Europe is home to a diverse range of newspapers at national, regional and local level. European publishing houses offer a broad menu of professional news, information and entertainment to citizens every day.

In doing so, the newspaper sector plays a unique role in democracy in Europe, stimulating informed debate and promoting engaged citizenship.

The European Newspaper Publishers’ Association (ENPA) is an international non-profit association, advocating the interests of the European newspaper publishing sector towards different European and international institutions. ENPA promotes the interests of newspaper publishers on all platforms.

Today’s newspaper sector is a complex and innovative business, competing hard to offer European citizens exciting new experiences across all platforms. Business models and commercial practises are being adapted constantly to offer readers newspaper content in a format that suits their different needs and lifestyle.

In this context, ENPA’s mission is to ensure a legislative environment in which the newspaper industry can develop a successful and sustainable future, both in print and in the digital environment.

The Association also acts a source of facts, figures and expertise on the newspaper industry, which is crucial to inform the work of EU decision-makers.

Newspaper companies are linked to ENPA through its member associations in 26 countries.

x� These daily, weekly and Sunday tiles are published in 23 European Union Member States as well as in Norway, Switzerland and Serbia.

x� Every day more than 150 million national, regional and local newspapers are sold.

x� Newspaper websites are often the most consulted website at national, regional and local level, receiving many millions of unique daily visits.

With its headquarters in Brussels, Belgium, ENPA has a core team of six people headed by Executive Director, Francine Cunningham. The Association also has specialist committees and working groups made up of experts from across Europe.

ENPA works to create conditions in which the newspaper sector can thrive in the future, as a creator, producer and distributor of professional and authoritative content on all platforms. In this way, newspapers can continue to inform, educate and engage debate in European society.

one has chosen to live at a safe distance from the Berlaymont.

Together with our Executive Director, I have defined a three-pronged approach to further improving ENPA as an effective and efficient instrument for our members:x� Structure and transparency: Modernising

the statutes, establishing new definitions of our governing bodies and a clear division of responsibilities between them (Board, Executive Committee, standing committees and working groups).

x� Strategy and position papers: Selecting the most important political issues on which to concentrate our efforts, and producing compact position papers to facilitate our communication with our counterparts in the EU. In connection with the Anniversary Congress, we summarised this in a booklet setting out our “10 priorities for the EU Digital Agenda (Informing Newspaper Readers on all Platforms)”.

x� Achieving results: In political lobbying work, one is never able to claim «victory» in any particular piece of legislation, nor should one do so. On the other hand, I can report with confidence that during the past year, we have seen several legislative processes being concluded in a positive way, when measured against our goals of protecting the basic freedoms of editorial work and promoting the «level playing field» in all business activities.

Publishing newspapers means living on the crossroads between business, politics and society in general, or in short: reflecting human life itself. This is what makes our profession so challenging, so rewarding, so addictive - and so much fun! In my speech to the 50th Anniversary Congress, I stated that no matter how or when we print or publish, the core of our business remains the same: to provide news, to explain the news, to act as the watchdogs of society - but also to be the «glue» that makes societies stick together. In other words: to present and promote the truth in such a way that we can build our business on our readers’ confidence in us.

This is still the mission. I thank all our members and friends for your kind support during 2011.

Looking back at my first year of service as Presi-dent of ENPA, there is no doubt in my mind that our 50th Anniversary Congress was the absolute high-light. During that interesting and intense November afternoon in Brussels, we were able to confirm that ENPA and the media we represent in 26 European countries are still young, vital and forward-looking.

Certainly, there are challenges. The transition from analogue to digital publishing is already old news, readers’ habits are changing and advertisers are always looking for new channels, preferably «more competitive» ones. But as our anniversary publication “50 Ideas for the Future of Newspapers” demonstrated: Newspapers and news publishers are changing, as we need to do in order to survive and succeed.

The 50th Anniversary Congress also confirmed that independent newspapers and news media are universally respected as foundations of our European democratic societies. Three senior politicians honoured us by their participation in the Congress: European Commission President José Manuel Barroso, Vice-President Viviane Reding (Justice, Fundamental Rights and Citizenship) and Commissioner Michel Barnier (Internal Market and Services). They all offered strong and clear messages to an audience of media people from more than 20 countries and several associations, members of the European Parliament and EU officials.

