continued to walk away from Police. The Accusedkept his hands around the front of his waist,Police could not identify if any weapon was in hishands so drew their firearms and repeatedly calledfor him to stop.

The Accused threw an item into a planter boxseparating the footpath from an open square at 255George Street, Sydney, which was witnessed by

& Police and believed to be theknife. Constable moved in to arrest theAccused and held him in a bear hug, but this wasresisted by the Accused who was thrashing about,further Police and security arrived to assist inrestraining the Accused on the ground.

The Accused continued to wriggle and thrash about,Constable was holding onto the Accused'sarm when the Accused bit Constable on hisright thigh just about his knee cap, leaving atwenty cent coin sized red mark. The Accused wasplaced into a caged truck and transported to DayStreet Police Station, where he was introduced tothe Custody Manager.

The knife was collected from the planter box andseized by Police, this was booked up as anexhibit, number X0003154549.

The Accused was not read his rights under Part 9of the Law Enforcement (Powers & Responsibilities)Act 2002 nor was he offered the opportunity to beelectronically interviewed due to his level ofintoxication and continued aggressive behaviourwhilst at the station.

All safeguards under the Law Enforcement (Powers &Responsibilities) Act 2002 were adhered to.

The Accused is now charged with the matters beforethe Court.

causing a small laceration which began bleeding.

The Accused was placed into a caged truck and transported to Day Street Police Station,

where he was introduced to the Custody Manager.

The knife was collected from the planter box and seized by Police, this was booked up as an

FACTS:

The accused is , who at the time ofthis offence was of age.

The victim is Acting Sergeant , aserving NSW Police officer, who at the time ofthis offence was undertaking her duties infull police uniform.

About 7:50pm on Sunday 7 January 2018 the accusedand a female person, who do not know each other,become involved in a verbal argument outside theentrance to the 7 Eleven convenience store on EddyAvenue in Haymarket. As a result the female walkedaway to seek assistance from police.

Acting Sergeant was walking about 50 metresaway and was approached by the female, whoinformed her she had been sworn at and verballyabused by the accused, and that as a result shefelt that she was being harassed. obtaineddetails from the female before making her waytowards the accused.

As she approached the accused she was informed byother passing pedestrians that the accused wasyelling at them as they passed. They informed herthat the actions of the accused caused them tofeel intimidated.

Acting Sergeant approached the accused andrecognised him to be She informedthe accused why she was speaking with him andinformed him that, due to his actions, he wasbeing given a direction to leave the area.

Whilst in the process of providing this directionthe accused raised his voice and commenced usingprofanities towards Acting Sergeant . Whileyelling at he commenced walking towardsher, coming within her personal space causing herto fear that she may be assaulted.

Acting Sergeant placed her left hand out infront of her, with her palm facing towards theaccused. She pushed against the chest area of theaccused in an effort to create a space betweenherself and the accused. The accused wassuccessfully pushed a short distance away,creating a safe space between the two.

As a result of the assault Acting Sergeantsuffered scratches to her face, left eye andknees. The scratches to her face were deepenough to bleed. She was transported by ambulanceto hospital where medical treatment wasadministered. At the time of writing she remainsin hospital undergoing treatment.

No permission was provided to the accused toassault .

The accused was transported to Day Street PoliceStation, where he was entered into custody andinformed of his Part 9 rights under LEPRA.

He participated freely in an electronicallyrecorded interview, during which he stated he hadhad an argument with an unknown Aboriginal femalewho went and alerted a unformed police officer. Hestated the police officer told him to leave, andafter doing so there was a 'collision' between thetwo. He denied punching her to the face orpulling at her hair causing her to fall to theground.

The accused consented to forensic procedures,being the taking of photographs.

The accused is , who at the time of this offence was of age.

The victim is Acting Sergeant a serving NSW Police officer, who at the time

of this offence was undertaking her duties in full police uniform.

About 7:50pm on Sunday 7 January 2018, and a female person, who do not know

each other, become involved in a verbal argument outside the entrance to the 7-Eleven

convenience store on Eddy Avenue in Haymarket. As a result the female walked away to

seek assistance from police.

Acting Sergeant was undertaking other duties nearby. She was approached by the

female who informed her she had been sworn at by a male and believed the male was going

to hit her. As a result of his actions she felt intimidated. obtained details from the

female, told her to move on, and made her way towards

As Acting Sergeant approached she was informed by other passing

pedestrians that he was yelling at them as they passed. They informed her that the actions

of the accused caused them to feel intimidated.

Acting Sergeant approached who was seated on a milk crate. She

recognised him from previous interactions. She said to him, " , you know me, I'm Senior

Constable from the Police Transport Command upstairs at Central. Can I get you to

stop abusing members of the public as they walk by?"

replied, "Fuck you, I'm not doing nothing fucking wrong, you cunt."

Acting Sergeant said, "And that's why I'm now giving you an official move on

direction to leave the area, you have been verbally abusing members of the public, causing

fear. People don't needto be sworn at and abused by you."

create a safe space between the two. As this action was being undertaken, Acting Sergeant

said to , "Get back, and move on, now!" - whilst pointing in the direction

that she wanted him to walk.

leaned forward and punched out quickly with his right hand and arm. This punch

connected with the left side of Acting Sergeant 's face, around her left eye, causing

immediate pain and causing her to have difficulty with her vision. She distinctive raised up

both her hands in an attempt to defend herself.

grabbed the hair of Acting Sergeant , that was tied in a bun to the rear of

her head. He forcefully pulled her hair downward, causing her to fall to the ground, landing

on her knees in a crouching position.

Acting Sergeant could feel the weight of on her back. She then felt herself

being dragged along the ground whilst still in the crouching position.

Almost immediately Acting Sergeant was assisted by passing members of the

public. They took hold of and removed him from .

Acting Sergeant called for assistance via the police radio. Further police arrived and

the accused was placed under arrest at the scene.

As a result of the assault, Acting Sergeant suffered scratches to the bridge of her

nose, the left side of her face and to an area below her lips, as well as scratches to both

knees. The scratches to her face were deep enough to bleed, and there was an amount of

blood that was coming from her nose. Her left eye was noted to be red and bloodshot.

Acting Sergeant was transported by ambulance to hospital where medical

treatment was administered. During this treatment it was determined the force of the assault

caused a scratch to her left left eye ball. Medical treatment is on-going to clarify the extent

of this injury.

The Accused at this time was walking along GeorgeStreet, Redfern, and approached the Victim who waslooking down at her phone with headphones in herears. The Accused without provocation then punchesthe Victim 4 times to the head forcing her to theground. The Accused stands and continues to walkaway turning West onto Redfern Street, Redfern.

A number of nearby witnesses who saw the incidentimmediately run to the aid of the Victim whilstothers follow the Accused. Uniformed Police onRedfern Street, Redfern, were alerted to theassault on the Victim and approach the Accused.When approaching the Accused she immediatelybegins to yell and scream before head buttingLeading Senior Constable in the mouth.

Police subsequently took the Accused to ground andhandcuffed her to the rear placing her underarrest.

