthenumberofvalidvotespolledbysuchcandidatedoesnotexceedone-sixthofthevotesnecessarytosecurethereturnofacandidateatsuchelection.

SYSTEM OF ELECTION

22. The election to the office of the Vice-President shall be held inaccordance with the system of proportional representation by means of thesingle transferable vote and the voting at such election shall be by secret ballot.

23. FortheVice-PresidentialElection,thevalueofvoteofeachMemberofParliamentisONE.

SYSTEM OF PROPORTIONAL REPRESENTATION BY MEANS OF SINGLE TRANSFERABLE VOTE-DETAILED PROCEDURE

24. ThemannerofvotingatVice-PresidentialElectioniscontainedinRule17ofthePresidentialandVice-PresidentialElectionsRules,1974.

25. Theballotpapershallcontainthenamesofthecontestingcandidates,butdoesnotcontainanyelectionsymbol.Therewillbetwocolumnsintheballotpaper.Column1oftheballotpapercontainstheheading“NameofCandidate”,andColumn2containstheheading“Markorderofpreference”.

26. Eachelectorshallhave,asmanypreferencesastherearecandidatesbutnoballotpapershallbeconsideredinvalidsolelyonthegroundthatallsuchpreferencesarenotmarked.

27. Anelectoringivinghisvoteshallplacethefigure”1”inthespaceoppositethenameofthecandidatewhomhechoosesforhisfirstpreferenceandmay,inaddition,markasmanysubsequentpreferencesashewishesbyplacingonhisballotpaperthefigure2,3,4andsooninthespacesoppositethenamesofothercandidates,inorderofpreference.ThefiguresmaybemarkedintheinternationalformofIndiannumeralsorintheRomanformorintheformusedinanyIndianlanguageBUTSHALLNOTBEINDICATEDINWORDS.

COUNTING METHOD

28. The Returning Officer takes up the counting of votes at the hour fixedfor such counting which is normally on the same day on which the poll is taken.

29. The Returning Officer scrutinizes the ballot papers first and separates theinvalidvotes.Thevalidballotpapersaredistributedamong thecontestingcandidatesby placing the valid ballot papers according to first preference marked thereinin the tray meant for the candidate. After distributing all the valid ballot papers,the Returning Officer totals the valid ballot papers credited to each candidate.

QUOTA FOR ELECTION

30. Aftercountingthetotalvalidvotespolledbyeachcandidate,theReturningOfficertotalsupthevalidvotespolledbyallthecontestingcandidates.Thequotafordeclaringacandidateaselected isdeterminedbydividingthetotalvalidvotesby2andaddingoneto thequotient, ignoring theremainder, ifany.Forexample,assumingthe totalofvalid votes polled by all candidates is 789, the quota required for getting elected is:

789 ------+1 = 394.50+1[Ignore.50] 2

Quota = 394 +1 = 395

31. Afterascertainingthequota,theReturningOfficerhastoseewhetheranycandidatesecuredthequotaforbeingdeclaredaselectedonthebasisofthetotaloffirstpreferencevotespolledbyhim/her.

32. If no candidate gets the quota on the basis of first preference votes, thenthe Returning Officer proceeds further to second round of counting during whichthe candidate having lowest number of votes of first preference is excludedand his votes are distributed among the remaining candidates according tothe second preference marked on these ballot papers. The other continuingcandidates receive the votes of excluded candidate at the same value of ONE.

33. TheReturningOfficerwillgoonexcludingthecandidateswithlowestnumberofvotesinsubsequentroundsofcountingtilleitheroneofthecontinuingcandidatesgetstherequiredquotaortillonlyonecandidateremainsinthefieldasthesolecontinuingcandidateanddeclareshim/heraselected.

PREVIOUS ELECTIONS

34. TheVice-PresidentialElectiontobeheldin2012,willbethefourteenthofsuchelectionstothatoffice.Theearlierelectionstothisofficewereheldin1952,1957,1962,1967,1969,1974,1979,1984,1987,1992,1997,2002and2007.DetailsofeachoftheearlierelectionsaregiveninbriefintheAPPENDIX-I & II.

DISPUTE OVER ELECTION

35. (i)AnydoubtordisputerelatingtoaVice-Presidentialelectioncanberaisedonlybymeansofanelectionpetitionaftertheelectionisover.

(ii)AnelectionpetitioncallinginquestionanelectiontotheofficeofVice-Presidentmaybepresentedbyanycandidateatsuchelectionorbyanytenormoreelectorsjoinedtogetheraspetitioners.

