1. Declare a Quorum Mr. Brad Treptow called the meeting to order at 5:02 p.m. and declared a quorum. Mr. James Paxton, Ms. Gina Klinekole, and Ms. Kimberly Smith were present; Dr. Lynn Willard was present via telephone. Also present was Dr. Ryan Carstens.

1. Guests Mr. Treptow introduced guests Jane Christensen, Paul Wenzel, Brent Kernohan, Joseph Rutledge, Pierre Laroche, Marla Romero and Sara Chapman

2. Highlights Mr. Laroche introduced Cyber-security students Brent Kernohan and Joseph Rutledge, as being star students, who earned scholarships to continue their studies. Mr. Laroche outlined the requirements of the scholarship, and turned the floor to the students. Mr. Rutledge is retired military, with no formal cyber security background. Mr. Kernohan is from the Mescalero Tribe and a graduate from Tularosa High School. Mr. Treptow congratulated them and thanked them for attending.

ROUTINE MATTERS

1. Report from College Board Chair - Mr. Treptow thanks Regent Board Chair Ms. Christensen for her time and attendance. Mr. Treptow also recognized Dr. Carsten for the new budget workshop interaction and progress, and thanks to the Board for a productive budget workshop. Lastly, it was nice to have a presentation in regards to stakeholders meeting at the Ruidoso Rotary Club.

2. Report from the ENMU System president – Dr. Carstens send Dr. Elwell’s regards. Chair Christensen had no comment

3. Report from the ENMU- Ruidoso president – Refer to College Highlights document. Dr. Carstens documented successes of the Workforce Job fair that occurred earlier that day. Good to make connection with employers around the area. Another point of interest is the 2+2 Cybersecurity program and partnering with NMSU. ENMU-Ruidoso is in the process of working with NMSU to make sure courses transfer to their new potential program. Other news includes Coda Omness’ work with Hondo schools in collaborating with them for dual credit, over the Roswell branch. Dr. Orozco proposed having a campus wide symposium on women’s history; along with another similar lecture Texas A&M. Ms. Klinekole asked if any employers from Inn of the Mountain Gods was present at the Workforce Job Fair. Ms. Chapman stated they were invited, but did not attend. Mr. Treptow opened the floor to questions and comments – Mr. Paxton asked a clarifying question for who is meeting in Portales to facilitate articulation of emergency management program. Dr. Carstens informed that John McCullough was in charge of this matter, and would likely be meeting via phone, to ensure students from Ruidoso can transfer to attain a four-year degree. Paul Wenzel addressed board in regards to the completion of the construction, saying it was a success and ahead of schedule. He is ordering a LED order for some of the electrical, which will result in a rebate from PNM Electric. Mr. Laroche outlined the contents of new student’s back-to-school tool kit, and the purpose behind it. Mr. Laroche also state that Portales leads the state in degrees in applied science: taking student’s associates degrees or certificates and turning it into a bachelor’s degree, by creating a career ladder. Dr. Carstens continued on the topic of articulation models in other colleges and their potential applications for ENMU.

4. Policy and Procedures – Travel Policy- Dr. Carstens relayed that Scott Smart has reached out to both campuses about a potential policy change. This allows the board to be included in the discussion as well. Currently, this is in a discussion phase, and nothing can be approved as of now, but will eventually be approved by the Regents. Attached documentation will be presented to Scott for the next policy discussion at Portales. Dr. Carstens opens the floor for comments or questions. Dr. Carstens first concern was spending employee time processing low dollar reimbursements. Main issue in policy change regards New Mexico receipt liability laws, and Portales wanting to create standard per diem, based on hours away, so individuals do not have to archive minor receipts for years and reduces vulnerability in regards to this law. It reduces

paperwork, and processing hours. Mr. Treptow encouraged the board to share comments or concerns with Dr. Carstens by Friday, April 13.

