ORGANISATION Ministry of Infrastructure and the Environment

The Ministry of Infrastructure and Water management is committed to improving quality of life, access and mobility in a clean, safe and sustainable environment. The Ministry strives to create an efficient network of roads, railways, waterways and airways, effective water management to protect against flooding, and improved air and water quality.

Organisation Generally speaking, the Ministry of Infrastructure and Water management (I&M) consists of three sections: policy, implementation and inspection. In the policy section, three Directorates-General are concerned with developing policy in the areas of mobility, water management, aviation and maritime affairs, spatial planning and the environment.

The Directorate-General for Public Works and Water Management (Rijkswaterstaat, RWS) ensures that policy is implemented. Human Environment and Transport Inspectorate (ILT) oversees compliance with statutory regulations by private individuals and companies. The Royal Netherlands Meteorological Institute (KNMI) gathers information on the weather, climate and seismology and performs research. The Directorate-General for Public Works and Water Management, Human Environment and Transport Inspectorate (ILT), the Netherlands Emissions Authority, the Netherlands Environmental Assessment Agency and the KNMI are agencies of the ministry.

Human Environment and Transport Inspectorate (ILT) The Human Environment and Transport Inspectorate (ILT) ensures compliance with statutory regulations pertaining to sustainability and physical safety. The ILT is organized into seven inspectorate domains, which adopt an integrated approach in their supervision wherever possible. The inspectorate is led by Inspector-General Mr. J. van den Bos.

ILT / Aviation

The ILT/Aviation department is the Civil Aviation Authority for The Netherlands and is located in Amsterdam. It consists of the following divisions: - Compliance and inspections, - Licensing infrastructure - Licensing operations - Licensing technical - Analysis and development - Planning and service provision

The 'licensing operations' division is, amongst other things, responsible for the standardisation, certification and authorization of examiners.

National Expert Team and Standardisation Committees The purpose of this chapter is to explain the aim of the Std-Cie's within ILT and its composition. Aim: In order to ensure the availability of knowledge and experience on the subject of aviation exams to the government, the minister of Infrastructure and the Environment of The Netherlands has the possibility to install a National Expert Team Practical exams (NET-P). The main task of this NET-P is to guard the standardisation and protection of the quality of skilltest and proficiency checks for pilots and airmen and also to provide the Minister with advice when asked for. NET-P prepares advice to ILT concerning pending improvements, rules and/or regulations and procedures to be used during exams and checks. It also is the first contact for Examiners. Composition: The team consists of 3 subcommittees called Standardisation Committees. The three chairmen of these committees form the NET-P. An Inspector of ILT has been nominated as Chairman of the NET-P. The three subcommittees are: 1) STD-Cie MPA: Multi pilot airplanes: Consists of 8 senior TRE’s, all still working with major

airlines in the Netherlands. All TRE's and SFE's resort under this committee. and Hef: Helicopters. 4 Senior examiners responsible for helicopter issues.

2) STD-Cie CPL: Consists of 6 senior examiners from different Aviation Schools. Dealing with items related to Training facilities for Modular or Integrated Courses including IR and Instructional Courses.

3) STD-Cie GA: General Aviation: 6 Senior examiners dealing with issues of class rating aircraft, balloon, microlight, motorized gliding, SEP, historical/experimental Aviation, PPL in general.

The committees each convene 5 to 6 times per year. Every committee has a diversity of members representing different aircraft types and fields of operation, covering the area of interest of the committee. All members are active pilot and examiner in their respective field. Authorization of the members of the STD-Cies A member of the STD-Cie acts as senior examiner on behalf of ILT. The senior examiner has the authority to perform AoC's for the issue, revalidation or renewal of examiner certificates. The Committee as a whole and the members as individuals do not have the authority to make decisions towards third parties that would be binding for ILT. Task of the STD-Cies: The institution of the standardisation committees was done to contribute to the uniformity and professionalism of aviation-examiners within the respective areas. This has been achieved by: 1) Supervising AoC's for the issue, revalidation or renewal of examiner certificates. 2) The teaching of initial and senior examiner courses and recurrent seminars for examiners. 3) Acting as an intermediary between examiners and ILT. 4) Giving advice regarding standardisation and the interpretation of legislation. 5) Guarding the quality of exams and in this way contributing to the safety of aviation. During the years many answers to questions and decisions by the authority have been collected by the NET-P and put into a database of Frequently Asked Questions (FAQ's). These FAQ's still exist and are a valuable reference for all examiners in The Netherlands. The FAQ is regularly updated 2-3 times/year and has been adapted to EASA-FCL

KIWA NV In 2010 the Human Environment and Transport Inspectorate transferred a part of her licensing tasks to Kiwa NV. Kiwa NV is an international quality management company in Rijswijk, specialized in certification activities in a number of relevant market sectors like shipping, road transport and aviation. Kiwa NV handles all the administration connected with flying licenses, instruction certificates and the associated processing of examination papers and reports. The charges applied by Kiwa are determined in consultation with the government. Kiwa acts under the management responsibility of the Human Environment and Transport Inspectorate (ILT). BASIC REGULATIONS

REGULATION (EU) 2018/1139 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL

of 4 July 2018

on common rules in the field of civil aviation and establishing a European Union Aviation Safety

Agency, and amending Regulations (EC) No 2111/2005, (EC) No 1008/2008, (EU) No 996/2010,

(EU) No 376/2014 and Directives 2014/30/EU and 2014/53/EU of the European Parliament and of

the Council, and repealing Regulations (EC) No 552/2004 and (EC) No 216/2008 of the European

Parliament and of the Council and Council Regulation (EEC) No 3922/91 CHAPTER I

PRINCIPLES Article 1 Subject matter and objectives 1.

1. The principal objective of this Regulation is to establish and maintain a high uniform level of civil aviation safety in the Union. 2. This Regulation further aims to:

(a) contribute to the wider Union aviation policy and to the improvement of the overall performance of the civil aviation sector;

(b) facilitate, in the fields covered by this Regulation, the free movement of goods, persons, services and capital, providing a level playing field for all actors in the internal aviation market, and improve the competitiveness of the Union's aviation industry;

(c) contribute to a high, uniform level of environmental protection;

(d) facilitate, in the fields covered by this Regulation, the movement of goods, services and personnel worldwide, by establishing appropriate cooperation with third countries and their aviation authorities, and by promoting the mutual acceptance of certificates and other relevant documents;

(e) promote cost-efficiency, by, inter alia, avoiding duplication, and promoting effectiveness in regulatory, certification and oversight processes as well as an efficient use of related resources at Union and national level;

(f) contribute, in the fields covered by this Regulation, to establishing and maintaining a high uniform level of civil aviation security;

(g) assist Member States, in the fields covered by this Regulation, in exercising their rights and fulfilling their obligations under the Chicago Convention, by ensuring a common interpretation and a uniform and timely implementation of its provisions, as appropriate;

(h) promote, worldwide, the views of the Union regarding civil aviation standards and civil aviation rules, by establishing appropriate cooperation with third countries and international organisations;

(i) promote research and innovation, inter alia, in regulatory, certification and oversight processes;

(j) promote, in the fields covered by this Regulation, technical and operational interoperability and the sharing of administrative best practices;

(k) support passenger confidence in a safe civil aviation. 3. The objectives set out in paragraphs 1 and 2 shall be achieved by, inter alia: (a) the preparation, adoption and uniform application of all necessary acts; (b) the taking of measures to improve safety standards;

(c) ensuring that the declarations and certificates issued in accordance with this Regulation, and with the delegated and implementing acts adopted on the basis thereof, are valid and recognised throughout the Union, without any additional requirements; (d) the development, with the involvement of standardisation and other industry bodies, of detailed technical standards to be used as a means of compliance with this Regulation, and with the delegated and implementing acts adopted on the basis thereof, where appropriate; (e) the establishment of an independent European Union Aviation Safety Agency (the ‘Agency’); (f) the uniform implementation of all necessary acts by the national competent authorities and the Agency, within their respective areas of responsibility; (g) the gathering, analysis and exchange of information to support evidence-based decision making; (h) the undertaking of awareness and promotion initiatives, including training, communication and dissemination of relevant information.. Article 2 Scope (excerpts) 1. This Regulation shall apply to: (a) The design and production of products, parts and equipment to control aircraft remotely by a natural or legal person under the oversight of the Agency or a Member State, to the extent not covered by point (b); (b) The design, production, maintenance and operation of aircraft, as well as their engines, propellers, parts, noninstalled equipment and equipment to control aircraft remotely, where the aircraft is or will be: (i) registered in a Member State, unless and to the extent that the Member State has transferred its responsibilities pursuant to the Chicago Convention to a third country and the aircraft is operated by a third country aircraft operator; (ii) registered in a third country and operated by an aircraft operator established, residing or with a principal place of business in the territory to which the Treaties apply; (iii) an unmanned aircraft, that is registered neither in a Member State nor in a third country and that is operated within the territory to which the Treaties apply by an aircraft operator established, residing or with a principal place of business within that territory; (c) the operation of aircraft into, within, or out of the territory to which the Treaties apply by a third country aircraft operator; (d) the design, production, maintenance and operation of safety-related aerodrome equipment used or intended for use at the aerodromes referred to in point (e) and the provision of groundhandling services and AMS at those aerodromes; (e) the design, maintenance and operation of aerodromes, including the safety-related equipment used at those aerodromes, located in the territory to which the Treaties apply, which: (i) are open to public use; (ii) serve commercial air transport; and (iii) have a paved instrument runway of 800 metres or more, or exclusively serve helicopters using instrument approach or departure procedures; (f) without prejudice to Union and national law on environment and land-use planning, the safeguarding of surroundings of the aerodromes referred to in point (e); (g) the provision of ATM/ANS in the Single European Sky airspace, and the design, production, maintenance and operation of systems and constituents used in the provision of those ATM/ANS; (h) without prejudice to Regulation (EC) No 551/2004 of the European Parliament and of the Council (1) and the responsibilities of Member States with regard to airspace under their jurisdiction, the design of airspace structures in the Single European Sky airspace.

2. This Regulation shall also apply to the personnel and organisations involved in the activities referred to in paragraph 1. 3. This Regulation shall not apply to: (a) aircraft, and their engines, propellers, parts, non-installed equipment and equipment to control aircraft remotely, while carrying out military, customs, police, search and rescue, firefighting, border control, coastguard or similar activities or services under the control and responsibility of a Member State, undertaken in the public interest by or on behalf of a body vested with the powers of a public authority, and the personnel and organisations involved in the activities and services performed by those aircraft; (b) aerodromes or parts thereof, as well as equipment, personnel and organisations, that are controlled and operated by the military; (c) ATM/ANS, including systems and constituents, personnel and organisations, that are provided or made available by the military; (d) the design, production, maintenance and operation of aircraft the operation of which involves low risk for aviation safety, as listed in Annex I, and to the personnel and organisations involved therein, unless the aircraft has been issued, or has been deemed to have been issued, with a certificate in accordance with Regulation (EC) No 216/2008........

The Member State which has taken an exemption decision pursuant to paragraph 8 shall, without delay, notify the Commission and the Agency of that decision and provide them with all relevant information, and in particular the date from which the that decision applies and the category of aircraft that it concerns. A Member State may decide to modify or revoke an exemption decision that it has taken pursuant to paragraph 8. In such cases, it shall without delay inform the Commission and the Agency thereof. The Agency shall include in the repository referred to in Article 74 all of the decisions of the Member States that have been notified pursuant to this paragraph. An exemption decision taken by a Member State pursuant to paragraph 8 shall also apply to the organisations and personnel involved in the design, production, maintenance and operation activities to which that decision applies. Article 3 Definitions (excerpts)

(a) ‘certification’ means any form of recognition in accordance with this Regulation, based on an appropriate assessment, that a legal or natural person, product, part, non-installed equipment, equipment to control unmanned aircraft remotely, aerodrome, safety-related aerodrome equipment, ATM/ANS system, ATM/ANS constituent or flight simulation training device complies with the applicable requirements of this Regulation and of the delegated and implementing acts adopted on the basis thereof, through the issuance of a certificate attesting such compliance;

(b) ‘certificate’ means any certificate, approval, licence, authorisation, attestation or other document issued as the result of a certification attesting compliance with the applicable requirements;;

Article 21 Pilots 1. Pilots shall be required to hold a pilot licence and a pilot medical certificate appropriate to the operation to be performed, except for situations in which, as a result of the adoption of implementing acts referred to in point (c)(i) of Article 23(1), taking into account the objectives and principles set out in Articles 1 and 4, and in particular the nature and risk of the activity concerned, such licences or medical certificates are not required. 2. The pilot licence referred to in paragraph 1 of this Article shall be issued upon application, when the applicant has demonstrated that he or she complies with the implementing acts referred to in Article 23

adopted to ensure compliance with the essential requirements referred to in Article 20. 3. The pilot medical certificate referred to in paragraph 1 of this Article shall be issued upon application, when the applicant has demonstrated that he or she complies with the implementing acts referred to in Article 23 adopted to ensure compliance with the essential requirements referred to in Article 20. 4. The pilot licence and the pilot medical certificate referred to in paragraph 1 of this Article shall specify the privileges granted to the pilot. The pilot licence and pilot medical certificate may be amended to add or remove privileges, in accordance with the implementing acts referred to in point (c) of Article 23(1). 5. The pilot licence or the pilot medical certificate referred to in paragraph 1 of this Article may be limited, suspended or revoked when the holder no longer complies with the rules and procedures for issuing and maintaining a licence or a medical certificate in accordance with the implementing acts referred to in point (c) of Article 23(1). 6. Training and experience on aircraft not subject to this Regulation may be recognised for the purpose of obtaining the pilot licence referred to in paragraph 1 of this Article, in accordance with the implementing acts referred to in point (c)(iv) of Article 23(1). Article 25 Flight simulation training devices 1. A certificate shall be required in respect of each flight simulation training device used for the training of pilots, except for situations in which, as a result of the adoption of implementing acts referred to in point (a) of Article 27(1), taking into account the objectives and principles set out in Articles 1 and 4, and in particular the nature and risk of the activity concerned, such certificates are not required. 2. The certificate referred to in paragraph 1 of this Article shall be issued upon application, when the applicant has demonstrated that the applicant and the device comply with the implementing acts referred to in Article 27 adopted to ensure compliance with the essential requirements referred to in Article 20. 3. The certificate referred to in paragraph 1 of this Article shall specify the functionalities of the device. The certificate may be amended to reflect changes to those functionalities, in accordance with the implementing acts referred to in point (a) of Article 27(1). 4. The certificate referred to in paragraph 1 of this Article may be limited, suspended or revoked when the holder or the device no longer complies with the rules and procedures for issuing and maintaining such certificate, in accordance with the implementing acts referred to in point (a) of Article 27(1). 5. Where the implementing acts referred to in Article 27 so provide, the organisation responsible for the operation of the flight simulation training device shall be required to declare the compliance of the device with the essential requirements referred in Article 20 and with the detailed specifications established in accordance with the implementing acts referred to in point (b) of Article 27(1). Article 26

Instructors and examiners 1. Persons responsible for providing flight training, flight simulation training, or for assessing pilots' skills, as well as aero-medical examiners, shall be required to hold a certificate, except for situations in which, as a result of the adoption of implementing acts referred to in point (a) of Article 27(1), taking into account the objectives and principles set out in Articles 1 and 4, and in particular the nature and risk of the activity concerned, such certificates are not required. 2. Taking into account the objectives and principles set out in Articles 1 and 4, and in particular the nature and risk of the activity concerned, persons responsible for providing cabin crew training or for assessing cabin crew skills may be required to hold a certificate, in accordance with the implementing acts referred to in point (a) of Article 27(1).

3. The certificates referred to in paragraphs 1 and 2 of this Article shall be issued upon application, when the applicant has demonstrated that he or she complies with the implementing acts referred to in Article 27 adopted to ensure compliance with the essential requirements referred to in Article 20. 4. The certificates referred to in paragraphs 1 and 2 of this Article shall specify the privileges granted. Those certificates may be amended to add or remove privileges, in accordance with the implementing acts referred to in point (a) of Article 27(1). 5. The certificates referred to in paragraphs 1 and 2 of this Article may be limited, suspended or revoked when the holder no longer complies with the rules and procedures for issuing and maintaining such certificates, in accordance with the implementing acts referred to in point (a) of Article 27(1). Article 67 Validity and recognition of certificates and declarations 1. Certificates issued by the Agency or the national competent authorities, and declarations made by natural and legal persons in accordance with this Regulation and with the delegated and implementing acts adopted on the basis thereof shall be subject exclusively to the rules, conditions and procedures laid down in this Regulation and national administrative requirements and shall be valid and recognised in all Member States, without further requirements or evaluation. ANNEX I

PART FCL

SUBPART A, GENERAL REQUIREMENTS (excerpts)

FCL.001 Competent authority For the purpose of this Part, the competent authority shall be an authority designated by the Member State to whom a person applies for the issue of pilot licenses or associated ratings or certificates. FCL.005 Scope This Part establishes the requirements for the issue of pilot licenses and associated ratings and certificates and the conditions of their validity and use. FCL.010 Definitions For the purposes of this Part, the following definitions apply: ‘Aerobatic flight’ means an intentional manoeuvre involving an abrupt change in an aircraft’s attitude, an abnormal attitude, or abnormal acceleration, not necessary for normal flight or for instruction for licenses or ratings other than the aerobatic rating. ‘Aircraft’ means any machine which can derive support in the atmosphere from the reactions of the air other than the reactions of the air against the earth’s surface. ‘Aeroplane’ means an engine-driven fixed-wing aircraft heavier than air which is supported in flight by the dynamic reaction of the air against its wings. ‘Category of aircraft’ means a categorization of aircraft according to specified basic characteristics, for example, aeroplane, powered-lift, helicopter, airship, sailplane, free balloon. ‘Class of aeroplane’ means a categorizations of single-pilot aeroplanes not requiring a type rating. ‘Multi-pilot aircraft’: for aeroplanes, it means aeroplanes certificated for operation with a minimum crew of at least two pilots; for helicopters, airships and powered-lift aircraft, it means the type of aircraft which is required to be operated with a co-pilot as specified in the flight manual or by the air operator certificate or equivalent document. ‘Proficiency check’ means the demonstration of skill to revalidate or renew ratings, and including such oral examination as may be required. 'Renewal', certificate has lapsed for the purpose of renewing the privileges of the rating or certificate for a further specified period consequent upon the fulfillment of specified requirements. ‘Revalidation’ (of, e.g. a rating or certificate) means the administrative action taken within the period of validity of a rating or certificate which allows the holder to continue to exercise the privileges of a rating or certificate for a further specified period consequent upon the fulfillment of specified requirements. ‘Skill test’ means the demonstration of skill for a license or rating issue, including such oral examination as may be required.

FCL.015 Application and issue of licenses, ratings and certificates a) An application for the issue, revalidation or renewal of pilot licenses and associated ratings and

certificates shall be submitted to the competent authority in a form and manner established by this

authority. The application shall be accompanied by evidence that the applicant complies with the requirements for the issue, revalidation or renewal of the license or certificate as well as associated ratings or endorsements, established in this Part and Part- Medical.

b) Any limitation or extension of the privileges granted by a license, rating or certificate shall be endorsed in the license or certificate by the competent authority.

c) A person shall not hold at any time more than one license per category of aircraft issued in accordance with this Part.

d) An application for the issue of a license for another category of aircraft, or for the issue of further ratings or certificates, as well as an amendment, revalidation or renewal of those licenses, ratings or certificates shall be submitted to the competent authority which initially issued the pilot license, except when the pilot has requested a change of competent authority and a transfer of his licensing and medical records to that authority.