The Accused was subsequently conveyed by Policecaged vehicle to Redfern Police station where shewas entered into custody. Due to the Accusedbehaviour an Ambulance was called and she wassedated before being transported under Policeguard to Hospital for assessment under the MentalHealth Act.

As a result of the Accused actions the Victimsuffered swelling and bruising to her head and wasrequired to be transported to Hospital. LeadingSenior Constable suffered redness andswelling to his mouth.

####################################################Narrative:About 02:30am, Saturday 18 February 2018 policeattended the Watershed Hotel in relation to abrawl which had occurred.

Police spoke with a number of people at thepremises.

As police were attempting to escort a person awayfrom the premises, an unknown female has runtoward the POI, , yelling aggressively.

The POI, who was up a small flight of stairs,threw a full, sealed bottle of water toward theunknown female.

The bottle has flown through the air and collidedwith the left rear side of the Victim, MCGREGOR's,head. This caused immediate pain and shocked thevictim.

Police approached the POI and arrested her forassault police. Police informed the POI she wasbeing recorded on body worn video.

Police later identified the POI as a victim in aseparate matter.

As a result of the assault the victim has receivedlocalised swelling on the rear of his head, whichhas swollen 2-3cms, causing pain.

The POI admitted guilt at the scene and said,"Sorry I was aiming for the lady running up thestairs, I was afraid she'd come and hit me. Ididn't mean for it to hit you."

Given the nature of the original incident and theminor nature of the injury the POI is to be issueda FSCAN for assault police at a later date.

About 02:30am, Saturday 18 February 2018 police attended the Watershed Hotel in relation

to a brawl which had occurred. Police were in full uniform at the time.

Police spoke with a number of people at the premises.

As police were attempting to escort a person away from the premises, an unknown female

has run toward the accused, yelling aggressively.

The accused, who was up a small flight of stairs, threw a full, sealed bottle of water toward

the unknown female.

The bottle has flown through the air and collided with the left rear side of the Victim,

Constable 's, head. This caused immediate pain and shocked the victim.

The accused was identified by security at the scene who and been standing with her.

Police approached the accused and arrested her for assault police. Police informed the

accused she was being recorded on body worn video. The accused was handcuffed to the

rear and moved away from others at the scene.

Police later identified the accused as a victim in a separate matter. Police removed the

accused handcuffs, and spoke to her in regards to the other incident.

As a result of the assault the victim has received localised swelling on the rear of his head,

which has swollen 2-3cms, causing pain. This swelling receded a few hours later, leaving a

slight lump. The area remained tender to the touch.

The accused admitted guilt at the scene and said, "Sorry I was aiming for the lady running up

the stairs, I was afraid she'd come and hit me. I didn't mean for it to hit you."

Given the nature of the original incident, and the fact that the accused did not intend to injure

police, the accused was issued a FSCAN instead of a bail CAN.

About 5:15pm on Sunday the 18th of March 2018,police were patrolling the area of Pitt Street,Sydney, near Saint Lawrence Lane. This area isvery well known to police for drug and propertyoffences. While patrolling, police recognised

,the Accused walking along PittStreet.

The Accused appeared affected by drugs other thanalcohol. She was sweating profusely, was erraticin her movements, her eyes were widened and hermoods fluctuated quickly. Police stopped theAccused, introducing themselves as required bySection 202 of the Law Enforcement (Powers andResponsibilities) Act 2002.

The Accused was immediately defensive, vehementlydenied being ' ', providing police withvarious names confirmed to be false and becomingirate when addressed by her name. Police at thescene were familiar with the Accused and herhistory from previous interactions and were ableto confirm her identity via photograph at thescene. Due to the history and intelligence relatedto the location for drug offences, the apparentintoxication of the Accused by drugs other thanalcohol, and her insistence at providing policewith false details, police formed the suspicionshe was in possession of prohibited drugs andsubsequently requested the Accused submit to asearch. As the search was being conducted, policeperformed checks on the Accused's actual detailswhich revealed she was wanted for a breach ofbail. The Accused was placed under arrest andcautioned. Due to her erratic and aggressivebehaviour, the Accused was handcuffed.

Offence One (1): Assault police officer inexecution of his duty occasioning actual bodilyharm.During the arrest of the Accused she leanedforwards before rapidly propelling her headbackwards and up, connecting with the lower liparea of Constable . This head butt causedConstable 's lip to split and some minorbleeding. The Accused was taken to the ground toprevent further similar assaults. She was againcautioned and informed she was now under arrestfor assaulting police.

While the Accused was on the ground, Constablewas checking the handcuffs to ensure they

were secure. The Accused began grabbing at theright hand of Constable and was warned notto do so. She clawed at the back area of Constable

' right hand causing three distinct scratchesand breaking the skin in two spots, causing minorbleeding.

The Accused was eventually taken to Day StreetPolice Station where she was entered into custody.She was not offered to participated in anelectronically recorded interview due to her levelof intoxication and aggressive behaviour towardspolice.

This incident was capture by police body wornvideo.

The Accused is charged with two (2) sequence ofassault police in execution of their duty causingactual bodily harm.

her history from previous interactions and were able to confirm her identity via photograph at

the scene. Due to the history and intelligence related to the location for drug offences, the

apparent intoxication of the Accused by drugs other than alcohol, and her insistence at

providing police with false details, police formed the suspicion she was in possession of

prohibited drugs and subsequently requested the Accused submit to a search. As the search

was being conducted, police performed checks on the Accused's actual details which

The accused in the matter is , born.

About 11.10pm, Saturday the 19th of May, 2018, theaccused was in the Dee Why Hotel, with somefriends celebrating the birthday of one of thefriends, . The group was consumingalcohol and had been in the venue for at least twohours.

At this time a security guard made an assessmentof the group that some of them were showing thesigns of intoxication and approached them. Theguard advised the group that they were on lastdrinks and when they finished they were to leave.Some members of the group began arguing with theguard, including the accused. The guard asked theaccused to leave the venue due to his intoxicationand for being quarrelsome.

Sequence 1 - Excluded person fail to leavelicensed premises when requiredThe accused became aggressive in his behaviour,getting up in the face of the guard and pointinghis fingers at him, swearing and refusing tofollow their instructions to leave. Some membersof the group attempted to physically push theaccused out, although the accused fought againstthem, insisting on staying to argue his case notto leave. The accused was eventually pushed outthe door by , where they stood on thefootpath of Pittwater Road, for a short timearguing with security before walking away in anortherly direction.

About one to two minutes later the accused andwalked back to the entrance of the Hotel,

with the accused continuing to argue withsecurity. attempted to push the accusedaway, although the accused refused to leave. Asecurity guard told the accused that he must be atleast 50 metres away from the venue. After anotherminute or so the accused and walked away inthe southerly direction for a few metres beforestopping and talking to each other.

Sequence 2 - Excluded person remain in thevicinity of licensed premisesThe accused continued to come and go from theentrance, yelling and swearing at the guards,demanding to know why he was asked to leave,although refusing to listen to the guards. Theaccused refused to leave the vicinity of the DeeWhy Hotel.