(iii)Theauthorityhavingjurisdictiontotrysuchelectionpetition,istheSupremeCourtofIndia.

(iv)Anelectionpetitionmaybepresentedwithin30daysfromthedateofpublicationofthedeclarationcontainingthenameofthereturnedcandidate.

FIRST VICE-PRESIDENTIAL ELECTION, 1952

The list of electors for the first Vice-Presidential election was prepared andpublishedby theCommissionon18.4.1952. It contained thenamesof 715electors. According to clause (1) of article 66 of the Constitution, as originallyenacted, the Vice President was to be elected by the members of bothHouses of Parliament assembled at a joint meeting, in accordance with thesystem of proportional representation by means of single transferable vote.

Radhakrishnan as validand rejected the nomination of Shri Hussain. Being the only candidate, Dr.Radhakrishnanwasdeclaredaselectedunopposedtotheofficeof theVice-Presidenton 25.04.1952. CHANGE IN THE METHOD OF ELECTION

Accordingtoclause(1)ofarticle66oftheConstitution,asoriginallyenacted,theVice-PresidentwastobeelectedbythemembersofbothHousesofParliamentassembledatajointmeetinginaccordancewiththesystemofproportionalrepresentationbymeansof single transferable vote. No such joint meeting, however, took place in the Vice-PresidentialElectionsheldeitherin1952orin1957,asonbothoccasionstheelectionwas uncontested. The procedure laid down in thePresidential andVice-PresidentialElectionsAct,1952for thiselectionwasthesameasfor thePresidentialElectionanddidnotvisualizeorprovideforajointmeetingofthemembersatanystage.Itwasfeltoncloserconsiderationthatthevariousstagesofanimportantelectionofthischaractercouldnotbesatisfactorilyorconvenientlygonethroughatajointmeetingof700andoddpersonsassembledatoneplace.TheclausewasaccordinglyamendedbytheConstitution(EleventhAmendment)Act,1961,providingforelection“bythemembersofanElectoralCollegeconsistingofthemembersofbothHousesofParliament.”Accordingly,theElectionCommissionpreparedthelistofElectoralCollegeandelectionwasheldon7thMay,1962.

TheplaceofpollwasaCommitteeRoominParliamentHouse.ThepolltookplacealongwiththePresidentialElectionin1962.ForthePresidentialElection,61MembersofParliamenttookpermissiontovoteattheirownStateHeadquarters.However,thereisnosuchprovisionfortheVice-PresidentialelectionandallmembersintheElectoralCollegehavetovoteattheplacefixedintheParliamentHouseinNewDelhi.Therefore,since this Vice-Presidential election was held simultaneously with the Presidentialelection,those61memberscouldnotvoteinNewDelhiattheVice-Presidentialelection.However, 679members out of 749 voted and the percentage of votingwas 90.65%.

ThetermofShriV.V.GiriasVice-Presidentelectedin1967wasupto12.05.1972.However,Dr. ZakirHussain, the thirdPresident of India passed away on 03.05.1969and theVice-PresidentShriV.V.Giri assumedofficeasactingPresident. Thereafter,ShriV.V.Giri resignedon20thJuly1969as theactingPresidentandVice-President.Thus a vacancy occurred in the office of the President as well as Vice President.The Vice-Presidential election was taken up by the Commission immediately.

1. ThenominationpaperofaVice-Presidentialcandidateshallbesubscribedbyatleast5electorsasproposersand5electorsasseconders.

2. ThesecuritydepositwasmadeRs.2,500/-.

3. ElectionpetitionchallenginganelectioncanbepresentedonlybeforetheSupremeCourtbyanycandidateorbyminimum10electorsjoinedtogetheraspetitioners.

4. ThetimetablefortheelectionstotheofficesofthePresidentandVice-Presidentwasmadestatutory.Itwasprovidedthatthelastdateformakingnominationsshallbethe14thdayafterthepublicationofthenotificationcallingtheelection,thescrutinywillbeonthedayfollowingsuchlastdateforfilingnominations,thelastdateforwithdrawalofcandidatureswillbetheseconddayfollowingthedateofscrutinyandthedateofpoll, ifnecessary,shallbenotearlierthanthefifteenthdayafterthelastdateforwithdrawalofcandidatures.Inviewoftheextensiveamendments,theCentralGovernment,inconsultationwiththeElectionCommission,issuedanewsetofPresidentialandVice-PresidentialElectionsRules,1974,replacingtheRulesof1952.