Such visible confirmation, particularly when coming on top of the large number of small steps of progress achieved by our staff members in their day-to-day, long-term work towards the Parliament and Commission, shows us that ENPA does make a difference. And, on a personal level, I admit freely that it is this fact that inspires me in my role as ENPA President - and that makes me endure the many hours of boring air travel required when

safeguard the rights that journalists and publishers have over the use of their works on the Internet, in particular in view of the rise of news aggregation services.” ENPA will continue to engage with the Commission as it examines these issues.

3. EU Media Futures Forum. ENPA provided

early input into the work of the multi-stakeholder platform set up by European Commission Vice-President, Neelie Kroes, in December 2011. Chaired by Christian Van Thillo, CEO of de Persgroep (Belgium/Netherlands), this Forum brings together some 20 individuals from the world of publishing, broadcasting, telecoms, social networks and ICT, to debate how to improve the policy framework for the European media industries. ENPA’s publication launched in November, “Informing Newspaper Readers on all Platforms: 10 Priorities for the EU Digital Agenda”, was distributed to all of the members of the group and we shall continue to engage with this Forum as its work progresses in 2012. Some of the issues addressed in the publication were also discussed in-depth during an ENPA meeting with European Commission Vice-President Joaquin Almunia (Competition) in October 2011.

4. ENPA News Lunches in the European Parliament. The association held the first of an on-going series of “Newslunches” in the European Parliament. On 16th March, we organised a topical lunch debate entitled “From Google to Apple: Challenges and Opportunities for Newspaper Publishers in the Digital Era.” The event was kindly hosted by Belgian MEP, Ivo Belet, and included an introduction by ENPA President, Ivar Rusdal, followed by key note speeches by Christoph Keese, President Public Affairs, Axel Springer AG Germany; and Hans Nijenhuis, publisher of NRC Media, The Netherlands. The Newslunch was well attended by MEPs who asked many questions about the relationship between newspapers and technology platforms in the digital environment.

Ten things we did in 2011

1. ENPA 50th Anniversary Congress. It was a moment to bring European Commission President, José Manuel Barroso together with other leading European politicians, EU officials, publishers and other stakeholders to debate freedom of press and the role of newspapers in the Digital Agenda. The ENPA 50th Anniversary Congress in Brussels on 8th November, 2011, acted as a focal point of our activities in the course of a very busy year. It was also an opportunity to look forward to the next 50 years. To coincide with the Congress, ENPA released a publication entitled “50 Ideas for the Future of Newspapers”, showcasing examples of innovation and creativity in the sector. In a foreword to the publication, European Commission Vice-President, Neelie Kroes, stated: “The 50 ideas in this book are a clear sign that ENPA’s members are well on their way to sweep away the doom and gloom surrounding the future of the press and contribute to a press renaissance going forward.”

2. Value of Content. ENPA spoke out at the World Copyright Summit in Brussels in June 2011, as well during many other occasions, as a strong advocate of copyright. Newspaper publishers are facing a situation in which the news content they financed and developed is too often being used by third parties as an added value for their commercial services. The need for news aggregators and technology platforms to respect newspaper copyrights on the Internet is therefore a high priority for the news media sector. In 2011 this issue was specifically addressed in the European Commission’s Communication for a Single Market for Intellectual Property Rights, which stated: “Publishers play an important role in disseminating the work of writers, journalists, researchers, scientists, photographers and other creators. In this respect, it is important to

5. VAT: Don’t Tax Reading. In 2011, ENPA urged the EU to maintain the existing zero, super-reduced and reduced rates of VAT on printed newspapers and provide similar treatment for digital press formats. The association met with the EU Taxation Commissioner, Algirdas Semeta and worked along with other publishers’ organisations to meet to all the relevant Commission cabinets. In addition, ENPA also organised a special VAT seminar in Warsaw on 19th May addressed by Donato Raponi, Head of the VAT Unit at the European Commission; and former French Culture Minister and special envoy of the French Government on taxation, Jacques Toubon. The final Commission Communication on VAT, presented in December 2011, addressed the issue of equal treatment for products which are available in both traditional and online formats. While all reduced rates are under scrutiny, the Communication also stated that “…the potential benefits of a limited use of reduced rates, if rationally defined and applied, should not be disregarded.” ENPA will continue to make this issue a priority as the Commission carries out an Impact Assessment on VAT in 2012.