FCL.030 Practical skill test a) Before a skill test for the issue of a license, rating or certificate is taken, the applicant shall have

passed the required theoretical knowledge examination, except in the case of applicants undergoing a course of integrated flying training. In any case, the theoretical knowledge instruction shall always have been completed before the skill tests are taken.

b) Except for the issue of an airline transport pilot license, the applicant for a skill test shall be recommended for the test by the organisation/person responsible for the training, once the training is completed. The training records shall be made available to the examiner.

FCL.040 Exercise of the privileges of licenses The exercise of the privileges granted by a license shall be dependent upon the validity of the ratings contained therein, if applicable, and of the medical certificate. FCL.045 Obligation to carry and present documents a) A valid license and a valid medical certificate shall always be carried by the pilot when exercising

the privileges of the license. b) The pilot shall also carry a personal identification document containing his/her photo. c) A pilot or a student pilot shall without undue delay present his/her flight time record for

inspection upon request by an authorized representative of a competent authority. d) A student pilot shall carry on all solo cross-country flights evidence of the authorization required by

FCL.020(a).

SUBPART K, EXAMINERS

SECTION 1 Common requirements

(shortened to aeroplanes and helicopters only) FCL.1000 Examiner certificates (a) General. Holders of an examiner certificate shall:

1) hold an equivalent license, rating or certificate to the ones for which they are authorized to conduct skill tests, proficiency checks or assessments of competence and the privilege to instruct for them;

2) be qualified to act as PIC on the aircraft during a skill test, proficiency check or assessment of competence when conducted on the aircraft.

(b) Special conditions: 1) In the case of introduction of new aircraft in the Member States or in an operator’s fleet,

when compliance with the requirements in this Subpart is not possible, the competent authority may issue a specific certificate giving privileges for the conduct of skill tests and proficiency checks. Such a certificate shall be limited to the skill tests and proficiency checks necessary for the introduction of the new type of aircraft and its validity shall not, in any case, exceed 1 year.

Holders of a certificate issued in accordance with (b)(1) who wish to apply for an examiner certificate shall comply with the prerequisites and revalidation requirements for that category of examiner. (c) Examination outside the territory of the Member States:

1) Notwithstanding paragraph (a), in the case of skill tests and proficiency checks provided in an ATO located outside the territory of the Member States, the competent authority of the Member State may issue an examiner certificate to an applicant holding a pilot license issued by a third country in accordance with ICAO Annex 1, provided that the applicant: (i) holds at least an equivalent license, rating, or certificate to the one for which they

are authorized to conduct skill tests, proficiency checks or assessments of competence, and in any case at least a CPL;

(ii) (ii) complies with the requirements established in this Subpart for the issue of the relevant examiner certificate; and

(iii) (iii) demonstrates to the competent authority an adequate level of knowledge of European aviation safety rules to be able to exercise examiner privileges in accordance with this Part.

2) (2) The certificate referred to in paragraph (1) shall be limited to providing skill tests and proficiency tests/checks: (i) (i) outside the territory of the Member States; and (ii) (ii) to pilots who have sufficient knowledge of the language in which the test/check is

given. FCL.1005 Limitation of privileges in case of vested interests Examiners shall not conduct: (a) skill tests or assessments of competence of applicants for the issue of a license, rating or

certificate: 1) to whom they have provided more than 25% of the required flight instruction for the

license, rating or certificate for which the skill test or assessment of competence is being taken;

2) when they have been responsible for the recommendation for the skill test, in accordance with FCL.030(b);

(b) skill tests, proficiency checks or assessments of competence whenever they feel that their objectivity may be affected.

FCL.1010 Prerequisites for examiners Applicants for an examiner certificate shall demonstrate: (a) relevant knowledge, background and appropriate experience related to the privileges of an

examiner; (b) that they have not been subject to any sanctions, including the suspension, limitation or

revocation of any of their licenses, ratings or certificates issued in accordance with this Part, for non-compliance with the Basic Regulation and its Implementing Rules during the last 3 years.

FCL.1015 Examiner standardisation (a) Applicants for an examiner certificate shall undertake a standardisation course provided by the

competent authority or by an ATO and approved by the competent authority. (b) The standardisation course shall consist of theoretical and practical instruction and shall

include, at least: 1) the conduct of 2 skill tests, proficiency checks or assessments of competences for the

licenses, ratings or certificates for which the applicant seeks the privilege to conduct tests and checks;

2) instruction on the applicable requirements in this part and the applicable air operations requirements, the conduct of skill tests, proficiency checks and assessments of competence, and their documentation and reporting;

3) a briefing on the national administrative procedures, requirements for protection of personal data, liability, accident insurance and fees.

4) a briefing on the need to review and apply the items in (3) when conducting skill tests, proficiency checks or assessments of competence of an applicant for which the competent authority is not the same that issued the examiner’s certificate; and

5) an instruction on how to get access to these national procedures and requirements of other competent authorities when needed.

(c) Holders of an examiner certificate shall not conduct skill tests, proficiency checks or

assessments of competence of an applicant for which the competent authority is not the same that issued the examiner’s certificate, unless they have reviewed the latest available information containing the relevant national procedures of the applicant’s competent authority.

FCL.1020 Examiners assessment of competence Applicants for an examiner certificate shall demonstrate their competence to an inspector from the competent authority or a senior examiner specifically authorized to do so by the competent authority responsible for the examiner’s certificate through the conduct of a skill test, proficiency check or assessment of competence in the examiner role for which privileges are sought, including briefing, conduct of the skill test, proficiency check or assessment of competence, and assessment of the person to whom the test, check or assessment is given, debriefing and recording documentation. FCL.1025 Validity, revalidation and renewal of examiner certificates (a) Validity. An examiner certificate shall be valid for 3 years. (b) Revalidation. An examiner certificate shall be revalidated when the holder has, during the

validity period of the certificate: 1. conducted at least 2 skill tests, proficiency checks or assessments of competence

every year; 2. attended an examiner refresher seminar provided by the competent authority or by an ATO 3. and approved by the competent authority, during the last year of the validity period. 4. One of the skill tests or proficiency checks completed during the last year of the validity

period in accordance with (1) shall have been assessed by an inspector from the competent authority or by a senior examiner specifically authorized to do so by the competent authority responsible for the examiner’s certificate.

5. When the applicant for the revalidation holds privileges for more than one category of examiner, combined revalidation of all examiner privileges may be achieved when the applicant complies with the requirements in (b)(1) and (2) and FCL.1020 for one of the categories of examiner certificate held, in agreement with the competent authority.

(c) Renewal. If the certificate has expired, applicants shall comply with the requirements of (b)(2) and FCL.1020 before they can resume the exercise of the privileges.

(d) An examiner certificate shall only be revalidated or renewed if the applicant demonstrates continued compliance with the requirements in FCL.1010 and FCL.1030.

FCL.1030 Conduct of skill tests, proficiency checks and assessments of competence (a) When conducting skill tests, proficiency checks and assessments of competence, examiners shall:

1. ensure that communication with the applicant can be established without language barriers;

2. verify that the applicant complies with all the qualification, training and experience requirements in this Part for the issue, revalidation or renewal of the license, rating or certificate for which the skill test, proficiency check or assessment of competence is taken;

3. make the applicant aware of the consequences of providing incomplete, inaccurate or false information related to their training and flight experience.

(b) After completion of the skill test or proficiency check, the examiner shall: 1. inform the applicant of the result of the test. In the event of a partial pass or fail, the

examiner shall inform the applicant that he/she may not exercise the privileges of the rating until a full pass has been obtained. The examiner shall detail any further training requirement and explain the applicant’s right of appeal;

2. in the event of a pass in a proficiency check or assessment of competence for revalidation or renewal, endorse the applicant’s license or certificate with the new expiry date of the rating or certificate, if specifically, authorized for that purpose by the competent authority responsible for the applicant’s license;

3. provide the applicant with a signed report of the skill test or proficiency check and submit without delay copies of the report to the competent authority responsible for the applicant’s license, and to the competent authority that issued the examiner certificate. The report shall include: i. a declaration that the examiner has received information from the applicant regarding

his/her experience and instruction, and found that experience and instruction complying with the applicable requirements in this Part;

ii. confirmation that all the required manoeuvres and exercises have been completed, as well as information on the verbal theoretical knowledge examination, when applicable. If an item has been failed, the examiner shall record the reasons for this assessment;

iii. the result of the test, check or assessment of competence. iv. a declaration that the examiner has reviewed and applied the national procedures

and requirements of the applicant’s competent authority if the competent authority responsible for the applicant’s license is not the same that issued the examiner’s certificate.

v. a copy of the examiner’s certificate containing the scope of his/her privileges as examiner in the case of skill tests, proficiency checks or assessments of competence of an applicant for which the competent authority is not the same that issued the examiner’s certificate.

(c) Examiners shall maintain records for 5 years with details of all skill tests, proficiency checks and assessments of competence performed and their results.

(d) Upon request by the competent authority responsible for the examiner certificate, or the competent authority responsible for the applicant’s license, examiners shall submit all records and reports, and any other information, as required for oversight activities.

SECTION 2

Specific requirements for flight examiners — FE

FCL. 1005.FE FE — Privileges and conditions (a) FE(A). The privileges of an FE for aeroplanes are to conduct:

1. skill tests for the issue of the PPL(A) and skill tests and proficiency checks for associated single-pilot class and type ratings, except for single-pilot high performance complex aeroplanes, provided that the examiner has completed at least 1 000 hours of flight time as a pilot on aeroplanes or TMGs, including at least 250 hours of flight instruction;

2. skill tests for the issue of the CPL(A) and skill tests and proficiency checks for the associated single-pilot class and type ratings, except for single-pilot high performance complex aeroplanes, provided that the examiner has completed at least 2 000 hours of flight time as a pilot on aeroplanes or TMGs, including at least 250 hours of flight instruction;

3. skill tests and proficiency checks for the LAPL(A), provided that the examiner has completed at least 500 hours of flight time as a pilot on aeroplanes or TMGs, including at least 100 hours of flight instruction;

4. skill tests for the issue of a mountain rating, provided that the examiner has completed at least 500 hours of flight time as a pilot on aeroplanes or TMGs, including at least 500 take- offs and landings of flight instruction for the mountain rating.

5. proficiency checks for the revalidation and renewal of EIRs, provided that the FE has completed at least 1 500 hours as a pilot on aeroplanes and complies with the requirements in FCL.1010.IRE(a)(2).

(b) FE(H). The privileges of an FE for helicopters are to conduct:

1. skill tests for the issue of the PPL(H) and skill tests and proficiency checks for single-pilot single-engine helicopter type ratings entered in a PPL(H), provided that the examiner has completed 1 000 hours of flight time as a pilot on helicopters, including at least 250 hours of flight instruction;

2. skill tests for the issue of the CPL(H) and skill tests and proficiency checks for single-pilot single-engine helicopter type ratings entered in a CPL(H), provided the examiner has completed 2 000 hours of flight time as pilot on helicopters, including at least 250 hours of flight instruction;

3. skill tests and proficiency checks for single-pilot multi-engine helicopter type ratings entered in a PPL(H) or a CPL(H), provided the examiner has completed the requirements in (1) or (2), as applicable, and holds a CPL(H) or ATPL(H) and, when applicable, an IR(H);

4. skill tests and proficiency checks for the LAPL(H), provided that the examiner has completed at least 500 hours of flight time as a pilot on helicopters, including at least 150 hours of flight instruction.

FCL.1010.FE FE — Prerequisites An applicant for an FE certificate shall hold: an FI certificate in the appropriate aircraft category.

SECTION 3

Specific requirements for type rating examiners — TRE FCL.1005.TRE TRE — Privileges and conditions (a) TRE(A) and TRE(PL). The privileges of a TRE for aeroplanes or powered-lift aircraft are

to conduct: 1. skill tests for the initial issue of type ratings for aeroplanes or powered-lift aircraft, as

applicable; 2. proficiency checks for revalidation or renewal of type ratings, EIRs and

IRs; (3) skill tests for ATPL(A) issue; 3. skill tests for MPL issue, provided that the examiner has complied with the requirements in 4. FCL.925; 5. (5) assessments of competence for the issue, revalidation or renewal of a TRI or SFI

certificate in the applicable aircraft category, provided that the examiner has completed at least 3 years as a TRE.

(b) TRE(H). The privileges of a TRE(H) are to conduct: 1. skill tests and proficiency checks for the issue, revalidation or renewal of helicopter type

ratings; 2. proficiency checks for the revalidation or renewal of IRs, or for the extension of the IR(H)

from single-engine helicopters to multi-engine helicopters, provided the TRE(H) holds a valid IR(H);

3. skill tests for ATPL(H) issue; 4. assessments of competence for the issue, revalidation or renewal of a TRI(H) or SFI(H) 5. certificate, provided that the examiner has completed at least 3 years as a TRE.

FCL.1010.TRE TRE — Prerequisites (a) TRE(A) and TRE(PL). Applicants for a TRE certificate for aeroplanes and powered-lift

aircraft shall: 1. in the case of multi-pilot aeroplanes or powered-lift aircraft, have completed 1 500 hours of

flight time as a pilot of multi-pilot aeroplanes or powered-lift aircraft, as applicable, of 2. which at least 500 hours shall be as PIC; 3. in the case of single-pilot high performance complex aeroplanes, have completed 500 hours

of flight time as a pilot of single-pilot aeroplanes, of which at least 200 hours shall be as PIC;

4. hold a CPL or ATPL and a TRI certificate for the applicable type; 5. for the initial issue of an TRE certificate, have completed at least 50 hours of flight

instruction as a TRI, FI or SFI in the applicable type or an FSTD representing that type.

(b) TRE(H). Applicants for a TRE (H) certificate for helicopters shall: 1. hold a TRI(H) certificate or, in the case of single-pilot single-engine helicopters, a valid FI(H)

certificate, for the applicable type; 2. for the initial issue of a TRE certificate, have completed 50 hours of flight instruction as a

TRI, FI or SFI in the applicable type or an FSTD representing that type;

3. in the case of multi-pilot helicopters, hold a CPL(H) or ATPL(H) and have completed 1 500 hours of flight as a pilot on multi-pilot helicopters, of which at least 500 hours shall be as PIC;

4. in the case of single-pilot multi-engine helicopters: i. have completed 1 000 hours of flight as pilot on helicopters, of which at least 500

hours shall be as PIC; ii. hold a CPL(H) or ATPL(H) and, when applicable, a valid

IR(H); 5. in the case of single-pilot single-engine helicopters:

a. have completed 750 hours of flight as a pilot on helicopters, of which at least 500 hours b. shall be as PIC;hold a professional helicopter pilot license.

6. (Before the privileges of a TRE(H) are extended from single-pilot multi-engine to multi-pilot multi-engine privileges on the same type of helicopter, the holder shall have at least 100 hours in multi-pilot operations on this type.

7. In the case of applicants for the first multi-pilot multi-engine TRE certificate, the 1 500 hours of flight experience on multi-pilot helicopters required in (b)(3) may be considered to have been met if they have completed the 500 hours of flight time as PIC on a multi-pilot helicopter of the same type.

SECTION 4

Specific requirements for Class Rating Examiner — CRE FCL.1005.CRE CRE — Privileges The privileges of a CRE are to conduct, for single-pilot aeroplanes, except for single-pilot high performance complex aeroplanes: (a) skill tests for the issue of class and type ratings; (b) proficiency checks for:

(1) revalidation or renewal of class and type ratings; (2) revalidation and renewal of IRs, provided that the CRE complies with the requirements in

FCL.1010.IRE(a). (3) revalidation and renewal of EIRs, provided that the CRE has completed at least 1 500

hours as a pilot on aeroplanes and complies with the requirements in FCL.1010.IRE(a)(2). (c) skill tests for the extension of LAPL(A) privileges to another class or variant of aeroplane. FCL.1010.CRE CRE — Prerequisites Applicants for a CRE certificate shall: (a) hold a CPL(A), MPL(A) or ATPL(A) with single-pilot privileges or have held it and hold a PPL(A); (b) hold a CRI certificate for the applicable class or type; (c) have completed 500 hours of flight time as a pilot on aeroplanes.

SECTION 5

Specific requirements for Instrument Rating Examiner — IRE FCL.1005.IRE IRE — Privileges The privileges of the holder of an IRE certificate are to conduct skill tests for the issue, and proficiency checks for the revalidation or renewal of EIRs or IRs. FCL.1010.IRE IRE — Prerequisites (a) IRE(A). Applicants for an IRE certificate for aeroplanes shall hold an IRI(A) and have completed:

(1) 2 000 hours of flight time as a pilot of aeroplanes; and (2) 450 hours of flight time under IFR, of which 250 hours shall be as an instructor.

(b) IRE(H). Applicants for an IRE certificate for helicopters shall hold an IRI(H) and have completed: (1) 2 000 hours of flight time as a pilot on helicopters; and (2) 300 hours of instrument flight time on helicopters, of which 200 hours shall be as an

instructor.

SECTION 6

Specific requirements for Synthetic Flight Examiner — SFE FCL.1005.SFE SFE — Privileges and conditions

(a) SFE(A) and SFE(PL). The privileges of an SFE on aeroplanes or powered-lift aircraft are to conduct in an FFS: (1) skill tests and proficiency checks for the issue, revalidation or renewal of type ratings for

multi-pilot aeroplanes or powered-lift aircraft, as applicable; (2) proficiency checks for revalidation or renewal of IRs, provided that the SFE complies with

the requirements in FCL.1010.IRE for the applicable aircraft category; (3) skill tests for ATPL(A) issue; (4) skill tests for MPL issue, provided that the examiner has complied with the requirements in

FCL.925; (5) assessments of competence for the issue, revalidation or renewal of an SFI certificate in the

relevant aircraft category, provided that the examiner has completed at least 3 years as an SFE.

(b) SFE(H). The privileges of an SFE for helicopters are to conduct in an FFS:

(1) skill tests and proficiency checks for the issue, revalidation and renewal of type ratings; and (2) proficiency checks for the revalidation and renewal of IRs, provided that the SFE complies

with the requirements in FCL.1010.IRE(b); (3) skill tests for ATPL(H) issue; (4) skill tests and proficiency checks for the issue, revalidation or renewal of an SFI(H) certificate, provided that the examiner has completed at least 3 years as an SFE.

(b) SFE(H). The privileges of an SFE for helicopters are to conduct in an FFS: FCL.1010.SFE SFE — Prerequisites (a) SFE(A). Applicants for an SFE certificate for aeroplanes shall:

(1) hold or have held an ATPL(A), a class or type rating and an SFI(A) certificate for the applicable type of aeroplane;

(2) have at least 1 500 hours of flight time as a pilot on multi-pilot aeroplanes; (3) for the initial issue of an SFE certificate, have completed at least 50 hours of synthetic flight

instruction as an SFI(A) on the applicable type. (b) SFE(H). Applicants for an SFE certificate for helicopters shall:

(1) hold or have held an ATPL(H), a type rating and an SFI(H) certificate for the applicable type of helicopter;

(2) have at least 1 000 hours of flight time as a pilot on multi-pilot helicopters; (3) for the initial issue of an SFE certificate, have completed at least 50 hours of synthetic flight

instruction as an SFI(H) on the applicable type.

