What is Copyright? A law that protects the creators of “original

works of authorship.” Protection is available for original works immediately after they are created regardless of if they are published, unpublished, or registered with the U.S. Copyright Office.

You Can!The Fair Use doctrine of the copyright law

allows the use of copyrighted works without permission or payment if the use is “fair” according to the “rule of reason”.

What is “fair” according to the “rule of reason”?

In general, judges and lawyers determine if the use of copyrighted material is “fair” by answering two key questions:1. Did the unlicensed use “transform” the material

from the copyrighted work by using it for a different purpose than that of the original?

2. Was the material taken appropriate in kind and amount considering the nature of copyrighted work and of the use?

YES?! Then you are likely to be using the document fairly!

Common Fair Use Questions …1. Can I use copyrighted material in lessons ?

Consensus: Educators have the right to use copyrighted material in lessons as long as the material is relevant to the topic being taught and they must use only what is necessary to obtain the goal.

2. Can I use copyrighted material to create curriculum materials?

Consensus: Educators can integrate copyrighted material into curriculum but they must provide attribution for quoted material wherever possible.

3. Can my students use copyrighted materials in their own work?

Consensus: Students can use copyrighted material in their work, however, it cannot be a substitute for their own creative effort. They must be able to show how they used the copyrighted work

Create and Understand Creative Commons Licensing Options…Creative Commons License Conditions:

1. Attribution (by): Allows others to copy, distribute, display and perform copyrighted work but they must give credit in the manner requested by the author.

2. Share Alike (sa): Allows others to share work only under a license identical to the one that governs the creators work.

3. Non-Commercial (nc): Permits others to copy, distribute, display and perform copyrighted work but not for commercial purposes.

4. No Derivative Works (nd): Permits others to copy, distribute, display and perform copyrighted work but the work cannot be altered- must be verbatim.