Sequence 3 - Assault occasioning actual bodilyharmAfter a few minutes other members of the groupwere being escorted out of the Hotel by securityguards, with one aggressive male being forcefullyremoved out the door onto Pittwater Road, where hewas pushed out falling onto the footpath. Theaccused, who was close by, ran at security guard

, raising his right arm with hisright fist clenched. saw the accusedcoming and in an attempt to avoid a confrontation,put his hands up in an defensive action. Theaccused continued though and forcefully punchedguard to the left side of his face,causing immediate pain to the left cheek of

. As a result stumbled andfell onto the footpath. The accused ran off in anortherly direction onto Pittwater Road. Securitycalled for Police assistance. The group, includingthe accused, stayed in the area for a short timebefore walking away in a northerly direction andwaving down a Taxi.

About 11.20pm, on the same date plain clothesLicensing Police attended the location and walkedto the entrance of the Hotel. A guard brieflyexplained that another guard had been punched andidentified the males getting into the Taxi about50 metres away as the group involved. Policeapproached the Taxi and showed their Policewarrant badges to the group, asking the group offive males, including the accused, to get out ofthe Taxi and, due to them being near by where analleged assault took place, provide their namesand addresses and some identification. All partiesprovided some identification, including theaccused, who produced a NSW drivers licence

Some members of the group became argumentative,with the accused insisting to see the Policewarrant badges again and again and continue to askfor their names and ranks. Police showed theaccused their warrant badges on several occasions,providing their names and ranks and asking theaccused to get his phone out so he can take downtheir names and ranks so he would stop askingthem, which he did.

Sequence 4 - Assault occasioning actual bodilyharm (Police Officer)While Senior Constable was conductingchecks with VKG radio, was standing lessthan half a metre away, getting into his personalspace, demanding his drivers licence back. Tocreate a gap and continue with his duties bywriting the parties details in his Policenotebook, Senior Constable walked away,although followed him, continuing to getinto his personal space, which prevented SeniorConstable from his Police duties. SeniorConstable asked to stand back, althoughhe refused. To prevent hindering SeniorConstable and to ensure his safety, SeniorConstable placed a hand on the shoulder of

and walked him away. turned towardsSenior Constable and got into his face,swearing at him. Fearing a physical confrontationand to create a gap between himself and ,Senior Constable administered an approvedPolice defensive tactic called a check drill, byusing both hands to push away.

The accused, who was standing about one metre awayto Senior Constable 's left, and while SeniorConstable was facing sideways and not lookingdirectly at him has raised his right arm and witha clenched fist, and in a similar manner in thepunch to , has forcefully punched SeniorConstable to the left side of his face,causing immediate pain to his left side of hisskull, behind his left ear, before running awayalong Pittwater Road in a northerly direction.

Sequence 5 - Resist arrestSenior Constable ran after the accused,while yelling out, "Police, stop running, Policestop running". After a few metres Senior Constable

grabbed hold of the accused, just beforecrossing Pacific Parade. Senior Constableheld onto the accused yelling, "You are under

arrest, stop running". The accused violently movedhis body from side to side in an attempt to freehimself and tensed his arms pulling them away fromthe grip of Senior Constable . Theaccusedcontinued to run, crossing the road ontothe footpath on the other side. After another fewmetres Senior Constable caught up to theaccused. The accused stopped and turned to SeniorConstable , raising his arms up andclenching his fists at him. To prevent beingassaulted and to protect himself from physicalharm, Senior Constable deployed a onesecond burst of Oleoresin Spray into the eyes ofthe accused, causing him to grab his eyes and bendover forwards. Senior Constable PRINCE took holdof the accused and attempted to place him onto theground where he could control him and placehandcuffs on him. At this stage Senior Constable

arrived and assisted to force the accusedonto his front onto the ground and place handcuffsto his wrists while his hands were behind hisback.

Further Police assistance arrived and the accusedwas conveyed to the Manly Police Station where hewas introduced to the Custody Manager and read hisrights under part nine of the Law EnforcementPowers and Responsibilities Act, 2007.

Police spoke to the security guards involved andviewed CCTV footage which shows the matters in theDee Why Hotel and the assault upon . AnAmbulance attended and administered first aid to

at the Hotel. As a result of theassault, suffered bruising and swellingto his left cheek. As a result of the secondassault, Senior Constable suffered sorenessto the left side of his head, a headache and asore neck.

Due to his aggression and intoxication, Police didnot offer the accused an interview.

and Senior Constable did not givetheir permission to the accused to be assaulted.

The accused is charged with the matters to be putbefore the court.

Should the matter proceed to sentence, Policerequest the CCTV footage be played.

The 4 males listed above were in the group withthe accused, . The 2 witnesses wereasked to leave the Dee Why Hotel and took sometime to leave, although were not seen acting in anadverse manner in the CCTV footage. The witnesseswere also cooperative with Police.

POI2 , who is named in the fact sheet, wasuncooperative with Security when been asked toleave and after been eventually removed out ontoPittwater Road, refused to move out of the 50metre vicinity for some time.

POI3 required to be forcefully removed bysecurity after being asked to leave, whichresulted in him being pushed out onto thefootpath, causing minor grazes to his legs. POIJONES was uncooperative with Police, belligerentand confrontational.

All persons listed above were issued official movealong directions to leave the Dee Why area for aperiod of 6 hours due to their intoxication anddisorderly behaviour. POI2 later returned tothe scene where Police had the accused placed inhandcuffs waiting for conformation of the CCTVfootage details. POI2 was not actingdisorderly at this time and just kept enquiring asto the welfare of the accused. Police issued POI2

with a further move along direction to leavethe Dee Why area for 6 hours, although he refused,insisting to stay with the accused. POI2made attempts to walk past police to speak to theaccused and was refusing to listen to theirdirections. Due to the aggressive behaviour ofPOI2 earlier in the night, his current

behaviour and his non compliance with the movealong direction, POI2 was placed underarrest for the offence and placed him inhandcuffs. When Police had placed the accused intoa caged truck and conveyed him away, POI2agreed to leave the area. Police removed thehandcuffs and discontinued the arrest. POI2left the area in a Taxi.

Police are yet to view CCTV footage as it has notbeen provided, due to the size and the Dee WhyHotel not having the appropriate storage device.Police will follow up with the Licensee, NickRUSH, for the footage and view before deciding onthe most appropriate infringements for POI2and POI3 .

walked to the entrance of the Hotel. A guard briefly explained that another guard had been

involved. Police approached the Taxi and showed their Police warrant badges to the group,

asking the group of five males, including the accused, to get out of the Taxi and, due to them

being near by where an alleged assault took place, provide their names and addresses and

some identification. All parties provided some identification, including the accused, who

produced a NSW drivers licence 19983351, in the name of the accused which included a

photo that depicted him.

another few metres Senior Constable caught up to the accused. The accused

stopped and turned to Senior Constable , raising his arms up and clenching his fists

at him. To prevent being assaulted and to protect himself from physical harm, Senior

Constable deployed a one second burst of Oleoresin Spray into the eyes of the

accused, causing him to grab his eyes and bend over forwards. Senior Constable

took hold of the accused and attempted to place him onto the ground where he could

control him and place handcuffs on him. At this stage Senior Constable arrived and

The accused in this matter isborn .

