P.U.C. et. al. v. The York Water Company Docket Number R-2012-2336379 On November 19, 2013, my office received two letters from Mr. Larry L. Wolfe, a party of record in the above captioned case. One letter dated November 18, 2013, was addressed to the Chairman and Commissioners of the Public Utility Commission, and a second letter, dated November 18, 2013, was addressed to both Administrative Law Judges Kandace Melillo and Joel Cheskis, the presiding officers in this case. Both letters address the proposed settlement in the York Water Company’s rate increase request. Mr. Wolfe also separately filed a Brief and a Reply Brief, both of which have been added to the record. Since this case is still pending the issuance of a decision by the presiding officers, and a subsequent final decision by the Commission, Section 334(c) of the Pennsylvania Public Utility Code prohibits any response to Mr. Wolfe’s letters due to the statutory prohibition on ex-parte communications. 66 Pa. C.S. Section 334(c). Although a review of the letters reveals that Mr. Wolfe appears to have sent a copy of each letter to all of the parties of record, no certificate of service accompanied his letters. Therefore, the Commission is serving both letters on all the parties of record in this matter, and I am placing the letters on the record at this docket number. Sincerely,
