    C L A R I F I C A T I O N

    The Honble Supreme Court (Bench of Hon. 7 judges) has delivered a judgment on 12/8/2005 in

    Civil Appeal No.5041/2005 in SLP (C) No.9932/2004 in respect of rights and entitlement of

    Government as against Private Professional Educational Institutions. This judgment expects

    enactment of legislation by Central Government and in its absence, by State Government in this

    regard. This process has been initiated. However it is not certain, as of this date, as to when

    such legislation will come into force, as also its provisions.

    In the meanwhile, in terms of the observations of the Honble Supreme Court from the

    aforesaid judgment, at least at this stage, it appears that State Government cannot claim any

    quota/seats in these colleges/institutions and consequently cannot effect admissions in these

    Private Engineering/Technology Colleges/institutions, except to the extent agreed by certain

    institutions, if any.

    It is therefore made clear that on the aforesaid interpretation and advice given to the

    State Government, this Brochure will not apply to the admissions to be effected in the academic

    year 2009-2010 at the Private Engineering/Technology Colleges/Institutions, in so far as

    undergraduate courses are concerned, with the above exception.

    However, it is made expressly clear that if, after issuance of this Brochure, either on

    account of any legislation or on account of any different interpretation/opinion/advice or due to

    any judgment/order passed by any court of law or even otherwise, the State Government is

    found entitled to any seat(s) in the Private Engineering/Technology Colleges/Institutions and

    consequently entitled to effect the admission(s) to such seat(s), the rules and regulations set out

    in this Brochure will be made applicable to such seat(s) and admission(s). In such event, a

    separate intimation will be issued with appropriate details.

    It is further clarified that separate information brochure will be issued at the time of

    filling of Application form for Centralized Admission form/option form giving details as to

    availability of number of seats, their institution wise, categorywise distribution as also rules and

    regulations governing such distribution and consequent allotment of seats of Government as also

    Private Engineering/Technology Colleges / Institutions, if any.

    It is also made hereby clear in no uncertain terms that the same Common Entrance Test

    (MHT-CET-2009) that is proposed to be conducted in terms of this Brochure will govern such

    admission(s), if any.

    RULES OF ELGIBILITY FOR MHT-CET 2009 AND FOR ADMISSION TO FIRST YEAR

    OF FOUR YEAR FULL TIME DEGREE COURSES IN ENGINEERING/TECHNOLOGY

    FOR THE ACADEMIC YEAR 2009-2010

    1.0 Introduction

    The entrance examination for the selection to all Health Science Degree Courses, Engineering and

    Pharmacy degree courses in State of Maharashtra for the academic year 2009-2010 shall be conducted

    by the Competent Authority appointed by Government of Maharashtra. The Common Entrance Test (MHT-

    CET 2009) will be held on Thursday, 7 th May 2009, at all the district headquarters in the State of

    Maharashtra.

    The Selection Process shall however be separate for degree courses in Health Sciences, Engineering andPharmacy. The respective Competent Authorities shall devise the system of Counseling/Allotment. This

    procedure shall be governed by the regulations and directions as specified by the Government of

    Maharashtra from time to time.

    This brochure gives the rules for the eligibility for appearing to the Maharashtra HealthTechnical Common

    Entrance Test 2009 i.e. MHT-CET 2009 , the eligibility for admission to first year of various courses in

    Engineering/Technology in the State of Maharashtra and also gives definition of various types of

    candidatures. These rules govern only the aspect of the Common Entrance Test and the eligibility of the

    candidates to appear at this examination.

    The rules and information regarding the Distribution of seats under various heads i.e. Home University,

    Outside Home University, Institute Level seats, Minority seats, AIEEE seats etc.; details of the Reservation

    of seats, Fees concession (if any) offered to eligible candidates, details of the Centralized Admission

    Process (CAP), details of the Admission rounds, Institute/course wise Information etc. shall be provided in

    a separate Information Brochure, which will be made available to the aspiring candidates at the time of

    filling up of the Application Form for Admission to Engineering/Technology Courses.

    It is specifically made clear that the CET proposed to be conducted in terms of these rules will also govern

    the admissions of the Autonomous Institutes [viz. i) Veermata Jijabai Technological Institute

    (VJTI), Mumbai, ii) College of Engineering, Pune, (Formerly Government College of Engg.,

    Pune) iii) Shri Guru Gobind Singhji Instit ute of Engineering & Technology (SGGSIET), Nanded

    iv) Walchand College of Engineering, Sangli. & V) Vishwakrm a Institu te of Technology, Pune(VIT)] and Deemed University i.e Institute of Chemical Technology (UICT), Mumbai . However the

    Admission process for these Autonomous institutes/Deemed University (and of any other Autonomous

    Institute upon receiving the permission from the State Government) will be separately carried out by the

    competent authorities appointed by these institutes. There will be a separate Information Brochure

    specifying the rules of admission to the above mentioned Autonomous institutes / Deemed University.