On the night of Saturday 14 July 2018 the accusedand his girlfriend have rented ahotel room at the Kings Hotel, 39 DarlinghurstRoad, Potts Point. The accused and LOWE werestaying in Room 15.

There is a application for Apprehended DomesticViolence Order which is being heard at Mt DruittLocal court on Monday 16th July 2018 listing theaccused as the defendant and as the PINOP.

During the course of the night the accused andLOWE have become involved in some form of domesticincident within their room.

About 10:45pm on Saturday 14 July 2018, LOWE hascontacted Kings Cross police station stating "Ihave just had an argument with my boyfriend, wehave an AVO in place, send police".

About 11:00pm, has again contacted KingsCross police station and stated "I think policeare out the front but I can't let them up as he'sstopping me from getting to the door" Police couldthen hear a male and female shouting and scufflingin the background as the phone dropped to thefloor.

Police have urgently made their way to the KingsHotel where they were let inside the building byanother resident, and made their way to room 15where they observed . stated "He's left"and has declined to speak further with police orgive them any other information about whathappened.

A minute or so later other police have arrived atthe Kings Hotel, as they were waiting to gainentry to the building the accused has walked downthe stairs through the foyer to leave, and openedthe door for police. Police could see the accusedright hand was swollen and grazed and he had asplit lip. Police have asked the accused for hisname which he stated " " which policerecognised as the same name of the male involvedin the domestic. Whilst the accused was talking heslurred his words and was sweating profusely fromhis forehead.

Police have activated their body worn video cameraand observed room key 15 in the accused hand.Police have informed the accused theirconversation and his actions were being recordedand police introduced themselves by name, rank andstation.

The accused was questioned on what has happenedduring the night to which he stated "Me and mypartner had an argument tonight. . Wecome in here and she told me she has been fuckingother people. I work full time and she doesn't. Ipaid for the hotel room and the fucking night outand she told me she's gonna fucking leave.... Isaid 'call the cops' ".

The accused was asked why his lip was bleedingwhich he responded with "She punched me". Policehave cautioned the accused and he responded with"Yep I understand, she did not punch me. I don'twant to say another word".

Police requested the accused to place his hands onthe wall behind him as they wished to search himwhich he complied with. As police were searchingthe accused he called out "Great night Jasmine....love you boo".

A few seconds later has quickly walked downstairs to the foyer of where the accused was beingsearched. As came into view the accusedquickly became upset, as he was sweating more andstarted crying whilst saying "Don't worry aboutthat hard cunt... it's over boo".

OFFENCE 1: Assault policeThe accused has removed his hands off the wall andturned towards . He was instructed by LeadingSenior Constable to keep his hands on thewall. The accused turned around and said "Don'tfucking touch me you fucking dog" at the same timepushing Leading Senior Constable to thechest.

OFFENCE 2: Resist police x 6The accused started to violently resist police andwas wrestled to the ground by Leading SeniorConstable , Leading Senior Constable ,Leading Senior Constable , Constable ,Constable , and Constable . The accusedwas instructed he was under arrest and to placehis hands behind his back, relax, and cooperatewith police. The accused refused and continued towrestle and resist police efforts control andhandcuff him.

to the right hand side of the face causingimmediate pain and swelling.

The shock of being punched caused Leading SeniorConstable to let go of the accused legs. Theaccused has lifted his right foot and with theheel driven it into the mouth of Leading SeniorConstable . The force of the kick has chipped

'S front two incisor teeth, this causedimmediate pain and pieces of tooth fell from hismouth. will require extensive dentistry workto repair his teeth. The accused stated "Come oncunt, is that all you got"

Further police assisted and the accused wasfinally contained within the rear of the cagedvehicle. The accused started shouting "Fuckingdogs I'll get you" whilst kicking at the vehicledoor.

The accused was conveyed to Kings Cross chargeroom, where whilst still in the back of the cagedvehicle was spitting everywhere then vomited alarge amount of bourbon and cola. The accusedcontinued to abuse and threaten to assault policethrough the back of the vehicle.

Due to his behaviour he was forcibly removed fromthe vehicle before being searched and taken to aprisoner holding dock.

Whilst in the holding dock the accused yelled,abused and threaten to assault police if theyopened the door or came near him. No custodyquestions were asked of the accused due to hisaggressive behaviour. The accused constantly spatand in the dock and urinated in the dock.

OFFENCE 7: Assault policeWhilst police were going through theirinvestigation into the incident the accused hasspat between the perspex and door of the dock atpolice. This spittle has landed on the chest ofLeading Senior Constable .

OFFENCE 8: Intimidate PoliceOver the next couple of hours the accusedcontinued to spit from the gap in the dock door atpolice, this all hit the ground in front of himand a perspex shield protecting police using thecomputers.

The accused continued to shout at police, "Thefirst chance I get I'll fucking stab you" "You

OFFENCE 9: Breach of bailThe accused is currently on Bail for the offencesof 'Stalk/intimidateintend fear physical etc harm'and 'Use carriage service tomenace/harass/offend', charge H66492458 relates.

One of the conditions of the accused bail is toreside at: 30/ 7 Bougainville Road, LethbridgePark, NSW 2770. This condition is in place untilhis next court appearance on 23 July 2018.

The accused attempting to reside at the KingsHotel, 39 Darlinghurst Road, Potts Point is inbreach of his bail.

Police could see dried blood on LOWE face. Afemale officer initially asked her what happenedand LOWE stated "He punched me in the face, he bitme on the head, and pushed me". As other policeentered the room declined to comment furtherand told police she won't be making a statement orparticipating in a DVEK.

A few minutes later the defendant was spoken to inthe foyer of the Kings Hotel by other police.Police had a conversation with him on Body WornVideo where he stated "Me and my partner had anargument tonight. . We come in hereand she told me she has been fucking otherpeople. I work full time and she doesn't. I paidfor the hotel room and the fucking night out andshe told me she's gonna fucking leave.... I said'call the cops' ".

Police could see the defendant had a swollen handwith grazes and a split and swollen lip.

Upon hearing the defendants voice has comedown stairs which aggravated the defendant and hestated "Don't worry about that hard cunt... it'sover boo". Moments later the defendant wasinvolved in a long wrestle with police which hewas arrested and charged for.

After the defendant was taken from the scene,police attempted to speak with in her room.She has verbally abused police and denied evencalling them. has demanded police leave herroom which they did.

Road, Potts Point. The accused and were staying in Room 15.

There is a application for Apprehended Domestic Violence Order which is being heard at Mt

Druitt Local court on Monday 16th July 2018 listing the accused as the defendant and

as the PINOP.

During the course of the night the accused and have become involved in some form

of domestic incident within their room.

About 10:45pm on Saturday 14 July 2018, has contacted Kings Cross police station

stating "I have just had an argument with my boyfriend, we have an AVO in place, send

police".

About 11:00pm, has again contacted Kings Cross police station and stated "I think

police are out the front but I can't let them up as he's stopping me from getting to the door"

Police could then hear a male and female shouting and scuffling in the background as the

phone dropped to the floor.