6. Public Service Broadcasters: ENPA conducted a comprehensive pan-European survey into the expanding online activities of public service broadcasters. While newspaper publishers believe in a vibrant media landscape offering both public service and commercial press offers, the survey found that the online activities of PSBs are too often distorting the digital market for independent press. This issue is all the more critical at a time when publishers are investing heavily to develop new business models capable of sustaining the newspaper business and employment, including paid-for offers in the digital environment.

7. Freedom and Pluralism of the Media: ENPA has worked in the last year to emphasise to EU decision-makers the vital role of the newspapers in providing a trusted source of news, information and democratic debate. At the same time, we have stressed that self-regulation of the media

is the best approach and the EU does not have competence to regulate media diversity, other than through competition law. ENPA developed a new position paper entitled “Preserving Pluralism in a Rapidly Changing Media Market”, as early input into the work of the High Level Group on Freedom and Pluralism of the Media, appointed by European Commission Vice-President, Neelie Kroes, in October 2011. ENPA shall continue to engage with the High Level Group, chaired of the former President of Latvia, Dr Vaira Vike-Freiberga, as the work of the group progresses in 2012.

8. Advertising: driving innovation and growth. ENPA continued to highlight to EU decision makers the potential danger of placing bans or restrictions on advertising, which could interfere with the viability and sustainability of the free and independent press sector in Europe. In October, ENPA co-organised with other media and advertising organisation a “Media Lounge” event in the European Parliament entitled “The role of advertising in driving innovation & growth”, with speakers from the Parliament and Commission. ENPA also continued to give active input into the European Advertising Standards Alliance (EASA) Best Practise Recommendation for Online Behavioural Advertising. This self-regulatory framework, being developed by industry members of EASA, aims to provide transparency and choice for consumers as regards Online Behavioural Advertising.

9. Defending marketing. ENPA emphasised the importance to publishing houses of concluding contracts for subscriptions via telephone and the Internet, during the debate in the European Parliament in early 2011 on the EU Consumer Rights Directive. Such telephone and internet contracts are essential for publishers to maintain subscriptions. MEPs understood that this means of developing readership for press titles is essential to the newspaper sector and avoided further obstacles for concluding such contracts.

10. Media Literacy: In July 2011, ENPA met with European Education & Culture Commissioner, Androulla Vassiliou, where among other topics we had a discussion on the important role of newspapers in promoting both literacy and media literacy in both printed press and in the digital formats. The ENPA Media Literacy Working Group also developed and updated its position paper, “Equipping citizens with critical skills for a multi-channel world”. This position was part of ENPA’s input into a new Media Literacy Expert Group convened by the European Commission.

President Barroso and Commissioners speak out at 50th Anniversary Congress Priority concerns of the newspaper sector in relation to freedom of the press, copyright, news aggregators and VAT, were highlighted by the President of the European Commission, José Manuel Barroso, Vice-President Viviane Reding and Commissioner Michel Barnier at the ENPA 50th Anniversary Congress in Brussels on 8th November, 2011.

President Barroso praised ENPA’s function as: “Steward of an industry that has a very important role as a liberating force and guardian of our shared values.” The President stated: “Freedom of expression and the freedom of the press are two non-negotiable freedoms that lie at the very heart of our democratic societies. They are essential core values of the EU and  you can be assured that  the Commission will continue to defend them vigorously.”

President Barroso congratulated ENPA on its 50th Anniversary and sent wishes that “the next 50 years will be just as successful or even more successful.”ENPA President Ivar Rusdal underlined the role of newspapers as the watchdogs of society and as a cohesive force binding societies together. stressed that the sector relies on the EU to provide a legal, policy framework in which the newspaper business can grow in the next half century.

