EDMONTON - A man who strangled his girlfriend with the belt from her bathrobe and immediately turned himself in to RCMP was convicted of second-

degree murder Wednesday

Edward James Fountain 44 pleaded guilty and admitted he strangled 39-year-old Charissa Kozakewich in their home after the couple argued on the night

of Oct 3 2012

Crown prosecutor Mark Huyser-Wierenga told court it was an ldquoentirely senselessrdquo killing

ldquoThe dispute between Charissa and Mr Fountain seems so mundane and his violent response and dominating her is so grossly disproportionate to any

words she might have said to offend himrdquo

According to agreed facts Kozakewich a mother of two daughters and Fountain met in July 2012 and he moved into her south Edmonton home that

September The night of her death the couple was home alone They had supper cleaned dishes and began drinking together on the couch They briefly

left the home to buy a bottle of wine Fountain drove because he was concerned Kozakewich had already consumed alcohol court heard

Later that night they had an argument that ldquoturned nastyrdquo Huyser-Wierenga said

ldquoI donrsquot need you to be my fatherrdquo Kozakewich repeatedly told Fountain

The fight continued after the couple went to bed and Fountain felt frustrated He ldquofelt his head was going to exploderdquo according to the agreed facts

Fountain strangled her with the cotton belt on the floor of the couplersquos bedroom Once he noticed that her face was blue Fountain fled the home and drove

directly to the Sherwood Park RCMP detachment

At the time defence lawyer Laura Stevens told court Fountain was confused and erratic He has a long history of mental illness including depression andbipolar disorder

ldquoHe is clearly confused by what has happenedrdquo Stevens said ldquoHe canrsquot believe what hersquos done Hersquos horrified by itrdquo

As Fountain tried to confess to his crime RCMP members mistook his confusion for drunkenness and arrested him for being intoxicated in public He then

told them he thought he might have killed his girlfriend Edmonton police officers went to the couplersquos home and found Kozakewich dead with the belt still

around her neck

In victim impact statements Kozakewichrsquos family said they forgave Fountain and hoped he would find Jesus while imprisoned

ldquoJust as Jesus has forgiven me for my sins I must forgive yourdquo said Stephen Kozakewich Charissarsquos younger brother Before the court hearing he gave

Stevens a Bible to give to Fountain

ldquoDomestic violence is a particularly virulent problem in our societyrdquo said Court of Queenrsquos Bench Justice Sheila Greckol ldquoFew crimes are as devastatingrdquo

Fountainrsquos life sentence was automatic He will serve 10 years before he is eligible for parole