5. Strategic Plan Discussion – Dr. Carstens would like to be disciplined in regular reporting and updates to the strategic plan. He gathered a synopsis throughout the community from focus groups. From the information gathering stages, he created an idea of topics ENMU should focus on for plans. Mr. Treptow voiced that he would like to see progress on various approved metrics from several years ago. Mr. Paxton voiced to give Dr. Carstens time to understand better prior goals, and how they relate to Dr. Carsten’s vision for the college. Dr. Carstens suggested putting one item of the strategic plan the board agenda for every meeting. A big issue facing the success of strategic goals is implementing methodology of measurements, metrics and tracking, which the college is still verifying, which Dr. Carstens hopes to present soon. Ms. Klinekole mentioned her agreement of the discussion, and reiterated that past strategic goals have not been followed up upon. Dr. Willard would like to focus on what the community said, in focus groups, in moving forward with college goals. Mr. Treptow agreed with Dr. Willard. Ms. Klinekole asked about Mescalero’s involvement with the community focus groups process. Dr. Carstens mentioned his concerns with the focus group being an inappropriate setting for Mescalero.

INFORMATION ITEMS

1. College Board Retreat Date Discussion – Marla Romero proposed July and August calendars for retreat, as every weekend in June was unavailable for all parties. Although retreats are historically held in June, scheduling sometimes forces them into other months. Mr. Treptow suggested waiting till after graduation is over, due to the work related to that. Several dates and times were discussed in May and July, before finally deciding on a half-day the morning of July 21 at 8 am. Locations were discussed, but nothing was determined; tentatively set for college campus. Ms. Romero asked for a headcount of board members attending graduation.

2. FY17-18 Budget Adjustment (Restricted/Unrestricted) Request (Tab 3) – Unrestricted and restricted were presented. Highlights: 100,000 move in case remodel happens before July 1. And $650,000 moved to reserve. Restricted $100,000 moved to cover workforce. 2% salary increase.

3. Architect Plans for Adjacent Building Discussion (Tab 3) – Architect plans AB Discussions- Carstens presented timeline for first wave planning from Dekker Perrich Sabatini.

1. Capital Projects Plan – list 5 projects from memo Mall space included for board feedback: Mr. Willard and Mr. Treptow would like adjacent building project to begin before purchasing mall. Mr. Paxton should retain mall on wish list potential. Current mall owners would like to sell. Dr. Carstens to include on 30 year Master Plan, not 5 year Capital Plan. BUSINESS MATTERS

Approval of Updated Capital Projects Plan Dr. Carstens went over the edits made to the Capital Projects Plan, after suggestions from Dr. Willard and guidance from Scott Smart. Ms. Klinekole arrives late. Dr. Carstens continues to go over rationale behind including infrastructure in bond request, of $500,000-$700,000. Liability was discussed in wording the bond in a flexible way. Mr. Treptow asked if this would fit into the May 11 regents meeting. Dr. Carstens assured it would. Mr. Paxton asked if others have seen this version. Dr. Carstens said the regents have seen it, but HED has not.

Motion: Mr. Paxton moves to recommend the Capital Projects Plan to the Board of Regents Approval

HED governance, if needed Dr. Carstens went over email detailing town hall meeting: main theme to work together. Various groups teamed together and discussed questions and notes, in terms of governance. Dr. Carstens explained some the data presented suggesting that branch colleges are not as effective. He defended that the data was manipulated in way which did not account for students accurately, i.e. rural factors. Some new policy could potentially strip community colleges of their effectiveness but creating a network of one controlling community college. Mr. Treptow voiced support in opposing new governance propositions.

REPORT FROM ENMU-RUIDOSO PRESIDENT Dr. Carstens presented a combined report from various department leads of the college. Reflecting updates on facilities, Human Resources, ENMU Foundation, Sun Path Grant, Marketing, Title V grant, New Mexico Workforce Connection Center, Student Services, Community Education and a report from the Vice President of Student Learning which included reports from department chairs. The report is attached.

ACTION ITEMS Approval of Educational Programs:

I. Computer and Network Security Apprenticeship Certificate Mr. Laroche outlined the Computer and Network Security Apprenticeship Certificate, and the college’s ongoing partnership with CNM to match ENMU students with meaningful work experience in cyber security. Dr. Willard inquired whether the internships were primarily federal or private based and suggested contacting Dr. Miller of Systems MD, in Albuquerque. Recruitment plans and target student groups were also discussed. Motion: Mr. Paxton recommended the computer and network security apprenticeship certificate for approval by the ENMU Board of Regents Seconded: Ms. Smith Vote: 5-0-0