Police have urgently made their way to the Kings Hotel where they were let inside the

building by another resident, and made their way to room 15 where they observed .

stated "He's left" and has declined to speak further with police or give them any other

information about what happened.

A minute or so later other police have arrived at the Kings Hotel, as they were waiting to gain

entry to the building the accused has walked down the stairs through the foyer to leave, and

opened the door for police. Police could see the accused right hand was swollen and grazed

and he had a split lip. Police have asked the accused for his name which he stated " "

which police recognised as the same name of the male involved in the domestic. Whilst the

accused was talking he slurred his words and was sweating profusely from his forehead.

Police have activated their body worn video camera and observed room key 15 in the

accused hand. Police have informed the accused their conversation and his actions were

being recorded and police introduced themselves by name, rank and station.

The accused was questioned on what has happened during the night to which he stated

"Me and my partner had an argument tonight. . We come in here and she told

me she has been fucking other people. I work full time and she doesn't. I paid for the hotel

room and the fucking night out and she told me she's gonna fucking leave.... I said 'call the

cops' ".

The accused was asked why his lip was bleeding which he responded with "She punched

me". Police have cautioned the accused and he responded with "Yep I understand, she did

not punch me. I don't want to say another word".

Police requested the accused to place his hands on the wall behind him as they wished to

search him which he complied with. As police were searching the accused he called out

"Great night Jasmine.... love you boo".

A few seconds later has quickly walked down stairs to the foyer of where the accused

was being searched. As came into view the accused quickly became upset, as he

was sweating more and started crying whilst saying "Don't worry about that hard cunt... it's

over boo".

OFFENCE 1: Assault police The accused has removed his hands off the wall and turned

towards . He was instructed by Leading Senior Constable to keep his hands

on the wall to prevent a breach of the peace. The accused turned around and said "Don't

fucking touch me you fucking dog" at the same time pushing Leading Senior Constable

to the chest.

OFFENCE 2: Resist police x 6 The accused started to violently resist police and was wrestled

to the ground by Leading Senior Constable , Leading Senior Constable ,

Leading Senior Constable , Constable , Constable , and Constable

PHELPS. The accused was instructed he was under arrest and to place his hands behind his

back, relax, and cooperate with police. The accused refused and continued to wrestle and

resist police efforts control and handcuff him.

OFFENCE 3: Assault police Whilst police were attempting to control and arrest the accused

he started to bring phlegm into his mouth to spit at police. Constable has placed his

hand next to the accused mouth to stop being spat on. The accused has bit Constable

on the hand. This caused Constable immediate pain though no bleeding

as he was wearing leather gloves.

The accused has grabbed the body worn video of police and said "See you're all on

camera". This was removed from the accused and secured.

OFFENCE 4: Assault police Whilst Constable was attempting to place handcuffs on

the accused he has punched Constable to the face and also attempted to bite his

fingers, though just missing and only getting a blue latex glove finger.

OFFENCE 5: Assault police Whilst Leading Senior Constable was attempting to

handcuff and control the accused he has bitten on the left knee. This caused

immediate pain.

After wrestling and resisting police for approximately 2 minutes, police were finally able to

handcuff the accused to the front where he was escorted out of the premises and towards a

waiting caged police vehicle.

Whilst inside the Kings Hotel the entire incident is captured on their CCTV system and initial

dealings on Leading Senior Constable body worn video camera.

Police canvassed other guests within the hotel and as there is no independent evidence

police are able to take any action against the accused or for the initial domestic.

OFFENCE 6: Assault police - GBH The accused continued to struggle and resist police as

he was being placed into the rear of the caged vehicle. The accused was on his back with

his legs still hanging out of the vehicle. When police went to lift his legs into the vehicle he

has sat up and punched Leading Senior Constable to the right hand side of the face

causing immediate pain and swelling.

The shock of being punched caused Leading Senior Constable to let go of the

accused legs. The accused has lifted his right foot and with the heel driven it into the mouth

of Leading Senior Constable . The force of the kick has chipped 'S front two

incisor teeth, this caused immediate pain and pieces of tooth fell from his mouth.

will require extensive dentistry work to repair his teeth. The accused stated "Come on

cunt, is that all you got"

Further police assisted and the accused was finally contained within the rear of the caged

vehicle. Theaccused started shouting "Fucking dogs I'll get you" whilst kicking at the vehicle

door.

The accused was conveyed to Kings Cross charge room, where whilst still in the back of the

caged vehicle was spitting everywhere then vomited a large amount of bourbon and cola.

The accused continued to abuse and threaten to assault police through the back of the

vehicle.

Due to his behaviour he was forcibly removed from the vehicle before being searched and

taken to a prisoner holding dock.

Whilst in the holding dock the accused yelled, abused and threaten to assault police if they

opened the door or came near him. No custody questions were asked of the accused due to

his aggressive behaviour. The accused constantly spat and in the dock and urinated in the

dock.

OFFENCE 7: Assault police Whilst police were going through their investigation into the

incident the accused has spat between the perspex and door of the dock at police. This

spittle has landed on the chest of Leading Senior Constable .

OFFENCE 8: Intimidate Police Over the next couple of hours the accused continued to spit

from the gap in the dock door at police, this all hit the ground in front of him and a perspex

shield protecting police using the computers.

The accused continued to shout at police, "The first chance I get I'll fucking stab you" "You

open this door and you're fucking dead" "There's no chance I'm leaving this dock and going

correctives".

Due to the accused aggressive behaviour he was not offered to participate in an interview

and no custody photos or fingerprints were taken from him.

The Accused left his home address after his fathercontacted police and continued drinkingintoxicating liquor at an unknown location for theduration of the afternoon. About 7:00 pm the sameevening the Accused made his way to the PagewoodHotel.

Whilst in the Pagewood Hotel the Accused walkedaround harassing patrons asking for cigarettes.The manager of the premises became aware of thisand asked the Accused to leave. After a short timethe Accused left the venue. The Accused madeattempts to re enter the premises however wasturned away.

The Accused subsequently made his way to the busstop outside the 'Elissar Lebanese Restaurant'.Whilst in the bus stop the Accused continued todrink intoxicating liquor from glass bottles.

The Accused remained in the bus stop for a shorttime until approximately 7:25 pm when the Victimdrove past the bus stop. As the Victim made herway southbound along Bunnerong Road, past the busstop the Accused has thrown a glass bottle towardsthe Victim's car. The bottle has landed on thewindscreen of the vehicle causing a loud bang, andthe windscreen to chip.

The Victim stopped her car and got out to have alook and saw that there was broken glass acrossthe front of her vehicle. As the Victim wasinspecting her vehicle she saw the Accused personstanding in the bus stop. As she was looking inthat direction, another vehicle drove past and theAccused threw another glass bottle towards thatcar however it didn't make contact.

The Victim took out her mobile phone and began towalk towards the Accused, who by this point hadmade his way towards Glanfield Street and waslurking in the darkness near the entrance to theLebanese restaurant. The Victim filmed the Accusedfrom a distance and said, "Stop throwing things atcars you idiot." At this point the Accused beganto make his way towards the Victim. The Victim

felt unsafe and so retreated back to her car andmade her way to Maroubra Police Station to make areport.

