CERTIFY EHS COMPLIANCE - PROCEDURE FOR DUBAI WORLD DEVELOPMENTS
Introduction
The move to monitor and control potentially unsustainable industrial activities in JAFZ was formalized with the
setting up of the Free Zone Industrial Operations Control Department (FZIOC) that came into being in 1990.
Over the last 15 years, this department has evolved into “ EHS” , that monitors and enforces a string of
Environmental, Public health and safety regulations in all DW areas of jurisdiction of the Ports & Free Zone
Corporation. Business Units like JADAF, DMC, DMCC, DPA, Techno Park, Nakheel etc., apart from JAFZ are
also monitored and guided by EHS. The achievement of ISO 14001 in the year 2002, DIMA Awards in 2004 &
2005, and now OHSAS 18001, calls for implementing standardized environment management and safety
standards in all the businesses under the GROUP/ Ports Customs and Free Zone Corporation (PCFC).
1.0 PURPOSE
The purpose of this process is to ensure that the Client’ s processes comply with the required Environment,
Health, Safety, Fire & Sustainability procedures & standards as defined by Environment, Health and Safety
(EHS) from conceptualization through operations to termination of the project.
2.0 SCOPE
From receipt of the initial application for license (Trading/Retail, Service, R&D or Industrial), the processes of
facility allocation, review & construction of the project, the request for issuance/renewal of an Operation Fitness
Certificate and Environmental Compliance Permits to Facility Termination, the scope covers assessment and
monitoring of all Environment, Health, Safety & Fire Safety impacts for all such projects. It also includes the
required inspections/assessments of the Client’ s processes to cover all projects from Construction, Operationto termination of operations. The scope also includes the environmental /risk reviews/s assessment and
pollution control of existing / proposed clients/ project activities. The scope of these regulations cover all
developments under the jurisdiction of Dubai World, where applicable. Commercial and residential /mixed use
facilities are also included especially in the areas of Sustainability requirements.

3.0 REFERENCES
These range from Laws, Regulations, Standards, Guidelines & procedures as laid down by FEA, Dubai
Municipality, Civil Engineering, EHS etc.
4.0 DEFINITIONS4.1 Environmental Impact Assessment (EIA) :- is an assessment of the Client’ s process from the
environment point of view, considering all the air emissions and waste effluents and other type of
wastes/products from the process, which could have an immediate or future impact on human health and/or
the environment. It also includes the aspects regarding recycling, reuse and recovery of substances and
judicious use of natural resources and recommends actions required to address the same.
4.2 Risk Assessment (RA) : - Health, Safety & Environment and Fire assessment of the project; could
include HAZOP (Hazard and operability study) or HAZAN (Hazard Analysis). It includes fire load calculations,
heat radiation calculations and occupational health.
4.3 E-form (Form 2) : Is a form that should be filled by the client at the project conceptualization stage,
enumerating process and environmental issues relating to the proposed company's activities. This form should
be updated and submitted as and when changes are effected/proposed in the company’ s operations.
4.4 Environmental Compliance Permit (ECP) : - This Permit(s) shall specify the environmental requirements
that the company needs to fulfill and maintain during its operations. Validity of this Permit coincides with that of
the OFC.
4.5 Environmental Termination certificate (ETC) - This Certificate issued by EHS shall certify that the client
has terminated the operations without any significant Environmental Impacts.
4.6 Environmentally Significant/ High Risk Clients (ES-HRC) : - Those companies that operate and
generate or have a potential to generate potentially industrial/trade wastewater/ air emissions and/or
hazardous solid wastes (as per DM Classifications) and or pose significant Safety/Occ. Health or Fire Hazard.
4.7 Environmental Impact: Any change to the environment, whether adverse or beneficial, wholly or
partially resulting from an organization’ s activities, products or services.
4.8 Operation Fitness Certification : It is a certificate (OFC) issued by the Authority, that certifies EHS, Fire
& Electrical compliance of the operations carried out by the client. This Certificate is renewable annually,
usually on renewal of the client’ s license.
4.9 Pollutant : Any solid, liquid, gas substance, present in concentrations that may be injurious to health.
4.10 Pollution Control : The control of environmental impacts from the operations of Clients/projects so that
the pollutant levels are within applicable local/ federal/international standards.
4.11 Sustainable Development :
The concept of sustainable development implies, first, the integration of environmental issues with the
imperatives of economic development in order to meet the immediate needs of populations today without
undermining the aspirations of future generations.