SECTION 7

Specific requirements for the flight instructor examiner — FIE FCL.1005.FIE FIE — Privileges and conditions (a) FIE(A). The privileges of an FIE on aeroplanes are to conduct assessments of competence for

the issue, revalidation or renewal of certificates for FI(A), CRI(A), IRI(A) and TRI(A) on single- pilot aeroplanes, provided that the relevant instructor certificate is held.

(b) FIE(H). The privileges of an FIE on helicopters are to conduct assessments of competence for the issue, revalidation or renewal of certificates for FI(H), IRI(H) and TRI(H) on single-pilot helicopters, provided that the relevant instructor certificate is held.

FCL.1010.FIE FIE — Prerequisites (a) FIE(A). Applicants for an FIE certificate for aeroplanes shall in case of applicants wishing to conduct

assessments of competence: (1) hold the relevant instructor certificate, as applicable; (2) have completed 2 000 hours of flight time as a pilot on aeroplanes or TMGs; and (3) have at least 100 hours of flight time instructing applicants for an instructor certificate.

VARIOUS AMC-, GM-, ARA- ARTICLES ARA.FCL.205 Monitoring of examiners (a) The competent authority shall develop an oversight program to monitor the conduct and

performance of examiners taking into account: (1) the number of examiners it has certified; and (2) the number of examiners certified by other competent authorities exercising their

privileges within the territory where the competent authority exercises oversight. (b) The competent authority shall maintain a list of examiners it has certified. The list shall state the

privileges of the examiners and be published and kept updated by the competent authority. (c) The competent authority shall develop procedures to designate examiners for the conduct of skill

tests. AMC1 FCL.1010 Prerequisites for examiners When evaluating the applicant’s background, the competent authority should evaluate the personality and character of the applicant, and his/her cooperation with the competent authority. The competent authority may also take into account whether the applicant has been convicted of any relevant criminal or other offenses, taking into account national law and principles of non- discrimination. AMC1 FCL.1015 Examiner standardisation GENERAL (a) The competent authority may provide the course itself or through an arrangement with an ATO.

This arrangement should clearly state that the ATO is acting under the management system of the competent authority.

(b) The course should last: (1) for the FE and FIE, at least 1 day, divided into theoretical and practical training; (2) for other examiners, at least 3 days, divided into theoretical training (1 day) and practical

training in an FFS conducting role played proficiency checks and skill tests (at least 2 days). (c) The competent authority or the ATO should determine any further training required before

presenting the candidate for the examiner assessment of competence. (d) The training should comprise:

(1) Theoretical training covering at least: (i) the contents of AMC2 FCL.1015 and the FEM; (ii) Part-FCL and related AMCs and GM relevant to their duties; (iii) operational requirements and related AMCs and GM relevant to their duties; (iv) national requirements relevant to their examination duties; (v) fundamentals of human performance and limitations relevant to flight examination; (vi) fundamentals of evaluation relevant to applicant’s performance; (vii) management system of ATO’s; (viii) MCC, human performance and limitations, if applicable.

(2) Examiners should also be briefed on the protection requirements for personal data, liability, accident insurance and fees, as applicable in the member state concerned.

(3) All items above are the core knowledge requirements for an examiner and are recommended as the core course material. This core course may be studied before recommended examiner training is commenced. The core course may utilize any suitable training format.

(4) Practical training consisting of at least: (i) knowledge and management of the test for which the certificate is to be sought. These

are described in the relevant modules in the FEM; (ii) knowledge of the administrative procedures pertaining to that test or check.

(5) For an initial examiner certificate, practical training should include the examination of the test profile sought, consisting of the conduct of at least two test or check profiles in the role of examiner (these two tests or checks profiles can be performed in the same simulator session), including briefing, conduct of the skill test and proficiency check, assessment of the applicant to whom the test or check is given, debriefing and recording or documentation under the supervision of an examiner of the appropriate category on the applicable type. This training is conducted in the aircraft if approval for testing or checking in the aircraft is required. If examiner privileges in FSTD’s are required, practical instruction in the use of FSTD(s) for testing or checking should also be completed.

(6) If examiner privileges are to include the conduct of proficiency checks for the revalidation or renewal of an instrument rating, practical instruction should include the conduct of at least four instrument check profiles in the role of examiner, including briefing, conduct of the skill test and proficiency check, assessment of the applicant to whom the test or check is given, debriefing and recording or documentation under the supervision of an examiner of the appropriate category on the applicable type. This training is conducted in the aircraft if approval for testing or checking in the aircraft is required. If examiner privileges in both FSTD and aircraft are required, at least one of the instrument check profiles should be conducted in an FSTD.

(7) For extension of an examiner certificate to further types (as required for TRE), further practical training on the new type may be required, consisting of the conduct of at least one test or check profile in the role of examiner on the new type, including briefing, conduct of the skill test and proficiency check, assessment of the applicant to whom the test or check is given, debriefing and recording or documentation under the supervision of an examiner of the appropriate category on the applicable type. A further examiner check on the new type may be required, which may be supervised by an inspector of the competent authority or a suitably authorized senior examiner.

GM1 FCL.1015 Examiner standardisation (a) An examiner should plan per day not more than:

(1) three tests or checks relating to PPL, CPL, IR or class ratings; (2) four tests or checks relating to LAPL, SPL or BPL; two tests or checks related to

CPL, IR or ATPL; (3) two assessments of competence related to instructor certificates; (4) four tests or checks relating to SP type ratings.

(b) An examiner should plan at least 2 hours for a LAPL, SPL or BPL, 3 hours for a PPL, CPL, IR or class rating test or checks, and at least 4 hours for FI, CPL, IR, MPL, ATPL or MP type rating tests or checks, including pre-flight briefing and preparation, conduct of the test, check or assessment of competence, de-briefing, evaluation of the applicant and documentation.

(c) When planning the duration of a test, check or assessment of competence, the following values may be used as guidance: (1) 45 minutes for a LAPL(B) or BPL and SP class ratings VFR only; (2) 90 minutes for LAPL(A) or (H), PPL and CPL, including navigation section; (3) 60 minutes for IR, FI and SP type or class ratings; (4) 120 minutes for CPL, MPL, ATPL and MP type ratings.

(d) For the LAPL(S) and SPL test or check flight the flight time must be sufficient to allow that all the items in each test or check section can be fully completed. If not all the items can be completed in one flight, additional flights have to be done.

AMC1 FCL.1020 Examiners assessment of competence GENERAL (a) The competent authority may nominate either one of its inspectors or a senior examiner to

assess the competence of applicants for an examiner certificate. DEFINITIONS (a) Definitions:

(1) ‘Inspector’: the inspector of the competent authority conducting the examiner competence assessment;

(2) ‘Examiner applicant’: the person seeking certification as an examiner; (3) ‘Candidate’: the person being tested or checked by the examiner applicant. This

person may be a pilot for whom the test or check would be required, or the inspector of the competent authority who is conducting the examiner certification acceptance test.

CONDUCT OF THE ASSESSMENT (a) An inspector of the competent authority or a senior examiner will observe all examiner

applicants conducting a test on a ‘candidate’ in an aircraft for which examiner certificate is sought. Items from the related training course and test or check schedule will be selected by the inspector for examination of the ‘candidate’ by the examiner applicant. Having agreed with the inspector the content of the test, the examiner applicant will be expected to manage the entire test. This will include briefing, the conduct of the flight, assessment and debriefing of the ‘candidate’. The inspector will discuss the assessment with the examiner applicant before the ‘candidate’ is debriefed and informed of the result.

BRIEFING THE ‘CANDIDATE’ (a) The ‘candidate’ should be given time and facilities to prepare for the test flight. The briefing

should cover the following: (1) the objective of the flight; (2) licensing checks, as necessary; (3) freedom for the ‘candidate’ to ask questions; (4) operating procedures to be followed (for example operators manual); (5) weather assessment; (6) operating capacity of ‘candidate’ and examiner; (7) aims to be identified by ‘candidate’; (8) simulated weather assumptions (for example icing and cloud base); (9) use of screens (if applicable); (10) contents of exercise to be performed; (11) agreed speed and handling parameters (for example V-speeds, bank angle, approach

minima); (12) use of R/T; (13) respective roles of ‘candidate’ and examiner (for example during emergency); (14) administrative procedures (for example submission of flight plan).

(b) The examiner applicant should maintain the necessary level of communication with the ‘candidate’. The following check details should be followed by the examiner applicant: (1) involvement of examiner in a MP operating environment; (2) the need to give the ‘candidate’ precise instructions; (3) responsibility for safe conduct of the flight; (4) intervention by examiner, when necessary; (5) use of screens; (6) liaison with ATC and the need for concise, easily understood intentions; (7) prompting the ‘candidate’ about required sequence of events (for example following a go-

around); (8) keeping brief, factual and unobtrusive notes.

ASSESSMENT (a) The examiner applicant should refer to the flight test tolerances given in the relevant skill test.

Attention should be paid to the following points: (1) questions from the ‘candidate’; (2) give results of the test and any sections failed; (3) give reasons for failure.

DEBRIEFING (a) The examiner applicant should demonstrate to the inspector the ability to conduct a fair,

unbiased debriefing of the ‘candidate’ based on identifiable factual items. A balance between friendliness and firmness should be evident. The following points should be discussed with the ‘candidate’, at the applicant’s discretion: (1) advise the candidate on how to avoid or correct mistakes; (2) mention any other points of criticism noted; (3) give any advice considered helpful.

RECORDING OR DOCUMENTATION (a) The examiner applicant should demonstrate to the inspector the ability to complete the

Senior Examiners AMC1FCL.1020: FCL.1025 Qualification of senior examiners (a) A senior examiner specifically tasked by the competent authority to observe skill tests or

proficiency checks for the revalidation of examiner certificates should: (1) hold a valid or current examiner certificate appropriate to the privileges being given; (2) have examiner experience level acceptable to the competent authority; (3) have conducted a number of skill tests or proficiency checks as a Part-FCL examiner.

(b) The competent authority may conduct a pre-assessment of the applicant or candidate carrying out a skill test and proficiency check under supervision of an inspector of the competent authority.

(c) Applicants should be required to attend a senior examiner briefing, course or seminar arranged by the competent authority. Content and duration will be determined by the competent authority and should include: (1) pre-course self-study; (2) legislation; (3) the role of the senior examiner; (4) an examiner assessment; (5) national administrative requirements.

(d) The validity of the authorization should not exceed the validity of the examiners certificate, and in any case should not exceed 3 years. The authorization may be revalidated in accordance with procedures established by the competent authority.

EXAMS Instructions for examiners How to check the requirements for skill tests, proficiency checks and assessments of competence. General With the introduction of PART-FCL on April 8, 2013, the examiner became responsible for checking whether a candidate meets all requirements at a skill test, proficiency check or assessment of competence. The requirements to be checked vary per skill test, proficiency check or assessment of competence. Information on these requirements can be found in the relevant chapters of Part-FCL. See the appendix for details. These instructions provide additional information about how the examiner should check these requirements. If it cannot be determined that all requirements have been met by the candidate when performing a skill test, proficiency check or assessment of competence, the examiner may decide to cancel or reschedule the session. In that case a new recommendation may be necessary. If it is likely that the candidate or the ATO can prove to the examiner within a few days that the requirements have been met, the examiner may decide to perform the skill test, proficiency check or assessment of competence. He holds all relevant forms until the candidate or the ATO has provided the necessary information. The examiner must also inform the applicant of the consequences of providing incomplete, inaccurate or false information regarding his training and experience as a pilot (see FCL.1030 (a) (3). This can lead to restriction, suspension or revocation of licenses, ratings and certificates of the candidate. See also ARA.FCL.250 (appendix 2). Identification and age This should be checked on the basis of a valid Dutch passport, a valid Dutch identity card or a valid Dutch driving license. Copies of these documents cannot be used for this purpose because the security features thereon cannot be checked. For non-Dutch citizens this can be checked on the basis of a valid foreign passport, a valid foreign identity card or a valid Dutch residence permit. Medical certificate If required, the candidate must have a valid medical certificate as defined in Appendix VI of Part-ARA and issued in accordance with Part-MED. There are three possibilities for a medical certificate: LAPL, Class 2 and Class 1. Class 1 is also valid as Class 2 and LAPL. Class 2 is also valid as LAPL. Detailed requirements for the necessary medical certificates are found in MED.A.030. Theoretical knowledge examinations Before a skill test for the issue of a license, rating or certificate is taken, the applicant shall have passed the required theoretical knowledge examination, except in the case of applicants undergoing a course of integrated flying training. In any case, the theoretical knowledge instruction shall always have been completed before the skill test (see FCL.030(a). A positive result for a theoretical knowledge examination is valid for the issue of a corresponding license, rating or certificate for a limited time: LAPL, PPL, SPL, BPL: 24 months. CPL, IR: up to 36 months depending on the type of training course (see AMC1 to

Appendix 3). ATPL(A): 7 years after the most recent validity date of an IR ATPL(H): 7 years from the last validity date of a type rating in a helicopter. See FCL.025(c) and FCL.030(a). For crediting of theoretical knowledge, see FCL.035(b)

Training The completion of a training course, or the required training in case of a renewal, shall be demonstrated by means of a statement of the relevant ATO. If the Flight Test Schedule for the skill test of proficiency check has a column 'Practical Training', all maneuvers and procedures that are part of the training shall be initialed by the instructor. Thereby the instructor states that this exercise was trained to exam level. According FCL.030 (b) all training data must be made available to the examiner at a skill test (except for an ATPL-test). This must be done to enable the examiner to determine whether the candidate meets all the requirements, but the objectivity of the examiner may not be affected. So these training data may not contain any reviews, value judgments or opinions. Experience and flying hours These shall be checked against the logbook of the candidate which at least meets the requirements as described in AMC1 FCL.050. Revalidation / renewal of ratings and/or certificates An authorized examiner may revalidate or renew a rating or instruction-certificate by filling in the table on the back of the license. Attention should be paid to the following: - The rating must be precisely copied from the front of the license. - Data shall be noted as DD-MM-YYYY. - The new 'valid-until' date is always the last day of the month. For example: Old 'valid until' date 1 jun 2013. After a one-year revalidation the new 'valid until' date becomes 31-05-2014. - Ratings with equal 'valid until' dates can be written on one line (e.g. B747-400 / IR (ME)). Documents to submit After completion of the skill test, proficiency check or assessment of competence, the examiner shall send a report to the authority responsible for the license of the candidate and a report to the authority responsible for the certificate of the examiner (FCL.1030 (b) (3)). This report contains in most cases: - a Skill Test and Proficiency Check Report Form, - a Flight Test Schedule. - A statement from the ATO that the required training is completed (for initial issue and renewal) If both the candidate and the examiner have a license and certificate issued by the Dutch authorities it is sufficient to submit the required documents to KIWA Register in Rijswijk. If the examiner has revalidated or renewed the rating(s) by filling in the table on the license it is sufficient to submit the forms mentioned above. APPENDIX 2

ARA.FCL.250 Limitation, suspension or revocation of licenses, ratings and certificates (a) The competent authority shall limit, suspend or revoke as applicable a pilot license and

associated ratings or certificates in accordance with ARA.GEN.355 in, but not limited to, the following circumstances: (1) obtaining the pilot license, rating or certificate by falsification of submitted documentary

evidence; (2) falsification of the logbook and license or certificate records;

(3) the license holder no longer complies with the applicable requirements of Part-FCL;

(4) exercising the privileges of a license, rating or certificate when adversely affected by alcohol or drugs;

(5) non-compliance with the applicable operational requirements; (6) evidence of malpractice or fraudulent use of the certificate; or (7) unacceptable performance in any phase of the flight examiner’s duties or responsibilities.

(b) The competent authority may also limit, suspend or revoke a license, rating or certificate upon the written request of the license or certificate holder.

(c) All skill tests, proficiency checks or assessments of competence conducted during suspension or after the revocation of an examiner’s certificate will be invalid.

AMC2 FCL 1015 Examiner standardisation STANDARDISATION ARRANGEMENTS FO EXAMINERS LIMITATIONS (a) An examiner should allow an applicant adequate time to prepare for a test or check,

normally not more than 1 hour. (b) An examiner should plan a test or check flight so that all required exercises can be performed while

allowing sufficient time for each of the exercises and with due regard to the weather conditions, traffic situation, ATC requirements and local procedures.

PURPOSE OF A TEST OR CHECK (a) Determine through practical demonstration during a test or check that an applicant has

acquired or maintained the required level of knowledge and skill or proficiency. (b) Improve training and flight instruction in ATOs by feedback of information from examiners about

items or sections of tests or checks that are most frequently failed. (c) Assist in maintaining and, where possible, improving air safety standards by having

examiners display good airmanship and flight discipline during tests or checks.

CONDUCT OF TEST OR CHECK (a) An examiner will ensure that an applicant completes a test or check in accordance with Part- FCL

requirements and is assessed against the required test or check standards. (b) Each item within a test or check section should be completed and assessed separately. The test or

check schedule, as briefed, should not normally be altered by an examiner. A failed item is not always a failed section, for example type rating skill test where a failure of an item in a section does not fail the entire section, only the failed item is taken again.

(c) Marginal or questionable performance of a test or check item should not influence an examiner’s assessment of any subsequent items.

(d) An examiner should verify the requirements and limitations of a test or check with an applicant during the pre-flight briefing.

(e) When a test or check is completed or discontinued, an examiner should debrief the applicant and give reasons for items or sections failed. In case of a failed or discontinued skill test and proficiency check, the examiner should provide appropriate advice to assist the applicant in re-tests or re-checks.

(f) Any comment on, or disagreement with, an examiner’s test or check evaluation or assessment made during a debriefing will be recorded by the examiner on the test or check report, and will be signed by the examiner and countersigned by the applicant.

EXAMINER PREPARATION (a) An examiner should supervise all aspects of the test or check flight preparation, including, where

necessary, obtaining or assuring an ATC ‘slot’ time. (b) An examiner will plan a test or check in accordance with Part-FCL requirements. Only the

manoeuvres and procedures set out in the appropriate test or check form will be undertaken. The same examiner should not re-examine a failed applicant without the agreement of the applicant.

EXAMINER APPROACH (a) An examiner should encourage a friendly and relaxed atmosphere to develop both before and

during a test or check flight. A negative or hostile approach should not be used. During the test or check flight, the examiner should avoid negative comments or criticisms and all assessments should be reserved for the debriefing.