European Commission Vice-President, Viviane Reding, congratulated ENPA on its 50th Anniversary during her speech at the Congress. Vice-President Reding stressed the role of the professional press in contributing to informed and engaged citizens in Europe: “There is nothing like a strong press to keep politicians sharp and on track,” she said.

“Newspapers are just as relevant today in the digital era as they were 50 years ago. They are, also at European level, the “fourth estate” acting as a control on the executive, on the legislators and on the judiciary,” added Vice-President Reding.

In the closing speech of the Congress, European Commissioner Michel Barnier, responsible for Internal Market and Services, highlighted the value of creative content and the necessity of promoting paid for business models also in the digital environment. Commissioner Barnier said: “In a world of abundant information fl ows,  independent press and quality journalism are more important than ever. Rather than a threat, the Internet can be an enabler. I want to make sure that European laws are pitched properly to incentivise  new  business models that safeguard the values that the members of ENPA stand for.”   

Commissioner Barnier also spoke out strongly against news aggregators using newspaper content without authorisation. He stated: “…news aggregators should always ask publishers for their consent before taking their articles.”

In addition, Commissioner Michel Barnier spoke out in favour of a reduced VAT rate for digital press, stating: “In a personal capacity, I favour the idea that the current framework in place for the printed press should also apply to the digital press.”

and “The Future of News Media in Europe”. The discussions were chaired by Ben Fenton, Chief Media Correspondent of the Financial Times.

Other speakers included Members of the European Parliament such as Malcolm Harbour (UK), Anni Podimata (Gr) and Sophie In ‘t Veld (NL) and Nadja Hirsch (DE). Joining them on panels were Baron Black of Brentwood, Executive Director of the Telegraph Media Group; and Christian Van Thillo, CEO of de Persgroup.

ENPA calls for a VAT system that promotes rather than hinders access to information in democratic society

European newspaper publishers provide an incredibly diverse palette of news, views and analysis to citizens every day, at national, regional and local level. In doing so, the news media sector plays a unique role in democracy in Europe, stimulating debate about the “Grand Challenges” facing Europe today and promoting engaged citizenship. As the European Commission undertakes a review of the EU VAT System, ENPA calls on legislators to ensure that the VAT system serves to promote, rather than hinder, access to authoritative news and information which is central to democratic society.

Jacques Toubon, the former Minister and special envoy for France on taxation of cultural goods and services, spoke of the “absurd” distortion caused by the current standard rate of VAT applied to digital press, during a VAT Seminar organised by ENPA in Warsaw on 19th May. M. Toubon stressed that taxation is a decisive factor in the competitiveness of the European creative industries compared to the U.S. and Asia. Outlining the position of the French Government, he said: “We must do everything in our power to ensure that, in the promising new market for on-line books and press, wealth and jobs are created and maintained in Europe by existing or future European services that can draw on Europe’s powerful industry of book and press publishers”.

ENPA believes that maintenance of zero VAT on newspapers in Member States where currently

permitted is essential. Furthermore, providing the option for Members States to apply zero or the lowest possible VAT on all formats would not result in any loss of revenues to national Treasuries, since the digital market is still in its infancy. On the contrary, it would help to promote the development of a successful and sustainable digital press market.

An extension of the current VAT rates for print to digital newspapers would also help to accomplish the following:

x� Ease access to newspapers for all citizens, especially those on lower incomes.

x� Enhance the competitiveness of the news media sector and promote jobs in Europe, in line with the Europe 2020 strategy for smart, sustainable and inclusive growth.

x� Promote paid for content models in the digital environment and help to achieve the goal of a vibrant European digital content market.

x� Promote European languages, media literacy and strengthen the role of newspapers as an indispensable contribution to the education and lifelong learning of citizens.

We therefore call on the EU institutions and national governments to ensure that the VAT system helps to create conditions in which the European news media sector can thrive in the future, as a creator, producer and distributor of professional content on all platforms.
