7 Q Can you r e c a l l when you would have been coming back
8 t o t h e S t a t e s a t t h a t time? And I'm assuming t h i s i s sometime
9 i n t h e summer o f 2007?
10 A Yeah. I came back when I always do i n J u l y , August,
11 g e n e r a l l y . I t may have been August, September t h a t y e a r .
12 Q Did you a c t u a l l y go t o c o u r t w i t h him, or was your
13 i n v o l v e m e n t g o i n g t o t h e lawyer's o f f i c e ?
14 A I was o n l y g o i n g t o t h e lawyer's o f f i c e . He g ot t h e
15 DUI, and my w i f e g o t him out of j a i l . I was w i t h her but she
16 took t he s t e p s . She knew what t o do. We p i c k e d him up,
17 b r o u g h t him home, and t h e next day we went and saw Mr. B e r r y
18 at t h e lawyer's o f f i c e .
19 Q Had you ever g o t t e n him out of j a i l ?
2 0 A No.
21 Q So you go see t h e law y e r and the lawyer g i v e s you
22 these two o p t i o n s . Did t h e lawyer e x p l a i n a n y t h i n g t o you o r
2 3 t o y o u r son about what t h e F l o r i d a program was l i k e ?
24 A He s a i d i t was a program c a l l e d t h e Brid g e and i t
25 was g e n e r a l l y f o r -- i t was a p l a c e of l a s t r e s o r t . And i f

2 depending on you performance i n the B r i d g e , c o u l d be dropped.

5 dropped. But he t a l k e d about t h e B r i d g e as b e i n g an o p t i o n o f *

13 A I c a l l e d L i s a Moody, a t h i s d i r e c t i o n . She's t h e
14 a d m i n i s t r a t o r of t h e F l o r i d a Drug Court. I c a l l e d her and she ; i
15 t o l d me e x a c t l y what I had t o do i n o r d e r t o comply w i t h t h i s f
16 and I too k her guidance which was v e r y , v e r y c l e a r . I t had t o [
17 be a six-month program. I t had t o be an i n p a t i e n t '
18 r e h a b i l i t a t i o n t r e a t m e n t f a c i l i t y t h a t was a c c r e d i t e d i n t h e J
19 s t a t e of F l o r i d a t h a t was s t a f f e d w i t h c e r t i f i e d c o u n s e l o r s !
20 and p r o f e s s i o n a l s t a f f and i t had t o be accepted by t h e | i
21 F l o r i d a Drug Court. I th e n went on t h e I n t e r n e t and d i d v e r y !
22 e l e m e n t a r y r e s e a r c h w i t h words l i k e drug r e h a b i l i t a t i o n i n ;
23 F l o r i d a , i n p a t i e n t s i x months. I , of course, came up w i t h \
24 hundreds. I s e l e c t e d some t h a t were n e a r e s t t o me and t h a t I '
25 f e l t met t h e c r i t e r i a . I s t a r t e d c a l l i n g them and 100 p e r c e n t I

1 of them d i d not meet t h e c r i t e r i a f o r s i x months, i n p a t i e n t
2 r e h a b i l i t a t i o n . 100 p e r c e n t o f them d i d n ' t because none o f
3 them were s i x months i n l e n g t h . Even one of them was a
4 Narconon of F l o r i d a . I n D e s t i n , F l o r i d a t h e y have a program
5 b u t i t ' s o n l y t h r e e months i n l e n g t h . I t h e n s t a r t e d - - As I
6 was t a l k i n g t o every one of these people, I e x p l a i n e d my
7 s i t u a t i o n and t h e y s a i d t h e r e were v e r y few, i f any, s i x month
8 l o n g drug programs. I kept a s k i n g everybody and e v e n t u a l l y I
9 got one person t h a t s a i d t o t r y Narconon of Georgia t h e y do
10 have s i x month programs or t h e y can b u i l d p e r s o n a l programs
11 t h a t would be f o r s i x months and I s h o u l d c a l l them.
12 U l t i m a t e l y , I d i d and t h a t ' s how we ended up w i t h Narconon.
13 Q Now, t h e c r i t e r i a t h a t L i s a Moody gave you, d i d she
14 g i v e you those o r a l l y o r i n w r i t i n g ?
15 A O r a l l y . I o n l y spoke t o her on t h e phone.
16 Q D i d she ever send you i n w r i t i n g any k i n d o f paper
17 or s t a t u t e o r d i r e c t i o n as t o what t h e r e q u i r e m e n t s had t o be?
18 A She d i d not send t h a t t o me.
19 Q D i d she ever t e l l you how i t would be determined
20 whether or n o t a f a c i l i t y you might p i c k out would be judged
21 as t o whether i t met t h e c r i t e r i a o r not?
22 A She t o l d me t h a t i f I found a s u i t a b l e f a c i l i t y o r
23 one t h a t I f e l t was s u i t a b l e , t o p u t her i n t o u c h w i t h t h a t
24 f a c i l i t y o r p u t t h a t f a c i l i t y i n t o u c h w i t h her and t h a t , i f
25 she deemed i t was s u i t a b l e and met a l l o f t h a t c r i t e r i a , t h e n