II. Educational Assistant Certificate Mr. Laroche provided an overview of the Educational Assistant Certificate, and its benefits apart from similar certificates offered from other schools. Ms. Coda Omness asserted the program goal, to be 100% online by fall 2018, is underway. Motion: Ms. Klinekole recommended the Educational Assistant Certificate for approval by the ENMU Board of Regents Second: Ms. Smith Vote: 5-0-0

III. Pre Engineering Mr. Laroche explained the plans to offer the beginning of a STEM program at ENMU-Ruidoso. Mr. Treptow asked about partnerships to expand the program to other schools. Mr. Laroche responded that courses will transfer, through partnership with New Mexico Technical Institute, due to their expressed interest. Dr. Carstens also interjected that there is a desire in STEM classes as a dual enrollment option for Ruidoso High Schools. Motion: Ms. Smith recommended the Pre-Engineering Associate of Science Degree for approval by the ENMU Board of Regents Seconded: Dr. Willard Vote: 5-0-0

IV. Teacher Education Alternative Licensure Certificates Mr. Laroche introduces the program as a resource for the local school district and educators. The program is supported by the superintendent and anticipated to grow over several years. Dr. Carstens stated that PED must approve the courses first, which may not happen until after the Fall 2018 semester. Mr. Treptow asked questions about timelines and whether that could impact the program as a whole. Mr. Laroche responded in the effects leadership impact has had on delays in the past. Mr. Paxton voiced concerns about the courses not transferring to graduate level credits. Dr. Carstens explained the benefit of this program at the certificate level. Motion: Mr. Paxton recommended the Teacher Education Alternative

Licensure Certificate programs for approval by New Mexico Education Department and the ENMU Board of Regents

V. Approval of Education Foundations 222/L Course fee change Mr. Laroche justifies this fee increase to assure students will participate in testing to prepare them for licensure and their future careers. Motion: Dr. Willard recommended EDF 222/L course fee change for approval

VI. Approval of Emergency Medical Services program fee change Mr. Laroche presented this item as a means to ease student burdens. Motion: Mr. Paxton recommended EMS course fee change for approval by the

ENMU Board of Regents Seconded: Ms. Smith Vote: 5-0-0

INFORMATION ITEMS

I. Update on Facilities and Planning – Dr. Carstens provided an overview of the plan update, and models, of the adjacent building’s remodel phase plan. He reported that the project would require funding of $6.9 million, with anticipated completion in 2020. The first phase would begin in December, after securing bond funding. Mr. Paxton expressed budgetary concerns over the remodel of the existing operating building. Dr. Willard expressed timeline concerns, hoping to begin the project before December.

II. Update regarding Board of Regents meeting calendar – Dr. Carstens outlined the new model and thus calendar effect changes. The board was responsive to an updated meeting schedule, and accepting to the idea of afternoon meetings.

III. Discussion regarding Board Retreat – Dr. Carstens and the board discussed the time and the agenda. The location was left for further discussion.

IV. HED update – Dr. Carstens mentioned that the rule for undergraduate program “certificate” had been stripped in some contexts, and that four CAOs were added. He noted that these changes help to move forward.

BUSINESS MATTERS During the week of June 25th, institutional corrective professional, Dr. Rosemary Reynolds, will

be meeting with staff to help form and implement strategic plan.

Staff and Faculty will create a report on the specific metrics inquired about earlier by the retreat.

Dr. Carstens acknowledged the potential of Board and Administration training in the future. Many members of the board were fully supportive. Voicing their support to help fulfill the vision of Dr. Carstens.

College-wide Notes

Facilities • Update on the submission for the Severance Tax Bond: The

earlier $1.5 M submission has been pulled based upon feedback from the Capital O utlay Hearing on August 1. The revised submission includes two safety-related projects (roof and retaining wall repair or replacement) for a total request of $582,000.

Human Resources • Attended Title IV Civil R ights Investigator Certification Course to

become ENMU-Ruidoso Title IV Designee

ENMU Foundation • Currently the Foundation has awarded $10,400 in scholarships

for the 2018-2019 school ye ar • ENMU-Ruidoso Foundation volunteered at the Ruidoso Downs

Racetrack and Casino on August 11, in conjunction with Albertson’s Supermarket to deliver retro lunch boxes for kids. The Race Track will be donating to the Foundation.

• ENMU-Ruidoso Foundation will participate in the Welcome Back College Cookout that will b e on campus August 20. We will have a raffle for students to win gift cards.