A short time later police arrived at the locationand found the Accused to be leaning against thefence of the restaurant in a clearly intoxicatedstate. The Accused was mumbling to himself in whatsounded like a foreign language. Police introducedthemselves to the Accused and began a shortconversation with him during which he became moreand more aggressive. The Accused showed signs ofbeing under the influence of a prohibited drugalong with alcohol intoxication.

After a short time dealing with the Accused policeinitiated their body worn video camera.

Police begin searching the Accused due to hisbehaviour and their belief he was under theinfluence of drugs. During this search t?heAccused became increasingly aggressive and beganto back away from police. Police directed theAccused to remove the necklace he is wearing towhich he refuses. The Accused once again begins tospeak in a mumbled language before saying toConstable , "Who are you? You Pakistanicunt."

Police became aware the Accused was to be arrestedfor damaging the Victim's vehicle. Police informthe Accused that he is under arrest and advise himthat he is going to be taken back to MaroubraPolice Station at which point he says, "Woah Woahbrother, hold up."

Police take hold of the Accused by his wrists atwhich point he begins to struggle. The Accusedinitially falls to the ground after the shortstruggle however makes his way back to his feetall the while fighting with police, pushing andshoving and saying, "fuck you cunt, fuck you."

Whilst the Accused was fighting and resisting heswung towards police with an open left hand andscratched Constable 's face causing hisglasses to fall from his face onto the ground andnumerous scratch marks to appear around his righteye. The Accused continued to resist before beingtaken to the ground.

Whilst police made an attempt to handcuff theAccused, the Accused bit Constable on herleft forearm near her elbow. This bite causedimmediate pain to Constable to which she

responded by screaming to the Accused, "Don't biteme!"

After a continued struggle, the Accused waseventually restrained once further police arrivedat the location and assisted in placing theAccused in handcuffs.

The Accused was conveyed to Maroubra PoliceStation and introduced to the Custody Manager andexplained his rights under Part Nine (9) of theLaw Enforcement (Powers and Responsibilities) Act2002.

Due to the Accused persons intoxicated state, hewas not offered the opportunity to be interviewedfor both matters.

These matters are now before the courts.

Offence One - Assault Occasioning Actual Bodily Harm (DV)

The Accused, the Victim and his wife reside at

. The Accused resides in the rear of the property in a self contained granny flat.

The Victim resides in the main house along with his wife.

About 1:00 pm on Saturday the 4th of August 2018, the Victim arrived home along with his

wife. At this time the Accused was in the kitchen talking to himself and cutting up food at the

kitchen sink. Due to this behaviour the Victim believed the Accused was intoxicated. This

lead to the Victim asking the Accused " Have you been drinking?" This has caused the

Accused to erupt with aggression and start yelling at the Victim and his wife.

At this time the Victim has walked behind the Accused to walk into the bathroom and whilst

doing so the Accused has pushed the Victim in the back with such force the Victim has fallen

into the door and grazed his right forearm causing bleeding and bruising.

The Victim immediately contacted police. This caused the Accused person to leave the

residence.

About 2:00 pm the same day, police attended the Victim's address and took a video

statement whilst also obtaining photographs of his injuries.

Police left the scene and returned to the station in order to apply for an immediate

Apprehended Domestic Violence Order.

The Accused left his home address after his father contacted police and continued drinking

intoxicating liquor at an unknown location for the duration of the afternoon. About 7:00 pm

the same evening the Accused made his way to the Pagewood Hotel.

Whilst in the Pagewood Hotel the Accused walked around harassing patrons asking for

cigarettes. The manager of the premises became aware of this and asked the Accused to

leave. After a short time the Accused left the venue. The Accused made attempts to re enter

the premises however was turned away.

The Accused subsequently made his way to the bus stop outside the 'Elissar Lebanese

Restaurant'. Whilst in the bus stop the Accused continued to drink intoxicating liquor from

glass bottles.

The Accused remained in the bus stop for a short time until approximately 7:25 pm when the

Victim drove past the bus stop. As the Victim made her way southbound along Bunnerong

Road, past the bus stop the Accused has thrown a glass bottle towards the Victim's car. The

bottle has landed on the windscreen of the vehicle causing a loud bang, and the windscreen

to chip.

The Victim stopped her car and got out to have a look and saw that there was broken glass

across the front of her vehicle. As the Victim was inspecting her vehicle she saw the Accused

person standing in the bus stop. As she was looking in that direction, another vehicle drove

past and the Accused threw another glass bottle towards that car however it didn't make

contact.

The Victim took out her mobile phone and began to walk towards the Accused, who by this

point had made his way towards Glanfield Street and was lurking in the darkness near the

entrance to the Lebanese restaurant. The Victim filmed the Accused from a distance and

said, "Stop throwing things at cars you idiot." At this point the Accused began to make his

way towards the Victim. The Victim felt unsafe and so retreated back to her car and made

her way to Maroubra Police Station to make a report.

A short time later police arrived at the location and found the Accused to be leaning against

the fence of the restaurant in a clearly intoxicated state. The Accused was mumbling to

himself in what sounded like a foreign language. Police introduced themselves to the

Accused and began a short conversation with him during which he became more and more

aggressive. The Accused showed signs of being under the influence of a prohibited drug

along with alcohol intoxication.

After a short time dealing with the Accused police initiated their body worn video camera.

Police begin searching the Accused due to his behaviour and their belief he was under the

influence of drugs. During this search t?he Accused became increasingly aggressive and

began to back away from police. Police directed the Accused to remove the necklace he is

wearing to which he refuses. The Accused once again begins to speak in a mumbled

language before saying to Constable , "Who are you? You Pakistani cunt."

Police became aware the Accused was to be arrested for damaging the Victim's vehicle.

Police inform the Accused that he is under arrest and advise him that he is going to be taken

back to Maroubra Police Station at which point he says, "Woah Woah brother, hold up."

Police take hold of the Accused by his wrists at which point he begins to struggle. The

Accused initially falls to the ground after the short struggle however makes his way back to

his feet all the while fighting with police, pushing and shoving and saying, "fuck you cunt,

fuck you."

Whilst the Accused was fighting and resisting he swung towards police with an open left

hand and scratched Constable 's face causing his glasses to fall from his face onto

the ground and break. As a result numerous scratch marks appeared around his right eye.

The Accused continued to resist before being taken to the ground.

Whilst police made an attempt to handcuff the Accused, the Accused bit Constable

on her left forearm near her elbow. This bite caused immediate pain to Constable to

which she responded by screaming to the Accused, "Don't bite me!" Constable

suffered a red abrasion to her left forearm, breaking the skin.

After a continued struggle, the Accused was eventually restrained once further police arrived

at the location and assisted in placing the Accused in handcuffs.

The Accused was conveyed to Maroubra Police Station and introduced to the Custody

Manager and explained his rights under Part Nine (9) of the Law Enforcement (Powers and

Responsibilities) Act 2002.

Due to the Accused persons intoxicated state, he was not offered the opportunity to be

interviewed for both matters.

The Victim intends to seek compensation for the damage to her windscreen.

