Roman

Hussein, how are you?

All is well! How about you?

Everything is great! I am just coming back from a seminar at Manitoba Start. It was about employee rights in Manitoba. What an eye-opener! I learned so much!

Well, for one thing, we learned about things like vacation pay and overtime pay.

Sounds interesting! What kinds of things did you learn?

Hmmmm…. It is good to know about things like that. Don’t employers have to pay us more if we work more than 40 hours a week?

Yes, in most cases. And we also learned about the right to take certain leaves.

Certain leaves? What is that all about?

Basically that employees have the right to take time off work, in some situations.

Oh yes, I heard that employees can take time off to attend a funeral for a family member, or to take care of a sick child, for example.

Right! There are also laws and rules in place for things like statutory holidays and termination of employment.

You got it!

I think that if we work on a stat holiday our employer has to pay us extra right? I think it’s called time-and-a half, or something like that?

You sure covered a lot of ground. I wish I could have attended that seminar with you!

Don’t worry! This is a two part seminar. You can attend with me tomorrow. The meeting is at 7:00. We are going to learn about the right to refuse work and employment deductions.

Ok, see you then!

That would be wonderful. Can you be at my house by 6:30?

I would love to! Do you mind if we carpool?

Case studies

Activity 5

Page 65: Employee rights in manitoba

Case Study 1

Simbaljeet’s employer deducts money from her pay to pay for coffee in the lunch room, but she doesn’t drink coffee. She wonders if this is fair.

What do you think?

Page 66: Employee rights in manitoba

Case Study 1

Generally, employers can only deduct money if the employee agrees to pay for something that is a direct benefit to them.

Page 67: Employee rights in manitoba

Case Study 2

Jack took a day off to attend a funeral for his uncle. He took the day off, but his employer didn’t pay him for the day.

Was this legal?

Page 68: Employee rights in manitoba

Case Study 2

Yes! Only domestic violence leaves are required to be paid for by the employer.

Page 69: Employee rights in manitoba

Case Study 3

Roman earns $20.00 / hour. He usually works 8 hours a day, but one day he worked 10 hours. He wonders how much he will earn for those extra two hours.

What would you say?

Page 70: Employee rights in manitoba

Case Study 3

Roman would earn $60.00.

$20x1.5x2=$60.00

Page 71: Employee rights in manitoba

Case Study 4

Jon went to work for 2 weeks at a local convenience store. He was told that he would not get paid for those weeks because it was his “probationary” period..

Any thoughts?

Page 72: Employee rights in manitoba

Case Study 4

This was not correct! Employers must pay their employees for each and every hour worked.

Page 73: Employee rights in manitoba

Case Study 5

Will he get paid for this day?

Marcos works 40 hours a week. Last week a statutory holiday fell on a day that he doesn’t work.

Page 74: Employee rights in manitoba

Case Study 5

Because the general holiday fell on a day that Marcos does not normally work, his employer must give him a normal workday off with general holiday pay.