ASSESSMENT SYSTEM (a) Although test or checks may specify flight test tolerances, an applicant should not be expected to

achieve these at the expense of smoothness or stable flight. An examiner should make due allowance for unavoidable deviations due to turbulence, ATC instructions, etc. An examiner should terminate a test or check only when it is clear that the applicant has not been able to demonstrate the required level of knowledge, skill or proficiency and that a full re-test will be necessary or for safety reasons. An examiner will use one of the following terms for assessment: (1) a ‘pass’, provided that the applicant demonstrates the required level of knowledge, skill

or proficiency and, where applicable, remains within the flight test tolerances for the license or rating;

(2) a ‘fail’ provided that any of the following apply: (i) the flight test tolerances have been exceeded after the examiner has made due

allowance for turbulence or ATC instructions; (ii) the aim of the test or check is not completed; (iii) the aim of exercise is completed but at the expense of safe flight, violation of a

rule or regulation, poor airmanship or rough handling; (iv) an acceptable level of knowledge is not demonstrated; (v) an acceptable level of flight management is not demonstrated; (vi) the intervention of the examiner or safety pilot is required in the interest of

safety.

(3) ‘partial pass’ in accordance with the criteria shown in the relevant skill test appendix of Part-FCL.

METHOD AND CONTENTS OF THE TEST OR CHECK (a) Before undertaking a test or check an examiner will verify that the aircraft or FSTD intended to be

used is suitable and appropriately equipped for the test or check. (b) A test or check flight will be conducted in accordance with the AFM and, if applicable, the AOM. (c) A test or check flight will be conducted within the limitations contained in the operations manual

of an ATO. (d) Contents:

(1) a test or check is comprised of: (i) oral examination on the ground (where applicable); (ii) pre-flight briefing; (iii) in-flight exercises; (iv) post-flight debriefing.

(2) oral examination on the ground should include: (i) aircraft general knowledge and performance; (ii) planning and operational procedures; (iii) other relevant items or sections of the test or check.

(3) pre-flight briefing should include: (i) test or check sequence; (ii) power setting, speeds and approach minima, if applicable; (iii) safety considerations.

(4) in-flight exercises will include each relevant item or section of the test o check;

(5) post-flight debriefing should include: (i) assessment or evaluation of the applicant; (ii) documentation of the test or check with the applicant’s FI present, if possible.

(e) A test or check is intended to simulate a practical flight. Thus, an examiner may set practical scenarios for an applicant while ensuring that the applicant is not confused and air safety is not compromised.

(f) When manoeuvres are to be flown by sole reference to instruments, the examiner should ensure that a suitable method of screening is used to simulate IMC.

(g) An examiner should maintain a flight log and assessment record during the test or check for reference during the post or flight debriefing.

(h) An examiner should be flexible to the possibility of changes arising to pre-flight briefings due to ATC instructions, or other circumstances affecting the test or check.

(i) Where changes arise to a planned test or check an examiner should be satisfied that the applicant understands and accepts the changes. Otherwise, the test or check flight should be terminated.

(j) Should an applicant choose not to continue a test or check for reasons considered inadequate by an examiner, the applicant will be assessed as having failed those items or sections not attempted. If the test or check is terminated for reasons considered adequate by the examiner, only these items or sections not completed will be tested during a subsequent test or check.

(k) An examiner may terminate a test or check at any stage, if it is considered that the applicant’s competency requires a complete re-test or re-check.

Part FCL, Appendix 9 Training, skill test and proficiency check for MPL, ATPL, type and class ratings, and proficiency check for IR's

A. General 1. An applicant for a skill test shall have received instruction on the same class or type of aircraft

to be used in the test. 2. Failure to achieve a pass in all sections of the test in two attempts will require further training. 3. There is no limit to the number of skill tests that may be attempted. CONTENT OF THE TRAINING, SKILL TEST/PROFICIENCY CHECK 1. Unless otherwise determined in the operational suitability data established in accordance with

Part-21, the syllabus of flight instruction, the skill test and the proficiency check shall comply with this Appendix. The syllabus, skill test and proficiency check may be reduced to give credit for previous experience on similar aircraft types, as determined in the operational suitability data established in accordance with Part-21.

2. Except in the case of skill tests for the issue of an ATPL, when so defined in the operational suitability data established in accordance with Part-21 for the specific type, credit may be given for skill test items common to other types or variants where the pilot is qualified.

CONDUCT OF THE TEST/CHECK 1. The examiner may choose between different skill test or proficiency check scenarios

containing simulated relevant operations developed and approved by the competent authority. Full flight simulators and other training devices, when available, shall be used, as established in this Part.

2. During the proficiency check, the examiner shall verify that the holder of the class or type rating maintains an adequate level of theoretical knowledge.

3. Should the applicant choose to terminate a skill test for reasons considered inadequate by the examiner, the applicant shall retake the entire skill test. If the test is terminated for reasons considered adequate by the examiner, only those sections not completed shall be tested in a further flight.

4. At the discretion of the examiner, any manoeuvre or procedure of the test may be repeated once by the applicant. The examiner may stop the test at any stage if it is considered that the applicant’s demonstration of flying skill requires a complete re-test.

5. An applicant shall be required to fly the aircraft from a position where the PIC or co-pilot functions, as relevant, can be performed and to carry out the test as if there is no other crew member if taking the test/check under single-pilot conditions. Responsibility for the flight shall be allocated in accordance with national regulations.

6. During pre-flight preparation for the test the applicant is required to determine power settings and speeds. The applicant shall indicate to the examiner the checks and duties carried out, including the identification of radio facilities. Checks shall be completed in accordance with the check-list for the aircraft on which the test is being taken and, if applicable, with the MCC concept. Performance data for take-off, approach and landing shall be calculated by the applicant in compliance with the operations manual or flight manual for the aircraft used. Decision heights/altitude, minimum descent heights/altitudes and missed approach point shall be agreed upon with the examiner.

7. The examiner shall take no part in the operation of the aircraft except where intervention is necessary in the interests of safety or to avoid unacceptable delay to other traffic.

SPECIFIC REQUIREMENTS FOR THE SKILL TEST/PROFICIENCY CHECK FOR MULTI-PILOT AIRCRAFT TYPE RATINGS, FOR SINGLE-PILOT AEROPLANE TYPE RATINGS, WHEN OPERATED IN MULTI-PILOT OPERATIONS, FOR MPL AND ATPL 1. The skill test for a multi-pilot aircraft or a single-pilot aeroplane when operated in multi-pilot

operations shall be performed in a multi-crew environment. Another applicant or another type rated qualified pilot may function as second pilot. If an aircraft is used, the second pilot shall be the examiner or an instructor.

2. The applicant shall operate as PF during all sections of the skill test, except for abnormal and emergency procedures, which may be conducted as PF or PNF in accordance with MCC. The applicant for the initial issue of a multi-pilot aircraft type rating or ATPL shall also demonstrate the ability to act as PNF. The applicant may choose either the left hand or the right hand seat for the skill test if all items can be executed from the selected seat.

3. The following matters shall be specifically checked by the examiner for applicants for the ATPL or a type rating for multi-pilot aircraft or for multi-pilot operations in a single-pilot aeroplane extending to the duties of a PIC, irrespective of whether the applicant acts as PF or PNF: (a) management of crew cooperation; (b) maintaining a general survey of the aircraft operation by appropriate supervision; and (c) setting priorities and making decisions in accordance with safety aspects and relevant

rules and regulations appropriate to the operational situation, including emergencies. 4. The test/check should be accomplished under IFR, if the IR rating is included, and as far as

possible be accomplished in a simulated commercial air transport environment. An essential element to be checked is the ability to plan and conduct the flight from routine briefing material.

5. When the type rating course has included less than 2 hours flight training on the aircraft, the skill test may be conducted in an FFS and may be completed before the flight training on the aircraft. In that case, a certificate of completion of the type rating course including the flight training on the aircraft shall be forwarded to the competent authority before the new type rating is entered in the applicant’s license.

B. Specific requirements for the aeroplane category PASS MARKS 1. In the case of single-pilot aeroplanes, with the exception of for single-pilot high performance

complex aeroplanes, the applicant shall pass all sections of the skill test or proficiency check. If any item in a section is failed, that section is failed. Failure in more than one section will require the applicant to take the entire test or check again. Any applicant failing only one section shall take the failed section again. Failure in any section of the re-test or re-check including those sections that have been passed at a previous attempt will require the applicant to take the entire test or check again. For single-pilot multi-engine aeroplanes, section 6 of the relevant test or check, addressing asymmetric flight, shall be passed.

2. In the case of multi-pilot and single-pilot high performance complex aeroplanes, the applicant shall pass all sections of the skill test or proficiency check. Failure of more than five items will require the applicant to take the entire test or check again. Any applicant failing five or less items shall take the failed items again. Failure in any item on the re-test or re-check including those items that have been passed at a previous attempt will require the applicant to take the entire check or test again.

Section 6 is not part of the ATPL or MPL skill test. If the applicant only fails or does not take section 6, the type rating will be issued without CAT II or CAT III privileges. To extend the type rating privileges to CAT II or CAT III, the applicant shall pass the section 6 on the appropriate type of aircraft.

FLIGHT TEST TOLERANCE 1. The applicant shall demonstrate the ability to:

(a) operate the aeroplane within its limitations; (b) complete all manoeuvres with smoothness and accuracy; (c) exercise good judgement and airmanship; (d) apply aeronautical knowledge; (e) maintain control of the aeroplane at all times in such a manner that the successful

outcome of a procedure or manoeuvre is always assured; (f) understand and apply crew coordination and incapacitation procedures, if applicable;

and (g) communicate effectively with the other crew members, if applicable.

2. The following limits shall apply, corrected to make allowance for turbulent conditions and the handling qualities and performance of the aeroplane used:

Generally ± 100 feet

Starting a go-around at DH + 50 feet/– 0 feet

Minimum descent height/altitude + 50 feet/– 0 feet

Tracking on radio aids ± 5° For “angular” deviations Half scale deflection, azimuth and glide path (e.g. LPV, ILS, MLS,

GLS) 2D (LNAV) and 3D (LNAV/VNAV) “linear” lateral cross-track error/deviation shall normally be deviations limited to

± ½ the RNP value associated with the procedure.

Brief deviations from this standard up to a maximum of 1 time the RNP value are allowable.

3D linear vertical deviations (e.g. RNP APCH) not more than – 75 feet below the vertical (LNAV/VNAV) using BaroVNAV) profile at any time, and not more than + 75 feet above the vertical

profile at or below 1000 feet above aerodrome level. Heading all engines operating ± 5° with simulated engine failure ± 10°

(c) The starred (*) items of section 3B and, for multi-engine, section 6, shall be flown solely by reference to instruments if revalidation/renewal of an IR is included in the skill test or proficiency check. If the starred (*) items are not flown solely by reference to instruments during the skill test or proficiency check, and when there is no crediting of IR privileges, the class or type rating will be restricted to VFR only.

(d) Section 3A shall be completed to revalidate a type or multi-engine class rating, VFR only, where the required experience of 10 route sectors within the previous 12 months has not been completed. Section 3A is not required if section 3B is completed.

(e) Where the letter ‘M’ appears in the skill test or proficiency check column this will indicate the mandatory exercise or a choice where more than one exercise appears.

(f) An FFS or an FNPT II shall be used for practical training for type or multi-engine class ratings if they form part of an approved class or type rating course. The following considerations will apply to the approval of the course:

(i) the qualification of the FFS or FNPT II as set out in the relevant requirements of Part-

ARA and Part-ORA; (ii) the qualifications of the instructors; (iii) the amount of FFS or FNPT II training provided on the course; and (iv) the qualifications and previous experience on similar types of the pilot under training.

(g) When a skill test or proficiency check is performed in multi-pilot operations, the type rating shall be restricted to multi-pilot operations.

6. Multi-pilot aeroplanes and single-pilot high performance complex aeroplanes:

(a) The following symbols mean: P = Trained as PIC or Co-pilot and as PF and PNF for the issue of a type rating as applicable.

X = Simulators shall be used for this exercise, if available; otherwise an aircraft shall be used if appropriate for the manoeuvre or procedure. P# = The training shall be complemented by supervised aeroplane inspection.

(b) The practical training shall be conducted at least at the training equipment level shown as (P), or may be conducted up to any higher equipment level shown by the arrow (———>). The following abbreviations are used to indicate the training equipment used:

A = Aeroplane FFS = Full Flight Simulator FTD = Flight Training Device OTD = Other Training Devices (c) The starred items (*) shall be flown solely by reference to instruments. If this

condition is not met during the skill test or proficiency check, the type rating will be restricted to VFR only.

(d) Where the letter ‘M’ appears in the skill test or proficiency check column this will indicate the mandatory exercise.

(e) An FFS shall be used for practical training and testing if the FFS forms part of an approved type rating course. The following considerations will apply to the approval of the course: (i) the qualification of the FFS or FNPT II; (ii) the qualifications of the instructors; (iii) the amount of FFS or FNPT II training provided on the course; and (iv) the qualifications and previous experience on similar types of the pilot under

training. (f) Manoeuvres and procedures shall include MCC for multi-pilot aeroplane and for single

-pilot high performance complex aeroplanes in multi-pilot operations. (g) Manoeuvres and procedures shall be conducted in single-pilot role for single-pilot

high performance complex aeroplanes in single-pilot operations.

(h) In the case of single-pilot high performance complex aeroplanes, when a skill test or proficiency check is performed in multi-pilot operations, the type rating shall be restricted to multi-pilot operations. If privileges of single-pilot are sought, the manoeuvres/procedures in 2.5, 3.9.3.4, 4.3, 5.5 and at least one manoeuvre/procedure from section 3.4 have to be completed in addition as single-pilot.

(i) In case of a restricted type rating issued in accordance with FCL.720.A (e), the applicants shall fulfil the same requirements as other applicants for the type rating except for the practical exercises relating to the take-off and landing phases.

C. Specific requirements for the helicopter category 1. In case of skill test or proficiency check for type ratings and the ATPL the applicant shall

pass sections 1 to 4 and 6 (as applicable) of the skill test or proficiency check. Failure in more than five items will require the applicant to take the entire test or check again. An applicant failing not more than five items shall take the failed items again. Failure in any item of the re-test or re-check or failure in any other items already passed will require the applicant to take the entire test or check again. All sections of the skill test or proficiency check shall be completed within 6 months.

2. In case of proficiency check for an IR the applicant shall pass section 5 of the proficiency check. Failure in more than three items will require the applicant to take the entire section 5 again. An applicant failing not more than three items shall take the failed items again. Failure in any item of the re-check or failure in any other items of section 5 already passed will require the applicant to take the entire check again.

FLIGHT TEST TOLERANCE 3. The applicant shall demonstrate the ability to:

(a) Operate the helicopter within its limitations; (b) Complete all manoeuvres with smoothness and accuracy; (c) Exercise good judgement and airmanship; (d) Apply aeronautical knowledge; (e) Maintain control of the helicopter at all times in such a manner that the successful outcome of a procedure or manoeuvre is never in doubt; (f) Understand and apply crew coordination and incapacitation procedures, if applicable; and (g) Communicate effectively with the other crew members, if applicable.

4. The following limits shall apply, corrected to make allowance for turbulent conditions and the handling qualities and performance of the helicopter used.

a)IFR flight limits Height: Generally ± 100 feet Starting a go-around at decision height/altitude + 50 feet/– 0 feet Minimum descent height/altitude + 50 feet/– 0 feet Tracking: On radio aids ± 5° For “angular” deviations half scale deflection, azimuth and glide (e.g.

Brief deviations from this standard up to a maximum of 1 time the RNP value are allowable.

6. An FSTD shall be used for practical training and testing if the FSTD forms part of a type rating course. The following considerations will apply to the course: (i) the qualification of the FSTD as set out in the relevant requirements of Part ARA and Part-

ORA; (ii) the qualifications of the instructor and examiner; (iii) the amount of FSTD training provided on the course; (iv) the qualifications and previous experience in similar types of the pilot under training; and (v) the amount of supervised flying experience provided after the issue of the new type

rating. MULTI PILOT HELICOPTERS 1. Applicants for the skill test for the issue of the multi-pilot helicopter type rating and ATPL(H) shall

take only sections 1 to 4 and, if applicable, section 6. 2. Applicants for the revalidation or renewal of the multi-pilot helicopter type rating proficiency

Subpart G, Instrument rating - IR

SECTION 1

Common requirements FCL.600 IR — General Except as provided in FCL.825, operations under IFR on an aeroplane, helicopter, airship or powered-lift aircraft shall only be conducted by holders of a PPL, CPL, MPL and ATPL with an IR appropriate to the category of aircraft or when undergoing skill testing or dual instruction. FCL.605 IR — Privileges (a) The privileges of a holder of an IR are to fly aircraft under IFR with a minimum

decision height of 200 feet (60 m). (b) In the case of a multi-engine IR, these privileges may be extended to decision heights lower

than 200 feet (60 m) when the applicant has undergone specific training at an ATO and has passed section 6 of the skill test prescribed in Appendix 9 to this Part in multi-pilot aircraft.

(c) Holders of an IR shall exercise their privileges in accordance with the conditions established in Appendix 8 to this Part.

(d) Helicopters only. To exercise privileges as PIC under IFR in multi-pilot helicopters, the holder of an IR(H) shall have at least 70 hours of instrument time of which up to 30 hours may be instrument ground time.

FCL.610 IR — Prerequisites and crediting Applicants for an IR shall: (a) hold:

(1) at least a PPL in the appropriate aircraft category, and: (i) the privileges to fly at night in accordance with FCL.810, if the IR privileges will

be used at night; or (ii) an ATPL in another category of aircraft; or

(2) a CPL, in the appropriate aircraft category; (b) have completed at least 50 hours of cross-country flight time as PIC in aeroplanes,

helicopters or airships of which at least 10 or, in the case of airships, 20 hours shall be in the relevant aircraft category.

(c) Helicopters only. Applicants who have completed an ATP(H)/IR, ATP(H), CPL(H)/IR or CPL(H) integrated training course shall be exempted from the requirement in (b).

FCL.615 IR — Theoretical knowledge and flight instruction (a) Course. Applicants for an IR shall have received a course of theoretical knowledge and flight

instruction at an ATO. The course shall be: (1) an integrated training course which includes training for the IR, in accordance with

Appendix 3 to this Part; or (2) a modular course in accordance with Appendix 6 to this Part.

(b) Examination. Applicants shall demonstrate a level of theoretical knowledge appropriate to the privileges granted in the following subjects: — Air Law, — Aircraft General Knowledge — Instrumentation, — Flight Performance and Monitoring, — Human Performance, — Meteorology, — Radio Navigation, — IFR Communications.

FCL.620 IR — Skill test (a) Applicants for an IR shall pass a skill test in accordance with Appendix 7 to this Part to

demonstrate the ability to perform the relevant procedures and manoeuvres with a degree of competency appropriate to the privileges granted.

(b) For a multi-engine IR, the skill test shall be taken in a multi-engine aircraft. For a single-engine IR, the test shall be taken in a single-engine aircraft. A multi-engine centerline thrust aeroplane shall be considered a single-engine aeroplane for the purposes of this paragraph.

FCL.625 IR — Validity, revalidation and renewal (a) Validity. An IR shall be valid for 1 year. (b) Revalidation.

(1) An IR shall be revalidated within the 3 months immediately preceding the expiry date of the rating.

(2) Applicants who fail to pass the relevant section of an IR proficiency check before the expiry date of the IR shall not exercise the IR privileges until they have passed the proficiency check.