Both Constable and Constable were required to attend the hospital for

assessment. As a result of their injuries the pair were required to receive a tetanus injection.

These matters are now before the courts.

About 9:30pm Police attended the LOC to assistCamperdown Mental Health Crisis team for anassessment of the PAT

Upon arrival Police knocked on the door to attemptto speak to the PAT, however the PAT did notanswer the door. Police were given a key to accessthe property by the owner the PAT's father. Withthe permission of the owner police entered theproperty announcing there presence as they enteredaccompanied by the two members from the mentalhealth crisis team.

The PAT approached police from the bedroom of theunit and began speaking to the PAT at this timethe PAT yelled at police asking them why they werethere and how they had gained entry. Police toldthe PAT that they had a key which they had used.

The PAT appeared to be in a highly manic state andwas constantly rambling to police in an agressivemanner after a couple of minutes of communicationwith the PAT the Crisis team staff informed policethat they have now scheduled the PAT and policeinformed the PAT of this.

At this time the PAT attempted to push past policeand was asked not to. The PAT remained manicthroughout the interaction and appeared to besuffering from delusions. The PAT then attemptedto push past police and at this time police toldthe PAT that he would be placed in handcuffs. Aspolice attempted to grab the PAT he struck out atpolice using his right arm and punched ConstableSTACEY to the left side of the head on 4 occasions

and striking Constable to the right chestin a failed attempt to punch constable a5th time. Polcie called for urgent assistance.

The PAT placed officer in a headlock underhis right arm Stating " I've got your Skull"before releasing his grip.

The Members from Camperdown Crisis Team assitedpolice in restraining police and at this time

, was kicked by the PAT to the left leg ofcausing him to suffer a dead leg.

The PAT continued to resist police and were beingoverpowered by the PAT, at this time OfficerStacey removed his taser from its holster andactivated it in a draw and cover manner, informingthe PAT to get on the ground or he will betasered.

Police manager to get the PAT on the ground and hewas placed in handcuffs. After being handcuffedthe PAT became compliant with police howevercontinued to ramble and appeared to remaindelusional.

Further Police arrived at the LOC to assist withthe PAT, Followed by Ambulance officers whosedated the PAT before restraining him fortransportation to Royal Prince Alfred Hospital(RPA). Police accompained the PAT onboard theambulance to ensure their safety.

The pat was admitted to the emergency departmentat RPA about 10:20pm.

Police are having increasing interactions with thePAT and have had to assist the crisis team on theprevious 3 dealing with the PAT, the crisis teamcurrently will not attend the LOC with out theassistance of police, and the PAT has had to bephysically restrained by police on the previous 3interactions. The PAT's violence has beenincreasing in severity with each interaction theyhave had with the PAT

Police to charge the PAT with assault andresist/hinder related charges following furtherinvestigation and taking of statements fromwitnesses and victim from Camperdown Mental HealthCrisis team

Crisis Team to assess the mental health status ofthe accused, ..Once police were at the location Constable Staceyhad a conversation with witness 2,

and in turn has calledthe accused's father who has attended the locationand provided police and the crisis team with a keyto the residence, as he is the owner of theproperty, and informed them that they could usethe key to enter the property..Constable Stacey, Constable and Constable

have entered the premises and announcedtheir office. The accused has approached policefrom the bedroom that is located towards the rearof the unit and began yelling at police. Theaccused was speaking very quickly and wasaggressive with police..After interacting with the accused for a shorttime has informed police that theaccused was now under schedule. Constableconfirmed with that the accusedwas under schedule and would need to be conveyedto hospital..Constable said "OK, what's going to happentonight is you're going to have to go to hospitaltonight, OK?"The accused said "No I'm not." Constableagain informed the accused what was going to occurand asked Constable to call for anambulance to attend the location..The accused has tried to push past Constable

About 9.30pm on Monday the 1st of October 2018, victim 1, Constable Rick Stacey, victim 2,

Constable and witness 1, , have attended unit

in relation to assisting the Camperdown Crisis Team to assess the

mental health status of the accused, .

Once police were at the location Constable had a conversation with witness 2,

and in turn has called the accused's father who has

attended the location and provided police and the crisis team with a key to the residence, as

he is the owner of the property, and informed them that they could use the key to enter the

property.

Constable , Constable and Constable have entered the premises and

announced their office. The accused has approached police from the bedroom that is

located towards the rear of the unit and began yelling at police. The accused was speaking

very quickly and was aggressive with police.

After interacting with the accused for a short time has informed police

that the accused was now under schedule. Constable confirmed with

that the accused was under schedule and would need to be conveyed to hospital.

Constable Stacey said "OK, what's going to happen tonight is you're going to have to go to

hospital tonight, OK?" The accused said "No I'm not." Constable again informed the

accused what was going to occur and asked Constable to call for an ambulance to

attend the location.

The accused has tried to push past Constable and was behaving in an erratic

manner and was rambling. has tried talking to the accused and Constable

had a conversation with the accused. During this conversation Constable has

asked the accused if he had anything in his pockets. The accused has turned out his

pockets and tried to push past Constable and Constable again.

The accused continued to ramble to police and became increasingly aggressive before

swinging his right arm in a punching motion which made contact with the left side of

Constable 's head. The accused has thrown four more punches towards police, again

hitting Constable to the side of his head which caused serious pain and dizziness to

Constable . Constable came to the assistance of Constable and was

punched in the chest area by the accused, causing pain and discomfort.

The accused has grabbed Constable in a headlock with his right arm and said "I've

got your skull." Constable has called for urgent assistance via police radio. Constable

has attempted to restrain the accused using approved weapon-less control

techniques including hammer strikes to the upper arm of the accused and knee strikes to the

accused's leg.

The two staff members from the Camperdown Crisis Team,

, have assisted police with trying to restrain the accused. Constable has

removed his taser from it's holster, activating it in a draw and cover manner and said "Get on

the ground or you will be tasered get on the ground now. Stop resisting."

The accused was wrestled to the ground where Constable has placed him in

handcuffs to prevent further injury. At that point several other police officers arrived and the

This incident was captured on a police body worn video and audio recording device in it's

entirety.

The accused was taken outside and placed on a stretcher and put in mechanical restraints

and conveyed to Royal Prince Alfred Hospital with a police escort. The accused was admitted

to Royal Prince Alfred Hospital at 10.20pm on Monday the 1st October 2018. The next day

the accused was conveyed to Concord Mental Health Facility and remained there for 10

days.

Constable was treated at Royal Prince Alfred Hospital and diagnosed with a

concussion. Several days later, the face and head of Constable was still significantly

swollen.

About 3pm on Friday 12th October 2018, police were notified by staff at Concord Mental

Health Hospital that the accused was cleared to be discharged from hospital.

About 4pm that afternoon, police attended Concord Mental Health Hospital, introduced

themselves, placed the accused under arrest and cautioned him. The accused was

conveyed to Burwood Police Station where he was introduced to the Custody Manager and

informed of his rights. The accused was offered the opportunity to participate in an interview,

which he declined.

The accused is charged with the matter before the court.

