Dear Sir(s) 1. Your offer for the above work for Rs.10,90,83,362/‐ (RUPEES TEN CRORE NINETY LAKH EIGHTY THREE

THOUSAND THREE HUNDRED AND SIXTY TWO ONLY ) is accepted by the competent authority. The accepted schedule of items showing the rates and quantities is enclosed herewith. The completion period of the work is 12 (TWELVE) months from the date of issue of this letter. This Letter of Acceptance constitutes a binding contract between you and the Railway Administration. Please quote UCC in all further correspondence.

2. The Security Deposit (SD) for the contract is Rs.54,54,168/‐ (RUPEES FIFTY FOUR LAKH FIFTY FOUR THOUSAND

ONE HUNDRED AND SIXTY EIGHT ONLY). The Earnest Money Deposit of Rs.7,41,910/- remitted vide DR of Kuber Yojana Deposit Scheme No.123115 dated 18/10/2016 issued by UCO BANK, HYDERABAD, by you along with the offer is adjusted towards a part of the SD. The balance SD of Rs.47,12,258/-will be recovered from the running bills of the contract @ 10% of bill amount from each bill. Please note that no interest will accrue on the Security Deposit.

3. A Performance Guarantee (PG) for Rs.54,54,168/‐ (RUPEES FIFTY FOUR LAKH FIFTY FOUR THOUSAND ONE

HUNDRED AND SIXTY EIGHT ONLY) is to be submitted by you within 30 (thirty) days from the date of issue of this letter in the forms mentioned in clause 4.0 (b) of Special Conditions of Contract. The PG shall be valid up to 60 days beyond the stipulated date of completion.

be accorded by the Contract Agreement signing Authority. However, a penal interest of 15% per annum shall be charged for the delay beyond 30 (thirty) days on a daily basis i.e., from 31st day of the date of issue of LOA. In case you fail to submit the requisite PG even after 60 days from the date of issue of LOA, the contract shall be terminated duly forfeiting the EMD and other dues, if any payable against the contract and you shall also be debarred from participating in re‐tender for the work. The PG will be released after satisfactory completion of the work as per the contract conditions. If the contract is rescinded, the SD shall be forfeited and, the PG shall also be encashed. Further, you will be debarred from participating in the tender for executing the balance work

2. You shall execute an agreement for the work within seven days from the date of receipt of notice by Railways regarding

readiness of the agreement. The detailed programme of work to be submitted by you in conformity with the milestones given below or even earlier, shall be as stipulated in the special conditions. The programme shall indicate the time schedule of various items of works in the form of Bar Chart/PERT Chart/CPM Chart. The programme should also include the details of organization (in terms of labour and supervisors), plant and machinery intended to be utilized from time to time for execution of the work within the stipulated date of completion. In case of non‐submission of acceptable programme of work within 15 days of issue of this letter, you are liable for penal action including levying fine up to Rs. 50,000/‐.

NOTES: 1.1 Each tenderer at the time of tendering shall submit the test report of ballast forimpact value, abrasion value and water absorption value from railway laboratories or approvedlaboratories mentioned in tender document in accordance with the Railway specification and IScodes as per provision of "Specification of Track Ballast, IRS‐GE‐1, failing which the offer is liable to be rejected. Test report shall indicate the name of the quarry from where the sample issubmitted. 1.2 Tenderer shall submit along with offer, adequate proof of having made sufficientarrangements by way of tie up of either existing quarries or new quarries intended to be setup for timely supply of ballast. 1.3 The tenderer shall also furnish an undertaking that the ballast supply at all times willconform to Specification for track Ballast as specified by Railways. 1.4 Ballast's sample should satisfy the following physical properties in accordance with IS 2386Pt‐IV‐1963 when tested as per the procedure laid down in Specification of Ballast IRS‐GE‐1 June 2004 and amended from time to time. Abrasion Value ‐ 30% maxImpact Value ‐ 20% maxWater absorption ‐ 1%. 1.5 Ballast should satisfy the following size and gradation: a) Retained on 65mm sq mesh sieve ‐ 5% Maximumb) Retained on 40mm sq mesh sieve ‐ 40% to 60%c) Retained on 20mm sq mesh sieve ‐ Not less than 98%. 1.6 In case gradation of ballast in a stack does not conform to required gradation, payment for thestack will be reduced as below: i) In case ballast retained on 65mm sieve exceeds 5% but does not exceed 10% payment at 5%reduction in agreement rate shall be made for full stack. ii) In case ballast retained on 40mm square mesh sieve exceeds 60% limit prescribed payment

Notes: 1. This item consists of 3 stages of payment as mentioned in the sub‐items. The first 3 stages are for a lead of 150 m, the next 3 stages are for a lead between 150 m and 750 m and the last 3stages are for a lead between 750 m and 5000 m. Dumping shall be undertaken in these 3 stagesas instructed; 2. While operating sub‐items d, e and f, sub‐ items a, b and c need not be and shall not be operated as sub‐items d, e and f are all‐inclusive and not extra over sub‐ items a, b and c. (i) Fixing guard rails on bridges with 60 kg / 52 kg / 90R rails (supplied by Railways) as per the provisions of IRPWM without rail traffic block during day / night including cutting and bending ofrails with all fittings and fastenings and drilling of holes in PSC sleepers (if necessary) withcontractors drilling machine and contractors drill bits; (ii) Fixing Railways wooden nose blocks at the ends of guard rails on either end of the bridgeincluding fixing grip expansion bolts and nuts, M.S. clips, washers etc. All of the above shall be executed with contractor's skilled personnel, tools and plant, vehicles, machinery, fuel, consumables, loading, unloading with all incidental charges and in all kinds ofweather conditions and site conditions including crossing of tracks wherever required dulyobserving all safety precautions and including all lead, ascent, descent, taxes, duties, cess,surcharges, fees etc. completely as per the special conditions / specifications / regulations, asdirected by the Engineer‐in‐Charge and as per the note(s) below. Note: Drilling of holes in sleepers (if executed) shall be paid separately.