    1.2 Definitions:

    1. State Government means the Government of Maharashtra.

    2. Directormeans the Director of Technical Education, Maharashtra State.3. "Application Form" means prescribed form filled up by the candidate for appearing for MHT-CET

    2009.

    4. Appeal Committeemeans the Committee setup under the chairmanship of the CompetentAuthority, it shall deal with the representations submitted by the candidates/parents relating togrievances of the candidates with regard to MHT-CET-2009 examination and the selection process.

    5. Competent Authoritymeans the Authority designated or appointed by Government ofMaharashtra to conduct MHT-CET 2009, and declare the results. The respective Competent

    Authorities will supervise and control the selection process for the admission to Health Sciences,Engineering and Pharmacy degree courses and act as a chairperson of the Appeal Committee forrepresentations submitted by the candidates. The Competent Authority will issue necessaryexecutive instructions for implementation and provide relevant information to be published orcommunicated.

    6. Representative of the Competent Authoritymeans an officer appointed to assist Competent Authority for smooth conduct of Admission Process as per the directives of the CompetentAuthority.

    7. Center in-charge of the Districtmeans the District Collector or the officer(s) authorized bythe District Collector.

    8. Sub-Center in-Charge means the officer in-charge of the High School/College where the MHT-CET 2009 examination is being conducted.

    9. Divisional Authoritymeans the Dean/Officer(s) of specified Government Medical Colleges whowill be responsible to carryout the directions and instructions of the Competent Authority.

    10. Notified Collegesmeans the colleges/institutions responsible for distribution of informationbrochures and application forms for MHT-CET-2009 examination, receipt of the application formsfrom the School/Jr. colleges, collection & distribution of admit cards and mark sheets of MHT-CET-2009 examination.(Refer Annexure - A)

    11. Qualifying examinationmeans examination on the result of which a candidate becomeseligible to appear at MHT-CET 2009 entrance examination. i.e. HSC(12th standard) or equivalentexamination

    12.College or Institutionmeans Engineering College or Technological Institution duly approvedby the AICTE and Government of Maharashtra to impart Education in Engineering/ Technology atthe degree level.

    13.Government Engineering Collegemeans the Engineering College run by the Government ofMaharashtra.

    14. Government Aided Engineering Collegemeans Engineering College run by privatemanagement but which receives financial assistance from the Government of Maharashtra.

    15. University Managed Engineering Collegemeans Engineering College run by a particularUniversity.

    16. University Departmentmeans a department of University which offers four year degreecourses in Engineering/Technology.

    17. Autonomous Institutemeans the institute for which autonomy is granted by the Governmentof Maharashtra.

    18.Un-Aided Engineering Collegemeans Engineering College run by private management on selffinancing basis.

    19. Sanctioned Intakemeans the course wise number of seats sanctioned by the GovernmentResolution with reference to the AICTEs approval.

    20. Inter se meritmeans the order of merit as defined by Maharashtra State Merit list/Home

    University area merit list/All India (AIEEE) Merit list/J & K Migrant Merit list as the case may be.21. Candidatemeans an applicant who is an Indian National and desires to appear for MHT-CET-

    2009 with an intention to seek admission to first year of four year Degree Courses inEngineering/Technology in Maharashtra State by submitting the prescribed application form for theyear 2009-2010.

    22.Defencemeans services established under the Army Act 1950/Airforce Act 1950/Navy Act 1957.23. F.E. Admissionmeans the Admission to first year of four year degree courses in Engineering /

    Technology.24.Persons of Indian Origin (PIO): A Person having foreign citizenship (except Pakistan and

    Bangladesh) without NRI status, who holds a Foreign Passport at the time of sending application,consideration for admission and during the period of his/her study, and he/she or any one/both ofhis/her parents or any one/both of his/her grand parents is (or was)/are (or were) citizen(s) ofIndia by virtue of the provisions of the Constitution of India or Sec. 2(b) of Citizenship Act, 1955

    (Act No. 57 of 1955).25.OMS candidatemeans Outside Maharashtra State candidate who is an Indian National.26.Foreign N ationalsmeans Citizens of all countries other than India, who are not of Indian origin

    as defined under PIO.27. Foreign Studentmeans Foreign Student in this context shall be defined as the student who

    possesses a foreign passport.28.CAP Seats These are the seats for which allotment/admission is carried out by the Competent

    Authority through CAP29.NRI : Non Resident Indian as per the definition given in the section 6 of the Income Tax Act

    1961.

    30. NRI Candidatemeans a candidate who is a child/ward of the person who has the NRI statusas defined under section 6 of the Income Tax Act.