Marketing and Recruitment• New Logo and Brand launching • Social media ads are posting • Billboards are up in Ruidoso, Roswell a nd Alamogordo • New Website is being built

TAACCCT/SUNPATH Grant• Rachel W hitehead continues to complete reporting work and

tracking down loose ends for the grant director in Santa Fe.

Title V Grant • The Emergency Medical S ervices (EMS) program will be

fully institutionalized by October 1. Final purchases for the hands-on area of classroom #107 are underway.

• We are creating non-credit courses in the learning management system (Canvas) for EMS and Structural Fire Science (SFS) students to access program-specific advising resources, which will include information on how to access and use the online degree audit resource to produce a Curriculum, Advising, & Program Planning (CAPP) report, as well a s career resources.

• 4 Structural Fire Science courses have been or are being developed and piloted with more to come in the upcoming academic year.

• The year three annual performance report was completed and submitted to the Department of Education in July.

New Mexico Workforce Connection Center ( NMWCC) • The WIOA Program received a 28% increase in

operational f unding and a 33% increase in training funds for fiscal year 2018-2019. The increased operational funding will be used to hire additional staff in our One Stop offices. We currently have three positions posted.

• 10 individuals funded through WIOA completed the third and fourth modules in the Wind Turbine Training.

• NMWCC will h ost a Rapid Response meeting for Farley’s employees on August 23.

• NMWCC i s currently seeking an HSE instructor to expand services in Capitan and ESL instructor(s) for our Tularosa classes as well a s the evening classes held on campus.

Instruction

Vice President of Student Learning• Switching to a new learning management system called “Canvas” this year.

The purchase of the new learning management system was funded by the Title V grant. Title V and early adopters will u se Canvas in the Fall and the rest of the college will t ransition by Spring 2019.

Language & Fine Arts• The department chair resigned in late July to accept a position with the

Ruidoso Municipal Schools. Working on class schedules, etc.

Math & Science • Hosting Certified Medical A ssisting courses this Fall. Instructors from the

ENMU-Roswell C MA program will offer the face-to-face courses required by their certificate in Ruidoso. Other courses will b e available online or already exist at ENMU-Ruidoso.

• Researching offering Certified Nursing Assistant classes. • Scheduling classes around the resignation of a math faculty member in late

July, who accepted a position with a college in another state.

ENMU-Ruidoso Updates Community College Board Meeting – August 23, 2018

History, Humanities & Social Science • Dr. Orozco served as a board member of Unladylike, a national d igital media

project to celebrate 31 women in the US during the Progressive Era (1880-1925). This project is funded by NEH and Dr. Orozco was the only community college historian invited.

• Dr. Orozco has a manuscript in progress on Alonso S. Perales, LULAC founder, US diplomat, and lawyer. Contracted by Arte Publico Press, and should complete this November.

• Dinah Hamilton was awarded the Excellence in Teaching Award, ENMU Ruidoso National Society of Leadership and Success, May 2018

• Providing I-BEST (integrated basic education skills and training) this Fall in courses with challenging pass-rates. The I-BEST curriculum is taught in tandem with academic content and is intended to give beginning learners instruction and support in behaviors that improve student success.

• James Pawlak attended the New Mexico Consortium of Academic libraries annual Retreat in Las Vegas NM Aug 2 –3.

Information Item 3: Board Elections regarding HB 98

Summary

The college reached out to ENMU System attorneys, Sutin Thayer and Browne law firm, for their input regarding House Bill 98-Local Elections Act, and its possible affects on Community College Board terms. Their response is outlined below.

Legal Explanation

Short explanation: Our research indicates that the Local Election Act does not apply to the election of members of the Ruidoso Branch Community College Board. The Local Election Act amended the Community College Act, NMSA 1978, Sections 21-13-1 to -16, which applies to community colleges. The Community College Act now states that the election of community college board members shall be held pursuant to the Local Election Act. Section 21-13-8(B). Branch community colleges are governed by a different statute, NMSA 1978, Sections 21-14-1 to -16. This statute was not amended by the Local Election Act. This may have been an oversight by the Legislature, but as the law is written, branch community colleges are not included in the scope of the Local Election Act.

