SANTA CLARA COUNTY, CALIF.

The California Supreme Court unanimously upheld the Legislature’s power to abolish redevelopment agen-cies (“RDAs”) statewide. This decision adopted argu-ments made by the County of Santa Clara (“County”), a party to the case. The re-sult is that scarce public dol-lars will return to schools, counties, fire districts and other local agencies to per-form vital public services.

California Supreme Court Upholds Legislature’s Decision to Abolish Redevelopment Agencies

The County joined as a respondent in the case, California Redevelopment Association et al. v. Ma-tosantos et al. (California Supreme Court Case No. S194861), shortly after it was filed. The controversy centered on the validity of two legislative bills that were passed as part of the state’s FY 2012 budget. The first, ABX1 26, abolished all redevelopment agencies in the state through an or-derly wind-down process. The second, ABX1 27, cre-

ated a new voluntary rede-velopment program. The Court unanimously upheld ABX1 26; and, by a 6-1 vote, it struck down ABX1 27 as a violation of Proposition 22. The end result is that redevelopment agencies throughout the state will be required to wind-down operations and public dol-lars will be returned to local governments as redevelop-ment debts are fulfilled.

“Redevelopment has had a huge negative effect on local governments’ abil-

ity to provide basic pub-lic services,” said Miguel Márquez, Santa Clara County Counsel. “Prior to yesterday’s ruling, redevel-opment agencies received 12 percent of all property tax revenue in the state. The Court affirmed that the Legislature may abolish redevelopment agencies to better serve the needs of all Californians during these difficult economic times.”

In Santa Clara County alone, this decision will eventually mean a return of $90 million annually that can be used for critical health

and safety services and vi-tal infrastructure provided by the County, and over $150 million annually for schools within the County.

“This decision does not mean an end to economic development or redevelop-ment activities, just an end to the diversion of money to redevelopment agencies,” said Jeffrey V. Smith, Santa Clara County Executive. “In fact, the County – which does not have its own rede-velopment agency – already plays a large role in job cre-ation, public safety and eco-nomic development. The

Court’s decision will help the County address the enor-mous needs in public safety, health care, and transpor-tation infrastructure such as roads and expressways.”

“We look forward to implementing the careful wind down of redevelop-ment that the Legislature directed,” said Vinod Shar-ma, Santa Clara County Di-rector of Finance. “We are pleased that the County’s participation in this case has led to the correct out-come, which will benefit schools and local govern-ments for years to come.”

WHO:   For drivers with outstanding traffic tickets that was due to be paid in full before January 1, 2009. All of the following also must apply:

• Those who either failed to appear in court or failed to pay in full.

• The last date you made a payment was on or before January 1, 2009.

• Those who don’t owe restitution to a victim on any case in the county where the traffic case was filed. 

• Those who have no out-standing misdemeanor or felony warrants in the county where the traffic case was filed.

• Other eligibility require-ments may vary from county to county

WHAT: The California Legislature mandated (As-

sembly Bill 1358) that all 58 counties implement a one-time amnesty period that al-lows a lump sum payment of 50 percent of the outstand-ing balance on certain viola-tions to fully satisfy that court ordered obligation.

Only traffic tickets that were due to be paid before January 1, 2009, are eligible. Parking tickets, driving under the influence (DUI), and reck-less driving cases are NOT eligible.

WHEN: The program be-gan January 1, 2012, and ends June 30, 2012.

HOW:  Payment may be made in whatever form is cus-tomary in your county, which

WHY:  A one-time infrac-tion amnesty program will do the following:

• Provide relief to individ-uals who have found them-selves in violation of a court-ordered obligation because they are financially unable to pay traffic bail or fines.

• Provide increased rev-enue at a time when revenue is scarce by encouraging pay-ment of old fines that have remained unpaid.

• Allow courts and coun-ties to resolve older delin-quent cases and focus limited resources on collecting on more recent cases.

• A one-time amnesty program for fines and bail meeting the eligibility re-quirements.

The 401k retirement plan, which was made avail-able to small businesses in the early 1980’s, is about to take a bigger role in the retirement planning for Americans. There are about 72 milliion people with about three trilliion dol-lars invested in their 401k retirement plans. With the abandonment of many tra-ditional plans that were based on salary and years of service (for example, de-fined benefit plans), self directed plans like 401k plans, IRA’s and annui-ties are growing rapidly.

Government policy has encouraged the use of 401k plans by granting ‘saver’s credits’ to participants thus paving the way to direct people to save for them-

selves and thereby mitigat-ing the reliance on the exist-ing social security system. A recent study by the U.S. Government Accountabil-ity Office reveals that many 401k plans have hidden fees that employer sponsors and employees have not been fully informed about. 401k plan legislation that will take effect in Apil 2012 now requires that there be Fee Transparency Disclosure moving forward. While many providers of 401k ser-vices were not disclosing fees properly, some providers do a good job of doing that.

What does this mean for the consumer-client? Honesty and full disclo-sure should be the only policy. If the employer or the participant is paying for a service they should be informed about all features and fees (costs).