Green buildings promote resource conservation, including energy efficiency, renewable energy, and water
conservation features; consider environmental impacts and waste minimization; create a healthy and
comfortable environment; reduce operation and maintenance costs; and address issues such as historical
preservation, access to public transportation and other community infrastructure systems. The entire life-cycle of
the building and its components is considered, as well as the economic and environmental impact andperformance

5.0 PROCEDURE
5.1 Review & Approve Client Application for License (Selectively for Office/Residential Buildings)
5.1.1 On receipt of a copy of the initial “ Application for License” and/or “ Facility Allocation Request” (See
Procedure : EHS-CLNT-PROC-013), forwarded to EHS by the relevant Business Unit, Sales & Marketing
Department, the relevant EHS Manager shall review it with the Fire and Food & Health Departments (as
required). The review shall determine suitability of the project (See Guidelines : EHS Guidelines on Prohibited
Activities in DW Areas) as well as type of facility/ zoning/location of the project requested depending on the
client's processes and also determine the need for an Environmental Impact Assessment and / or Risk
Assessment studies (See Guidelines – EIA, RA, Site Suitability; Procedures – EHS-CLNT-PROC-011 & 20).
Dubai Municipality ETG-4 and/or 53 forms may be required to be filled and submitted as part of the Project
Review requirements (Industrial projects). In the event that further clarification is required, then the EHS
Manager shall liaise with the relevant Business Units Sales Dept. or client accordingly, until such time the
project is approved by EHS. It shall be noted that Labour Camps/Temporary facilities or
Residential/Commercial Facilities that may impact or be impacted by surrounding activities shall need to be
approved at this stage.

5.1.2 Given that either an EIA and / or RA is deemed required by the EHS Group, then the Business Unit
shall communicate this requirement to the client to advise this to be carried out, along with a List of approved
EIA/RA Consultants and Guidelines for carrying out the study (See Pre-qualified List of EIA/RA Consultants
and EHS-CLNT-PROC-011). Otherwise, the application shall be approved with/without comments for
adherence during the construction/operational stage of the project.5.1.3 Where it is determined that a particular project/client has environmentally significant aspects, a
separate section shall be created in the client file to incorporate EMS Requirements and Compliance records.
Note : At this stage, EHS Regu lations/Guidelines can be submitted/referred to client for his information
(www.ehss.ae)
5.2 Advise EIA and / or RA (Optional – in case 5.1.2 is applied)
5.2.1 Following 5.1.2, the Client shall need to confirm acceptance of the EIA and / or RA, based on which
facility allocation may be conditionally approved. It shall be noted that any move to locate/establish
Chemical/Hazardous Companies/Processes in non-designated Chemical/Hazardous Zones shall necessitate
3rd. Party Site Suitability Studies prior to any License/facility Approval. (See also List of DM Approved
Consultants). All mega/master developments for residential/ commercial developments shall also necessitate
an EIA/RA Process.
Note : This is important as the assessment requires the location details, which can affect the impacts.
5.3 Endorse Consultant Selection for EIA/RA
5.3.1 On approval of the facility allocation, the EHS Manager shall also request from the client, the short-
listed Consultants to be used, including scope of work and CV’ s, to endorse or otherwise, the client’ s
selection. This shall be normally reviewed/endorsed/approved by EHS Department within a maximum of 3
working days.
5.3.2 In the event of not endorsing the selection, EHS shall request the Client to submit new recommendations
until they are approved.
5.4 Receive, Review & Approve EIA and / or RA
5.4.1 On completion of the study by the approved consultant, EHS shall receive the Assessment with
recommendations on the impacts and actions required to control / prevent them. This shall be normally
reviewed/approved by relevant EHS Managers within a maximum period of 7 working days.
Note : An alternative plot could be advised in the light of the study.
5.4.2 Given that the EIA/RA study is satisfactory (in consultation with DM-EPSS, where required), EHS shall
approve the same and inform the client/consultant to implement all necessary recommendations and EHS&F
requirements during the construction/ operational phase of the project. If the EIA/RA is not satisfactory, then
EHS shall respond accordingly until such time the EIA/RA study is approved.
5.5 Receive, Review Request and Issue Approval for EHS NOC for Building Permit
5.5.1 Once it has been ascertained that all Application, Site Suitability, Allocation and EIA, RA requirements
are met, EHS may accept request for EHS-NOC for Building Permit. (See Procedure EHS-CLNT-PROC-001)
and Process the same as per EHS Procedures. It shall at this stage be required that the developer submit proof

of registration of his project with an EHS approved Green Building Certifying Agency, signed by the Client/End-
User, Consultant and 3 . Party Certification Body. Industrial Developments shall also require to follow Green
Building requirements, though the specific parameters shall be applied on a case-to-case basis as decided by
EHS.