(c) Renewal. If an IR has expired, in order to renew their privileges applicants shall: (1) go through refresher training at an ATO to reach the level of proficiency needed to pass

the instrument element of the skill test in accordance with Appendix 9 to this Part; and (2) complete a proficiency check in accordance with Appendix 9 to this Part, in the relevant

aircraft category. (d) If the IR has not been revalidated or renewed within the preceding 7 years, the holder will be

required to pass again the IR theoretical knowledge examination and skill test.

SECTION 2

Specific requirements for the aeroplane category FCL.625.A IR(A) — Revalidation (a) Revalidation. Applicants for the revalidation of an IR(A): (1) when combined with the revalidation of a class or type rating, shall pass a proficiency check in accordance with Appendix 9 to this Part; (2) when not combined with the revalidation of a class or type rating, shall: (i) for single-pilot aeroplanes, complete section 3b and those parts of section 1 relevant to the intended flight, of the proficiency check prescribed in Appendix 9 to this Part; and (ii) for multi-engine aeroplanes, complete section 6 of the proficiency check for single-pilot aeroplanes in accordance with Appendix 9 to this Part by sole reference to instruments. (3) An FNPT II or an FFS representing the relevant class or type of aeroplane may be used in the case of paragraph (2), but at least each alternate proficiency check for the revalidation of an IR(A) in these circumstances shall be performed in an aeroplane. (b) Cross-credit shall be given in accordance with Appendix 8 to this Part.

SECTION 3

Specific requirements for the helicopter category FCL.625.H IR(H) — Revalidation (a) Applicants for the revalidation of an IR(H):

(1) when combined with the revalidation of a type rating, shall complete a proficiency check in accordance with Appendix 9 to this Part, for the relevant type of helicopter;

(2) when not combined with the revalidation of a type rating, shall complete only section 5 and the relevant parts of section 1 of the proficiency check established in Appendix 9 to this Part for the relevant type of helicopter. In this case, an FTD 2/3 or an FFS representing the relevant type of helicopter may be used, but at least each alternate proficiency check for the revalidation of an IR(H) in these circumstances shall be performed in a helicopter.

(b) Cross-credit shall be given in accordance with Appendix 8 to this Part.

FCL.630.H IR(H) — Extension of privileges from single-engine to multi-engine helicopters Holders of an IR(H) valid for single-engine helicopters wishing to extend for the first time the IR(H) to multi-engine helicopters shall complete: (a) a training course at an ATO comprising at least 5 hours dual instrument

instruction time, of which 3 hours may be in an FFS or FTD 2/3 or FNPT II/III; and

(b) section 5 of the skill test in accordance with Appendix 9 to this Part on multi-engine helicopters.

Subpart H, Class and Type Ratings

SECTION 1

Common requirements FCL.700 Circumstances in which class or type ratings are required (a) Except in the case of the LAPL, SPL and BPL, holders of a pilot license shall not act in

any capacity as pilots of an aircraft unless they have a valid and appropriate class or type rating, except when undergoing skill tests, or proficiency checks for renewal of class or type ratings, or receiving flight instruction.

(b) Notwithstanding (a), in the case of flights related to the introduction or modification of aircraft types, pilots may hold a special certificate given by the competent authority, authorizing them to perform the flights. This authorization shall have its validity limited to the specific flights.

(c) Without prejudice to (a) and (b), in the case of flights related to the introduction or modification of aircraft types conducted by design or production organizations within the scope of their privileges, as well as instruction flights for the issue of a flight test rating, when the requirements of this Subpart may not be complied with, pilots may hold a flight test rating issued in accordance with FCL.820.

FCL.705 Privileges of the holder of a class or type rating The privileges of the holder of a class or type rating are to act as pilot on the class or type of aircraft specified in the rating. FCL.710 Class and type ratings — variants (a) In order to extend his/her privileges to another variant of aircraft within one class or type rating,

the pilot shall undertake differences or familiarization training. In the case of variants within a type rating, the differences or familiarisation training shall include the relevant elements defined in the operational suitability data established in accordance with Part-21.

(b) If the variant has not been flown within a period of 2 years following the differences training, further differences training or a proficiency check in that variant shall be required to maintain the privileges, except for types or variants within the single-engine piston and TMG class ratings.

(c) The differences training shall be entered in the pilot’s logbook or equivalent record and signed by the instructor as appropriate.

FCL.725 Requirements for the issue of class and type ratings (a) Training course. An applicant for a class or type rating shall complete a training course at an

ATO. The type rating training course shall include the mandatory training elements for the relevant type as defined in the operational suitability data established in accordance with Part-21.

(b) Theoretical knowledge examination. The applicant for a class or type rating shall pass a theoretical knowledge examination organised by the ATO to demonstrate the level of theoretical knowledge required for the safe operation of the applicable aircraft class or type. (1) For multi-pilot aircraft, the theoretical knowledge examination shall be written and

comprise at least 100 multiple-choice questions distributed appropriately across the main subjects of the syllabus.

(2) For single-pilot multi-engine aircraft, the theoretical knowledge examination shall be written and the number of multiple-choice questions shall depend on the complexity of the aircraft

(3) For single-engine aircraft, the theoretical knowledge examination shall be conducted verbally by the examiner during the skill test to determine whether or not a satisfactory level of knowledge has been achieved.

(4) For single-pilot aeroplanes that are classified as high performance aeroplanes, the examination shall be written and comprise at least 100 multiple-choice questions distributed appropriately across the main subjects of the syllabus.

(c) Skill test. An applicant for a class or type rating shall pass a skill test in accordance with Appendix 9 to this Part to demonstrate the skill required for the safe operation of the applicable class or type of aircraft. The applicant shall pass the skill test within a period of 6 months after commencement of the class or type rating training course and within a period of 6 months preceding the application for the issue of the class or type rating.

(d) An applicant who already holds a type rating for an aircraft type, with the privilege for either single-pilot or multi- pilot operations, shall be considered to have already fulfilled the theoretical requirements when applying to add the privilege for the other form of operation on the same aircraft type.

(e) Notwithstanding the paragraphs above, pilots holding a flight test rating issued in accordance with FCL.820 who were involved in development, certification or production flight tests for an aircraft type, and have completed either 50 hours of total flight time or 10 hours of flight time as PIC on test flights in that type, shall be entitled to apply for the issue of the relevant type rating, provided that they comply with the experience requirements and the prerequisites for the issue of that type rating, as established in this Subpart for the relevant aircraft category.

FCL.740 Validity and renewal of class and type ratings (a) The period of validity of class and type ratings shall be 1 year, except for single-

pilot single- engine class ratings, for which the period of validity shall be 2 years, unless otherwise determined by the operational suitability data, established in accordance with Part-21.

(b) Renewal. If a class or type rating has expired, the applicant shall: (1) take refresher training at an ATO, when necessary to reach the level

of proficiency necessary to safely operate the relevant class or type of aircraft; and

(2) pass a proficiency check in accordance with Appendix 9 to this Part.

SECTION 2

Specific requirements for the aeroplane category FCL.720.A Experience requirements and prerequisites for the issue of class or type ratings — aeroplanes Unless otherwise determined in the operational suitability data established in accordance with Part-21, an applicant for a class or type rating shall comply with the following experience requirements and prerequisites for the issue of the relevant rating: (a) Single-pilot multi-engine aeroplanes. An applicant for a first class or type rating on a single- pilot

multi-engine aeroplane shall have completed at least 70 hours as PIC on aeroplanes. (b) Single-pilot high performance non-complex aeroplanes. Before starting flight training, an

applicant for a first class or type rating for a single-pilot aeroplane classified as a high performance aeroplane shall: (1) have at least 200 hours of total flying experience, of which 70 hours as PIC on aeroplanes;

and (2) (i) hold a certificate of satisfactory completion of a course for additional theoretical

knowledge undertaken at an ATO; or (ii) have passed the ATPL(A) theoretical knowledge examinations in accordance with this Part; or (iii) hold, in addition to a license issued in accordance with this Part, an ATPL(A) or CPL(A)/IR with theoretical knowledge credit for ATPL(A), issued in accordance with Annex 1 to the Chicago Convention;

(3) in addition, pilots seeking the privilege to operate the aeroplane in multi-pilot operations shall meet the requirements of (d)(4).

(c) Single-pilot high performance complex aeroplanes. Applicants for the issue of a first type rating for a complex single- pilot aeroplane classified as a high performance aeroplane shall, in addition to meeting the requirements of (b), have fulfilled the requirements for a multi-engine IR(A), as established in Subpart G.

(d) Multi-pilot aeroplanes. An applicant for the first type rating course for a multi-pilot aeroplane shall be a student pilot currently undergoing training on an MPL training course or comply with the following requirements: (1) have at least 70 hours of flight experience as PIC on aeroplanes; (2) hold a multi-engine IR(A); (3) have passed the ATPL(A) theoretical knowledge examinations in accordance with this Part;

and (4) except when the type rating course is combined with an MCC course:

(i) hold a certificate of satisfactory completion of an MCC course in aeroplanes; or (ii) hold a certificate of satisfactory completion of MCC in helicopters and have more than

100 hours of flight experience as a pilot on multi-pilot helicopters; or (iii) have at least 500 hours as a pilot on multi-pilot helicopters; or (iv) have at least 500 hours as a pilot in multi-pilot operations on single-pilot

multi-engine aeroplanes, in commercial air transport in accordance with the applicable air operations requirements.

(e) Notwithstanding paragraph (d), a Member State may issue a type rating with restricted privileges for multi pilot aeroplane that allows the holder of such rating to act as a cruise relief co-pilot above Flight Level 200, provided that two other members of the crew have a type rating in accordance with paragraph (d).

(f) Additional multi-pilot and single-pilot high performance complex aeroplane type ratings. An applicant for the issue of additional multi-pilot type ratings and single-pilot high performance complex aeroplanes type ratings shall hold a multi-engine IR(A).

(g) When so determined in the operational suitability data established in accordance with Part-21, the exercise of the privileges of a type rating may be initially limited to flight under the supervision of an instructor. The flight hours under supervision shall be entered in the pilot’s logbook or equivalent record and signed by the instructor. The limitation shall be removed when the pilot demonstrates that the hours of flight under supervision required by the operational suitability data have been completed.

FCL.725.A Theoretical knowledge and flight instruction for the issue of class and type ratings — aeroplanes Unless otherwise determined in the operational suitability data established in accordance with Part 21: (a) Single-pilot multi-engine aeroplanes.

(1) The theoretical knowledge course for a single-pilot multi-engine class rating shall include at least 7 hours of instruction in multi-engine aeroplane operations.

(2) The flight training course for a single-pilot multi-engine class or type rating shall include at least 2 hours and 30 minutes of dual flight instruction under normal conditions of multi- engine aeroplane operations, and not less than 3 hours 30 minutes of dual flight instruction in engine failure procedures and asymmetric flight techniques.

(b) Single-pilot aeroplanes-sea. The training course for single-pilot aeroplane-sea ratings shall include theoretical knowledge and flight instruction. The flight training for a class or type rating-sea for single-pilot aeroplanes-sea shall include at least 8 hours of dual flight instruction if the applicant holds the land version of the relevant class or type rating, or 10 hours if the applicant does not hold such a rating.

(c) Multi-pilot airplanes. The training course for the issue of a multi-pilot Aeroplane type rating shall include theoretical knowledge and flight instruction in upset prevention and recovery.

FCL.730.A Specific requirements for pilots undertaking a zero flight time type rating (ZFTT) course — aeroplanes (a) A pilot undertaking instruction at a ZFTT course shall have completed, on a multi-pilot turbo-

jet aeroplane certificated to the standards of CS-25 or equivalent airworthiness code or on a multi-pilot turbo-prop aeroplane having a maximum certificated take-off mass of not less than 10 tonnes or a certificated passenger seating configuration of more than 19 passengers, at least: (1) if an FFS qualified to level CG, C or interim C is used during the course, 1 500 hours

flight time or 250 route sectors; (2) if an FFS qualified to level DG or D is used during the course, 500 hours flight time or

100 route sectors. (b) When a pilot is changing from a turbo-prop to a turbo-jet aeroplane or from a turbo-jet to a

turbo-prop aeroplane, additional simulator training shall be required. FCL.735.A Multi-crew cooperation training course — aeroplanes (a) The MCC training course shall comprise at least:

(1) 25 hours of theoretical knowledge instruction and exercises; and (2) 20 hours of practical MCC training, or 15 hours in the case of student pilots attending an

ATP integrated course. An FNPT II MCC or an FFS shall be used. When the MCC training is combined with initial type rating training, the practical MCC training may be reduced to no less than 10 hours if the same FFS is used for both the MCC and type rating training.

(b) The MCC training course shall be completed within 6 months at an ATO. (c) Unless the MCC course has been combined with a type rating course, on completion of the MCC

training course the applicant shall be given a certificate of completion. (d) An applicant having completed MCC training for any other category of aircraft

shall be exempted from the requirement in (a)(1). FCL.740.A Revalidation of class and type ratings — aeroplanes (a) Revalidation of multi-engine class ratings and type ratings. For revalidation of multi-engine

class ratings and type ratings, the applicant shall: (1) pass a proficiency check in accordance with Appendix 9 to this Part in the

relevant class or type of aeroplane or an FSTD representing that class or type, within the 3 months immediately preceding the expiry date of the rating; and

(2) complete during the period of validity of the rating, at least: (i) 10 route sectors as pilot of the relevant class or type of aeroplane; or (ii) 1 route sector as pilot of the relevant class or type of aeroplane or FFS,

flown with an examiner. This route sector may be flown during the proficiency check.

(3) A pilot working for a commercial air transport operator approved in accordance with the applicable air operations requirements who has passed the operators proficiency check combined with the proficiency check for the revalidation of the class or type rating shall be exempted from complying with the requirement in (2).

(4) The revalidation of an en route instrument rating (EIR) or an IR(A), if held, may be combined with a proficiency check for the revalidation of a class or type rating.

(b) Revalidation of single-pilot single-engine class ratings. (1) Single-engine piston aeroplane class ratings and TMG ratings. For revalidation

of single- pilot single-engine piston aeroplane class ratings or TMG class ratings the applicant shall: (i) within the 3 months preceding the expiry date of the rating, pass a

proficiency check in the relevant class in accordance with Appendix 9 to this Part with an examiner; or

(ii) within the 12 months preceding the expiry date of the rating, complete 12 hours of flight time in the relevant class, including: — 6 hours as PIC, — 12 take-offs and 12 landings, and — a training flight of at least 1 hour with a flight instructor (FI) or a class

rating instructor (CRI). Applicants shall be exempted from this flight if they have passed a class or type rating proficiency check or skill test in any other class or type of aeroplane.

(2) When applicants hold both a single-engine piston aeroplane-land class rating and a TMG rating, they may complete the requirements of (1) in either class, and achieve revalidation of both ratings.

(3) Single-pilot single-engine turbo-prop aeroplanes. For revalidation of single-engine turbo- prop class ratings applicants shall pass a proficiency check on the relevant class in accordance with Appendix 9 to this Part with an examiner, within the 3 months preceding the expiry date of the rating.

(4) When applicants hold both a single-engine piston aeroplane-land class rating and a single-engine piston aeroplane-sea class rating, they may complete the requirements of (1)(ii) in either class or a combination there of,and achieve the

fulfilment of these requirements for both ratings. At least 1 hour of required PIC

time and 6 of the required 12 take-offs and landings shall be completed in each class.

(c) Applicants who fail to achieve a pass in all sections of a proficiency check before the expiry date of a class or type rating shall not exercise the privileges of that rating until a pass in the proficiency check has been achieved.

SECTION 3

Specific requirements for the helicopter category

FCL.720.H Experience requirements and prerequisites for the issue of type ratings — helicopters Unless otherwise determined in the operational suitability data established in accordance with Part-21, an applicant for the issue of the first helicopter type rating shall comply with the following experience requirements and prerequisites for the issue of the relevant rating: (a) Multi-pilot helicopters. An applicant for the first type rating course for a multi-pilot helicopter type

shall: (1) have at least 70 hours as PIC on helicopters; (2) except when the type rating course is combined with an MCC course:

(i) hold a certificate of satisfactory completion of an MCC course in helicopters; or (ii) have at least 500 hours as a pilot on multi-pilot aeroplanes; or (iii) have at least 500 hours as a pilot in multi-pilot operations on multi-engine

helicopters; (3) have passed the ATPL(H) theoretical knowledge examinations.

(b) An applicant for the first type rating course for a multi-pilot helicopter type who is a graduate from an ATP(H)/IR, ATP(H), CPL(H)/IR or CPL(H) integrated course and who does not comply with the requirement of (a)(1), shall have the type rating issued with the privileges limited to exercising functions as co-pilot only. The limitation shall be removed once the pilot has: (1) completed 70 hours as PIC or pilot-in-command under supervision of

helicopters; (2) passed the multi-pilot skill test on the applicable helicopter type as PIC.

(c) Single-pilot multi-engine helicopters. An applicant for the issue of a first type rating for a single-pilot multi-engine helicopter shall: (1) before starting flight training:

(i) have passed the ATPL(H) theoretical knowledge examinations; or (ii) hold a certificate of completion of a pre-entry course conducted by an ATO. The

course shall cover the following subjects of the ATPL(H) theoretical knowledge course: — Aircraft General Knowledge: airframe/systems/power plant, and instrument/

electronics, — Flight Performance and Planning: mass and balance, performance;

(2) in the case of applicants who have not completed an ATP(H)/IR, ATP(H), or CPL(H)/IR integrated training course, have completed at least 70 hours as PIC on helicopters.

FCL.735.H Multi-crew cooperation training course — helicopters (a) The MCC training course shall comprise at least:

(1) for MCC/IR: (i) 25 hours of theoretical knowledge instruction and exercises; and (ii) 20 hours of practical MCC training or 15 hours, in the case of student pilots attending

an ATP(H)/IR integrated course. When the MCC training is combined with the initial type rating training for a multi- pilot helicopter, the practical MCC training may be reduced to not less than 10 hours if the same FSTD is used for both MCC and type rating;

(2) for MCC/VFR: (i) 25 hours of theoretical knowledge instruction and exercises; and (ii) 15 hours of practical MCC training or 10 hours, in the case of student pilots attending

an ATP(H)/IR integrated course. When the MCC training is combined with the initial type rating training for a multi- pilot helicopter, the practical MCC training may be reduced to not less than 7 hours if the same FSTD is used for both MCC and type rating.

(b) The MCC training course shall be completed within 6 months at an ATO. An FNPT II or III qualified for MCC, an FTD 2/3 or an FFS shall be used.c) unless the MCC course has been combined with a multi-pilot type rating course, on completion of the MCC training course the applicant shall be given a certificate of completion.

(d) An applicant having completed MCC training for any other category of aircraft shall be exempted from the requirement in (a)(1)(i) or (a)(2)(i), as applicable.

(e) An applicant for MCC/IR training who has completed MCC/VFR training shall be exempted from the requirement in (a)(1)(i), and shall complete 5 hours of practical MCC/IR training.

FCL.740.H Revalidation of type ratings — helicopters (a) Revalidation. For revalidation of type ratings for helicopters, the applicant shall:

(1) pass a proficiency check in accordance with Appendix 9 to this Part in the relevant type of helicopter or an FSTD representing that type within the 3 months immediately preceding the expiry date of the rating; and

(2) complete at least 2 hours as a pilot of the relevant helicopter type within the validity period of the rating. The duration of the proficiency check may be counted towards the 2 hours.