3 Q So you understood t h a t whether or not t h e f a c i l i t y
4 met the c r i t e r i a would be u l t i m a t e l y up t o the judge and n o t
5 t o you?
6 A C o r r e c t . A b s o l u t e l y . I t was v e r y c l e a r t h a t i t was
7 not up t o me.
8 Q D i d your son p a r t i c i p a t e i n t h i s e f f o r t t o t r y and
9 f i n d a f a c i l i t y ?
10 A No. He t a l k e d t o us about i t and we kept him i n t h e
11 l o o p . But, no, t h i s was -- I was d o i n g t h i s .
12 Q Other t h a n Narconon here i n Georgia, d i d you f i n d
13 any o t h e r f a c i l i t y t h a t met t h e requirements?
14 A No.
15 Q How l o n g d i d t h i s take? And I u n d e r s t a n d you had a
16 compressed p e r i o d o f t i m e , b u t how l o n g d i d i t t a k e t o g e t
17 t h i s done?
18 A I would t h i n k by t h e end of t h e second day, my w i f e
19 and I had p r e t t y much concluded t h a t our o n l y o p t i o n t o
2 0 recommend t o L i s a Moody was g o i n g t o be Narconon. I had
21 spoken e x t e n s i v e l y w i t h Mary R i e s e r a t t h a t time on two or
22 t h r e e o c c a s i o n s , my w i f e had f o l l o w e d up w i t h phone c a l l s t o
23 her as w e l l w i t h q u e s t i o n s and concerns she had, we had
24 checkmarked a l l o f the c r i t e r i a from t h e drug c o u r t t h a t L i s a
25 Moody had g i v e n us, and we f e l t c o n f i d e n t t h a t t h e y were a

1 s u i t a b l e c a n d i d a t e . So I c a l l e d i t i n t o L i s a Moody a t t h a t
2 t i m e and s h o r t l y t h e r e a f t e r , I b e l i e v e t h a t Mary Ri e s e r c a l l e d
3 L i s a Moody. I n f a c t , I know she d i d because Ms. Moody t o l d me
4 t h a t , and someone e l s e c a l l e d Mr. Be r r y , P a t r i c k ' s l a w y e r ,
5 from Narconon. I don't know t h a t i t was Mary R i e s e r . I t may
6 have been someone e l s e .
7 Q At some p o i n t , d i d someone from t h e drug c o u r t t e l l
8 you t h a t t h e y had de t e r m i n e d t h a t Narconon met the c r i t e r i a ?
9 A The drug c o u r t a d m i n i s t r a t o r L i s a Moody c a l l e d me
10 up, a f t e r maybe two or t h r e e days and s a i d t h a t i t had met t h e
11 c r i t e r i a and we needed t o get P a t r i c k e n r o l l e d i n t h e r e as
12 soon as p o s s i b l e and how f a s t c o u l d we do t h a t because she had
13 t o l e t the drug c o u r t know.
14 Q And what d i d you say?
15 A I s a i d we were p r e p a r e d t o do i t as soon as
16 p o s s i b l e . I was a c t u a l l y l e a v i n g t h a t day. I had t o leave
17 b e f o r e my son. My w i f e was a b l e t o take my son. A c t u a l l y , I
18 t h i n k on the same day I f l e w o u t , she took my son t o Georgia.
19 Q Were any of these c o n v e r s a t i o n s t h a t you had w i t h
2 0 anybody a t Narconon r e c o r d e d i n any f a s h i o n ?
21 A They weren't r e c o r d e d by us. I c a n ' t speak f o r
2 2 Narconon.
23 Q D i d you make any k i n d o f w r i t t e n r e c o r d s about them
24 y o u r s e l f ?

