September 2017: Governor Scott issues Emergency Power Rule Requires all ALFs and Nursing Homes to have an

emergency power plan

Plans must ensure climate control system can be sustained in the event of an extended power outage

March 26, 2018: Governor signs legislation into law Defines specific criteria for duration of

emergency power and safe temperatures Plans are due to OEM by April 26, 2018 Plans must be implemented by June 1, 2018

Applies to 115 ALFs and 34 Nursing Homes in Orange County

State Rules require facilities to: Maintain an alternate source of power Ensure ambient temperatures can be kept at 81oF or less for up

to 96 hours after loss of primary power Store enough fuel on-site to run the alternate source of power

for specified time periods (varies by facility size) Submit plan to local Emergency Management for approval Comply with local zoning and Florida Building Code for location

of alternate power source

Criteria have been developed to standardize the plan review process and facilitate approval

Resubmit plan with changes if not approved

Facility forwards approval letter to AHCA within 2 business days

If approved, letter is issued by OEM to the facility

Florida law requires Assisted Living Facilities and Nursing Homes to develop and implement an Emergency Power Plan

EPPs are due to the local emergency management agency for review by April 26, 2018

EPPs must be implemented by June 1, 2018

Orange County has developed a process to facilitate compliance by affected agencies

The Office of Emergency management will assist as needed to help agencies achieve compliance with the new rules

Regulatory authority for failure to comply – by way of sanctions, fees or penalties – is primarily a function of AHCA