5.5.2 On satisfactory submission of EHS details/requirements (See Guidelines - Checklist for EHS_NOC for BP), EHS NOC for Building Permit shall be issued (format attached) with/without comments that need to be
resolved during the Building Permit Process. It shall at this stage be required that the developer submit proof of
preliminary approval of his project plans by an EHS approved Green Building Certifying Agency.
5.5.3 Payment of EHS-NOC for BP Fees shall be made in line with EHS Tariff, accepted by cheque in the
name of “ Dubai World Corporate Services” payable at DWCS Cashier, near Gate No. 3.
5.6 Issue CED Building Permit
5.6.1 After 5.5.2 and compliance with CED requirements, a Building Permit or NOC may be issued to all
proposed permanent facilities by CED. Thereafter the contractor is allowed to mobilize his site.
5.6.2 CED does not issue Permits for Temporary Structures (Tents, Port cabins etc.) or machinery/equipment
and in such cases, the proponent shall approach the BU and EHS for such approvals.
5.7 Carry out Routine Inspections during Construction (EHS- Construction Safety)
5.7.1 Certificate of Conformity and Routine inspections shall be conducted at the various phases of
construction (See Procedure – Complete COC Procedure) to ensure Health, Safety & Environmental aspects
are being addressed during the construction stage of any Dubai World Project. ( Also See Section 5, Health &
Safety and Fire Regulations & Standards). Requirements for Green Building Development during this stage
may be cross checked by EHS.
5.8 EHS-NOC for Building Completion Certificate
5.8.1 On completion of the building or other works, as per the approved drawings, EHS shall receive a letter
from the Consultant to that effect, and also requesting final inspection to lead to the issue of the EHS-NOC for
Building Completion Certificate. This letter shall be mandatorily accompanied by a Certificate of Compliance by
the approved 3rd. party Green Building Certification Body stating that all required Green Building requirements
(See EHS Green Building Regulations) have been completed satisfactorily (as related to construction of the
facility). The same shall be carried out as per EHS Procedures (EHS Procedure – EHS-CLNT-PROC-021).
Also see Guidelines - Checklist for EHS_NOC for BCC. Any pending requirements (to be checked during
commissioning / operations shall be listed, agreed and jointly signed by the 3rd. party and End User/Client.
Note: It is important to recognize that the inspections are diverse in nature (given the different activities of
different business units). The inspections may also include relevant EHS aspects of construction elated to the
Operation Fitness Certificate, depending on the nature of the process to be u ltimately installed.

5.9 Issue EHS-NOC for BCC and CED- Building Completion Certificate
5.9.1 On satisfactory completion of the outstanding construction works, and receipt of any clarifications if any,
the EHS Engineer(s) may issue an EHS-NOC for BCC for the information and further processing by Civil
Engineering Department (CED), with copies to the consultant & Client.