About 7.50am on Monday the 26th of November 2018the accused drove a silver Toyota Kluger stationwagon bearing New South Wales registration ,in a northerly direction on Fairfield Road,Guildford West.

The accused approached the intersection ofDennistoun Avenue where there are a total of three'No Right Turn' signs displayed. The accusedproceeded by turning right from Fairfield Roadonto Dennistoun Avenue and then proceeded in aneasterly direction.

A Senior Constable Police, working alpha, stoppedhis motor vehicle and approached the accused whowas seated in the drivers seat and the soleoccupant of the vehicle. The accused was told thereason for the stop as disobeying a no right turnsign and he responded, "I'm just in a hurry". Theaccused was then asked to produce his driverslicence to which he complied with and produced aclass C, unrestricted, New South Wales driverslicence number , in his name, with anexpiry date of 25 August 2021.

Police submitted the accused to a road side breathtest which returned a negative reading. He wasthen submitted to a random oral fluid test whichwas also negative.

Police conducted checks on the accused personsdrivers licence via the records held by the Roadsand Maritime Services. The checks confirmed thatthe accused is the holder of the previouslymentioned licence, however the status of thelicence was endorsed as suspended due to demeritpoints between the 16th of October 2018 and 15thof January 2019.

Police approached the accused and spoke to himabout his licence status where he denied anyknowledge of it currently being suspended. Theaccused was advised that he is not allowed todrive from this point onwards and to make anynecessary phone calls whilst police completed thenecessary paperwork. At this point the accuseddirectly stated to police, "I'm telling you, I'mnot going to walk, I'm going to drive home." As aresult police asked the accused to step out of themotor vehicle to ensure he does not commit anoffence. Police also opened the drivers doorwhilst making the request. The accused immediatelyreached over with his right hand to the ignitionof the vehicle and turned the keys whilst at thesame time he put his right foot on the brake pedaland his left hand onto the transmission lever andthe vehicles engine started. Police immediatelyreached in to grab the keys from the ignition andthe accused attempted to prevent police fromgrabbing the keys by reaching over with his righthand and grabbed the officers right hand and triedto push away. Police managed to grab the key fromthe ignition and began to verbally demand thedriver to get out of the vehicle which he refused.Police attempted to pull the accused out of thevehicle which led to a short wrestle whilst theaccused was still seated in the drivers seat.During this wrestle the accused refused to complyand resisted police arrest. The keys of the motorvehicle also fell onto the road way.

Police immediately called for urgent assistanceand soon after retreated back towards the roadwayin order to create a safe gap. The accused steppedout of the vehicle and began to walk towardspolice. Police stated "Get back" and drew theOlerion Capsicum Spray. As the accused continuedwalking police sprayed the Olerion Capsicum Spraytowards the face of the accused which wasineffective due to the accused wearing spectacles.The accused managed to grab the car keys from theroad way and began walking back to the driversseat of his motor vehicle.

Police again tried to prevent him from enteringthe vehicle by grabbing a hold of him from therear. The accused continued to resist and managedto sit back in the drivers seat. As policecontinued to try and remove him from the vehiclethe accused began to strike the police officerwith his right hand multiple times. One thesestrikes caused a large 9 centimetre long scratchon the right arm bicep of the police officer whichdrew blood and caused bruising.

Police again called for urgent assistance andprovided a location and grappled the accusedaround his torso in order to prevent furtherstrikes and again sprayed the Olerison CapsicumSpray directly to the right eye of the accusedwithin close proximity which was effective as theaccused yelled out in pain for his eyes.

At this point a civilian had stopped his motorvehicle and approached the scene. Police requestedassistance from the civilian who grabbed the legsof the accused and assisted in pulling him out ofthe vehicleand onto the roadway.

The accused was then handcuffed, searched andadvised of the reason for arrest before he wascautioned.

The accused was moved off the roadway to the kerband rendered aid as other police arrived on scene.Police used a hose to wash his eyes and requestedan ambulance to attend. A short time later theaccused stated he did not want paramedics. He wasthen conveyed to Granville Police Station where hewas introduced to the custody manager and read hisrights under part 9 of LEPRA.

The accused was afforded an opportunity toparticipate in an electronically recordedinterview to which he declined.

The officer involved sustained a large scratch tohis right bicep, a small laceration to his righthad middle finger and some grazes to his leftelbow whilst attempting to arrest the accused andprevent him from driving away. The scratch to thebicep caused pain and discomfort.

As a result the accused is now charged with thematters before the court.

immediately reached over with his right hand to the ignition of the vehicle and turned the

keys whilst at the same time he put his right foot on the brake pedal and his left hand onto

the transmission lever and the vehicles engine started. Police immediately reached in to grab

the keys from the ignition and the accused attempted to prevent police from grabbing the

keys by reaching over with his right hand and grabbed the officers right hand and tried to

push away. Police managed to grab the key from the ignition and began to verbally demand

the driver to get out of the vehicle which he refused. Police attempted to pull the accused

out of the vehicle which led to a short wrestle whilst the accused was still seated in the

drivers seat. During this wrestle the accused refused to comply and resisted police arrest.

The keys of the motor vehicle also fell onto the road way.

Police immediately called for urgent assistance and soon after retreated back towards the

roadway in order to create a safe gap. The accused stepped out of the vehicle and began to

walk towards police. Police stated "Get back" and drew the Olerion Capsicum Spray. As the

accused continued walking police sprayed the Olerion Capsicum Spray towards the face of

the accused which was ineffective due to the accused wearing spectacles. The accused

managed to grab the car keys from the road way and began walking back to the drivers seat

of his motor vehicle.

Police again tried to prevent him from entering the vehicle by grabbing a hold of him from the

rear. The accused continued to resist and managed to sit back in the drivers seat. As police

continued to try and remove him from the vehicle the accused began to strike the police

officer with his right hand multiple times. One these strikes caused a large 9 centimetre long

scratch on the right arm bicep of the police officer which drew blood and caused bruising.

Police again called for urgent assistance and provided a location and grappled the accused

around his torso in order to prevent further strikes and again sprayed the Olerison Capsicum

Spray directly to the right eye of the accused within close proximity which was effective as

the accused yelled out in pain for his eyes.

At this point a civilian had stopped his motor vehicle and approached the scene. Police

requested assistance from the civilian who grabbed the legs of the accused and assisted in

pulling him out of the vehicle and onto the roadway.

The accused was then handcuffed, searched and advised of the reason for arrest before he

was cautioned.

The accused was moved off the roadway to the kerb and rendered aid as other police arrived

on scene. Police used a hose to wash his eyes and requested an ambulance to attend. A

short time later the accused stated he did not want paramedics. He was then conveyed

toGranville Police Station where he was introduced to the custody manager and read his

rights under part 9 of LEPRA.

The accused was afforded an opportunity to participate in an electronically recorded

interview to which he declined. The accused however apologised for his actions and stated,

"I don't know what came over me this morning."

The officer involved sustained a large scratch to his right bicep, a small laceration to his right

had middle finger and some grazes to his left elbow whilst attempting to arrest the accused

and prevent him from driving away. The scratch to the bicep caused pain and discomfort.

The entirety of the incident has been captured on the in car video from the police vehicle as