(3) When applicants hold more than 1 type rating for single-engine piston helicopters, they may achieve revalidation of all the relevant type ratings by completing the proficiency check in only 1 of the relevant types held, provided that they have completed at least 2 hours of flight time as PIC on the other types during the validity period. The proficiency check shall be performed each time on a different type.

(4) When applicants hold more than 1 type rating for single-engine turbine helicopters with a maximum certificated take-off mass up to 3 175 kg, they may achieve revalidation of all the relevant type ratings by completing the proficiency check in only 1 of the relevant types held, provided that they have completed: (i) 300 hours as PIC on helicopters; (ii) 15 hours on each of the types held; and (iii) at least 2 hours of PIC flight time on each of the other types during the validity

period. The proficiency check shall be performed each time on a different type. (5) A pilot who successfully completes a skill test for the issue of an additional type rating shall

achieve revalidation for the relevant type ratings in the common groups, in accordance with (3) and (4).

(6) The revalidation of an IR(H), if held, may be combined with a proficiency check for a type rating.

(b) An applicant who fails to achieve a pass in all sections of a proficiency check before the expiry date of a type rating shall not exercise the privileges of that rating until a pass in the proficiency check has been achieved. In the case of (a)(3) and (4), the applicant shall not exercise his/her privileges in any of the types.

Informatieblad hernieuwde afgifte

Informatieblad van verlopen klasse-, type- en instrument bevoegdverklaringen Uitgiftedatum : 3 februari 2015 Uitgiftenummer: 3.0 1. INLEIDING 1.1 In dit informatieblad treft u de eisen aan die gelden voor hernieuwde afgifte van

bevoegdverklaringen op vliegtuigen en helikopters in uw Part FCL bewijs van bevoegdheid. Deze informatie is ook op u van toepassing als u nu nog een JAA-brevetdocument heeft of een nationaal bewijs van bevoegdheid (RPL) heeft.

1.2 Er is sprake van hernieuwde afgifte indien de geldigheidsduur van uw bevoegdverklaring is verlopen.

1.3 Alvorens een eventuele aanvraag voor hernieuwde afgifte van een bevoegdverklaring ingediend kan worden, moet door een geschikte trainingsorganisatie bepaald worden of en zo ja, aan welke aanvullende eisen voldaan moet worden.

1.4 Dit informatieblad is bedoeld om u te helpen te bepalen welke aanvullende eisen mogelijk gelden in uw specifieke situatie.

1.5 In dit informatieblad worden onder trainingsorganisatie gedurende de transitieperiode de volgende organisaties verstaan: Registered Training Facility of Approved Training Organisation.

2. PROCEDURE De procedure voor hernieuwde afgifte van een bevoegdverklaring kent de volgende stappen, (zie bijlage I voor een uitgebreidere weergave): 2.1 De trainingsorganisatie beoordeelt of en hoelang de betreffende bevoegdverklaring verlopen is. 2.2 De trainingsorganisatie beoordeelt het niveau van de brevethouder en bepaalt of er

aanvullende training noodzakelijk is. 2.3 Indien aanvullende training noodzakelijk is wordt deze getraind met een

instructeur in dienst van de trainingsorganisatie. 2.4 Na het voltooien van de training stelt de trainingsorganisatie een certificaat op waarbij zij

verklaart dat de aanvullende training is afgerond. 2.5 Indien voldaan is aan alle eisen neemt de examinator de proeve van bekwaamheid af. 2.6 Indien de kandidaat is geslaagd voor de proeve van bekwaamheid mag de examinator dit

aftekenen op het bewijs van bevoegdheid, mits de examinator daartoe is geautoriseerd en het brevet nog ruimte biedt voor het noteren van de verlenging hernieuwde afgifte.

2.7 Het (trainings)certificaat en een kopie van het resultaat van de proeve van bekwaamheid wordt

door de examinator opgestuurd naar Kiwa Register B.V1. 2. ALGEMENE VOORWAARDEN 3.1 De trainingsorganisatie die het niveau van de kandidaat beoordeelt en de training verzorgt

dient te beschikken over een goedgekeurde syllabus van de betreffende bevoegdverklaring (bijvoorbeeld een syllabus classrating SEP voor een verlopen bevoegdverklaring SEP). De ATO welke een MPA type rating verzorgt mag naast de type rating ook de herafgifte van de ME-IR verzorgen. Gedurende het transitieproces wordt een goedgekeurde JAR compliant syllabus ook geaccepteerd.

3.2 De examinator mag de bekwaamheidsproef niet afnemen wanneer hij/zij zijn/haar objectiviteit niet kan garanderen.

3.3 Een trainingsvlucht zal niet worden aangemerkt als een examenvlucht en een examenvlucht zal niet worden aangemerkt als een trainingsvlucht.

3.4 De kandidaat moet voor aanvang van de bekwaamheidsproef in bezit zijn van een certificaat van de trainingsorganisatie waarin is vermeld dat de training is gevolgd alsmede een beschrijving van de aangeboden training. Ook wordt er een certificaat verstrekt als er naar oordeel van de trainingsorganisatie geen training noodzakelijk is. De examinator controleert dit voor aanvang van de bekwaamheidsproef.

4. VLIEGTUIGEN 4.1 MLA,RPL(SEP),

RPL(TMG) 4.1.1 Voor de hernieuwde afgifte van de Single Pilot-Single engine bevoegdverklaring

RPL(MLA), RPL(SEP) en RPL(TMG) moet de kandidaat alleen een proeve van bekwaamheid in de betreffende klasse afleggen. Voor deze bevoegdverklaring gelden geen aanvullende eisen.

4.2 Type- of klassebevoegdverklaring, met uitzondering van MLA, RPL(SEP) en RPL(TMG) 4.2.1 Voor de hernieuwde afgifte van een verlopen type- of klassebevoegdverklaring moet

de kandidaat naast de proeve van bekwaamheid aanvullende training2 volgen bij een training organisatie, in overeenstemming met AMC1 FCL.740(b)(1). De te volgen training is afhankelijk van het niveau en de ervaring van de kandidaat, de termijn dat de bevoegdverklaring van de kandidaat is verlopen en de complexiteit van het luchtvaartuig. Als richtlijn kan worden aangehouden dat voor een kandidaat waarvan de bevoegdverklaring:

minder dan 3 maanden is verlopen mogelijk geen aanvullende eisen gelden;

meer dan 3 maanden maar minder dan een 1 jaar is verlopen tenminste twee

trainingssessies nodig zullen zijn;

meer dan 1 jaar maar minder dan 3 jaar is verlopen tenminste drie trainingssessies nodig

zullen zijn, waarbij de meest belangrijke storingen in de beschikbare systemen moeten

worden geoefend;

meer dan 3 jaar is verlopen de gehele training voor de eerste afgifte van de betreffende

bevoegdverklaring overnieuw moet worden gevolgd. 4.2.2 Zie bijlage II voor meer informatie over de hernieuwde afgifte van verlopen

klasse- en typebevoegdverklaring. 4.3 Instrument-Rating

4.3.1 Voor de hernieuwde afgifte van een verlopen instrument-rating moet de kandidaat

naast de proeve van bekwaamheid aanvullende training3 volgen bij een training organisatie, in overeenstemming met AMC1 FCL.625(c). De te volgen training is afhankelijk van het niveau en de ervaring van de kandidaat en de termijn dat de IR van de kandidaat is verlopen. Als richtlijn kan worden aangehouden dat voor een kandidaat waarvan de IR:

minder dan 3 maanden is verlopen mogelijk geen aanvullende eisen gelden;

meer dan 3 maanden maar minder dan een 1 jaar is verlopen tenminste één

trainingssessies nodig zal zijn.

meer dan 1 jaar maar minder dan 7 jaar is verlopen tenminste drie trainingssessie nodig

zullen zijn

meer dan 7 jaar is verlopen de gehele training (zowel theorie als praktijk) voor de eerste

afgifte van de betreffende ir overnieuw moet worden gevolgd

4.3.2 De bekwaamheidsproef IR wordt afgenomen in de relevante luchtvaartcategorie. Dit houdt in dat de proef in een relevant vliegtuig moet worden afgelegd, of in een relevante FFS wanneer deze beschikbaar is. De proef kan niet in een FSTD anders dan een FFS worden afgelegd.

4.3.3 Zie bijlage III voor meer informatie over de hernieuwde afgifte van een verlopen IR.

5. HELIKOPTERS 5.1 Typebevoegdverklaring RPL

5.1.1 Voor hernieuwde afgifte van een typebevoegdverklaring in een RPL moet de kandidaat – naast een proeve van bekwaamheid- voldoen aan de aanvullende eisen zoals hieronder aangegeven:

Verlopen korter dan 3 maanden: geen aanvullende eisen;

Verlopen langer dan 3 maanden maar korter dan 1 jaar: minimaal twee trainingssessies

Verlopen langer dan 1 jaar: minimaal drie trainingssessie waarin het volledige pakket van

de meest belangrijke storingen in de aanwezige systemen worden getraind. 5.2 Typebevoegdverklaring PPL, CPL of ATPL

5.2.1 Voor de hernieuwde afgifte van een verlopen typebevoegdverklaring moet de

kandidaat naast de proeve van bekwaamheid aanvullende training4 volgen bij een training organisatie, in overeenstemming met AMC1 FCL.740(b)(1). De te volgen training is afhankelijk van het niveau en de ervaring van de kandidaat, de termijn dat de bevoegdverklaring van de kandidaat is verlopen en de complexiteit van het luchtvaartuig. Als richtlijn kan worden aangehouden dat voor een kandidaat waarvan de bevoegdverklaring:

minder dan 3 maanden is verlopen mogelijk geen aanvullende eisen gelden;

meer dan 3 maanden maar minder dan een 1 jaar is verlopen tenminste twee

trainingssessies nodig zullen zijn

meer dan 1 jaar maar minder dan 3 jaar is verlopen tenminste drie trainingssessies

nodig zullen zijn, waarbij de meest belangrijke storingen in de beschikbare systemen

moeten worden geoefend;

meer dan3 jaar is verlopen de gehele training voor de eerste afgifte van de betreffende

bevoegdverklaring overnieuw moet worden gevolgd. In geval van een helikopter is hier sprake van de training welke benodigd is hier sprake van de training voor ‘additional type issue’, gelet op de andere geldige ratings die de kandidaat in bezit heeft.

5.2.2 Zie bijlage II voor meer informatie over de hernieuwde afgifte van verlopen klasse-

en type-bevoegdverklaringen. 5.3 Instrument-rating

5.3.1 Voor de hernieuwde afgifte van een verlopen instrument-rating moet de kandidaat

naast de proeve van bekwaamheid aanvullende training5 volgen bij een training organisatie, in overeenstemming met AMC1 FCL.625(c). De te volgen training is afhankelijk van het niveau en de ervaring van de kandidaat en de termijn dat de IR van de kandidaat is verlopen. Als richtlijn kan worden aangehouden dat voor een kandidaat waarvan de IR:

minder dan 3 maanden is verlopen mogelijk geen aanvullende eisen gelden;

meer dan 3 maanden maar minder dan een 1 jaar is verlopen tenminste één

trainingssessie nodig zal zijn meer dan 1 jaar maar minder dan 7 jaar is verlopen tenminste drie trainingssessies nodig zullen zijn

betreffende IR overnieuw moet worden gevolgd.

BIJLAGE II HERNIEUWDE AFGIFTE VERLOPEN KLASSE- EN TYPEBEVOEGDVERKLARINGEN 1. INTRODUCTIE De eisen voor de hernieuwde afgifte van een verlopen bevoegdverklaring zijn vastgelegd in EU Verordening 1178/2011 en het bijbehorend AMC materiaal. Doel van deze eisen is dat kandidaten op niveau worden aangeboden voor een bekwaamheidsproef (proficiency check). 2. VERLOPEN KLASSE OF TYPE BEVOEGDVERKLARING Wanneer een klasse of type bevoegdverklaring is verlopen zijn de eisen in FCL.740 en AMC FCL.740(b)(1) van toepassing.: FCL.740 Validity and renewal of class and type ratings a) The period of validity of class and type ratings shall be 1 year, except for single-pilot single-

engine class ratings, for which the period of validity shall be 2 years, unless otherwise determined by the operational suitability data, established in accordance with Part-21.

b) Renewal. If a class or type rating has expired, the applicant shall: 1) take refresher training at an ATO, when necessary to reach the level of proficiency

necessary to safely operate the relevant class or type of aircraft; and 2) pass a proficiency check in accordance with Appendix 9 to this Part. AMC1

FCL.740(b)(1) Validity and renewal of class and type ratings RENEWAL OF CLASS AND TYPE RATINGS: REFRESHER TRAINING a) Paragraph (b)(1) of FCL.740 determines that if a class or type rating has lapsed, the applicant

shall take refresher training at an ATO. The objective of the training is to reach the level of proficiency necessary to safely operate the relevant type or class of aircraft. The amount of refresher training needed should be determined on a case-by- case basis by the ATO, taking into account the following factors: 1) the experience of the applicant. To determine this, the ATO should evaluate the pilot’s

log book, and, if necessary, conduct a test in an FSTD; 2) the complexity of the aircraft; 3) the amount of time lapsed since the expiry of the validity period of the rating. The

amount of training needed to reach the desired level of proficiency should increase with the time lapsed. In some cases, after evaluating the pilot, and when the time lapsed is very limited (less than 3 months), the ATO may even determine that no further refresher training is necessary. When determining the needs of the pilot, the following items can be taken into consideration: i. expiry shorter than 3 months: no supplementary requirements; ii. expiry longer than 3 months but shorter than 1 year: a minimum of two training

sessions; iii. expiry longer than 1 year but shorter than 3 years: a minimum of three training

sessions in which the most important malfunctions in the available systems are covered;

iv. expiry longer than 3 years: the applicant should again undergo the training required for the initial issue of the rating or, in case of helicopter, the training required for the ‘additional type issue’, according to other valid ratings held.

b) Once the ATO has determined the needs of the applicant, it should develop an individual training programme that should be based on the initial training for the issue of the rating and focus on the aspects where the applicant has shown the greatest needs.

c) After successful completion of the training, the ATO should give a certificate, or other documental evidence that the training has been successfully achieved to the applicant, to be submitted to the competent authority when applying for the renewal. The certificate or documental evidence needs to contain a description of the training program.

3. ROL VAN DE BREVETHOUDER Wanneer de klasse- of typebevoegdverklaring van een brevethouder (kandidaat) is verlopen, zijn de eisen met betrekking tot hernieuwde afgifte op hem/haar van toepassing. Om de bevoegdverklaring weer geldig te maken dient de kandidaat zich te melden bij een trainingsorganisatie om zijn/haar niveau te laten beoordelen en (eventueel) refresher training te volgen. Zonder een beoordeling van het niveau van de kandidaat door een trainingsorganisatie en het (eventueel) volgen van een refresher training kan er geen bekwaamheidsproef worden afgelegd en kan geen hernieuwde klasse- of typebevoegdverklaring worden afgegeven. 4. ROL VAN DE TRAININGSORGANISATIE Wanneer een kandidaat met een verlopen klasse- of typebevoegdverklaring zich meldt dient de trainingsorganisatie het niveau van de kandidaat te evalueren en te beoordelen of de kandidaat aanvullende training nodig heeft. Van een trainingsorganisatie welke als ATO is gecertificeerd wordt verwacht dat zij over een beoordelingsprocedure beschikt.

Beoordeling niveau kandidaat De trainingsorganisatie is in de eerste plaats verplicht om bij een verlopen bevoegdverklaring het niveau van de kandidaat te beoordelen en vast te stellen of de kandidaat aanvullende training nodig heeft. Het doel hiervan is dat de kandidaat op niveau wordt aangeboden voor een bekwaamheidsproef. De mate van training welke nodig is hangt af van de ervaring van de kandidaat, de complexiteit van het toestel waarop wordt gevlogen, de tijd die is verstreken sinds de verloopdatum van de bevoegdheid en de meest recente vlieguren die zijn gemaakt. Dit zal per kandidaat verschillend zijn. De beoordeling is daarom een case-by-case benadering. Deze beoordeling kan alleen worden uitgevoerd door een trainingsorganisatie die beschikt over een syllabus van betreffende klasse of type

bevoegdverklaring en deze training op het certificaat7 heeft staan. Dat wil zeggen dat wanneer de bevoegdverklaring SEP van een kandidaat is verlopen, de trainingsorganisatie welke het niveau van de kandidaat beoordeelt en de training verzorgt moet beschikken over de syllabus classrating SEP. Zo moet de trainingsorganisatie ook beschikken over een syllabus classrating MEP in geval van een verlopen bevoegdverklaring MEP, etc. De ATO welke een MPA type rating verzorgt mag naast de type rating ook de herafgifte van de ME-IR verzorgen. Wanneer de trainingsorganisatie niet beschikt over de betreffende syllabus mag deze de beoordeling zoals bedoeld in AMC1 FCL.740(b)(1) niet uitvoeren en de training niet aanbieden. De ervaring van de kandidaat dient de trainingsorganisatie tenminste te beoordelen aan de hand van een evaluatie van het logboek. Hieruit blijkt onder andere wat de recente ervaring van de kandidaat is. Wanneer blijkt dat de kandidaat al enige maanden niet heeft gevlogen kan aan de hand van de evaluatie van het logboek al worden geconcludeerd dat er mogelijkerwijs training moet worden gevolgd. De trainingsorganisatie kan besluiten een beoordelingsvlucht af te nemen van de kandidaat in een FSTD om zijn/haar niveau beter in te schatten. Hoewel niet expliciet in de regelgeving vermeld, wordt een beoordelingsvlucht in een trainingsvliegtuig van de trainingsorganisatie ook geaccepteerd. Daarnaast dient de trainingsorganisatie bij de beoordeling van het niveau van de kandidaat en de te volgen refresher training rekening te houden met de termijn dat de bevoegdverklaring van de kandidaat is verlopen. Naarmate meer tijd is verstreken sinds het verlopen van de bevoegdverklaring zal de kandidaat meer trainingssessies moeten volgen om op het gewenste niveau te komen (uiteraard afhankelijk van het niveau en de ervaring van de kandidaat). 7 Of registratie in het geval van een geregistreerde trainingsorganisatie wanneer deze nog niet als ATO is gecertificeerd.

Als richtlijn kan worden aangehouden dat voor een kandidaat waarvan de bevoegdverklaring:

minder dan 3 maanden is verlopen mogelijk geen aanvullende eisen gelden;

meer dan 3 maanden maar minder dan een 1 jaar is verlopen tenminste twee trainingssessies

nodig zullen zijn.

meer dan 1 jaar maar minder dan 3 jaar is verlopen tenminste drie trainingssessies nodig zullen

zijn, waarbij de meest belangrijke storingen in de beschikbare systemen moeten worden geoefend.

bevoegdverklaring overnieuw moet worden gevolgd (in geval van een helikopter is hier sprake

van de training welke benodigd is hier sprake van de training voor ‘additional type issue’, gelet op de andere geldige ratings die de kandidaat in bezit heeft).