    2.0

    Eligibility Criteria:

    2.1 Eligibility of Maharasht ra State Candidate and OMS candidate forappearing for MHT-CET-2009:

    Candidate should be an Indian National and should have passed/appeared* the HSC (Std.XII) examinationof Maharashtra State Board of Secondary and Higher Secondary Education or its equivalent examinationwith subjects English, Physics, Chemistry and Mathematics.

    Note:

    *Candidates who have appeared for the qualifying examination i.e. HSC (Std. XII) or its equivalentexamination during the academic year 2008-09 and whose results are not declared till the last dateof submission of application form are eligible to appear for MHT-CET-2009, however for admissionto first year of degree courses in Engineering/Technology, such candidates must fulfill the eligibilitycriteria as mentioned in rules 2.2 to 2.10 as applicable.

    Maharashtra State candidates (defined as per rule no. 3.1) and OMS candidates (defined as perrule no. 3.2) are eligible to appear for the MHT-CET-2009 conducted by the Competent Authorityof Government of Maharashtra for the academic year 2009-2010.

    Even though Outside Maharashtra State (OMS) candidates are eligible to appear for the MHT-CET-2009, it is specifically made clear that such OMS candidates will not be able to participate inthe Centralized Admission Process on the basis of score in MHT-CET 2009. These OMScandidates will be able to apply for the admissions against the Institute Level seats as well as thevacancy round of admission after completion of Centralized Admission Process, ONLY in theUnaided Private Engineering Colleges/ Institut es on the basis of score in MHT-CET 2009.

    The facility of Constitutional Reservation (Annexure-II) is not available for the OMS candidates.Therefore all OMS candidates will be treated as OPEN/GENERAL category candidates in theentire admission process.

    2.2 Eligibility criteria for Maharashtra State Candidate and Outside

    Maharashtra State Candidate for admission to first year of degree courses inEngineering/Technology:

    Candidate should be an Indian National and should have passed the HSC (Std.XII) examination ofMaharashtra State Board of Secondary and Higher Secondary Education or its equivalent examination withsubjects English, Physics, Chemistry and Mathematics AND Secured minimum 50% marks i.e. not lessthan 150 marks out of 300 marks (minimum 45% marks i.e. not less than 135 marks out of 300 marks incase of candidates of Backward class categories belonging only to Maharashtra State) in the subjectsPhysics, Chemistry and Mathematics added together AND Obtained a non zero score in subjects

    Physics, Chemistry and Mathematics added together at MHT-CET 2009.

    2.3 Eligibility Criteria for All India (Paper-I of AIEEE-2009 qualified)

    candidates: [both the Maharashtra Candidates i.e. Type A, B, C, D, E and F(refer rule no. 3.1) and the OMS candidates (refer rule no. 3.2)]

    Candidate should be an Indian National and should have passed the HSC (Std.XII) examination ofMaharashtra State Board of Secondary and Higher Secondary Education or its equivalent examination withsubjects English, Physics, Chemistry and MathematicsAND secured minimum 50% marks i.e. not lessthan 150 marks out of 300 marks (minimum 45% marks i.e. not less than 135 marks out of 300 marks incase of candidates of Backward class categories belonging only to Maharashtra State) in the subjectsPhysics, Chemistry and Mathematics added togetherAND Candidate should have a valid AIEEE Score (i.e.total score should be positive) for the year 2009-2010.

    2.4 Eligibi l ity Criteria for Foreign National/Foreign student/ PIO/ Children of

    Indian w orkers in the Gulf countries/ Children of NRI

    Candidate should have passed the HSC (Std.XII) examination of Maharashtra State Board of Secondaryand Higher Secondary Education or its equivalent examination with subjects English, Physics, Chemistryand Mathematics and secured minimum 50% marks i.e. not less than 150 marks out of 300 marks in thesubjects Physics, Chemistry and Mathematics added together.

    The NRI candidates are eligible to apply for admission against the Institute level seats,only in Unaided Private Engineering Colleges/Institutes. The extent to which such NRIcandidates shall be admitted is limited to 15% of the sanctioned intake.

    The eligibility of the candidates passing the HSC (Std. XII) equivalent ex amination from aschool/college/Examination Board situate outside India shall be further decided by theUniversity Authorities to which the candidate is admitted. Hence such candidates areadvised to get their eligibility verified by the respective University Authorities beforeseeking admission to the Engineering courses in the State of Maharashtra.

    The candidate belonging to this type is not required to appear for the MHT-CET2009/ AIEEE 2009.