Diversification is the

other issue. Many fund companies address di-versification by providing funds by different families and different sectors. This is no longer sufficient. We are in an international and global economy so we need funds outside the U.S.A. We are now more sensi-tive to green industries and lifestyle funds that invest in companies that don’t violate human rights.

To quote an old say-ing “We are not in Kan-sas anymore.” The 401k retirement plan of the future will provide more transparency, education, fund selection and more post-retirement planning. Let’s accomplish some-thing this 2012 New Year. What shall that be? There is no shortage of important matters which need to be addressed at any jurisdic-tional level. At the global level, a stable monetary en-vironment needs to be es-tablished in order to have the global economy become stabilized. At the national level, the domestic economy must become focused on recreation of manufacturing which provides the working class with jobs. In additon, the middle class needs to understand that their jobs will not come back. How-ever, new technologies will present many opportunities for those who are prepared and ready. This requires an effective educational system at all levels. At the local lev-el, the educational systems need to become more effec-tive in their efforts to teach students the basics needed to survive in the coming global society and its tech-nology. With respect to educating the poor minority child, the current education system needs to improve its ability to prepare a child for a future which requires an ability to adapt to new career opportunities which require the use of one’s logic, rhetoric, and mathematics with creative applications.

Something to be accom-plished is comprehensive income tax reform which today permits too many cor-porations and the wealthy to end up paying no income taxes at all. The income tax disparity must be corrected. The many forms of corpo-rate welfare must be ended,

2012 YEARespecially those that exist in agribusiness. Adminis-tratively, certain crops, such as corn, should not be used to produce more alcohol which is added to gasoline. This is especially so when such diversions create a food shortage with result-ing increased cost of food which the impoverished have no money to purchase.

Another accomplish-ment to be undertaken is to establish a comprehen-sive immigration reform act which puts an end to the inappropriate legisla-tive activities at the state level. At the minimum, the proposed American Dream Act needs to be en-acted by the U.S. Congress.

Then there is the need to accomplish something with respect to the escalation of health care costs and pre-scription medications. Big pharmaceutical companies need to explain why certain medicaitons cost so much in America while being sold at lower prices beyond our bor-ders. Health care costs must be contained in the near fu-ture because, at present, any serious illness ends up cost-ing the family its retirement fortune, especially for the underinsured or uninsured.

Health care insurance and aid to our impoverished and disabled must be ac-complished. There are too many more individuals who have become poor under the economic practices which enable corporations to move manufacturing and infor-mation technology jobs be-yond our domestic borders.

A national housing policy needs to be developed be-cause the current real estate market does not protect the home buyer at all especially when the wage earner’s job is outsourced. Mort-gage adjustments must become a priority for the Office of Consumer Affairs.

Another accomplish-ment is that unions must not lose their colletive bar-gaining rights. In additon, the unions representatives must understand that any retirement pension pro-posal must be subjected to actuarial analysis to determine if the jurisdic-tion and its taxpayers can afford to agree thereto.

Let’s not forget that this is an election year where we either elect a new president or re-elect the current presi-dent. An accomplishment is to reconstitute the make-up of Congress to eliminate the current ‘do-nothing for the people’ climate. The elector-ate will have a choice: Elect senators and representa-tives who will deal with the establishment of checks and balances which permit the fair distribution of wealth. The middle class and work-ing class sectors of American society are suffering today from excessive unemploy-ment and lack of health care insurance benefits because health care insurance is coupled with employment.

None of the above will happen if the makeup of the U.S. Congress, as well as that of many state leg-islatures, is not changed through the election pro-cess. The coming election of November 2012 is going to determine if any of the above gets accomplished by the next Obama adminis-tration (if President Obama is elected to a second term) and if the partisan make-up of the U.S. Congress is changed to favor the pas-sage of legislation which fairly deals with disparities of all kinds which currently afflict our American society. One thing is certain: the voter, especially the His-panic voter, needs to decide to accomplish something during this New Year 2012.

¡Para empezar tiene que estar vivo! Porque hasta donde la ciencia ha dado noticia los muertos no leen. Ya es, estar vivo un gran motivo de agradecimien-to y un privilegio, ¿no?

Tiene la capacidad de sostener el periódico en sus manos. ¿Ha pensado alguna vez en la cantidad de perso-nas que no pueden hacerlo?

¡Puede leerlo! Son in-mensos los índices de anal-fabetismo en el mundo, y si, en Estados Unidos también hay analfabetismo. Usted no es un analfabeta. Eso es ya una gran ventaja. Tiene el mundo de los libros y el conocimiento a su alcance.

Pero como si fuera poco puede pensar y puede deci-dir. En este momento, por ejemplo, puede estar pen-sando, para dónde va esta columna y decidiendo, línea por línea, si quiere seguir-

Pues bien, si sigue leyen-do, lo mínimo que puedo ha-cer es darle las gracias. Aquí va mi mensaje de año nuevo:

¡Somos privilegia-dos! ¡Disfrutémoslo!

Cada vez que tenemos la gloria de abrir los ojos por la mañana y empezar ese nuevo día, esa nueva oportunidad de ser feli-ces, somos privilegiados.

