What is “fair” according to the “rule of reason”?

In general, judges and lawyers determine if the use of copyrighted material is “fair” by answering two key questions:1. Did the unlicensed use “transform” the material

from the copyrighted work by using it for a different purpose than that of the original?

2. Was the material taken appropriate in kind and amount considering the nature of copyrighted work and of the use?

YES?! Then you are likely to be using the document fairly!

Common Fair Use Questions …1. Can I use copyrighted material in lessons ?

Consensus: Educators have the right to use copyrighted material in lessons as long as the material is relevant to the topic being taught and they must use only what is necessary to obtain the goal.

2. Can I use copyrighted material to create curriculum materials?

Consensus: Educators can integrate copyrighted material into curriculum but they must provide attribution for quoted material wherever possible.

3. Can my students use copyrighted materials in their own work?

Consensus: Students can use copyrighted material in their work, however, it cannot be a substitute for their own creative effort. They must be able to show how they used the copyrighted work