Bovenstaande uitgangspunten gelden als richtlijn. Dit vereist een goede evaluatie van de kandidaat door de trainingsorganisatie. De beoordeling die de trainingsorganisatie heeft uitgevoerd moet zij goed kunnen onderbouwen. Ter illustratie: op basis van deze criteria kan er niet standaard van worden uitgegaan dat een kandidaat waarvan de bevoegdverklaring minder dan drie maanden is verlopen geen aanvullende training nodig heeft. Wanneer een trainingsorganisatie beoordeelt dat er geen training noodzakelijk is dient dit zorgvuldig te worden onderbouwd en te worden aangetoond dat de kandidaat recente ervaring heeft en dat de bevoegdverklaring minder dan drie maanden is verlopen. Neem een onervaren kandidaat met een bevoegdverklaring SEP welke 2 maanden is verlopen, terwijl de kandidaat in de voorafgaande 12 maanden geen MEP, SEP e.d. heeft gevlogen. In geval van deze kandidaat is het voor de trainingsorganisatie moeilijk te onderbouwen dat de kandidaat geen refresher training nodig heeft en kan de trainingsorganisatie de kandidaat mogelijkerwijs niet aanbieden met de vermelding ‘geen training benodigd’. Gezien de recente ervaring van de kandidaat (laatste 12 maanden) kan worden verondersteld dat één of meerdere trainingssessies nodig zijn. Trainingsprogramma Op basis van de beoordeling van de kandidaat dient de trainingsorganisatie in alle gevallen een (individueel) trainingsprogramma op te stellen. Dit trainingsprogramma moet op grond van AMC1 FCL.740(b)(1) (b) een syllabus zijn welke is gebaseerd op de initiële training voor de betreffende klasse- of typebevoegdverklaring. Het individuele trainingsprogramma geeft inzicht in hoe de kandidaat wordt getraind, welke trainingsessies er worden uitgevoerd en welke oefeningen minimaal aan bod komen. In het trainingsplan wordt de nadruk gelegd op de items waarin de kandidaat de meeste training nodig heeft. Hieruit kan worden afgeleid dat er voor het begin van de training en voor het opstellen van een trainingsplan een goede beoordeling moet plaats vinden om vast te stellen waar de betreffende kandidaat het meeste op moet worden getraind. De training moet worden aangeboden op een vliegtuig dat voldoet aan de eisen zoals gesteld in Part ORA.ATO.135 en de te gebruiken luchthavens dienen te voldoen aan de eisen zoals gesteld in Part ORA.ATO.140. Voor de vliegtuigen betekent dit dat deze op de lijst van trainingsvliegtuigen moet zijn vermeld. De instructeurs die de training aanbieden zijn verbonden aan de trainingsorganisatie en staan op de instructeurlijst van de trainingsorganisatie vermeld. Certificaat

Nadat de kandidaat de training succesvol heeft afgerond dient de trainingsorganisatie een

certificaat8 te verstrekken. In dit certificaat verklaart zij dat de kandidaat de training succesvol heeft gevolgd en dat de kandidaat op het vereiste niveau is voor de bekwaamheidsproef. Dit certificaat dient tenminste een beschrijving te bevatten van het trainingsprogramma dat door de kandidaat is gevolgd. Dit certificaat moet ook worden verstrekt wanneer de kandidaat geen refresher training heeft gevolgd. In dit geval wordt in de beschrijving van het trainingsprogramma aangegeven dat de kandidaat geen aanvullende training nodig heeft gehad. Het is de verantwoordelijkheid van de trainingsorganisatie om (conform haar eigen beoordelingsprocedure, in geval van een trainingsorganisatie die als ATO is gecertificeerd) een kandidaat op niveau aan te bieden voor een bekwaamheidsproef. 8 Onder certificaat wordt verstaan een verklaring of ander schriftelijk bewijs wat de benodigde elementen bevat. De opmaak van dit certificaat is niet voorgeschreven in Part FCL.

5. ROL VAN DE EXAMINATOR Nadat de kandidaat de refresher training bij de trainingsorganisatie succesvol heeft afgerond en het certificaat heeft ontvangen legt de kandidaat een bekwaamheidsproef af bij een examinator. Voordat de bekwaamheidsproef wordt afgenomen dient de examinator zeker te stellen dat de kandidaat voldoet aan de eisen en beschikt over een certificaat met een beschrijving van het trainingsprogramma dat de kandidaat heeft gevolgd (zie hiervoor ook de instructies voor examinatoren voor de controle van de eisen bij vaardigheidstests, bekwaamheidsproeven en beoordelingen van vakbekwaamheid). Wanneer de kandidaat deze gegevens niet kan overhandigen kan de bekwaamheidsproef niet worden afgenomen. Wanneer de stukken wel kunnen worden overhandigd en de kandidaat op niveau is, zal de examinator de bekwaamheidsproef afnemen in overeenstemming met de relevante eisen in Part FCL Appendix 9. Wanneer de bekwaamheidsproef succesvol wordt doorlopen wordt het brevet door de examinator afgetekend. Na het afnemen van de bekwaamheidsproef stuurt de examinator het certificaat met de beschrijving van het trainingsprogramma met daarnaast een kopie van het examinatorrapport (bestaande uit een STRF en een FTS) van de kandidaat naar Kiwa. 6. ROL VAN KIWA Nadat Kiwa de stukken heeft ontvangen beoordeelt zij of alle benodigde documenten aanwezig zijn en registreert deze in het dossier van de kandidaat. Wanneer Kiwa hierbij constateert dat niet conform de voorschriften is gehandeld kan Kiwa de aanvraag voor hernieuwde afgifte afwijzen, na een rappel aan de kandidaat. 7. ROL VAN DE INSPECTIE LEEFOMGEVING EN TRANSPORT - LUCHTVAART De Inspectie Leefomgeving en Transport zal in haar toezichtsprogramma op trainingsorganisaties, examinatoren en Kiwa toezien op de naleving van de eisen zoals gesteld in Part FCL en de interpretatie van deze voorschriften zoals in dit informatieblad is vermeld.

BIJLAGE III HERNIEUWDE AFGIFTE VERLOPEN INSTRUMENT-RATING 1. INTRODUCTIE De eisen voor de hernieuwde afgifte van een verlopen instrument-rating (IR) zijn vastgelegd in EU Verordening1178/2011 en het bijbehorend AMC- m a t e r i a a l . Doel van deze eisen is dat kandidaten op niveau worden aangeboden voor een bekwaamheidsproef (proficiency check). 2. VERLOPEN INSTRUMENT-RATING Wanneer een IR is verlopen zijn de eisen in FCL.625 en AMC1 FCL.625(c) van toepassing: FCL.625 IR — Validity, revalidation and renewal a) Validity. An IR shall be valid for 1 year. b) Revalidation.

1) An IR shall be revalidated within the 3 months immediately preceding the expiry date of the rating.

2) Applicants who fail to pass the relevant section of an IR proficiency check before the expiry date of the IR shall not exercise the IR privileges until they have passed the proficiency check.

c) Renewal. If an IR has expired, in order to renew their privileges applicants shall: 1) go through refresher training at an ATO to reach the level of proficiency needed to

pass the instrument element of the skill test in accordance with Appendix 9 to this Part; and

2) complete a proficiency check in accordance with Appendix 9 to this Part, in the relevant aircraft category.

d) If the IR has not been revalidated or renewed within the preceding 7 years, the holder will be required to pass again the IR theoretical knowledge examination and skill test.

AMC1 FCL.625(c) IR — Validity, revalidation and renewal RENEWAL OF INSTRUMENT RATING: REFRESHER TRAINING a) Paragraph (b)(1) of FCL.740 determines that if the instrument rating has lapsed, the applicant

shall go through refresher training at an ATO, to reach the level of proficiency needed to pass the instrument element of the skill test prescribed in Appendix 9 to Part-FCL. The amount of refresher training needed should be determined on a case-by- case basis by the ATO, taking into account the following factors: 1) the experience of the applicant. To determine this, the ATO should evaluate the pilot’s

log book, and, if necessary, conduct a test in an FSTD. 2) the amount of time lapsed since the expiry of the validity period of the rating. The

amount of training needed to reach the desired level of proficiency should increase with the time lapsed. In some cases, after evaluating the pilot, and when the time lapsed is very limited (less than 3 months), the ATO may even determine that no further refresher training is necessary. The following may be taken as guidance when determining the needs of the applicant: (i) expiry for a period shorter than 3 months: no supplementary requirements; (ii) expiry for longer than 3 months but shorter than 1 year: a minimum of one

training session; (iii) expiry for longer than 1 year but shorter than 7 years: a minimum of three training sessions;

(iv) expiry for longer than 7 years: the applicant should undergo the full training course for the issue of the IR.

b) Once the ATO has determined the needs of the applicant, it should develop an individual training program, which should be based on the initial training for the issue of instrument ratings and focus on the aspects where the applicant has shown the greatest needs.

c) After successful completion of the training, the ATO should give a certificate to the

applicant, to be submitted to the competent authority when applying for the renewal.

Om de IR weer geldig te maken dient de kandidaat zich te melden bij een ATO om zijn/haar niveau te laten beoordelen en refresher training te volgen. Zonder een beoordeling van het niveau van de kandidaat door een ATO en het volgen van een refresher training kan er geen bekwaamheidsproef worden afgelegd en kan geen hernieuwde IR worden afgegeven. 4. ROL VAN DE ATO Wanneer een kandidaat met een verlopen IR zich meldt dient de ATO het niveau van de kandidaat te evalueren en te beoordelen of de kandidaat aanvullende training nodig heeft. Beoordeling niveau kandidaat De ATO is in de eerste plaats verplicht om bij een verlopen IR het niveau van de kandidaat te beoordelen en vast te stellen of de kandidaat aanvullende training nodig heeft. Het doel hiervan is dat de kandidaat op niveau wordt aangeboden voor een bekwaamheidsproef. De mate van training welke nodig is hangt af van de ervaring van de kandidaat en de tijd die is verstreken sinds de verloopdatum van de IR en de meest recente vlieguren die zijn gemaakt. De ervaring van de kandidaat beoordeelt de ATO aan de hand van een evaluatie van het logboek. Hieruit blijkt onder andere wat de recente ervaring van de kandidaat is. Wanneer blijkt dat de kandidaat al enige maanden geen IFR heeft gevlogen kan aan de hand van de evaluatie van het logboek al worden geconcludeerd dat er mogelijkerwijs training moet worden gevolgd. De ATO kan besluiten een beoordelingsvlucht af te nemen van de kandidaat in een FSTD om zijn/haar niveau beter in te schatten. Hoewel niet expliciet in de regelgeving vermeld, wordt een beoordelingsvlucht in een geschikt trainingsvliegtuig van de ATO ook geaccepteerd. Daarnaast dient de ATO bij de beoordeling van het niveau van de kandidaat en de te volgen refresher training rekening te houden met de termijn dat de bevoegdverklaring van de kandidaat is verlopen. Naarmate meer tijd is verstreken sinds het verlopen van de bevoegdverklaring zal de kandidaat meerdere trainingssessies moeten volgen om op het gewenste niveau te komen (uiteraard afhankelijk van het niveau en de ervaring van de kandidaat). Als richtlijn kan worden aangehouden dat voor een kandidaat waarvan de IR:

minder dan 3 maanden is verlopen mogelijk geen aanvullende eisen gelden;

meer dan 3 maanden maar minder dan een 1 jaar is verlopen tenminste één trainingssessies

nodig zal zijn.

meer dan 1 jaar maar minder dan 7 jaar is verlopen tenminste drie trainingssessies nodig zullen

zijn.

meer dan 7 jaar is verlopen de gehele training (zowel theorie als praktijk) voor de eerste afgifte van

de betreffende IR overnieuw moet worden gevolgd. Bovenstaande uitgangspunten gelden als richtlijn. Dit vereist een goede evaluatie van de kandidaat door de ATO. De beoordeling die de ATO heeft uitgevoerd moet zij goed kunnen onderbouwen.

Trainingsprogramma Op basis van de beoordeling van de kandidaat dient de ATO in alle gevallen een (individueel) trainingsprogramma op te stellen. Dit trainingsprogramma moet op grond van AMC1 FCL.625(c) zijn gebaseerd op de IR syllabus van de ATO (of de type rating syllabus in geval van een ATO welke een hernieuwde afgifte van een ME-IR verzorgt in combinatie met een type rating). Het individueel trainingsprogramma geeft inzicht in hoe de kandidaat wordt getraind, welke trainingsessies er worden uitgevoerd en welke oefeningen minimaal aan bod komen. In het trainingsplan dient de nadruk te worden gelegd op de items waarin de kandidaat de meeste training nodig heeft. Hieruit kan worden afgeleid dat er voor het begin van de training en voor het opstellen van een trainingsplan een goede beoordeling moet plaatsvinden om vast te stellen waar de betreffende kandidaat het meeste op moet worden getraind. De training moet worden aangeboden op een relevant vliegtuig of FSTD dat voldoet aan de gestelde eisen. Het betreffende vliegtuig en/of FSTD staat op de lijst met trainingsvliegtuigen en FSTD’s van de ATO vermeld. De instructeurs die de training aanbieden zijn verbonden aan de ATO en staan op de instructeurlijst van de ATO vermeld. Certificaat

Nadat de kandidaat de training succesvol heeft afgerond dient de ATO een certificaat9 te verstrekken. In dit certificaat verklaart de ATO dat de kandidaat de training succesvol heeft gevolgd en dat de kandidaat op het vereiste niveau is voor de bekwaamheidsproef. Dit certificaat moet ook worden verstrekt wanneer de kandidaat geen refresher training heeft gevolgd. In dit geval wordt in de beschrijving van het trainingsprogramma aangegeven dat de kandidaat geen aanvullende training nodig heeft gehad. ROL VAN KIWA Nadat Kiwa de stukken heeft ontvangen beoordeelt zij of alle benodigde documenten aanwezig zijn en registreert deze in het dossier van de kandidaat. Wanneer Kiwa hierbij constateert dat niet conform de voorschriften is gehandeld kan Kiwa de aanvraag voor hernieuwde afgifte afwijzen, na een rappel aan de kandidaat. 9 Onder certificaat wordt verstaan een verklaring of ander schriftelijk bewijs wat de benodigde elementen bevat. Nederland heeft de Europese Commissie, het Europees Agentschap voor de Veiligheid van de Luchtvaart en de nationale luchtvaartautoriteiten per brief medegedeeld dat zij besloten heeft de volgende, door de Europese Commissie bij beschikking nr. 2014/425/EU goedgekeurde, afwijkingsmogelijkheden van Verordening (EU) nr. 1178/2011 te zullen toepassen. Desbetreffende artikel FCL.625, punten c en d, van bijlage I, van Verordening (EU) nr. 1178/2011 Afwijkingsmogelijkheden In afwijking van het bepaalde onder de punten c) en d) van FCL.625 „IR – Geldig- heid, verlenging en hernieuwde afgifte” van bijlage I (deel-FCL) bij Verordening (EU) nr. 1178/2011, mag worden toegestaan dat houders van deel-FCL- bevoegdheidsbewijzen die recent hebben gevlogen met een geldige instrumentbe- voegdverklaring op een bevoegdheidsbewijs van een derde land dat is afgegeven overeenkomstig ICAO bijlage I, worden geacht te voldoen aan de criteria voor hernieuwde afgifte van instrumentbevoegdverklaringen van deel-FCL, zoals uiteengezet in punt c) van FCL.625, door te voldoen aan de criteria voor verlenging die zijn uiteengezet in punt b) van FCL.625. Bovendien mag worden toegestaan dat deze houders van deel-FCL-bevoegdheidsbewijzen die houder zijn van een instrumentbevoegdverklaring van een derde land die niet meer geldig is maar gedurende de voorgaande 7 jaar werd verlengd of hernieuwd afgegeven, alleen hoeven te voldoen aan de criteria voor hernieuwde afgifte voor de deel-FCL- instrumentbevoegdverklaring, zoals uiteengezet in punt c) van FCL.625, zonder dat zij opnieuw hoeven te slagen voor het in punt d) van FCL.625 vermelde theorie- examen. Desbetreffende artikel FCL.740, punt b, van bijlage I, van Verordening (EU) nr. 1178/2011 Afwijkingsmogelijkheden In afwijking van punt b) van FCL.740 „Geldigheid en hernieuwde afgifte van klasse- en typebevoegdverklaring” van bijlage I (deel-FCL) bij Verordening (EU) nr. 1178/2011, mag worden toegestaan dat houders van deel- FCL- bevoegdheidsbewijzen die recent hebben gevlogen met een geldige gelijkwaardige klasse- of typebevoegdverklaring op een bevoegdheidsbewijs van een derde land dat is afgegeven overeenkomstig ICAO bijlage 1, geacht worden te voldoen aan de criteria voor hernieuwde afgifte door te slagen voor de bekwaamheidsproef zonder dat zij een aanvullende herhalingstraining hoeven te volgen.

Afwijkingsvoorwaarden Deze afwijking geldt voor houders van deel-FCL-bevoegdheidsbewijzen met een klasse- of typebevoegdverklaring die hernieuwd moet worden afgegeven. Als de houder van een bevoegdheidsbewijs ook houder is van een bevoegdheidsbewijs van een derde land met een geldige bevoegdverklaring voor dezelfde klasse luchtvaartuigen of hetzelfde type luchtvaartuig, moet de houder van het deel-FCL- bevoegdheidsbewijs alleen slagen in een bekwaamheidsproef voor de hernieuwde afgifte van de klasse- of typebevoegdverklaring, maar hoeft hij geen herhalingstrai- ning te volgen bij een erkende opleidingsorganisatie. Desbetreffende artikel FCL.740a, punt b, onder punt 1, onder punt ii, van bijlage I, van

Verordening (EU) nr. 1178/2011 Afwijkingsmogelijkheden In afwijking van punt ii) van punt FCL.740.A, onder b), punt 1) „Verlenging van klasse- en typebevoegdverklaringen – Vleugelvliegtuigen” van bijlage I (deel-FCL) bij Verordening (EU) nr. 1178/2011, mag worden toegestaan dat houders van bevoegdheidsbewijzen als piloot een klassebevoegdverklaring voor eenmotorige zuigervliegtuigen of zelfstartende gemotoriseerde zweefvliegtuigen verlengen zonder de opleidingsvlucht met een vlieginstructeur of een instructeur voor klassebevoegdverklaring te hebben afgelegd, voor zover de houder van het bevoegdheidsbewijs in de twaalf maanden voorafgaande aan het verstrijken van de bevoegdverklaring: a)geslaagd is voor een vaardigheidstest of bekwaamheids- proef voor om het even welke klasse-, type- of instrumentbevoegdverklaring of bevoegdverklaring voor het vliegen in bergachtige gebieden die is vermeld op het bevoegdheidsbewijs als piloot; of b)geslaagd is voor een vakbekwaamheidsbeoor- deling voor om het even welk certificaat als vlieginstructeur, instructeur voor klassebevoegdverklaring of instructeur voor instrumentbevoegdverklaring dat op het bevoegdheidsbewijs als piloot is vermeld. Afwijkingsvoorwaarden Deze afwijking geldt voor de houders van deel-FCL-bevoegdheidsbewijzen met een bevoegdverklaring voor eenmotorige zuigervliegtuigen of zelfstartende gemotori- seerde zweefvliegtuigen. De opleidingsvlucht met een instructeur mag alleen worden vervangen als de houder een vaardigheidstest, bekwaamheidsproef of vakbekwaamheidsbeoordeling voor een bevoegdverklaring of bevoegdheidsbewijs voor een vliegtuig heeft voltooid. B. Helicopters Credits shall be granted only when the holder is revalidating IR privileges for single-engine and single-pilot multi- engine helicopters as appropriate.