    2.5 Eligibility criteria for GOI nominees:

    Candidate should be an Indian National and should have passed the HSC (Std.XII) examination ofMaharashtra State Board of Secondary and Higher Secondary Education or its equivalent examination withsubjects English, Physics, Chemistry and Mathematics and secured minimum 50% marks i.e. not less than150 marks out of 300 marks (minimum 45% marks i.e. not less than 135 marks out of 300 marks in caseof candidates of Backward class categories) in the subjects Physics, Chemistry and Mathematics addedtogether.Note:- The candidate belonging to this type is not required to appear for the MHT-CET 2009/AIEEE 2009.

    2.6 Eligibility criteria for J & K Migrant candidates:

    Candidate should be an Indian National and should have passed the HSC (Std.XII) examination ofMaharashtra State Board of Secondary and Higher Secondary Education or its equivalent examination withsubjects English, Physics, Chemistry and Mathematics and secured minimum 50% marks i.e. not less than150 marks out of 300 marks in the subjects Physics, Chemistry and Mathematics added together.Note:- The candidate belonging to this type is not required to appear for the MHT-CET 2009/AIEEE 2009.

    2.7 Eligibility criteria for MK B candidates:

    In addition to the basic eligibility criterion mentioned in rule no. 2.2, candidates who have appeared &obtained a non zero score in the MHT-CET 2009 and belonging to the Maharashtra Karnataka DisputedBorder Area are required to fulfil following additional eligibility criterions.

    Candidates have to be from such villages/towns, from the Maharashtra Karnataka disputed borderareas, on which Maharashtra puts its claim (Refer Annexure I).

    The candidate should produce the certificate that his/her father/mother/candidate himself/herself is adomicile of Karnataka in the disputed border area as specified in the Proforma G1/G2 OR Thecandidate should produce the domicile certificate of his/her father/mother/candidate himself/herselfstating that he/she is a resident of a village mentioned in Annexure I.

    The candidate should have passed SSC (or equivalent) and/or HSC (or equivalent) from an Institutionsituate in the disputed border area. The candidate must produce a certificate from the Principal/HeadMaster of the College/School stating that the candidate has passed SSC/HSC (or equivalent)Examination from that Institution.

    Mother tongue of the candidate must be Marathi. The candidate must produce a certificate from thePrincipal/Head Master of the School from which he/she has passed the SSC (or equivalent)

    Examination, stating that the candidates Mother tongue is Marathi as per the original School record. Candidate should have passed SSC or HSC (or equivalent) Examination with Marathi as one of the

    subject.

    2.8 Eligibility criteria for Candidates who are sons/ daughters of Defenceservice personnel:

    In addition to the basic eligibility criterion mentioned in rule no.2.2, candidates who have appeared &

    obtained a non zero score in the MHT-CET 2009 and satisfying any one of the following criteria as are

    eligible to seek admission against seats for sons/daughters of defence service personnel.

    Candidate is a son/daughter of ex-service personnel who is domiciled in Maharashtra State (Def-1). Candidate is a son/daughter of active service personnel who is domiciled in Maharashtra State (Def-2). Candidate is a son/daughter of active service personnel (Def -3)

    Who is transferred to Maharashtra State but is not domiciled in Maharashtra State

    Who is not domiciled in Maharashtra State but his/her family is stationed in Maharashtra State

    under the provision of retention of family accommodation at the last duty station on the

    grounds of childrens education, provided further that, such candidate should have appeared

    and passed the HSC (Std.XII) examination of Maharashtra State Board of Secondary and

    Higher Secondary Education or its equivalent examination from a school/college situate in the

    State of Maharashtra.

    Note:

    This provision is NOT available to the children of CIVILIAN STAFF who is working/ who has worked with

    the Indian Defence Services.

    2.9 Eligibility criteria for Candidates who are Physically Handicapped:

    In addition to the basic qualification mentioned in rule no. 2.2, candidate who has appeared & obtained a

    2.11 Eligibility criteria of Candidates who have passed/passing Diploma inEngineering/Technology and seeking admission to First Year ofEngineering/ Technology in Unaided Insti tutes: ( Against Institute Level Seats,Vacant seats after the completion of CAP rounds)

    Diploma holders who have passed the Diploma course in Engineering/Technology with minimum of 50%marks and medium of instruction as English from the Polytechnics affiliated to MSBTE or AICTE approvedautonomous Polytechnics in Maharashtra State ( for Maharashtra State Candidates) or such polytechnicssituate inside/outside the State of Maharashtra ( for Outside Maharashtra State Candidates).

    Note:1. To resolve a tie i.e. more than one candidate securing equal aggregate marks in Final year of the

    Diploma exam, following order of preference shall be adopted: marks in Maths at SSC, Grand Totalat SSC.

    2. Eligible Diploma candidates (rule 2.11) shall be considered for Admission against the Institute levelseats, vacant seats existing after completion of the Centralized Admission Process in UnaidedPrivate Institutes only. The details of the admission process for filling application for admissionagainst vacant seats shall be made available in the separate information brochure.