Long explanation: The Local Election Act governs “local government elections.” NMSA 1978, Section 1-22-2(A). A “local government” under the Local Election Act includes “a school district . . . a community college district, a technical and vocational institute district, a learning center district . . . and a municipality . . . .” NMSA 1978, 1-22-2(C). The Community College Act (NMSA 1978, Sections 21-13-1 to -26) specifically provides that elections of “community college board members . . . . shall be held pursuant to the Local Election Act.” Section 21-13-8(B). However, a branch community college, like ENMU-Ruidoso, is not governed by the Community College Act, but rather by the provisions of NMSA 1978, 21-14-1 to -16. See N.M. Attorney General Advisory Letter, 2005 WL 723896 (N.M.A.G. Mar. 21, 2005).

Neither the Local Election Act nor the provisions of Sections 21-14-1 to -16 specifically provide that the election of the branch community college board members are subject to the provisions of the Local Election Act. Section 21-14-2 provides that the governing board of the school district where the branch community college is located (in this case, the Ruidoso Municipal School District) acts as the branch community college board, but that such board may exercise the “local option” and “cease to operate as the branch community college board and provide for an elected branch community college board.” Section 21-14-2.1 (A). The governing board of ENMU-Ruidoso exercised the local option back in 2007.

Pursuant to Section 21-14-2.1(A), once the local option is exercised, five members are elected to serve on the branch community college board. Then, at the first board meeting after the election, the five members draw lots for the following terms: two for terms of two years and three for terms of four years. Thereafter, branch community college elections are held on the first Tuesday of February of each odd-

numbered year, and board members are elected for terms of four years from March 1 succeeding their election. Id.

Prior to the 2018 amendments to the Local Election Act, this schedule of elections was also in comport with Section 1-22-3 (2015) (“A regular school district election shall be held in each school district on the first Tuesday in February of each odd-numbered year.”), which applied by virtue of Section 21-14-2(H)(2) (“All elections held pursuant to the branch community college laws shall be as follows: . . . (2) the election shall be conducted and canvassed in the same manner as municipal school district elections unless otherwise provided in the branch community college laws”). However, the Local Election Act was amended in 2018, such that a school district election is now considered a “local election” which must take place on “the first Tuesday after the first Monday in November of each odd-numbered year.” Section 1-22-3(A) (2018).

Section 21-14-2(H)(2) has not been amended, and still provides that “[a]ll elections held pursuant to the branch community college laws . . . shall be conducted and canvassed in the same manner as municipal school district elections unless otherwise provided in the branch community college laws.” Because Section 21-14-2.1(A) of the branch community college statute (law) provides that branch community college elections are “to be held on the first Tuesday of February of each odd-numbered year” and that branch community college board members’ terms begin on March 1 after their election, the provisions of the Local Election Act affecting the dates of elections and beginning of elected terms do not apply to branch community college board members. See Section 21-14-2(H)(2) (“[a]ll elections held pursuant to the branch community college laws . . . shall be conducted and canvassed in the same manner as municipal school district elections unless otherwise provided in the branch community college laws” (emphasis added)).

The legislature amended other statutory sections to specifically provide that certain elections are subject to the Local Election Act (see e.g. Section 22-5-8(A) (2018) (amended, effective July 1, 2018, to require local school board elections to be held pursuant to the Local Election Act); Section 72-16-10(A) (amended, effective July 1, 2018, to require election of directors for the Albuquerque Metropolitan Arroyo Flood Control to be held pursuant to the Local Election Act); Section 21-13-8(B)(amended, effective July 1, 2018, to require community college board elections to be held pursuant to the Local Election Act)), but did not amend the sections regarding branch community colleges. Under the rules of statutory construction, the fact that these statutory sections were specifically amended, but the branch community college statutes were not, indicates that the legislature intended (even if it was an oversight) not to include branch community college board elections in the scope of the Local Election Act.

Action Item 3: General Bond Election

Summary

Based on feedback from the 1 August 2018 HED Capital Outlay Committee meeting in Clovis, it is strongly advised that the college pursue a local bond election to help raise funds for facility needs. The 3-phase College Nexus Project was presented, and while the goal of the project is well received, the state leaders would like to see a local investment in the facility cost before they support additional state dollars for capital project needs.

Working with Hilltop Securities, we have preliminary information to suggest that a bond election would provide necessary funds for the construction project, at a reasonable cost to taxpayers (see attached).