When a proficiency check, including IR, is performed and the holder has a valid:

(c) Endorsement of license by examiners. Before specifically authorizing certain examiners to revalidate or renew ratings or certificates, the competent authority shall develop appropriate procedures.

(d) Endorsement of license by instructors. Before specifically authorizing certain instructors to revalidate a single-engine piston or TMG class rating, the competent authority shall develop appropriate procedures.

ARA.FCL.215 Validity period (a) When issuing or renewing a rating or certificate, the competent authority or, in the case of

renewal, an examiner specifically authorized by the competent authority, shall extend the validity period until the end of the relevant month.

(b) When revalidating a rating, an instructor or an examiner certificate, the competent authority, or an examiner specifically authorized by the competent authority, shall extend the validity period of the rating or certificate until the end of the relevant month.

(c) The competent authority, or an examiner specifically authorized for that purpose by the competent authority, shall enter the expiry date on the license or the certificate.

(d) The competent authority may develop procedures to allow privileges to be exercised by the license or certificate holder for a maximum period of 8 weeks after successful completion of the applicable examination(s), pending the endorsement on the license or certificate.

ARA.FCL.220 Procedure for the re-issue of a pilot license (a) The competent authority shall re-issue a license whenever necessary for administrative reasons

and: (1) after initial issue of a rating; or (2) when paragraph XII of the license established in Appendix I to this Part is completed and no

further spaces remain. (b) Only valid ratings and certificates shall be transferred to the new license document.

ARA.FCL.250 Limitation, suspension or revocation of licenses, ratings and certificates (a) The competent authority shall limit, suspend or revoke as applicable a pilot license and

associated ratings or certificates in accordance with ARA.GEN.355 in, but not limited to, the following circumstances: (1) obtaining the pilot license, rating or certificate by falsification of submitted documentary

evidence; (2) falsification of the logbook and license or certificate records; (3) the license holder no longer complies with the applicable requirements of Part-FCL; (4) exercising the privileges of a license, rating or certificate when adversely affected by

alcohol or drugs; (5) non-compliance with the applicable operational requirements; (6) evidence of malpractice or fraudulent use of the certificate; or (7) unacceptable performance in any phase of the flight examiner’s duties or

responsibilities. (b) The competent authority may also limit, suspend or revoke a license, rating or certificate upon

the written request of the license or certificate holder. (c) All skill tests, proficiency checks or assessments of competence conducted during suspension

or after the revocation of an examiner’s certificate will be invalid.

Invulinstructie brevet document Naar aanleiding van signalen uit het veld en reacties op de nieuwsbrief van juli 2015 over onduidelijkheid bij het invullen van het brevet document en vooral het verlengen van de Instrument Rating, is er door ILT in overleg met KIWA en het NET-P gezocht naar een manier die duidelijker en eenduidig moet zijn en tot

minder verwarring leidt. Ook blijkt er onduidelijkheid over hoe om te gaan met typebevoegdverklaring

voor luchtvaarttuigtypen waarmee zowel SP als MP vluchten kunnen worden uitgevoerd. Binnen de EU hebben lidstaten een beperkte vrijheid om invulling te geven aan de lay-out en het invullen van een brevetdocument. Nederland heeft er voor gekozen om de Instrument Rating (IR) op het brevetdocument aan te vullen met eventuele Remarks en Restrictions. Bijv. SE en/of ME. In de toekomst zal dit meer toegespitst gaan worden op SP en/of MP. Systematiek: 1 Verschillende Ratings worden altijd op een aparte regel geschreven. Uitsluitend bij die typeratings

waarin er zowel de mogelijkheid bestaat om ze SP als MP te vliegen wordt dit op de zelfde regel achter de typerating aangegeven

ADDITIONAL ORO.FC.230, Recurrent training and checking (a) Each flight crew member shall complete recurrent training and checking relevant to the type or

variant of aircraft on which they operate. (b) Operator proficiency check

(1) Each flight crew member shall complete operator proficiency checks as part of the normal crew complement to demonstrate competence in carrying out normal, abnormal and emergency procedures.

(2) When the flight crew member will be required to operate under IFR, the operator proficiency check shall be conducted without external visual reference, as appropriate.

(3) The validity period of the operator proficiency check shall be six calendar months. For operations under VFR by day of performance class B aeroplanes conducted during seasons not longer than eight consecutive months, one operator proficiency check shall be sufficient. The proficiency check shall be undertaken before commencing commercial air transport operations.

(4) The flight crew member involved in operations by day and over routes navigated by reference to visual landmarks with an other-than-complex motor-powered helicopter may complete the operator proficiency check in only one of the relevant types held. The operator proficiency check shall be performed each time on the type least recently used for the proficiency check. The relevant helicopter types that may be grouped for the purpose of the operator proficiency check shall be contained in the operations manual.

(5) Notwithstanding ORO.FC.145(a)(2), for operations of other-than-complex motor- powered helicopters by day and over routes navigated by reference to visual landmarks and performance class B aeroplanes, the check may be conducted by a suitably qualified commander nominated by the operator, trained in CRM concepts and the assessment of CRM skills. The operator shall inform the competent authority about the persons nominated.

(c) Line check (1) Each flight crew member shall complete a line check on the aircraft to demonstrate

competence in carrying out normal line operations described in the operations manual. The validity period of the line check shall be 12 calendar months.

(2) Notwithstanding ORO.FC.145(a)(2), line checks may be conducted by a suitably qualified commander nominated by the operator, trained in CRM concepts and the assessment of CRM skills.

(d) Emergency and safety equipment training and checking. Each flight crew member shall complete training and checking on the location and use of all emergency and safety equipment carried. The validity period of an emergency and safety equipment check shall be 12 calendar months.

(e) CRM training (1) Elements of CRM shall be integrated into all appropriate phases of the recurrent training.

(2) Each flight crew member shall undergo specific modular CRM training. All major

topics of CRM training shall be covered by distributing modular training sessions as

evenly as possible over each three-year period. (f) Each flight crew member shall undergo ground training and flight training in an FSTD or an

aircraft, or a combination of FSTD and aircraft training, at least every 12 calendar months. (g) The validity periods mentioned in (b)(3), (c) and (d) shall be counted from the end of the month

when the check was taken. (h) When the training or checks required above are undertaken within the last three months of the

validity period, the new validity period shall be counted from the original expiry date. AMC1 ORO.FC.230 Recurrent training and checking (shortened) (b) Recurrent checking Recurrent checking should comprise the following: (

Where applicable, operator proficiency checks should include the following manoeuvres as pilot flying:

(A) rejected take-off when an FSTD is available to represent that specific aeroplane, otherwise touch drills only;

(B) take-off with engine failure between V1 and V2 (take-off safety speed) or, if carried out in an aeroplane, at a safe speed above V2;

(C) precision instrument approach to minima with, in the case of multiengine aeroplanes, one-engine-inoperative;

(D) non-precision approach to minima; (E) missed approach on instruments from minima with, in the case of multi-engined aeroplanes,

one-engine-inoperative; (F) landing with one-engine-inoperative. For single-engine aeroplanes a practice forced landing

is required. (ii) Helicopters

(A) Where applicable, operator proficiency checks should include the following abnormal/emergency procedures:

- engine fire; - fuselage fire; - emergency operation of under carriage; - fuel dumping; - engine failure and relight; - hydraulic failure; - electrical failure; - engine failure during take-off before decision point; - engine failure during take-off after decision point; - engine failure during landing before decision point; - engine failure during landing after decision point; - flight and engine control system malfunctions; - recovery from unusual attitudes; - landing with one or more engine(s) inoperative; - instrument meteorological conditions (IMC) autorotation techniques; - autorotation to a designated area; - pilot incapacitation; - directional control failures and malfunctions. (B) For pilots required to engage in IFR operations, proficiency checks include the

following additional abnormal/emergency procedures: - precision instrument approach to minima; - go-around on instruments from minima with, in the case of multi-engined

helicopters, a simulated failure of one engine; - non-precision approach to minima; - in the case of multi-engined helicopters, a simulated failure of one engine to be

included in either the precision or non-precision approach to minima; - landing with a simulated failure of one or more engines; - where appropriate to the helicopter type, approach with flight control system/flight

director system malfunctions, flight instrument and navigation equipment failures. (C) Before a flight crew member without a valid instrument rating is allowed to operate

in VMC at night, he/she should be required to undergo a proficiency check at night. Thereafter, each second proficiency check should be conducted at night.

(iii) Once every 12 months the checks prescribed in (b)(1)(ii)(A) may be combined with the proficiency check for revalidation or renewal of the aircraft type rating.

(iv) Operator proficiency checks should be conducted by a type rating examiner (TRE) or a synthetic flight examiner (SFE), as applicable.

Language Proficiency Endorsement (LPE) Informatieblad Beperkte Language Assessment Body Op 8 april 2014 is EU Verordening 1178/2011 in werking getreden. In deze Verordening zijn de criteria aangaande de ‘Language Proficiency Endorsement’ (LPE) vastgelegd. Met de invoering van deze Verordening is er een wijziging opgetreden met betrekking tot het examineren van de taalvaardigheid zoals deze in Nederland wordt toegepast. 1. Inleiding In Nederland kunnen taalvaardigheidexamens worden afgenomen door de volgende taalbeoordelings-instanties, ook wel language assessment bodies (LAB’s): 1. Een volwaardige LAB (deze instantie is bevoegd tot het afnemen van initiële evaluaties en re-

evaluaties in alle beoordelingsniveaus); 2. Een beperkte LAB (deze instantie is bevoegd tot het afnemen van een re-evaluatie op

beoordelingsniveau 4). De voorwaarde is dat deze organisatie ook een Approved Training Organisation (ATO) en/of houder van een Air Operator Certificate (AOC) is.

Dit informatieblad is van toepassing op de beperkte LAB bij een ATO en/of houder van een AOC. 2. Beoordeling taalvaardigheid De beoordeling voor de verlenging van de taalvaardigheid van houders van een bewijs van bevoegdheid kan worden verricht door een ATO en/of houder van een AOC. Deze organisatie moet dan wel door de Inspectie Leefomgeving en Transport – Luchtvaart (ILT) zijn erkend voor het uitvoeren van taalbeoordelingen (een beperkte LAB) en geïmplementeerd zijn binnen een goedgekeurd kwaliteitssysteem. De organisatie dient hierbij te voldoen aan de criteria gesteld in FCL.055 (zie bijlage FCL.055 Language proficiency) en het bijbehorende AMC materiaal. De taalbeoordeling mag worden uitgevoerd tijdens één van de verschillende bestaande toetsings- of trainingsactiviteiten, zoals afgifte van een bewijs van bevoegdheid, afgifte-, verlenging- of hernieuwde afgifte van een bevoegdverklaring, lijntraining, lijnchecks van de operator of bekwaamheidsproeven, zie AMC1 FCL.055 (g). Door een beperkte LAB kan alleen een verlenging worden afgegeven van een level 4. De beoordeling staat in beginsel los van een volwaardige LAB. Voor het verkrijgen van een ander niveau dient de kandidaat zich te wenden tot een volwaardige LAB. 3. Taalbeoordelaar beperkte LAB De taalbeoordeling moet worden afgenomen door een taalbeoordelaar die hiervoor een taalvaardigheidsexamen heeft ondergaan. Een taalbeoordelaar bij een beperkte LAB moet een examinator zijn, tenminste in het bezit van een LPE level 5. De examinator mag een level 4 verlengen. De beperkte LAB dient zeker te stellen dat een examinator voor aanstelling succesvol de initial training heeft doorlopen, als opgenomen in handboeken van de LAB. De beperkte LAB dient zeker te stellen dat de examinator jaarlijks succesvol een herhalingstraining doorloopt, als opgenomen in de handboeken van de LAB. 4. Afwijzende beoordeling door beperkte LAB Indien de desbetreffende examinator constateert dat de kandidaat niet aan het minimum niveau van level 4 voldoet, dan zakt de kandidaat. Dit heeft tevens als consequentie dat de betrokken vlieger de RT bevoegdverklaring niet mag uitoefenen. De betrokken vlieger kan dan alleen nog maar gebruik maken van ongecontroleerd luchtruim.

Wanneer een examinator na het afnemen van een check twijfelt aan het niveau van taalvaardigheid van de kandidaat of wanneer de kandidaat het oneens is met de beoordeling van de examinator, dan moet de examinator de kandidaat doorverwijzen naar een door de ILT erkende volwaardige LAB. Deze LAB’s zijn, anders dan examinatoren bij een beperkte LAB, specifiek ingericht op het beoordelen van taalvaardigheid. Dergelijke gespecialiseerde instituten kunnen de technische accuratesse leveren die in sommige gevallen noodzakelijk kan zijn. Administratie Uit AMC1 FCL.055 volgt dat er door de beperkte LAB een degelijke administratie en documentatie moet worden bijgehouden met daarin de procedures voor het afnemen en documenteren van taalvaardigheidsexamens. De procedures, administratie en documentatie en de kaders waarbinnen de examinator handelt inzake de taalbeoordeling, moeten worden beschreven in de operationele handboeken en trainingsprogramma's. De wijzigingen op de handboeken en trainingsprogramma's worden ter goedkeuring bij ILT ingediend. In de ingediende trainingsprogramma's dient te worden vermeld dat het taalvaardigheidsexamen is opgenomen. De procedure voor de aanvraag voor een beperkte LAB, alsmede de wijzigingen op de handboeken en trainingprogramma’s is te raadplegen op www.ilent.nl. 6. Annex FCL.055 Language proficiency 2.6 General. Aeroplane, helicopter, powered-lift and airship pilots required to use the radio telephone

shall not exercise the privileges of their licenses and ratings unless they have a language proficiency endorsement on their license in either English or the language used for radio communications involved in the flight. The endorsement shall indicate the language, the proficiency level and the validity date.

2.7 The applicant for a language proficiency endorsement shall demonstrate, in accordance with

Appendix 2 to this Part, at least an operational level of language proficiency both in the use of phraseologies and plain language. To do so, the applicant shall demonstrate the ability to: (1) communicate effectively in voice-only and in face-to-face situations; (2) communicate on common and work-related topics with accuracy and clarity; (3) use appropriate communicative strategies to exchange messages and to recognise and

resolve misunderstandings in a general or work-related context; (4) handle successfully the linguistic challenges presented by a complication or unexpected turn of

events which occurs within the context of a routine work situation or communicative task with which they are otherwise familiar; and

(5) use a dialect or accent which is intelligible to the aeronautical community. 2.8 Except for pilots who have demonstrated language proficiency at an expert level, in accordance

with Appendix 2 to this Part, the language proficiency endorsement shall be re-evaluated every: (1) 4 years, if the level demonstrated is operational level; or (2) 6 years, if the level demonstrated is extended level.

2.9 Specific requirements for holders of an instrument rating (IR). Without prejudice to the paragraphs

above, holders of an IR shall have demonstrated the ability to use the English language at a level that allows them to: (1) understand all the information relevant to the accomplishment of all phases of a flight,

including flight preparation; (2) use radio telephony in all phases of flight, including emergency situations; (3) communicate with other crew members during all phases of flight, including flight

preparation. 2.10 The demonstration of language proficiency and of the use of English for IR holders shall be

Protection of personal data EU GDPR On 4 May 2016, the official texts of the Regulation and the Directive have been published in the EU Official Journal in all the official languages. While the Regulation will enter into force on 24 May 2016, it shall apply from 25 May 2018. The Directive enters into force on 5 May 2016 and EU Member States have to transpose it into their national law by 6 May 2018. The objective of this new set of rules is to give citizens back control over of their personal data, and to simplify the regulatory environment for business. The data protection reform is a key enabler of the Digital Single Market which the Commission has prioritised. The reform will allow European citizens and businesses to fully benefit from the digital economy. Whenever you open a bank account, join a social networking website or book a flight online, you hand over vital personal information such as your name, address, and credit card number. What happens to this data? Could it fall into the wrong hands? What rights do you have regarding your personal information? Under EU law, personal data can only be gathered legally under strict conditions, for a legitimate purpose. Furthermore, persons or organisations which collect and manage your personal information must protect it from misuse and must respect certain rights of the data owners which are guaranteed by EU law. Every day within the EU, businesses, public authorities and individuals transfer vast amounts of personal data across borders. Conflicting data protection rules in different countries would disrupt international exchanges. Individuals might also be unwilling to transfer personal data abroad if they were uncertain about the level of protection in other countries. Therefore, common EU rules have been established to ensure that your personal data enjoys a high standard of protection everywhere in the EU. You have the right to complain and obtain redress if your data is misused anywhere within the EU. The EU's Data Protection Directive also foresees specific rules for the transfer of personal data outside the EU to ensure the best possible protection of your data when it is exported abroad. The Directive aims to protect the rights and freedoms of persons with respect to the processing of personal data by laying down guidelines determining when this processing is lawful. Guidelines: - Personal data must be collected for specified, explicit and legitimate purposes. - Personal data must be processed fairly and lawfully. - Personal data must be accurate and, where necessary, kept up to date. - Personal data may be processed only if the data subject has unambiguously given his/her consent. - It is forbidden to process personal data revealing racial or ethnic origin, political opinions, religious or

philosophical beliefs, trade-union membership, etc - The data subject has the right to object, on legitimate grounds, to the processing of data relating to

him/her. - Personal data must not be transferred to other countries without adequate protection. - Personal information must be protected against accidental or unlawful destruction or accidental loss,

alteration, unauthorized disclosure or access.

Insurance and Liability The CAA-NL is not liable for any personal harm, damages or other consequences originating from the conduct of tests, checks or AoC’s. The CAA-NL does not provide any insurance during the tests, checks or AoC’s. These are the responsibility of the examiner or the PIC. The examiner is fully responsible for the safety during the test or check, in the simulator or when acting as PIC in an aircraft.

Disagreement and complaints Any comment on, complaint about or disagreement with, an examiners evaluation, assessment, behavior or method of conducting tests, checks or AoC’s shall be reported to the authority that issued the examiners certificate..

New training standards for flying (DTO) In EASA Opinion 11/2016, the Agency proposes to introduce a new regulatory framework which requires training organisations for Light Aircraft Pilot Licence-LAPL, Private Pilot Licence-PPL, Sailplane Pilot Licence-SPL and Balloon Pilot Licence-BPL not to seek prior approval but to simply declare its training activities to the competent authority. This new ‘declared training organisation’ (DTO) also benefits from simplified organisational and oversight requirements, all in all granting extensive alleviations to GA training providers. A DTO is considered to be a single organisation staffed, equipped and operated in a suitable environment offering flight training, synthetic flight instruction and/or theoretical knowledge instruction.

A DTO may conduct more than one kind of training course providing these fall within the scope listed in Table 1. However, the CAA will require assurances that satisfactory arrangements are put in place to conduct a combination of courses.