    3. Such Diploma candidates (rule 2.11) are not eligible to appear for the MHT-CET 2009.

    General Notes:

    1. In case the maximum marks in individual subject is other than 100, convert the marks out of 100 for

    individual subject but do not round off these marks. If the sum of the converted marks of three

    individual subjects without rounding off works out to be a figure with fraction then fraction up to two

    decimal places will only be considered

    Example: If a candidate obtains 101 marks out of 200 in Physics, 86 marks out of 150 in Chemistry

    and 40 Marks out of 100 in Mathematics, then the sum of marks obtained works out to be 227 out of

    450 marks. If it is conveted out of 300, it works out to be 151.33. However if the marks in individual

    subjecte are converted out of 100, then the marks are as 50.5 in Physics, 57.3333 in Chemistry and 40

    in Mathematics. It means the sum of converted marks of individual subject is 147.8333, which is

    147.83 upto two fraction. Hence the candidate is not eligible for admission under OPEN Category.

    2. If letter grades are assigned instead of marks at SSC, HSC or its equivalent examination the

    candidate must obtain the certificate of conversion of letter of grades into marks from the competent

    authority where from the candidate haspassed the examination. The candidate should produce such

    certificate at the time of submission of application form. The Eligibility shall be decided based on the

    equivalent marks submitted by such candidates.

    3. If the candidate reappears for the qualifying examination (Std. XII or its equivalent) wit h all subjects

    then the marks obtained in the latest examination will only be considered for determining the eligibility

    Type FMaharashtraKarnataka DisputedBorder AreaCandidates.

    Refer Rules 2.2 and 2.7 for eligibilitycriteria

    Candidates will only be consideredfor 30% OHU seats of MaharashtraState of CAP. These candidates willalso be eligible for the seatsremaining vacant in Un-aidedInstitutes after the CAP round andfor additional round of Government,Government Aided, UniversityDepartments and UniversityManaged institutes.

    3.2 Outside Maharashtra State candidate:

    Type of candidature: OutsideMaharashtra State candidate

    (OMS)

    OMS candidate should be an Indian national, who is not satisfying any of the

    conditions Stated in Sr. No. 1,2, 3, 4,5,6 (i.e. Type A,B,C,D,E,F) of rule 3.1and should have passed HSC(Std. XII) examination from an institute situateoutside State of Maharashtra within India.

    Note: Claiming facility under Type B, C, D, E & F is optional and it is binding for the candidates to

    produce the documentary proof along with the application form for CAP to claim the facility. Candidate can claim only one type of candidature while submitting the application form.

    e.g. Candidates who are eligible to apply against the provision of Jammu & Kashmir MigrantCandidate seats as well as against the Maharashtra State seats are only entitled to claim for oneof these seats.

    Refer proforma A for Type-C, proforma B for Type-D/E and proforma H for Type-F candidates.The candidate should submit the certificate in the necessary proforma at the time of filling up of

    Application Form for CAP. Eligible OMS candidates shall be considered on the basis of score of MHT-CET 2009, for Admission

    to institute level seats as well as against the vacant seats existing in Unaided PrivateInstitutes, after completion of the Centralized Admission Process. The details of the admissionprocess for filling up vacant seats and the institute level seats shall be made available in aseparate information brochure.

    4.0 Assignment of merit number:

    4.1 Merit Number:

    4.1.1 Each eligible Maharashtra State Candidate (Rule 2.2) who has appeared for MHT-CET 2009 andobtained a non zero score in MHT-CET 2009 and submitted application form on or before the lastdate prescribed for the submission of Application Form for Admission to Engineering through CAPwill be assigned a provisional merit number.

    Merit of all eligible Maharashtra State candidates will be based on the MHT-CET 2009 score (out of200 marks) only; relative merit in case of a tie (i.e. equal marks in MHT-CET 2009) shall be

    resolved as per rule no. 4.2.

    4.1.2 OMS candidates should note that, a separate merit list of all eligible OMS candidates (Rule 2.2)shall be prepared based on the MHT-CET 2009 score (out of 200 marks) only, relative merit incase of a tie (i.e. equal marks in MHT-CET 2009) shall be resolved as per rule no. 4.2.

    Note:1. Merit list of M aharashtra State Candidates so prepared shall indicate a State level

    General Merit N o., State level Category Merit no. (as applicable), Home UniversityGeneral Merit No., Home University Category M erit no. (as applicable) etc.