5.9.2 Payment of EHS-NOC for BCC Fees shall be made in line with EHS Tariff, accepted by cheque in the
name of “ Dubai World Corporate Services” payable at DWCS Cashier, near Gate No. 3.
5.9.3 Issuance of any Approval for DEWA Connections shall be as per EHS Guidelines and issued only for the
information of CED.
5.9.4 Wherever required, the EHS Manager and Client may review and discuss to resolve any contentiousissues.
5.10 Receive Intimation of Facility Lease or Building Completion Certification
The EHS Manager shall receive intimations as regards issuance of facility leases and / or Building Completion
Certificates for the Clients. Based on the same, the EHS Manager shall send the client a letter reminding them
of the requirement for obtaining an Operation Fitness Certificate.
Note : In the case of a pre-built unit, the Business Unit Admn. Dept./Sales shall intimate EHS when the client
Leases the premises, based on which EHS Manager shall send the client a letter reminding them of the
Operation Fitness Certificate – OFC (EHS-CLNT -PROC-008) requirements. This is also checked by Customs
Dept. who ensures that Import/Export operations may take place only with an EHS C learance (See Procedure
– EHS-CLNT-PROC-015)
5.11 OFC Process
5.11.1 On commencement of client/project operations, the EHS Manager shall receive a request from the
client to carry out an inspection for the Operation Fitness Certificate. (See EHS Procedure Flow Chart). This
request shall be accompanied by the Final Certificate by the Approved EHS 3 rd. party in regard to compliance
with Green Building Requirements of Dubai World.
5.11.2 The EHS Manager shall review the same and ensure that the OFC request is valid (plot is developed,
Building Completion certificate available or if the company is ready to commence operations).
5.11.3 The EHS Officer shall liaise with the Client/end-user and the respective engineers in EHS, Fire and
Electrical, (taking into consideration any specialist knowledge required, e.g., food processing), to prepare and
agree a visit schedule to carry out an inspection at the Client’ s premises. The inspection request shall then
be logged and a Visit Schedule issued to the Client (with a copy to relevant engineers) to give time, date and
personnel involved. Any additional requirements, e.g., drawings, may also be requested.
5.11.4 The Engineers shall conduct the inspection on the Client’ s site. To do so, the Client’ s process shall
be operated to enable checks of all operational requirements to be made in respect of EHS (See Guideline :
Checklist for OF Inspections), Fire and Electrical, Marine etc. (wherever applicable).
Note : Certain measurements/records/3 rd. tparty certifications etc. maybe required according to the ype of activity. The
Client shall be requested to conduct these and to present the results to EH S on completion for their assessment.
5.11.5 On completion of the inspection, the individual engineers shall prepare their reports and forward these
to the coordinating EHS Officer (Administrator).
5.11.6 The EHS Manager may review the Inspection Reports wherever required and then shall send the
reports to the Client to make the appropriate responses, within certain deadlines in respect of any actions
required. This shall be done within 3 working days of completing the inspection.

5.11.7 On receipt of the Compliance Report from the Client, the EHS Manager shall distribute copies to the
respective Engineers, (involved in the original inspection), for their comments and approval.
5.11.8 The Engineers shall take whatever actions are considered to be appropriate in order to confirm the
validity of the Client’ s report, relative to their individual disciplines, and then feedback their comments /
approval to the Asst. EHS Manager – Free Zones. Note : In case of unsatisfactory feedback and/or where it is determined that further e-inspections a e required
due to non-compliance by the client, re-inspection charge is levied at the published rate.

5.11.9 In case there is no/unsatisfactory feedback from the client within the stipulated time frames, two
reminders are sent to the client and meetings may be arranged, informing him of necessary actions to be
completed. This may be followed up by Warning Notices and/or Financial penalties as per BU Rules in
extreme cases of non-compliance.
5.11.10 On receipt of the total approved feedback, the EHS COO/Manager shall approve the OFC. Thereafter
the OFC is printed and collected by the client.
5.11.11 On issuance of the OFC, a checklist of EHS requirements may be also attached with the OFC that
enumerate the requirements that need to be adhered/submitted on an annual basis. This shall serve as an
EHS checklist for the BU client/project to refer during the year and on expiry of their OFC.
Note : This shall enable the clients to have a ready reference of EHS general monitoring/testing/documentation
requirements that need to be adhered every year rather than waiting for the inspections/reports.
5.11.12 Payment of OFC Issuance Fees shall be made in line with EHS Tariff, either through JAFZA Oracle
Software (JAFZA Customers) or accepted by cheque in the name of “ Dubai World Corporate
Services” payable at DWCS Cashier, near Gate No. 3.
5.12 Check Operational Sustainability, Environmental Compliance & Issue Environmental Permits (ECP)
5.12.1 On receipt of the total approved feedback (Including Operational Sustainability Certification from 3rd.
party) on the Green Building and Environmental Compliance Requirements, and approval of the OFC, the EHS
Manager shall prepare Sustainability, Environmental Compliance Permit(s) wherever applicable forward it EHS
COO for signature.
5.12.2 The EHS Manager shall then notify the Client that the Permits are available and also issue the schedule
for Pollution Monitoring Requirements for the next one year (until OFC Renewal). This may be included in the
Environmental Permit itself or separately issued.
5.12.3 The Pollution Monitoring requirements as mentioned in the ECP or otherwise will then be followed up by
the EIA Inspector on a monthly/quarterly/ half-yearly/annual basis as scheduled. The Asst EIA Manager shall
ensure that all requirements are complied/clarified by the client prior to renewal of the Operation Fitness
Certificate Renewal for the subsequent year.
5.12.4 Every year, the end-user (for built facilities) shall need to obtain and submit to EHS, 3rd. party
Certification confirming compliance with Green Building operational requirements.
5.13 Random Inspections
5.13.1 Subsequent to issuance of the Operation Fitness Certificate, EHS requirements may be followed up by

