Acquisition of property located at 137 and 139 Whitburn Crescent, in the City of Toronto, under the "Greenlands Acquisition Project for 2016-2020", Flood Plain and Conservation Component, Humber River watershed.

CARRIED BACKGROUND Resolution #A161/15 at Authority Meeting #8/15 held on September 25, 2015, approved the Greenlands Acquisition Project for 2016-2020. Following initial review by TRCA inspectors of the damage from the July 8, 2013 storm, 27 sites were recommended for preliminary slope stability and erosion risk assessments by a third party engineering firm, which was completed by Terraprobe Inc. Following these preliminary geotechnical reviews, 24 properties which included 137 and 139 Whitburn Crescent were recommended for detailed geotechnical assessments, which were also completed by Terraprobe.

As the detailed geotechnical assessments for 137 and 139 Whitburn Crescent confirmed long-term impact to the dwellings, the approved 2014 work plan included the implementation of erosion control works at these properties, subject to approval from the City of Toronto and confirmation of available funding. The works at 137 and 139 Whitburn Crescent were completed in spring of 2016 and included erosion control design development and implementation, negotiation of erosion agreements, fence installation and restoration plantings. The TRCA funding policy for works carried out on private lands, stipulates that benefiting landowners are required to contribute to the cost of the project, either financially, or through the transfer of lands. The owners at 137 and 139 Whitburn Crescent have agreed to convey lands and permanent easements to TRCA as their contribution toward the costs of the project. Attached is a plan showing the location of the subject lands. RATIONALE The subject properties are required for the construction of the Whitburn Crescent Erosion Control Project. TAXES AND MAINTENANCE The lands proposed to be acquired at 137 and 139 Whitburn Crescent will be turned over to the City of Toronto under the terms of the existing management agreement. Through the review of the Zoning By-law Amendment, TRCA staff established the limits of the open space land comprised of valleylands.

TAXES AND MAINTENANCE Based on TRCA's preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, staff estimates 75% of the subject property should be eligible for a tax exemption. After the tax exemption, taxes for 2017 are estimated to be approximately $500 annually. It is expected that the subject parcel of land will not significantly impact TRCA’s maintenance costs at this location. BACKGROUND As part of the Site Plan Approval process for the development of TRCA’s Bolton Camp property, the Regional Municipality of Peel has imposed a condition that the conveyance of certain lands is required for the future widening of Regional Road 9, locally known as King Street East in the hamlet of Bolton. The subject TRCA lands are located north of the intersection of Sneath Road and King Street East, west of the Caledon-King Towline. The Regional Municipality of Peel requires a 0.3 metre wide strip of land across the entire frontage of the TRCA property at this location for the future road widening. The subject lands form part of a larger acreage acquired by TRCA from Hi-Lands of Bolton Corp. on July 14, 2011, under the “Greenlands Acquisition Project for 2006-2010”, Flood Plain and Conservation Component, Humber River watershed. The subject lands required by the Regional Municipality of Peel are located within the Regulated Area of the Humber River. A permit application pursuant to Ontario Regulation 166/06, as amended, will be brought forward to a future Executive Committee Meeting prior to commencement of construction. CARRIED BACKGROUND Tridel Inc. approached Toronto and Region Conservation Authority on behalf of The Residences at Argento Inc. to negotiate a permanent easement. The purpose of the easement is to allow for the permanent (buried) installation, operation and maintenance of a 200mm pipe that is currently lying above ground. TRCA has temporarily permitted the above ground pipe location.

The pipe carries groundwater, originating from pumping wells within the right-of-way on Graydon Hall Drive adjacent to the building at 18 Graydon Hall Drive, across TRCA lands, to an existing outfall at the Don River. The well discharge system is to relieve the groundwater and artesian aquifer pressure on the building. The Ministry of the Environment and Climate Change has approved the discharge of this groundwater into the Don River. The proposed pipe is required because Toronto Water has indicated that they will not allow the groundwater to be discharged into the existing city storm sewer system because of concerns with cost, maintenance and volumes.

The subject property was acquired from Municipality of Metropolitan Toronto on July 3, 1980, under the Don River Flood Plain Land Component of the Land Acquisition Project.

Plantings All lands disturbed by construction will be stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material in accordance with existing TRCA landscaping guidelines. A landscape plan will be prepared as part of the permit application submission.

A sketch illustrating the location of the permanent easement is attached. FINANCIAL DETAILS The easement compensation is based on market value as determined by D. Bottero & Associates Limited. The Residences at Argento Inc. has agreed to assume all legal, survey and other costs involved in completing this transaction. Funds obtained from this permanent easement be utilized for the purchase of priority properties under the Greenlands Acquisition Project 2016-2020 and for the Long Term Office Accommodation Project. NEW BUSINESS RES.#B113/16 – BLACK CREEK BIKE PATH Moved by: Maria Augimeri Seconded by: Ron Moeser THAT Toronto and Region Conservation Authority (TRCA) staff be requested to conduct a study and report back by April 2017 to determine the potential of installing a bike path along Black Creek from Shoreham Drive to Steeles Avenue West on lands owned and managed by TRCA. CARRIED