    2. Assignment of a Merit number does not indicate or ensure admission to any seat.

    4.2 Relative merit in case of a tie:

    In the case of candidates securing equal number of marks in MHT-CET-2009, their relative merit will befixed on the basis of the following order of preference:

    (a )A candidate securing higher marks out of 100 in the subject of Mathematics in MHT-CET-2009.(b )A candidate securing higher marks out of 50 in the subject of Physics in MHT-CET-2009.(c )A candidate passing the SSC (Std. X) examination with higher aggregate marks out of 750.(d ) A candidate securing higher marks out of 150 in the subject of Mathematics at SSC (Std. X)

    Examination.(e)Birth Date of the candidate (Elder Candidate will be given preference)

    Note: While converting the marks e.g. out of 750, if the converted marks work out to be a figure withfraction, fraction up to two decimal places will only be considered.

    4.3 Change of Marks due to verification:

    If the marks in the qualifying examination are modified due to verification and the same is dulycertified by the Maharashtra State Board of Secondary and Higher Secondary Education or itsequivalent, the same shall be reported to the ARC incharge immediately.

    However the effect of the change will be taken into consideration only for the subsequent round(s)of admission.

    5.0 Conduct and Discipline

    Failure of the candidate in making full and correct Statements in the application form and/orsuppression of any information and/or submission of false documents shall lead todisqualification of the candidate for MHT-CET 2009 or even at later date during the AdmissionProcess. Such a candidate will be debarred from the examination as well as the entire selectionprocess. Therefore the candidate is required to make only such claims which could be

    substantiated by relevant original documents. Adopting any unfair means or engaging in malpractice in the examination shall render a candidate

    liable for punishment under, Maharashtra Prevention of Malpractices Act, Universities, Board andOther Specified Examination Act, 1982 and disqualify him/her for MHT-CET-2009 examination.

    If any person(s) or officer(s) dealing with the conduct of the MHT-CET-2009 are found engaged inact(s) that would result in the leakage of question paper or attempt to use or help in the use ofunfair means in this examination he/she shall be liable to prosecution under Indian Penal Code.

    Any issue not dealt here-in above will be dealt with, when arising, fully and finally by theCompetent Authority.

    A candidate belonging to Creamy Layer amongst the categories VJ/DT-NT(A), NT(B), NT(C), NT(D),SBC and OBC must note that the provision of reservation is NOT applicable to him/her. A candidateclaiming benefit of reservation under the categories VJ/DT-NT(A), NT(B), NT(C), NT(D), SBC and OBCabove will be required to produce Non-Creamy Layer Certificate in the name of the candidate asspecified in the Government Resolution No. CBC/10/2007/CR-15/MVK-5, dated 5th June 2007. This

    certificate should be valid upto 31 st March 2010. The format is given in (- E).

    However, such a Non-Creamy Layer Certificate shall be produced in any case on or before the last dateof filling up of Application Form for Admission to Engineering, failing which the category claim, will notbe granted.

    Certificate of the Indian Nationality:-

    The certificate of Indian Nationality, which is usually issued by the Tahshildar/Executive Magistrate/Dy.

    Collector of the concerned Taluka/District wherein the candidate ordinarily resides. In lieu of the

    Certificate of Indian N ationalityany one ofthe following certificate will also be acceptable-

    The School leaving Certificate indicating the Nationality of the candidate as Indian. Indian Passport in the name of the candidate, issued by appropriate authorities.

    Birth Certificate of the Candidate indicating the place of birth in India.

    Cut off date for the eligibility and/ or submission of claim(s):The eligibility and/or submission of claim(s) of the candidate shall be determined and/or decided for allpurposes including for applicability of all these Rules and Regulations by considering the last date ofsubmission of Application form for Admission to Engineering as the cut off date.It is made abundantly clear that if a candidate is found ineligible and/or fails to produce documents in

    support of claim(s) on the last date of submission of Application Form for Admission to Engineering, interms of these Rules and Regulations, and if such an ineligible candidate acquires the requisiteeligibility and/or produces documents after the aforesaid cut off date, such subsequent acquisition ofeligibility will not make an ineligible candidate eligible for any purpose whatsoever, muchless for thepurpose of admission.

    IMPORTANT NOTE: Admission under constitutional reservation seat will be governed by theMaharashtra Schedule Castes, Scheduled Tribes, Denotified Tribes (Vimukta Jatis), Nomadic Tribes,Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of)Caste Certificate Act, 2000 (Mah.     Para 10: (Benefits secured on the basis of false Caste Certificate to be withdrawn)(1) Whoever not being a person belonging to any of the Scheduled Castes, Scheduled Tribes,Denotified Tribes, De-notified tribes, (Vimukta Jatis), Nomadic Tribes, Other Backward Classes or

