County Zoning Recommendation

County Staff recommends DENIAL

Development Proposal:

Rezone from AG-2 to RPD

AG-2 = 1u/acre RPD = 6u/acre

Impact 37 acres of wetlands

Fill for 55 homes w/docks

Dredge canal + 13 slip boat basin

Extend canal under Shell Pt Blvd

Lee County Decision Points

The Plan Must Demonstrate They Meet Criteria:

1. Complies with the Lee County Comprehensive Land Use Plan;

2. Meets the Land Development Code, County regs or qualifies for

deviations

3. Compatible with existing and planned uses in the surrounding area;

4. Mitigates impacts on transportation facilities;

5. Will not adversely affect environmentally critical or sensitive areas

and natural resources; and

6. Served by urban services, defined in the Lee Plan, if located in a

Future Urban area category.

The project is inconsistent with the Goals, Objectives, and

Policies of the Comprehensive Land Use Plan.

The project does not meet the Comp Plan requirements:

• protection and enhancement of wetlands,

•protection of wildlife habitat,

•protection of life and property,

•limiting public expenditures in Coastal High Hazard Zone

•mitigate impacts to transportation

•providing effective evacuation infrastructure

The project will adversely affect environmentally critical and

environmentally sensitive areas and natural resources, and is

creates compatibility-related concerns to adjacent properties as a

result of the adverse environmental impacts.