As for the date of an election, we are seeking clarity from our ENMU attorney and also at the state level regarding when the college would be required to conduct the local bond election. Based on research thus far, we will need to look at either February or November, 2019 (see attached).

Action Requested

The ENMU-Ruidoso Branch Community College advisory board shall conduct an election in 2019 for a two million dollar ($2,000,000) capital improvement general obligation bond issue. The exact date is to be determined, likely as a special election in February 2019 or as part of the general election in November 2019.

As a result of the informaRon you sent me I have reached out to Senator Ivey-Soto and he is in discussion with the Secretary of State. They acknowledge the lack of correcRon to the “Branch Community College Statute” was an oversight and they are researching opRons for a remedy. I anRcipate we will have some plan to deal with this parRcular issue in the next week or two. Also I am going to a General ElecRon School next Monday and will talk with the SOS personally. I know they are considering a couple of different soluRons or a temporary remedy to deal with the statutory requirement for February board elecRons and also will introduce a legislaRve correcRon in the next session for this problem.

Senator Ivey-Soto did concur with my prior reading (in the message below), that the nonconforming language mandates board member elecRons only and the Local ElecRon Act clearly states any bond quesRon would be an all mail ballot elecFon.

In my discussion with Ms. Massey I believe we idenRfied three opRons for a bond quesRon: 1) conduct an all mail ballot independently at the Rming of your choice 2) coordinate with the Ruidoso Schools to share an all mail ballot elecRon for both bond quesRons (February) 3) wait to place the quesRon on the November 2019 Local ElecRon Act ballot

As soon as I learn what the proposal or proposals for the branch college board member quesRons, I will let you know.

I really believe this a compilaRon issue (conforming the appropriate statutes to the intent of the bill which was vast) and I hope we can get guidance as to how to resolve this maeer… my opinion which is not a legal one is that the plain language only refers to board member elecRons and the Local ElecRon would sRll require a special elecRon for bond quesRons at any Rme other than the Local ElecRon Act ballot in November of odd years. I am thinking the language in the Local ElecRon Act adjusRng the terms of current board members which is not considered in the argument below may have some statutory influence too.

We know the intent of the legislaRon was to address all local nonparRsan elecRons and conforming language could be adopted this next session but It is an interesRng problem as there are I would imagine quite a large number of branch colleges in the State.

Action Item 4: Moving Forward with Phase 1 of Building Project

Summary

The recent acquisition of the adjacent retail space (the adjacent building north of the existing facility) affords the opportunity to increase instructional space, and also affords the opportunity to address our limited capacity and space for student success efforts and programs. In light of this, Dr. Carstens began to visualize the ENMU-Ruidoso Campus Nexus Project to address the many issues that have resulted from years of patching spaces together. His goal was to implement a strategic approach that unites our facilities with our mission. To flesh out the concept, a series of community forums were conducted which provided insight regarding resources, services, and desired facilities and technologies that would better support the college mission and goals. The data gathered was assessed by Dr. Carstens and Dekker Perich Sabatini (DPS) Architects and resulted in the conceptual design that is attached.

The first phase of the Nexus project entails building out the annex space by bringing restrooms up to code, constructing instructional and support spaces, renovating infrastructure throughout the facilities and connecting between the annex and existing buildings. The targeted timeframe for this project is Dec 2018 – Oct 2019. The anticipated cost for this phase is $2.4 million.

The funding for Phase 1 comes from $1.2M in local funds (already identified in the budget), and $1.2M in public funds ($700K already secured from prior GO Bond, $500K pending the results of November 2018 General Obligation Bond election). In the event that the November bond does not pass, the college will cover the $500K with local funds.

Potential Additional Funds: We have a small amount of funding (estimated $100k) potentially available from the prior severance tax bond project that has been used to complete the remodeling of the trades area in the current building. Use of remaining funds from this bond would be possible through a successful request to re-purpose the funds via the next legislative session or executive order.

Action Requested

The ENMU-Ruidoso Branch Community College Advisory Board approves moving forward with Phase I of the Campus Nexus Project, engaging with the architecture firm to complete design tasks, and selecting a builder to execute the renovations. Design work may proceed immediately with construction beginning o/a December 2018. Use funds in the amount of $2.4M is approved.