    Special Backward Category secures admission in any educational institution against a seat reserved forsuch Castes, Tribes or Classes, or secures any appointment in the Government, local authority or inany other company of Corporation, owned or controlled by the Government or in any Governmentaided institution or Co-Operative Society against a post reserved for such Castes, Tribes or Classes byproducing a false Caste Certificate shall, on cancellation of the Caste Certificate by the ScrutinyCommittee, be liable to be debarred from the concerned educational institution, or as the case may be,discharged from the said employment forthwith and any other benefits enjoyed or derived by virtue ofsuch admission or appointment by such person as aforesaid shall be withdrawn forthwith.(2) Any amount paid to such person by the Government or any other agency by way of scholarship,grant, allowance or other financial benefit shall be recovered from such person as an arrears of landrevenue.(3) Notwithstanding anything contained in any Act for the time being in force, any Degree, Diploma orany other educational qualification acquired by such person after securing admission in any educationalinstitution on the basis of a Caste Certificate which is subsequently proved to be false shall also standcancelled, on cancellation of such Caste Certificate, by the Scrutiny Committee.(4) Notwithstanding anything contained in any law for the time being in force, a person shall bedisqualified for being a member of any statutory body if he has contested the election for localauthority, Co-operative Society or any statutory body on the seat reserved for any of Scheduled

    Castes, Scheduled Tribes, De-notified Tribes, (Vimukt jatis), Nomadic Tribes, Other Backward Classesor Special Backward Category by procuring a false Caste Certificate as belonging to such Caste, Tribeor Class on such false Caste Certificate being cancelled by the Scrutiny Committee; and any benefitsobtained by such person shall be recoverable as arrears of land revenue and the election of suchperson shall be deemed to have been terminated retrospectively.

    Para 11: (Offences & Penalties)(1) Whoever,-(a) Obtains a false Caste Certificate by furnishing false information or filing false statements ordocuments or any other fraudulent means ; or(b) not being a person belonging to any of the Scheduled Tribes, De-notified Tribes, (Vimukt jatis),Nomadic Tribes, Other Backward Classes or Special Backward Category secures any benefits orappointment exclusively reserved for such Castes, Tribes or Classes in the Government, local authorityor any other company or corporation owned or controlled by the Government or in any Government

    aided institution, or secures admission in any educational institution against a seat exclusively reservedfor such Castes, Tribes or Classes or is elected to any of the elective offices of local authority or Co-operative Society against the office, reserved for such Castes, Tribes of Classes by producing a falseCaste Certificate; shall, on conviction, be punished , with rigorous imprisonment for a term which shallnot be less than six months but which may extent up to two years or with fine which shall not be lessthan two thousand rupees, but which may extend up to twenty thousand rupees or both.(2) No court shall take cognizance of an offence punishable under this section except upon acomplaint, in writing, made by the scrutiny Committee or by any other officer duly authorized by theScrutiny Committee for this purpose.

    Para 12: (Offences under Act to be cognizable & nonbailable)

    Notwithstanding anything contained in the Code of Criminal Procedure; 1973 --(a) offence punishable under section 11 shall be cognizable and non-bailable;(b) every offence punishable under this Act, shall be tried by any Magistrate of First Class in asummery way and provisions of sections 262except sub-section(2) to 265 both inclusive of this Code

    shall as for as possible may be applied to such trial.Para 13: (Penalty for issuing false Caste Certificate)

    (1) Any person or authority performing the functions of Competent Authority under this act, whointentionally issues of false Caste Certificate shall earn conviction, be punished with rigorousimprisonment for a term which shall not be less than six months but which may extend up to twoyears or with fine which shall not be less than two thousand rupees, but which may extend up totwenty thousand rupees or both.(2) No court shall take cognizance of an offence punishable under this section except with the previoussanction of the Government.

    Para 14: (Penalty for abatement)

    Whoever abets any offence punishable under this Act shall be punished with the punishmentprovided for in this Act for such offence.

    ANNEXURE-III

    SCHEME OF MHT-CET 2009 EXAMINATION

    Date of Examination: The examination will be conducted at various centres in Maharashtra on

    Thursday, 7th May 2009.

    Schedule & Test Design: The MHT-CET-2009 will consist of three question papers. Each paper is of

    100 marks.

    Paper I : Physics & Chemistry (50 marks each)

    Paper II : Biology (Botany & Zoology - 50 marks each)

    Paper III : Mathematics (100 Marks)

    There is no choice among the questions, i.e. all questions have to be answered. The candidate

    desirous of selection to Health Science courses and BVSc & AH should appear for Paper I & Paper

    II. The candidate desirous of selection to Engineering degree courses should appear for Paper I

    and Paper III and the candidate desirous of selection to Pharmacy degree course should appear for

    Paper I & Paper-II and/or Paper-III. Candidates will be provided with separate OMR answer sheets

    with each question paper. At the end of each paper, candidate will handover the OMR Answer

    sheet and Question booklet to the invigilator.