6 A When was t h i s ? The f i r s t DUI?
7 Q Whenever you t h o u g h t t h a t you needed t o h i r e an
8 a t t o r n e y .
9 A I a c t u a l l y d i d n o t t h i n k P a t r i c k had a substance
10 abuse problem a t t h a t t i m e . I was l a t e r t o t h i n k t h a t t h a n my
11 w i f e was.
12 Q When d i d you f i r s t d e c i d e t h a t he had a substance
13 abuse problem?
14 A R e a l l y r i g h t when he was g o i n g i n t o Narconon, and he
15 and I had a l o n g t a l k .
16 Q T e l l me about t h a t t a l k .
17 A He j u s t i n d i c a t e d t o me t h a t he was d r i n k i n g a l l o f
18 t h e t i m e and he was d r i n k i n g vodka and a l o t o f i t , t h a t he
19 c o u l d n ' t g e t a handle on i t , and he was v e r y much l o o k i n g
2 0 f o r w a r d t o g o i n g t o t h i s program t o get on t o p o f i t .
2 1 Q You d i d n ' t t h i n k t h e r e was a pr o b l e m a f t e r he was
22 suspended f r o m school?
23 A A c t u a l l y , no, I d i d n ' t . He was a s i x t e e n year o l d
24 - - h e was d r i n k i n g when he was s i x t e e n -- and I d i d n ' t t h i n k
25 t h a t t h a t was t h a t i n c r e d i b l y u n u s u a l i n h i s s c h o o l o r i n any

1 A Yes, he was. He had a s m a l l amount of c o c a i n e i n
2 h i s c a r .
3 Q And t h e n i n 2007, b e f o r e he went t o Narconon, he was
4 a r r e s t e d f o r d r i v i n g under the i n f l u e n c e ?
5 A That's c o r r e c t .
6 Q And t h e n i n 2008 i s when he r e f u s e d t o take t h e
7 t e s t ?
8 A C o r r e c t . No. I n 2007. I n 2007 he r e f u s e d t o t a k e
9 the t e s t . 2008. Excuse me. Yes; e a r l y 2008.
10 Q So you c a l l e d Ms. Rieser and you t a l k e d t o her about
11 what you u n d e r s t o o d Ms. Moody t o l d you the c o u r t r e q u i r e m e n t s
12 were. Did you have a n y t h i n g i n w r i t i n g from t h e c o u r t a t t h a t
13 time?
14 A As I s a i d b e f o r e , no, I d i d n o t .
15 Q You d i d n ' t ask f o r a n y t h i n g ?
16 A No, I d i d n o t . I t o t a l l y t r u s t e d Ms. Moody. She
17 was v e r y competent, c o u r t e o u s , and p r o f e s s i o n a l w i t h me.
18 Q D i d you have any c o n v e r s a t i o n s w i t h Ms. Rieser,
19 o t h e r t h a n t h i s f i r s t one, when you t o l d her what you
2 0 u n d e r s t o o d t h e r e q u i r e m e n t s were?
21 A Yeah. I c a l l e d her back and t a l k e d a l i t t l e b i t
22 about t h e program and how f a s t we c o u l d get P a t r i c k e n r o l l e d .
23 Of course, we t a l k e d about t h e cost and the payment and we d i d
24 t a l k about t h e b r o a d e r aspects of t h e t r e a t m e n t and the
25 program. She t a l k e d about t h e m e d i c a l e x a m i n a t i o n as a

1 p r e l i m i n a r y f o l l o w e d by some sauna o r f o l l o w e d by, I t h i n k
2 v i t a m i n i n t a k e ' w i t h t h e sauna and then a p e r i o d o f d a i l y
3 c o u n s e l i n g and l e a r n i n g .
4 Q What d i d you u n d e r s t a n d t h e g o a l o f the program was?
5 A The g o a l of t h e program was t o h e l p change
6 l i f e s t y l e s , t e a c h the p a t i e n t s t o be able t o cope w i t h l i f e
7 w i t h o u t r e l y i n g on substances and t o be b e t t e r a b l e t o
8 i n t e g r a t e i n s o c i e t y and not abuse the v a r i o u s substances,
9 whatever t h e y were.
10 Q Who had t o change the l i f e s t y l e ?
11 A The s t u d e n t s had t o change t h e i r l i f e s t y l e .
12 Q D i d you t a l k t o Ms. R i e s e r about s e c u r i t y ?
13 A I d i d n ' t ever use the t e r m " s e c u r i t y . " What I used
14 i s i s t h i s an i n p a t i e n t program. And she was v e r y c l e a r t h a t
15 i t was and t h a t i t would be no pro b l e m s a t i s f y i n g t h e
16 r e q u i r e m e n t s o f t h e F l o r i d a Drug Cou r t .
17 Q What d i d you u n d e r s t a n d -- W e l l , you t o l d me t h a t
18 you u n d e r s t o o d t h a t i n p a t i e n t meant t h a t t h e y would l i v e a t
19 t he f a c i l i t y ?
2 0 A Yes.
2 1 Q Was t h e r e any reason, o t h e r than you und e r s t o o d i t
2 2 was a r e q u i r e m e n t of t h e drug c o u r t , t h a t you wanted a program
23 t h a t was i n p a t i e n t ?
24 A I wanted t h a t because t h a t was t h e re q u i r e m e n t s of
25 the drug c o u r t , p r i m a r i l y . My w i f e , more so tha n me but me as