the EHS Officer on a case-by-case basis, as scheduled and ensure that all EHS requirements are complied.
(See Guidelines – Risk Matrix)
5.14 OFC/ECP Renewal
5.14.1 The EHS Manager shall receive/ascertain electronically intimation of License/ OFC expiry, which shall
be on an annual basis. Alternatively, this could also be as a receipt of intimation from BU Administrationregarding license renewals. For all Group Projects, the OFC shall be valid for a period of one year (Usually at
the time of License renewal), renewable each year
5.14.2 Based on the above, inspection logs are created for these establishments and inspections will be
carried out without prior intimation to the clients.
5.14.3 The process for the OFC inspection/reporting shall then be repeated, but shall normally only involve the
EHS Department (other departments may be involved at the discretion of the EHS Officer), which shall make
appropriate judgement on the need to involve other departments. Key points only shall be assessed and
confirmed for renewal.
5.14.4 The Sustainability and Environmental Compliance Permits shall also need to be renewed with the
Operation Fitness Certificate. In the same regard, the EIA/ Pollution Control Inspector shall also be involved in
the OFC/ECP Renewal process in terms of compliance and/or revised (if any) environmental
compliance/reporting requirements.
5.14.5 A new OFC with original OFC approval (date), current OFC date and OFC Expiry shall be issued to the
client. Similarly a new Sustainability Permit and ECP shall be prepared and issued to the client.
Note : OFC Renewal /License Expiry Dates and proposed inspection Dates shall be sha ed with relevant
departments of EHSS to enable minimization of inspections.

5.15 OFC/ECP Amendment
5.15.1 Wherever an existing company/client modifies/adds to his facilities/ activities, his existing OFC and/or
ECP needs to be amended to reflect the changes facilities/ activities. In the same regard, the OFC procedure
as above shall be followed.
Note : In case of facility modifications, the process of NOCs, Building Completion Certification from CED will be
mandatory prior to the OFC amendment process.
5.15.2 Instances of OFC Amendment include (not limited to) the following :
a) Construction of Additional facility/Modifications/Expansions (New BCC)
b) Additional lease (EHS-CLNT-PROC-013)
c) Activity Amendment (EHS-CLNT-PROC-014)
d) Additional Licenses (EHS-CLNT-PROC-014)
e) Additional Machinery or Machinery Modifications (EHS-CLNT-PROC-003)
5.15.3 Instances of ECP Amendments include (not limited to) the following :
a) Additional Waste mitigation Equipment
b) Changes in Waste/Effluent generations
c) Changes in Waste/Effluent quality

5.16 EHS Facility Termination Compliance
5.16.1 Receive intimation for facility termination approval – AUTHORITY/BU Administration shall intimate theEHS of any proposed Facility (Land, pre-built unit) terminations. This intimation shall be routed to the EHS
Manager, who shall in turn assign the EHS Officer to inspect the site/facility.
5.16.2 Inspections - The Inspectors shall inspect the Facility and submit his comments (See Forms – Lease
Termination Form) to the EHS Officer who shall in turn forward the same to the AUTHORITY/BU Admn. Dept.
or the client directly (with a copy to Admn. Dept.) for their necessary action. The inspector shall take into
consideration EHS non-compliance during the period of the client's operations and the inspection comments
may also require the client to carry out certain investigations (at the client's cost) to determine future
environmental suitability of the premises/facility.
5.16.2 Compliance - The client shall then comply with the required actions and forward a compliance report,
based on which a re-inspection shall be carried out. In case of non-compliance, pending requirements shall
again be communicated to the client/ Admn. Dept.
5.16.3 Certify EHS Compliance of Facility Termination - On compliance with all required recommendations of
the EHS Dept., the Manager shall issue an EHS Compliance Termination Certificate.
5.16.4 This Certificate shall be shared with Admn. Department to enable completion of legal/administrative
formalities in regard to Facility Termination.
5.17 Miscellaneous