    The candidate will be required to mark the correct answer by blackening the corresponding circle

    against the serial number of the question in the answer sheet with black ink ballpoint pen only. Out of

    four circles provided for selection of an answer against a question, the candidate should fill up one

    circle only. Each correct answer will be given mark/(s). There shall be no negative marking for wrong

    answers.

    CHANGING AN ANSWER IS NOT ALLOWED: The candidates must fully satisfy

    themselves about the accuracy of the answer before darkening the appropriate circle, as no

    change in the Answer once marked is allowed. The answer once marked is final, any change in

    the option once marked, done by any method, will amount to a invalid/incorrect response.

    Candidate should completely darken one and the only one best response (circle)

    e.g A B C D

    Candidate should not use any other method for answering i.e. Half circle, dot. tick mark, cross

    etc. This may not be read by the scanner. Answer sheet of each candidate will be evaluated by

    computerized scanning method only (Optical Mark Reader). There will not be any manual

    checking during evaluation and verification.

    Grievance Redressal Committee : A Greviance Redressal Committee will be constituted at each sub

    centre comprising following members:

    i) Sub-centre Incharge - Chairperson

    ii) A Supervisor - Member Secretary

    The committee will function from 8.00 am to the end of the examination on the day of

    examination. If there is any grievance during this period (regarding loss of time due to

    administrative error or any other examination related important matter), the candidate will report

    it to the invigilator of his/her examination block. It will be communicated to the subcentre

    incharge through supervisor. The committee will examine the Grievance on the spot and take

    necessry decision regarding the Grievance/s.

    If a candidate has objection against any question in the question paper of this examination, the same

    may be raised through a written application addressed to the Competent Authority within 3 days after

    examination. Representation received after this period shall not be considered.

    Syllabus of Examination: Syllabi of Physics, Chemistry, Biology and Mathematics for the MHT-

    CET-2009 will be the same as for the current year for HSC Examination (i.e March 2009) of HSC

    Board of Maharashtra.

    Time & duration of Examination: There will be three papers of one and half hours each. Schedule of

    examination is given on page no.1.

    Language of Question Paper: The medium for examination shall be English or Marathi or Urdu forPhysics, Chemistry and Biology. However, Mathematics paper shall be in English only. The option

    once exercised about the medium by the candidate shall be irrevocable.

    Examination Centre: The MHT-CET-2009 will be conducted at all the district headquarters of the State

    of Maharashtra. The MHT-CET examination center will be within the same district from where the

    candidate has passed / is appearing at the qualifying examination i.e. HSC/12th Standard examination. For

    the eligible candidates passing qualifying examination from outside the state of Maharashtra, the

    Competent Authority shall allot the examination center. The centre of examination for candidates who have

    passed their HSC (12th Std) or equivalent examination from an institution situated outside the state of

    Maharashtra (Candidates eligible under Rule 4.7 and Rule 4.8 of Health Science Brochure and Type B,

    Type C, Type D and Type F of Engineering and Pharmacy Brochures) shall be the district/headquarter of

    the Divisional Authority where he/she has submitted MHT-CET 2009 Application Form. The center once

    allotted by the Competent Authority shall not be changed under any circumstances.

    ANNEXURE-IV

    SALE OF APPLICATION FORM, INFORMATION BROCHURES, ADMITS CARD RESULT

    OF MHT-CET 2009 etc.:

    Mode of Sale:

    A single Application form and three information Brochures for MHT-CET 2009 (Health Science, Engineering andPharmacy) will be available at Junior College/High School where student has studied for HSC (12th Std examination).

    Prescribed application forms as per the requirement shall be obtained by Head Master/Principal of the college from

    the Principal/Dean of the notified college in the district as shown in Annexure-A. The cost of application form along

    with the Information Brochures of MHT-CET-2009 and the Examination fee is Rs.700/- for open category, and

    Rs.500/- for reserve category candidate. This amount is not refundable. The School/Junior College should submit

    two separate demand drafts / pay orders, one for open category candidates, another for reserve category candidates

    drawn in favour ofCompetent Authority (MH-CET), Mumbai, on any scheduled commercial Bank, payable at

    Mumbai, to the Notified College while collecting application forms. Duly filled application form should be submitted

    by the candidate to the same Junior College/School, from where he/she has passed / appearing for HSC or equivalent

    examination, on or before the prescribed date.

    All the Defence category candidates who are appearing/have appeared for qualifying examination (HSC or

    equivalent) from outside Maharashtra State and are otherwise eligible as per the rules to appear at MHT-CET-2009,

    should obtain the brochures and application form on payment of fee of Rs.700/- by Demand Draft/Pay order drawn on

    any scheduled commercial Bank in favour of Competent Authority, MH-CET, Mumbai payable at Mumbai,

    from respective Divisional Authorities.
