The project, located in T19N, R5W, Section 7, is approximately 26 miles westsouthwest of Cuba, NM. Miocene, LLC proposes to drill 52 exploratory drill holes approximately 20 feet deep. Depth to groundwater in the area, based on measurements available in the GWSI database maintained by the U.S. Geological Survey is expected to be between 50 to 100 feet below land surface. As stated in the application, no drilling will take place within 100 feet on any perennial, intermittent or ephemeral stream. Therefore, the exploratory drill holes are not anticipated to encounter groundwater. As there appears to be no water use associated with this project, the Hydrology Bureau has no additional comments or issues related to the permit application. Re: New Minimal Impact Exploration Permit Application, Section 7 Exploration Project,McKinley County, New Mexico, MKO5 OEM

Dear Mr. Ennis:

This letter is in response to the above new minimal impact exploration permit applicationreceived at the Historic Preservation Division (HPD) on April 25, 2016. According to theapplication, the proposed project is within Township 19 North, Range 5 West, Section 7.

In accordance with rule 19.10.3 NMAC, ivlinirnal Impact Operations, I reviewed our recordsto determine if cemeteries, burial grounds or cultural resources listed on the State Register ofCultural Properties or the National Register of Historic Places exist within or near the permitarea. Our records show that there are no cultural resources listed on the National Register orState Register within or near the proposed permit area and no known cemeteries or burialgrounds. Although there ate no cultural resoutces listed on the State or Natiojial Register, our records show several archaeological surveys within part of the permit area. These surveysidentified archaeological sites.

The application states that the surface and mineral estate owner is the Bureau of LandManagement (BLM), Farmington Field Office and that Miocene will have the area surveyedas requested by BLM. The BLM will review the results of the survey report and considerproject effects on any archaeological sites that niay be eligible for listing on the NationalRegister pursuant to Section 106 of the National Historic Preservation Act. The BLM mayrequire avoidance of any eligible archaeological sites and an archaeological monitor toensure that eligible sites are not affected.

Please do not hesitate to contact me if you have any questions regarding these comments. I canbe reached by telephone at (505) 827-4064 or by email at michelle.ensey(ästate.nm.us.