2 P a t r i c k needed h e l p and he wasn't g o i n g t o be a b l e t o g e t i t
3 i n an u n s u p e r v i s e d manner.
4 Q What k i n d o f s u p e r v i s i o n d i d you expect?
5 A I d i d n ' t know. And I asked Ms. R i e s e r what t h e y
6 had, and she t o l d me t h e y engaged t h e s e r v i c e s of a p r i v a t e
7 company. I d i d n ' t know i f i t was a p r i v a t e s e c u r i t y company
8 but a p r i v a t e company t h a t managed t h e i r r e s i d e n c e f o r them
9 and ensured t h a t t h e s t u d e n t s , as t h e y were c a l l e d , were
10 c o m p l e t e l y s u p e r v i s e d a t a l l t i m e s , t h a t t h e y weren't a l l o w e d
11 t o go anywhere w i t h o u t s u p e r v i s i o n , t h e y weren't a l l o w e d t o
12 b r i n g p e o p l e i n t o t h e ap a r t m e n t s w i t h o u t s u p e r v i s i o n , t h e
13 apartments were c o n t i n u a l l y checked by t h i s s e c u r i t y company
14 t h a t was engaged on t h e i r b e h a l f -- o r s e c u r i t y company
15 excuse me -- t h i s p r i v a t e company t h a t was engaged on t h e i r
16 b e h a l f , and t h a t t h e company ensured t h e w e l l - b e i n g and t h e
17 w e l f a r e o f t h e s t u d e n t s when t h e y were n o t i n t h e program, and
18 t h a t , when t h e y moved fr o m t h e t r e a t m e n t f a c i l i t y o r t h e
19 c l a s s r o o m f a c i l i t y t o t h e r e s i d e n c e , t h a t t h e y were moved i n a
20 bus c o l l e c t i v e l y , t h a t t h e y were t a k e n i n t h e i r rooms
21 c o l l e c t i v e l y , and t h e y d i d n ' t come o u t and go anywhere w i t h o u t
22 s u p e r v i s i o n .
23 Q D i d you u n d e r s t a n d -- T h i s p r i v a t e company, d i d you
24 u n d e r s t a n d t h a t t h e y were armed s e c u r i t y guards?
25 A No, I d i d n o t .

6 A W e l l , I don't know how t h e y were t o know. I t h i n k
7 t h e r e ' s p r o b a b l y a g e n e r a l a s sumption by most p e o p l e t h a t p u t
8 t h e i r c h i l d r e n o r p a t i e n t s i n t o a program t h a t t h e y ' r e g o i n g
9 t o be w e l l c a r e d f o r . And i f t h e y p u t t h e i r c h i l d r e n o r
10 p a t i e n t s i n t o a substance abuse program t h a t t h e y a r e n o t
11 g o i n g t o have access t o drugs o r a l c o h o l o r any substance.
12 Q I f you t h o u g h t t h a t P a t r i c k was so unable t o c o n t r o l
13 h i s own i m p u l s e s o r r e s t r a i n h i m s e l f t o t h e e x t e n t t h a t h i s
14 l i f e would be a t r i s k , why d i d n ' t you j u s t p u t him i n t h e j a i l
15 program?
16 A Because we were w o r k i n g as a f a m i l y t o t r y and work
17 w i t h P a t r i c k and get h i s l i f e i n o r d e r and we were a b s o l u t e l y
18 c o n v i n c e d by our a t t o r n e y t h a t t h e j a i l program was a n y t h i n g
19 b u t p r o d u c t i v e . And we were h o p i n g t h a t t h e t i m e a t Narconon
2 0 would be p r o d u c t i v e and so was P a t r i c k . He went t h e r e w i t h an
21 e x c e l l e n t a t t i t u d e .
22 Q D i d you communicate t o Narconon or t o anybody i n t h e
23 Delgado A p a r t m e n t s your c o n v i c t i o n t h a t P a t r i c k had t o be