Cada día es una opor-tunidad más para hacer las cosas que nos gustan, para estar con la gente que queremos, para avanzar en las metas que nos hemos propuesto, ¡para ser feli-ces! porque al fin y al cabo ese es el propósito… ¿o no?

Claro, a veces nos dis-traemos y se complica la cosa, porque siempre es más fácil pensar en lo que no tenemos, en aquello que deseamos y olvidarnos de todo lo que si tenemos.

Pues bien, empecemos por agradecer lo que tene-mos. Si continuamos nues-tro camino por esta vida con alegría y optimismo segura-mente vamos a llegar a don-de nos propongamos llegar.

Somos privilegiados por-que hay mucha gente que nos quiere. Esta bien, tal vez mucha de esa gente no está a nuestro lado, pero igual nos quiere. Tenemos el pri-vilegio de ser queridos. Se lo digo por experiencia, el co-razón no conoce fronteras. Esas personas que nos quie-ren nos quieren de verdad y el cariño es una bendición.

Puedo seguir haciendo la lista de los privilegios de todos los días, pero esa se la dejo a usted. Es bueno que tenga metas para este año que comienza, claro que si. Pero empiece dando las gra-cias por todo lo que tiene, sea consiente de todas sus ventajas. Piense en todo lo que ha invertido para llegar hasta donde está y siénta-se orgulloso de usted mis-mo y valore sus privilegios.

Acaso disfruta aun del cariño de sus padres, o tiene el privilegio de ser usted mismo un buen pa-dre, un buen esposo o tal vez tenga el privilegio de tener un hermano incom-parable o un gran amigo. Se lo aseguro, usted es un privilegiado y en la medi-da en que lo sepa, será más feliz. Le deseo un 2012 lle-no de privilegios y alegrías.

Aunque las cataratas es la causa principal de la pérdida de visión en todo el mundo, los mitos aún per-sisten acerca de sus causas y tratamiento. Las catara-tas afectan a cerca de 22 millones de americanos a partir de los 40 años. A la edad de 80 años más de la mitad de los americanos tie-nen cataratas según el Ins-tituto Nacional de la Visión.

“Las cataratas no pue-den prevenirse pero pueden tratarse” afirma Richard P. Mills, MD, “y la mejor forma de asegurarse de que la vi-sión sigue sana a lo largo de nuestra vida es visitando al oftalmólogo. Más del 90 por ciento de las personas que tienen operaciones de cata-ratas vuelven a tener visión”.

En la noche del 5 de ene-ro cada año llegan los reyes magos a dejar regalos a los pequeños que se portan bien durante todo el año que aca-ba de terminar. Como toda buena tradición se empieza por dejar un zapato abajo del árbol navideño y lo peor de todo es esperar a que salga el sol para descubrir que fue el regalo dejado por Melchor, Gaspar y Baltasar. Ya después entrado el día la familia se junta para partir la rosca de reyes la cual lleva escondida muñequitos los cuales representan al niño dios, al afortunado de cor-tar el pedazo de rosca con el muñeco tiene que hacer tamales los cuales se ten-drán que pagar el día 2 de febrero, día de la candelaria.

Particularmente conmi-go siempre fue la ansiedad lo que me dejaba sin dormir esa noche, las ganas de po-der jugar con mis juguetes. Creo que ese es el mayor martirio para un niño en esta época del año. Recuer-do que en un año los reyes me trajeron una pista de carreras con una bicicleta y bota de dulces de las que no se encuentran en este país, a mi hermana, la más grande, le trajeron una mu-ñeca y unos patines y a mi hermana la mas chica, solo unos cubos y unos muñecos de peluche cada una con sus respectivas botas de dulce.

Recuerdo lo mejor era el despertarse temprano para jugar con los vecinos y ver que habían recibido ellos en sus respectivas casas y el jugar hasta tarde todo el día sin que tu mama te dijera que tenias que ir a la escuela al día siguiente ni nada por el estilo. Ya que en México el día 6 de Enero siempre suele ser festivo y nadie tra-baja creo que eso lo agra-decen los papas también.

El guardameta de Real Madrid se colocó por cuarto año como el mejor con 248 puntos, superando y por mucho al alemán Manuel Neuer del Bayern Munich quien acumuló 130 unida-des en la votación realizada por miembros editoriales y expertos, quienes confor-man el comité de elección.

El capitán de Real Ma-drid antes fue nombrado segundo mejor portero de la primera década del Siglo XXI por la IFFHS, terna en la que fue superado por el italiano Gianluigi Buffon, mientras que en la clasifica-ción del mejor de la historia ocupa el tercer lugar, después de Buffon y el danés Peter Boleslaw, retirado en 2003.

“Nos satisface saber que el público de esos paí-ses recuerda con cariño a ‘Cantinflas’ y celebran su legado, a 100 años de su natalicio. Estamos orga-nizando la manera en que llevaremos esta exposición que ahora tendrá un carác-ter de itinerante”, apuntó en entrevista con Notimex.
